Episode 340 |Comfortable but Not Free: The Solo Practitioner’s Path to a Firm That Generates Wealth Even in Your Absence · Wealthy Woman Lawyer Podcast, Helping you create a profitable, sustainable law firm you love

0:01
Intro: Welcome to the Wealthy Woman Lawyer Podcast. What if you could hang out with successful women lawyers, ask them about growing their firms, managing resources like time, team, and systems, mastering money issues, and more? Then take an insight or two to help you build a wealth generating law firm. Each week, your host, Devina Frederick, takes an in-depth look at how to think like a CEO, attract clients who you love to serve and will pay you on time, and create a profitable, sustainable firm you love. Devina is founder and CEO of Wealthy Woman Lawyer, and her goal is to give you the information you need to scale your law firm business from 6 to 7 figures in gross annual revenue so you can fully fund and still have time to enjoy the lifestyle of your dreams.
0:47
Now here's Davina.
0:49
Davina: Do you remember when you first went out on your own? I do. I remember feeling scared, worried that no one would hire me, and grateful for my husband's financial and emotional support. Slowly but surely, though, the clients began to come. My marketing worked, and the business took off from there.
1:06
There was just one problem. If I took time off, for whatever reason, everything ground to a halt. There was no one to handle consultations, no one to handle cases, no one to book new appointments or take client calls. Even after I hired my first employee, an admin assistant, the problem persisted. It wasn't until I hired a bigger team, including two other attorneys, that this problem diminished.
1:33
Maybe you can relate. If you are a solo practitioner, even if you have a couple of good staffers working for you, do you ever have thoughts like, What happens if I get sick or if someone in my family gets sick and needs me? What happens if I wanna slow down in a few years and there's no one there to take on some of the work? When can I stop hustling so hard? I'm not sure I can keep this up for decades.
1:56
What happens when I take that vacation I have been putting off and come home to a pile of work so tall that I spend two weeks digging out from under it, and the whole trip starts to feel like it wasn't worth the trouble. If you've had thoughts like these, you are not alone. I have conversations every day with practitioners just like you, some who are just climbing the 6 figure revenue ladder as best they can, hoping one day to get to half 1,000,000 in revenue one day, and some who've made it to that comfortable spot where they are taking home enough to feel safe. But they have to show up every day and grind to do it. That voice in your head that asks these kinds of questions may sound like fear, but it's really wisdom.
2:38
It is the part of you that knows the truth. What you have built for yourself is not a business that can operate even in your absence, but instead, it is a high paying, albeit high stress job. Welcome to the Wealthy Woman Lawyer Podcast. I am your host, attorney Devina Frederick. And today, I am talking about the comfort trap and why it is so detrimental to your long term success, health, and well-being.
3:04
The comfort trap is not a failure. It is not a sign that you made wrong decisions along the way. It is, in many respects, a sign that you did many things right. You built a practice. You brought in clients.
3:19
You earned a strong reputation. You figured out how to run your own shop without a manual, without a business partner, and often without much of a safety net. That is genuinely impressive. But there is a particular moment that happens for many solo practitioners, usually somewhere after the five year mark, maybe longer for some, when the hustle that built the practice starts to feel less like momentum and more like a treadmill. Revenue has plateaued at a level that feels stable.
3:51
The draw you take home every month is comfortable, maybe more comfortable than you imagined when you first hung your shingle. Maybe the thought of disrupting any of it with hiring, building, growing, or going through the chaos of change feels like more than you can take on right now because, honestly, you are up to your ears and work. The trap is not the comfort itself. The trap is its static nature because you are not static. Your body is not static.
4:20
Your financial needs are not static. The market is not static. Let's face it, a law firm built entirely around your personal capacity to show up and do the work every day grows more fragile with every passing year, not more resilient. So the current comfort you feel with your daily routine, your right hand paralegal, and taking home enough to pay for everything that's currently in front of you, like private school or dance classes for your child, is not doing much for future you. I know this because I lived it, and I know it from working with hundreds of women law firm owners who have sat in the same seat you are sitting in right now.
5:02
The comfort trap feels safe until the day it doesn't. I would rather you have this conversation now while you still have full options than after the treadmill has worn you down to the point where you have no good choices left. One of the most common statements I hear from women law firm owners who are caught in the comfort trap is some version of I'm making enough. What's interesting, though, is when I start asking more specific questions about number one priorities, hopes, goals, and dreams, that's when I hear statements like, I want to take three or four international trips a year with my kids. I want to retire early.
5:40
I want to invest in other businesses. I want to pay for my children's college. I want to buy my dream house. Most women share some version of that story. Basically, they want it all.
5:52
I get it. Very few of us don't want it all. But what I find so interesting is that no one attaches, really, dollars to these goals. They just get up every day, go into their office, get right to work on the cases in front of them, and hope everything will work out without any real plan or strategy. Lest you think I am judging, let me be clear, that was me for many, many years.
6:17
And then I had a conversation about the difference between enough and plenty, which changed my perspective. Someone asked me, when you throw a pizza party, how much pizza do you order? Do you order just enough for everyone to have a slice or two? Or do you want to make sure you order enough so that everyone has plenty? The answer, of course, is that I wanted everyone to have plenty.
6:38
I didn't want someone leaving my imaginary party hungry because I only ordered what I thought was enough. Plenty means not only that we don't have to worry about not having enough, it also means we can have excess, even if there's not good reason to, but just because we want it. To me, when people are telling me about their dreams, they aren't thinking only about what would be enough. They are thinking about having it all, whatever that turns out to be down the line. What they really want, what we all want, is to have so much that we no longer have to worry not only about how we spend our money, but how we spend our time.
7:17
People who are truly wealthy have unlimited control over their time. They have more options. They have more resources. They have more freedom and flexibility, the very thing we all say we want more of. So let's revisit enoughness and what it really means.
7:35
Let's start with a little math. When you say you are making enough, is that true on a per hour basis? Because here's what most solo practitioners do not stop to calculate. When you are the only attorney in your firm, you are doing every consultation, every client intake, every piece of substantive legal work, every emergency call that comes in on a Saturday, every email that requires attorney judgment. Your effective hourly rate, when you divide what you take home by the hours you work, may be considerably lower than your billing rate suggests.
8:11
The revenue looks good on paper. The math often looks different in practice. When you say you are making enough, have you thought seriously about what happens when you want to stop? A law firm whose revenue is generated entirely by one attorney is frankly not worth much on the open market. When you walk out the door, the revenue walks out with you.
8:33
If you are planning to sell your firm someday, or to transfer it to a successor, or even to simply step back and work fewer hours in the years ahead, a solo practice built entirely on your personal production is a much harder asset to transition than a firm with multiple attorneys, strong systems, and a client base that is attached to the firm rather than exclusively to you. And when you say you are making enough, is that amount going to keep being enough? Overhead goes up. Malpractice insurance goes up. Technology costs, the kind that are increasingly non negotiable, go up, staff salaries go up as they should, the lifestyle you want to sustain, the retirement you need to fund, the life circumstances that have a way of arriving unexpectedly, all of that has a carrying cost that tends to grow, not shrink, over time.
9:29
I promise I'm not trying to create anxiety here. I am trying to create clarity to get you to consider whether your current status is the pinnacle for you or whether there is something more beyond your current comfort zone. Now I wanna talk about something that comes up in nearly every conversation I have with solo practitioners who are stuck in the comfort trap because I think it is one of the most significant obstacles holding so many of you back from growth and expansion. Tell me, does this sound like you you tried hiring an associate a while back and it didn't go the way you hoped? Maybe they were a competent attorney who turned out to be a poor fit for your firm's culture.
10:11
Maybe they needed more supervision than you had bandwidth to give. Maybe they weren't billing enough to fully sustain their salary, or they left for a bigger firm after nine months, or the whole experience was disruptive and expensive enough that when it was finally over, you told yourself you would never go through that again. I hear you. A failed attorney hire is not just a professional setback. It is an emotional one.
10:38
It shakes your confidence in your own judgment. It costs real money, real time, and real goodwill with your clients who can feel the disruption even when you are trying to shield them from it. And when it is finally over, the relief of having your firm back to yourself, quiet and controlled and predictable, can feel so profound that you are willing to stay solo indefinitely just to avoid repeating the experience. That response is completely understandable. It is also the response that will keep you stuck in the comfort trap.
11:12
Consider this a failed hire is almost never a sign that you are not cut out to lead a team. It is almost always a sign that the hire happened without the right infrastructure in place without a defined hiring process without role clarity without onboarding and training systems without documented performance expectations, without the cultural guardrails that protect your firm's standards and values from someone who does not share them. Most solo practitioners hire their first associate reactively when they are already overwhelmed, already behind, already desperate for relief. That is the worst possible state in which to make a high stakes hiring decision. When you are hiring from a place of desperation, you are more likely to overlook warning signs.
12:03
You are more likely to settle for the candidate who is available right now over the one who is right for the long term. You are more likely to skip the steps in the process that feel slow because you just need someone in the seat. Then when it doesn't work out, you carry the weight of it as a personal failure. You tell yourself, No one wants to work anymore, or, I guess I'm just not good at hiring, or managing, or leading, or, I don't have time to train anyone because I'm too busy. The answer to a bad hire is not to stop hiring.
12:36
The answer is to build the systems and infrastructure that make the next hire a fundamentally different experience. Every solo practitioner I have worked with who pushed through that fear and did the work to hire well has told me the same thing. I cannot imagine going back to doing this alone. Building my team was the best decision I made for my firm and for my life. That same outcome is available to you.
13:03
What you have built deserves to be honored, not managed around, not apologized for, not dismantled in a rush to do something bigger. The practice you have created, the clients you serve, the reputation you have earned, those are real and they matter. What I'm discussing today is not about abandoning what you have built. It is about building a stronger, more sustainable version of it. The comfort you feel in your current practice stems from something in it that is genuinely working.
13:33
It is serving you. That is worth acknowledging. What we are really talking about is not leaving your comfort zone behind. We are talking about expanding it in an intentional, thoughtful way with a plan that respects how hard you have worked to get here and is designed to take you somewhere even better. Because here's the thing about a static comfort zone, you are not.
13:57
Five years from now, you're going to want different things than you want today. Your energy levels may be different. Your family situation may be different. What you care most about and the way you want to spend your time will shift. A firm that is built entirely around who you are and what you can produce today is not necessarily built to serve who you are going to be.
14:21
The invitation I am extending to you today is to build a business that grows with you, a career path that becomes more capable and more resilient over time, not more exhausting. A law firm that serves your clients well pays you and your team generously while requiring less of your personal time and energy with every passing year. Let's imagine for a minute what's possible. My client, we'll call her Lexi, hired me after she'd already scaled her firm over the million dollar mark. She built her personal injury practice by hiring lots of case managers, and it worked.
14:55
That is, until she wanted to strengthen her litigation department. Up until that point, she was the only attorney and therefore the only one who could handle a trial. She knew that insurance companies probably would not be that intimidated by a solo attorney who threatened to try a case against them. She needed to hire more attorneys to form a litigation team. There was just one problem.
15:19
Lexi had never hired another attorney before, much less an experienced civil litigator, and she certainly had never managed a team of attorneys. She was super comfortable managing her case managers, her assistant, and her office manager, but she was still way more involved in the day to day details of, well, everything. Not only was it exhausting, but it was really limiting her firm's impact, not to mention capping her profits. Long story short, Lexi decided to leave her comfort zone, hired her first litigation attorney, then her second, and so on. And then she began training and promoting other members of her team for leadership roles within her firm.
16:01
These decisions and actions freed up time for her to think more strategically, invest in better systems, and begin tracking key performance indicators, enabling her to improve her marketing and operations systems. This year, her firm is on track for 8 figures, and she has more time than ever to devote to her family, her other businesses, and pet projects. It is my proposition that the goal of a law firm business is to generate wealth even when you, the owner, are not involved in the day to day details. In fact, the more capacity you create, the more satisfied I think you will be. But first, you must let yourself believe it is possible for you.
16:43
For most of the women I work with, the milestone that makes this possible is somewhere in the neighborhood of $1,000,000 in gross annual revenue because at that point, our law firm can truly afford to invest in itself. I want to be clear about what that number means and what it does not mean. It does not mean that $1,000,000 is the finish line, that everyone needs to reach exactly that number, or that you have failed if you are not there. What it means is that in most practice areas and most markets, a firm generating around $1,000,000 in gross revenue has enough capital to do the things that change the game. To hire a second attorney with confidence.
17:26
To invest in the technology and systems that reduce the burden on you personally, to pay a well qualified team what they deserve and keep them, to run the business like a business, not like a one woman relay race. The goal is not the number. The goal is what the number enables, which is the freedom to step away without the firm falling apart, the ability to take a real vacation and come home to a practice that kept moving while you were gone, the security of knowing that your income does not depend entirely on your personal ability to show up and produce every day, the asset value of a firm that can be sold or transitioned because it does not retire when you do. That kind of firm is not reserved for attorneys in large markets, high volume practice areas, or those who had the right connections from the start. I have witnessed women law firm owners build wealth generating firms in family law, immigration, estate planning, criminal defense, and many, many other practice areas.
18:31
I've been part of their journey as they've done it in small towns, mid sized cities, and large cities. Some have built all remote firms, others all in person, and some hybrid. Their client avatars are as varied as they are. What they have in common is not luck. What they have in common is a decision to leave their comfort zones, try something new, dream a little bigger, develop a plan, execute it.
18:55
Each and every one of them chose to stop playing small and start expanding their capacity for wealth and impact. So what does it take to get from where you are to a firm that generates wealth in your absence, creates more income, and frees up your time. There are four areas that in my experience must shift for a solo practice to become truly self sustaining. First, you need a revenue engine that does not depend entirely on you alone. Right now, your revenue is largely a function of how many hours you personally put in.
19:31
If you work more, revenue goes up. If you step back, it drops. To break out of that pattern, you need a client acquisition and intake system that generates consistent, predictable revenue regardless of how many hours you personally bill. That means marketing that works continuously, not just when you have a spare hour to think about it. It means an intake process that your team can manage with your oversight so consultations happen and cases are signed even when your calendar is full.
20:02
It means fees that reflect the true value of what your firm delivers, not a rate you set five years ago and have not revisited since. A predictable revenue engine is what provides the confidence to invest in growth. It is very hard to make smart strategic decisions about hiring, systems, and technology when you are not sure what is coming in next month. Predictability changes everything. Second, you need attorney capacity beyond your own.
20:35
A support team is invaluable. Your paralegal, your admin staff, the people who keep the wheels turning, they matter enormously and they extend your capacity in meaningful ways. But they cannot do attorney work. They cannot conduct consultations. They cannot build the billable hours that grow revenue beyond what you personally can produce.
20:56
They can't go to court or give legal advice. Adding other attorneys to your firm, the right attorneys hired through the right process with the right structure in place is the single most consequential growth decision available to you. It is also the decision that tends to feel the most daunting, especially if you have tried it before and it did not go well. But as I said earlier, a bad past experience is not a prediction of the future. It is information.
21:27
And you can use that information to do it better this time. Third, you need systems that live outside your head. If your firm's processes live primarily in your memory, your firm cannot function without you. That is the definition of a bottleneck, and it is one of the most common issues I see in solo practices that have plateaued. Building systems is not glamorous work.
21:52
It is the work that most law firm owners put off because they are too busy doing everything else. But every hour you invest in building a process is an hour you will never have to spend manually doing that task again. Systems are leverage. They are what allow a team to operate with consistency and quality, even when you are not in the room. The good news is you do not need to take six weeks off to build your law firm systems.
22:20
You also do not need to be the doer who creates everything yourself. There are much, much better ways. Fourth, you need to stop thinking like a solo practitioner and start thinking like a CEO and law firm leader. This is the piece that ties everything else together. You can have the best systems and the best team and still be the bottleneck in your own firm if you are still operating mentally as though you are the only attorney.
22:50
Making the shift to CEO thinking means recognizing that your highest and best use is not producing every piece of work yourself. It is about leading. It is making strategic decisions. It is spending your time on the activities only you can do as the law firm's leader and visionary and trusting your team and systems to handle the rest. That shift is not a demotion from being a great attorney.
23:17
It is an evolution into being an exceptional firm owner, and it is the shift that makes everything else sustainable. If right now you are thinking, this all sounds good, but I am already working at capacity. I do not have extra hours in the week to build systems, revamp my hiring process, rethink my fees, and become a CEO, whatever that means. I am just trying to keep up. I feel you.
23:42
I was once in your exact shoes. It is a fair concern. Here's the truth. You are not going to build a wealth generating firm by adding more to your already full plate. You are going to build it by making strategic decisions about where to direct your energy and by stopping the practice of trying to figure everything out alone.
24:01
One of the hidden costs of the solo practitioner model is that you are not just the only attorney you are also the only strategic thinker. Every question about hiring, pricing, marketing, systems, leadership, you are answering by yourself, often late at night, often when you're already depleted. You're searching Google, asking questions in attorney Facebook groups, or sometimes just lurking and feeling like you are way behind and hoping that something useful turns up. Working with a coach who has built this before, has a clear framework, and has helped hundreds of women in your exact situation make this transition is not an indulgence. It is the most efficient path available.
24:46
It shortens the learning curve dramatically. It reduces costly mistakes that arise from trial and error, And it gives you something that is genuinely hard to come by as a solo practitioner. A community of women who understand exactly what you are navigating, who have been there, and who can tell you honestly what is possible on the other side. You do not have to have it all figured out before you take a step. You just need to be willing to take the step.
25:15
The women who build wealth generating firms are not the ones who wait for perfect conditions, unlimited time, or the absence of fear. They are the ones who decided that the discomfort of growing was worth more than the slow, quiet erosion of staying in a trap that no longer fits. So here's the next step if you are ready to take it. If today's conversation has resonated with you, I would love to continue it in a more personal way. At Wealthy Woman Lawyer, we work exclusively with women law firm owners who are ready to move beyond the comfort trap and build a firm that generates real wealth with the systems, the team, and the freedom that come with it.
