- 0:36passionate about the industry, this is the place to build
- 0:40confidence, share experiences, and stay informed.
- 0:45Join us as we tackle the challenges, celebrate the winds
- 0:50and drive forward. Hello everybody, I'm Trucker
- 0:59mouth. Welcome to the underground
- 1:01studio and we're back on the road.
- 1:04All right, so now it's beginning the start of the Labor Day
- 1:10weekend and it's nice out. It's going to be nice for I live
- 1:19out anyway and I got trucker Mouth got some money so you can
- 1:24have a good weekend. But all right, so I noticed
- 1:28watching my podcast and I used to watch my podcast on YouTube
- 1:35TV. You'll find it under trucker
- 1:38mouth. Go to YouTube TV and search
- 1:40trucker mouth and you know my podcasts will come up.
- 1:45I used to watch YouTube TV, but since the asshole up around the
- 1:48corner kicked me off of his YouTube, I can't do that
- 1:53anymore. But I noticed by watching that
- 1:56sometimes have a hard time understanding me when I'm
- 2:00talking. So I'm going to try to talk
- 2:04slower. Today's topic is predatory
- 2:12towing. OK wrecker, OK wrecker, a
- 2:17driver's paycheck. And I mean, you know, these guys
- 2:22are ruthless out there. So let's get going with us.
- 2:28Checkers hit by huge towing bills could soon catch a break.
- 2:31Cater A lot of states are cracking down on this because
- 2:35it's just just ridiculous. And, you know, you're out there
- 2:39and you're in the crunch area. You're trying to find a place to
- 2:41park. It's kind of hard sometimes.
- 2:47A lot of places are are, you know, posted, you know, no truck
- 2:52parking, no truck parking you it might be industrial park, big
- 2:56Hughes industrial park, big wide roads, but it'll be boats, no
- 2:59truck parking. Why?
- 3:03I don't know why. So that's when these predatory
- 3:06towing companies, I got some stories here, so listen to this.
- 3:10So for many truckers, a tow just doesn't ruin your day.
- 3:14You can eat up a paycheck. That's why a lot of states are
- 3:18fighting back against this, praying on truckers.
- 3:22My employee. From Connecticut to Utah,
- 3:25lawmakers are passing new protection to stop bad actors
- 3:28from cashing on drivers when they have no choice.
- 3:32The LIDDA has led the push work on states to get fair towing
- 3:38rules on the books. So there's a lot of people
- 3:41trying to get this predatory towing, you know, hit them back.
- 3:51Utah has approved new protection for, I'm going to read some of
- 3:56what different states have did. So in Utah, the law clearly
- 3:59separates recovery work from recovery towing.
- 4:02It also requires commercial insurance policies to cover
- 4:05recovery costs. So they want the commercial
- 4:08insurance that the truck has to cover the recovery costs and not
- 4:14the driver. And that's just great.
- 4:17I mean, see what I did this week?
- 4:20I did something different instead of writing everything
- 4:22down. And a lot of times I can't read
- 4:24my writing or understand what it means.
- 4:26Sometimes I I typed, I got it printed out, I went to the
- 4:30library. I don't have a printer yet.
- 4:33Went to the library and printed a bunch.
- 4:36Pick cost me $7.25 and I printed out a lot more than I probably
- 4:40needed. But I can't do that all the
- 4:42time. Sometimes come with a happy
- 4:44meet. In between writing stuff down, I
- 4:46want to do my research or getting it printed out.
- 4:50Oh yeah. So 1/3 of recovery companies
- 5:01proposing Republican Kathy Kristofferson, a Republican Leia
- 5:07said nearly 1/3 of recovery companies must post a bond while
- 5:11this disagreements are worked out and part of payment must be
- 5:14made-up front. So to make these towing
- 5:18companies, this is still Utah, post a bond.
- 5:24You got to put the money up front to fight, you know, while
- 5:27this what is being worked out, what is this agreement being
- 5:31worked out? Towing companies that charge
- 5:32more than their posted rates could lose their right to
- 5:35collect payment. That's the Utah Trucking
- 5:40Association supports the law, which takes effect May of 2027
- 5:45Arizona in Arizona Arizona lawmakers are taking name at
- 5:49predatory towing after many drivers were hit with outrageous
- 5:52fees in Arizona here. So we got a bill HB23O5 would
- 6:01create one set of towing rules for entire state cities and
- 6:04counties will no longer be able to set their own towing rates
- 6:07for vehicles removed from private property.
- 6:13Towing companies would have to take photos of the vehicle or
- 6:18video of the of violation and notify law enforcement within
- 6:21one hour. So they got to take pictures now
- 6:24in Arizona and notify law enforcement that they're going,
- 6:27they're going to do that. OK, Arizona finally got a spot.
- 6:36We're going to put them in the predatory tone in the state.
- 6:47That bill right now is on the governor's desk at HB23O5 S
- 6:52North Carolina and North Carolina, they say, is the Wild
- 6:55West of towing. That there's been so many so
- 6:59much so much unfair towing for drivers in North Carolina that
- 7:04they call it the Wild West of of freaking towing.
- 7:08One of the biggest changes since December 1st.
- 7:10Tower Appliance can no longer in North Carolina.
- 7:15They can no longer put a boot on a truck for for parking.
- 7:19They were booting trucks. They must have big boots like
- 7:23cars. I never got booted in my car or
- 7:26nothing. Yeah, they can no longer boot a
- 7:29truck. The laws protects valuable cargo
- 7:35after a non essential or government order.
- 7:37Tow companies must quickly return commercial cargo when a
- 7:40driver or a cargo owner asks for it.
- 7:44Now they're allowed to do a trailer swap if they impound.
- 7:46If they tow your shit and you're in their impound a lot that that
- 7:49you're allowed to swap trailers out so you can get your freight
- 7:53as long as the trailer's no more than five years older than
- 7:56original and in decent shape. Doug Morris is of OIDA director
- 8:10of State Government Affairs, said most towing companies do
- 8:12the job right. But he said a small number of
- 8:14bad actors give the entire industry a black eye.
- 8:18And that's pretty much what any within the industry.
- 8:24Couple of bad actors give it a bad name.
- 8:29So they were also in North Carolina.
- 8:33They would license towing companies, and they would have a
- 8:36cap for towing, storage, booting and cargo handling.
- 8:40The group would also investigate public complaints.
- 8:46So this is just so here, here we go with this.
- 8:51So 1 driver's here, here, here's a story here.
- 8:55One of the stories I was talking about one of the drivers 30
- 9:00minutes over truck parking limit cost the driver $9000.
- 9:04Nationwide truck parking shortage left drivers vulnerable
- 9:06to people who take advantage of of situations. 1 driver's $9000
- 9:12towing bill highlights the problem and another prayer to
- 9:15our towing that's just terrible for a driver.
- 9:23Truck driver is faced with two battles and looking for a place
- 9:25to park. First the truck parking spot and
- 9:29the second is the race against the clock.
- 9:31You're going to have to drive 11 hours a day and you got that
- 9:34meal DS once that 11 hour comes up, man, you got you got to you
- 9:39got to shut down or I think the the truck will shut down.
- 9:44Not sure how that worked. I'm pretty sure he didn't shut
- 9:46down. The truckers are forced to stop
- 9:49wherever whenever the clock went out.
- 9:51Look, I just said so. Lack of truck parking is
- 9:53starting to cost professional drivers money.
- 9:55In addition, the more property owners charging for parking
- 9:59spots, the more property owners are charging for parking spots
- 10:03out there now that were once free.
- 10:06Some towing companies are pouncing on trucks parked
- 10:08illegal and charging massive fees.
- 10:12Bastards, sneaky bastards at that you know, praying on on a
- 10:17truck driver who's living out of a freaking walk in closet and
- 10:20he's got that's just another thing that's just another thing
- 10:23out there. Memphis, TN A1's towing was
- 10:26ordered not to touch certain trucks after three trucking
- 10:28companies sued their asses in north in in Charlotte, NC.
- 10:33The state attorney general sued A1 and you know they were, they
- 10:43were told not to touch Western Express and Birmingham AL based
- 10:50church transportation. MHT and Birmingham AL's based
- 10:54church transportation. So this A1's A1 and he, he's a
- 10:59sneaky bastard right here. This guy here, this A1 towing
- 11:02out out of out of Memphis for years.
- 11:08For years drivers stopped at Memphis area have complained
- 11:11about one infamous towing company practice of towing.
- 11:17Towing it would be parked trucks A1's towing and hauling.
- 11:21Although the name is nearly identical to sharded towing
- 11:23company, the Memphis company is not related.
- 11:25So that one that prick down there in Shard, it has name just
- 11:29like app. But they're not, they're not the
- 11:31same company. So the center in operation is
- 11:33Colton Ahmad Kathy, owner of several companies, including S
- 11:37Line and A1 Towing. This is the story here.
- 11:40These these bastards here. So Colton Ahmad Kathy is the
- 11:47owner of so including S Line and A1 Towing.
- 11:53S Line is a company providing security and parking services.
- 11:58So they walk these lots, make sure people in parked illegal.
- 12:03They would direct A1's towing to boot or totally be parked trucks
- 12:07and hold them for ransom. So see his, he has two
- 12:10companies, he has the security for these lots and he's got A1
- 12:14towing and they were annoying the security truck.
- 12:17The security end of that of his companies.
- 12:20Kathy's companies would would would set drivers up and call
- 12:28A1. Trump companies claimed that
- 12:29Kathy's companies territory lured and entrapped truck
- 12:32drivers and would illegally harassed, intimidate, assault,
- 12:37batter, hijack and or hold hostage trucks and truck drivers
- 12:41until a ransom was paid. Harass, intimidate, assault,
- 12:45batter, hijacked and or hold hostage trucks and truck drivers
- 12:49until a ransom was paid. Ambassador esalon contracted
- 12:54with gas stations, truck stops and paid parking lots frequented
- 13:00by by truck drivers. So S line would either give the
- 13:04appearance of open parking by felony to they didn't, they
- 13:08didn't post the lots right this line.
- 13:11They didn't post the lots and then the trucks will pull in
- 13:14there and drive and leave wherever for an hour or whatever
- 13:18the case may be. Go to sleep, then call A1 towing
- 13:22up because that's the same company.
- 13:26This line contract gas station trucks stop and paid parking
- 13:29lots frequent by truck drivers. So then I would give the
- 13:32appearance of open parking by family to post property as
- 13:36private or off limits to truck parking.
- 13:38In some cases A1's telling would go after illegally parked
- 13:42trucks. A1's telling would go after
- 13:45legally parked trucks in some cases.
- 13:48Other cases about telling trucks despite the driver having paid
- 13:52for the spot. So even though a driver paid for
- 13:54a spot, they were still telling her towing their truck and
- 13:57trailer away. Well, that's, that's something
- 14:01there. So according to to the lawsuit,
- 14:08anyone's towing would literally truck trucks and lots with their
- 14:11vehicles or dismantle of a victim's truck.
- 14:16Tow workers proceed to use force through intimidation,
- 14:20bulletproof vests, guns and badges.
- 14:21So these, so these guys, these security guys are walking around
- 14:26tow workers. OK.
- 14:28The tow workers are walk around bulletproof vests, guns and
- 14:31badges. The tow workers are because
- 14:33they're doing sneaky shit, people trying to stop them
- 14:37walking, looking like cops trying to bodily harm or
- 14:39outright assault and battery when towing a truck or demanding
- 14:42up to thousands of dollars. He's towing companies are Oh,
- 14:49and one example truck drive was booted at 5510.
- 14:52He should be driving Memphis by anyone's towing.
- 14:54This is in Memphis now. The driver was not given the
- 14:57opportunity to pay or go before. He's not given the opportunity
- 15:01to pay. The opportunity to pay.
- 15:02The opportunity to pay. Here it goes.
- 15:04I know you couldn't understand that, probably.
- 15:06Or go before being towed. A violation city ordinance,
- 15:11state law. After being instructed to stay
- 15:12inside the truck, the driver called Memphis police who could
- 15:15not do anything since the incident was on private
- 15:17property. So the trucking company ended up
- 15:24buying a 2 day parking through S line.
- 15:27OK, that's the security that that this Cathy owns and the
- 15:32same one owns that A1 Towing. So the truck company ended up
- 15:35buying 2 day parking through S line so the driver could get
- 15:38some rest in the sleeper berth. A1's telling employees then
- 15:42begin honking horns and rocking the truck to keep the trucker
- 15:46awake. This is the tow company.
- 15:49This time Memphis Police told the tow workers to stop after
- 15:53after police left, the harassment resumed.
- 16:00I'll tell you what, this this a one out of Memphis.
- 16:06Chuck em out. Don't like you?
- 16:07He's putting a hammer down on you.
- 16:10OK Chuck em out. Don't like you.
- 16:12A 1 Kathy predatory towing on on drivers putting a hammer down
- 16:19anymore next morning Trump coming out for the truck.
- 16:23The next morning the truck coming out for 7500 hours to
- 16:26release the truck which everyone's telling refused.
- 16:29So this this this towing company refused to let the truck go and
- 16:34then when they were out they were going to pay 7500 hours to
- 16:36release the truck. After members, police and Shelby
- 16:39County Sheriff's obviously determined nothing could be
- 16:41done, the Tennessee Tennessee Highway Patrol stepped in and
- 16:46got involved. Once they arrived, 2 employees
- 16:50fled the scene. Highway Patrol left the truck
- 16:52driver cut the boot off so they know they were sneaky bastards.
- 16:56Tennessee Highway Patrol five days later in their truck driver
- 17:00from the same carrier paid for parking at Capital Fuel Truck
- 17:03Stop in West Memphis, AR. Now West Memphis AR pretty a
- 17:07pretty that's a pretty shady area.
- 17:10OK, I stayed in West Memphis and the Flying J there also it was
- 17:17there's a few truck stops in West Memphis right there on 40.
- 17:23I stayed already in West Memphis at a greyhound.
- 17:26There's a greyhound track here in West Memphis, casino and all
- 17:30instead of instead of horses, instead of horses, it it's it's
- 17:33instead of horses, it's it's greyhound track.
- 17:36Big part. You're not parking with trucks.
- 17:37I don't know. Yeah.
- 17:42So five days later and their truck driver paid for parking
- 17:45and capital fuel truck in West Martin or West Memphis, AR
- 17:48Sorry, I'm tongue tied. I noticed that unbeknownst to
- 17:51him, the lot was also operated by S line.
- 17:54A similar situation played out including a one's towing
- 17:57humanity $3000 and removed the boot.
- 18:01They were they were doing this to they're just playing praying
- 18:04on trucks. Just praying on truck drivers.
- 18:07That's what I call a predatory towing.
- 18:09The trucker mouth don't like it. He put the hammer down on them
- 18:11already. Anyone's telling no touch order.
- 18:19So according to court documents, A1's telling it's prohibited.
- 18:25According to court doctors, A1's telling it's prohibited from
- 18:28ticketing, booting, towing, driving spring, or otherwise
- 18:31touching a truck owned by the plaintiff companies.
- 18:35So they sued this bastard and may not touch them no more.
- 18:40So Additionally, Kathy's companies, Kathy's, the guy who
- 18:44owns S S Line and A1 Towing must provide these carriers with a
- 18:51list of all the locations they operate or service.
- 18:56They must also provide information on any new locations
- 18:58that may acquire parking rules that that they may acquire.
- 19:02So they're, they, they got to give these companies that, that
- 19:05have a lawsuit against them, a list of all the places that they
- 19:09have security at. It's S Line, Kathy's companies
- 19:14lawsuits, A1 Towing. Oh, so I'm going to take an
- 19:24effort for the boys. OK, A1's history, towing history
- 19:28of complaints. Here's A1 still here.
- 19:32This isn't A1's first run in with the law.
- 19:34Since 2022, Tennessee Attorney General, Division of Consumer
- 19:38Affairs has received numerous complaints about a one's towing
- 19:42at the local level. The city of Memphis
- 19:44investigation, prompted by nearly a dozen complaints from
- 19:49truckers across the country founding their towing company
- 19:56violated city ordinance. Subsequently, the city suspended
- 20:00its towing and booting permits in September 2023 to under a
- 20:06Shell. A Shell truck stop off
- 20:08Interstate 40 in Fayette County, Tennessee, was granted an
- 20:11emergency injunction for hearing A1's towing from entering the
- 20:14property after they're illegally booted and towed trucks multiple
- 20:18times. This is a truck stop.
- 20:21I never and anyone was coming in there and.
- 20:24And towing trucks, booting and towing trucks, truck stop under,
- 20:27said the unauthorized who's caused substantial harm to his
- 20:30business. Well, I'll tell you, Oh, man.
- 20:37So we're OK. So we're not going to do a we're
- 20:51going to not do a commercial today, I guess because I've been
- 20:54reading here. Like I said, I printed this
- 20:56stuff out instead of writing it down.
- 20:58I printed it out. But this, this A1, he's got to
- 21:02be shut down. Trucker mouth already.
- 21:04Put the hammer down on him. Kathy, I don't like you like
- 21:09smashing the head with a hammer. All right, so one token wreck, a
- 21:15trucker's paycheck. The truck is gone.
- 21:19The bill keeps growing. States are now moving to stop
- 21:22towing companies from turning roadside trouble into financial
- 21:25trap. And from North Carolina to
- 21:28Arizona, lawmakers are making new rules to stop unfair towing
- 21:31practices. Pennsylvania.
- 21:34Now that's where I'm at. Pennsylvania.
- 21:38Pennsylvania. You know what, Kathy?
- 21:50Thank you bastard. We just do that Kathy shooting
- 21:56like that. Pennsylvania has taken aim at
- 22:01predatory towing. New law sets statewide rules for
- 22:04towing companies and storage lots.
- 22:06It also creates criminal penalties for operators who
- 22:08break the rules. The rule covers trucks and other
- 22:11vehicles. The overwhelming majority of
- 22:14towing companies are honest, professional, hard workers with
- 22:19would provide an important service, said Senator Sheriff
- 22:24Sheriff St. Democrat Philadelphia
- 22:26legislation is aimed at the small number of bad actors whose
- 22:31practices hurt consumers and damaged reputation.
- 22:33Industry tone companies and storage facilities must also
- 22:37tell drivers where the vehicle was taken and how to get it
- 22:40back. Tone companies also cannot
- 22:44simply shut up, show up and tow a vehicle on their own.
- 22:47The tow must be requested by the vehicle's owner, operator or law
- 22:52enforcement or another authorized or another authorized
- 22:55official. So they're really cracking down
- 22:59here in PA too. Enforcement will no longer fall
- 23:01on the attorney general's office, OK.
- 23:06State and local police will also be allowed to enforce the rules.
- 23:10The Pennsylvania Motor Truck Association said that the new
- 23:14law creates clear rules for what happens after the vehicle is
- 23:17towed. Violators could face fines
- 23:21ranging from 750 to $5000. So Pennsylvania's really
- 23:25cracking down on bastard's tow total company store facility can
- 23:29also have his truck impounded. The truck would stay.
- 23:32Yeah, they're going to impound the The Wreckers.
- 23:36They're going to impound his shit.
- 23:39He's got to pay a big, big money to get it out $755,000.
- 23:52Everyone's towing now. I guess he reached the
- 23:55settlement with I guess he reached the settlement with a
- 24:00trio of trunk companies in federal laws in a federal
- 24:02lawsuit. OK, he put in one of the most
- 24:07notorious towing companies in in the Memphis, TN area on notice
- 24:11again. So I really want to add to this
- 24:13prick this, this Cathy, this guy knows what he wanted that that's
- 24:19line. Predatory towing has been issued
- 24:23for truck drivers across the country.
- 24:27Despite state and local status, predatory towing persists.
- 24:32Everybody's, everybody's tries to prey on the truck driver, you
- 24:36know, breaking in their trucks, stealing stuff, you know,
- 24:38impounding their trucks. I mean, everybody's out to get
- 24:42the truck driver, man. You've really got to watch it
- 24:44out there. And if drivers, if you see
- 24:46something going on, unite. I meant to say this earlier, if
- 24:51you're out there Rd. drivers, you see something going on, you
- 24:54know, there's unite, you know, and do something about it.
- 25:05You know, I always under the impression, you know, like, so
- 25:07when I was a kid, I always wanted to be a road truck
- 25:09driver. You know, I thought there was
- 25:12this big, this big allegiance out there between truck drivers.
- 25:16And you know, I found that that's pretty much a myth.
- 25:22That's pretty much a myth. I mean, everybody's kind of
- 25:25looking out for yourself out there.
- 25:26But Rd. drivers, you need to get unionized, well, unionized.
- 25:32And I mean look out for each other, have each other's back,
- 25:35make this industry great again. Yep.
- 25:41Spike state and local status. Predatory towing.
- 25:44They'll persist, forcing trucking companies to resort to
- 25:47legal action. Sharded again.
- 25:50There's an A1 down there that says not affiliated with one in
- 25:52Memphis. Resorted to pay $30,000 and had
- 25:55to be restricted on how it conducts business.
- 26:02Local media has sharded the short.
- 26:06North Carolina are being the Wild West of towing.
- 26:09It's played attention to the issue.
- 26:10Predatory towing appears to be alive and well in the city.
- 26:15According according to the WSOCTV report, a truck driver
- 26:21was hit with a $9000 towing bill.
- 26:23Averaged just 30 minutes past the parking limit, 30 minutes
- 26:27past the limit. So obviously they were, they're
- 26:29sitting there waiting on these, on these, they're sitting there
- 26:35waiting for their time to run up and to run and, and snagging
- 26:38them up and, and, and, and telling them, oh, man.
- 26:46This includes $7000 for impound towing, $1500 for gate
- 26:51administration and firing hours for storage for one day.
- 26:55Footage from local reports shows signs for shorted travel plazas.
- 26:59This is the short North Carolina again located on Sunset Rd.
- 27:02right off Interstate 77. A sign located at the entrance
- 27:05of the truck parking lot of states that all similar trucks
- 27:07want to sign in inside the store and be in a designated parking
- 27:12spot, and trucks are allowed to park for two days once you sign
- 27:18in. So I guess the guy was signed
- 27:20in, up in there signing in and they came and grabbed his shit.
- 27:29All right, I'm not sure, but also on sign, also on that sign,
- 27:34there's a they have a breakdown there.
- 27:36Shit, $3500 impound fee. OK, $35 for vehicles that rate
- 27:411000 lbs. Thirty $500 impound fee, 3500
- 27:46for vehicles that rate 1000 lbs up to $2500 boot fee up to $1500
- 27:51special equipment fee, the $750 gate administration fee.
- 27:59Driver told WSOCTV that the incident happened one day after
- 28:02a historic snowstorm. At the time the area was under
- 28:04state of emergency. So I mean, you know, historic
- 28:08snowstorm you got you got to park there probably was that
- 28:16made it way worse. So he was probably parking where
- 28:18he could to go sign in and they snagged his shit.
- 28:21This may be a one off situation and so should be approached from
- 28:25April 2025. One driver warned about
- 28:28Chartered Travel Plaza and Predatory Towing and what
- 28:31appears to be a dispatch screenshot.
- 28:33Drivers were alerted to several trucks being towed with bills
- 28:36over $10,000. Boy, they're just, they're just
- 28:45doing anything they can. So now we're going to go to the
- 28:50to the to the to the issue with truck stops, which the lack of
- 28:53truck stops across the nation is a serious issue.
- 28:56OK. There's a lot of areas they
- 29:00don't have enough truck stops out there.
- 29:02There's not enough parking. I did a story the other day
- 29:04where it said what it was. There's one truck spot in trucks
- 29:10in truck. There's one truck spot for every
- 29:1311 drivers out there. Yeah, lack of truck stops across
- 29:20the nation, serious issue. It really is rule is research
- 29:26has had many problems with truck stops availability.
- 29:28These issues worsened during emergencies.
- 29:30Yeah. And water's better.
- 29:30Everybody wants to be in the truck stop.
- 29:32They want to be in there getting a shower and stuff like that
- 29:34There. This is rule band where roads
- 29:36are shut down everybody. Then you got you want to be at a
- 29:38truck stop so you can. Yeah.
- 29:41You understand that? No stakeholders in the trucking
- 29:50ecosystem have a clean obligation to provide humane
- 29:52treatment or sufficient infrastructure.
- 29:55So these guys, you know, people are looking for a a, a safe
- 29:58place to park. I mean, it has good amenities
- 30:01like a restaurant, you know, clean showers somewhere you can,
- 30:05you know, fill a little bit of of relaxation and like, you
- 30:10know, being at home con and out of your truck.
- 30:14So all right, well, we're I'm about out of time and this this
- 30:22truck stop thing is going to be in their show.
- 30:24I think it's going to be part of another show next week.
- 30:29I'm going to do the the highway bill Next week is going to be
- 30:34the yeah, the highway bill and on truck stops.
