Start With Why · I Believe

0:29
SPEAKER_01: The apartment is cold.
0:31
SPEAKER_01: Outside, sirens.
0:34
SPEAKER_01: Somewhere down the block, gunshots.
0:36
SPEAKER_01: This is Hunting Park, North Philadelphia.
0:40
SPEAKER_01: The sounds of Hunting Park don't stop because a mother is trying to feed her children.
0:45
SPEAKER_01: At the kitchen table, two kids are eating.
0:48
SPEAKER_01: Whatever was in the cupboard, she put it on their plates.
0:52
SPEAKER_01: Her son is going blind and needs a doctor.
0:55
SPEAKER_01: Her daughter is small and hungry.
0:58
SPEAKER_01: She knows.
0:59
SPEAKER_01: She sits with them.
1:00
SPEAKER_01: She is holding a piece of paper.
1:03
SPEAKER_01: Sometimes a pizzeria menu.
1:05
SPEAKER_01: Sometimes whatever paper she could find.
1:08
SPEAKER_01: A flyer, a receipt, anything.
1:11
SPEAKER_01: She reads it, studies the pictures if there are pictures, asks herself what she would order if she could.
1:19
SPEAKER_01: She calls this read-eating.
1:21
SPEAKER_01: Her name is Barbie Izquierdo.
1:24
SPEAKER_01: Years later, she will tell advocates what this was.
1:28
SPEAKER_01: Her stomach had been empty long enough that the brain had learned to feed itself on images.
1:34
SPEAKER_01: I was feeding my brain, she said, when I couldn't put food into my stomach.
1:39
SPEAKER_01: She had a job, a full-time job, through her advocacy work.
1:44
SPEAKER_01: She had done what everyone told her to do: get off assistance, get back to work, climb the ladder.
1:51
SPEAKER_01: She climbed.
1:53
SPEAKER_01: Her paycheck put her$2 an hour over the SNAP threshold.
1:58
SPEAKER_01: $2.
1:59
SPEAKER_01: Snap ended.
2:01
SPEAKER_01: The childcare subsidy ended.
2:03
SPEAKER_01: The cash assistance ended.
2:05
SPEAKER_01: The children's free and reduced price school meals ended.
2:09
SPEAKER_01: Three separate systems, each one operating according to its rules, each one executing those rules without error, collectively produced the outcome in the cold apartment with the pizzeria menu.
2:21
SPEAKER_01: No corruption, no villain, no malfunction.
2:26
SPEAKER_01: The machine worked just like all bureaucracy works.
2:30
SPEAKER_01: Just enough, she said, to feel like you're still poor, but not homeless.
2:36
SPEAKER_01: The neighbors sometimes brought a can of beans, a cup of rice, whatever they could spare, which was never much, because they were her neighbours.
2:46
SPEAKER_01: This is not a story about a broken system.
2:50
SPEAKER_01: The system worked just like we designed it.
2:53
SPEAKER_01: That is the problem.
2:54
SPEAKER_01: This is a story about a country that wrote a pledge and forgot what it was for.
2:59
SPEAKER_01: A country that built machinery in the name of that pledge and then let the machine run without looking at it for so long that the machine stopped serving the pledge and started serving itself.
3:11
SPEAKER_01: A country that now finds itself so loud with argument about how the machine should run that no one remembers to ask why it exists.
3:20
SPEAKER_01: We are a country at war with itself over the how.
3:24
SPEAKER_01: We have forgotten the why.
3:27
SPEAKER_01: And in the space between those two things, a mother sits alone in a cold apartment in Hunting Park and reads a menu while her children eat the last of the food.
3:37
SPEAKER_01: If we want to fix what is broken in America, we have to go back further than the argument.
3:43
SPEAKER_01: We have to go back to the page those 56 men signed.
3:47
SPEAKER_01: We have to start with why.
3:52
SPEAKER_00: Welcome to I Believe, where we talk about America.
3:56
SPEAKER_00: I'm Joel Douglas, and I believe in America.
3:59
SPEAKER_00: Thanks for joining me.
4:04
SPEAKER_00: Act 1.
4:05
SPEAKER_00: Forscore and 7 years ago.
4:09
SPEAKER_00: In February of 2011, Simon Sinek walked into the Commandant's Hall at Nellis Air Force Base, a civilian, an author, a man who had spent years studying what made certain organizations inspire loyalty while others just sold product.
4:24
SPEAKER_00: Why some thrive while others fail.
4:27
SPEAKER_00: His thesis fit on a napkin.
4:29
SPEAKER_00: Most organizations, he argued, start with what they do.
4:33
SPEAKER_00: Great ones start with why they exist.
4:36
SPEAKER_00: The room is full of Apex Predators, Air Force Weapons School instructors, fighter pilots, weapon system officers.
4:44
SPEAKER_00: Before they were students, they were the top officers in their squadrons, selected, nominated, and sent to the toughest school in the Department of Defense.
4:52
SPEAKER_00: Six months of grueling hours and indifferent, violent intensity.
4:56
SPEAKER_00: The best of them graduate at the top of their class and are asked to train the next generation.
5:01
SPEAKER_00: Every fighter squadron in the Air Force has one.
5:04
SPEAKER_00: Almost every top officer in the Air Force is a distinguished graduate.
5:09
SPEAKER_00: Nothing on a military combat uniform is silver, except a weapon school patch, a silver beacon with a black border.
5:15
SPEAKER_00: When a weapons school instructor walks into a briefing room, every pilot in the room sits up straight.
5:21
SPEAKER_00: Cynic told a room full of weapons school instructors to start with, why?
5:26
SPEAKER_00: I was in that room.
5:28
SPEAKER_00: I was skeptical.
5:29
SPEAKER_00: I ran missions for a living.
5:30
SPEAKER_00: Missions are what?
5:32
SPEAKER_00: Brief, execute, debrief, achieve the objective.
5:36
SPEAKER_00: If you failed, cut everything and everyone to the bone until you achieve it.
5:40
SPEAKER_00: The whole Air Force runs on what.
5:42
SPEAKER_00: Cynic was telling us to start somewhere else.
5:45
SPEAKER_00: Somewhere softer, slower.
5:47
SPEAKER_00: Somewhere the math was not immediately obvious.
5:49
SPEAKER_00: It took me ten years to break it down.
5:52
SPEAKER_00: No organization, movement, or country ever endured because of the what.
5:56
SPEAKER_00: It endured because of the why, the what changes, the how changes, the why holds, and the American why is written down.
6:04
SPEAKER_00: Fifty-six men signed it on a hot July day in Philadelphia, in a room that smelled of candle wax and ink and sweat.
6:11
SPEAKER_00: All men are created equal.
6:14
SPEAKER_00: The Almighty endows each of us with unalienable rights.
6:18
SPEAKER_00: Life, our breath and being, liberty, to act, speak, grow, the right to pursue happiness.
6:26
SPEAKER_00: And at the bottom of the page, under the last paragraph, we agreed.
6:30
SPEAKER_00: We mutually pledge to each other our lives, our fortunes, and our sacred honor.
6:35
SPEAKER_00: A pledge, a contract signed in ink, and within months in blood.
6:42
SPEAKER_02: Seventy-six years later, on the 5th of July, 1852, Frederick Douglass stood in front of an audience in Rochester, New York, and asked a question about the grand national lie.
6:56
SPEAKER_02: What to the American slave is your Fourth of July.
7:02
SPEAKER_02: His answer across pages of the most devastating rhetoric in the English language plainly stated that the declaration is either true or it is the most spectacular lie ever committed to paper.
7:20
SPEAKER_02: Douglas was not asking a rhetorical question.
7:23
SPEAKER_02: He was demanding an answer.
7:25
SPEAKER_02: We either believe that we all share the same rights, or the document is a fraud, and the country has no moral foundation.
7:35
SPEAKER_02: Douglas demanded that the country look at its own pledge and decide whether we admit it.
7:41
SPEAKER_02: The Harlan brothers answered him.
7:46
SPEAKER_01: Two boys grew up under the same roof in Danville, Kentucky, in the early 1800s.
7:52
SPEAKER_01: The first, John Marshall Harlan, son of James Harlan, a prominent politician and slaveholder.
7:59
SPEAKER_01: The second, Robert James Harlan.
8:04
SPEAKER_01: Born a slave in Mecklenburg County, Virginia, on December 12, 1816, brought to Kentucky as a boy, raised in the Harlan household, educated alongside James's white sons.
8:18
SPEAKER_01: It was widely understood in the hushed, polite etiquette of slaveholding society that James Harlan was Robert's biological father.
8:28
SPEAKER_01: John and Robert were half-brothers.
8:30
SPEAKER_01: The two of them ate at the same table, studied the same lessons, walked the same halls of the same house.
8:38
SPEAKER_01: One was free.
8:39
SPEAKER_01: One was property.
8:43
SPEAKER_02: The life of Robert Harlan, born a slave, tests our national why against reality.
8:50
SPEAKER_02: The test.
8:51
SPEAKER_02: Given a fraction of the opportunity the Declaration promised, could a black man match the free men who had kept him in chains?
9:00
SPEAKER_02: In 1849, he goes to the California Gold Rush.
9:04
SPEAKER_02: A black man legally classified as livestock runs a business in a boom town where the rules haven't finished being written yet.
9:14
SPEAKER_02: Within 18 months, he comes back east with a fortune, somewhere between$45,000 and$90,000 in gold and currency.
9:26
SPEAKER_02: Worth millions today.
9:28
SPEAKER_02: He returns to Ohio and invests in real estate.
9:33
SPEAKER_02: He opens a photography and daguerreotype gallery in Cincinnati.
9:38
SPEAKER_02: He purchases his freedom from the Harlan family.
9:41
SPEAKER_02: He sails to England, spends nine years in the High Society horse racing circuit, the Kentucky style, taught in English jockey clubs by a man who had been born in chains.
9:54
SPEAKER_02: He comes back, settles in Cincinnati, he opens the first school for black children in the city.
10:02
SPEAKER_02: He becomes a trustee for the local Colored Orphan Asylum.
10:07
SPEAKER_02: He becomes the first African-American member of the Ohio Republican State Central Committee.
10:15
SPEAKER_02: In 1872, he serves as a delegate at-large to the Republican National Convention.
10:23
SPEAKER_02: President Ulysses S.
10:24
SPEAKER_02: Grant requests a private audience with him.
10:28
SPEAKER_02: They sit together and discuss international treaties with England because Robert knows England better than most of Grant's cabinet.
10:37
SPEAKER_02: They discuss the racial situation in the post-war South.
10:41
SPEAKER_02: The Cincinnati commercial quotes Grant afterward.
10:45
SPEAKER_02: It is not every day that I have the pleasure of talking with someone of your race who can speak for them so well.
10:52
SPEAKER_02: Robert Harlan.
10:54
SPEAKER_02: Born in Mecklenburg County in Chains in a private audience with the sitting President of the United States discussing foreign policy.
11:04
SPEAKER_02: In 1878, President Rutherford B.
11:08
SPEAKER_02: Hayes commissions him a colonel.
11:10
SPEAKER_02: He raises a battalion of 400 African American men, the 2nd Ohio Militia Battalion, Ohio's first Black State Militia.
11:22
SPEAKER_02: When his brother John Marshall Harlan's music-loving older sister Elizabeth marries Dr.
11:28
SPEAKER_02: James Hatchett, Robert buys her a magnificent handmade piano and ships it to her wedding.
11:36
SPEAKER_02: The piano arrives at the Harlan family home, heavy, polished.
11:42
SPEAKER_02: The weight of it is the weight of a black man's wealth in a country that hasn't decided whether he is allowed to have it.
11:52
SPEAKER_01: The declaration is either true or it is a lie.
11:56
SPEAKER_01: If the premise in the declaration is true, and all men are created equal, is a statement about human capability and not empty words.
12:06
SPEAKER_01: Then a black man born enslaved in 1816, given even partial opportunity, should be able to match or exceed the achievements of the free men around him.
12:17
SPEAKER_01: Robert did.
12:18
SPEAKER_01: Which means two things simultaneously, and they have to be held together.
12:23
SPEAKER_01: One, the why is true.
12:26
SPEAKER_01: Human equality is real.
12:29
SPEAKER_01: Robert proved it.
12:31
SPEAKER_01: Two, the how was a lie.
12:34
SPEAKER_01: Because the country that signed the pledge in 1776 spent the next century building laws, statutes, and court rulings designed to guarantee that what Robert achieved would remain the exception.
12:47
SPEAKER_01: Not because the pledge wasn't true, but because acting on the pledge would have required the country to give up the economic, political, and social arrangements it had built on top of denying the pledge.
12:59
SPEAKER_01: This is the oldest American argument, compressed into two brothers.
13:04
SPEAKER_01: Not an argument about slavery, an argument about whether we believe a kid born in poverty has the same right to life, liberty, and the pursuit as a kid born in a mansion, the one we are still having.
13:18
SPEAKER_01: It brings us to the unfinished work.
13:29
SPEAKER_00: The Declaration is the why.
13:31
SPEAKER_00: The Constitution is the what.
13:33
SPEAKER_00: The preamble outlines that we have six national goals union, justice, domestic tranquility, common defense, general welfare, liberty, six goals.
13:44
SPEAKER_00: Written in 1787.
13:46
SPEAKER_00: Ratified in 1788.
13:48
SPEAKER_00: Not poetry, not philosophy.
13:51
SPEAKER_00: A contract between the government and the governed.
13:53
SPEAKER_00: They specify what the machine seeks to achieve.
13:56
SPEAKER_00: The why is the moral premise.
13:59
SPEAKER_00: The what is the blueprint.
14:00
SPEAKER_00: The how is everything else.
14:02
SPEAKER_00: The laws, the agencies, the tax codes, the zoning boards, the benefit formulas, the eligibility thresholds, the how is where we live, the how is where we fight.
14:13
SPEAKER_00: The how is where we have gotten lost.
14:15
SPEAKER_00: There's a philosopher named John Rawls.
14:18
SPEAKER_00: He was a World War II combat veteran who came to hate war.
14:21
SPEAKER_00: He taught at Harvard University for over 40 years.
14:24
SPEAKER_00: He gave us a tool to measure whether the how is doing its job.
14:28
SPEAKER_00: He called it the Veil of Ignorance.
14:30
SPEAKER_00: Imagine you were designing America from scratch.
14:33
SPEAKER_00: You will write the laws, set the thresholds, and build the institutions.
14:37
SPEAKER_00: But you don't know where you will land in the country you are building.
14:40
SPEAKER_00: You don't know if you will be born in a mansion in Greenwich or a cold apartment in Hunting Park.
14:45
SPEAKER_00: You don't know if you will be a senator's daughter or the daughter of Barbie Izquierdo.
14:50
SPEAKER_00: Now build your system.
14:51
SPEAKER_00: No rational person behind that veil designs an economy where a mother works full-time and still can't feed her children without help.
14:59
SPEAKER_00: No rational person behind that veil designs a benefits cliff.
15:02
SPEAKER_00: A cliff that claims to be a safety net for wages that punishes the worker for earning a dollar more of wages that were never high enough to live on.
15:11
SPEAKER_00: But we built that system, not by malice, by bureaucratic machine, and the people making the rules have full bellies.
15:20
SPEAKER_02: Barbie Izquierdo is not an anomaly.
15:24
SPEAKER_02: The Federal Reserve Bank of Atlanta built a model for this.
15:29
SPEAKER_02: They call it the Cliff Tool, the career ladder identifier and financial forecaster.
15:36
SPEAKER_02: The Federal Reserve had to build a calculator to help Americans figure out whether a raise would make them poorer.
15:44
SPEAKER_02: Let's hear that again.
15:47
SPEAKER_02: Same meaning.
15:48
SPEAKER_02: Slightly different words.
15:51
SPEAKER_02: Rather than spend time and resources to make sure every American benefits from the raises they earn, we spent time and resources to help Americans figure out when they should stay on social programs, because more effort would make them more poor.
16:09
SPEAKER_02: We built a tool to help people figure out when to stop trying.
16:15
SPEAKER_02: The conservative looks at Barbie's kitchen and hears that she needs to work harder.
16:20
SPEAKER_02: But the bureaucratic state punishes the work ethic.
16:24
SPEAKER_02: A system so tangled in its own rules that it traps the people it was built to free.
16:31
SPEAKER_02: The liberal looks at the same kitchen and reads that she needs more help.
16:36
SPEAKER_02: But rather than setting conditions to empower Barbie to succeed on her own, the safety net starves a working mother over a two-dollar technicality.
16:48
SPEAKER_02: A system so rigid.
16:51
SPEAKER_02: It punishes the people.
16:53
SPEAKER_02: It was built to protect.
16:56
SPEAKER_02: They're both right.
16:58
SPEAKER_02: She does need to work hard.
17:01
SPEAKER_02: Hard work is a part of life.
17:03
SPEAKER_02: And she is working hard.
17:06
SPEAKER_02: She also needs help.
17:08
SPEAKER_02: They are looking at the same kitchen.
17:11
SPEAKER_02: They agree on the disease.
17:13
SPEAKER_02: They fight about the treatment.
17:15
SPEAKER_02: And while we fight about the treatment, Barbie sits with a menu.
17:20
SPEAKER_02: We will never agree on the how if we cannot agree on the why.
17:25
SPEAKER_02: It's the same question Douglass asked in 1852.
17:30
SPEAKER_02: We are still asking it in Barbie's kitchen.
17:33
SPEAKER_02: It's the how.
17:35
SPEAKER_02: Untethered from the why.
17:39
SPEAKER_01: At Gettysburg, standing over the dead, Lincoln called it the unfinished work.
17:45
SPEAKER_01: The unfinished work, which they who fought here have thus far so nobly advanced.
17:50
SPEAKER_01: The founders didn't finish the work.
17:52
SPEAKER_01: The Civil War didn't.
17:54
SPEAKER_01: Reconstruction didn't.
17:56
SPEAKER_01: The civil rights movement did not finish the work.
17:59
SPEAKER_01: The work is never finished.
18:02
SPEAKER_01: A mother feeds her brain with pictures of food because there isn't enough for everyone.
18:08
SPEAKER_01: She gives the real food to her children.
18:11
SPEAKER_01: She is the measure, not the machine.
18:14
SPEAKER_01: She is the unfinished work.
18:18
SPEAKER_02: We are divided.
18:20
SPEAKER_02: We are told the division is about politics, about parties, about policy, about trans rights or women's rights or gay rights, or whether men are still allowed to be men.
18:32
SPEAKER_02: It is not.
18:34
SPEAKER_02: Those fights matter.
18:36
SPEAKER_02: Every one of them is a fight about who the pledge applies to.
18:41
SPEAKER_02: But they are downstream of a deeper fracture.
18:45
SPEAKER_02: It is about the distance between the why and the how.
18:49
SPEAKER_02: We argue about the how, the tax rate, regulation, statute, court ruling, executive order, because we have lost the thread back to the why.
19:01
SPEAKER_02: And when you lose the thread, the argument becomes self-consuming.
19:05
SPEAKER_02: It feeds on itself.
19:08
SPEAKER_02: The how argues with the how about the how.
19:11
SPEAKER_02: And no one in the room remembers to ask.
19:15
SPEAKER_02: Does a kid born in Hunting Park have the same shot at life, liberty, and the pursuit as a kid born in the Hamptons?
19:25
SPEAKER_02: That is the only question that matters.
19:29
SPEAKER_02: And it is not a question about policy.
19:32
SPEAKER_02: It is a question about whether we believe that we all share the same rights.
19:38
SPEAKER_02: If we don't, our beliefs are a fraud.
19:43
SPEAKER_02: So what do we do?
19:44
SPEAKER_02: We course correct.
19:46
SPEAKER_02: It will not happen in Washington.
19:54
SPEAKER_01: Act three.
19:55
SPEAKER_01: It is for us the living.
19:59
SPEAKER_01: In the early 90s, a kid named Antong Lucky started the first bloodsgang in the city of Dallas.
20:05
SPEAKER_01: The state looked at him and saw a menace.
20:07
SPEAKER_01: The judge said so.
20:08
SPEAKER_01: The statute said so.
20:10
SPEAKER_01: The Howe processed him and sent him to prison.
20:13
SPEAKER_01: Another inmate named Willie Ray Fleming looked at him and saw something else.
20:19
SPEAKER_01: Young man, if you had the ability to lead these dudes to do wrong, you have that same ability to lead them to do right.
20:27
SPEAKER_01: You're a leader.
20:30
SPEAKER_01: One sentence turned the key.
20:32
SPEAKER_01: After serving his sentence, Lucky walked out and met a bishop named Omar Jawa.
20:38
SPEAKER_01: Jawa had a theory, stated in biological terms.
20:42
SPEAKER_01: Anytime you're trying to find a cure to a disease, you extract some of the virus for the antibody.
20:49
SPEAKER_01: The young men the system had written off weren't the disease.
20:53
SPEAKER_01: They were the cure.
20:55
SPEAKER_01: Together they put former gang members into Dallas schools, not as security, as mentors.
21:02
SPEAKER_01: Violence dropped.
21:04
SPEAKER_01: The state had never asked why.
21:06
SPEAKER_01: Fleming and Jawa did.
21:11
SPEAKER_02: Then came July 5th, 2016.
21:14
SPEAKER_02: Baton Rouge, Louisiana.
21:16
SPEAKER_02: Police killed Alton Sterling outside a convenience store.
21:20
SPEAKER_02: The next day in Minnesota, Philando Castile was shot during a traffic stop.
21:26
SPEAKER_02: Five days later, on July 7th in downtown Dallas, a sniper opened fire on a police line at a peaceful protest.
21:36
SPEAKER_02: Five Dallas officers were killed.
21:39
SPEAKER_02: Ten days after that, on July 17th, 2016, in Baton Rouge, another gunman ambushed officers, responding to a call.
21:50
SPEAKER_02: Three officers were killed.
21:52
SPEAKER_02: Two of them, Brad Garrafola and Montrell Jackson, left behind widows for 18 months.
22:01
SPEAKER_02: The country held its breath.
22:03
SPEAKER_02: Every community meeting was a referendum on who was to blame.
22:09
SPEAKER_02: On Martin Luther King weekend, January 2018, Joe and Lucky didn't hold a policy summit.
22:17
SPEAKER_02: They didn't invite the mayor.
22:20
SPEAKER_02: They didn't invite cable news.
22:22
SPEAKER_02: They brought the family of Olton Sterling together, with the widows of the Baton Rouge, officers killed in the ambush that followed his death.
22:32
SPEAKER_02: Same room, same stage, breathing the same air.
22:37
SPEAKER_02: Sabrina Fulton Drayvon Martin's mother had given them the line months earlier.
22:47
SPEAKER_02: No matter where it felt, feels the same.
22:52
SPEAKER_02: A mother who lost her son to a policeable a widow who lost her husband to a gunman's rifle across a stage in a room no one in Washington had built talking to each other.
23:06
SPEAKER_02: That is the how.
23:08
SPEAKER_02: Restitched to the why, not with a statute in a room.
23:17
SPEAKER_00: There's an old line in Ecclesiastes.
23:19
SPEAKER_00: The writer was a king, a man who had tasted everything a life could offer wealth, power, wisdom, pleasure, everything.
23:27
SPEAKER_00: He wrote it all down and then he asked what a life was actually for.
23:31
SPEAKER_00: His answer was spare, to eat and drink, and to enjoy the good of all his labor, to eat with the people you love, to enjoy your work, to know that your day's labor was worth something.
23:41
SPEAKER_00: That is the purpose.
23:43
SPEAKER_00: And it's the same thing as life, liberty, and the pursuit, which implies a home to eat in, a table to sit at, food on the table, work worth enjoying, an education that prepares a kid for work worth enjoying.
23:56
SPEAKER_00: A community to belong to, a neighbor who would bring a can of beans when the cupboard is bare, and a country that would not punish her for doing so.
24:04
SPEAKER_00: A country that keeps its pledge.
24:06
SPEAKER_00: Design the system so that a kid who grows up in a cold apartment and hunting park can grow into that life.
24:12
SPEAKER_00: A kid who grows up in a leaky trailer in rural Wyoming can grow into that life.
24:17
SPEAKER_00: A kid who grows up anywhere in America can grow into that life.
24:21
SPEAKER_00: That is the why.
24:23
SPEAKER_00: It is the only test that matters.
24:28
SPEAKER_01: Back to the Harlan brothers in 1883 in Washington Justice John Marshall.
24:36
SPEAKER_01: Harlan, the son of a Kentucky slaveholder, the boy who had grown up beside Robert, sits at his desk.
24:43
SPEAKER_01: The Supreme Court has just struck down the Civil Rights Act of 1875, 8 to 1.
24:51
SPEAKER_01: The majority ruled that the Fourteenth Amendment only restrains the state, not private actors.
24:57
SPEAKER_01: A hotel, theatre, railway car may discriminate by race as a matter of private liberty.
25:04
SPEAKER_01: The how has been used with the clean logic of the machine to destroy the why of the Thirteenth and Fourteenth Amendments.
25:13
SPEAKER_01: The nation is re-segregating itself, one ruling at a time.
25:18
SPEAKER_01: Harlan resolves to dissent.
25:20
SPEAKER_01: For days he sits at his desk, but the words will not come.
25:25
SPEAKER_01: He is the only man on the court who understands what has just been destroyed, and his hand will not move.
25:32
SPEAKER_01: His wife, Malvina Shanklin Harlan, knows him.
25:37
SPEAKER_01: Years earlier, Harlan had purchased from the Supreme Court Martial the ink stand that had once belonged to Chief Justice Roger Taney.
25:46
SPEAKER_01: Taney had used it when he wrote the 1857 Dred Scott decision that declared black Americans had no rights, the white man was bound to respect.
25:56
SPEAKER_01: The vessel that held the ink of America's original sin.
26:01
SPEAKER_01: Malvina had hidden it.
26:03
SPEAKER_01: She was afraid her husband might return it to the Taney family.
26:07
SPEAKER_01: Now, watching her husband fail at his desk, she retrieves it.
26:12
SPEAKER_01: She cleans it.
26:14
SPEAKER_01: She fills it with fresh ink.
26:16
SPEAKER_01: She places it squarely on his writing desk.
26:19
SPEAKER_01: Harlan sees it.
26:21
SPEAKER_01: And then, in Malvina's own words, his pen begins to move across the page like magic.
26:28
SPEAKER_01: He writes Our constitution is colour blind and neither knows nor tolerates classes among citizens.
26:37
SPEAKER_01: He is using his own pen.
26:39
SPEAKER_01: He is dipping it into Taney's inkwell.
26:43
SPEAKER_01: The vessel that had held the ink of Dred Scott is now giving up its ink, drop by drop, to draft the constitutional blueprint of the 20th century civil rights movement.
26:55
SPEAKER_01: The court would not adopt the blueprint for seventy years, the same inkwell, a new hand, the same why.
27:05
SPEAKER_00: John Marshall Harlan could see it because he had grown up with Robert, eaten at the same table, watched him carry gold back from California, watched him sit with President Grant, watched him send a piano to Elizabeth's wedding.
27:19
SPEAKER_00: The why wasn't an abstraction for John Marshall Harlan.
27:22
SPEAKER_00: It was his brother.
27:24
SPEAKER_00: This doesn't start in Washington.
27:25
SPEAKER_00: Our why is by the people.
27:27
SPEAKER_00: It starts with us.
27:28
SPEAKER_00: It is not an argument about slavery.
27:31
SPEAKER_00: It's about whether we believe a kid born in poverty has the same right to life, liberty, and the pursuit as a kid born in a mansion.
27:38
SPEAKER_00: The machine forgets.
27:39
SPEAKER_00: That is the whole country.
27:41
SPEAKER_00: The unfinished work.
27:42
SPEAKER_00: We start with why.
27:49
SPEAKER_03: You feel like summer days to me won't turn the sunny rays.
27:56
SPEAKER_03: I hope that we are meant to be.
28:11
SPEAKER_03: Oh, come what may I'm ready?
28:16
SPEAKER_03: Put your frames leaving.
28:24
SPEAKER_03: Within this romance, I get the chance to run and be the fuck you are thoughts and send us the dreams, and we sing to find Guess everyone gets a runs up.
28:56
SPEAKER_03: Never care much about What's right or sin?
29:04
SPEAKER_03: As you stand before me at the end of frames and pain.
29:21
SPEAKER_03: Stop the running one.
29:36
SPEAKER_03: With some chance.
