- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:05We're going to pick up where we left off with
- 0:07the last episode and we're going to continue looking at
- 0:10the OIG report into the circumstances surrounding Jeffrey Epstein's death.
- 0:17And in our last episode, we were talking about the
- 0:20discovery of the security camera system recording issues. So let's
- 0:25pick right up with Section B response on August eighth
- 0:30and ninth to discovery of the recording failure. On August eighth,
- 0:35following discovery of the recording failure, Company one Service records
- 0:40reflect that the electronics technician contacted a Company one technical
- 0:44support representative who ultimately determined that two hard drives within
- 0:49DVR two had failed. According to the electronics technician and
- 0:54the Company one Service request record, the Company one representative
- 0:58informed the election letronics technician that the two drives needed
- 1:03to be replaced and that DVR two needed to be
- 1:06rebuilt in order for the cameras to record again. The
- 1:10electronics technician told the OIG that he informed a Company
- 1:14one technician that he had to obtain the drives from
- 1:18mcc New York's computer services manager. The electronics technician further
- 1:24stated that he left the institution at the end of
- 1:27his shift and did not obtain the hard drives and
- 1:30did not continue to work on the matter. The electronics
- 1:34technician told the OIG he had no idea why he
- 1:37did not stay at the facility to resolve the problem
- 1:40that day, but he noted for the OIG that he
- 1:43had not historically been required to stay after his shift
- 1:48ended to work on such matters, and even if he
- 1:51had begun working on the DVR that day, he would
- 1:54not have completed the work on August eighth due to
- 1:57the time it takes for the rebuilding process. The OIG
- 2:02found that the electronics technicians immediate supervisor, the facility manager,
- 2:07was on leave that week and therefore was not told
- 2:10on August eight about the DVR recording failure. The facility
- 2:14manager confirmed that he did not learn about the camera's
- 2:17problem until days after Epstein's death. The electronics technician told
- 2:22the OIG that he did not report the problem to
- 2:25the lock and security supervisor, who was the acting facility
- 2:29manager in the facility manager's absence. The SIS lieutenant told
- 2:34the OIG that after the electronics technician had examined the
- 2:38system on August eight, the electronics technician informed her that
- 2:43the cameras were not recording and said, I'm going to
- 2:46stay and do overtime tonight. Based on his comment, the
- 2:50SIS Lieutenant assumed that the electronics technician would remain at
- 2:54the institution after his shift ended that day to correct
- 2:58the issue. The electronics technician told the OIG there must
- 3:02have been some sort of miscommunication because he did not
- 3:05say he was going to work overtime and resolved the
- 3:08problem that same evening since he knew the problem could
- 3:11not be fixed in one evening. The electronics technician told
- 3:15the OIG that in hindsight, he should have stayed at
- 3:18the institution to begin work on the problem that same day.
- 3:22The Sis Lieutenant told the OIG that she verbally informed
- 3:26the captain on August eighth that the cameras were down,
- 3:30but BOP records reflect that the captain left the institution
- 3:34before the malfunction was discovered. The captain told the OIG
- 3:38that he did not learn about the DVR recording issue
- 3:41until after Epstein's death on August tenth, when he asked
- 3:45to see video related to the Epstein incident. Associated ward
- 3:49I confirmed she was with the Sis Lieutenant on August eighth,
- 3:53when the camera problem was discovered, but she told the
- 3:56OIG she only knew video could not be replaced. She
- 4:00did not know the recording system for certain cameras was down.
- 4:05She could see live video from the cameras on the
- 4:07date and therefore assumed that they were recording. According to
- 4:12the electronics technician, after he reported the work on August ninth,
- 4:15twenty nineteen, and attended to other matters throughout the day,
- 4:19the electronics technician obtained the replacement hard drives and attempted
- 4:23to perform the repair sometime late in the day. However,
- 4:28the electronics technician told the OIG that no SIS staff
- 4:33were present at the time to give him access to
- 4:35the room in which the DVR room was located, so
- 4:39he requested access from the only other individual who had
- 4:42a key to the space, Correctional Officer Number four. According
- 4:47to the electronics technician, Correctional Officer number four denied a
- 4:51access to the room because CO four shift was ending
- 4:54at four pm and CO four was unable to stay
- 4:57to accompany him in the space while the electronics technician
- 5:01performed the work. According to the electronics technician, CO four
- 5:06said he would be at the institution the following day
- 5:09to provide the electronics technician access to the room, so
- 5:13the electronics technician decided to postpone the repair until the
- 5:17following day. The electronics technician said his decision was influenced
- 5:22by the fact that he had historically been told by
- 5:25mcc New York supervisors that such matters did not have
- 5:29to be attended to until the following day, and even
- 5:32if he had replaced the hard drives that day, the
- 5:35rebuilding process would have taken twenty four hours to complete
- 5:39and would therefore not have finished until the following day anyway.
- 5:44Part c. Shoe Camera locations and operational status on August tenth.
- 5:51The electronics technician arrived at the institution around six am
- 5:55on August tenth, twenty nineteen, and shortly thereafter, before he
- 6:00could begin working on the DVR system, he heard the
- 6:02staff body alarm sound, and he reported to the shoe
- 6:06to assist. Later that day, he asked to pull potential
- 6:10video from cameras located in and around the shoe. The
- 6:14electronics technician eventually determined that most of the cameras in
- 6:18the shoe area were assigned to record to DVR two,
- 6:23while the cameras assigned to DVR two were providing live
- 6:27video streams on August ninth and tenth, twenty nineteen. No
- 6:31recordings from those cameras were available due to the DVR
- 6:34two hard drive issue, which the FBI later determined had
- 6:38occurred on July twenty ninth, twenty nineteen. Among the cameras
- 6:43whose video was not recorded was the camera at the
- 6:46end of El Tier, the shoe tier in which Epstein
- 6:49was housed. Only two cameras in the vicinity of the
- 6:52shoe area were recording to DVR one at the time
- 6:56of Epstein's death. One camera was located on the upper
- 7:00level entrance to the ten South Unit, a housing unit
- 7:03adjacent to the shoe, near the door mcc new York
- 7:07staff referred to as the forty six door. That camera
- 7:11captured video of a large part of the common area
- 7:14of the shoe, including the shoe officer's station, and portions
- 7:18of the stairways leading to the different shoe tiers, including
- 7:22the tier containing Epstein's cell. Thus, anyone entering or attempting
- 7:27to enter the l Tier from the common area of
- 7:30the shoe on August ninth and tenth would have been
- 7:33picked up by the video recorded by that camera. Epstein
- 7:37cell door, however, was not in the camera's field of view.
- 7:40The other camera that was recording was located in one
- 7:45of the ninth floors two elevator bays and provided video
- 7:48of the ninth floor fire exit and two of the
- 7:51floors four elevators. The available video showed that at approximately
- 7:56seven to forty nine pm on August ninth, Epstein was
- 8:00escorted toward the L Tier stairway by an individual believed
- 8:04to be the evening watch shoe officer in charge. At
- 8:08approximately ten thirty nine pm, and unidentified COO appeared to
- 8:12walk up the L Tier stairway and then reappeared within
- 8:16view of the camera at ten forty one pm. This
- 8:19is believed to be the last time anyone entered El
- 8:22Tier before approximately six thirty am on August tenth. Between
- 8:27approximately ten forty pm on August ninth and just before
- 8:31six thirty am on August tenth, the OIG did not
- 8:35observe on the recorded video any COO or other individual
- 8:40enter any of the shoe tiers, which is consistent with
- 8:43co Tovin Noel and material handler Michael Thomas's admissions to
- 8:48the OIG that the shoe rounds and counts were not
- 8:51conducted during that timeframe. At approximately six twenty eight am,
- 8:56an unidentified officer was observed on the l Tier stairway,
- 9:01presumably to deliver breakfast food trays. Between six twenty eight
- 9:05am and six thirty two am, an unidentified officer believed
- 9:09to be Noel, moved back and forth several times between
- 9:13the El Tier stairway and the shoe officer's station. At
- 9:17approximately six thirty three am, additional officers entered the Shoe
- 9:22and ascended the El Tier stairway, presumably after Noel activated
- 9:27her body alarm when Epstein was discovered hanged in his cell.
- 9:31As noted above, the camera at the end of the
- 9:34el Tier was providing a live video feed at the
- 9:37time of Epstein's death, but the video was not being recorded.
- 9:42The electronics technician told the OIG that certain mcc New
- 9:46York personnel, including the Control Center SIS personnel, the warden,
- 9:51most lieutenants, and the electronics technician, had access to the
- 9:55live video feed of the institution's security cameras. Explain that
- 10:00to view the live video feed of a particular camera,
- 10:04an employee with access would need to key in the
- 10:07specific camera into the security camera system to call up
- 10:10the live feed. The correctional systems officer, who was working
- 10:14at the control center on August tenth from twelve am
- 10:17to eight am, and the morning watch operations lieutenant both
- 10:21told the OIG that the only live feed from the
- 10:24shoe on their screens was video from the cameras showing
- 10:28the shoe's common area, and they did not perceive a
- 10:31need to take the necessary steps to see the live
- 10:34feed from the shoe el tier from either of their
- 10:38duty stations. On the evening Epstein died. The wharton, who
- 10:43was not scheduled to work on August tenth, twenty nineteen,
- 10:47arrived at the institution later that morning after being notified
- 10:51of Epstein's death and was informed that most of the
- 10:54cameras in the shoe were not recording. He told the
- 10:57OIG that when the SIS lieutenant arrived at the facility
- 11:01that morning, he informed her that the shoe cameras had
- 11:05not been recording, and the SIS lieutenant explained that the
- 11:09hard drive issue had been detected on August eighth. He
- 11:13told the OIG that prior to August tenth, he was
- 11:17unaware that the DVR two issue had been detected on
- 11:20August eighth, and that approximately half of the facility's cameras
- 11:24and in particular, the cameras in the shoe, were found
- 11:28to not be recording on that date. The electronics technician
- 11:33told the OIG that the warden had instructed electronics technician
- 11:37to try and recover any potential shoe video and that
- 11:41may have been recorded by the cameras assigned to the
- 11:44malfunctioning DVR two system, but the electronics technician was unable
- 11:49to find anything. The electronics technician further said that the
- 11:53warden wanted to have the facilities cameras recording again as
- 11:57soon as possible, so he instructed the electronics technician to
- 12:01begin repairing DVR number two. Part D FBI forensic analysis
- 12:07of the DVR system. FBI evidence documents revealed that on
- 12:12August tenth, twenty nineteen, the FBI seized all hard drives
- 12:17contained within the DVR two system. On August fourteenth, twenty nineteen,
- 12:22the FBI returned to mcc New York and seized additional
- 12:26DVR two components. On August fifteenth, twenty nineteen, the FBI
- 12:31sees the entire DVR one system. The FBI's Digital Forensic
- 12:36Analysis Unit in Quantico, Virginia, received mcc new York's DVR
- 12:41system on August sixteenth, twenty nineteen, and began to conduct
- 12:46a forensic analysis of the system. According to FBI forensic reports,
- 12:51DVR two did not start successfully. The Digital Forensic Analysis
- 12:56Unit found that the system contained three faulty hard drives.
- 13:00The FBI forensic report states that the three drives were
- 13:04repaired by an FBI Advanced Data Recovery Specialist, but the
- 13:09DVRs were never able to be assembled successfully. The forensic
- 13:13report further state that an FBI computer scientist and the
- 13:17company's one technician reviewed the DVR two controller logs and
- 13:22found that there had previously been catastrophic disc failures and
- 13:26no recordings would have been available after July twenty ninth,
- 13:30twenty nineteen. When the OIG asked the electronics technician about
- 13:35his findings by the FBI, he told the OIG he
- 13:38was unaware that cameras were not recording to DVR two
- 13:42between July twenty ninth and August eighth of twenty nineteen.
- 13:46Neither the warden nor the SIS Lieutenant was aware of
- 13:50the cameras assigned to DVR two had not been recording
- 13:53since July twenty ninth, twenty nineteen. The company won technician
- 13:58could not recall working with the electronics technician on any
- 14:02DVR issues prior to August eighth, twenty nineteen, but he
- 14:07said that if the entire DVR two server went down
- 14:11on July twenty ninth, twenty nineteen, no video would have
- 14:15been able to have been retrieved from that point forward
- 14:18from any of the cameras recording to DVR two. All Right, folks,
- 14:22that's gonna bring chapter six to its conclusion. In our
- 14:26next episode, we're gonna pick up with the OIG report,
- 14:30and that's going to be with Chapter seven conclusions and recommendations.
- 14:35And then once we have this whole entire OIG report
- 14:39added to the catalog without my commentary, then I'm gonna
- 14:42go back and we're gonna go through certain parts of
- 14:44it again, but with added commentary, because it's taking everything
- 14:49in my power not to have my app running while
- 14:52I'm reading through this. All right, folks, All of the
- 14:55information that goes with this episode can be found in
- 14:58the description box. As for me, I'll be back in
- 15:00a little bit
