- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:04In this episode, we're going to pick back up with
- 0:06the OIG report and continue on with the official narrative
- 0:11of the United States Government into the circumstances surrounding the
- 0:15death of Jeffrey Epstein. Epstein is allowed to make an
- 0:20unmonitored telephone call on August ninth. For safety and security reasons.
- 0:25BOP policy requires that all inmate telephone calls be made
- 0:29through the inmate telephone system. BOP records reflect that Epstein
- 0:34placed an unrecorded, unmonitored telephone call to a telephone number
- 0:39in the local six four to six area code using
- 0:42a non inmate telephone system line on August ninth, twenty nineteen,
- 0:47from six fifty eight pm to seven nineteen pm. No
- 0:51other BOP records exist regarding the unmonitored call, including identity
- 0:56of the person called or a summary of the conversation.
- 1:00The OIG found no evidence that Epstein signed an acknowledgment
- 1:04of inmate form, as required by BOP policy and necessary
- 1:09for him to use a non inmate telephone system line.
- 1:13The acknowledgment of inmate form provides, among other things, that
- 1:18the GOP reserves the authority to monitor and record non
- 1:22attorney conversations on any telephone located within the institution to
- 1:27preserve the security and orderly management of the institution and
- 1:31to protect the public. The OIG did not find that
- 1:35any notification was made to the mcc New York Special
- 1:39Investigative Services staff advising the telephone call had been made,
- 1:43the day and time of the telephone call, the name
- 1:46of the person being called, Epstein's name and register number,
- 1:51or a brief statement explaining the purpose of Epstein's telephone call,
- 1:55as BOP policy requires. The Evening Watch Operations Lieutenant told
- 2:01the OIG that when he was preparing to escort Epstein
- 2:05back to the Shoe from the attorney conference room on
- 2:08August ninth, twenty nineteen, a unit manager said to the
- 2:12Evening Watch Operations lieutenant that he was going to escort
- 2:16Epstein so he could provide Epstein with the opportunity to
- 2:19place a telephone call using an unrecorded legal telephone line
- 2:24that is utilized by inmates to call their attorneys. The
- 2:27unit manager was the institutional duty officer. The week of
- 2:31Epstein's death, the Northeast Regional Director told the OIG at
- 2:36an institutional duty officer is a supervisor who monitors the
- 2:41facility on non duty hours on behalf of the warden
- 2:44when the warden is not present. The captain told the
- 2:48OIG that he had authorized the unit manager to provide
- 2:52Epstein with a telephone call from the Shoe on August ninth,
- 2:56twenty nineteen, because he wanted to accommodate Epstein's request for
- 3:00a telephone call since Epstein was assigned to the Shoe
- 3:04and had limited ability to place telephone calls. The captain
- 3:08explained that when the unit manager was escorting Epstein from
- 3:12his attorney visit back to the Shoe, he told the
- 3:15unit manager in the elevator that Epstein could place a
- 3:18telephone call from the Shoe, but it had to be
- 3:21monitored and lobbed. The unit manager told the OIG that
- 3:25he worked on August ninth from approximately eleven am to
- 3:29seven pm. The unit manager explained that on August ninth,
- 3:33Epstein asked to call his mother and that it was
- 3:36his understanding that Epstein had not been able to obtain
- 3:39the necessary documentation to use the inmate telephone system for
- 3:44various reasons, including the fact that Epstein was with his
- 3:47attorneys during normal working hours as described below. Epstein had
- 3:52in fact completed the requisite BOP paperwork that allowed him
- 3:57to place calls through the inmate telephone say. The unit
- 4:01manager said the decision to allow Epstein to place the
- 4:04call was his loan as the unit manager and because
- 4:08as the institutional duty officer, he was representing the warden
- 4:12who was not physically within mcc New York at the time.
- 4:17The unit manager said he did not recall having a
- 4:20conversation with the captain about permitting Epstein to make the call,
- 4:24and he would have allowed the call even if the
- 4:26Captain did not want him to, given it was his
- 4:29decision to make as the unit manager. The unit manager
- 4:33explained that he viewed ensuring that inmates had family socialization
- 4:38as part of his job, and he would allow inmates
- 4:41to place telephone calls if they were unable to make
- 4:43calls under ordinary circumstances. The unit manager told the OIG
- 4:49that at approximately six forty five pm, he and the
- 4:52Senior Officer Specialist I escort at Epstein from the attorney
- 4:56conference room to the shoe so that Epstein could place
- 4:59a telephone call. The unit manager said he put Epstein
- 5:03in the shower area to make the telephone call because
- 5:05CEOs were present in that area. The unit manager explained
- 5:10that he also chose the shower because that location in
- 5:13shirt Epstein would not be able to pull the phone
- 5:16cord into his cell and use it to harm himself.
- 5:20The unit manager said he plugged the telephone line into
- 5:23the legal line, which was not recorded, and dialed the
- 5:26telephone number that Epstein provided. As noted above, the number
- 5:30was dialed was in the local six four to six
- 5:33area code. The unit manager said he allowed Epstein to
- 5:37place the telephone call on the unrecorded legal line because
- 5:41he believed that Epstein had not set up his inmate
- 5:44telephone system account that would have allowed him to call
- 5:48on the institution's recorded lines. According to the unit manager,
- 5:52a mail answered and the unit manager handed the receiver
- 5:56to Epstein. The unit manager heard Epstein say, Hey, how
- 5:59are you doing? How's everything. The unit manager admitted that
- 6:03he should have verified who was on the line, as
- 6:06Epstein had requested to make the telephone call to speak
- 6:09with his mother and it was a male who answered
- 6:11the phone. The unit manager said he could not verify
- 6:14the phone number because he believed that Epstein did not
- 6:17have his inmate telephone system account set up, and he
- 6:20did not have any phone numbers associated with his account.
- 6:24The unit manager told the OIG that after he handed
- 6:27the telephone to Epstein, his shift ended, so he left
- 6:30the Shoe and left mcc new York for the day.
- 6:34The unit manager said that when he left the Shoe,
- 6:37Epstein was still on the phone, and the evening watched
- 6:40Shoe officer in charge and Noel were at the officer's desk,
- 6:44and that senior officer Specialist one was also present. According
- 6:48to the unit manager, when he was leaving, he told
- 6:51the officers, hey, make sure he gets his fifteen minutes
- 6:54and after that he's done. The unit manager said he
- 6:58did not provide the shoe staff with instructions to monitor
- 7:01the call. He said that after he left, he contacted
- 7:04Noel on the shoe telephone and asked her to make
- 7:07sure that Epstein's call had ended because his time was up.
- 7:11The unit manager acknowledged that he did not stay and
- 7:14monitor the call as he should have done. The unit
- 7:17manager said the proper way to have an inmate place
- 7:20a telephone call on an unmonitored line would be to
- 7:24bring the inmate out and place them in a belly chain,
- 7:27because then he would be handcuffed in the front. The
- 7:30unit manager said he should have provided Epstein with the phone,
- 7:35with the counselor or unit team member present and place
- 7:38the call on speaker so the call was monitored. The
- 7:42OIG investigation determined that Epstein did not in fact speak
- 7:45with his mother, who, according to public records, died in
- 7:49two thousand and four. The OIG found that Epstein actually
- 7:53spoke with Individual One, who declined to be interviewed by
- 7:56the OIG. Individual one's lawyer told the US Attorney's Office
- 8:01for the Southern District of New York during an attorney
- 8:05proffer that Individual one spoke with Epstein on August ninth,
- 8:09twenty nineteen, at about seven pm for approximately twenty minutes.
- 8:14Individual one's attorney proffer was that Individual one was in
- 8:18the country of Belarus at the time of the call.
- 8:22Individual one's attorney told the US Attorney's office that during
- 8:26the telephone call, Epstein told Individual one that the press
- 8:30had gotten crazy, and they discussed personal things such as books, music,
- 8:35and hygiene while incarcerated. According to the representations by Individual
- 8:40one's council, Epstein told Individual one they are trying to
- 8:44keep me safe and that his case would take a
- 8:47little longer than he originally thought. He told Individual one
- 8:51that he loved her to be strong and that he
- 8:53would not be able to call her again for another month.
- 8:57Senior Officer Specialist one told THEID that he was not
- 9:01a witness to Epstein's August ninth call, but he had
- 9:04previously discussed telephone calls with Epstein and knew that Epstein
- 9:08had the requisite paperwork that allowed him to place calls
- 9:11through the inmate telephone system. Senior Officer Specialist one told
- 9:16the OIG that Epstein was issued the necessary documentation to
- 9:21make telephone calls when Inmate one was his cellmate. Senior
- 9:25Official Specialist one who advised the OIG about an interaction
- 9:30that he had with one of Epstein's attorneys prior to
- 9:33August ninth, when he was on an elevator with Epstein
- 9:36and the attorney. According to Senior Official Specialist one, Epstein's
- 9:40attorney asked him about getting Epstein the necessary documentation to
- 9:45make calls. Senior Officer Specialist one said he then verified
- 9:50that Epstein was able to make calls through the inmate
- 9:53telephone system. When Senior Officer Specialist one asked Epstein why
- 9:58he said he was unable to make calls. Epste Dean responded,
- 10:01they said they monitor those phone calls. Senior Officer Specialist
- 10:05one said that in subsequent conversations with Epstein's attorney, the
- 10:09attorney asked how Epstein could get unmonitored calls. Senior Officer
- 10:14Specialist one told Epstein's attorney that decision had to be
- 10:17made by a lieutenant or a unit manager. Noel told
- 10:22the OIG that after Epstein's attorney conference on August ninth,
- 10:26the unit manager plugged the telephone line in the legal
- 10:29line and placed Epstein in a shower area within the shoe,
- 10:33where he was afforded a telephone call. The OIG investigation
- 10:37determined that legal line is an unrecorded telephone line outside
- 10:41of the inmate telephone system, which is designed for inmates
- 10:45to use when speaking with their council, and therefore is
- 10:49not recorded. Noel said that after the unit manager set
- 10:54Epstein up with the call, he left the shoe and
- 10:56did not instruct Noel or anyone else to Noel's night
- 11:00college to monitor Epstein's call. According to Noel, the call
- 11:04was not monitored or logged. Noel said that approximately fifteen
- 11:09to twenty minutes later, while Epstein was still using the telephone,
- 11:12the unit manager called the shoe staff via telephone, told
- 11:16Noel that Epstein's time was up and asked that Noel
- 11:19retrieved the telephone from Epstein. Noel estimated that Epstein's call
- 11:24lasted for twenty minutes, and said the Evening Watched Shoe
- 11:27officer in charge and the material handler were also present
- 11:31in the shoe during Epstein's phone call. Noel reported that
- 11:36she took the phone back from Epstein, left Epstein alone
- 11:39in the shower, and went to use the bathroom on
- 11:42ten South. Noel said upon her return, Epstein was already
- 11:47placed back in his cell. The Evening Watched Shoe officer
- 11:51in charge told the OIG that he was present in
- 11:53the shoe on August ninth during the time of Epstein's
- 11:57telephone call, but did not overhear Epstein's conversation. The Evening
- 12:02Watch Shoe officer in charge also said that while Epstein
- 12:05was having his telephone call, the officers were distracted by
- 12:09the actions of another inmate. The material handler said he
- 12:13did not recall seeing the unit manager or Epstein in
- 12:16the shower area on the night of August ninth, and
- 12:18did not have any knowledge or information regarding a phone
- 12:22call made by Epstein that night. The Northeast Regional Director
- 12:27told the OIG, if Epstein's call was monitored by an
- 12:30mcc New York official, then it should have been done
- 12:34on a speaker phone while being monitored by a staff member,
- 12:37and the call should have been logged and a record
- 12:40of the call should have been created. The Northeast Regional
- 12:43Director said Epstein's unmonitored phone call was extremely concerning because
- 12:49we don't know what happened on the phone call. It
- 12:51could have potentially led to the incident of Epstein's death,
- 12:54but we don't. We will never know, all right, folks.
- 12:58So that's gonna do it for part four of chapter five.
- 13:03The next episode, we have part five of Chapter five,
- 13:07which is the failure to conduct shoe inmate counts and
- 13:10staff rounds on August ninth and tenth. All of the
- 13:14information that goes with the episode can be found in
- 13:17the description box.
