- 0:22Hello and welcome back to Into the Weeds podcast here on
- 0:25Military Broadcast Radio. I'm Amber.
- 0:29Whoops, that got moved and I'm the Laura and this is Oates.
- 0:33I hope everybody's doing well tonight.
- 0:35Yes, hello everyone. I hope also that the last two
- 0:40weeks was kind of a a break for you guys to kind of refresh
- 0:47everybody before we get back into the documents.
- 0:50I had a good time with Tony the last two weeks.
- 0:54I had a good time. I think we goofed off a little
- 0:56too much, but we had a good time.
- 0:58Yeah. Hey, Joy and Pippa dot, good to
- 1:01see you guys. So this week we really didn't do
- 1:07much this week I don't think. I was lazy other than going to
- 1:10work so. Yeah, anyway, hello Fluffy
- 1:15Stingray. I actually I've been working on
- 1:20a video. I just showed a Laura a preview
- 1:24of it. It is going to be about Woodrow
- 1:28Derrenberger. Nell from the case Dive told me
- 1:32about that case. I had never heard about it
- 1:36before and so I'm making a video about it.
- 1:40And she's doing a good job. And I'm a tough critic.
- 1:44I don't go easy on nobody, but my mom was doing a good job.
- 1:46Well, thank you very much. And I did gloss my hair this
- 1:51week. I, I, well, that's not what I
- 1:56was trying to do. I was just I was wanting to go
- 1:59more upper and then when I got in there, Jayden was like, hey,
- 2:02let's try this. You're looking more curly now
- 2:05too, ever since like. Yeah, 'cause he does a special
- 2:08kind. Of haircut.
- 2:10Yeah, he does a curly cut since my hair is curly technically so,
- 2:15yeah. So it, you know, forms the curls
- 2:20better. Yeah.
- 2:21No, it's it's, it's doing something.
- 2:23I didn't even do anything. All I did was washed it and put
- 2:25some gel in it. So good stuff.
- 2:27Yeah, I'm so bad at doing my hair, like it's not even funny.
- 2:32Oh, thank you fluffy Stingray. Stingray.
- 2:34I don't I don't really understand all the YouTube gifts
- 2:37quite. Yet I don't either.
- 2:39I don't either. Hey, Marissa Monroe, good to see
- 2:44you. OK, so also before we get into
- 2:48the preliminary hearing that we've been going over on Athena
- 2:52Hogan, I did want to mention that military broadcast radio.
- 2:58Hold on, let me take the the lay over layoff real quick.
- 3:04So MBR is trying to raise some money.
- 3:09We are trying to raise $2600. I believe we raised 400 so far
- 3:14last count for our stream yards accounts.
- 3:19For our veterans. We try to keep the services
- 3:22free, but we've had to ask for donations.
- 3:25So that $400.00 I believe has actually come from other
- 3:28veterans, you know, trying to help us support everything.
- 3:33But I think we need it by September 1st, if I'm not
- 3:37mistaken. And that just allows us to keep
- 3:44veterans broadcasting. And so if you feel inclined,
- 3:49please go to MB Radio, dot US and you can donate there.
- 3:56And I think there's even, there might, Oh yeah, there is AQR
- 4:01code on the overlay so you can hit that QR code.
- 4:05But that's something that we need.
- 4:07It's not something that we do often to ask for that kind of
- 4:11stuff, but it is something important to me.
- 4:14And so, yeah, if you, if you feel so inclined and if you've
- 4:20gotten something out of Into the Weeds podcast, please go and
- 4:26show your love to MBR because they are the reason that I'm
- 4:30here. So please.
- 4:33OK, so it looks like we got some more people.
- 4:36Oh, I got to change that. OK, so let's see, we've got
- 4:44Merkel. I just caught up on your videos
- 4:46about this case. How interest.
- 4:48Interesting. Coincidental that this case was
- 4:50getting reopened for the first time in years when you decided
- 4:54to cover it. Yeah, no, it really is.
- 4:58And that's, I think that's the reason why the detective called
- 5:01me, because he's like, hey, what?
- 5:04What's going on here? So he's no longer the detective
- 5:09on the case, someone else's. But they've never reached out to
- 5:12me. But since he has been taken off
- 5:15of the case, he has reached out to me a couple of times.
- 5:19I remember being in the car one time.
- 5:21We were in Colorado, I think. Yeah, we were actually on our
- 5:23way to crime con to set up and everything.
- 5:27So yeah. What are the odds?
- 5:29Yeah, I know. Very interesting.
- 5:32So we're going to get right into it.
- 5:34And last time I was on, I stopped on page.
- 5:41Let me zoom out a little bit. I think it's 327, yes, 327
- 5:51you're having a hard time hearing.
- 5:52Yeah, I'm wondering, Noah, you're like, like, it's really
- 5:55bad in my ear. I wonder if it's because Charles
- 5:58messes with the audio every time I'm gonna punch him.
- 6:02My son comes down here and uses it for Dungeons and Dragons.
- 6:05So when? He when I come back like.
- 6:09Everything's coming out so bad. OK, so we're starting back on
- 6:13page 327 of the original document and 332 of the PDF.
- 6:21And thank you, Joy, for putting that Google link in there
- 6:26because you can find the documents and read along with
- 6:29us. And this is the preliminary
- 6:34hearing of Harvey Templeton in the murder of Athena Hogan from
- 6:421987. And, and Athena was out selling
- 6:48candy bars for a school fundraiser like many of us did
- 6:52in the 80s and the 90s. So yeah, that's, that's what
- 6:57we're going to get into. And this is the testimony, the
- 7:01cross examination of Donald, Detective Donald Belcher.
- 7:08So we're going to get into it. Where's 1980 millennials?
- 7:14She'd be sad she missed them. Yeah, Yep.
- 7:19Yeah. I tried to get into D&D, but
- 7:24it's really hard for me. You've got to have like an
- 7:27elaborate imagination, and I'm just not that good at it.
- 7:33Now. Baldersgate.
- 7:34I can get down with Baldersgate a little bit more than D&D, but
- 7:38definitely you've got to have an imagination with D&D.
- 7:44I'm glad Charles likes it. I'm, I mean, I don't know, I'm
- 7:48not very interested in like fantasy or like fiction anyway.
- 7:52Like even like watching movies or reading books I, I like.
- 7:55I'm not. Interested.
- 7:56Oh, I love fantasy. Maybe it's just 'cause I'm
- 7:58boring. I like the idea of it, like I
- 8:00like very like, I don't know, like the elves and the the
- 8:04fairies and she. Likes the pretty stuff.
- 8:06Things, but I don't know, I'm not really that interested in
- 8:08listening to stories. OK, so they went on recess and
- 8:13they came back and so we're going to get into it.
- 8:21The court, Mr. Tannery, I've spoken with you and Mr. Zelps
- 8:26during the recess and you need, if I'm correct, Detective Greg,
- 8:30Lord Anne Reed with the OSBI, of course, Mr. Belcher's still on
- 8:35the witness stand. And was it Mr. Tannery?
- 8:39Larry Mohammed, The court, Larry Mohammed, You, you 3 need to
- 8:45stay here. All you other witnesses that are
- 8:49here. Now, we're going to pick this up
- 8:51at 1:30 on January the 7th, and you're ordered to be back ready
- 8:56to testify at that time. You may or may not receive
- 8:59another subpoena, but whether or not you receive 1, you are
- 9:04ordered to be back at that time, January 7th at 1:30, unless
- 9:09you're notified otherwise by the court and you're excused.
- 9:13And the rule still remains in effect that I told you about
- 9:16earlier until this preliminary hearing is concluded.
- 9:20That does not prohibit you from talking to attorneys, though.
- 9:24All right, let's see. I guess I need to put on the
- 9:27record, and Lord is here. What's your name, Sir?
- 9:31Yes, Sir. Witness Bill Albert.
- 9:36Bill Albert, the court. Bill Albert.
- 9:39What's your name, ma'am? Right here.
- 9:42Witness Lorraine Jenkins. Lorraine Jenkins, The court.
- 9:46OK. And you've already testified,
- 9:48haven't you? Witness Jenkins?
- 9:51Yes, the court, OK, That's all the other witnesses that are
- 9:55here, I guess the rest of them will be back at 4.
- 9:59Witness. And Lord, this is for all
- 10:02defense witnesses, the court, all the witnesses other than the
- 10:07three that I named off that we need to finish up with.
- 10:10And let's see, Mr. Belcher, you can just resume your seat here.
- 10:14Yeah. Mr. Zelps.
- 10:16Thank you, Your Honor, by Mr. Zeltz Detective Belcher, over
- 10:21the lunch period, I got to thinking about some of the
- 10:24things you said and I wanted to know, you said that you
- 10:28approximately there was 230 houses that were visited
- 10:34screening for or in excess of 230 looking for carpet, right?
- 10:39Yes, there was. And that was there in that
- 10:43neighborhood, specifically Mission, that and the
- 10:47surrounding area too. OK, Now of those 230 or excess
- 10:53of 230, how many were how many samples were taken?
- 10:58I would say 10 or better, 10 or better.
- 11:02And were all of those sent? Did you take all of those
- 11:05samples up to Anne Reed? They were all taken to her.
- 11:09You didn't take all of them, right?
- 11:12I took the majority of them. We'd love to look and see which
- 11:16ones I did take. You only took carpet that you
- 11:21felt fit the description. Description.
- 11:24Or yes, Sir. That she was looking for, right?
- 11:28Yes, Sir. OK, now when you were down there
- 11:31at Clyde and Tilly's down at the, I think it's called C&E,
- 11:35auto or C and something. Seeing something.
- 11:39OK. Did you go in the office down
- 11:41there? I may have.
- 11:44There wasn't anyone in the office, if I recall.
- 11:47We were outside talking. Do you know for sure if you went
- 11:51in there or not? I don't know positively.
- 11:54I was kind of snooping around at lunchtime and, gosh, got the
- 11:59same kind of carpet in there that they had out there at
- 12:02Harvey's house. And I wondered if you noticed
- 12:05that. No, I didn't.
- 12:08OK. You didn't take a sample from
- 12:10his, did you? No, I didn't.
- 12:13Now I'm a little confused. What color do you say the carpet
- 12:17is in the Tina in the Tina Hogan home?
- 12:20What color was that in there? I'd have to look at the sample,
- 12:24but I was under the impression it was blue-green, that type of
- 12:29color, multi colored. OK.
- 12:31Did you ever search a home in Shelter Creek known as the
- 12:35Warner Home or did you assist on that?
- 12:38I was out there. I didn't take anything from
- 12:41there. Do you know what prompted the
- 12:43Lawton Police Department to search that home?
- 12:47Yes. That was a home that Robert
- 12:49Taylor had said he'd visited. OK Was there any evidence seized
- 12:54out there that you know of? I believe carpet samples were
- 12:59sent to Anne Reid from that home.
- 13:01What color? What color is the carpet out
- 13:03there? There was some orangish color, I
- 13:08believe, and maroon or red, something that fit that was
- 13:12close or some similar. Anyhow, that caught your
- 13:16attention, didn't it? Well, I didn't take the samples,
- 13:20so I don't know exactly what was taken from there.
- 13:24Anything else strange that looked like somebody had been in
- 13:27there? I know that place is no one's
- 13:31lived there. Did it look like somebody had
- 13:33been in there? Maybe the back door was open.
- 13:37I mean, it was not locked. You didn't do the search?
- 13:43No. Detective Muhammad, was he
- 13:45involved in that? I believe he was.
- 13:49I'm not sure who all went out there.
- 13:52I know they were there before I was there, so I don't know now
- 13:58that if I recall right from visiting with my buddy Tyrone,
- 14:03wasn't that search on the Warner house conducted even after
- 14:08Robert Taylor had been released? I don't know.
- 14:12OK, OK. You just kind of went out and
- 14:15watched the boys do whatever they do and went on.
- 14:18No, they, they had already had the samples.
- 14:21I went out later and seen the house.
- 14:24OK, What was the purpose of going out there and seeing?
- 14:28Just to look around, OK. See if you might find something.
- 14:32Yeah. Just to see the house.
- 14:34Did you? I didn't find anything.
- 14:38Was there some speculation that possibly, Well, it the girl had
- 14:43died there or was taken there, it's a possibility that that's
- 14:48what they were trying to rule out.
- 14:51OK Have they been able to rule that out?
- 14:54Well, the carpet samples didn't match.
- 14:57You know that for sure. That's what I was told by Anne
- 15:00Reed. Anne told you that.
- 15:04OK, We don't know where the carpet on her came from, do we?
- 15:10We don't know where the carpet fibers on the little girl came
- 15:13from, do we? Well, I think we do.
- 15:16But I don't know that to be 100%.
- 15:19That's what I mean. You There's similarity that
- 15:24carpet's similar to the carpet found in his home, right, Mr.
- 15:28Tannery? Objection, Your honor, and reads
- 15:32the expert in that the court. No, now he's offered an opinion
- 15:37and I think Mr. Zelps ought to be allowed to follow up on that.
- 15:41Yes. By Mr. Zelps.
- 15:44They're similar, aren't they? Yes.
- 15:48And no one can positively say that that carpet found on the
- 15:53little girl, the fiber is absolutely positively came from
- 15:56that house because there could be possibilities of other
- 16:01sources, right? That is possible out of the one,
- 16:05out of the ones that I did look at, that was the closest to me.
- 16:11Yeah, OK, I understand that. Now I want to know, was every
- 16:15house out there at Mission Village gone into and samples,
- 16:19you know, to look for samples? There was three that was not
- 16:24three houses there. Yes.
- 16:27Now, where else did you take carpet samples from other than
- 16:30Mission Village? There's a list of the ones.
- 16:35Who's got that? I I believe Anne Reid does.
- 16:39Good. OK, maybe she'll let me look at
- 16:41it. There was three that were not.
- 16:44Can you tell me why they weren't looked into unable to contact
- 16:49someone there at the house? OK.
- 16:52And so the possibility is you have, there's still a
- 16:56possibility that three of them have the kind of carpet you're
- 16:59looking for, right? Well, out of the three, only one
- 17:04would and it's possible the other two, the other two, all of
- 17:08them but one were made contact once or more.
- 17:13One had no contact at all. And that was 2315 Woodbridge
- 17:19Woodridge Dr. 2315 Woodridge. Yes, that man, as far as I could
- 17:26learn, is a railroad worker and I've been, I have left cards
- 17:30there on several occasions and have not made contact with him.
- 17:35So you so you haven't you haven't excluded that place yet
- 17:39at this time? That's the one house that in
- 17:42Mission Village. No contacts been made.
- 17:46OK. Now, where else outside of
- 17:48Mission Village did you all look?
- 17:51There was a trailer park. Is that where the swimming pool
- 17:55is? That's empty.
- 17:57Yeah. That's all messed up.
- 17:59Yes. Yes.
- 18:01Uh huh. OK.
- 18:02That little trailer park. Yes.
- 18:04OK. Did you go in those trailers
- 18:06there and look at the carpets? Yes.
- 18:10And were samples taken from any of those trailers?
- 18:12Yes. OK.
- 18:14How many? I think 2 Red's a pretty good
- 18:18color over there in that trailer park, isn't it?
- 18:22Well, it is. It wasn't just red.
- 18:24It was a mixture of the three that we're looking for.
- 18:28OK. Any place else?
- 18:30Montego Bay. OK, Why?
- 18:34What is Montego Bay? What does that come in?
- 18:38How does that come into it? OK, if anybody remembers here on
- 18:42the channel, hello, New Orleans lady, Good to see you.
- 18:47If you remember correct, or if you remember, Michelle Crawford
- 18:52went missing from Montego Bay, or at least her car was found in
- 18:58the Montego Bay parking lot. We don't actually know where she
- 19:02went missing from, but that's where her car and her purse and
- 19:06everything was found. Wow, so that's interesting.
- 19:09And that was where my sister lived as well.
- 19:13It was an apartment complex and then in front of it was a a
- 19:20hotel. So OK, how does that come into
- 19:30it? Oh, it's within access off the
- 19:32freeway. What did you go in apartments or
- 19:36in motel rooms? We went in apartments as far as
- 19:40getting samples and hallway. We also went to Regency Arms and
- 19:45got samples there. I don't know exactly how many
- 19:48apartments, but those that had a similarity, we went ahead and
- 19:53took and admitted, submitted those to Anne.
- 19:58OK, now we've. Is that pretty much it on the
- 20:02you say maybe 10 different sets were sent up there to Anne?
- 20:07There was more than that. I say 10, but I mean, I had more
- 20:12than that this morning in my hands.
- 20:15She'll have the exact number. Whatever she got, she should
- 20:19have. OK.
- 20:21Now, do you know a Mr. Bird who lives across the street from
- 20:25Harvey Lee Templeton and his family?
- 20:27Black gentleman, works for lot in public schools.
- 20:31He's the landlord. Yes.
- 20:33OK. I do know him.
- 20:35OK. His daughter saw little Tina
- 20:37that day at about 5:15, 5/30. He saw her, too.
- 20:42Did you talk to him about that carpet?
- 20:45Uh huh. OK.
- 20:47Who placed that carpet in there? I'm trying to.
- 20:50I cannot remember the man's name, but I talked to him also.
- 20:55All right. Where did he get the carpet?
- 20:57He got the carpet as a piece. This is the red section.
- 21:03Now, the other part, as far as the patch works.
- 21:06What am I what I'm talking about?
- 21:10Yeah. There's a red patch in the
- 21:12house, right, that came from the back of his pickup that he had
- 21:17left over years about a week or two after the Templeton's moved
- 21:22in. Now the other carpet, that was
- 21:24the three colors joined together, uh huh, was put in
- 21:28prior to 79, prior to the Templeton's moving in.
- 21:34Yes, it was there already, and it's been there as far as he
- 21:38knew, up until 79. All right, now I'm getting back
- 21:44to the red carpet. OK, where was that red carpet
- 21:48purchased? Mr. I cannot remember the man's
- 21:51name, but he stated to me now, is this the this would be the
- 21:56guy that Mister Byrd, Mr. Byrd had put in, hired him to put in.
- 22:03Right. And you talked to the man who
- 22:05was hired to put it in? Yes.
- 22:09All right. Where did he purchase that
- 22:10thing? He didn't purchase it.
- 22:13He had it as a piece leftover. OK.
- 22:17Did you check around town, see if a fellow could purchase that
- 22:21kind of carpet? No, I didn't.
- 22:24OK. Did you ever find out this multi
- 22:27colored carpet that was in there?
- 22:29Not the red? Uh huh.
- 22:31Did you ever find out if that carpet was being sold here in
- 22:34Lawton? No, that doesn't sound like
- 22:38much. Due diligence.
- 22:41Didn't find that out. Did you ever find the content of
- 22:45nylon? Did you ever find out the
- 22:47ingredients in the car in the carpet were what the ingredients
- 22:52in the carpet were? Sorry guys, so much wool, so
- 22:55much nylon, anything like that. Yes, I did not do that, but I
- 23:00was told some chemical and and Reid, yes, she did that.
- 23:06OK, so she can tell us all about that.
- 23:09Pretty much. OK.
- 23:11Now the little girl, as you probably well know, was found
- 23:14with a gag in her mouth. Yes.
- 23:17OK. Did you ever have you ever seen
- 23:19the color of that piece of cloth?
- 23:21Yes, OK. Did you seize any?
- 23:24Did you seize any cloth? Cloth that are similar.
- 23:30Sorry. Hold on, Let me take a drink.
- 23:38What? I'm just watching you take the
- 23:40drink. I feel comfortable.
- 23:42Nothing. See what I have to deal with.
- 23:45OK. Did you seize any?
- 23:47Did you seize any clothes that are similar?
- 23:50I did not. Did you take any from the
- 23:52Templeton's? I do not know what was taken
- 23:57from there. OK.
- 23:59There's a return. Where's where?
- 24:01There's been items listed. So I assume that whatever they
- 24:06took, it's been listed. Yes, it's listed.
- 24:10OK. Did you and your investigation
- 24:12look when you were in there looking at the carpets, ask
- 24:15people to show them their dish rags or towels?
- 24:20No. OK.
- 24:23Now, Mr. Templeton told you that he had taken at about 10:00.
- 24:29He went out and he went to the up by the 711.
- 24:33Is that correct? Excuse me.
- 24:35Yeah. 7:11 at the corner of 11th and Gore Blvd. dumped some
- 24:40trash. He had said that on the
- 24:44statement and after we questioned him about that, he
- 24:47said between 8:00 and 10:00. He couldn't be specific then.
- 24:52Well, he's specific on the statement.
- 24:54It says it happened 10:00, doesn't it?
- 24:58I believe it may say around or about 10.
- 25:02All right, now, did you go up to the seven?
- 25:05Did did he show? Did you ask him to take you
- 25:10exactly to where he dumped it? No.
- 25:13You know, there's a VFW and some other things back there.
- 25:19Yes, he had said that. The dumpster beside the 711.
- 25:24OK. Did he tell you that he dumped
- 25:26the trash there in the past? He said that he had done that
- 25:30before. All right, And you, being a good
- 25:33detective, know that those Dempsey dumpsters, a lot of
- 25:37people don't like you dumping in them unless you're supposed to
- 25:40be dumping in them. You understand what I'm saying?
- 25:44I guess Regency Arms wants the Regency Arm tend Arms tenants
- 25:52tenants to put their trash in those.
- 25:56Is that correct? You know that or could you
- 25:59assume that with me? I could.
- 26:02OK. In other words, you know, if you
- 26:05got caught out there dumping your trash somewhere, you would
- 26:08probably take your trash somewhere else, wouldn't you?
- 26:12Oh, I probably would if somebody said something.
- 26:16OK, that's what I'm getting to. Did you go to 711 with a picture
- 26:21of Harvey Templeton and ask them about the gentleman that came in
- 26:25there at a certain time to try to purchase, not try, but
- 26:30purchase some cigarettes? No.
- 26:34OK. Coca-Cola or whatever?
- 26:36No. That's wild.
- 26:40Do you know if any officers followed that up to see if
- 26:45Harvey was up there that anybody can remember?
- 26:48I don't know if they did or not. OK.
- 26:53Do you know of any witness or have heard of any witness that
- 26:57seen Harvey during this period of time that he was out of the
- 27:01home before he returned? He told me no one saw him.
- 27:08Well, I guarantee you somebody saw him in Lawton.
- 27:12It's just a matter of finding that person.
- 27:16So have you found anybody else that says that they have found
- 27:20that they have found saw they did see him?
- 27:25No. OK.
- 27:28You don't know. Haven't heard any other
- 27:31detectives say anything about that.
- 27:33No. OK.
- 27:35What date was it? The first date that you that you
- 27:39met Harvey Templeton, was that on the 31st, OK, yes.
- 27:46You went out there and that's when you had a search warrant to
- 27:50take hair. No, that's when we got the
- 27:53samples from the house. Samples from the house?
- 27:57Was he questioned at that time? No, other than, you know what
- 28:03happened. He was a suspect, wasn't he?
- 28:07Yeah. All everyone that we run into as
- 28:10far as connected with her were was all right.
- 28:17Hello, Kathleen. Good to see you.
- 28:19Hello. Yeah, being a good detective, I
- 28:26think he. Thinks that.
- 28:27Yeah, seems oddly evasive for someone being questioned in
- 28:31court. Yep.
- 28:33Yeah, no, this is it seems like they didn't do very much unless
- 28:40another detective is going to get on here and say something
- 28:43different. I don't know.
- 28:44I feel like we're constantly finding out that the police
- 28:46don't do their job. They want to be as lazy as
- 28:48possible. Ain't that the truth?
- 28:50And. You know.
- 28:53OK. Or detectives or whatever.
- 28:58Yeah, I know. Right.
- 28:59OK, Line 18, was that the first time that carpet samples came
- 29:04out of Harvey Templeton's house was on the 31st?
- 29:07Yes. OK.
- 29:09So he's just, he's in the group. Everybody you're going around
- 29:13canvassing, right? Uh huh.
- 29:15OK. When was and you talked to him?
- 29:18You basically when he saw Tina, if he saw Tina, Yeah.
- 29:24OK. So on and so forth.
- 29:28Uh huh. OK.
- 29:30He told you he saw her, didn't he?
- 29:34I believe he did. And we told him we needed to get
- 29:37a statement from him about it. OK.
- 29:40And he cooperated at every Ave. Yes, he did.
- 29:45He was pleasant to work with, was he not?
- 29:47Compared to some. Compared to some, He was.
- 29:51I'm wondering if they're alluding that Robert Taylor was
- 29:53not as pleasant to work with. OK, He didn't give you any hard
- 29:59times, did he? Oh, not really.
- 30:01I wouldn't. I wouldn't say so.
- 30:04The next time you saw Harvey was when?
- 30:07Now, this was on the 24th that you you're talking about.
- 30:12It was the 24th when we got the carpet samples.
- 30:16OK, the 31st was the next time. All right, you go back out there
- 30:25the next time you have a search warrant.
- 30:27At that time, no, he came down to the department.
- 30:32Now, by that time, Anne Reed had said, hey, there's something
- 30:36that looks similar, right? Yeah, the 24th and the 31st UV
- 30:42zeroed you, you start to 0 in on Harvey.
- 30:46Yes, Yes, we did. And that's why we advised him of
- 30:50his rights when he come in. OK, that's what I'm getting to.
- 30:56He now is a legitimate prime suspect in the murder of Tina
- 31:01Hogan. At this time.
- 31:03Yes. OK, he is.
- 31:06So you advise him of his rights? Muhammad.
- 31:10Yes, I believe Muhammad read them.
- 31:12But I was present. Well, did did you, did he sign a
- 31:17consent form at that time? Yes, he did.
- 31:21Is that the one? Uh huh.
- 31:23And that's when the statement was taken that day, Yes.
- 31:27OK. Anything he said to you that you
- 31:30have not relayed to us today, anything at all, only I can't
- 31:36think of everything that was said.
- 31:37Now, we did question, well, the details of the statement and
- 31:42that's where the OK 8 to 10 come in and he said could have been
- 31:52Detective Belcher. It's very important because
- 31:54later if there is a trial in this matter, I don't want to be
- 31:58surprised with a statement that we've never heard about before.
- 32:03So take your time here a few minutes and think about
- 32:06everything that was said, because if there's something
- 32:09that he said down there that we haven't heard, I want to know
- 32:13about it. Well, we talked about several
- 32:16things. He did state about she had
- 32:19several pieces of candy in the bag and that she had an envelope
- 32:23with money in it, I assume. I believe that's where he said
- 32:27she kept her money. Now, let me ask you something
- 32:31about that before we move on. OK?
- 32:35Were you able to find all the people she sold her candy to?
- 32:39No. OK.
- 32:42Is it going to turn out? What I'm trying to get to is at
- 32:46some later point, is there going to be a witness produced or
- 32:52series of witnesses that say, well, she didn't have any candy
- 32:57in her bag by the time she got to Harvey's.
- 33:00Do you know of anybody that says going to say anything like that
- 33:05or cumulative effect of that? Because they know who bought the
- 33:09candy and they're going to say no, OK, you see what I'm saying?
- 33:18There's a contradiction. If if Mr. Templeton said, yeah,
- 33:23there was some candy in her bag and they know how many pieces
- 33:28she had and go down the line, it would be hard for me to say
- 33:33because I don't know what if he was to say what he's going to.
- 33:39Then if somebody's got something that says different, then they
- 33:43can say so. Well, that's what I'm wondering
- 33:48if you have some witnesses. I don't.
- 33:52You know what you said? You know what he told you?
- 33:56That's all. I he said there was candy in the
- 34:00bag. She had some candy in the bag,
- 34:02right? Yes.
- 34:05OK. What else do you do you recall
- 34:07him saying? Well, now he did.
- 34:10He didn't really. He said some personal things as
- 34:14far as him and his wife not getting along OK, and that's
- 34:19about as far as that went. Didn't want to get real personal
- 34:24about that, but that's the conversation.
- 34:26As far as being exact, I can't. I don't recall, but I know that
- 34:31I knew this all along from talking to her before.
- 34:35They've had their squabbles like everybody else.
- 34:37I guess that's married, right? Yes.
- 34:41OK. You talked to her probably quite
- 34:44a bit, didn't you? Not really, You didn't.
- 34:49Afterwards I talked to her again before.
- 34:52I'd been out there at the house once before and talked to her.
- 34:55But Harvey was working, I guess. All right now.
- 35:00Mr. Tannery asked a question this morning.
- 35:04Did you ask Harvey if he put her pants and her shoes in there in
- 35:08the Dempsey dumpster? You never asked that question,
- 35:11did you? The way I just did it or said
- 35:14it? Not the way, no.
- 35:17We may have said that. That's what he did with the
- 35:20bags. That's what was in the bags.
- 35:23Accused him of it, did you say? Did you accuse him of that?
- 35:28I don't know if I did or if Muhammad did, but that could
- 35:32have been brought out. Was there some accusing going on
- 35:37during this interview? Oh, yes.
- 35:39Uh huh. OK.
- 35:41And that's a technique and a tactic that's probably
- 35:45recognized by all law enforcement.
- 35:47Yes. Well, once the statement was
- 35:49given, we went over it and we started finding some problems
- 35:53with it. OK.
- 35:55What you thought? OK, what you thought were
- 35:59problems. Right.
- 36:00What I thought was problems, yes.
- 36:03Turn up the heat and see what happens, right?
- 36:08Sort of like cross examination, right?
- 36:11Kind of. Next time around, you'll know
- 36:14I've got this statement. If you make a mistake, I'm going
- 36:17to turn up the heat, right? Well, I don't know if it's
- 36:21exactly that way, but OK. Now, when you talk to the wife,
- 36:26did she tell you that she was wanting to sell the car long
- 36:29before Tina Hogan disappeared? Not that I recall.
- 36:34You didn't ask her that question.
- 36:36Question, did you? Didn't talk to her about the
- 36:39car, did you? Yes, you did.
- 36:42Well, tell us what she said about the car then.
- 36:45She wasn't wanting to get in any more debt.
- 36:49He only did it because he wanted to, is what I can recall her
- 36:54saying. Now.
- 36:55There was a statement taken to that.
- 36:58He gave a statement, Yes. OK, where's that statement at?
- 37:03Do you have? It's here somewhere.
- 37:06You don't have it? No.
- 37:08OK, 31st he comes in, makes a statement.
- 37:11What day is he arrested? Do you know?
- 37:17No, Sir, I'd have to. Was it the day?
- 37:20Was it that day or the next day? No, it wasn't within.
- 37:24It had to be 3 or 4 days later. OK, In between the time he was
- 37:30down there giving the statement. What did you do Really Just did
- 37:35houses. Houses did.
- 37:38Did you go talk to the children at the schoolhouse?
- 37:41Do what? Did you go to the school and
- 37:45interview the children? Yes, I did.
- 37:48I did. You did that.
- 37:50I did that in the beginning, OK Went to the school and talked to
- 37:54each kid or in a group and asked them if they knew anything and
- 37:59kind of went over things. Yes, we did that.
- 38:03Uh huh. Any more contact with Harvey
- 38:06Templeton? No, other than the day he was
- 38:09arrested. I asked him a couple of
- 38:11questions and he said he didn't want to talk to me.
- 38:14OK. And that was it.
- 38:18OK. And that's proper, isn't it?
- 38:21Yeah. Did you think of any more
- 38:23statements that might have that he might have said no, I can't
- 38:31right now. Are you saying there are no more
- 38:36statements? No, I'm not saying that.
- 38:39I'm saying that the conversation that we now the the types the
- 38:46type statement was the one that he gave reference Tina.
- 38:51Now we discuss family problems a lot of other things, but any
- 38:55statements that were would show in any way that he was guilty of
- 38:59this crime charged. No any statements that would
- 39:04incriminate him in any way that you not no related to us other
- 39:10than other than just conversation about family
- 39:12problems. Maybe we talked about his hand
- 39:15getting hurt. Different things like this.
- 39:18OK, You know what I'm getting to.
- 39:21I Yes. There's no other I don't want to
- 39:26get. I don't want to have that big
- 39:28bombshell go off someday. Yeah.
- 39:32And there's no bombshells that you know about.
- 39:35None that I know of. Yes, Sir.
- 39:38I'm sorry. What was the color of the house?
- 39:41Color of the carpet in the Warner house.
- 39:44I think I've asked you that. I think you did and I thought it
- 39:49was One room had some orange, another room had maroon.
- 39:53There wasn't no multi colored carpet that I remember now.
- 39:58Someone else went out there. Whoever did the sampling would
- 40:02know. I didn't do the sampling.
- 40:05The fibers, I'm getting a little confused.
- 40:08The fibers that were taken from the body, did each of them have
- 40:12a different, I mean one? On one fiber, was there more
- 40:16than one color? No.
- 40:19OK, Well, the same colors were coming out of the Warner house
- 40:24that really you were looking for, right?
- 40:27Well, in the beginning, I believe.
- 40:30Now see, we didn't know and Anne had provided additional
- 40:35information for us as we went along.
- 40:38As a matter of fact, Anne had been down here.
- 40:42She was out there when they searched Harvey's house, wasn't
- 40:45she? Yes, but she wasn't there when
- 40:48we got the carpet samples. OK.
- 40:51She was there, though. Mr. Zelps, I don't believe I
- 40:55have any other questions. Thank you.
- 40:57The court? Anything else, Mr. Tannery?
- 41:00Yes, Your Honor. Mr. Zelps.
- 41:03Your Honor, may I look at the court file?
- 41:06Direct re examination. OK.
- 41:09A Laura, it's your turn to read. OK, I have really bad sensory
- 41:13overload today. You do?
- 41:15Yeah, OK. You don't have to put the
- 41:18headphones on or anything. Just breathe.
- 41:21No, you're good. There's something I need to hear
- 41:22on the headphones. OK, I can try.
- 41:29We need to clear off this damn desk girl.
- 41:31Well, it's not even that cluttered, it's just I need to
- 41:36figure out a better system. OK.
- 41:43Redirect examination by Mr. Tannery.
- 42:00OK, sorry about that. We were supposed to be streaming
- 42:05on TikTok but for whatever reason it's not doing it so I
- 42:11don't know. Joel finagled it to where we
- 42:14could start live streaming on TikTok.
- 42:17Is it our TikTok or MBRS? TikTok, it's MBRS TikTok so feel
- 42:22like. You guys make it confusing for
- 42:24people to, I don't know, there it's just on so many different.
- 42:30Well, it's on into the weeds and it's on MBR.
- 42:33That's it. It's on 2 stations so.
- 42:38OK, he mentioned that he had heard a left hand.
- 42:41What are you talking about? Well, during conversation he
- 42:45mentioned that he had hurt his left hand, I believe on Monday
- 42:47or the 29th, I forget. I believe that he said the 29th
- 42:52and he was off work that Monday at which would have been a day
- 42:55or two or three before the death of Tina Hogan.
- 42:58Oh. There it is.
- 43:02Do you have any knowledge about him having any kind of a brace
- 43:04on his left hand or anything like that?
- 43:06No, when I when I talked with him he didn't.
- 43:10But now if he did at that. I know it's hard to read.
- 43:17You sound very. I wouldn't know.
- 43:20Yeah. You sound very mentally
- 43:21challenged. I sound very mentally challenged
- 43:24when I read it. That's.
- 43:25One way to put it. Oh, my goodness.
- 43:27I would have said to. Really.
- 43:28OK. You also discussed the fact that
- 43:31you said he cooperated. That's up to a point, was it
- 43:33not? Well, yes.
- 43:36Now before his arrest and you got your consent for hair and so
- 43:40forth on the 31st, why did you have to go get a search warrant
- 43:43to get the hair on? Well, because he did refuse to
- 43:48give it to us. He said no.
- 43:49I said, well, we had found hair along with the fibers on her
- 43:52body. So I told him that we he refused
- 43:55to give you what? He refused to give me the hair,
- 43:59pubic hair, head hair. When did he do that?
- 44:02On the 31st, he said that we gotten on his bad side and he
- 44:05wasn't going to do it. So we went and we had a search
- 44:08warrant done. So he wasn't fully cooperative.
- 44:11No, he wasn't. Not like that he wasn't.
- 44:13He just never did fight or anything.
- 44:15Jump up, nothing. OK, But now did you pinpoint the
- 44:19time that According to him that Tina was there?
- 44:22Yes, he said that it was around 5:30 and he knew it to be
- 44:26because there was his movie on Toby Tyler spelled phonetically
- 44:31and it was about halfway over and it came on at 5.
- 44:34It's a Walt Disney show and it goes off at six.
- 44:37He said it was after the movie was half over, so she came.
- 44:40So that was after 530 Toby. Tyler I know.
- 44:43I'm thinking Toby. Tyler A Disney movie.
- 44:46Anybody seen that before? Joy, You're a resident. 1960.
- 44:54Hold up, Just go to plus or. That one's fine.
- 45:01Yeah, there we go. Oh no, I want to go on actual
- 45:05Google. I don't like the Bing.
- 45:08There we go, Toby. You're not putting it in there.
- 45:16I need to sue somebody I don't know who.
- 45:23Will be Tyler. Sorry, have one hand. 10 weeks
- 45:29at the circus. Staying Hold up.
- 45:31I have never seen that movie. I I don't want to do.
- 45:41That shoot, it's fine. Sorry, share screen.
- 45:45Sorry, all my brains not loading.
- 45:47I'm not working at full capacity today.
- 45:51But yeah, Toby Tyler. I've never seen that. 1960
- 45:55little orphan Toby Tyler. Kevin Corcoran runs out to join
- 46:00a travelling circus following a quarrel with his foster parents,
- 46:03Aunt Olive and Daniel, Or and Uncle Daniel Under the big top,
- 46:07Toby is exposed to the magical new world that includes A wacky
- 46:09chimpanzee named Mr. Stubbs. The boy's friendship with
- 46:13paternal candy seller Harry Tupper, Bob Sweeney is
- 46:17considerably less endearing, especially when Tupper starts
- 46:20showing his mean spirited true colors.
- 46:22I don't recognize any of those names.
- 46:23Has anybody seen this? I've never seen it before.
- 46:28Like never. I've never even seen artwork or
- 46:35anything. Oh, that's a little creepy.
- 46:38That would have scared you as a child.
- 46:41Oh my goodness. Well, I said it before you
- 46:44looked at it, I only got some candy apples.
- 46:46Joy said he's a young orphan who runs away to join a travelling
- 46:49circus where he befriends A chimpanzee named Mr. Stubbs.
- 46:55OK, interesting. So anyway, that was which.
- 47:03One hold on. I got it.
- 47:04I'm sorry. My bad.
- 47:05You're good. Oopsie, Daisy.
- 47:08Window. There you go.
- 47:14OK. Now did you pinpoint the time,
- 47:17According to him, that Tina was there?
- 47:18Yes, he said that it was. What just happened?
- 47:31I think a family went in her mouth.
- 47:34We have this one fly that's been around here for days now.
- 47:38It's driving me crazy and I think it just went in the Lord's
- 47:41mouth. I know I went in her nose.
- 47:56Oh my goodness, she snorted. A family?
- 48:03Oh, what's that song? There was an old lady who
- 48:07swallowed a family. What was this song was an old
- 48:12lady who swallowed a family. I guess she'll die.
- 48:17What? Oh, I can't remember what it is.
- 48:21Oh, about my oldies falling flies, but that's not my damn
- 48:23nose. Oh my God.
- 48:26Protein. Yes, Kathleen.
- 48:28Yeah, I'm already kind of not feeling today, reply OK.
- 48:36It's bring 6 out of nine Holy SH 06.9 out of 10.
- 48:41No, I told you I got. I know, but that.
- 48:45Sucks. She's looking at my ankle on and
- 48:51yeah, I got bit up by I don't even know how many freaking
- 48:57ticks I had on me, but my ankle alone has probably got like 50.
- 49:05It looks. Rough.
- 49:06It's really bad and it's all over it, literally from head to
- 49:11toe. That'll be scars too, at least a
- 49:13few of them. Because.
- 49:14Oh, I know it's bad. It's really bad.
- 49:18That's mad tough, man. I know, sorry, I'm definitely
- 49:22not going to get a massage or anything soon because that's
- 49:26just embarrassing to then have like tick bites all over me.
- 49:30I did that when we went to Eureka Springs at the Crescent
- 49:34Hotel. I had a massage there and I had
- 49:37tick bites on my back there. I thought you said that you're a
- 49:41massage therapist. Doesn't even lift or take off
- 49:44the towel. Or well she doesn't but I have
- 49:47tick bites everywhere where else too and she does like touch my
- 49:51legs and stuff like that but. Well Dang, you need to go in
- 49:54there soon though so I can figure out what's going on with
- 49:56the pole dancing. It's hard to it's hard to figure
- 49:59it out from the website. And they also do the aerial
- 50:03acrobatics. Yeah, I'd like to learn that
- 50:04eventually, but I'm poor. I want to focus on one thing at
- 50:07a time. Yeah, ticks scare the heck out
- 50:10of me. And maybe yesterday my husband
- 50:15pulled up at the same area where I got the ticks to walk the dog
- 50:19doing something and I was like, no, oh, OK, goat's.
- 50:21Doing something? Take him.
- 50:23The puppy is by himself because my son is at work and my husband
- 50:28is at a funeral. So, Flinnigan, can you just take
- 50:33him out please? OK.
- 50:37That way he doesn't pee on my floor.
- 50:39I'm going to put oats in the Laura's chair real quick.
- 50:44Oh, well, I guess not. He decided to take off.
- 50:48Yeah, Lyme's disease is very scary.
- 50:52I have Alpha Gal, a tick borne illness that makes you allergic
- 50:58to mammal products. So yeah, life is fun.
- 51:03I'm sitting here scratching my foot.
- 51:06It's just so bad. I need to go put some more
- 51:09cortisone on. OK, let's see.
- 51:14It's pretty bad when cortisone is my regiment instead of
- 51:19lotion. Now I think we're going to go
- 51:23for another 9 minutes and then we're going to get off because
- 51:28the dog is only good for so long by himself and I don't want to
- 51:34push it. I don't want him to eat my new
- 51:37couch or fairly new couch. So, OK, we're going to get back
- 51:44into this. I'm going to start on, well,
- 51:52we're just going to go to 10 now.
- 51:54Did you pinpoint the time that According to him that Tina was
- 51:59there? Yes, he said that it was around
- 52:015:30. And he knew it to be that
- 52:04because there was this movie on Toby Tyler spelled phonetically,
- 52:08and it was about halfway over and it came on at 5.
- 52:12It's a Walt Disney show, and it goes off at six.
- 52:16And he said it was after the movie was half over that she
- 52:19came. So it was after 530.
- 52:23OK. And you did talk to his wife?
- 52:26Yes, I did. When she returned, I talked to
- 52:29her prior to talking to Harvey that day.
- 52:33The second I 3rd, I believe. Second, I was over to her house.
- 52:39Either that or the third I think.
- 52:41I don't remember the day I talked to her.
- 52:44Did you talk? And then?
- 52:47OK, Oates is going crazy, Joy says.
- 52:53I love dogs but wouldn't want one.
- 52:54Too much work. Yeah, too.
- 52:57Way too much work. And I told my husband this is
- 53:01his dog, technically, so he has to be the one in charge.
- 53:06And then he ends up going everywhere and leaving me in
- 53:09charge. Oh, well, Flynn is absolutely
- 53:12adorable, but he's definitely hard to manage.
- 53:18OK, Oh, let's get up here, sit up here and quit being a menace
- 53:24to society. OK.
- 53:31I talked to her prior to talking to Harvey that day.
- 53:34The second, the 3rd I believe second I was over to her house.
- 53:38Either that or the third I think I don't remember the day I
- 53:42talked to her. Did you talk and then did you
- 53:44talk to her about the garbage? Yes I did.
- 53:47She was surprised at what he did on the garbage.
- 53:51Yes she was. And say she ever done.
- 53:56She say he ever done that before.
- 53:59She said he hadn't ever done that as far as taking the trash
- 54:04away. And he had also told me that the
- 54:07reason he took it to the dumpster was because the dogs
- 54:10tore it up. So I approached her on that and
- 54:14said, well, wouldn't the dogs have tore the bags up if he
- 54:17hadn't have taken it? She says no, they didn't have
- 54:20any problems with the dogs. So it contradicted what he had
- 54:25told us. So, Mr. Tannery, that's all I
- 54:30have, Your Honor, the court, anything else?
- 54:34OK, so we're going to actually stop at the RE cross
- 54:37examination. I know we usually go longer, and
- 54:40I'm sorry guys, but until I have a actual babysitter for the dog
- 54:46without a Laura having to go up there and do it, we have to be a
- 54:53little mindful of that. I definitely don't want my couch
- 54:56eaten. OK, so let me take that off and
- 55:05let me fix that. Sorry, guys.
- 55:09Joel wants us to use these layovers to be more
- 55:11professional, so I'm trying, you know?
- 55:15It is what it is. Hey, Red Feather, I'm sorry
- 55:18you're joining us late. We're about to call it quits
- 55:22because my dog is was unattended.
- 55:25Elora had to run up there and make sure that he wasn't getting
- 55:29into anything or chewing my couch.
- 55:32But so next week we I'm not going to be here.
- 55:39I'm hoping Elora will want to do a live stream but I'm not going
- 55:44to be here because my nephew is graduating from basic training.
- 55:48I'm so proud of him. I did not think that he would
- 55:52even make it this far. So I am super, super proud of
- 55:57him. Phoenix, you rock.
- 55:59I'm proud of you. So that's where I will be.
- 56:02I will be at Fort Sill watching a basic training graduation,
- 56:06which just happens to be my hometown.
- 56:09So while I'm there, I will do a little bit more investigating on
- 56:13the lot and serial killer, Athena Hogan, Michelle Crawford
- 56:17and hopefully Kim Kimberly Damberville as well, which could
- 56:25or could not be related to the lot and serial killer.
- 56:29But yeah, so that's what I'm going to be doing.
- 56:32And just know that there is some very interesting things brewing
- 56:38in the background. I know next month towards the
- 56:45end of the month, there'll be something coming out that I
- 56:49participated in, not something that is my project, but
- 56:53something that I have participated in and a couple of
- 56:56other people have participated in and I'm really excited to see
- 57:01how that turns out. Let's see what else, What else,
- 57:07What else? I can't think of anything else
- 57:12at the moment, but please just remember that MBR exists to, to
- 57:26help people, to help veterans, first responders, and even
- 57:30active duty get out of our heads.
- 57:35And, and I'm just so thankful for military broadcast radio and
- 57:41what they've done for me. So thank you, Joel, and I hope
- 57:44you're having a good time right now with your granddaughter and
- 57:49I hope everybody has a really great week and you go out and do
- 57:53something good to change the world for the better.
- 57:56Oh, and go watch Nancy Simpson's The Toll.
- 58:00I've been on a few live streams with them the last few weeks, so
- 58:04go check that out. And on Monday I will be doing an
- 58:10interview with another host on MBR.
- 58:14She will be interviewing me so lots to come.
- 58:19So with all that being said, have a wonderful evening and
- 58:23like I said, go out and do something good to change the
- 58:25world for the better. Bye everybody.
