- 6:31Speaker 4: deposed before?
- 6:32Speaker 1: Yes?
- 6:33Speaker 4: I had on how many occasions?
- 6:34Speaker 1: On what? And when?
- 6:36Speaker 14: Was that?
- 6:37Speaker 1: Uh too best marri Galastcan. That was back in between
- 6:42Speaker 1: the period nineteen ninety to nineteen ninety three?
- 6:51Speaker 4: And what was the were you party to that lawsuit?
- 6:54Speaker 1: I was a plaintiff in that lawsuit?
- 6:56Speaker 2: And what was that law?
- 6:57Speaker 1: What was the subject under that lost subject matter was
- 7:00Speaker 1: the university?
- 7:01Speaker 6: I had been attending grad school and uh, there was
- 7:05Speaker 6: a suit brought against the school and certain.
- 7:09Speaker 1: Parties of that school.
- 7:11Speaker 10: And what were the allegations in mess to allegation or
- 7:14Speaker 10: slender Agnar's conspiracy charge.
- 7:20Speaker 4: Do you recall what court that lawsuit was in.
- 7:23Speaker 1: I can tell you that it was in I believe
- 7:26Speaker 1: the Virginia Beach area. Okay.
- 7:32Speaker 4: And do was that lawsuit ultimately settle or did it
- 7:35Speaker 4: go to trial? Yeah?
- 7:36Speaker 1: It went to trial then it was dismissed. Uh, good
- 7:39Speaker 1: way through a trial, sister old tups.
- 7:42Speaker 4: Will you move your microphone down? It's turned over on.
- 7:45Speaker 1: The lit summer that thing? Would you like it over here?
- 7:49Speaker 4: That would be okay, thank you?
- 7:57Speaker 6: And what university was that I could Tealigerate referred to
- 8:01Speaker 6: or prior to the trial as uh CBN University.
- 8:06Speaker 1: Uh in the midst and the course of action they
- 8:08Speaker 1: changed the name to Regent University.
- 8:16Speaker 4: And what were you studying at Region University?
- 8:18Speaker 1: The best recollection? It was film studies as well as
- 8:23Speaker 1: drama and that aquted course of answer of writing?
- 8:37Speaker 4: And was that an undergraduate program or a graduate or
- 8:39Speaker 4: graduate studies?
- 8:40Speaker 1: Okay?
- 8:41Speaker 10: Now one we jumped right in, So let me back
- 8:45Speaker 10: up al briefly and and UH talk a little bit
- 8:49Speaker 10: about the rules of the road here. Although this looks
- 8:54Speaker 10: somewhat like a meeting, it is not. Uh, you realize
- 8:58Speaker 10: you're under oath as if you were in court.
- 9:02Speaker 6: I A yes or no?
- 9:04Speaker 4: Oh, I'm sorry, yes, okay.
- 9:06Speaker 1: Uh.
- 9:06Speaker 4: The court reporter is taking down everything we say, and
- 9:09Speaker 4: his record is.
- 9:10Speaker 10: The official record of this deposition, and that has two
- 9:13Speaker 10: important implications.
- 9:15Speaker 4: The first is it's very important that we not talk
- 9:17Speaker 4: over each other. So although often you will know exactly
- 9:21Speaker 4: where my question is going, it's important that you let
- 9:23Speaker 4: me finish my question before you answer. You'll also probably
- 9:27Speaker 4: wanna give a brief moment just in case.
- 9:29Speaker 10: Your your attorney may want to object and n before
- 9:33Speaker 10: you answer by the same token, I will do everything.
- 9:37Speaker 4: I can not to jump on the end of your
- 9:39Speaker 4: answer with my next question. Does that make sense?
- 9:42Speaker 1: Okay?
- 9:43Speaker 10: The other important implication of the fact that the court
- 9:47Speaker 10: reporter is taking everything down is that.
- 9:49Speaker 15: You will uh need to answer with words uh whatever
- 9:54Speaker 15: The answer is a yes, a no, and I don't
- 9:58Speaker 15: know or a longer explanation, but uh huh and uh
- 10:01Speaker 15: uh and headshakes don't reflect on the record.
- 10:05Speaker 4: Does that make sense?
- 10:06Speaker 1: Of course?
- 10:06Speaker 9: Okay?
- 10:09Speaker 10: A few other uh rules here anytime you need a break,
- 10:14Speaker 10: just take one, uh ask me first, but.
- 10:17Speaker 4: We'll take one.
- 10:18Speaker 10: The only uh, the only caveat would be that, uh,
- 10:22Speaker 10: if there's a question pending, I'll ask you to answer
- 10:26Speaker 10: the question before we take a break.
- 10:27Speaker 4: Okay, okay, And.
- 10:31Speaker 10: UH if you don't understand my question, please ask me
- 10:37Speaker 10: to rephrase it.
- 10:38Speaker 4: If you answer my question, I'll presume you understood it.
- 10:41Speaker 1: Okay, okay. Uh.
- 10:43Speaker 4: At the conclusion of this deposition, Uh, the court reporter
- 10:47Speaker 4: will compile the testimony into a booklet. You'll have the
- 10:50Speaker 4: opportunity to review that booklet and make any changes.
- 10:54Speaker 9: Uh.
- 10:55Speaker 10: However, if you do make changes or corrections, I'll have
- 10:58Speaker 10: the I'll be able to comment that is at trial.
- 11:00Speaker 4: So we'll need your best testimony today. Okay, absolutely, okay.
- 11:04Speaker 10: And then lastly, uh, well we may it uh be well.
- 11:11Speaker 10: I may ask you for questions for which you don't
- 11:14Speaker 10: know the precisely answer. I don't want you to speculate,
- 11:19Speaker 10: but I am a title to.
- 11:20Speaker 4: Your best estimate and your best recollection. And do you
- 11:23Speaker 4: understand the distinction?
- 11:25Speaker 1: Yes, Okay.
- 11:31Speaker 10: Now we were talking about, uh, your your studies at
- 11:35Speaker 10: Regent University. Did you complete that program?
- 11:39Speaker 1: I was not able to.
- 11:41Speaker 4: And when did you leave.
- 11:44Speaker 1: Regent the best of my recollection, that was nineteen eighty eight.
- 11:55Speaker 4: And when you say you were not able to wait.
- 12:01Speaker 1: To say my studies were terminated.
- 12:11Speaker 4: By the university?
- 12:12Speaker 1: Yes, and on what grants? That's the difficult part to answer, uh,
- 12:29Speaker 1: and every hard that's the reason for the tribe.
- 12:33Speaker 4: What grounds were stated to you?
- 12:37Speaker 6: It was suggested to me the best amount knowledge that
- 12:41Speaker 6: I had volunteered to in my studies, and.
- 12:47Speaker 4: That was not true.
- 12:50Speaker 1: From my perspective and from what I don't it is
- 12:52Speaker 1: not true.
- 13:00Speaker 4: What do you believe the reason your studies were terminated
- 13:03Speaker 4: to be?
- 13:06Speaker 6: The studies were terminated, to the best of my knowledge
- 13:09Speaker 6: because of the incident that occurred with their associate.
- 13:13Speaker 1: Dean, which that you don't about to be public. And
- 13:20Speaker 1: what was that in.
- 13:23Speaker 4: That is it's the approacherate.
- 13:26Speaker 1: On that the trip alone, which was against school policy or.
- 13:41Speaker 10: Yeah, And other than this deposition in your lawsuit against
- 13:45Speaker 10: Regent University.
- 13:47Speaker 4: You've never been to post now there are otherwise been deposed, correct,
- 13:51Speaker 4: so best my knowledge that.
- 13:52Speaker 12: Ever, other than your lawsuit against Regent University, if ever
- 13:59Speaker 12: been a party to a lot suit, there.
- 14:04Speaker 1: Was a suit fraud against the paper that was allowed
- 14:15Speaker 1: to come to the trial.
- 14:20Speaker 16: That energy in the selling and the suit brought by you. Yes,
- 14:34Speaker 16: what was that paper the Virginia Pilot. I believe it's
- 14:39Speaker 16: the correct name of paper.
- 14:45Speaker 4: And what were your allegations against the Virginia.
- 14:48Speaker 6: Pilot false for the best of my knowledge, false recording
- 14:55Speaker 6: which least the detrimentals of my character?
- 15:08Speaker 10: And you said that matters settled, they agreed to retract.
- 15:14Speaker 10: Was there any money paid play a mass for anybody?
- 15:29Speaker 17: Alright?
- 15:29Speaker 4: Mis er old house? How did you prepare for your
- 15:31Speaker 4: definition today?
- 15:39Speaker 1: I have agreed to talk with my attorney.
- 15:42Speaker 4: Did you play in together?
- 15:45Speaker 1: We flew in together?
- 15:49Speaker 10: About how long did you discuss the matters that would
- 15:53Speaker 10: straight babu?
- 15:54Speaker 4: How long did you was your discussion with your attorney
- 15:58Speaker 4: related to preparation.
- 15:59Speaker 6: For your domination?
- 16:02Speaker 1: I'd said it was pretty.
- 16:02Speaker 4: Brief, more than half an hour?
- 16:09Speaker 1: All at all? Containment? Say not okay?
- 16:15Speaker 4: And uh did you review any documents in preparation for
- 16:20Speaker 4: your deposition?
- 16:24Speaker 6: To best knowledge? Basically only uh lae I was asked
- 16:27Speaker 6: to look at and I did?
- 16:31Speaker 1: And what was that block entry?
- 16:38Speaker 4: And that was the truth about the matrix?
- 16:40Speaker 10: I believe that's the time, right, and that's the only
- 16:46Speaker 10: document you reviewed in preparation for your deposition your reledge, Yes, yeah,
- 16:52Speaker 10: And other than your attorney, did you discuss your deposition
- 16:55Speaker 10: with anyone?

- 16:59Speaker 1: to be one with friends.
- 17:12Speaker 4: That's your old times. Are you currently employed? I am

- 35:00Speaker 4: Do you know who owns the rights? And Church Wars?
- 35:07Speaker 1: If I had a contract that it lists the information
- 35:09Speaker 1: that did not know much of me or that alright?
- 35:14Speaker 4: And then after Church Well, let me ask you this,
- 35:18Speaker 4: how did that contract come about?
- 35:21Speaker 1: The parties?
- 35:22Speaker 6: There were parties company and it came to me and

- 36:14Speaker 4: Have you ever received compensation for script?
- 36:16Speaker 1: Right? I believe I have, if it difficult to recall
- 36:19Speaker 1: them at this time, but I would certainly try.
- 36:25Speaker 4: Can you think of any event.
- 36:30Speaker 10: The one with Colonia Waitsburg starts and that was that
- 36:35Speaker 10: was for a play rather than a screen or a screenplay?
- 36:38Speaker 1: Or was that first cause a script for to be
- 36:43Speaker 1: as part of the production. What do you mean production?
- 36:51Speaker 4: I'm just trying to understand.
- 36:52Speaker 10: Are we talk of live theater? Well, ud stand, I'd
- 36:54Speaker 10: see to trying to add what the best of my
- 36:55Speaker 10: bene that's fun?
- 36:58Speaker 4: Or is that live theater or.
- 37:01Speaker 5: Or was something else?
- 37:02Speaker 1: This particular one was.
- 37:06Speaker 6: A more or less an exhibit, but also a program
- 37:11Speaker 6: that accompanied the exhibit, So it was compositive different things
- 37:16Speaker 6: that involved casting in and having a live performance along
- 37:21Speaker 6: with the exhibit, but also an exhibit that needed to
- 37:24Speaker 6: be read that would r recycle throughout the exhibit have
- 37:32Speaker 6: been played over and over.
- 37:39Speaker 10: Can you think of any examples, any additional examples other
- 37:42Speaker 10: than the Colony of Williamsburg and church Wars.
- 37:46Speaker 4: For which you've been compensated for stomatic.
- 37:57Speaker 1: Why are we talking to children's program too? Sure? I
- 38:02Speaker 1: was asked to write children's programming for a company on
- 38:08Speaker 1: MALOI two. And what company was that? Maloy Academy of
- 38:19Speaker 1: Performing Arts?
- 38:21Speaker 4: And when was this?
- 38:23Speaker 1: I believe this would be the theory between two thousand
- 38:27Speaker 1: and two, roughly two roughly two thousand and six.
- 38:35Speaker 4: And what did you what programming did you write for
- 38:38Speaker 4: the Maui Academy.
- 38:40Speaker 1: Of Performing Arts, the children's musicals or programs that were
- 38:45Speaker 1: then towards throughout the state of Await.
- 38:55Speaker 4: And are you still associated with the Maui Academy of
- 38:57Speaker 4: Performing Arts?
- 38:58Speaker 1: Well, I had the grammar.
- 38:59Speaker 10: They so you left the Mali Academy of Performing Arts
- 39:06Speaker 10: in two thousand and six.
- 39:09Speaker 1: I just I was just continued there and went to
- 39:13Speaker 1: and continue at the Y andCA, and then then that
- 39:15Speaker 1: they that really also mkay.
- 39:17Speaker 4: Let's uh, let's sort of break that down a little bit.
- 39:30Speaker 4: Let's start.
- 39:31Speaker 10: I just wanna get an understanding of your employment history.
- 39:35Speaker 10: So you left Regent nineteen eighty eight, what happened then.
- 39:46Speaker 6: About your region? Correct, I was continuing to perform. I
- 39:55Speaker 6: was hired at Colonia Waisburg to do night and evening
- 39:59Speaker 6: per program then also the day programming. And I was
- 40:04Speaker 6: also had been employed there also to come up with programming.
- 40:10Speaker 6: So you were both a performer and the belsty programming.
- 40:14Speaker 1: Okay.
- 40:16Speaker 4: And how long were you at Colonia.
- 40:17Speaker 6: Williams or the best of my knowledge, I was there
- 40:20Speaker 6: from nineteen ninety two or three right in there.
- 40:32Speaker 1: To nineteen ninety six I believe, and then back again
- 40:43Speaker 1: leaving in two thousand and two.
- 40:49Speaker 6: I believe there were a national Shakespeare's Wars in between that,
- 40:52Speaker 6: and also Shakespeare festivals and other epinias.
- 40:57Speaker 4: So what did you do between nineteen eighty eight and
- 40:59Speaker 4: nineteen ninety two?
- 41:09Speaker 1: I was writing, I was in the drawn out litigation,
- 41:26Speaker 1: I was performing, kay.
- 41:38Speaker 10: So then Colonial Williamsburg from ninety six, then you've left
- 41:42Speaker 10: to go to Shakespeare set what was under a yearly.
- 41:45Speaker 1: Contracts to performed Shakespeare internationally.
- 41:49Speaker 4: For how long?
- 41:50Speaker 1: There were two years that I five went on the
- 41:52Speaker 1: Roadtory okay.
- 41:54Speaker 4: And and then you went back to Williamsburg until two
- 41:58Speaker 4: thousand and two.
- 41:59Speaker 1: I was invited went back and customas.
- 42:02Speaker 4: And then what happened in two thousand and two, I
- 42:05Speaker 4: was invited out.
- 42:06Speaker 6: By after performing on tours by Elders and Hawaii that
- 42:15Speaker 6: had won awards in singing, and I took the offer.
- 42:23Speaker 1: To come out.
- 42:26Speaker 4: And the offer was from.
- 42:27Speaker 1: Whom Kaylie Rochelle and his partner. And what was the
- 42:32Speaker 1: offer for? They simply wanted me to have the experience
- 42:35Speaker 1: and succeed where they had being fella artists.
- 42:45Speaker 4: So were you employed by them?
- 42:47Speaker 1: No? They were simply doing it cause that's what they do.
- 42:54Speaker 4: But did they pay you.
- 42:57Speaker 5: Nope? Okay.
- 42:58Speaker 6: They had me come out and ready to for me
- 43:00Speaker 6: to got me up in a hotel and things like that,
- 43:02Speaker 6: and helped me get established on the island.
- 43:04Speaker 1: Okay, So.
- 43:10Speaker 4: When was the next what? What did you do once
- 43:13Speaker 4: you got to the island? I was unemployment and lived.
- 43:17Speaker 4: Did you find?
- 43:19Speaker 6: I started off with the YECA working with children, did
- 43:22Speaker 6: you swimming life guardy I also was hired immediately, basically
- 43:29Speaker 6: immediately by the Yale Theater at that time. I was
- 43:34Speaker 6: cast in the show immediately, the Fantastics, and they then
- 43:38Speaker 6: asked to hire me on at the theater so I
- 43:40Speaker 6: could committe to do shows.
- 43:44Speaker 4: In the And did you go to work for the theater?
- 43:46Speaker 1: I certainly?
- 43:48Speaker 4: And how long were you moved at the theater at
- 43:50Speaker 4: the Yale Theater?
- 43:51Speaker 1: I worked from That's my regulation was two thousand and
- 43:56Speaker 1: two to about It was like I believe in about.
- 44:03Speaker 4: Two years okay. And why did you leave?
- 44:15Speaker 1: I was invited to.
- 44:16Speaker 6: Be hired or asked to be signed on that malaccady
- 44:19Speaker 6: before the Arts to do their programming in tours.
- 44:22Speaker 10: Okay, and that was through two thousand and six, right
- 44:30Speaker 10: the best of my knowledge of this time, I guess.
- 44:32Speaker 4: And and why did you leave the Malay Academy of
- 44:34Speaker 4: Performing Arts.
- 44:48Speaker 1: The best of my knowledge because I.
- 44:51Speaker 6: Being a tour manager, I brought forward a situation that
- 44:55Speaker 6: was ongoing between their one of their middle people home.
- 45:02Speaker 1: And children youth that were part of the academy.
- 45:15Speaker 4: And as a result of bringing forward that situation, you were.
- 45:18Speaker 6: Terminated because I brought for the information that was involving
- 45:21Speaker 6: drugs and other things that were on jelling.
- 45:24Speaker 1: They thought it best at.
- 45:25Speaker 5: That as scientist's clay, So I go drown to do ah.
- 45:42Speaker 1: For your own company?
- 45:47Speaker 4: And was that Heart Tours?
- 45:49Speaker 9: That's right?
- 45:50Speaker 4: And how long was Heart Tours something?
- 45:54Speaker 1: The best of my olity was two and a half years.
- 45:58Speaker 10: Okay, So now we're up to two thousand nine ish,
- 46:04Speaker 10: I suppose did you sign anything with the Malay Academy
- 46:08Speaker 10: of Performing once when you left as a confidentality roamers?
- 46:12Speaker 1: You know most one year olds at all?
- 46:14Speaker 5: Okay?
- 46:29Speaker 4: So then what can two thousand and where did you.
- 46:33Speaker 1: Go to work? Always continued to work at the YCA okay,
- 46:37Speaker 1: and always continued to perform.
- 46:49Speaker 4: From two thousand nine until last year when you started
- 46:52Speaker 4: the Grand Yla. Did you have any other employment?
- 47:02Speaker 1: I did many different shows, anything else? I would do
- 47:10Speaker 1: whatever I could? What would do? Yard work? I do
- 47:24Speaker 1: just like whatever I can.
- 47:47Speaker 4: What is Crossroads?
- 47:52Speaker 1: Crossroads is a musical that I can see during my time? No,
- 47:58Speaker 1: I can't informing arts when they have show drop out
- 48:05Speaker 1: on them. You know I've owned I said, I had
- 48:07Speaker 1: one of my own ideas I was developing.
- 48:10Speaker 4: Okay, And did you write the music for Crossroads?
- 48:18Speaker 6: Music was basically in Limerick fashion, so it wasn't really
- 48:24Speaker 6: music that was composed.
- 48:30Speaker 4: Did you rely on any existing pre existing music for Crossroads?
- 48:41Speaker 1: Not that I can think?
- 48:41Speaker 5: Are well?
- 48:43Speaker 1: What do you mean?
- 48:43Speaker 4: It was in Limerick fashion?
- 48:47Speaker 1: The characters were pirates.
- 48:48Speaker 6: And they're singing a diddy basically, and so it was
- 48:52Speaker 6: left up to the best performers to create whatever s
- 48:54Speaker 6: whatever sound we wanted was never set down from my knowledge.
- 49:00Speaker 4: So y there was never any like sheet used to
- 49:03Speaker 4: creative Is that correct?
- 49:05Speaker 6: I'm not aware of this time doesn't mean there wasn't,
- 49:07Speaker 6: but I'm not aware of it. I simply was singing
- 49:10Speaker 6: what came to my mind that that very well could
- 49:16Speaker 6: be somebody could something.
- 49:17Speaker 1: Down, but I wasn't attending nine.
- 49:37Speaker 4: When is Arlington Rabbit?
- 49:40Speaker 1: I thought the musical I wrote for children?
- 49:43Speaker 4: And did you write the music for that?
- 49:46Speaker 1: I composed the music for that, that's say, hm, I
- 49:52Speaker 1: had the help of a composer. And who was that composed? Well, actually,
- 49:59Speaker 1: uh yeah, mister pumping started saying, and who was that?
- 50:03Speaker 1: His name is Patrick Brown?
- 50:07Speaker 4: And did you have some sort of agreement with mister Brown,
- 50:11Speaker 4: like a rid agreement.
- 50:14Speaker 1: I got to check recons and see. I talked to him.
- 50:17Speaker 6: He was very excited about the piece that wants to
- 50:20Speaker 6: go continue with music. It's been talking to me about
- 50:23Speaker 6: arranging something so we can go forward.
- 50:33Speaker 4: And to your knowledge, was the music mister Brown composed
- 50:40Speaker 4: original for Farlington Robin can.
- 50:43Speaker 1: You rephrase the question. You're saying he composed it.
- 50:46Speaker 4: I'm sorry it sounds like you're saying you composed it. Okay,
- 50:49Speaker 4: you composed the music for Farlington Robin.
- 50:51Speaker 1: I came up with the sounds and the songs, okay.
- 50:55Speaker 4: And and those songs were original to you.
- 50:59Speaker 1: See, best of my know was the original with me?

- 51:08Speaker 1: Is that correct? My wife registered it. I'm not sure
- 51:11Speaker 1: what referring to, mkay.
- 51:14Speaker 10: Is there a reason why you didn't do you excluded
- 51:16Speaker 10: the music from your registration?
- 51:18Speaker 1: Why was it involved in the registractural process?
- 51:20Speaker 4: That would be your wife?
- 51:21Speaker 1: I saw you did it. Can you tell me a

- 1:11:51Speaker 4: Uh how did you get interested in screen riding?
- 1:11:56Speaker 1: That's a good question. I've always fascinated by film.
- 1:12:03Speaker 6: Stories and found I had an aptitude at an early
- 1:12:08Speaker 6: age that was pointing out to me.
- 1:12:12Speaker 1: Was encouraged to create stories, and uh, throughout my academic site.
- 1:12:18Speaker 6: I did and was told they were unique and.
- 1:12:24Speaker 1: To continue. I I thought of it too as a way.
- 1:12:41Speaker 6: That could from change or hope, and it struck me
- 1:12:48Speaker 6: that it really was the one vehicle to have a
- 1:12:53Speaker 6: voice that might encourage or effect change. And that is
- 1:12:57Speaker 6: really what encouraged me to developed my talents and see
- 1:13:01Speaker 6: if I could write a piece that would expect or encourage, likely.
- 1:13:09Speaker 1: Like a chip.
- 1:13:11Speaker 10: And when you say write a piece that would affect
- 1:13:14Speaker 10: or encourage, we were talking about the Immortals.
- 1:13:16Speaker 1: The Immortals is definitely the the pinnacle of that endeavor
- 1:13:22Speaker 1: at that time.

- 1:13:43Speaker 1: pretty disappointed in a lot of things. I was that
- 1:13:46Speaker 1: I did see.
- 1:13:49Speaker 6: If I thought, there must be another way to approach it,
- 1:13:53Speaker 6: there must be a better way to tell a story
- 1:14:01Speaker 6: out there. I had been told in school, did every
- 1:14:05Speaker 6: idea basically that it had never been done, already be done.
- 1:14:09Speaker 6: Then I didn't embrace that idea. So I looked for
- 1:14:16Speaker 6: something that would a factory challenge the thinking of the world,
- 1:14:24Speaker 6: something that would be a challenge to be.
- 1:14:28Speaker 1: And I found that any worlds, I found something that
- 1:14:31Speaker 1: was probably a a great challenge that after you met
- 1:14:36Speaker 1: it could be that.
- 1:14:57Speaker 4: Have you ever seen any Star Wars films?
- 1:15:01Speaker 1: I saw the Star Wars films when the first one out.
- 1:15:15Speaker 4: The original three. The good ones.
- 1:15:18Speaker 1: Well done.
- 1:15:22Speaker 6: I thought the first one was the most effaculty. It
- 1:15:26Speaker 6: seemed new that was hadneological aspects, were brilliant. They told
- 1:15:31Speaker 6: a story, was compelling and timely to the audiences of
- 1:15:35Speaker 6: that time. Seen you rich in their hearts and rich
- 1:15:39Speaker 6: exactly what ange?
- 1:15:40Speaker 1: Do youar?
- 1:15:41Speaker 17: What one is?
- 1:15:41Speaker 4: A year? And you saw at least the first one
- 1:15:49Speaker 4: in the theater?
- 1:15:50Speaker 6: I I saw the first one, believe it or not,
- 1:15:52Speaker 6: of the drive on he still had those. The funny
- 1:16:00Speaker 6: game is actually walked into it.
- 1:16:03Speaker 1: Cause I was dropped off, so I walked in and
- 1:16:05Speaker 1: join my friends.
- 1:16:09Speaker 4: Did you ever see two thousand and one of space? Honesty?
- 1:16:12Speaker 1: I can? My dad can me to see when I
- 1:16:16Speaker 1: was young?
- 1:16:23Speaker 4: Have you seen any of the Terminator movies?
- 1:16:26Speaker 1: So I could see the Terminator movies?
- 1:16:30Speaker 4: Did you see those in theaters?
- 1:16:34Speaker 1: I saw those on video?
- 1:16:36Speaker 19: I belie?
- 1:16:42Speaker 4: Did you ever see Blade Rinner?
- 1:16:44Speaker 1: I saw that, Monny.

- 1:20:27Speaker 1: But I'm aware else?
- 1:20:30Speaker 4: And Uh, prior to engaging mister Rankin to represent you
- 1:20:36Speaker 4: in this matter? Uh, did you contact any other attorneys?
- 1:20:42Speaker 3: Just a me objection by why do you think this
- 1:20:45Speaker 3: is relevant or calculated to me to discovery your relevant evidence?
- 1:20:49Speaker 4: Well? Uh, among other things. There are some limitations and
- 1:20:56Speaker 4: latches issues here.
- 1:20:59Speaker 17: Uh, so.
- 1:21:02Speaker 1: Go ahead at this time I'm not aware.
- 1:21:06Speaker 4: Of Well, let me ask you this again. Did you
- 1:21:11Speaker 4: try to find a lawyer? Did you do anything to
- 1:21:13Speaker 4: try to find the lawyer before you contacted the story?
- 1:21:18Speaker 1: We told our friends at the party that we were
- 1:21:20Speaker 1: we would need to find representation. What party was this?
- 1:21:25Speaker 6: After we had our discovery, we had a party to
- 1:21:29Speaker 6: inform our friends where we had discovered and found.
- 1:21:34Speaker 4: Kay, And what do you mean after we had our discovery.
- 1:21:43Speaker 1: When I had seen the images on the it's website,
- 1:21:49Speaker 1: I why way can I share about it? And then
- 1:21:53Speaker 1: we had a we had a gathering I guess a
- 1:21:56Speaker 1: month or so later and shared what we had found out.
- 1:22:01Speaker 4: Kay, And you said when you said, seen the images
- 1:22:03Speaker 4: on the website? What website?
- 1:22:05Speaker 1: I'll have to find what the website was. I just
- 1:22:08Speaker 1: know what. I know what the picture was and what
- 1:22:10Speaker 1: the pictures were. What was what were the pictures?
- 1:22:14Speaker 6: There was a picture of a little girl, uh it
- 1:22:17Speaker 6: set santy at the train station with Neo laying down
- 1:22:23Speaker 6: facing her, and I mean there's a train sign or
- 1:22:27Speaker 6: a station signed in the back of it.
- 1:22:30Speaker 1: And then below it was a picture of the little
- 1:22:33Speaker 1: girl of the.
- 1:22:35Speaker 6: Safty character pointing I guess towards the sun with the
- 1:22:39Speaker 6: por goal from the Major's film in the picture. And
- 1:22:50Speaker 6: what do you even recall what kind of website this
- 1:22:52Speaker 6: web I'd have to look into what that website was.
- 1:22:56Speaker 1: I just know it was very impactual and the it
- 1:22:59Speaker 1: it hit me when I saw the images, I was.
- 1:23:02Speaker 4: Just like.
- 1:23:05Speaker 6: Absolutely thrown away. I was totally affected and shared with
- 1:23:09Speaker 6: my life immediately it was the main images that I
- 1:23:17Speaker 6: had come up with my for my own play.
- 1:23:23Speaker 1: Or some of those main images.
- 1:23:30Speaker 4: Do you recall even what you were looking for when
- 1:23:33Speaker 4: you came across these images?
- 1:23:34Speaker 1: No, I was simply trying to for the best of
- 1:23:37Speaker 1: my knowledge, I was simply just on the web.
- 1:23:46Speaker 6: I made been nothing about and just I don't know,
- 1:23:49Speaker 6: I can't answer or not. And when was it, to
- 1:23:56Speaker 6: the best of my knowledgees was uh in February.
- 1:24:01Speaker 1: Twenty ten. I'm not mistaken around there?
- 1:24:12Speaker 10: Okay, So you see these two images of the Sawty character,
- 1:24:19Speaker 10: one in the train station one point two.
- 1:24:22Speaker 1: Yes, there was a text with it too, was explaining it.
- 1:24:28Speaker 4: Prior to that time? Had you seen any of the
- 1:24:31Speaker 4: Matrix movies?
- 1:24:33Speaker 1: I had seen partially, I say partially the first one.
- 1:24:47Speaker 4: And when did you see the partially the first Matrix pis?
- 1:24:50Speaker 1: And that was when I was, I believe, on tour
- 1:24:54Speaker 1: on the Shakespeare Tour, the National Tour.
- 1:25:03Speaker 4: So somewhere in the late nineteen nineties.
- 1:25:06Speaker 6: I wouldn't say it was around I I was on
- 1:25:10Speaker 6: tour in nineteen ninety nine, I believe through who I
- 1:25:13Speaker 6: did two years, so it be nineteen ninety nine two thousand, Holid.
- 1:25:17Speaker 1: I think it was ninety nine, ninety to two thousand
- 1:25:19Speaker 1: and one when we're on tour in c Poriod of Contracts.
- 1:25:22Speaker 4: And did you see it in the theater?
- 1:25:24Speaker 1: I believe it was the theater.
- 1:25:32Speaker 10: And when you saw the First Matrix in the theater?
- 1:25:36Speaker 10: Were portions of the First Matrix in the theater? Why
- 1:25:38Speaker 10: did you release thee Kark?
- 1:25:39Speaker 1: Cause I got nauseous, I got sick. I had trouble
- 1:25:44Speaker 1: watching the film.
- 1:25:47Speaker 5: Why was that because of the condition that I have, Well,
- 1:25:51Speaker 5: I'm not.
- 1:25:51Speaker 6: Really supposed to watch foo with films. It caused me
- 1:25:58Speaker 6: to have trouble recollect think and I get very sick
- 1:26:03Speaker 6: when I watch sometimes.
- 1:26:09Speaker 4: How much of the First Matrix did you see?
- 1:26:12Speaker 6: It'd be hard to recall according to my CONDI cause
- 1:26:15Speaker 6: of my condition.
- 1:26:17Speaker 1: I remember being nauseous. I remember that mostly having to
- 1:26:21Speaker 1: leave cause of illness. I was trying to hang out
- 1:26:26Speaker 1: with my friends. They asked me to go see it.
- 1:26:40Speaker 10: Now, when you saw the First Matrix in and around
- 1:26:43Speaker 10: the end of nineteen ninety nine, did you notice at
- 1:26:45Speaker 10: that point, uh, any similarities between your script the Immortals.
- 1:26:53Speaker 1: And the Matrix.
- 1:26:54Speaker 6: The thing that that I can recall that would have
- 1:26:58Speaker 6: considered similar would be that something attaching in the back
- 1:27:01Speaker 6: of the neck that seemed similar.
- 1:27:13Speaker 4: Hm. Did you do anything about that similarity?
- 1:27:18Speaker 1: So I was cause he trying to stay healthy. I
- 1:27:22Speaker 1: didn't see anything that was gonna spark anything beyond that
- 1:27:26Speaker 1: looked like it was similar.
- 1:27:40Speaker 10: Now, the things that are attached in the back of
- 1:27:45Speaker 10: the neck that are in the Immortals, was that your
- 1:27:50Speaker 10: original idea or when you.
- 1:27:53Speaker 4: Wrote that into the Immortals? Had you ever heard of
- 1:27:56Speaker 4: a story in any way that things?
- 1:27:58Speaker 1: Do you? Personally? I had never seen it like it before.
- 1:28:03Speaker 6: From my perspective and standpoint, I can honestly say that
- 1:28:07Speaker 6: to me was original conception material.
- 1:28:15Speaker 1: That element.
- 1:28:23Speaker 10: But in nineteen ninety nine you didn't do anything to
- 1:28:26Speaker 10: bring that to anyone's attention, that similarity between the Immortals and.
- 1:28:31Speaker 4: The First Victories.
- 1:28:32Speaker 1: I don't remember being struck with any idea of doing
- 1:28:34Speaker 1: anything about anything.
- 1:28:35Speaker 9: It was.
- 1:28:36Speaker 1: It was a similarity. In hindsight, I would say it's
- 1:28:44Speaker 1: one of many.
- 1:28:55Speaker 4: And since uh, nineteen ninety nine, have you come to one.
- 1:29:01Speaker 1: Of any.
- 1:29:11Speaker 4: Since nineteen ninety nine, have you come to learn of
- 1:29:13Speaker 4: any other works?
- 1:29:16Speaker 2: Uh?
- 1:29:17Speaker 10: That predate your Immortal Script that also have things attached
- 1:29:22Speaker 10: to the back of the neck.
- 1:29:27Speaker 24: Perceived not not at all. I can't think of anything
- 1:29:30Speaker 24: that lives has anything like that in that location, like
- 1:29:38Speaker 24: sods like a pat to buy off my page.
- 1:30:02Speaker 10: Would you recall how you describe the things in the
- 1:30:06Speaker 10: back of the neck even in your script, and it's
- 1:30:10Speaker 10: in the play clearly the actual language you use to
- 1:30:14Speaker 10: describe the things in the back of the.
- 1:30:16Speaker 6: Right, I would w wish to read it if I
- 1:30:18Speaker 6: was gonna run back it, because I wouldn't wanna.
- 1:30:22Speaker 1: Guess it with my own writing.
- 1:30:24Speaker 4: Suck, Well, what's smart?
- 1:30:37Speaker 5: Were the person?
- 1:30:48Speaker 4: Alright?
- 1:30:49Speaker 10: We've marked as exhibit too a document that begin that
- 1:30:54Speaker 10: is the cover page says the Immortals Tom Summers and
- 1:31:00Speaker 10: excuse me, which is exhibit one to the second amended
- 1:31:05Speaker 10: complaint that.
- 1:31:05Speaker 20: We marked as exhibit one, and it is a hundred
- 1:31:10Speaker 20: and twenty two page Uh screenplay, m and is this
- 1:31:16Speaker 20: your screenplay for the immortals?
- 1:31:18Speaker 1: Unlike believe it is untrusting?
- 1:31:20Speaker 10: Whatever it is, Okay, I'll represent to you that if
- 1:31:23Speaker 10: you see the marks at the top where it starts
- 1:31:26Speaker 10: with case and it says two call one thirteen and
- 1:31:29Speaker 10: goes on from there, that means that I attained this
- 1:31:33Speaker 10: copy of the screenplay from the court file.
- 1:31:37Speaker 4: Okay, and uh and as attached to the second amended complaint.
- 1:31:43Speaker 1: If it's helpful, okay, So can you.
- 1:31:49Speaker 10: Locate for me the description in the screenplay of what
- 1:31:55Speaker 10: the things on the back of the neck are intended
- 1:31:58Speaker 10: to look at?
- 1:32:05Speaker 1: Do you have a story treatment too?
- 1:32:08Speaker 17: What is it helpful?
- 1:32:35Speaker 19: Uh?
- 1:32:35Speaker 10: I don't have it with me.
- 1:32:38Speaker 4: Is it your contention that the screenplay or the story
- 1:32:41Speaker 4: treatment is what we in frenship?
- 1:32:43Speaker 6: It's my thought that it may be in both on
- 1:32:48Speaker 6: documents that maybe we can benefit class in both.
- 1:32:52Speaker 4: Okay, Uh, let me ask again, though, is it your
- 1:32:57Speaker 4: contention that the greenplay is what was copying? What was
- 1:33:03Speaker 4: the story treatment.
- 1:33:06Speaker 1: That was copied?
- 1:33:07Speaker 4: Okay, let's let's back up. What is it your claiming
- 1:33:11Speaker 4: in this lawsuit?
- 1:33:12Speaker 1: I would s I would say that my.
- 1:33:17Speaker 6: My screenplay and my story treatment were source materials and
- 1:33:22Speaker 6: used for the making story intent.
- 1:33:25Speaker 4: Late, I guess, mkay, is your story treatment? Did you
- 1:33:33Speaker 4: ever register the copyright in that?
- 1:33:37Speaker 1: I have to look into cop believe in it.
- 1:33:41Speaker 6: I believe once it's pendants copyrighted, and I believe it
- 1:33:43Speaker 6: was I believe it submitted. I know it's registered, are notorized.
- 1:33:50Speaker 6: You know that the notary notorized the material, witnessed it,
- 1:33:55Speaker 6: that copyrights approved to show who was the first true
- 1:33:58Speaker 6: Uh regilate the materials or the notary when you useful
- 1:34:01Speaker 6: and that also, But do you know when.
- 1:34:04Speaker 4: You have registered the story treatment with the copyright office?
- 1:34:09Speaker 1: I do not know what the respection the copying office
- 1:34:11Speaker 1: as be I can find.
- 1:34:12Speaker 6: Out, but I know that it is tagged as original
- 1:34:17Speaker 6: work from that date with the notary also, so well.
- 1:34:30Speaker 4: I look for an exhibit.
- 1:34:31Speaker 10: I believe the question is is there something in the
- 1:34:34Speaker 10: script that describes the things on the back of the.
- 1:34:39Speaker 6: Guess the only what I'm answering was that I'm I
- 1:34:41Speaker 6: believe both the story treatment and the scriptles have those
- 1:34:43Speaker 6: answers for you, and so yes, And.
- 1:34:54Speaker 4: With respect to the script, can you point me to
- 1:34:56Speaker 4: that language.
- 1:34:59Speaker 1: I believe that there's a number of entries regarding to
- 1:35:03Speaker 1: the hook up to the back of the neck, and
- 1:35:07Speaker 1: I believe our.
- 1:35:10Speaker 6: Complaint has the matchups that address where they're located in
- 1:35:16Speaker 6: which the same as time.
- 1:35:17Speaker 1: So I believe that's been addressed just the same as time.
- 1:35:25Speaker 4: Well, for example, let's look at if you go back.
- 1:35:28Speaker 10: To exhibit one, which is the complaint. And if you
- 1:35:31Speaker 10: go to page eight exhibit one. Okay, you go to
- 1:35:41Speaker 10: page eight and it says those in the Immortals programs
- 1:35:49Speaker 10: have enhancers in the back of their necks that allow them.
- 1:35:51Speaker 4: To connect to and interact in a virtual world. Do
- 1:35:54Speaker 4: you see that or do you see that?
- 1:35:55Speaker 17: Okay?
- 1:35:55Speaker 1: My question for you is is.
- 1:35:57Speaker 10: There something in the script that describes what those enhancers
- 1:36:03Speaker 10: look like in your mind, what you intended them.
- 1:36:06Speaker 5: To look like.
- 1:36:10Speaker 23: I believe we get the image on page ninety nine,
- 1:36:14Speaker 23: just just having open the script. On page ninety nine,
- 1:36:18Speaker 23: it says, Jim attaches Barriager's.
- 1:36:21Speaker 1: And Hanser to the back of his neck. If I
- 1:36:27Speaker 1: go through here, uh. On page eighty five, and there's
- 1:36:48Speaker 1: numerous entries.
- 1:36:49Speaker 6: On page eighty five, it says Jim, Jim hurries to
- 1:36:52Speaker 6: his home terminal and puts the chord to his neck, just.
- 1:36:56Speaker 1: As a matrix film.
- 1:36:57Speaker 6: The cord it's hooked up to a chord. The rights
- 1:37:00Speaker 6: on the screen transfers the files to his mind. So
- 1:37:05Speaker 6: it says that they're transfers to play all files last year,
- 1:37:07Speaker 6: all files empty.
- 1:37:19Speaker 1: And you're going back with pages in the upper right
- 1:37:21Speaker 1: the upper right. That's correct, and this is just looking
- 1:37:46Speaker 1: off the color. Thank you too.
- 1:38:18Speaker 4: Now we've marked as exhibit three a D. We'll come
- 1:38:22Speaker 4: back to the script.
- 1:38:23Speaker 10: We've we and marked as exhibit three A document that
- 1:38:27Speaker 10: was produced pursuant to uh W Warner Brother's first request
- 1:38:32Speaker 10: for production.
- 1:38:33Speaker 4: And it's labeled page zero zero one nine seven zero
- 1:38:40Speaker 4: through zero zero one nine eight zero. And I believe
- 1:38:46Speaker 4: these pages are not entirely in order, but this is
- 1:38:50Speaker 4: how it was produced to us. So this is how
- 1:38:52Speaker 4: I'm how we've marked it. I understand if you look.
- 1:38:56Speaker 10: At uh the first page, there's some there's a hand
- 1:39:00Speaker 10: written document here dated May nineteenth, nineteen ninety three.
- 1:39:04Speaker 4: Can you tell me what that is?
- 1:39:09Speaker 1: It looks like a testimonial. I do know the party well,
- 1:39:15Speaker 1: or did at that time, and she's writing about.
- 1:39:23Speaker 6: As it says, the conception date for time of the
- 1:39:29Speaker 6: street flighting questions in morals.
- 1:39:32Speaker 5: So for this.
- 1:39:35Speaker 10: Us, if this is dated May nineteenth, ninety nineteen ninety three,
- 1:39:39Speaker 10: do you have any bl reasonably that that date's not correct?
- 1:39:42Speaker 1: It it's notorized by the notary, Okay, so I would
- 1:39:45Speaker 1: say the theories page I believe it says but that
- 1:39:50Speaker 1: is the date sworn to by the notary.
- 1:39:52Speaker 4: Yeah, I the end.
- 1:39:53Speaker 10: If you look at the third page of this document,
- 1:39:56Speaker 10: there's a there's something that appears to be a signature
- 1:40:01Speaker 10: of a notary.
- 1:40:02Speaker 1: It is a signature of a notary. It is yes. Okay.
- 1:40:06Speaker 10: Do you know in around nineteen ninety three the Virginia
- 1:40:09Speaker 10: notaries used stamps.
- 1:40:12Speaker 1: There would be a press down stamp. Okay, I was
- 1:40:14Speaker 1: a notary myself.
- 1:40:15Speaker 4: Okay, alright, So what who was Who is Atifa Ball?
- 1:40:28Speaker 6: The cheek a Ball is the niece of seven of
- 1:40:31Speaker 6: your David former Senator David born of Oklahoma.
- 1:40:36Speaker 1: She was also.
- 1:40:39Speaker 6: In miss America agint that had was a runner out
- 1:40:42Speaker 6: for Oklahoma on that area. She was also a performer
- 1:40:51Speaker 6: and came from established family. She was someone that helped
- 1:41:00Speaker 6: me greatly when my condition was ongoing, and basically was
- 1:41:14Speaker 6: UH someone who witnessed the development completion how your balance
- 1:41:26Speaker 6: the ideas offer. We would go bolteed at times and
- 1:41:30Speaker 6: the ideas would kindly.
- 1:41:31Speaker 2: Rather my map and I.
- 1:41:32Speaker 1: She saw me through the head process of the development
- 1:41:36Speaker 1: of the screen flight from when I was attending to
- 1:41:39Speaker 1: uh the message I was attending to give the the
- 1:41:43Speaker 1: killing that was kinded that as an expiration.
- 1:41:49Speaker 4: Well, when you say my condition was ongoing, what did
- 1:41:51Speaker 4: you move.
- 1:41:52Speaker 6: The diagnosis of the post traumatic stress disorder which was
- 1:41:59Speaker 6: on a lot me to see those violent films so well?
- 1:42:13Speaker 4: And when were you to diagnose with posttic best disorder?
- 1:42:18Speaker 1: To the best of my knowledge, I believe there was
- 1:42:19Speaker 1: a couple of different times.
- 1:42:23Speaker 4: When was the first time?
- 1:42:26Speaker 6: I can tell you one of the times was we
- 1:42:29Speaker 6: have documentation learn from the doctor inself like cells?
- 1:42:33Speaker 19: It not clearly.
- 1:42:34Speaker 1: I always wanna rely on that doctors rather than just
- 1:42:36Speaker 1: try to guess what that date was.
- 1:42:38Speaker 4: Can you estimate.
- 1:42:46Speaker 1: It's on his letter? Had it's on his side as
- 1:42:48Speaker 1: his letter had, I would I it was. I wouldn't
- 1:42:54Speaker 1: know the date it is. I I don't know.
- 1:42:57Speaker 4: Was it when you were in at Williamsburg?
- 1:43:03Speaker 1: It was either one of those Williamsburg or before Williamsburg?
- 1:43:17Speaker 13: And what was the event, uh.
- 1:43:22Speaker 4: That led to the post traumatic stressed.
- 1:43:26Speaker 6: Desorder being taken on that motor home trip with the
- 1:43:30Speaker 6: homosexual associate Dean being approached told that.
- 1:43:34Speaker 1: I would lose everything if I didn't comply, and.
- 1:43:37Speaker 6: Then having my jobs at education terminated in all opportunities killed.
- 1:43:45Speaker 4: And that's the Region University.
- 1:43:47Speaker 6: That's Rigi University, the disturbing Pat Robinson's presidential campaign, and
- 1:43:56Speaker 6: that's why they was so, I guess so set on
- 1:44:00Speaker 6: alleviating the problem.
- 1:44:09Speaker 4: Okay, going back to Exhibit three. This handwritten document, uh,
- 1:44:20Speaker 4: signed by ms Ball?
- 1:44:22Speaker 1: Uh?
- 1:44:22Speaker 4: Is this something you asked her to do?
- 1:44:26Speaker 9: Is it?
- 1:44:27Speaker 6: So long as always you don't recollect or listen her
- 1:44:29Speaker 6: idea or mine, be very well may have.
- 1:44:31Speaker 1: Been her idea.
- 1:44:32Speaker 19: Kay Uh?
- 1:44:33Speaker 10: Do you recall any discussions with ms Ball about the
- 1:44:36Speaker 10: purpose of this handwritten document?
- 1:44:39Speaker 4: The first page of Exhibit three.
- 1:44:41Speaker 6: While understanding is that we were told the work was good,
- 1:44:47Speaker 6: then we needed to set down various ways that would
- 1:44:52Speaker 6: then show that our concept was the original one should.
- 1:44:55Speaker 1: It ever be disputed.
- 1:44:57Speaker 4: And who were you told that? Five?
- 1:45:00Speaker 1: There was a copyright attorney when I had talked to
- 1:45:04Speaker 1: and who was that we had it written down?
- 1:45:07Speaker 5: I don't really mean.
- 1:45:08Speaker 1: Exactly that he was envetmented? Is that mister.
- 1:45:20Speaker 4: Void done? And as uh May nineteenth, nineteen ninety three, Uh.
- 1:45:38Speaker 1: The.
- 1:45:40Speaker 4: Story treatment was complete?
- 1:45:43Speaker 1: Is that fright? That all the pieces were r were done? You? Sorry?
- 1:45:49Speaker 19: It was KICKINGG.
- 1:45:50Speaker 1: What do you mean? The pieces? M story treatment and
- 1:45:57Speaker 1: the script were written.
- 1:46:03Speaker 4: The entire the entire script are just in ugstening resicians.
- 1:46:06Speaker 1: That's is when I kept wanted to realize things.
- 1:46:11Speaker 4: But so because the Exhibit three says that.
- 1:46:23Speaker 10: All opening scenes up to Barringer at Jim's house in
- 1:46:27Speaker 10: script form that she had witnessed you developed, not that
- 1:46:30Speaker 10: she witness you developed.
- 1:46:31Speaker 1: Well, I did all the rest in the second section
- 1:46:33Speaker 1: of the OS, but she doesn't view it.
- 1:46:41Speaker 10: So as of May nineteenth, the sec second section will
- 1:46:46Speaker 10: in your mind? How many sections are there in the script?
- 1:46:50Speaker 1: Two? There were reason the words sections.
- 1:46:54Speaker 4: I guess, okay, well that was the you have the scenes.
- 1:47:00Speaker 4: As of May nineteenth, nineteen ninety three, was there a
- 1:47:02Speaker 4: complete script even if you were still making revisions?
- 1:47:07Speaker 6: I would say there was complete script except the second
- 1:47:10Speaker 6: half I wasn't satisfied with.
- 1:47:16Speaker 1: How about the fight scenes were a little should call
- 1:47:20Speaker 1: 'em new dystancy? And I think they turned that way
- 1:47:26Speaker 1: out of the film.
- 1:47:30Speaker 4: And when you say it turned that way out in
- 1:47:32Speaker 4: the film, you mean.
- 1:47:33Speaker 5: The Matrix film?
- 1:47:33Speaker 1: Or I say, if they did the same thing.
- 1:47:37Speaker 4: And which film are you referring to?
- 1:47:40Speaker 6: MM When I said, Jory, someun refer to all three,
- 1:47:44Speaker 6: But that would probably be the nd sequence or the.
- 1:47:47Speaker 25: Things and when you say the ending sequence, that would
- 1:47:57Speaker 25: be the ending sequence in the third one.
- 1:48:00Speaker 6: I'm it so that throughout the film there was way
- 1:48:02Speaker 6: too much violence, but in the battle sequences of the Dead.
- 1:48:11Speaker 14: Yeah, if you look back at exhibit one, which is
- 1:48:42Speaker 14: the complaint, actually you can stay on that page that
- 1:48:46Speaker 14: you're on, page eight.
- 1:48:48Speaker 26: That's the beginning of the comparison between the immortals and
- 1:48:55Speaker 26: the infringing works which are described here as the Matrix
- 1:48:58Speaker 26: reloaded and the Matrix revolutions.
- 1:49:01Speaker 1: Do you see that or do you see that?
- 1:49:02Speaker 10: Is there a reason why you uh did not include
- 1:49:05Speaker 10: the original matrix here?
- 1:49:12Speaker 3: Well, I'm managed after that question to the extend their
- 1:49:15Speaker 3: calls or uh work product and attorney client communications.
- 1:49:24Speaker 1: If there's anything.
- 1:49:26Speaker 6: As dril out school answers that that you don't feel
- 1:49:30Speaker 6: insisted of your work product on this case with me
- 1:49:35Speaker 6: and our communications, then you can answered otherwise, was your
- 1:49:39Speaker 6: the privilege all and stuff?
- 1:49:41Speaker 1: Do not answer that understood or go with the turn nice.
- 1:49:47Speaker 4: So, just just for the record, there's you don't have.
- 1:49:52Speaker 5: An any.
- 1:49:56Speaker 10: Information other than what you learned from your attorney as
- 1:49:59Speaker 10: to why the original matrix is not included.
- 1:50:02Speaker 1: In this part of your lesser of correct How do
- 1:50:04Speaker 1: you not know at this time?
- 1:50:21Speaker 4: Okay, let's go back to the three and this Ball's.
- 1:50:26Speaker 19: Letter.
- 1:50:30Speaker 10: Uh so this document was signed on May nineteenth, nineteen
- 1:50:35Speaker 10: ninety three.
- 1:50:37Speaker 4: Uh, what did you do with it after that?
- 1:50:40Speaker 1: With anything?
- 1:50:43Speaker 6: I believe we put it into a mail or let's
- 1:50:47Speaker 6: set priority mail to ourselves as.
- 1:50:50Speaker 1: Per instruction.
- 1:50:52Speaker 17: We like to see.
- 1:50:57Speaker 10: Okay, let's mark as exhibit four, Uh, this original document
- 1:51:05Speaker 10: and then we'll figure it out later.
- 1:51:10Speaker 3: Where do you wanna put the sun so so that
- 1:51:14Speaker 3: I'd like to make a copy for your exhibit. So
- 1:51:16Speaker 3: if you wanna mark the outside of it, you wanna
- 1:51:19Speaker 3: make a copy and mark the out j comp excuse
- 1:51:22Speaker 3: me of the front of it showing the postmark and
- 1:51:24Speaker 3: all that, and mark that exib it for.
- 1:51:27Speaker 1: We can do that.
- 1:51:27Speaker 4: Do you want me to go make a copy or
- 1:51:29Speaker 4: do sh let's walk to the record for one book.
- 1:51:31Speaker 4: Second's to go on?
- 1:51:32Speaker 1: Please?
- 1:51:33Speaker 19: What do you want with the record?
- 1:51:34Speaker 4: It be eleven twenty eight and.
- 1:51:37Speaker 3: We can do it later, or per your prior suggestion,
- 1:51:39Speaker 3: you can open it now and we can see what's
- 1:51:41Speaker 3: inside and and then we'll.
- 1:51:43Speaker 4: Copy it and the market. Yeah, okay, so we'll go
- 1:51:46Speaker 4: on to that four cause it'll get used, so we.
- 1:51:48Speaker 1: Can stay off the record if you wanna do it. Now,
- 1:51:50Speaker 1: it's up to you where you do that.
- 1:51:52Speaker 4: Yeah, why you do that? Cause we don't need to
- 1:51:54Speaker 4: be dramatic. Well, no, let's come back.
- 1:51:57Speaker 6: Just sorry, all I know.
- 1:51:58Speaker 4: I'm sorry about that. We're back on the record at
- 1:52:03Speaker 4: another twenty eight AM.

- 1:52:43Speaker 4: This this this envelope that we're looking at right now.
- 1:52:46Speaker 1: This we just discovered yesterday. In fact, my little boy
- 1:52:52Speaker 1: who's seven, went through a box of this.
- 1:52:58Speaker 6: Artwork that's an interest I had just saved all the
- 1:53:00Speaker 6: things he did in school, and he told me that
- 1:53:04Speaker 6: he had found something on the bottom of his work.
- 1:53:07Speaker 6: He's like, downy, I found something that it's yours and
- 1:53:09Speaker 6: so I then solid retreated thanked him and let him
- 1:53:14Speaker 6: know if he had found something very very important to him.
- 1:53:17Speaker 4: Okay, Uh, I's.
- 1:53:21Speaker 1: Sorry, so.

- 1:53:53Speaker 4: And then what's the next pitch?
- 1:53:56Speaker 1: Notes? The original? I mean obviously the originally notes from
- 1:54:01Speaker 1: what copies of writing?
- 1:54:03Speaker 9: Uh?
- 1:54:03Speaker 1: We're background for source material using models?
- 1:54:08Speaker 4: And is that your handwriting?
- 1:54:09Speaker 1: That's my handwriting? Oh?
- 1:54:36Speaker 9: Else?
- 1:54:36Speaker 4: Before you said it's been opened before?
- 1:54:45Speaker 1: Do I believe?
- 1:54:46Speaker 10: So?
- 1:54:46Speaker 1: Kay?
- 1:54:47Speaker 4: And why do you say that?
- 1:54:48Speaker 1: Because it's the scene. It's the thing on the front
- 1:54:53Speaker 1: says script Do you know I've open Yep, it's a scripture.
- 1:55:02Speaker 1: Don't no food? Was that good about? Anyway? Just answer
- 1:55:27Speaker 1: her question? Did you want him to describe her any
- 1:55:30Speaker 1: any sooner? We're just gonna mark all this, and i'd
- 1:55:36Speaker 1: prefer to for the record, just you don't at your microphone.
- 1:55:45Speaker 3: For the record, if you don't mind him as brough,
- 1:55:47Speaker 3: I'd prefer to just maintain the order of these pages
- 1:55:50Speaker 3: before he starts looking at them and possibly changing the
- 1:55:54Speaker 3: order or getting them extup at any else and I
- 1:55:58Speaker 3: photo copy them.
- 1:55:59Speaker 1: This perhaps part of XI A four or an EATHI
- 1:56:01Speaker 1: five to pop first.
- 1:56:03Speaker 4: Yeah, no, I think we could do that. Why don't
- 1:56:04Speaker 4: Why don't we although we haven't, why don't we do
- 1:56:08Speaker 4: that now? Just yeah, so that we don't bes track
- 1:56:11Speaker 4: of what we're doing, oparently alright, just among little things.
- 1:56:14Speaker 4: If you were off the record at the now than
- 1:56:15Speaker 4: thirty two am, are we close to the end of
- 1:56:20Speaker 4: the two forms? Not half an hour ago? Okay, I'll
- 1:56:26Speaker 4: change it in you month. Oh no, no, no, if
- 1:56:30Speaker 4: you weren't five minutes or something, No, I says that
- 1:56:32Speaker 4: something yet?
- 1:56:33Speaker 3: Okay, finely, I've had allarrements learning me to the beginning
- 1:56:42Speaker 3: of this deposition, but it was not Hawaii time, so
- 1:56:46Speaker 3: it came two hours later.
- 1:57:04Speaker 17: Ah, you see you said outside.
- 1:59:00Speaker 5: Just that to my crust.
- 1:59:01Speaker 18: Okay, you cannot trust ya anything, SACA.
- 2:06:15Speaker 1: That's something.
- 2:06:16Speaker 3: Let lest jolly house take a minute to look out
- 2:06:18Speaker 3: before we go back on the record.
- 2:06:20Speaker 4: Sure, absolutely.
- 2:07:20Speaker 1: Sure? What was its structure?
- 2:07:26Speaker 5: What do you excatted by?
- 2:07:29Speaker 1: It looks like you know, don't say that, starty, who
- 2:07:33Speaker 1: don't say how they i'sn't say that? Long way they
- 2:07:35Speaker 1: get you out? Okay, say that.
- 2:07:38Speaker 9: That's what's that you say.
- 2:07:48Speaker 1: That you kiddy worked type?
- 2:08:16Speaker 17: Yeah?
- 2:08:17Speaker 1: Okay, wite go back home.
- 2:08:18Speaker 4: Most just a moment, please, we are back on the record,
- 2:08:26Speaker 4: ending up in forty five.
- 2:08:28Speaker 10: And okay, what is mark? I should probably not marked,
- 2:08:36Speaker 10: but I'm gonna mark as Exhibit five.
- 2:08:40Speaker 4: Come back to four.
- 2:08:43Speaker 10: The contents of the envelope, the front page of which
- 2:08:48Speaker 10: will mark is a ghibb of four. I'll tell you
- 2:08:52Speaker 10: I used to mock people who couldn't w work their's
- 2:08:54Speaker 10: eRx machines, and now I can't.
- 2:08:57Speaker 4: But I have the portion that is.
- 2:08:59Speaker 27: Copied, the portion with the postwar Okay, so the the
- 2:09:07Speaker 27: copy the that's four and that's fine.
- 2:09:33Speaker 1: Okay.
- 2:09:39Speaker 4: Now looking at exhibit five mm, which is the contents
- 2:09:43Speaker 4: of the envelope, which I think is under.
- 2:09:59Speaker 9: Right.
- 2:09:59Speaker 4: So exhibit five, I believe it's under exhibit for there.
- 2:10:01Speaker 1: You can.
- 2:10:13Speaker 10: Hm, okay, so can exhibit five. We have 'em as
- 2:10:17Speaker 10: Ball's letter, correct, that's right. And then we have some
- 2:10:21Speaker 10: handwritten notes of yours.
- 2:10:23Speaker 1: Correct, that's right.
- 2:10:24Speaker 5: Okay.
- 2:10:25Speaker 4: And do you know when these notes were created?
- 2:10:28Speaker 1: M No, I have no recolection when U s actually
- 2:10:34Speaker 1: the actual date that are made?
- 2:10:35Speaker 4: Okay, you see there's a bunch of numbers, yes, I do.
- 2:10:39Speaker 4: What are those?
- 2:10:39Speaker 1: If you know, I'm not sure. If they are reference notations,
- 2:10:47Speaker 1: I'm not sure. If they are just seen identication idea numbers,
- 2:10:52Speaker 1: I don't. I'm not sure what they why they represent. Okay,
- 2:10:56Speaker 1: that it's time.
- 2:10:58Speaker 10: And then the next page is typewritten, single space typewritten, and.
- 2:11:12Speaker 4: It's it starts with sh see she.
- 2:11:14Speaker 10: Is sincere but frightened, sort of believes me to believe
- 2:11:18Speaker 10: there's a page missing there there is a passing.
- 2:11:20Speaker 4: Okay, and that would be the first page of the
- 2:11:27Speaker 4: story treatment that.
- 2:11:28Speaker 1: We see where we do have when your receptions Rice.
- 2:11:31Speaker 4: Okay, that's my solution. Okay, And then we keep going
- 2:11:46Speaker 4: through the story treatment
