Transcript
- 0:00This is Scott Becker with the Becker's Healthcare
- 0:03Podcast.
- 0:04Today for me is a is a is
- 0:05a great day because I get to interview
- 0:07today
- 0:08two of the brightest people that I get
- 0:10to talk to regularly.
- 0:12Today on the Becker's Healthcare Podcast, I get
- 0:14to talk to Jacob Emerson.
- 0:16Jacob follows the payer arena and is literally
- 0:19one of the most gifted people I get
- 0:20to visit with. I also later today get
- 0:22to visit with an extremely gifted person.
- 0:25But that person, he has a huge ego,
- 0:27so I'm not gonna say his name out
- 0:29loud right now. But Jacob is able to
- 0:31keep his ego in check and also super
- 0:33bright, so we'll mention it out loud. Jacob,
- 0:36tell us what's going on in the payer
- 0:37world currently. What are some of the stories
- 0:39that you're watching closely?
- 0:41Yeah. Hey, Scott. I I appreciate the kind
- 0:43words.
- 0:44So I think to start us off,
- 0:47just within this last week,
- 0:49we got CMS's
- 0:51final Medicare Advantage rule for 2027
- 0:54along with their separate final rate announcement for
- 0:57how much, the government is going to be
- 0:59raising how much they pay Medicare Advantage Plans
- 1:02going to, 2027.
- 1:04So some interesting updates there and just also
- 1:07some interesting policy updates and what it means
- 1:09politically and and, you know, contextually for the
- 1:11industry in terms of, how the administration overall
- 1:14is thinking about private Medicare.
- 1:16And then some some updates around prior authorization,
- 1:20you know, everyone's favorite term that causes a
- 1:23lot of headaches for I would honestly argue
- 1:25for both sides for both the insurance companies
- 1:27and providers, but certainly, I think more for
- 1:29the providers.
- 1:30Just some updates there around policy two, both
- 1:33from CMS and then some voluntary
- 1:35promises from the industry, from the insurance industry,
- 1:38and some of the progress that they say
- 1:40they've made on this on this challenge recently.
- 1:43So Medicare Advantage and prior authorization. And and
- 1:46talk about Medicare Advantage rates. I saw it
- 1:48registered. I think they went up 2.48%
- 1:50or something, but tell me what's going on
- 1:52there and what that means. Is the payer
- 1:53industry thrilled with that, not thrilled with that?
- 1:55Where does it look? What what do other
- 1:57people think? Give us some of your thoughts.
- 1:59I mean, I think they're they're thrilled with
- 2:02it compared to what it could have been,
- 2:04which was essentially flat,
- 2:06compared to last year. So so on that
- 2:09front, it's good. But I think also compared
- 2:11to years
- 2:12past or last year,
- 2:14it's it's about half of what they got
- 2:16last year in terms of a dollar amount
- 2:18overall. So, you know, I think happy ish
- 2:21is a good way to say it.
- 2:22I think overall in terms of what the
- 2:25policy, like, the final rule and the the
- 2:27payment rate combined tells
- 2:29us is that, you know, this is gonna
- 2:31be the dominant delivery model for Medicare moving
- 2:33forward. The government is still all in on
- 2:35Medicare Advantage. There's nothing, you know, there's nothing
- 2:37that's changed there. I know there's a lot
- 2:38of rhetoric that goes around in the industry,
- 2:40but, you know, it's full steam ahead with
- 2:42Medicare Advantage.
- 2:43I think that that's really an important point
- 2:45because as much as health systems
- 2:47seem to really not love and as much
- 2:50as physicians are not loving Medicare Advantage,
- 2:53when you look at o b three
- 2:55and you look at what's going on with
- 2:56Medicare Advantage and still at fifty four percent
- 2:59or so, I don't know what the exact
- 3:00number is right now enrolled in Medicare Advantage.
- 3:03Yeah. It it it seems like that is
- 3:05just where we're going whether we like it
- 3:07or not. Yeah. And I mean, one thing,
- 3:09you know, I I,
- 3:11I often talk to doctor Sachin Jain at
- 3:13SCAM Group who used to be at CMS,
- 3:14used to be at some of the big
- 3:15insurers.
- 3:16He's, you know, he's a very smart industry
- 3:19leader and about some of these tensions with
- 3:21MA and health systems,
- 3:23because it's a very real thing. A lot
- 3:24of health systems are not contracting with a
- 3:26lot of the bigger MA plans anymore because
- 3:28of all these issues with them getting paid
- 3:30and things like that.
- 3:31But he always says to me, you know,
- 3:33at the end of the day, Medicare Advantage
- 3:35provides cheaper care
- 3:36in people on low incomes are on these
- 3:38plans,
- 3:39on very fixed incomes as seniors.
- 3:41And, you know, at the end of the
- 3:43day, Medicare doesn't provide hearing,
- 3:45dental, vision benefits.
- 3:47And if you want those benefits when you
- 3:48have original Medicare, you have to pay a
- 3:50lot more for a supplement plan.
- 3:52So, you know, Medicare Advantage does provide better
- 3:55benefits overall even if it's a headache for
- 3:58providers sometimes to get paid,
- 4:00you know, for providing those services. So I
- 4:02think that's No. No. No. He he has
- 4:04a bias because he's also in the managed
- 4:06care Medicare business. Absolutely. And and and and
- 4:09some would argue that the reality is, yes,
- 4:11there's these other benefits, but the track record
- 4:14so far is it's costing Medicare
- 4:16more than traditional Medicare, not less. So you
- 4:19talk about so so this concept, and I
- 4:21I doctor Jane, Sachin Jane, is one of
- 4:23the brightest people I know. He's also one
- 4:25of the most straight shooting people I know.
- 4:27But this concept that there's a cost benefit
- 4:30to the country
- 4:31in Medicare Advantage has not played out yet.
- 4:33Yes. You know, you're absolutely correct. And I
- 4:35think, you know, diving into a little bit
- 4:38around what CMS has just done this past
- 4:41week goes directly to the heart of that,
- 4:43Scott, in terms of, you know, it costs
- 4:44more because there's a lot of,
- 4:47there's a lot of tricky
- 4:49coding that goes on, and I'm putting that's
- 4:51a I think a very polite way to
- 4:52say it. And so overall, to your point
- 4:55originally, you know, the the headline figure is
- 4:57the 2.48%
- 4:59rate increase,
- 5:00which translates to about $13,000,000,000
- 5:03more flowing to these private Medicare insurers for
- 5:062027.
- 5:08But basically and and that basically when you
- 5:11factor in risk scores over time,
- 5:13the effective increase is actually closer to 5%.
- 5:16So this is it is good news for
- 5:18MA overall, but,
- 5:20you know, they got 47,000
- 5:22comments on on on what was going on
- 5:25here because of, I think, a lot of
- 5:27the politically loaded changes that they made as
- 5:29well. And so one of these is,
- 5:33they're they're gonna be holding firm on a
- 5:35almost 6% coding pattern adjustment, which is the
- 5:38agency's way of saying, we know Medicare Advantage
- 5:41Plans systematically
- 5:43document patients as sicker than those that are
- 5:45in fee for service Medicare.
- 5:48So we're gonna be discounting payments to these
- 5:50insurers
- 5:51accordingly.
- 5:52And, you know, the insurance industry pushed back
- 5:54on this, but it's basically CMS
- 5:56signaling and saying, we're not abandoning scrutiny of
- 5:59upcoding that is making Medicare Advantage more expensive
- 6:01than Medicare
- 6:02even as even as we're increasing pay for
- 6:05next year. And the other thing that they're
- 6:07gonna be doing
- 6:08is they're gonna be keeping in the exclusion
- 6:11of diagnoses that are from unlinked chart reviews
- 6:14and
- 6:15basically that is a direct blow to to
- 6:18the the fraud and the overpayment scrutiny that
- 6:20we're also talking about. So unlinked chart reviews
- 6:23are basically when an MA plan hires coders
- 6:25to go through the patient record and add
- 6:27diagnoses that weren't actually captured
- 6:30when when the doctor or the nurse was
- 6:32in the room with the patient.
- 6:33And, you know, we've seen CMS and the
- 6:35DOJ go after plans for this even just
- 6:37this year with Kaiser, the the biggest example
- 6:40of all to date with that over $500,000,000
- 6:42settlement over over,
- 6:44upcoding, basically.
- 6:46They didn't admit to any wrongdoing, but it's
- 6:48basically
- 6:49CMS making it official that
- 6:52these diagnoses that weren't actually captured in the
- 6:54room, they don't count for risk scores that
- 6:57basically then gives the the plan more money
- 6:59from the federal government.
- 7:00So so, yes, the money's going up, on
- 7:03a percentage basis, on a, well, quantity basis
- 7:05for $13,000,000,000,
- 7:06but there's things being put in place here
- 7:08that make it very clear the federal government
- 7:10knows and is and is, responding
- 7:13to the very real upcoding and overpayment trend
- 7:16that exists in Medicare Advantage.
- 7:19Thank you very, very much.
- 7:21Jacob, talk about the pre authorization
- 7:24war and what's going on there. Yeah. So
- 7:27there's kind of two different things going on
- 7:29here. There's both
- 7:30CMS,
- 7:32parts of a rule that was enacted finalized
- 7:34back in 2024,
- 7:35parts of this rule going into effect now,
- 7:38starting in January year, starting then in March,
- 7:40and going into next year different parts of
- 7:41this rule, all basically requiring payers to,
- 7:45get better about prior auth over plans that
- 7:48CMS controls, Medicare Advantage, Medicaid, CHIP, ACA.
- 7:52Basically, they have to report publicly on all
- 7:54their websites how often they deny prior auth
- 7:56requests, how often appeals are,
- 7:59how denials are overturned by appeal,
- 8:02and then certain rules around how how quickly
- 8:04they,
- 8:05make decisions and new electronic
- 8:08requirements between the provider and the payer. So
- 8:10that's all happening. And then last year as
- 8:12well, payers, all 50
- 8:14big ones got together with CMS and basically
- 8:17announced a pledge
- 8:19that for
- 8:20employer plans, fully insured plans, the commercial stuff
- 8:24that they would also be kind of matching
- 8:26and expanding a little bit on those those
- 8:28rules that CMS put into place. Basically saying
- 8:31that they're gonna streamline and simplify prior auth,
- 8:34for for the vast majority of Americans. So
- 8:37we've got now we're starting to get back
- 8:39some of the data on how is this
- 8:40all shaking out. And
- 8:43on on the commercial side on the pledge,
- 8:45you know, again these are just promises from
- 8:47the insurance industry. So I think huge asterisk
- 8:50there.
- 8:51And then, you know, the results now is
- 8:53also coming from them through through surveys of
- 8:55health plans through AHIP, the the trade group.
- 8:57So, again, you kinda have to take some
- 8:59of this with a grain of salt, I
- 9:00will say. But they've said they've eliminated 11%
- 9:03of prior auth requirements,
- 9:04since last year,
- 9:06which, and 15%
- 9:08across Medicare Advantage Plans. Again, that's according to
- 9:11the industry based off of their own promises
- 9:14to to the government. And then in terms
- 9:16of on the CMS regulations,
- 9:19we these metrics went live across their website,
- 9:22the insurance websites on March 31,
- 9:25but there's already, you know, expert analysis being
- 9:28put out saying that it does it kinda
- 9:29like the price transparency rules that went into
- 9:31effect a few years ago that it doesn't
- 9:33offer a lot of insight to the normal
- 9:35everyday person because you can't actually see the
- 9:37reasons why prior auth requests were denied. You
- 9:39can't break it down by specific
- 9:42service categories.
- 9:43So it's kind of like the the the
- 9:45data is out there, but it's so broad,
- 9:47it's so large
- 9:49that the everyday person
- 9:51can't really use it. Kinda making some of
- 9:53these federal transparency efforts. I don't wanna say
- 9:56useless, but
- 9:57not not usable for you and I at
- 10:01least, to start. We're gonna have to have
- 10:02private companies probably wade through this data and
- 10:05transform it into more
- 10:07usable stuff,
- 10:09for for the everyday American.
- 10:11Well, isn't isn't that the truth of so
- 10:13much of this stuff that actually turning it
- 10:15into practical useful stuff Yeah. Is is very
- 10:18different than the legislative intent Yep. Or the
- 10:22policy that's put forth. I think that just
- 10:24is right on. It seems like it's always
- 10:26CMS says, you know, you've gotta put out
- 10:28your prices. This is simplifying it, but CMS
- 10:30says you gotta put out your prices. The
- 10:32insurers do to, you know, comply with the
- 10:34law,
- 10:35but, you know, those prices are hidden in
- 10:37very complicated spreadsheets that are huge that the
- 10:40normal everyday person does not have the computer
- 10:42power to process.
- 10:43So they've complied,
- 10:45but it doesn't actually matter because you and
- 10:47I cannot then go shop based off of
- 10:49pricing. So
- 10:51it's, yeah, it's another one of those situations
- 10:54where the the the insurance industry has complied.
- 10:57Is it usable? Not really. Right. It sounds
- 11:00all good, but it's not really helpful necessarily.
- 11:02Yeah. But I I think that's right on.
- 11:05Jacob, as always, I I learn more in
- 11:07a quick period of time from talking to
- 11:09you than almost anybody else in the world.
- 11:10Thank you so much for joining us today
- 11:12on the Becker's Healthcare Podcast. Again, we talked
- 11:14about today Jacob Emerson on Medicare Advantage and
- 11:18prior authorizations.
- 11:19Thank you so much for joining us. Thank
- 11:21you, Scott.
