- 0:00Speaker 1: Hi. I'm Jason Flamm, and I'm the host of Wrongful
- 0:02Speaker 1: Conviction with Jason Flamm.
- 0:04Speaker 2: And I'm Robbia Jaudry, attorney and co host of Undisclosed.
- 0:08Speaker 2: We want to talk to you today about your responsibilities
- 0:10Speaker 2: as an upstanding citizen and how they relate to you
- 0:13Speaker 2: serving on a jury.
- 0:14Speaker 1: So we know, Robbia, we're all eligible for jury duty.
- 0:17Speaker 1: We all get those notices in the mail time to time,
- 0:19Speaker 1: and it's usually a big imposition. Everybody feels like, oh damn,
- 0:22Speaker 1: I got so many other things to do. But I
- 0:23Speaker 1: want to urge everyone to try to change your attitude
- 0:27Speaker 1: about this. We should all view jury duty as an
- 0:30Speaker 1: opportunity to be a very necessary watchdog for those in
- 0:34Speaker 1: power and to make sure that real justice is done.
- 0:37Speaker 1: That takes each and every one of us. But I'm digressing.
- 0:40Speaker 1: So let's say you're in the jury room and the
- 0:43Speaker 1: case is a serious case and deliberations taking a long time.
- 0:46Speaker 1: Everyone wants to get back to their lives, back to
- 0:48Speaker 1: their jobs and families, but the pressure is on to
- 0:51Speaker 1: come to a decision. What are some of the things
- 0:54Speaker 1: that people should remember.
- 0:55Speaker 2: Well, first, I want to remind folks that listen your
- 0:58Speaker 2: decision is going to alter lives. It's going to alter
- 1:01Speaker 2: turn somebody's life, maybe forever, So you have to take
- 1:04Speaker 2: it really seriously. Nobody can get through a trial and
- 1:07Speaker 2: remember every single thing that happens. So if you're allowed
- 1:09Speaker 2: to take notes during the trial, make sure you have
- 1:10Speaker 2: those notes, use those notes during deliberations. If you don't
- 1:13Speaker 2: understand something, if you do not understand some testimony, some evidence,
- 1:17Speaker 2: ask the question, make the question available to the judge.
- 1:21Speaker 2: You can send a note to the judge. You can
- 1:23Speaker 2: ask one of the attorneys to clarify something. Make sure
- 1:25Speaker 2: you know every single thing you need to know before
- 1:27Speaker 2: you make the decision. And if you're feeling pressured by
- 1:30Speaker 2: your peers, you do not have to change your vote.
- 1:32Speaker 2: I don't care. If you're the only one holding out.
- 1:34Speaker 2: You can send a note to the judge and just
- 1:37Speaker 2: end deliberation. Somebody wanting to be with their family, just immediately.
- 1:40Speaker 2: It's no reason to deprive someone else of their family
- 1:43Speaker 2: while they wrot in prison. Do not feel the pressure.
- 1:45Speaker 2: The judge can decide whether it's a hung jury or not,
- 1:48Speaker 2: but being pressured into voting guilty or not guilty should
- 1:51Speaker 2: not be a thing. Don't let it happen to you.
- 1:53Speaker 1: Now you'll spend the rest of your life feeling guilty
- 1:55Speaker 1: yourself about having given somebody a life sense or ten
- 1:58Speaker 1: years or whatever it is, for something they may not
- 2:00Speaker 1: have done. Remember during nullification is a thing. If you
- 2:03Speaker 1: have to, if you feel it too much pressure, send
- 2:05Speaker 1: a note to the judge say I'm done. I'm not
- 2:07Speaker 1: voting guilty no matter what, and that's it and you're done.
- 2:09Speaker 1: You don't have toccumb to the pressure, and please don't.
- 2:12Speaker 1: To learn more and get involved, listen to Undisclosed.
- 2:16Speaker 2: And listen to the Wrongful Conviction podcast. Remember, as a juror,
- 2:20Speaker 2: this is your responsibility.
- 2:21Speaker 1: Right, So it's almost like a juror's bill of rights.
- 2:23Speaker 1: And the more you understand, the better the chance is
- 2:25Speaker 1: that we'll get actual justice that will have a fairer
- 2:28Speaker 1: system for everyone.
