- 0:00Speaker 1: Hello everybody, and welcome once again the Honey Badger Radio.
- 0:03Speaker 1: My name is Brian and this is the Fireside Chat
- 0:07Speaker 1: and I have the esteem pleasure of our guest, who
- 0:12Speaker 1: is a Major, Clarence Anderson the third. It's like the
- 0:16Speaker 1: whole name there, which is great. I think it's great.
- 0:20Speaker 1: I love the long names. As a Latino, we always
- 0:23Speaker 1: have long names.
- 0:24Speaker 2: So and.
- 0:26Speaker 1: You have a crazy story like so many in that
- 0:31Speaker 1: we've been talking to lately, and so yeah, first off,
- 0:36Speaker 1: welcome to the show, Major, and how are you doing today?
- 0:42Speaker 3: How are you how's your day going?
- 0:44Speaker 2: Well? Ryan?
- 0:45Speaker 4: First of all, Man, thank you for having me and
- 0:48Speaker 4: thank you for you know, just helping us to tell
- 0:50Speaker 4: our story. Man, I've been saying this for the past
- 0:54Speaker 4: decade or so. This has been a national security issue
- 0:58Speaker 4: and the moment someone kind of looks at it like that,
- 1:01Speaker 4: if you look at recruiting numbers, right, recruiting numbers from
- 1:05Speaker 4: I think they've been the worst since the Vietnam era.
- 1:07Speaker 4: So not only having a problem with recruiting because of
- 1:10Speaker 4: the systemic problem that's been going on and it's been
- 1:13Speaker 4: stepped on the rug, you also have a retention issue,
- 1:15Speaker 4: so folks aren't joining the military and they're exiting as
- 1:18Speaker 4: soon as possible and so so so.
- 1:21Speaker 2: Just thank you for doing that. I'm good man.
- 1:23Speaker 4: I'm working able to you know, find you know, it
- 1:28Speaker 4: was hard initially, but I was able to you know,
- 1:30Speaker 4: supply chain logistics guy. You know, there's always a need
- 1:33Speaker 4: for somewhere. So but it's been challenging. I'm grateful for
- 1:40Speaker 4: the change with regards to uh Trump actually looking you know,
- 1:46Speaker 4: pointing Pete except to be the sect because because had
- 1:48Speaker 4: it not been, you know, and we would have still
- 1:51Speaker 4: had you know, another And I'm an independent guy, I'm.
- 1:53Speaker 1: Not no for sure, for sure, we'll get into that
- 1:57Speaker 1: because I do, I do want to know what your
- 1:58Speaker 1: thoughts are with know, the sort of like shifting landscape,
- 2:02Speaker 1: let's say, in the Pentagon and all that. But before
- 2:05Speaker 1: we get too far afield, I want people that are
- 2:07Speaker 1: watching to see what what are we talking about here?
- 2:10Speaker 1: So you have let's just tell me a little bit
- 2:15Speaker 1: about your your story, the how you like, what, where
- 2:20Speaker 1: where did all this begin? So you experienced a false allegation,
- 2:25Speaker 1: That's kind of what the core of this is. So like,
- 2:27Speaker 1: as men's issues advocates here at Honey Badger Radio, we
- 2:33Speaker 1: think that like, there's a list of things that need
- 2:36Speaker 1: to be discussed and addressed and talked about. But one
- 2:39Speaker 1: of the big ones, at least one of the ones
- 2:41Speaker 1: that no one wants to talk about, are false allegations
- 2:45Speaker 1: specifically against men and the But more than that is
- 2:49Speaker 1: the lack of due process. So and I think your
- 2:53Speaker 1: story is unique for that. So why don't you tell
- 2:56Speaker 1: us all, like, you know, what's your story? Like what
- 2:58Speaker 1: happened with to put you in this situation right now?
- 3:02Speaker 2: Sure?
- 3:04Speaker 4: So it all started with my second wife. We're both
- 3:08Speaker 4: from the same simile hometowns, both went to college together.
- 3:12Speaker 2: I met her, linked back up with her when I
- 3:14Speaker 2: was a captain.
- 3:15Speaker 4: I had an early command billet back here at in
- 3:20Speaker 4: Alabama at Maxwell Air Force Base. So we both attended
- 3:23Speaker 4: Troy University, linked up at homecoming. We were married about
- 3:29Speaker 4: four months after students and started dating. I deployed, came back,
- 3:32Speaker 4: and so that's how we ended up in relationship. And
- 3:35Speaker 4: so fast forward about five years after that, we're looking
- 3:39Speaker 4: at about twenty thirteen, I got selected for command again
- 3:45Speaker 4: at Holloman Air Force Base.
- 3:47Speaker 3: So you were you out of curiosity you're in the
- 3:50Speaker 3: Air Force?
- 3:51Speaker 1: Was this like a career thing for you or was
- 3:53Speaker 1: it just like you know, like some people go career,
- 3:56Speaker 1: some people.
- 3:57Speaker 2: Just do it for the or whatever.
- 3:59Speaker 4: This point, I'm like fourteen fifteen years in and so
- 4:04Speaker 4: it was for me, you know, I was up for
- 4:06Speaker 4: lieutenant colonel had I was moving right along, second time
- 4:09Speaker 4: in command, and so we are stationed at Holland Air.
- 4:13Speaker 2: Force Base twenty thirteen.
- 4:15Speaker 4: I just you know, kicked ass at a Symcom tour.
- 4:19Speaker 2: I was working with SOCOM.
- 4:20Speaker 4: I was a division chief for Special Operations Command Central,
- 4:24Speaker 4: you know, took part in the.
- 4:28Speaker 2: Team.
- 4:28Speaker 4: I was on the back end of the team that
- 4:29Speaker 4: killed Osama bin Laden. We got the SOCOM guys, soft
- 4:33Speaker 4: guys doing that. There was a logistics entity at the
- 4:36Speaker 4: other end of it that made us successful.
- 4:38Speaker 2: And so man just just just killing it man.
- 4:40Speaker 4: And so I was I hadn't even put on lieutenant
- 4:42Speaker 4: colonel yet, So I was a major, got picked up
- 4:44Speaker 4: for command again at Holloman.
- 4:45Speaker 2: Air Force Base, just crushing it.
- 4:47Speaker 4: And so this is up and so you started to
- 4:49Speaker 4: see a shift and the perceptions the way Congress were going.
- 4:52Speaker 4: And so initially the military was getting a bad rap
- 4:55Speaker 4: under the initial I refue currently uh Ver early thousands
- 5:01Speaker 4: maybe or whenever.
- 5:03Speaker 2: Oh, I have kicked off.
- 5:05Speaker 4: Where there were a lot of domestic violence, sexual saut
- 5:08Speaker 4: cases being swept in another rug and so President Obama
- 5:12Speaker 4: came in saying, hey, we're going to you know, uh,
- 5:15Speaker 4: finally address these things. And so so if he was
- 5:19Speaker 4: right right, if those things were happening being swept on
- 5:21Speaker 4: the rug by all.
- 5:21Speaker 2: Means, let's address it. But unfortunately, what President.
- 5:24Speaker 4: Obama did was he he moved a pendulum from we're
- 5:27Speaker 4: not looking at anything to you know, if someone makes
- 5:30Speaker 4: an accusation, we're gonna believe him. And not only are
- 5:32Speaker 4: we're going to believe everything you're saying, we're going to
- 5:34Speaker 4: eliminate the investigation part of it, where you know, we're
- 5:38Speaker 4: not going to be looking for the fact, we're gonna
- 5:40Speaker 4: look for hey, how can we corroborate this happened?
- 5:42Speaker 2: Uh? And then by the way, we're gonna send everything.
- 5:44Speaker 4: To court martial to go to court martial and then
- 5:49Speaker 4: allow the process to kick off.
- 5:50Speaker 1: And so yeah, yeah, yeah, the system turned to a
- 5:56Speaker 1: hammer looking for nails.
- 5:57Speaker 2: So you there was yeah, go ahead.
- 6:03Speaker 4: No, sorry, yeah, And there was absolutely there's a matter
- 6:06Speaker 4: of fact air Force case and I'll get back to mine
- 6:08Speaker 4: in a second. Uh, Brandon T. Wright versus Air Force
- 6:12Speaker 4: Brandon T. Right was his case was his convenient authority,
- 6:15Speaker 4: which was a three star, had already uh pushed back
- 6:19Speaker 4: on another lieutenant colonel's court martial and said, no, this
- 6:22Speaker 4: is bogus. This didn't happen because at the time, convenient
- 6:24Speaker 4: authorities and convenient athorities are pretty much your generals that
- 6:26Speaker 4: are in charge of your military court martials, right, And
- 6:29Speaker 4: so that that three star at the time had already
- 6:33Speaker 4: said this convenience authority to after a case went to trial,
- 6:38Speaker 4: and the convenient athority thought, now, as he asked, the
- 6:41Speaker 4: convenient authority could toss it out the jury after court
- 6:45Speaker 4: martial found someone guilty, right, and so uh so he
- 6:49Speaker 4: had already done that in the lieutenant colonel's case, the
- 6:51Speaker 4: airman case, who was getting ready to do convenient authority duties.
- 6:57Speaker 4: And so the judge advocate generally Air Force at the time,
- 7:00Speaker 4: Richard C. Harding, Lieutenant General Harding, got involved and say, hey, look,
- 7:05Speaker 4: you know the Air Force policy at this time is
- 7:08Speaker 4: victas will be believed and all came for the trial,
- 7:10Speaker 4: and if you don't, that's going to put a target
- 7:12Speaker 4: on that and so and so that and so not
- 7:15Speaker 4: only was the judge Advocate General guilt of unlawful command influence.
- 7:19Speaker 4: At the time Secretary of the Air Force Beverly James
- 7:21Speaker 4: got caught up in that. Who ironically she's still in
- 7:23Speaker 4: the NISER last time a check. She's an advisor of
- 7:26Speaker 4: the wars and so so that, so that was the
- 7:29Speaker 4: background of the policy that you know, was substantiated by
- 7:33Speaker 4: orders from the Judge Advocate General of the of the
- 7:36Speaker 4: Air Force, who at the time was a top prosecutor.
- 7:38Speaker 2: Right so, and.
- 7:39Speaker 1: So the Advocate general what does the judge Advocate general
- 7:43Speaker 1: do typically?
- 7:45Speaker 3: What is the function.
- 7:47Speaker 2: Of that?
- 7:47Speaker 4: So they are the top prosecutors in each service, right
- 7:50Speaker 4: so they are the ones who assigned judges. They are
- 7:53Speaker 4: the ones who assigned where people were. Your judge advocate
- 7:59Speaker 4: attorneys go within the within the service.
- 8:02Speaker 2: They are this is you know, yeah.
- 8:05Speaker 1: So there, this is for the internal Yeah, but it's
- 8:08Speaker 1: internal Air Force STUF. It's kind of like internal affairs
- 8:11Speaker 1: for the okay.
- 8:12Speaker 2: Well, East Service, So East Service accepted.
- 8:14Speaker 4: The Marines has a Judge Avicate General which is a
- 8:17Speaker 4: three starting billet, except for the Marines lob. The Marines
- 8:20Speaker 4: fall under the department of the Navy. So the Air
- 8:22Speaker 4: Force has a judge advacate general. Three star Army does,
- 8:25Speaker 4: and so does the Navy. Right coach star has something
- 8:27Speaker 4: equivalent to that. But it's but so that that's that's
- 8:31Speaker 4: along the saying line. Judge evicate general is equivalent to
- 8:34Speaker 4: your general over state. Right, so the attorney general over
- 8:36Speaker 4: state is a top cop you know what I'm saying,
- 8:40Speaker 4: the top prosecutor. That So that's what they are. And
- 8:42Speaker 4: so that's the guidance he passed on. And so fast forward.
- 8:46Speaker 4: Now every uh commander that that's he is saying. We
- 8:52Speaker 4: were standing and everything, everything is going, everything's going to trial.
- 8:54Speaker 4: Soal in my case, I was a squad and commander.
- 8:58Speaker 4: My wife was a school teacher. She was we had
- 9:03Speaker 4: just Holloman Air Force Base and Alama border, New Mexico.
- 9:06Speaker 4: And so she starting another school teacher, you know, starts
- 9:09Speaker 4: having an affair. And so I when I found out.
- 9:12Speaker 2: About you know, our force, uh, and I.
- 9:16Speaker 4: Get awarded customer over our girl. Okay cool, and so
- 9:21Speaker 4: so you know, and and the family Court actuvated. You
- 9:25Speaker 4: get tossed out all the time, right, So you know,
- 9:27Speaker 4: when you when you fight for custody or fight for property.
- 9:30Speaker 4: You know, actually you get tossed all the time. Judge
- 9:33Speaker 4: didn't believe it. She had she had a criminal record
- 9:35Speaker 4: that we were able to disclose. So all these things
- 9:37Speaker 4: came up during a divorce. Right, so she is pissed.
- 9:40Speaker 4: So only are you see of the kid? Now I
- 9:44Speaker 4: got a pace, gotcha?
- 9:45Speaker 2: Oh? Hell now? Right? What her and her mother did
- 9:50Speaker 2: they called my.
- 9:50Speaker 4: Wing leadership and said and so now they're taking advantage
- 9:55Speaker 4: of this. Oballs, is that even placed through the service
- 9:57Speaker 4: secretary down the defiicate general, right, all victors would be
- 10:00Speaker 4: believe court martial and my wife, excuse me whatever it
- 10:05Speaker 4: has done nothing I sexulted wife while we were married.
- 10:10Speaker 2: Right, So she rose.
- 10:12Speaker 1: And let me sticks, let me, let me, let me
- 10:16Speaker 1: just repeat this real quick for the people that are listening,
- 10:20Speaker 1: because you're breaking up a little bit.
- 10:21Speaker 3: But I'm gonna I understood what you said.
- 10:23Speaker 1: So you you had a wife, she was a school teacher,
- 10:27Speaker 1: you were in the military. She cheated on you. This
- 10:31Speaker 1: is like where you know this? This was crazy. So
- 10:34Speaker 1: she's she's having an affair. You filed for divorce. When
- 10:39Speaker 1: you find out, you get the kids, right, and then
- 10:44Speaker 1: your wife because she was gonna have to pay child support,
- 10:48Speaker 1: right because she she lost the kids and she was
- 10:51Speaker 1: gonna pay child support. And instead of doing that, she
- 10:54Speaker 1: decided to collude with your mother in law, her mother
- 10:58Speaker 1: and accuse you of sexual assault, which I guess like, well,
- 11:04Speaker 1: the claim is that you fonneled her breasts and penetrated
- 11:07Speaker 1: her digitally. Yeah, you did eat her, and that because
- 11:15Speaker 1: they didn't go to the criminal courts or the civilian courts.
- 11:18Speaker 1: They took it to the military courts, and the military
- 11:21Speaker 1: courts just they don't even like their standards are completely different.
- 11:26Speaker 1: Is that fair to say to describe.
- 11:28Speaker 4: Okay, yes, sir, well there aren't any standards. Matter of fact,
- 11:32Speaker 4: there was a and let me know, if I sound choppy,
- 11:35Speaker 4: I'll certainly some things. As a matter of fact, a
- 11:39Speaker 4: Judiaries Panel all the JPP, which they were established in
- 11:43Speaker 4: roughly July I'm sorry, twenty thirteen is when they were established.
- 11:51Speaker 4: And this was by the National Defense Authorisation Act at
- 11:53Speaker 4: that time. And so they established a panel of civilians
- 11:57Speaker 4: and they later became a dak iPad, but they were
- 11:59Speaker 4: the JPP initially group of civilians, attorneys, judges going around
- 12:03Speaker 4: to military installation looked at hey, how's the military doing
- 12:06Speaker 4: with sexual sought cases?
- 12:08Speaker 2: And so the biggest finding at that time, this is
- 12:11Speaker 2: in the.
- 12:12Speaker 4: Report came out and I want to say twenty sixteen
- 12:16Speaker 4: that military of prosecuting cases with no probable cause, right.
- 12:19Speaker 4: And so in the civilian side, well, first of all,
- 12:22Speaker 4: the American Bar Association says, if you are attorney right
- 12:26Speaker 4: in the United States, that's that's judicated by the American
- 12:29Speaker 4: Bar Association. You cannot prosecute a case no probable cause. Well,
- 12:34Speaker 4: the military is prosecuting cases no probable cause. That was
- 12:36Speaker 4: the huge finding from that. And so for the so
- 12:39Speaker 4: for the non legal people, probable cause is basically a
- 12:42Speaker 4: statue that said there's a probability that the accusation happened, right,
- 12:46Speaker 4: and so therefore you can prosit a case like that.
- 12:48Speaker 4: If there's no probability that the accusation happened, you cannot
- 12:52Speaker 4: prosecute this case.
- 12:53Speaker 2: So that's why a lot of these cases.
- 12:55Speaker 4: Are getting prosecuted in military because they are saying, hell
- 12:59Speaker 4: with the American Bar Association standard, the ABA, we're gonna
- 13:01Speaker 4: prosecute this case. It And so my my my head
- 13:05Speaker 4: is against these jausers.
- 13:08Speaker 2: It's like we're freezing again.
- 13:11Speaker 1: No, a little bit, but you're you're you're good, okay, okay.
- 13:15Speaker 4: So my head is against these jacks, right, So what's
- 13:18Speaker 4: going on is instead of these jaggs co plaints to
- 13:21Speaker 4: the American Bar Association saying, hey, the military is making
- 13:25Speaker 4: us prosecute these cases, no probable cause to petition, make
- 13:29Speaker 4: me lose my law license, they're being quiet getting out
- 13:33Speaker 4: of the military and representing the service members in these
- 13:37Speaker 4: cases to get money.
- 13:38Speaker 2: You know what I'm saying, because it's a cash cow.
- 13:41Speaker 2: You see what I'm saying.
- 13:42Speaker 4: Yeah, you know, and so and so know this right,
- 13:44Speaker 4: they know this right. And so I filed the human
- 13:46Speaker 4: rights planks to the Inter America Commissioner Human Rights, kind
- 13:49Speaker 4: of stump under the rug. And so that was one
- 13:50Speaker 4: of the complaints I had. You know, Jack attorneys, if
- 13:53Speaker 4: you know the military is making you do this right
- 13:55Speaker 4: and it's a violation of your oth the office because
- 13:57Speaker 4: the old says you shall support and defend the Constitution. Well,
- 14:00Speaker 4: there's an element in the concert called Doe process. And
- 14:02Speaker 4: so whether you are a jack attorney or an officer
- 14:06Speaker 4: a convenient restort, you have a duty to the Constitution.
- 14:10Speaker 4: And so if the if service member. Your service is
- 14:13Speaker 4: making you old about that constitution even know you have
- 14:17Speaker 4: a right to do something about it. And so so
- 14:20Speaker 4: that's number one. So to cigure back, Yes, my wife,
- 14:23Speaker 4: so after that happened, she accused me of of rubbing
- 14:28Speaker 4: her breast and digitally penetrating her and.
- 14:30Speaker 2: Anything else that can stick to the wall and injury.
- 14:34Speaker 4: The insult is we had law enforcement officials testify my corcial.
- 14:39Speaker 4: We're talking a police officers.
- 14:41Speaker 2: That investigated it, and none of this ever happened.
- 14:45Speaker 1: So well here here's just a strange question. Okay, So,
- 14:49Speaker 1: like I'm married and I do occasionally rub my wife's
- 14:55Speaker 1: breasts as well, so like when she makes So what
- 14:58Speaker 1: I'm saying is is that the allegation doesn't sound like
- 15:02Speaker 1: assault unless you change the contact. So is she saying
- 15:07Speaker 1: that this happened, like was there like a time frame
- 15:12Speaker 1: that she's claiming Because it feels like this on its own,
- 15:16Speaker 1: should not, you know, stand up to scrutiny because if
- 15:19Speaker 1: you were married, then you were intimate at some point,
- 15:22Speaker 1: you know, right, I mean, So.
- 15:24Speaker 2: So here's what the law says.
- 15:25Speaker 4: The law says that if you're a married couple, you
- 15:28Speaker 4: have what you're what you have called and applied consent, right,
- 15:32Speaker 4: Like like if I'm dating somebody, or if I go
- 15:35Speaker 4: to a party and there's a woman pat out drunk
- 15:37Speaker 4: on the on the bed, I can't start fondling her
- 15:41Speaker 4: because there's no ada concent because we're natterie, right.
- 15:43Speaker 2: But what the law says.
- 15:45Speaker 4: Is that your wife can be drunk past out, and
- 15:48Speaker 4: because she's your wife, you have likeing to sin.
- 15:50Speaker 2: Right. So what happened with me?
- 15:53Speaker 4: My wife says that I tried to do these things
- 15:56Speaker 4: her and sold me this is rape. You gotta stop.
- 16:00Speaker 4: I continue to do it now. It never happened. It's
- 16:02Speaker 4: no evidence of it happening. It never happened.
- 16:04Speaker 2: But she just says, okay, this is.
- 16:05Speaker 4: Something this and you know, and her mother was on
- 16:08Speaker 4: the council locally at a military it's called Fort Rutgers
- 16:11Speaker 4: called Fort Nobles from now. So mother's well involved with
- 16:14Speaker 4: the military laws and the rules with the guards to
- 16:18Speaker 4: hot button items. And so that's why the mom was
- 16:21Speaker 4: on the phone call with my calling my base leadership saying, hey,
- 16:27Speaker 4: my son in law sexual assaulted martyr and you guys
- 16:31Speaker 4: are gonna do about this, right and so and so.
- 16:34Speaker 4: Not only that, but she was threatened to go to
- 16:35Speaker 4: the local media saying that the military wasn't doing anything
- 16:38Speaker 4: about it, and so it was, it was so so
- 16:41Speaker 4: get this Brian right before try so so so not
- 16:45Speaker 4: only did my wife make the accusation, but she was pregnant.
- 16:48Speaker 4: She got pregnant by this guy. You know what I'm saying.
- 16:51Speaker 4: Not know, did she have the affairs? She got pregnant
- 16:52Speaker 4: by that Goods you know. And so yeah, man, it's
- 16:56Speaker 4: just look, this is a Tyler Perry movie in the making.
- 16:59Speaker 2: You know, gonna figure ot who gonna play you in
- 17:01Speaker 2: the movie. Probably probably.
- 17:05Speaker 3: Me, somebody George, George, I don't know.
- 17:10Speaker 1: No, no, So go ahead, John SteamOS, I think, but
- 17:15Speaker 1: we'll do that.
- 17:16Speaker 2: I can see that.
- 17:17Speaker 4: I can see that. I can see that. So right
- 17:22Speaker 4: before trial, my wife says, look, if you give me
- 17:25Speaker 4: custody of our daughter, I won't testify your court martial.
- 17:28Speaker 2: Right. These are text messages her divorce attorney, my divorce attorney. Bright.
- 17:33Speaker 4: I take these text messages, I submit them to the prosecutor,
- 17:37Speaker 4: we submit them.
- 17:38Speaker 2: To my conven authority.
- 17:39Speaker 4: And the feedback I got was bring it up in trial.
- 17:43Speaker 4: I'm like, damn, Like this is motive, right, you still
- 17:46Speaker 4: want to go through with this court martial. And so look, look,
- 17:50Speaker 4: so I'm thinking, Okay, there's no way in hell I'm
- 17:53Speaker 4: gonna go uh jury, because I also that a lot
- 17:57Speaker 4: of times these guys do sit on your as a jury.
- 18:01Speaker 4: They're thinking, well, you got to be give something because
- 18:03Speaker 4: your boardmark right.
- 18:04Speaker 2: I didn't want to go with that. I wanted I'm
- 18:06Speaker 2: gonna judge.
- 18:07Speaker 4: Alone because the judge was a little ball know all
- 18:10Speaker 4: these things right now.
- 18:11Speaker 2: Hell, I know that President Obama.
- 18:14Speaker 4: Through the Service secretaries had told uh, the Jeffeck General
- 18:18Speaker 4: told all the judge who will over all these court martials?
- 18:21Speaker 4: And hey, if he said, she said the case, the
- 18:24Speaker 4: credibility goes see them. So my case, he said, she said,
- 18:28Speaker 4: So I know what I was doing, right, and so
- 18:31Speaker 4: the judge can be guilty and sentenced me to forty
- 18:35Speaker 4: two months in.
- 18:37Speaker 2: The mid prison. Come on, Brian, I was never after arrested.
- 18:40Speaker 4: Okay, so and so so so so, so the the
- 18:45Speaker 4: bar to get an arrest is low, right, the bar
- 18:48Speaker 4: to get a conviction is high, you know, well beyond
- 18:52Speaker 4: reasonable doubt.
- 18:52Speaker 2: So so I'm thinking.
- 18:53Speaker 4: How the hell if I don't even meet the bar
- 18:55Speaker 4: to get an arrest. How the hell do I meet
- 18:57Speaker 4: the bar to get a conviction?
- 18:59Speaker 2: You know?
- 19:00Speaker 1: Yeah? Let me let me read that bit. I like
- 19:03Speaker 1: that you did. You have on the website which is
- 19:05Speaker 1: linked below. You guys can check it out all of
- 19:08Speaker 1: the stuff that is involved with this this case and
- 19:12Speaker 1: all of the like complaint letters and everything.
- 19:15Speaker 3: It's very very concise.
- 19:17Speaker 1: But I want to I want to read this one
- 19:19Speaker 1: bit because you guys, you got this is this is
- 19:21Speaker 1: you gotta this is insane, Okay, So look at this.
- 19:24Speaker 1: So Major Anderson, in April twenty fifteen, you were court
- 19:27Speaker 1: martialed stemming from accusations.
- 19:30Speaker 3: Like we talked about.
- 19:33Speaker 1: At this time, the Judge Advocate General of the Air Force,
- 19:35Speaker 1: Lieutenant General Richard C. Harding, passed guidance to military judges
- 19:39Speaker 1: that all victims are to be believed and their cases
- 19:42Speaker 1: referred to trial with no pre trial confinement, no physical
- 19:46Speaker 1: evidence against Anderson, and civilian police officers testifying at trial
- 19:51Speaker 1: there was no evidence of any crime. So there were
- 19:54Speaker 1: cops saying that there's no evidence of any crime at
- 19:57Speaker 1: the trial.
- 19:57Speaker 3: Doesn't matter.
- 19:58Speaker 1: Judge alone Panels still found you guilty and sentenced you
- 20:02Speaker 1: to forty two months in prison.
- 20:04Speaker 2: Prior to that.
- 20:06Speaker 1: I don't know if you got to this bit, but
- 20:07Speaker 1: this is where against interesting to me. His wife offered
- 20:10Speaker 1: a bribe that if Major Anderson gave her full custody
- 20:13Speaker 1: of her daughter, then she would forego testifying at trial.
- 20:18Speaker 3: So she was willing.
- 20:19Speaker 1: She was willing to like, not send you to jail
- 20:22Speaker 1: if you gave her custody of your kid. This bribe
- 20:27Speaker 1: violated federal law eighteen US two on one. Bribing witnesses
- 20:31Speaker 1: and public officials was struck strictly forbids anyone offering something
- 20:35Speaker 1: of value to testimony in a federal proceeding. You declined
- 20:40Speaker 1: her offer and presented the evidence to his convening authority.
- 20:44Speaker 1: But this violation of federal law, with overwhelming evidence of
- 20:47Speaker 1: motives to fabricate accusations, were ignored after trial. It was
- 20:51Speaker 1: also discovered that the mother in law paid the man
- 20:55Speaker 1: his wife had an affair with one hundred thousand dollars.
- 21:00Speaker 2: But you got, like doctor evil one hundred thousand, yes.
- 21:04Speaker 1: One hundred thousand dollars prior to his testimony about his
- 21:09Speaker 1: relationship with Andres's wife. So your wife, your mom in law,
- 21:14Speaker 1: and the guy your wife was sleeping with or your
- 21:18Speaker 1: ex wife. They all colluded and they tried to like
- 21:23Speaker 1: is this just about the custody or is there some
- 21:26Speaker 1: vindictive thing going on? I mean, I guess you can't
- 21:29Speaker 1: really know and it doesn't really matter, but yeah, like
- 21:33Speaker 1: one hundred thousand dollars, and then you post it. You
- 21:36Speaker 1: were awarded post trial hearing to evaluate the one hundred
- 21:39Speaker 1: thousand dollars payment after you, as Congresswoman Martha Roby submitted
- 21:43Speaker 1: a congressional to the Air Force on the payment. The
- 21:46Speaker 1: Air Force told Congresswoman Roby, the military judge have full
- 21:50Speaker 1: authority to overorder a new trial or dismiss the charges
- 21:53Speaker 1: at the post trial hearing. But when witnesses at the
- 21:56Speaker 1: post trial hearing perjured themselves, the Air Force renegged on
- 22:01Speaker 1: what was told to Congresswoman Robi and refused to allow
- 22:05Speaker 1: Anderson's attorneys to file a motion for a new trial,
- 22:08Speaker 1: saying the judge was not authorized.
- 22:10Speaker 2: Yes, sir, that's exactly what happened.
- 22:13Speaker 4: So so so the fix is in, right, you can't.
- 22:17Speaker 2: You can't if anybody wants to know, at the highest.
- 22:20Speaker 4: Level service, the fixes in look at my case, right,
- 22:23Speaker 4: because so when so here's.
- 22:25Speaker 2: How I just working.
- 22:26Speaker 4: Once there's a congressional it goes through a special office
- 22:30Speaker 4: at headquarters at Air Force for them to sort it through.
- 22:33Speaker 4: The Air Force Secretary signs up on it. So at
- 22:36Speaker 4: the time, you got a service member in a high
- 22:39Speaker 4: profile case who there's evidence of witness tamperary, right, And
- 22:45Speaker 4: so so my mom goes to d C. God man
- 22:48Speaker 4: for one from my mama. I definitely would be lost, man.
- 22:51Speaker 4: So my mom goes to d C and so she
- 22:53Speaker 4: takes recorded conversation, right. So first one, I'm incarcerated, we
- 22:57Speaker 4: found guilty. We heard through my ex's side and family
- 23:03Speaker 4: of money was Jane to the guy, right, And so
- 23:07Speaker 4: my mom says, Okay, I'm gonna call this just see
- 23:13Speaker 4: being a boarded. And so my mom calls him. He
- 23:18Speaker 4: spills the beans, right because now she's given him hell
- 23:22Speaker 4: over their kids.
- 23:22Speaker 2: So he's he's feeling terrible about what happened, and so
- 23:25Speaker 2: he's ready to talk.
- 23:26Speaker 4: So and so, initially I could not admit the affair
- 23:30Speaker 4: as a motive during my court martial because both of
- 23:33Speaker 4: them lied and says that they weren't sleeping together until
- 23:35Speaker 4: we were divorced. And so the judge was like, well,
- 23:38Speaker 4: I can't, we can't admit this unother rape show protection issues.
- 23:41Speaker 4: I can't admit this because it has nothing to do
- 23:43Speaker 4: with the accusation of the specific time. And so we
- 23:46Speaker 4: found out. So my mom calls him. He admits to
- 23:50Speaker 4: Lyne up when the air started. Now you know what
- 23:52Speaker 4: I'm saying. Then he also says, well, her mom paid
- 23:53Speaker 4: me ten thousand dollars to do this, right, So that's
- 23:56Speaker 4: what he said on a recorded phone call. So my mother,
- 23:59Speaker 4: we transferred the conversation that was recorded, took it to
- 24:02Speaker 4: my local courthouse. They certified it, transcribed it. I gave
- 24:06Speaker 4: a few of that plus recording to the Air Force,
- 24:09Speaker 4: and I gave a copy of that plus recording to
- 24:11Speaker 4: my congresswoman. So she takes it, says okay, submits the
- 24:15Speaker 4: Congressional the Air Force. Air Force, okay, is what we're
- 24:19Speaker 4: going to do. Major ands case is not yet final.
- 24:22Speaker 4: We are going to have a post droung hearing, and
- 24:24Speaker 4: the judge out of the post dron hearing as full
- 24:27Speaker 4: authority to rule in any emotion that Major Anderson's attorneys submit,
- 24:31Speaker 4: whether it be a motion for a new trial and
- 24:34Speaker 4: motion to dismiss.
- 24:35Speaker 2: Now, now get this, Brian, here's the crux of it.
- 24:38Speaker 4: I think my case is the only case federal case
- 24:41Speaker 4: where you have suspected people committed of a crime testify
- 24:46Speaker 4: and there's no investigation to go with it, right and
- 24:48Speaker 4: so and so the air Force was like okay, and
- 24:51Speaker 4: the judge was like, we're just gonna take their word
- 24:52Speaker 4: for it, that everything they're saying is true and so
- 24:56Speaker 4: and but I'm like, hold on, shouldn't we look at
- 24:58Speaker 4: text messages.
- 24:58Speaker 2: Shouldn't we be looking at the email? Hell?
- 25:00Speaker 4: Can we get the FBI to look at this, because
- 25:02Speaker 4: even though there are civilians, I know os I and
- 25:05Speaker 4: the regular military investigators can't do anything. What about the feds?
- 25:08Speaker 4: Can we get that FBI to look at this? Airport
- 25:10Speaker 4: was like, hell, no, we ain't trying to get a conviction.
- 25:12Speaker 4: We just want to make it look like we're giving
- 25:14Speaker 4: you due process. So so, so that was the first
- 25:16Speaker 4: part of it. So then we get forward both of
- 25:19Speaker 4: them and my ex wife now and her boyfriend, and
- 25:23Speaker 4: a mother says, no, it wasn't ten thousands, one hundred
- 25:26Speaker 4: thousand dollars, And we're like, what but this hell, but
- 25:29Speaker 4: we only gave.
- 25:29Speaker 2: It, you know, to him, you know, to remodel his house,
- 25:33Speaker 2: you know, And.
- 25:34Speaker 4: I'm like, well, just just that alan should be issues,
- 25:38Speaker 4: I said, because if I don't know this, I probably
- 25:39Speaker 4: would have went with a jury panel so they can
- 25:41Speaker 4: hear this, right.
- 25:42Speaker 2: And so the judge.
- 25:44Speaker 4: Was like, well, I don't have any authority to do anything,
- 25:46Speaker 4: and we're I'm just here as a fact finder to
- 25:48Speaker 4: hear the facts and that'd be it and give it
- 25:51Speaker 4: to the Court of the And so that that response
- 25:55Speaker 4: to my congresswoman at the Air Force gave her that
- 25:57Speaker 4: the judge had full authority. I didn't get that until
- 26:00Speaker 4: four months after my post try hearing. Right, so the judge,
- 26:03Speaker 4: I can't do nothing. Get it to the Court of Appials,
- 26:05Speaker 4: let them, let them work with it. And so my
- 26:08Speaker 4: mother had went back to d C, sat back down
- 26:10Speaker 4: on Congress with Roobi. Congress of Roby's like, well, I
- 26:12Speaker 4: don't know why they told you that what they told
- 26:14Speaker 4: me in the letter. And I'm like, if we would
- 26:17Speaker 4: have had this letter out of a post our hearing, we
- 26:19Speaker 4: would hold on government. You guys are full of shit,
- 26:22Speaker 4: because you've already can see it the Congress. Let the
- 26:25Speaker 4: judge are full of authority, you know. So, uh, that's
- 26:28Speaker 4: what happened in the military side of things. So they
- 26:31Speaker 4: rubber stamped the conviction. Brian Court of Appeals didn't want
- 26:35Speaker 4: to hear it because now you know, because think about this,
- 26:38Speaker 4: Deberly James, the previous Secretary of the Air Force, had
- 26:41Speaker 4: already got got called slapped on the hand for unlawfully
- 26:44Speaker 4: influencing that that airmin Branditsy Wright case. So now you've
- 26:48Speaker 4: got followed up with Now she's also involved with lyning
- 26:51Speaker 4: to Congress. Oh, that would have completely undid all of this.
- 26:55Speaker 4: And so they rubber stamped my case because they didn't
- 26:57Speaker 4: want that to be known. And matter of fact, if
- 26:59Speaker 4: you look at the Air Force Court come up his findings,
- 27:02Speaker 4: they mentioned nothing about the Congression to Martha Roby at all,
- 27:05Speaker 4: you know. And so now get this, I file a
- 27:09Speaker 4: federal lawsuit and the Fourth Federal District Court DC because
- 27:14Speaker 4: the federal courts, if you're wrong to the military, the
- 27:17Speaker 4: federal courts can remedy and fix what the.
- 27:20Speaker 2: Military does to you.
- 27:21Speaker 4: So I filed a federal lawsuit and Alexandria, Virginia the
- 27:26Speaker 4: fourth Federal District because Alexander's where the Pentagon is right
- 27:29Speaker 4: and so I'll be damned.
- 27:31Speaker 2: They got to the federal judge right.
- 27:33Speaker 4: So the federal judge ruled this is in February twenty
- 27:36Speaker 4: twenty Bryant. He ruled that, well, this recording phone call
- 27:40Speaker 4: that you're alleging that you're saying happened, well, we don't
- 27:43Speaker 4: see anywhere in the record that you ever submitted this
- 27:46Speaker 4: to the air for doing your appeal. And I'm like,
- 27:52Speaker 4: I got to post our hand because of this. What
- 27:54Speaker 4: are you talking about?
- 27:55Speaker 2: So I submitted several reconsideration Moss to the judge.
- 27:59Speaker 4: Matter of fact, I want to want American News to
- 28:02Speaker 4: talk about this and my story.
- 28:03Speaker 2: One American News watched the video Heresident Trump's attention.
- 28:06Speaker 4: Yeah, yeah, that that interviews well got President Trump attention
- 28:09Speaker 4: where he ultimately offered me the pardon that I that
- 28:12Speaker 4: you know I told this all?
- 28:14Speaker 1: So yeah, yeah, wait, wait wait, so let's let's back
- 28:17Speaker 1: up a little bit. So like in because you sent
- 28:21Speaker 1: a letter you petitioned Biden for a new trial, and
- 28:27Speaker 1: there was a petition. It's it's linked in your on
- 28:30Speaker 1: your website. First I think it's the first link on there. Yeah, yeah,
- 28:34Speaker 1: it's the first link on there. And I'm going to
- 28:35Speaker 1: read it really quick. It's not long, but I'll read
- 28:38Speaker 1: it for the audience. So you you petitioned President Biden?
- 28:43Speaker 1: What year? What year did you do that? I mean,
- 28:44Speaker 1: I assume it was in when he was in office
- 28:46Speaker 1: twenty twenty two. I think January. Oh no, February first,
- 28:50Speaker 1: twenty twenty two. Okay, February first, twenty twenty two. So literally,
- 28:54Speaker 1: like you know, three years ago, and you said, Dear
- 28:58Speaker 1: President Biden, I write to request your so in ordering
- 29:00Speaker 1: a new trial for Major Clarence Anderson, the third, whose
- 29:03Speaker 1: military court martial was allegedly plagued with unlawful influence and
- 29:08Speaker 1: prosecurratorial prosecuratorial misconduct.
- 29:12Speaker 2: Hey, Bob, I think that letter is from my congressman.
- 29:14Speaker 2: I think, oh yeah, it is Barry Moore. Yeah, yeah, yeah.
- 29:18Speaker 1: As you may know, on April twenty second, twenty fifteen,
- 29:20Speaker 1: Major Anderson was convicted of sexual assault and other related
- 29:24Speaker 1: charges in a general court martial trial. Since his conviction,
- 29:27Speaker 1: Major Anderson has maintained his innocence and produced accounts of
- 29:31Speaker 1: alleged bribery, evidence suppression, and witness tampering throughout his court martial,
- 29:36Speaker 1: military appeal, and federal appeal. The Air Force Inspector General
- 29:40Speaker 1: has reviewed the case. However, Major Anderson has produced documentation
- 29:44Speaker 1: that he believes proves wrongdoing.
- 29:46Speaker 3: I respectfully request.
- 29:48Speaker 1: That you consider ordering a new trial to ensure that
- 29:52Speaker 1: Major Anderson is presented with a chance to prove his innocence.
- 29:55Speaker 1: I am confident that your support would help bring about
- 29:57Speaker 1: a timely conclusion to Major Anderson's efforts. I'm laughing because
- 30:02Speaker 1: that's obviously not what happened. If you are your staff
- 30:04Speaker 1: have questions regarding this request, please do not hesitate to
- 30:07Speaker 1: contact my chief of staff, Shana t Chan. And then
- 30:10Speaker 1: there's a phone number. So, uh so you did do
- 30:13Speaker 1: a petition. I assume you didn't hear anything, and hence
- 30:17Speaker 1: why we are then you you are now? So so
- 30:20Speaker 1: that didn't go anywhere. What happened specifically with oh go ahead,
- 30:25Speaker 1: go ahead.
- 30:26Speaker 2: So there's one better.
- 30:27Speaker 4: So you got letter and then in June going to
- 30:29Speaker 4: the top of my paves a link where.
- 30:31Speaker 3: My con doj investigation.
- 30:34Speaker 4: Yes, your request, Yeah, so do that and they later
- 30:37Speaker 4: go back and say, hey, he's the Biden.
- 30:39Speaker 2: You're not going anything. How about you give this kit
- 30:41Speaker 2: to the part just right? Yeah?
- 30:44Speaker 4: Yeah, So that letter was twenty twenty two, and so
- 30:49Speaker 4: here's what Biden did, right, So the backdrop is President
- 30:52Speaker 4: Trump's already being indicted down in Florida for everything that
- 30:57Speaker 4: happened with regards to accusations against them and Ukraine and Georgia,
- 31:02Speaker 4: right and so and so at the at the backdrop,
- 31:05Speaker 4: he's getting ready to be at it. My Congress, Miss
- 31:08Speaker 4: Press Biden requested the Department of Justice look up case.
- 31:12Speaker 4: Biden says, no, we're not doing that. So and the
- 31:15Speaker 4: reason why Biden said said no is because.
- 31:19Speaker 2: You don't.
- 31:20Speaker 4: So, So anytime there's an investigator from the DA, they
- 31:23Speaker 4: have jurisdiction if you live Bill Clinton, right, Bill Clinton stood,
- 31:26Speaker 4: the DJ was supposed to be looking at accusations of
- 31:29Speaker 4: when he was governor during Whitewater, right, or something to
- 31:32Speaker 4: that effect. And so the DJ jurisdiction, will we find
- 31:36Speaker 4: one criminal conduct? We can keep looking and keep looking
- 31:38Speaker 4: to keep So with Marla Winsky, how do you go
- 31:41Speaker 4: from getting out as a gun to we're talking about
- 31:44Speaker 4: Mama Lewinsky with with semen on a dress, right? And
- 31:48Speaker 4: Bill Clinton mean Burke again, I didn't want because it's.
- 31:56Speaker 3: Gonna go back, Yeah, just go back just a little bit.
- 32:01Speaker 1: I don't know if it's because your voice is moving
- 32:04Speaker 1: a little far away from your microphone and the phone
- 32:07Speaker 1: is trying to keep up or maybe your connection. But
- 32:09Speaker 1: go on where you were saying about Monica Lewinsky's dress.
- 32:13Speaker 2: That's where we left off, right, So.
- 32:17Speaker 4: What I did was Biden didn't want uh an independent inveagated.
- 32:23Speaker 2: From the Department little taste.
- 32:26Speaker 4: Just like with Bill Clinton, they had an independent investigator.
- 32:29Speaker 2: Uh if I'm still breaking up, let me know.
- 32:34Speaker 4: So far so good, Okay, Okay, they'll bring on let
- 32:37Speaker 4: me and so uh so the independent investigator and president
- 32:42Speaker 4: was supposed to be that what happened to him as
- 32:43Speaker 4: governor and then but they find a criminal conduct, criminal
- 32:46Speaker 4: conduct and and and then openly with him being questioned
- 32:50Speaker 4: about alask right, So an issue that can keep investing investing,
- 32:58Speaker 4: and so President want to the human president lawful.
- 33:06Speaker 2: And to the jetfificate generals.
- 33:08Speaker 4: So what Biden did in that letter, the first letter
- 33:10Speaker 4: you saw, which is June twenty twenty two, requested the
- 33:13Speaker 4: DJ he got me air force let the game themselves. Well,
- 33:19Speaker 4: of course they didn't find anything wrong.
- 33:20Speaker 1: You know, yeah, maybe try turning your camera off. It
- 33:26Speaker 1: might it might be an issue of like too much
- 33:28Speaker 1: data going out. Maybe your audio will be better. And
- 33:31Speaker 1: we I mean, I don't want to take away your
- 33:33Speaker 1: pretty face. But let's try turning the camera off and
- 33:36Speaker 1: see if that makes your sound better.
- 33:38Speaker 2: Okay, let me uh, let me figure this out. Man,
- 33:41Speaker 2: My apologies.
- 33:43Speaker 1: Oh no, it's okay, it's like these things happen. We're
- 33:45Speaker 1: just like working with tech. Like you said, the evolution
- 33:49Speaker 1: will be televised.
- 33:52Speaker 2: No, no, I can if.
- 33:54Speaker 4: You call you laugh, but that's going to break everything
- 33:57Speaker 4: we've already started, right, so let me.
- 33:59Speaker 1: Know it's okay. Where you just try turning off your
- 34:03Speaker 1: camera and see if that in zoom you might be
- 34:06Speaker 1: able to just go into your video settings, yeah, to
- 34:10Speaker 1: stop the video and then now can now you can
- 34:13Speaker 1: still hear me?
- 34:14Speaker 2: Right? I can't? Can you still here? Yeah? I can
- 34:17Speaker 2: hear you?
- 34:18Speaker 1: Just fine, this might this might work better. Maybe it's
- 34:21Speaker 1: just because your phone's doing too much. So okay, okay,
- 34:26Speaker 1: So you okay, So you sent a request for the
- 34:29Speaker 1: DOJ to investigate. Did that bear any fruit?
- 34:36Speaker 4: No, sir, President Biden says, you know because the backdrop,
- 34:41Speaker 4: the backdrop was President Trump was getting ready to be
- 34:43Speaker 4: indicted down in Florida and for the insurrection all that stuff, right,
- 34:48Speaker 4: because that would get in one case that actually not
- 34:51Speaker 4: allowed to run for president, right because unless you says
- 34:53Speaker 4: constantly says, anybody can run unless you're found guilty of
- 34:56Speaker 4: insurrection or something like that. And so Biden didn't want
- 35:00Speaker 4: an independent investigator looking into my case because that would
- 35:04Speaker 4: ultimately that independent investigators started asking questions like okay, well
- 35:08Speaker 4: who gave this order?
- 35:09Speaker 2: Well, then so they're gonna start talking to service secretary.
- 35:11Speaker 4: Well, yeah, who gave me this order? I was someone
- 35:14Speaker 4: from an executive branch? Okay, who was from executive So
- 35:17Speaker 4: Biden didn't want that. And so that's why you know,
- 35:20Speaker 4: I've got to win this election. Uh, air Force, you
- 35:23Speaker 4: guys take a look at this and uh say, say,
- 35:26Speaker 4: nothing happened, and so this guy can go away.
- 35:28Speaker 1: And that's what happened. So nothing happened. If nothing happened, Yeah,
- 35:33Speaker 1: that that makes sense. So that that yeah, like, uh
- 35:39Speaker 1: I can I can see that.
- 35:40Speaker 3: So so you man, this is uh, this is wild.
- 35:47Speaker 1: So what let's fast forward to like more recent history.
- 35:54Speaker 1: You said that that President Trump is considering a pardon
- 35:59Speaker 1: for you, is that.
- 36:00Speaker 2: You were trying to that point?
- 36:02Speaker 3: So did you go ahead?
- 36:04Speaker 2: Go ahead? What happened next?
- 36:05Speaker 4: So in June of I'm sorry in twenty twenty my case,
- 36:09Speaker 4: you know, I go on one American News, I work
- 36:13Speaker 4: with the Justice for Warris Caucus. I get linked up
- 36:18Speaker 4: with an attorney from the Justice for Warris Caucus Congress,
- 36:21Speaker 4: and Louis Goldmert was phenomenal and helping me out. And
- 36:25Speaker 4: so through all those efforts, it comes back that, hey,
- 36:30Speaker 4: there's a there's a pardon offer. And so so I thought, well,
- 36:34Speaker 4: so at the time, he had already President Trump had
- 36:36Speaker 4: already got involved with Major Matthew Goldstein, who was an
- 36:40Speaker 4: Army ranger, who was the Army Greenborough sorry and first
- 36:43Speaker 4: Lieutendant Clinton Rance. So he had already gave executive action
- 36:47Speaker 4: for those guys. And so came back that he's looking
- 36:50Speaker 4: to do it for me. I said, look, I don't
- 36:52Speaker 4: want that. Can we just get a new trial? Okay,
- 36:54Speaker 4: let's just do a new trial. That way I can
- 36:56Speaker 4: present all his evidence, you know, And so said there
- 37:00Speaker 4: was there were efforts in place to order the new trial,
- 37:04Speaker 4: and then January happens, right, and so my point of
- 37:07Speaker 4: contact and the White House can train our phone calls
- 37:11Speaker 4: and so so the January sixth incident at the Capitol
- 37:16Speaker 4: towarded all the efforts for me to get a new trial.
- 37:19Speaker 2: And so fast forward.
- 37:20Speaker 4: Joe Biden is the president for the next four years,
- 37:23Speaker 4: to see how we try to reach out to him.
- 37:24Speaker 2: Didn't do anything. So now the President Trump's back in office.
- 37:27Speaker 4: Uh, the angle is still to okay, sir, you know,
- 37:30Speaker 4: it refreshes memory who I am. And so that's currently
- 37:34Speaker 4: from my understanding being worked out now because you know,
- 37:37Speaker 4: because we talked to artists, most most folks, you know,
- 37:40Speaker 4: everybody kind of wants, you know, things to go away. No, no,
- 37:43Speaker 4: I want these basses to be brought back to trial.
- 37:45Speaker 4: You know what I'm saying.
- 37:46Speaker 2: I want I want you to court market.
- 37:49Speaker 4: Just bring in the current chief of Staff, General Brown,
- 37:52Speaker 4: who had just fired the other day.
- 37:53Speaker 2: Let's bring back these service secretaries. I want everybody under
- 37:56Speaker 2: oath to say what they did.
- 37:58Speaker 3: Mm hmmm do you think that.
- 38:02Speaker 4: Like this? Uh?
- 38:03Speaker 1: Okay, So let's let's go back to the conviction. So
- 38:07Speaker 1: what is on your record right now? Like, like, are
- 38:11Speaker 1: do you because I've spoken to people that you know,
- 38:13Speaker 1: they got court martial there they they lose their veteran status.
- 38:17Speaker 3: They they have to go on a registry like what.
- 38:21Speaker 1: Kind of or that, or they just have like they're
- 38:24Speaker 1: basically considered an ex con.
- 38:26Speaker 2: What are your all the above, Brian, all the above?
- 38:29Speaker 4: So I am have a conviction record, I register sex offender,
- 38:36Speaker 4: and yes, yes, yes to all of those things you know,
- 38:40Speaker 4: once once a quarter. Because I'm in Alabama, I gotta
- 38:42Speaker 4: I gotta register locally. So I have to go and
- 38:46Speaker 4: register out the city and the county that I live
- 38:48Speaker 4: in every three months. I got to pay at ten
- 38:50Speaker 4: dollar fine every time I register. Now, you know, you're
- 38:53Speaker 4: talking about a guy who had a top seeker security clance, right,
- 38:56Speaker 4: who was vetted, who was a command who took part
- 38:59Speaker 4: in and keeping our country safe. And this is what
- 39:03Speaker 4: happens when you decide to fight for you fight for
- 39:07Speaker 4: not only your constitution, what's in a constitution?
- 39:10Speaker 2: Hell, fight for your kid, you know, and by give
- 39:12Speaker 2: my wife know this would happened. But I couldn't do that. Man.
- 39:16Speaker 1: Yeah, no, I completely understand that. So like, okay, so
- 39:22Speaker 1: you're so all of the above.
- 39:24Speaker 3: And all of this on.
- 39:27Speaker 1: Like I mean, it's not even it's not even a
- 39:31Speaker 1: preponderance of evidence. It's like no evidence, and so like,
- 39:35Speaker 1: where where do you think? And I know that Arvist
- 39:37Speaker 1: has talked about this and We've talked about this for years,
- 39:40Speaker 1: But why do you think the system is the way
- 39:44Speaker 1: it is right now? Like in terms of how you
- 39:46Speaker 1: know these things can be exploited, I know that they're Well,
- 39:49Speaker 1: I'll just let you tell me what you think where
- 39:52Speaker 1: this comes.
- 39:53Speaker 4: I think the big reason is we have senior officers
- 39:56Speaker 4: who are cowards, right, and.
- 39:59Speaker 2: You kind of every now and then they'll act like
- 40:01Speaker 2: they have a spine.
- 40:02Speaker 4: Remember when President Trump was officially like, all right, if
- 40:04Speaker 4: you are LGBTQ, you can't serve, and the military pushed
- 40:09Speaker 4: back and we're like, no, sir.
- 40:10Speaker 2: We can't do that. Right.
- 40:12Speaker 4: Well, we needed our same courage when they were passing
- 40:16Speaker 4: these laws to say, look, no probable cause victures will
- 40:20Speaker 4: be believed. And so generals and these service secretaries should
- 40:24Speaker 4: have pushed back said no, if we do these things,
- 40:27Speaker 4: this is a violation through process and we can't do that.
- 40:29Speaker 2: Right. So the first problem how it happened is.
- 40:31Speaker 4: Is because you have folks in seniorship positions with cowards
- 40:35Speaker 4: and didn't want to push back right number one. Secondly,
- 40:39Speaker 4: what's happening is is you've had an element in Congress
- 40:42Speaker 4: who have you know, forgotten their vows to the Constitution, right,
- 40:47Speaker 4: because you know, if you are a congressman or a senator,
- 40:51Speaker 4: you have a vowe to the Constitution. Right, So they submitted,
- 40:54Speaker 4: they've turned they've turned a blind eye to what they're
- 40:57Speaker 4: supposed to be doing, which is parting and defending the Constitution.
- 41:01Speaker 4: And so even though Congress has given even though the
- 41:04Speaker 4: Constitution I was given, members of Congress the authority to
- 41:07Speaker 4: you know, the power of the purse and the draft laws,
- 41:10Speaker 4: they still have to be lawful and so and so
- 41:13Speaker 4: what happens is you have the likes of like a
- 41:15Speaker 4: Senator lebrand or the Senator Claire McCaskill, a lot of Missouri, right,
- 41:20Speaker 4: a lot of folks who sit on their Armed Services
- 41:22Speaker 4: Committee who draft these laws because they want to get
- 41:24Speaker 4: elected in the district. So like, hey, I'm showing that
- 41:27Speaker 4: I'm tough on military sexual assault, so can you please
- 41:31Speaker 4: reelect me for another six years?
- 41:32Speaker 2: Right? And so and so that's what's going on.
- 41:36Speaker 1: Right, So there's cowardice and sort of grasping at power.
- 41:42Speaker 1: So like, you know, look, I'm I'm protecting essentially women
- 41:46Speaker 1: from dangerous men in the military, So vote for me again.
- 41:50Speaker 1: And and one of the things that we've talked about
- 41:54Speaker 1: with other guests, and I want to get your take
- 41:56Speaker 1: on this as well, is that there's also like the
- 42:00Speaker 1: military wants to like, you know, do whatever it can
- 42:03Speaker 1: to protect this reputation.
- 42:05Speaker 3: And this is going to bring us full circle to
- 42:07Speaker 3: the beginning.
- 42:08Speaker 1: So they're they're willing to just like throw you know,
- 42:12Speaker 1: guys like you under the bus if there's a conviction,
- 42:14Speaker 1: because they don't want this to like get out of
- 42:17Speaker 1: hand and become like a big circus because then it's
- 42:19Speaker 1: going to make them look bad. But there's also and
- 42:22Speaker 1: I think this is the more dangerous part of it,
- 42:25Speaker 1: is that there is this idea and I think this
- 42:28Speaker 1: came it probably predates the Obama administration, but I know
- 42:32Speaker 1: we were hearing about it from that time where there
- 42:35Speaker 1: was an assumption that because there are studies that claim that,
- 42:40Speaker 1: you know, sexual assault happens at a high frequency, for
- 42:43Speaker 1: example on college campuses. You know, there's this claim that
- 42:46Speaker 1: in the United States, one in every four women will
- 42:49Speaker 1: be sexually assaulted in her lifetime. And because there is
- 42:53Speaker 1: this in the status bogus by the way, But that's
- 42:55Speaker 1: that's a that's a whole other thing.
- 42:57Speaker 2: Is it's a myth.
- 42:58Speaker 1: But because we assume this true, and then we look
- 43:01Speaker 1: at the numbers of convictions. Then there are people who
- 43:04Speaker 1: do this this backwards reasoning, where it's like, well, the
- 43:08Speaker 1: stats say this happens this much, but we're not getting
- 43:11Speaker 1: these convictions, so we got to bump up the numbers
- 43:13Speaker 1: of convictions to match the data.
- 43:16Speaker 3: And so there are people in the military that.
- 43:18Speaker 1: They're just well, well, why don't we just lower the
- 43:19Speaker 1: standards and then we'll we'll we'll increase the number of
- 43:22Speaker 1: convictions and then we'll it'll make us look good, but
- 43:26Speaker 1: it's also going to keep us from, like you know,
- 43:29Speaker 1: I don't know, potentially destroying our reputation.
- 43:32Speaker 2: What do you think about that? Well, you're right.
- 43:34Speaker 4: Remember it goes back to this is a daptioned security issue, right,
- 43:37Speaker 4: and so if hell I call it crises.
- 43:40Speaker 2: And so.
- 43:42Speaker 4: Those same folks that we I just talked about now
- 43:45Speaker 4: don't want it to come back on them. But hold on,
- 43:47Speaker 4: hold on, you pass these egregious policies and laws that
- 43:51Speaker 4: led to this, We're going to hold you accountable. Right,
- 43:54Speaker 4: And so it all goes to not only is it
- 43:58Speaker 4: a you know, they don't want to look bad.
- 44:01Speaker 3: They don't a lot of folks that want to go
- 44:03Speaker 3: to jail. Yeah, yeah, for sure.
- 44:07Speaker 2: So if.
- 44:10Speaker 1: If it's true that this is a national security issue,
- 44:16Speaker 1: do you think that, like, I think it's for another
- 44:20Speaker 1: reason too, Like obviously men are not going to want
- 44:22Speaker 1: to enlist.
- 44:22Speaker 3: This kind of shit is going on in the military.
- 44:25Speaker 1: And I know that there are young men that want
- 44:26Speaker 1: to be like you you know, they they want to
- 44:29Speaker 1: be like you know, they're patriotic. They they think that
- 44:33Speaker 1: it's good to to that we have a strong military.
- 44:37Speaker 1: So like, what what would have to change to like,
- 44:41Speaker 1: you know, change that morale? And do you think that's
- 44:43Speaker 1: starting to happen now that we've like you know, it
- 44:45Speaker 1: looks like things are moving around very quickly, like now
- 44:48Speaker 1: that we have Pete Pete Hegseth in there and stuff
- 44:51Speaker 1: like that.
- 44:52Speaker 4: Well, well, Ron I always say, the most important government
- 44:56Speaker 4: official we have isn't the president, isn't mems of cong
- 45:00Speaker 4: is to send it the segregary offense, the most important
- 45:02Speaker 4: government we have in those proful government fits would have
- 45:04Speaker 4: a formed citizen, right, And so it's it's I want
- 45:10Speaker 4: people to be made aware of what's going on, because again,
- 45:13Speaker 4: if the average citizen is aware of what's going on
- 45:18Speaker 4: with their service members, right, because I think I saw
- 45:21Speaker 4: a stat where during World War Two, roughly forty percent
- 45:25Speaker 4: of the country had somebody that either served or the
- 45:27Speaker 4: knew somebody. I think now is that like a BYuT
- 45:29Speaker 4: maybe ten percent or maybe one percent of the country,
- 45:32Speaker 4: right has somebody who's with three hundred and thirty million people,
- 45:36Speaker 4: and I think roughly two many people in the DoD
- 45:39Speaker 4: to include civilians. So that's you know, roughly you know,
- 45:41Speaker 4: you do the number is probably one percent less than that,
- 45:44Speaker 4: And so that's that's part of the problem.
- 45:46Speaker 2: Most folks just don't know.
- 45:47Speaker 4: If most folks were aware of what's going on, and
- 45:50Speaker 4: they'd be like, hold on, I'm not electing you to
- 45:53Speaker 4: Congress to represent me when you are aligning this to
- 45:56Speaker 4: go on. I want someone up there who's going to
- 45:58Speaker 4: do something about this, right. So Number one is.
- 46:01Speaker 2: We've got to get awareness out there. Uh.
- 46:06Speaker 4: I could only get the one American News is and
- 46:09Speaker 4: the Fox News is to take my story because the CNN's,
- 46:13Speaker 4: MSNBC's those were the liberal progressive sites and they don't
- 46:18Speaker 4: want to go back towards you know, you know, women
- 46:21Speaker 4: that are you know, women that can be lying.
- 46:24Speaker 2: Right, And so now that goes against their base of viewers, right,
- 46:28Speaker 2: and so it's.
- 46:30Speaker 4: More palatable, it's more palatable to say, hey, we got
- 46:32Speaker 4: the wrong guy because of DNA.
- 46:34Speaker 2: Right, So it doesn't it doesn't take away that that
- 46:36Speaker 2: that that what happened to Courage has got the wrong guy.
- 46:39Speaker 4: So you can get the CNN's MSNBC's a report on that,
- 46:42Speaker 4: because yeah, this guy was wrong, so what tell that story?
- 46:46Speaker 2: But they don't want to tell a story that this
- 46:48Speaker 2: woman lied, right, look at them heard right?
- 46:52Speaker 4: No easier thomach and liberal media that okay, yeah, some
- 47:00Speaker 4: false accused of this and you know, Dan Prus, it
- 47:04Speaker 4: wasn't him versus this this this woman lied.
- 47:07Speaker 1: They don't want to tell that story, you know, no,
- 47:10Speaker 1: because it's there is a narrative that's trying to maintain
- 47:13Speaker 1: because there's a lot of a lot of people in academia,
- 47:16Speaker 1: in politics, in the media, and in general uh sociology, psychology,
- 47:23Speaker 1: et cetera, that they there they have to hold on
- 47:25Speaker 1: to this this narrative, and it is essentially a destructive
- 47:28Speaker 1: narrative that men are are dangerous to women in all times,
- 47:32Speaker 1: at all places, and so that in order to maintain that,
- 47:36Speaker 1: we gotta we gotta like do stuff like like these
- 47:38Speaker 1: kangaroo courts in the military, in college campuses, in the workplace,
- 47:42Speaker 1: the Me Too movement, all of it. It's it's all
- 47:46Speaker 1: off the rails and on purpose. It's not an accident.
- 47:48Speaker 3: So we just have to like rein it in.
- 47:51Speaker 1: And I think that the only way to do that is,
- 47:52Speaker 1: like you said, with the informed citizen that you know,
- 47:56Speaker 1: knows what's going on and is not afraid to speak up.
- 47:59Speaker 1: And I think as more regular people speak up with
- 48:02Speaker 1: their voice, with their vote, whatever, then you know, you'll
- 48:05Speaker 1: you'll see more people in the that like might find
- 48:10Speaker 1: their spines.
- 48:11Speaker 3: But it takes regular people to help them with that.
- 48:13Speaker 4: So, you know, I don't know how much time we
- 48:15Speaker 4: have left, but I would say we need to go
- 48:16Speaker 4: back to So in nineteen sixty nine, there's a Supreme
- 48:20Speaker 4: Court case called O'Callahan, right, And Callahan says, the vertical
- 48:25Speaker 4: on that one was that military members cannot be prosecuted
- 48:29Speaker 4: for non military relatingcies, right, And so that was a
- 48:32Speaker 4: land of law.
- 48:33Speaker 2: So unless it was duty related, you can't be court martial, right.
- 48:37Speaker 4: And so the premise was, hey, let the local civilian
- 48:41Speaker 4: folks who let the you know, local jurisdiction. Folks handle
- 48:44Speaker 4: non military related offenses right over that. It was called
- 48:49Speaker 4: statciss when miss sprin Court goes back on.
- 48:51Speaker 2: Our previous ruling.
- 48:52Speaker 4: So in nineteen eighty seven they overturned that nineteen sixty
- 48:55Speaker 4: nine O'callaian case. And in nineteen eighty seven, the case
- 48:58Speaker 4: it's called Scenario so Ario overturned the Callahan verdict and
- 49:02Speaker 4: so and the Salario verdict, they says, well, it doesn't
- 49:07Speaker 4: matter if it's military related or non military related. A
- 49:09Speaker 4: service member can be court martialed for whatever, you know
- 49:12Speaker 4: what I'm saying, And so I would like for us
- 49:14Speaker 4: to go back to that o' callahan verdict.
- 49:16Speaker 2: And the reason and the biggest.
- 49:18Speaker 4: Problem that you see with the eighty seven ruling that
- 49:21Speaker 4: overturned that is there are a lot of civilian witnesses
- 49:24Speaker 4: in these military court martials, and the military court martins
- 49:27Speaker 4: don't have jurisdiction over them. So like in my case,
- 49:29Speaker 4: I've got the victim, my wife lyon her mother loss
- 49:34Speaker 4: a pavilion lion, and the dude she was seeing with
- 49:38Speaker 4: They're all lying, Well, the military don't have any tea
- 49:40Speaker 4: to do anything, right, And so that was a problem
- 49:42Speaker 4: with the eighty seven Supreme Court decision is they had
- 49:46Speaker 4: a huge blind spot when it came to what about
- 49:49Speaker 4: civilian folks that are participating these military tribunals. So I
- 49:52Speaker 4: would love for the military to go back to the
- 49:55Speaker 4: nineteen and sixty nine O Callahan verdict and how let's
- 49:58Speaker 4: go ahead and just cross these cases that are only
- 50:02Speaker 4: military related, duty related?
- 50:04Speaker 2: Is everything else? You know? Yeah?
- 50:07Speaker 1: Yeah, oh that sounds that sounds good, and that's a
- 50:10Speaker 1: that's a good thing to think about as we close
- 50:12Speaker 1: out the show. But I want to thank you major
- 50:16Speaker 1: for coming on and telling us your story. And uh,
- 50:20Speaker 1: I included all the links. You guys got to check
- 50:23Speaker 1: this out. It's it's crazy, and you know, we we gotta.
- 50:27Speaker 1: It starts with changing the people. So I hope that
- 50:30Speaker 1: you all found something interesting, learned something today and I
- 50:35Speaker 1: want to I want Clarence if you could follow up.
- 50:38Speaker 1: If you learn anything new or anything any new developments
- 50:41Speaker 1: with your case, let us know and we'll bring you
- 50:43Speaker 1: back on.
- 50:45Speaker 2: Man. Look, Brian Bruh, you are worth your weight in gold.
- 50:48Speaker 2: I thank you.
- 50:49Speaker 4: I sincerely apologize for the connectivity issues, but at least
- 50:54Speaker 4: you got my silhouette, my black suit, looks looking like
- 50:57Speaker 4: a young elbow right there.
- 50:59Speaker 3: No, I know, like black Superman over here. I was
- 51:02Speaker 3: like this, this that's okay, this is it's idealized. Is
- 51:06Speaker 3: the film version is looking good these days? Kidding and party.
- 51:14Speaker 4: Man, I just want to say say thanks for having me,
- 51:15Speaker 4: Thanks for Harvests, for doing a lot of the legwork,
- 51:18Speaker 4: to reaching out to guys who want to tell our story,
- 51:21Speaker 4: and and look, man, we we we at the end
- 51:23Speaker 4: of the day. Man, I'm all about justice and what's right.
- 51:26Speaker 4: You know, I'm not saying that stuff bad stuff don't happen,
- 51:30Speaker 4: but let's put let's reinforce the procedures and practices that
- 51:35Speaker 4: we have in place. We'll just call the constitution. Right,
