- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to pick up where we left
- 0:05Speaker 1: off with the Tyler Robinson prelim hearing and the transcript
- 0:08Speaker 1: from day four. Once again, the prosecution is doing the questioning. Question,
- 0:14Speaker 1: you testified earlier that Mr. Robinson arrived at the Washington
- 0:18Speaker 1: County Sheriff's Office at approximately 9 p.m. Is that right? Answer, yes,
- 0:23Speaker 1: that's correct. Question, and although you weren't physically present there
- 0:26Speaker 1: yet because you were flying down How do you know
- 0:29Speaker 1: that he arrived at approximately 9 p.m.? Answer just based
- 0:33Speaker 1: on the police reports I reviewed, and then go back
- 0:35Speaker 1: and look at the video and such. Question Judge, the
- 0:38Speaker 1: state moves to admit State Exhibit 16.2 and publish it
- 0:42Speaker 1: pursuant to the court order. Judge Graff, Mr. Novak. Defense,
- 0:47Speaker 1: thank you, Your Honor. We've already lodged all of our
- 0:50Speaker 1: objections on all three phases. Judge Graff, alright, noting the objections,
- 0:54Speaker 1: standing objections by defense, State Exhibit 16.2 is admitted into
- 0:59Speaker 1: evidence and may be published only in the gallery, not
- 1:02Speaker 1: for distribution on electric media. Question, do you recognize this? Answer,
- 1:07Speaker 1: I do. Question, what is it? Answer, this is a
- 1:10Speaker 1: handwritten note or letter from Tyler to Lance. Question, and
- 1:13Speaker 1: how do you know that? Answer, in Lance's first interview
- 1:17Speaker 1: with FBI, he tells them about this letter note that
- 1:19Speaker 1: he found... under Tyler's keyboard per a text message that
- 1:22Speaker 1: he received. He states from 11 p.m. on September 10th.
- 1:27Speaker 1: And so at that point, Lance finds this. This is
- 1:29Speaker 1: the letter that he finds under the keyboard. Question. Okay,
- 1:33Speaker 1: so to clarify, Mr. Twiggs gets a text from Mr.
- 1:36Speaker 1: Robinson around 11 p.m. on September 10th telling him to
- 1:39Speaker 1: look under his keyboard. Answer. Yes. Correct. Question. And this
- 1:44Speaker 1: is what Mr. Twiggs represented was underneath the keyboard. Answer. Yes. Question. Correct.
- 1:49Speaker 1: How did law enforcement get this photograph? Answer, so following
- 1:53Speaker 1: Lance's first interview at St. George PD, his phone is
- 1:56Speaker 1: recovered at that point, taking into evidence. It's downloaded, I believe,
- 2:00Speaker 1: it was the following day, or shortly after that. The
- 2:04Speaker 1: FBI transported the phone to the RCFL, which is the
- 2:07Speaker 1: Regional Computer Forensic Laboratory in Salt Lake City. The phone
- 2:11Speaker 1: was downloaded through Celebrite. And after that, following that download,
- 2:16Speaker 1: that was complete. SBI received a flash drive containing that download.
- 2:20Speaker 1: From there, it went to the SIAC analyst to go
- 2:23Speaker 1: through that data of his phone to look for any
- 2:26Speaker 1: pertinent evidence or information that may be on there. And
- 2:30Speaker 1: at that point, that this image of this letter was located. Question,
- 2:34Speaker 1: all right, I'm going to break down just a few things.
- 2:37Speaker 1: Just want to make sure that the record's clear. You
- 2:39Speaker 1: mentioned Celebrite a few times. What is Celebrite? It's a
- 2:42Speaker 1: downloading software that's commonly used by law enforcement. I don't
- 2:45Speaker 1: do that myself. but it's commonly used to recover data
- 2:49Speaker 1: to download electronic devices, particularly cell phones. Question, and you
- 2:54Speaker 1: mentioned SIAC. What does that mean? Answer, it's the Statewide
- 2:58Speaker 1: Information Analysis Center. It's a division within DPS that's a
- 3:03Speaker 1: fusion center. They assist law enforcement with various intelligence information
- 3:07Speaker 1: for our investigations. Question, you mentioned that you don't personally
- 3:11Speaker 1: do Celebrite phone extractions. Have you spoken with the law
- 3:15Speaker 1: enforcement officers that performed the Celebrite extraction on Mr. Twigg's
- 3:19Speaker 1: phone in this case? Answer, I don't believe I specifically
- 3:22Speaker 1: talked to those individuals, the RCFL that did that. Yeah,
- 3:27Speaker 1: that was then provided to SBI. Question, did you speak
- 3:31Speaker 1: with officers at SBI that have recovered the photo that
- 3:34Speaker 1: we're seeing in States Exhibit 16-3? Answer, yeah, I've spoken
- 3:38Speaker 1: with the SIAC analyst who particularly in particular found this image.
- 3:43Speaker 1: I've spoken to her personally as well. Question, was Mr.
- 3:46Speaker 1: Twiggs shown what's been marked State Exhibit 16-3 during his
- 3:50Speaker 1: second interview? Answer, yes, he was. Question, and again, you
- 3:54Speaker 1: were present for that. Answer, yes, I was. Question, is
- 3:58Speaker 1: Exhibit 16-3 a fair and accurate representation of the photo
- 4:02Speaker 1: law enforcement obtained from Mr. Twiggs' phone and that he
- 4:06Speaker 1: was subsequently shown in the second interview? Answer, yeah, it's
- 4:09Speaker 1: fair and accurate. Question, Your Honor, the state would move
- 4:12Speaker 1: to admit Exhibit 16.3, and then also publish pursuant to
- 4:16Speaker 1: court order. Judge Graff, defense? Answer, just noting the objections
- 4:22Speaker 1: that have previously been made, and I think that the
- 4:24Speaker 1: court's order is that it may be published in the
- 4:27Speaker 1: courtroom only. Judge Graff, thank you. Noting the standing objection
- 4:30Speaker 1: by defense, 16.3, correct? Answer, correct. Judge Graff, it's admitted
- 4:36Speaker 1: into evidence and may be published only in the courtroom,
- 4:39Speaker 1: and not to be shown or videoed. Question, do you
- 4:43Speaker 1: recognize this? Answer, I do. Question, what is it? Answer,
- 4:47Speaker 1: these are the images that the FBI released to the public.
- 4:51Speaker 1: That would have been on September 11th when those were released. Yeah,
- 4:54Speaker 1: those were the images that went public of the suspected
- 4:57Speaker 1: UVU shooting suspect. Question, and how do you know that? Answer,
- 5:02Speaker 1: I viewed the FBI's website and recall seeing these images
- 5:05Speaker 1: released on September 11th. Question, does State Exhibit 16.4... Is
- 5:10Speaker 1: that a fair and accurate representation of what you reviewed
- 5:13Speaker 1: from the FBI? And that the FBI released? Answer, yes
- 5:17Speaker 1: it is. Question, the state moves to admit Exhibit 16.4
- 5:22Speaker 1: and publish according to court order. Judge Graff, defense? Defense,
- 5:26Speaker 1: no further objections, thank you. Judge Graff, alright. Noting the
- 5:30Speaker 1: standing objection by the defense, overruling that objection, State Exhibit 16.4
- 5:34Speaker 1: is admitted into evidence and may be published in the courtroom.
- 5:40Speaker 1: question and again the discord judge at this time the
- 5:43Speaker 1: court has provisionally admitted state exhibit 15 i'm sorry 15 5.1
- 5:47Speaker 1: i would like to move forward admission now because the
- 5:51Speaker 1: note in state exhibit 16 3 as well as the
- 5:54Speaker 1: text thread in 16 1 exhibit 5.1 now provides additional
- 5:58Speaker 1: context as to why inaudible back to the prosecution thank
- 6:05Speaker 1: you for your patience judge State 16.3, which is the
- 6:08Speaker 1: note that Mr. Robinson, inaudible, the first paragraph he says,
- 6:12Speaker 1: I have the opportunity to take out Charlie Kirk from
- 6:14Speaker 1: the tickets. Continuing down in the second paragraph, he says,
- 6:19Speaker 1: I wish we could have lived in a world where
- 6:21Speaker 1: this did not feel necessary. I wish I could have
- 6:24Speaker 1: stayed before you, and inaudible. In State Exhibit 16.1, page 3,
- 6:29Speaker 1: this is the text thread between Mr. Robinson and Mr. Twiggs.
- 6:33Speaker 1: At the top of the page 3, Mr. Twiggs says, why? Mr.
- 6:36Speaker 1: Robinson responds, why did I do it? Mr. Twigg says, yeah. Mr.
- 6:40Speaker 1: Robinson responds, I had enough of his hatred. Some hate
- 6:43Speaker 1: can't be negotiated out. So that makes relevant Charlie Kirk's
- 6:47Speaker 1: organization what their purpose was because the activities and demonstrations
- 6:51Speaker 1: they engaged in. The defense's argument was that the relevance
- 6:55Speaker 1: or the irrelevance of 505.1 doesn't speak to Mr. Robinson's mind.
- 7:01Speaker 1: We now have incorporated context showing that Mr. Robinson's state
- 7:04Speaker 1: of mind regarding Mr. Kirk and his hatred. He wishes
- 7:08Speaker 1: that they could live in a world where this did
- 7:09Speaker 1: not feel necessary again referring to State Exhibit 16-2. So,
- 7:14Speaker 1: that makes relevant to Exhibit 5.1 because it provides context
- 7:18Speaker 1: for the type of activity and beliefs and facts that
- 7:21Speaker 1: Charlie Kirk and his organization were participating in. Inaudible from
- 7:28Speaker 1: the judge and inaudible from the defense. Now back to
- 7:31Speaker 1: the prosecution. our motion to admit, and I also believe
- 7:35Speaker 1: it should be published both in the gallery and the
- 7:37Speaker 1: public at large. Judge Graff, as it relates to 5.1
- 7:41Speaker 1: the court previously, the day that I did it, I
- 7:44Speaker 1: believe it's day two perhaps. Prosecution, that sounds correct. Judge Graff,
- 7:49Speaker 1: the court provisionally admitted it, contingent on additional foundation being laid,
- 7:53Speaker 1: whether through testimony or through evidence. And the court notes
- 7:57Speaker 1: that such foundation and testimony has been laid, in order
- 8:00Speaker 1: for the foundation to be laid for 5.1 to be
- 8:03Speaker 1: admitted into evidence for full consideration by the court. And
- 8:07Speaker 1: so that's received. As it relates to publication and taking
- 8:10Speaker 1: in consideration the argument by Mr. Novak, well, first noting
- 8:14Speaker 1: the standing objections by defense that is overruled as it
- 8:18Speaker 1: relates to the admission of 5.1. But going to the publication,
- 8:21Speaker 1: the court understands that the argument made by the defense,
- 8:25Speaker 1: that this is going towards perhaps religion, and that the enhancement, And, well,
- 8:29Speaker 1: let me just read the information. Victim Targeting Enhancement in
- 8:32Speaker 1: Violation of Utah Code Annotated 76-3-203.14 Sub 2 Tyler James
- 8:41Speaker 1: Robinson intentionally selected Charlie Kirk because Tyler James Robinson's belief,
- 8:46Speaker 1: or perception, regarding Charlie Kirk's political expression. And that was
- 8:51Speaker 1: also noted as an enhancement or Count 2 and Count 7.
- 8:54Speaker 1: The court is not going to engage. The court can
- 8:57Speaker 1: weigh how this is applied. but it finds it relevant.
- 9:00Speaker 1: How it relates to the enhancement is for the court
- 9:02Speaker 1: to weigh as it looks at the bind-over decision, and
- 9:06Speaker 1: it's not engaging in that decision making today, but finds
- 9:09Speaker 1: that it's relevant. It's admissible to the court, and it's
- 9:12Speaker 1: publishable to the gallery, as well as to the public.
- 9:16Speaker 1: And so if the state wishes to publish State Exhibit 5.1,
- 9:19Speaker 1: they may do so at this time. Prosecution, thank you,
- 9:22Speaker 1: yes we do. And Kimberly, I don't know if we
- 9:25Speaker 1: want to use the same kind of slow scrolling, thank you,
- 9:28Speaker 1: all right, I believe that should be sufficient. Agent Davis,
- 9:31Speaker 1: I apologize. I'm going to take you very briefly back
- 9:34Speaker 1: to State Exhibit 16-1, which is the text thread between
- 9:37Speaker 1: Robinson and Twiggs. If you could, turn to page 17.
- 9:42Speaker 1: And because this has already been admitted, the court, correct
- 9:45Speaker 1: me if I'm wrong, published not only to the gallery,
- 9:47Speaker 1: but to the cameras at large. I'd like to ask
- 9:50Speaker 1: it be displayed in that fashion again. Judge Graff, all right.
- 9:53Speaker 1: Any input from any party on that request? Defense, no.
- 9:58Speaker 1: Judge graph all right thank you it may be published
- 10:01Speaker 1: and the media may pick this up as well question
- 10:05Speaker 1: agent davis if i can direct you to the very
- 10:07Speaker 1: last message on that page starting with if any if
- 10:10Speaker 1: you could read that aloud answer okay this is tyler
- 10:13Speaker 1: he says if police ask you questions sorry let me
- 10:16Speaker 1: start over If any police ask you questions, ask for
- 10:19Speaker 1: a lawyer and stay silent. My lawyer should be Doug Terry.
- 10:22Speaker 1: I'll see if he can reach out to you and
- 10:24Speaker 1: make sure the police follow. Question, okay, thank you. That's
- 10:28Speaker 1: all I needed from that exhibit. And then finally, Agent Davis,
- 10:32Speaker 1: you testified before that you flew down to Washington County
- 10:35Speaker 1: Sheriff's Office and observed Tyler Robinson there, correct? Answer, correct. Question,
- 10:40Speaker 1: and you got his name there? Answer, yes. Question, and
- 10:43Speaker 1: you stated... that you transported or assisted transporting him up
- 10:48Speaker 1: to the Utah County Jail? Answer, yes. Question, and that
- 10:51Speaker 1: you were the booking officer? Answer, that's correct. Question, do
- 10:54Speaker 1: you recognize Tyler Robinson here in the courtroom today? Answer, yes,
- 10:58Speaker 1: I do. Question, if you could point him out briefly
- 11:01Speaker 1: and describe something that he's wearing. Answer, he's the individual
- 11:05Speaker 1: seated at the defendant's table in the center chair with
- 11:08Speaker 1: a gray suit coat and a green tie. Question, Your Honor,
- 11:12Speaker 1: if I could have the record reflect identification of the defendant.
- 11:16Speaker 1: Judge Graff. Counsel. Defense, no objection. Judge Graff. All right,
- 11:22Speaker 1: I'll note for the purpose of this hearing only that
- 11:24Speaker 1: Agent Davis has identified Mr. Robinson in court. Thank you. Prosecution.
- 11:29Speaker 1: We now pass the witness. Thank you. And I don't
- 11:32Speaker 1: know if this would be a good time for lunch.
- 11:34Speaker 1: All right, folks, we're going to wrap up right here.
- 11:36Speaker 1: And when we get back, we're going to pick up
- 11:38Speaker 1: with the defense doing some cross-examinations. All the information that
- 11:42Speaker 1: goes with this episode can be found in the description box.
