- 0:00Hello, good morning, welcome.
- 0:02I'm Samuel Trapp, this is International Flavor.
- 0:04I'm coming to you live from the Lake
- 0:05Ozark Real Estate of the Art Studio, coming
- 0:08to you live on damradio.com forward slash
- 0:10live in reverse or in the past as
- 0:16it were.
- 0:17You know what, we should change it instead
- 0:19of damradio.com forward slash podcast.
- 0:22We should call it damradio.com forward slash
- 0:27past because it's the past.
- 0:30It's history.
- 0:32It is now history.
- 0:34Kind of like the, and you know my
- 0:37initial reaction to this is just bull crap
- 0:43is my initial reaction to this.
- 0:45And I'm not sure if I can get
- 0:47it.
- 0:47They're going to want me to pay for
- 0:49it, I'm sure.
- 0:51And let's see.
- 0:54I want to see it, but it does
- 0:56give the page so I can get onto
- 0:58Pacer and pull it off.
- 1:00Maybe I'll try to do that.
- 1:01It's a 26 page docket and it is
- 1:05United States District Court for the Southern District
- 1:10of Florida.
- 1:12This is, now my initial reaction before I
- 1:15ever read this is that, let's see, that
- 1:21would be uscourts.gov SDFL, wouldn't it?
- 1:27Let's see if we can find this because
- 1:29I've been thinking about this stupidity ever since.
- 1:38And this is lawyers being a-holes is
- 1:42all this is.
- 1:43And in my opinion, an idiotic, you know,
- 1:48is what this is.
- 1:51Site cannot be reached.
- 1:52I wonder if we are blocked in the
- 1:56studio.
- 1:58I wonder why.
- 2:01I wonder if I go to my base
- 2:03account.
- 2:07Hmm.
- 2:07I'm sorry to be doing this on the
- 2:10fly while we're sitting here, but this is
- 2:15craziness.
- 2:17And here we are again.
- 2:22Where's my registered app?
- 2:24I have to do two-party login.
- 2:27Well, I'm trying to get on and get
- 2:29the Castro indictment.
- 2:32I want the original document from the court.
- 2:36I don't trust the ones that people ship
- 2:39out to you from New York Times and
- 2:44elsewhere.
- 2:45I don't trust any of those people.
- 2:47So, nor should you.
- 2:50It's a bad plan all the way around,
- 2:53but I got to get onto my Google
- 2:55Authenticator in order to log in.
- 2:59And sorry, you get to walk through this
- 3:00with me, but where is my account?
- 3:04Hello.
- 3:04How's the family?
- 3:06Five, five, five, nine, four, three.
- 3:08We'll get you in.
- 3:12Nine, four, three.
- 3:15And are we in?
- 3:16We are indeed in.
- 3:19Son of a nutcracker.
- 3:20They're doing it again.
- 3:23So, the second time, if you have to
- 3:25go in, it's three, seven, eight, five, four,
- 3:27one.
- 3:27Three, seven, eight, five, four, one.
- 3:31Entered.
- 3:32I understand.
- 3:33Quit quizzing me.
- 3:35Let's see.
- 3:37Please choose a court.
- 3:38Well, I tried to.
- 3:42S-D-F-L.
- 3:46Nope, not South Carolina.
- 3:49F-L.
- 3:50Sorry, you people get to listen to this,
- 3:52but here we are.
- 3:54Florida Southern District.
- 3:56There we have it.
- 3:58Southern District of Florida documents.
- 4:02Here we are.
- 4:03Query.
- 4:04What's this guy's name?
- 4:06Raul Castro, right?
- 4:08C-A-S-T-R-O.
- 4:11They're indicting him for murder is what I
- 4:13hear.
- 4:15And he's not a citizen of America.
- 4:21And this is my problem.
- 4:24The party defendant is Raul Castro, Raul party
- 4:32defendant.
- 4:33Maybe it's because he filed action here before
- 4:36and submitted himself previously to...
- 4:40Here's a file closed in 1991.
- 4:43Gonzales versus Castro.
- 4:46Where's the latest ones?
- 4:48These are not it.
- 4:50But this gives me the case number.
- 4:52I have the case number.
- 4:53So at least if they're not lying to
- 4:55us on the news.
- 4:59Here it is.
- 5:02Case number 03-03-USA Raul Modesto
- 5:11Castro Ruz.
- 5:14Okay.
- 5:15So we're going to go back because this
- 5:18was just Raul Modesto party defendant.
- 5:23Here he is.
- 5:2403.
- 5:26Filed 8-21-03.
- 5:31So their game plan for sure.
- 5:34And if we go to the history and
- 5:36documents and run the query.
- 5:40Oh, yep.
- 5:41So now they're claiming...
- 5:44You can't see the prior case.
- 5:48Filed 4-23-2026.
- 5:51Motion for miscellaneous relief.
- 5:54Order on motion for miscellaneous receipt.
- 5:57And then here we go.
- 5:59Indictment filed 4-23-2026.
- 6:06And I'm going to download this so JR
- 6:09can have it later.
- 6:11Cost me $2.60. My download will come
- 6:16into the zip and we shall keep it
- 6:21up.
- 6:21Here's document number 8.
- 6:23Okay.
- 6:24Sorry to go through all of that with
- 6:26you here.
- 6:27But this was entered on 4-29-2026
- 6:32and filed by BMDC, Angela Noble, Clerk of
- 6:36District Court, U.S. of America by Raul
- 6:39Modesto Castro Ruz.
- 6:40So this indicates to me that what we're
- 6:43going to do is we're going to be
- 6:44flying into to Cuba, attacking somebody.
- 6:51And here's a superseding indictment.
- 6:53General allegations.
- 6:57Let's see.
- 6:59We're going to read this whole thing to
- 7:01you just because.
- 7:03Okay.
- 7:03The grand jury.
- 7:04So this is a grand jury.
- 7:05First of all, you can indict a ham
- 7:07sandwich in a grand jury because nobody's there.
- 7:11Okay.
- 7:11So this isn't a prosecutor taking a stand.
- 7:15This is a prosecutor saying, well, citizens, 12
- 7:18citizens, right?
- 7:19Said whatever the hell they pick.
- 7:2112 citizens indicted this man.
- 7:22So they got to believe something.
- 7:24Well, they only believe what you tell them,
- 7:25you dumb ass.
- 7:26They only believe that because you said something
- 7:31to them and you're the lawyer.
- 7:32So there's nobody present but you.
- 7:34And there's nobody for the defense.
- 7:37There's no rules of evidence.
- 7:39There's nothing.
- 7:40It's whatever you say.
- 7:41So if you don't want to indict him,
- 7:44guess what you do?
- 7:45You shut up and nobody gets indicted.
- 7:48Right.
- 7:48But if you want him to be indicted,
- 7:51you can say any lie that you want
- 7:53to say and then not take, what do
- 7:57you call it?
- 7:58Not take responsibility for it.
- 7:59Right.
- 8:00You don't have to worry about all of
- 8:03that.
- 8:04And this is all over JR's TVs is
- 8:06the reason I'm watching this.
- 8:08And I was interested in it anyway.
- 8:10But, oh my God, they've indicted the man.
- 8:13They indicted him on April the 23rd, you
- 8:16assholes.
- 8:17It's like, why are we putting it out
- 8:20now?
- 8:20And it was entered in the Florida Southern
- 8:22District docket on April the 29th of 2026.
- 8:27These guys are lying to you just like
- 8:30they always do.
- 8:32And they call it a superseding indictment.
- 8:34Something's happened.
- 8:35Now, first of all, this case is case
- 8:37number 03 CR 2068503.
- 8:42You know what that means?
- 8:442003 is the first time they tried to
- 8:47file this.
- 8:48And when you look at the freaking docket
- 8:49and you look at the docket sheet, which
- 8:52is why you have to go to the
- 8:53docket sheet, because these people lie and they
- 8:57lie across the board.
- 8:59You know, this is just BS.
- 9:00There's an attachment.
- 9:02It's restricted, which means I can't probably get
- 9:04it.
- 9:05Let's see.
- 9:06This document is sealed and not available.
- 9:08It's probably the original indictment because the document
- 9:11history starts at number six, document number six,
- 9:15motion for miscellaneous relief.
- 9:18Let's read that son of a bucket.
- 9:19And we'll download this for you.
- 9:21Sealed documents are no longer available in CMS
- 9:24or CMF or via PACER.
- 9:27Contact the court directly to request the document.
- 9:30So this document has been sealed.
- 9:32Okay.
- 9:32So this is the request for miscellaneous relief
- 9:34and they sealed it.
- 9:36And that is why they've done it.
- 9:37And so they don't want you to be
- 9:39able to get it right.
- 9:40And they don't want, it's not public.
- 9:42Well, it can be public.
- 9:43You send a sunshine request or whatever.
- 9:44And then there's the order for miscellaneous relief.
- 9:47Well, let's see if that one is sealed
- 9:48as well.
- 9:49View document.
- 9:51This one sealed documents are no longer available.
- 9:54So I'm paying 10 cents for that new
- 9:58document that says, you can't have it.
- 10:01Motion to unseal the case.
- 10:03Here's one in number 10.
- 10:05Motion to unseal.
- 10:07This came afterward.
- 10:08Maybe now this is why it's unsealed, right?
- 10:10Maybe now they've unsealed something.
- 10:13View document.
- 10:14Nothing's happening.
- 10:17I'm trying to pay the dime.
- 10:19Come on.
- 10:21To accept the charges, view document.
- 10:24Otherwise, nothing.
- 10:28Wonder how many times I paid for that.
- 10:32Wonder how many times I've done that.
- 10:34Let's see.
- 10:35But I do have the indictment now, but
- 10:36you can't get the rest.
- 10:38They object.
- 10:40They don't want to give it to me.
- 10:41Come on.
- 10:42What have I done?
- 10:44Son of a nutcracker.
- 10:46Let's see if I go back.
- 10:47That's the New York Times.
- 10:48I don't want that version.
- 10:51I don't like you.
- 10:56Well, I'm on a roll today.
- 10:58Let's go back to our Southern District of
- 11:02Florida.
- 11:03Pacer log in.
- 11:05Southern District, Florida.
- 11:13Anyway, I am grumpy about this.
- 11:17Let's go back to the query and let
- 11:19us get our go back to what's his
- 11:23name?
- 11:26The old, what have I been blocked?
- 11:30ID case.
- 11:31We want Raul Perez.
- 11:36Perez, that is not who we're after here,
- 11:39folks, friends, and neighbors.
- 11:42But where are we in our document download?
- 11:46Okay.
- 11:47Let's get back there.
- 11:48We want case number 03CR and the superseding
- 11:56indictment.
- 11:58Here we go.
- 12:01But you can't get the rest.
- 12:02They haven't unlocked it.
- 12:06There's stuff that is unavailable.
- 12:10And that is unavailable to us.
- 12:14And Luis Raul Gonzalez, who are these people?
- 12:17There's a bunch of people listed.
- 12:19Lorenzo Alberto Perez.
- 12:21Perez, Emilio Jose, Palacio Blanco, Jose Fidel Gual,
- 12:27Barzaga, Raul Simanca Cardenas, and Luis Raul Gonzalez
- 12:32Pardo Rodriguez, defendants.
- 12:35Superseding indictment.
- 12:37Okay.
- 12:37This thing is how many pages we got
- 12:40here?
- 12:40Friends and neighbors.
- 12:41Page one of 26.
- 12:43Superseding indictment.
- 12:44Introduction.
- 12:45Since seizing power over the Republic of Cuba
- 12:47in 59.
- 12:48This is your grand write up of why
- 12:51the US should be able to charge anybody
- 12:53on the planet with murder, which is not
- 12:55what the law says, but they're doing it
- 12:58anyway.
- 12:59Because they're crooks.
- 13:00That's my initial take of how you file
- 13:03murder charges against somebody in another country.
- 13:07It's bullshit.
- 13:09Since seizing power of the Republic of Cuba
- 13:11in 1959, Fidel Alejandro Castro Ruiz, Fidel Castro,
- 13:16Raul Modesto Castro Ruiz, as depicted below, they
- 13:21put their pictures, and others establish a dictatorship,
- 13:25the Castro regime, designed to maintain and protect
- 13:28their rule and prevent regime change.
- 13:30What do we do?
- 13:31So we engage in regime change.
- 13:33That's what we do.
- 13:35It's what we live for.
- 13:36And some people are all happy about this.
- 13:38I am not.
- 13:39It's none of your freaking business.
- 13:40Stay out of it.
- 13:41For the next several decades, Cubans fled to
- 13:44the United States through the Florida Straits, risking
- 13:47their lives and many times resulting in the
- 13:49death of those migrants in those waters on
- 13:52their journey to freedom.
- 13:56Hermanos al Rescata, Brothers to the Rescue, Inc.,
- 14:00BTTR, was organized in Miami and flew unarmed
- 14:05Cessna aircraft to rescue or guide Cuban migrants
- 14:09stranded or lost at sea.
- 14:11In the 90s, BTR's flights also flew to
- 14:14support anti-Castro pro-democracy movements in Cuba.
- 14:18So they're meddling in other countries.
- 14:21No, fine.
- 14:22Good for them.
- 14:23That's fine.
- 14:24Cuba sent spies to Miami, Florida to obtain
- 14:27information on BTTR and report back to the
- 14:30Castro regime.
- 14:32These spies were part of a group codenamed
- 14:35La Red Avispa, the Wasp Network.
- 14:38The spies successfully infiltrated BTR, reported back to
- 14:42the Castro regime on BTR activity on or
- 14:45around January 1996.
- 14:49BTR flew unarmed Cessna aircraft in or around
- 14:51Cuban airspace and dropped pro-democracy leaflets that
- 14:54landed on the Cuban mainland.
- 14:56Cessna aircraft used by BTR flew at speeds
- 14:58significantly slower than the Cuban MiG fighter jets.
- 15:03In or around January 1996, the Cuban military
- 15:07headed by Castro Ruz engaged in training missions,
- 15:10during which Cuban MiG fighter jets located and
- 15:13followed planes with flight speeds and at the
- 15:15altitudes as those planes used by BTR.
- 15:20So they trailed them.
- 15:21The U.S. does the same thing.
- 15:23You know, if we want to harass somebody,
- 15:24we do the same thing.
- 15:27Escort their planes, right?
- 15:29We seize their ships.
- 15:32We do whatever else we feel like.
- 15:34We surround their island, okay?
- 15:38In or around February 1996, pro-democracy groups
- 15:42in Cuba planned demonstrations in Cuba and BTR
- 15:45planned to support those demonstrations through flights to
- 15:50Cuba at the time of the demonstration.
- 15:53The Castro regime did not permit the planned
- 15:56pro-democracy demonstrations.
- 15:58I imagine democracy would be well received in
- 16:02Cuba, right?
- 16:03Just like it is in Ukraine, right?
- 16:08That place isn't corrupt, not remotely, right?
- 16:12And BTR planned blah, blah, blah.
- 16:14The Castro regime did not permit the planned
- 16:17pro-democracy demonstrations in Cuba at that time.
- 16:20There's a surprise.
- 16:22They know that it's a dictatorship.
- 16:23You already said that ahead.
- 16:25You said that, well, Qatar is a dictatorship
- 16:27too.
- 16:28I imagine if we went and scheduled a
- 16:31pro-democracy, what do you call it?
- 16:35A pro-democracy demonstration in front of the
- 16:40prince's residence or in the prince's private airport,
- 16:45right next to the real airport, then you
- 16:48might have some arrests and people punished for
- 16:53it because guess what?
- 16:55That's a dictatorship too.
- 16:58But we're not attacking Qatar.
- 17:00We're not attacking anybody else that has dictatorships
- 17:04around the planet.
- 17:05Well, secretly we are, but we're not charging
- 17:07them with murder.
- 17:08You know, we're getting new airplanes from them.
- 17:11They're getting new airplanes.
- 17:13You know, oh geez, what was it?
- 17:14Since they're our friends and they provide us
- 17:15with oil and they don't piss us off
- 17:17like everybody else does, well, you know what
- 17:20we'll do?
- 17:21Since they lick our rear ends, we will
- 17:23lick back and we'll never say a word.
- 17:27But if we don't like you, we're going
- 17:29to fly in, send some special forces goons
- 17:31to go in there and kill people and
- 17:34seize you and arrest you for criminal charges
- 17:38in America.
- 17:39Why?
- 17:40Because we're the biggest swinging dicks on the
- 17:42planet and that's what we do because we
- 17:45played football.
- 17:46We play, we're in the Marines, hoorah.
- 17:49You know, that's what we did.
- 17:50And so in or around 2060s, pro-democracy
- 17:52groups planned their demonstrations and they didn't get
- 17:55to go.
- 17:55The Castro regime didn't permit them, surprise, and
- 17:58the planned democracy demonstrations at Cuba at that
- 18:01time and instructed its spies not to fly
- 18:04with BTTR during the planned BTTR flights in
- 18:08February 96.
- 18:10Hmm.
- 18:12On February 24th, sorry about that.
- 18:14On February 24th, 1996, three BTR aircraft flew
- 18:20from South Florida toward Cuba anyway.
- 18:23And Cuban Migs shot down two of them
- 18:26in international waters, killing four US nationals and
- 18:30three American citizens.
- 18:33Okay.
- 18:34Well, if you're going to take risks like
- 18:36that, how do I want to put this?
- 18:39If you're going to go to Ukraine and
- 18:41fight on behalf of Ukraine in Ukraine against
- 18:45the Russians and the Russians kill you, that's
- 18:47not on us.
- 18:49We don't get a charge Vladimir Putin with
- 18:55a crime because he happens to lead the
- 18:58country that you're fighting against and somebody killed
- 19:00you.
- 19:02It's crap.
- 19:03Do we say it's, I mean, we say
- 19:05the same thing, right?
- 19:06We say the same thing.
- 19:07If a Ukrainian goes into Russia and bombs
- 19:11in Kursk and any of these foreigners that
- 19:14ran in there, which they did, a lot
- 19:17of mercenaries in there, a lot of US
- 19:18mercenaries in there, a lot of a British,
- 19:20a lot of them have been captured and
- 19:21in Russia, they're all over the news and
- 19:24we are all up in arms.
- 19:26Oh, these people ought to be given Geneva
- 19:28Convention status.
- 19:29They're war combatants.
- 19:31No, they're not.
- 19:31They're frigging terrorists.
- 19:33They're mercenaries.
- 19:35That's what they are.
- 19:37They were hired as mercenaries and they went
- 19:39over.
- 19:39They are not subject to the Geneva Convention.
- 19:42They're committing crimes and that's true.
- 19:45You're a mercenary.
- 19:46You're not a combatant.
- 19:49You're not a combatant.
- 19:51You are not fighting.
- 19:53You may be fighting on behalf of a
- 19:55country, but you're not part of their armed
- 19:57forces.
- 19:58You're not.
- 19:59Most of them don't even speak Ukrainian.
- 20:01It's crazy.
- 20:02Well, most Ukrainians don't speak Ukrainian.
- 20:05It's crazy.
- 20:07I shouldn't say most, but a very good
- 20:09percentage.
- 20:10Anyway, including these three American citizens were all
- 20:13shot down.
- 20:13And you may not like what I'm saying.
- 20:15I don't care.
- 20:16This is the truth anyway.
- 20:17And so you might be going, yeah, but
- 20:20yeah, but we need to do what's right.
- 20:22Who are we to determine what's right?
- 20:25Who the hell are you to determine what's
- 20:27right?
- 20:27My right might be different than your right,
- 20:29right?
- 20:30So here you're going to hear my right.
- 20:32If you want to call and argue with
- 20:33me, please do 573-746-8020.
- 20:37Convince me why we have jurisdiction over the
- 20:41planet other than saying we have the biggest
- 20:44military and the biggest dicks.
- 20:45That's it.
- 20:46So we're the big bad wolf and therefore
- 20:49we get to do what we want.
- 20:50The end, that's it.
- 20:52That's what power buys you.
- 20:54And you buy into that power narrative.
- 20:57A lot of people aren't going to like
- 20:59that, right?
- 21:00So anyway, let's get to the Castro regime.
- 21:03Here they subtitle.
- 21:04Here's subparagraph one.
- 21:06Fidel Castro, Castro ruse and others seized power
- 21:08in Cuba on or about January 9, 1959,
- 21:11overthrowing then president Fulgencio Batista Uzaldivar.
- 21:16The Castro regime controlled Cuba thereafter.
- 21:20Paragraph two, the Castro regime established various ministries
- 21:23to support its objectives.
- 21:24El Ministerio de las Fuerzas Armadas Revolucionarias, the
- 21:28Ministry of Revolutionary Armed Forces, controlled all branches
- 21:32of the Cuban military.
- 21:35Within MINFAR, the Cuban Air Force and Air
- 21:37Defense Apparatus was named La Defensa Anti-Aerofuerza
- 21:41Revoluciones, the Cuban Revolutionary Air and Air Defense
- 21:45Forces.
- 21:46Castro, paragraph three, Castro regime created La Direcion
- 21:50de Contra Inteligencia Militar, Director of Counterintelligence Military
- 21:54Intelligence, part of MINFAR as its military intelligence
- 21:58agency.
- 21:59El Ministerio del Interior, Minister of Interior, oversaw
- 22:03the Directorate of Intelligence.
- 22:05I'm going to quit reading them in Spanish
- 22:06and give them to you the other way,
- 22:07that focused on foreign intelligence gathering.
- 22:10Unindicted co-conspirator one was Minister of the
- 22:14Directorate of Intelligence.
- 22:18So they're naming this guy.
- 22:19That's the unindicted co-conspirator one.
- 22:22They didn't indict him, but they listed him
- 22:24as a co-conspirator.
- 22:26From in or around 1959 through in around
- 22:292008, Castro Ruiz was the Minister of MINFAR.
- 22:33He was also Vice President from 1976 to
- 22:372008.
- 22:39From 1959 through June 1996, Cuba's political headquarters,
- 22:44including the ministries, were located at the Revolutionary
- 22:47Palace in Havana, Cuba, superior headquarters.
- 22:50That's the superior headquarters.
- 22:52Paragraph seven, 96, unindicted, they didn't indict, co
- 22:55-conspirator two was the base commander at San
- 22:57Antonio Airfield in Cuba.
- 22:59At least, paragraph eight, at least as early
- 23:02as 1992 through approximately 96, defendants, Lorenzo Alberto
- 23:06Perez, Emilio Jose Palacio Blanco, Jose Fidel Gual
- 23:11Barzaga, Raul Simanca Cardenas, and Luis Raul Gonzalez
- 23:16Pardo Rodriguez were trained MIG fighter pilots in
- 23:21DAAFAR.
- 23:23Luis Francisco Perez Perez was also a trained
- 23:26MIG fighter pilot in DAAFAR during this time.
- 23:32And they have pictures of them.
- 23:34At least as early as in or around
- 23:371992 through February 24, 1996, La Perez Perez,
- 23:42Blanco, Barzaga, Cardenas, and Rodriguez, and LF Perez
- 23:45Perez were jet fighter pilots stationed at San
- 23:48Antonio de los Baños Airfield in Cuba.
- 23:53Okay, that's the background of the people.
- 23:55So, these people were fighter pilots, okay, the
- 23:59other people.
- 24:01Castro Ruz and others known and unknown to
- 24:03the grand jury, of course, because you don't
- 24:06freaking know.
- 24:07Castro Ruz and others known and unknown to
- 24:09the grand jury, you can indict a ham
- 24:11sandwich member, grand jury.
- 24:13You ever get called to a grand jury,
- 24:15you got to say, no thanks, this is
- 24:16crap.
- 24:17There's nobody to tell the other side of
- 24:20the story.
- 24:20You get one side of the story.
- 24:21If you can't win here, lawyer, you're a
- 24:23terrible freaking lawyer.
- 24:25And the lawyer, the prosecutor that goes up
- 24:27and says, and the prosecutor goes and gets
- 24:30an indictment, tries to get an indictment by
- 24:33providing a sealed or unsealed indictment and gives
- 24:37it to the to the grand jury, and
- 24:41the grand jury doesn't give him an indictment.
- 24:44That's a shitty lawyer.
- 24:46That is a very bad lawyer.
- 24:48And they go, well, the grand jury didn't
- 24:50find enough evidence.
- 24:51Idiot, because you didn't tell him more.
- 24:54Just lie.
- 24:54That's what everybody else is doing.
- 24:56The whole thing's a scam.
- 24:57Anyway, you get one side of the story.
- 25:00A grand jury is nothing.
- 25:03You think it's grand.
- 25:04Why?
- 25:04Because they call it grand.
- 25:07It's grand.
- 25:08Oh, my God.
- 25:09I've been in jury.
- 25:12Isn't that grand?
- 25:14That's just freaking grand.
- 25:15I've been invited to the grand jury.
- 25:18Wonder who's going to show up.
- 25:19Nobody, you moron.
- 25:21Nobody shows up.
- 25:22The only person standing there is the prosecutor.
- 25:25He gives you a presentation and at the
- 25:27end says, now, do you think we should
- 25:29indict him or not?
- 25:30And you go, yeah, I only heard one
- 25:33side of the story.
- 25:34So let's go watch a movie.
- 25:36Let's go watch a movie.
- 25:38And at the end of the movie, go,
- 25:39boy, that was a bad dude.
- 25:41That that joker, he was a bad guy.
- 25:44Let's indict the actor who played him.
- 25:47That's the same freaking thing, you moron.
- 25:51If you think the grand jury is grand,
- 25:54you better think again.
- 25:55It ain't so grand.
- 25:56It's stupid.
- 25:57And what they have, OK, so in most
- 26:01states, and by the way, it's hard to
- 26:04do afterward.
- 26:05You have to file a motion to dismiss.
- 26:06You got to do something.
- 26:07But if they have the grand jury, suddenly
- 26:08they don't have to have a preliminary hearing,
- 26:11right?
- 26:11They don't have to have one.
- 26:12They've had the preliminary hearing.
- 26:14So in a preliminary hearing, most lawyers go
- 26:16and the reason they go to see the
- 26:18preliminary hearing.
- 26:19So you get charged with a felony.
- 26:20You go to court in a felony, the
- 26:22very first step and your idiot lawyer, if
- 26:24he isn't doing it, he's an idiot, in
- 26:26my opinion.
- 26:27OK, and or he has strategic other thing.
- 26:30But you better find out exactly why he's
- 26:32not doing it, because the first thing that
- 26:34you should do if you're charged with a
- 26:37felony, especially in the state of Missouri, is
- 26:39at the end of it, say, you know,
- 26:42before you ever because what happens is you'll
- 26:44get sent to associate court.
- 26:45You go to the lower court in the
- 26:47lower court.
- 26:47You sit there and your only thing at
- 26:49lower court is either get a waive the
- 26:54preliminary hearing or they have a preliminary hearing.
- 26:59Even if you don't ask a question, go
- 27:03to the preliminary hearing because you'll get the
- 27:06evidence.
- 27:07You'll get to see what the prosecutor presents
- 27:10to the judge to charge you.
- 27:13He has to have all the elements of
- 27:15the crime.
- 27:16And if you got a good judge, judge
- 27:17might just throw it out.
- 27:18And if you have a good lawyer, you
- 27:20may win at the preliminary hearing part.
- 27:22This is where you attack the sufficiency of
- 27:24evidence.
- 27:25OK, so here's this grand jury indictment.
- 27:28Why are they telling us all this?
- 27:30Why are they giving us this whole long
- 27:32story of drama at the end?
- 27:34Because this is the movie they played for
- 27:37the grand jury.
- 27:38That's why.
- 27:39And so I'm sharing it with you.
- 27:40The grand jury process is a joke.
- 27:42OK, and maybe not in every state.
- 27:45Maybe they have different provisions in different states.
- 27:48But in federal court, in state court, you
- 27:50don't get to be there.
- 27:52OK, in Missouri, at least in most other
- 27:54places, doesn't freaking matter.
- 27:56If you have a preliminary hearing process, though,
- 27:58that's a different deal.
- 27:59You get to have a hearing to find
- 28:01out if there's sufficient information to charge you
- 28:04with a crime.
- 28:06Now you're charged with a crime.
- 28:07The preliminary hearing replaces the grand jury.
- 28:10OK, then you can file an indictment.
- 28:12The indictment has to be heard by who?
- 28:14The grand jury.
- 28:15The grand jury hears it.
- 28:16Now they don't have to do anything.
- 28:17You don't get the right to have a
- 28:19hearing.
- 28:20Well, there's already been a sort of preliminary
- 28:23hearing.
- 28:23There's a grand jury indictment.
- 28:25So the grand jury indictment gets rid of
- 28:27the need to have a preliminary hearing.
- 28:30OK, and the state level.
- 28:32OK.
- 28:34And there are ways, you know, there's defenses
- 28:36and all that is different for different charges,
- 28:38different for different stuff like that.
- 28:40But the reason you have a grand jury
- 28:41is because the grand jury is a joke
- 28:43and that this lets people believe that there's
- 28:46some formal legal process that's really bullshit.
- 28:49But they put it out there anyway because
- 28:51there's nobody there to defend the accused.
- 28:53Nobody.
- 28:55And this is how you get past step
- 28:56one of charging somebody with a felony.
- 28:59So all you have is the basics.
- 29:01And so now if you go to trial
- 29:02and you go through, you have to attack
- 29:04the basics because they've already gotten the right
- 29:08to charge you by putting this crazy bullshit
- 29:11process called the grand jury in your lap.
- 29:15OK, so now we're going to have the
- 29:17background of the shoot down.
- 29:18We have the background of the participants, you
- 29:21know, what they did.
- 29:22And now we have the background to the
- 29:24shoot down.
- 29:25Castro, Ruse and others known and unknown to
- 29:27the grand jury used their leadership, membership and
- 29:32association to form a dictatorship with absolute authority
- 29:36in Cuba.
- 29:37Oh, my God, that's horrible.
- 29:39Grand jury sitting there thinking that's atrocious.
- 29:42They're dictators, man.
- 29:44These are dictators.
- 29:45Of course, they're the bad guys.
- 29:47The Castro regime established and maintained control over
- 29:50Cuba and her people through a reign that
- 29:54eliminated dissent, preserved their power, territory and reputation,
- 29:58and through expropriation and nationalization of private business
- 30:01funded those objectives.
- 30:04Gee, that sounds just like America.
- 30:06Only here we call it democracy there.
- 30:09They call it they call it that's a
- 30:11dictatorship.
- 30:12You think you think the Clinton regime, the
- 30:15Biden regime, Obama, you think that's not it?
- 30:18That's not those guys are all above board,
- 30:21right?
- 30:21They've never done anything.
- 30:23They didn't kill anybody.
- 30:25They didn't fly jets and kill private citizens.
- 30:29What about Israel?
- 30:30They don't just go out and kill humanitarian
- 30:32aid workers.
- 30:33That had never happened.
- 30:34They don't just fly into other countries and
- 30:36bomb the shit out of them, killing all
- 30:38kinds of civilians.
- 30:39They don't do that.
- 30:40No, no, no.
- 30:42We would never do that.
- 30:43We're a democracy.
- 30:44We're the good guys, right?
- 30:45We are the good guys.
- 30:47Well, we should quiz that because we're really
- 30:50not all that great.
- 30:51You know, individually, we're decent.
- 30:53You know, we're good folks.
- 30:54But don't go thinking that just because you
- 30:56happen to be elected that you're some kind
- 30:59of a good guy.
- 31:00I mean, just look in the look in
- 31:01the look in the state houses.
- 31:04Look around you.
- 31:05Wake up.
- 31:07Beginning in or around 1959, Cubans fled the
- 31:10Castro regime.
- 31:11Oh, my God.
- 31:11They've been fleeing to the United States of
- 31:14America and elsewhere.
- 31:15Well, you know, there's plenty of Ukrainians here.
- 31:18Maybe they've been fleeing.
- 31:20Maybe they've been fleeing, not a war.
- 31:23Maybe they've been fleeing the BS structure of
- 31:28the dictatorship that we installed.
- 31:31Maybe that's what they're doing.
- 31:33You're pretty selective in choosing who you get
- 31:35to charge with the crime.
- 31:36Right.
- 31:37I better hurry this up or I'm never
- 31:38going to make it through beginning here.
- 31:41I'm having too much fun with this.
- 31:43This is crap.
- 31:44This is complete crap.
- 31:46The beginning in or around 1959, Cubans fled
- 31:49the Castro regime.
- 31:50Blah, blah, blah.
- 31:50Already said that beginning in at least or
- 31:52as early as around 1960.
- 31:54Oh, my God.
- 31:55They've been doing it for sixty five years.
- 31:57The former Soviet Union allied with Cuba.
- 32:01Oh, my God.
- 32:02Vladimir Putin once again is the guilty party.
- 32:06Holy crap.
- 32:07It's Vlad.
- 32:09He's at it again.
- 32:10Beginning in 1960, the former Soviet Union allied
- 32:15with Cuba and began providing the Cuban government
- 32:18with significant economic and military support.
- 32:23Now, that's a big deal.
- 32:25I mean, my God, the U.S. government
- 32:27doesn't ally with other countries and provide any
- 32:30of them with significant economic and military support.
- 32:33That doesn't happen, does it?
- 32:34In around 1978, I want to know what
- 32:37sense that that what what what benefit that
- 32:42sentence has in here other than to say
- 32:45Soviet Union's are bad dudes.
- 32:47Those are some bad people.
- 32:49It was a bad.
- 32:51It was a good theory.
- 32:52It just can't quite work that way.
- 32:56Doesn't work that way.
- 32:58Doesn't work that way.
- 33:00Beginning in or well, in or around 1978,
- 33:04the U.S. and Cuba reached an agreement
- 33:07establishing a maritime and airspace boundary in the
- 33:12Straits of Florida and elsewhere based on an
- 33:15equidistant measurement at the 24th parallel.
- 33:18That is 40 to 60 nautical miles north
- 33:22of Cuba and well beyond Cuba's 12 mile
- 33:26maritime and airspace jurisdiction.
- 33:30So they're talking about having some some rules,
- 33:34right?
- 33:34The 24th parallel did not extend Cuban maritime
- 33:38and airspace jurisdiction, but did serve as an
- 33:41operational identifier, triggering notorious requirement to Havana air
- 33:45traffic control when planes crossed the 24th parallel
- 33:50en route to Cuba.
- 33:52In around 1980, Cubans fled Cuba by boat
- 33:57en masse from the Mariel Harbor through the
- 34:00Florida Straits.
- 34:01While many Cubans survived that voyage, others perished
- 34:05at sea.
- 34:06After the Soviet Union dissolved in 91, their
- 34:10economic support for Cuba ceased.
- 34:13Cuba suffered economic recession, which peaked in around
- 34:1694.
- 34:17Cuban citizens continued to flee the Castro regime
- 34:20for the United States by boat raft and
- 34:24makeshift flotation vessels, including many who did not
- 34:27survive the journey.
- 34:29During that time, BTR rescued many fleeing Cubans
- 34:34at sea, at least as early as in
- 34:37or around 92.
- 34:39The DI, that's the Defense Intelligence Directorate, Directorate
- 34:43of Intelligence, sent spies to the Sunder District
- 34:46of Florida to, among other tasks, infiltrate BTR
- 34:50and report to the Castro regime on its
- 34:54activities.
- 34:55Now, riddle me this, Batman, are we not
- 35:00engaged in the same thing in reverse?
- 35:04Are there spies from America going into Cuba?
- 35:09Now, if they get caught on Cuban soil,
- 35:11they're going to be killed, or then they're
- 35:13going to be denied by the United States,
- 35:15right?
- 35:17So, these guys, they're the ones with all
- 35:19the genius, and I'm sure they didn't have
- 35:20to provide any of this evidence, but this
- 35:22is what they put.
- 35:23Those spies included Rene Gonzalez, aka Castor, aka
- 35:30Eselin, and Juan Pablo Roque, aka German, aka
- 35:35Vedette.
- 35:37The spies posed as exiled pilots fleeing Cuba.
- 35:42Juan Pablo Roque also offered himself to the
- 35:44FBI as an informant on the activities of
- 35:47Miami-based exile groups, including BTR.
- 35:51The DIA directed and controlled his cooperation with
- 35:54the FBI.
- 35:55That's comfortable for you to say now, right?
- 35:58But back then, I guarantee you didn't either
- 36:01know that or you wouldn't have said it,
- 36:03and who knows whether it's true even now.
- 36:09You're not allowed to lie to the court,
- 36:11right?
- 36:12But all of this is questionable stuff.
- 36:16What evidence do you have of all this?
- 36:18Oh, we gave that to the grand jury,
- 36:20did you?
- 36:20You showed them a movie, and they said,
- 36:22yeah, let's kill these guys.
- 36:24That's what you did.
- 36:26And how do you have anything if you're
- 36:30not willing to subject it to cross-examination
- 36:33by somebody else with a different focus that
- 36:36doesn't have the same goal as you to
- 36:39indict somebody?
- 36:41On or about July 13, 1994, 70 Cubans
- 36:45attempted to flee the Castro regime in a
- 36:47tugboat named El Tres de Marzo, the 13th
- 36:50of March.
- 36:50The Castro regime's Coast Guard, a branch of
- 36:52military controlled by Castro regime, sank the tugboat
- 36:54and killed dozens of their own citizenry.
- 36:58Well, does this have to do with anything?
- 37:01They sunk a tugboat of people trying to
- 37:04leave, and they said, you're not leaving.
- 37:06If America had a rule that said you
- 37:07couldn't take your tugboat and leave American waters
- 37:10and said, by the way, if you go
- 37:12out there, we're going to kill you.
- 37:17Wonder what would happen there.
- 37:19Shortly thereafter, in or around August 1994, Cubans
- 37:23filled the streets in protest, along with the
- 37:25iconic seawall known as El Malecon in Havana,
- 37:29Cuba, in response to Castro's continued repression of
- 37:32seafaring migration to the United States.
- 37:35On or about November 19, 1994, three unarmed
- 37:37United States civilian aircraft operated by BTTR dropped
- 37:43leaflets and other items that landed on the
- 37:47Cuban mainland.
- 37:50Hmm.
- 37:51So American aircraft flying over.
- 37:55Ooh, what does this show?
- 37:58Oh, now I'm going to have to find
- 38:00out.
- 38:02Tell you what, the Castro regime took no
- 38:05military action against those aircraft.
- 38:08Isn't that crazy?
- 38:09Sorry, I got distracted.
- 38:11On or about July 13, 1995, four unarmed
- 38:15U.S. civilian aircraft operated by BTTR flew
- 38:19along with the maritime flotilla from the U
- 38:21.S. toward Cuba to commemorate the sinking of
- 38:24the El Tres de Marza.
- 38:27So on 13th of July, they were celebrating
- 38:29the sinking of the 13th of March.
- 38:32The Castro regime's Coast Guard met the flotilla
- 38:34and formed a blockade.
- 38:35The Castro regime dispatched MiG fighters to the
- 38:37area.
- 38:38The regime took no further action.
- 38:40In or around 95, a Cuban dissident group
- 38:43advocating for peaceful transition from Castro to a
- 38:46democratic government formed in Cuba.
- 38:48They were known as Consilio Cubano.
- 38:53On or about January 9, 1996 and January
- 38:5713, 96, four unarmed civilian aircraft operated by
- 39:00BTTR flew leaflets containing excerpts from the U
- 39:03.S. Nations, United Nations Universal Declaration of Human
- 39:07Rights that landed on the Cuban mainland.
- 39:10Cubans, including members of Consilio Cubano, received the
- 39:13leaflets.
- 39:14Consilio Cubano planned a meeting to begin on
- 39:16or about February 24, 1996.
- 39:18The DI, Defense Intelligence Directorate, on behalf of
- 39:21Castro regime formulated Operation Scorpion, Operation Scorpion, to
- 39:26perfect the confrontation of the counter-revolutionary actions
- 39:30of BTTR and provided instructions to its Miami
- 39:33-based agents to continue to provide information to
- 39:36on BTTR plans and activities, but not to
- 39:39fly with BTTR to Cuba in or around
- 39:42February 96.
- 39:46Part of the Operation Scorpion's mission was for
- 39:48the Wasp Network to provide information related to
- 39:50BTTR, which notably included any flight plan toward
- 39:53Cuba on February 24, 96, to coincide with
- 39:56the Consilio Cubano meeting.
- 39:57The Wasp Network provided information with the DI
- 39:59in which the DI was in turn to
- 40:03provide to the Cuban military, including Defar, Castro
- 40:07Ruiz, and the Castro regime.
- 40:08In response to BTTR flights on or about
- 40:10January 9, 96, and on or about January
- 40:1213, 96, in anticipation of future flights by
- 40:15BTTR, DAAFAR engaged in training missions, this is
- 40:19the flight people, with their MiG fighter pilots,
- 40:22including L.A. Perez-Perez, Blanco Barsaga, Cardenas
- 40:25Rodriguez, and L.F. Perez-Perez.
- 40:28The pilots practiced locating and flying low, slow
- 40:31-flying civilian aircraft like the ones used by
- 40:33BTTR.
- 40:34At or about this time, the Castro regime
- 40:36quashed Consilio Cubano's planned meeting and prevented the
- 40:39organization from gathering on February 24, 96, and
- 40:43thereafter.
- 40:44Okay?
- 40:45So these are all activities of a foreign
- 40:47government taken on foreign soil.
- 40:50Nothing has happened.
- 40:51If they didn't capture any of these guys,
- 40:54maybe they did and they're charging them with
- 40:55crimes.
- 40:56And so that's fine because they're in your
- 40:58jurisdiction and you catch them here.
- 41:00If you can catch them here, you can
- 41:02get them for murder, but you can't get
- 41:03them for murder in somewhere that occurred elsewhere
- 41:05in the world.
- 41:06Okay?
- 41:07The murder had to occur in the jurisdiction
- 41:09you're flying in.
- 41:10Okay?
- 41:11And that's what they're talking about.
- 41:13Remember that little line that they gave you
- 41:14about, here's the line that we agreed to
- 41:16under treaty.
- 41:17We said we'd give notice to each other
- 41:18and we wouldn't go any further than that.
- 41:20That seems to be the way they're trying
- 41:22to claim jurisdiction over these planes shot down
- 41:25over probably the Cuban spaces.
- 41:28But we're not there yet.
- 41:29Let's get to the shoot down.
- 41:31And that would maybe give you jurisdiction in
- 41:35the federal court in Florida.
- 41:39But I doubt it because it doesn't cover
- 41:41the sea.
- 41:42It covers everywhere else.
- 41:45Right?
- 41:46Jurisdiction on a boat, that's different.
- 41:48If you have jurisdiction on a boat and
- 41:51on a U.S. boat, U.S. licensed
- 41:52boat, something like that, maybe that'd work.
- 41:55Right?
- 41:55Maybe.
- 41:56But you still got to have both parties
- 41:59located in the boat.
- 42:00If I blow up a boat from somewhere
- 42:01else, I'm not on the boat.
- 42:02I just blew up a licensed boat.
- 42:04Right?
- 42:05You're not on that boat.
- 42:06You can't take jurisdiction of me on a
- 42:08boat that I'm not on as the captain
- 42:10of that boat.
- 42:11Anyway, the shoot down.
- 42:12Now we're getting to the meat.
- 42:13At BTTR's January 96 flight, Castor is authorized
- 42:16use of deadly force against BTTR.
- 42:18Okay?
- 42:19That's his prerogative as he can say, kill
- 42:22those bastards, shoot them down.
- 42:23You don't think we don't do the same?
- 42:25What do we do in America?
- 42:27Blow up that leader of Iran.
- 42:30Blow up his son.
- 42:31Blow up his wife and kids.
- 42:32Blow up that school over there full of
- 42:34girls because all the elites are over there
- 42:37going to school.
- 42:38You know, blow up Gaza.
- 42:39You know, blow it to freak up.
- 42:41Why not?
- 42:42I mean, geez, what are they going to
- 42:43do?
- 42:43Charge us with murder?
- 42:44I don't think so.
- 42:45Not in America.
- 42:47It might be if they could catch us
- 42:49in Iran at the time Donald Trump flies
- 42:52to Iran.
- 42:53Maybe they'll pick him up and go, well,
- 42:55sir, we're going to charge you with a
- 42:56crime.
- 42:57Have a nice day.
- 42:57And they put him in prison.
- 42:59Okay?
- 42:59So that's how you get jurisdiction.
- 43:01You don't get jurisdiction by creative means like
- 43:03this.
- 43:03This is good stuff.
- 43:04So I'm eager to find out where they're
- 43:06going, but I'm only halfway through and I'm
- 43:09only nine pages of 26.
- 43:10So I got to cruise a little faster
- 43:11and quit commenting and yelling at people.
- 43:14So Castro authorized the use of deadly force
- 43:18against BTTR.
- 43:20Oh my God.
- 43:21After January, 1996, at least as early as
- 43:25in around February 94 and continuing through at
- 43:28least around July 96 to military chain of
- 43:31command at San Antonio de los Banos airfield
- 43:33in Cuba was from the air base to
- 43:35day far from day far to min far,
- 43:37then back down the same chain of command.
- 43:38All orders to kill by the Cuban military
- 43:41traveled through this chain of command with Castro
- 43:43reason, Phil Del, Fidel Castro is the final
- 43:45decision makers.
- 43:47Okay.
- 43:48Similar Donald Trump.
- 43:50If he would choose us to kill the
- 43:51leader, the alchemy knee, they want to kill
- 43:54him.
- 43:55Trump gives the order.
- 43:56Okay.
- 43:57Trump ordered that guy killed period end of
- 44:00sentence.
- 44:01Okay.
- 44:01So there you go.
- 44:02That happened.
- 44:03And he gave that order while located on
- 44:05American soil, he's more guilty of a crime
- 44:08of murder in America than they're ever going
- 44:11to be able to establish by any creative
- 44:13weaving of a tail.
- 44:15Like I'm telling you right now.
- 44:16Okay.
- 44:17And not that I'm saying you should be,
- 44:18these are decisions that are made by foreign
- 44:20governments all the time.
- 44:22What was, what was Maduro charts with possession
- 44:27of machine guns, possession of machine guns.
- 44:30That's even more creative.
- 44:31That was even more bullshit by the way.
- 44:33But this one let's we'll we'll get to
- 44:36the end.
- 44:36Cause I haven't read all this.
- 44:37I just knew, I knew what it was
- 44:38going to contain before I read it.
- 44:40So I chose to do it right here,
- 44:41right here, live.
- 44:42So you're getting Sam's rot live thought process
- 44:45while I read this horse crap indictment.
- 44:49Oh my God.
- 44:49They've indicted someone at the time of their
- 44:52destruction.
- 44:52Okay.
- 44:53Wait, wait, wait, wait, wait.
- 44:55Honor about February 24 96 at 1 30
- 44:58PM, approximately three unarmed us civilian aircraft operated
- 45:02by BTTR bearing tail numbers and November 2
- 45:055 0 9 November 2 4 5 6
- 45:09Sierra and November 5 4 8 5 Sierra
- 45:12left Opa lockup airport in Miami Dade County,
- 45:17Florida.
- 45:18Honor about February 24, 1996, a defar mig
- 45:21fighter jet operated by La Perez present LF
- 45:24Perez Perez destroyed two of the BTR aircraft
- 45:26bearing tail numbers, November 2 4 5 6
- 45:29Sierra and November 5 4 8 5 Sierra.
- 45:32They killed four United States nationals, including us
- 45:37citizens, three us citizens.
- 45:40At the time of their destruction, the two
- 45:42BTTR aircraft were flying outside Cuban territory.
- 45:46In fact, they're flying over international water, traveling
- 45:49away from Cuba, despite their contact with the
- 45:52Havana air traffic control tower, Cuban military did
- 45:55not provide BTTR with any warning of the
- 45:57imminent destruction of their aircraft.
- 46:01Okay.
- 46:01Those are facts that maybe, maybe can be
- 46:04proven.
- 46:04Maybe they were just set in a movie
- 46:06format to the grand jury after the Castro
- 46:09regime shot down the two BTTR aircraft, Barzaga,
- 46:12Cardenas and Rodriguez followed the third BTTR aircraft
- 46:15with tail number November 2 5 0 6
- 46:17near the 24th parallel.
- 46:19But that aircraft escaped destruction.
- 46:24And then you show a picture of the
- 46:25sole surviving aircraft on February 26.
- 46:28Count one.
- 46:29Okay.
- 46:29Those are the facts.
- 46:30Those are the facts.
- 46:33Okay.
- 46:33Count one count paragraph count one conspiracy to
- 46:37kill a U S national under USC 18
- 46:40USC section, uh, 23 32 B two paragraph
- 46:44one through 33 of the general allegations section
- 46:47are incorporated here.
- 46:48And by reference beginning at a time unknown
- 46:50to the grand jury, but at least as
- 46:53early as in or around January 96 and
- 46:55continuing in or around April 96 while outside
- 46:57the United States defendants, they were outside the
- 47:00United States defendants role Modesto Castro ruse, Lorenzo,
- 47:04Alberto Perez, Perez, Emilio, Jose, Palacio, Blanco, Jose,
- 47:07Fidel, Gual, Barzaga, and Raul Samanka Cardenas and
- 47:12Luis Raul Gonzalez, Pardo Rodriguez did knowingly and
- 47:16willfully combined conspire Confederate and degree with each
- 47:20other and with other persons known and unknown
- 47:24to the grand jury to kill a national
- 47:26of the United States while the national was
- 47:28outside of the United States.
- 47:29And that is CC MD one P a
- 47:33a and other pilots and passengers of aircraft
- 47:35operated by BTTR, which conspiracy contemplated their murder
- 47:40as defined in title 18 U S code,
- 47:43uh, section one 11, I'm sorry, 1,111
- 47:48subparagraph a object of the conspiracy was the
- 47:51object of the conspiracy to kill us nationals
- 47:54by shooting down BTTR aircraft using information provided
- 47:58by spies in Miami to terrorize, intimidate, and
- 48:00retaliate against Cuban people and the Cuban exile
- 48:03community overt acts to achieve the objective of
- 48:07this conspiracy defendants and their co-conspirators can
- 48:10committed and cause to be committed at least
- 48:12one of the following overt acts among others
- 48:14in the Southern district of Florida and elsewhere
- 48:17because they know it's not Southern district of
- 48:19Florida in or around 1994 after BTTR's November
- 48:221994 flights and drop leaflets in Cuban territory
- 48:25DI formulated a plan for Juan Pablo Roque
- 48:28to fly to a BTTR aircraft to Cuba
- 48:30in late 95 to embarrass and undermine BTTR.
- 48:33What's that got to do with anything seriously
- 48:35on or about December 4, 1995 DI agreed
- 48:40to that Raul that Juan Pablo Roque should
- 48:43continue to inform on BTTR okay at least
- 48:46as early as January 1396 and after BTTR's
- 48:49January 996 and January 1396 dissemination of leaflets
- 48:53that landed on the Cuban mainland Castro Ruz
- 48:56met with military leaders and authorized them to
- 48:58take decisive and deadly action against BTTR aircraft
- 49:01okay he said what any leader would say
- 49:04America would say that China you can't come
- 49:06fly your shit into our territory and drop
- 49:09leaflets telling Americans that Donald Trump is fat
- 49:12you can't do that you're not allowed and
- 49:15so therefore I Donald Trump say blow those
- 49:17aircraft up if they cross our airspace again
- 49:19you think we're not going to do that
- 49:20we're absolutely going to do that on or
- 49:22about January the 18th 1996 DI instructed Washington
- 49:25to report on U.S. military personnel and
- 49:27asset movement as well as the United States
- 49:29military preparedness at the Boca Chica Naval Air
- 49:32Station a United States military installation located in
- 49:36Key West Southern District of Florida on or
- 49:39about January 1896 DI instructed Juan Pablo Roque
- 49:42and Rene Gonzalez to determine what aircraft BTTR
- 49:45used and other details regarding its January 13
- 49:49flight oh my god they're looking for information
- 49:52on how to stop these people on or
- 49:54about January 2696 Gerardo Hernandez a Cuban spy
- 49:58operating in the Southern District of Florida returned
- 50:01to the U.S. from Cuba with approval
- 50:02for Operation Scorpion and canceling his previous plan
- 50:05for Juan Pablo Roque to fly a BTTR
- 50:07plane to Cuba to embarrass and undermine BTTR
- 50:11but on or about January 2996 DI conveyed
- 50:14instructions to its Miami-based spies regarding Operation
- 50:19Scorpion the approved confrontation with BTTR that's on
- 50:23January 29th on or about January 3096 the
- 50:26DI instructed Juan Pablo Roque and Rene Gonzalez
- 50:28to avoid flying with BTTR and to use
- 50:30the particular phrases over the radio to communicate
- 50:33with Cuba if they were on the flight
- 50:35with BTTR on or about February 196 the
- 50:38DI and its agents in the Southern District
- 50:40of Florida and elsewhere began planning Juan Pablo
- 50:44Roque's return to Cuba the DI informed uh
- 50:47Gerardo Hernandez that the DI wanted Juan Pablo
- 50:49Roque filmed entering and leaving a Cuban-American
- 50:52exile group headquarters on or about February 3rd
- 50:57or February 5th 96 the DI instructed its
- 51:00agents to make Operation Scorpion a priority and
- 51:03urgently report to BTTR flight data on or
- 51:07about February 13 Cuban spies operating in Southern
- 51:09District of Florida directed Rene Gonzalez to provide
- 51:13clear detailed precise information about upcoming BTTR flights
- 51:16they ordered Rene Gonzalez not to join any
- 51:19flight and directed that if he could not
- 51:21avoid flying with BTTR he should broadcast specified
- 51:24phrases via the aircraft's radio on or about
- 51:27February 1896 the DI instructed that Juan Pablo
- 51:30Roque and Rene Gonzalez should not fly with
- 51:32BTTR or any other organization on February 24
- 51:3525 26 27 the anticipated meeting date of
- 51:38the Concilio Cubano on or about February 21
- 51:43Juan Pablo Roque falsely informed the FBI that
- 51:46BTTR would not be flying during the weekend
- 51:48of February 24 96 even though as he
- 51:51then knew BTTR was scheduled to fly during
- 51:54that time so there they found a patsy
- 51:56here on or about February 22 96 the
- 51:59DI communicated that a DI officer had traveled
- 52:01to Mexico to support the departure of Juan
- 52:03Pablo Roque from the U.S. to Cuba

- 52:29number two La Perez Perez Blanco Barzaga Cardenas
- 52:34Rodriguez LF Perez Perez and others engaged in
- 52:37training missions using Cuban military aircraft to find

- 52:48February 24 96 on or about uh at
- 52:51or about 3 p.m. three unarmed civilian
- 52:53aircraft operated by BTTR having those tail numbers
- 52:56flew south across the 24th parallel at approximately
- 53:013 p.m. La Perez Perez and LF
- 53:03Perez Perez in mig-1 and Blanco in
- 53:05a mig-2 took off from San Antonio
- 53:08Los Baños Air Force located near Havana Cuba
- 53:10at 3 20 p.m. Perez Perez and
- 53:13uh sought authorization to destroy the unarmed civilian
- 53:17aircraft bearing tail number and November 2456s which
- 53:21was flying at the time over international waters
- 53:24La Perez Perez and Perez LF were given
- 53:28the authorization to destroy unarmed civilian aircraft at
- 53:34approximately 3 21 p.m. without warning Perez
- 53:38Perez and LF Perez Perez shot down BTTRs

- 54:14passenger at time of the shoot down of
- 54:16the two BTR aircraft Barzagan Cardenas and mig
- 54:18-3 and Rodriguez and mig-4 were inside
- 54:21their Cuban fighter jets ready to deploy they
- 54:23listened to La Perez Perez and LF Perez
- 54:25Perez radio requests for authorization to destroy unarmed
- 54:28civilian aircraft the authorization received for the same
- 54:31and confiscation that those aircraft were destroyed Barzagan
- 54:34Cardenas and mig-3 and Rodriguez and mig
- 54:36-4 took off from San Antonio Los Banos
- 54:38airfield located in Havana Cuba to join La

- 54:45number and 2506 with the intent of destroying
- 54:49that aircraft as well unindicted co-conspirator to
- 54:53authorize Barzagan and Cardenas and mig-3 and
- 54:57Rodriguez and mig-4 to take off from
- 54:59San Antonio Los Banos airfield located near Havana
- 55:02to join La Perez Perez and other Perez
- 55:04Perez pursuit of the third unnamed civilian aircraft
- 55:07with the intent of destroying that via that
- 55:09aircraft all in violation of U.S. code
- 55:14section 2332 b2 which by the way doesn't
- 55:20apply to anything that we've talked about it's
- 55:26a U.S. code how in the world
- 55:28are these people all in violation of title
- 55:3318 U.S. code they aren't even located
- 55:36in America okay so that's interesting the easy
- 55:42answer would be just go screw you guys
- 55:44we aren't doing this but they've politicized it
- 55:47so the judge has to you know rethink
- 55:49and and give any sort of real the
- 55:51grand jury indicted these people come on what
- 55:55else are we gonna do that's it so
- 55:57murder that's the first count one murder has
- 56:00now been told to us about what that
- 56:04is that you know all of these people
- 56:06full of photos who have general allegations we
- 56:10have a superseding indictment we have overt acts
- 56:14that they conducted that's that's all count one
- 56:21conspiracy to kill U.S. nationals that's conspiracy
- 56:26friends and neighbors that is it count two
- 56:31destruction of aircraft paragraphs 1 through 34 of
- 56:36the general allegations section and paragraph 4 through
- 56:3831 of the overt act section are incorporated
- 56:41by reference on on or about February 24
- 56:44in the special juror aircraft jurisdiction of the
- 56:48United States right so now they have a
- 56:51special aircraft jurisdiction because that's why they mentioned
- 56:56that agreement with the with the Cuban government
- 57:02from way back when they said if you
- 57:04cross this parallel so while in the special
- 57:09aircraft jurisdiction of the United States unmentioned by
- 57:12the way they have U.S. 18 U
- 57:14.S.C. 32 A1 34 49 U.S
- 57:19.C. 46 501 subparagraph 2 so they're creating
- 57:23their own jurisdiction here all in an effort
- 57:27to be able to and this is extremely
- 57:30tenuous and bs just by reading it because
- 57:32they aren't even mentioning the jurisdiction they're just
- 57:35you know you throw the grand jury doesn't
- 57:37know crap about jurisdiction anyway jurisdiction is for
- 57:40the the courts to decide it's for lawyers
- 57:43to have before they get there you know
- 57:45you have to have the jurisdiction so they
- 57:47have to convince the court but if the
- 57:48court's on your side and the court's gonna
- 57:51you know just give you what you want
- 57:52you have to wait till appeal but in
- 57:54the meantime you get to have an act
- 57:56you get a file a case and Donald
- 57:58Trump goes well man let's go do we
- 58:00did to Maduro man that was great wasn't
- 58:02it we charged him with holding a machine
- 58:04gun he's got a machine I'm the biggest
- 58:08baddest wolf on the planet I'm gonna go
- 58:11get him and so you know this this
- 58:13is what they're trying to do all the
- 58:15way back in April they saw that oh
- 58:17my god here's a plan we're gonna capture
- 58:19that dude things will change in Cuba then
- 58:22you know that's right excuse me geez what
- 58:28games we play you got nothing better in
- 58:30your life than to lie about jurisdiction you
- 58:33know you just create your own jurisdiction this
- 58:35is government overreach at its finest this is
- 58:38this is what you do to make a
- 58:40name for yourself yeah I charged Castro with
- 58:42a grime well man that was great but
- 58:44you guess I could do that who needs
- 58:46to be a lawyer what difference does it
- 58:48make you're not using it anyway you're not
- 58:50using the law here this is this is
- 58:53uh creativity at its finest uh so on
- 58:56or about February 24 in the Special Aircraft
- 58:58Jurisdiction of the United States Raul Modesto Castro
- 59:01Ruiz Lorenzo Alberto Paris Paris so here they're
- 59:04charging Castro did willfully destroy and wreck an
- 59:08aircraft a wreck an aircraft that is a
- 59:11United States civilian aircraft bearing tail number blah
- 59:14by means of an air-to-air missile
- 59:16which resulted in the death of human beings
- 59:18cc and pm in violation of title 18
- 59:22U.S. code sections blah blah blah where
- 59:28is the jurisdiction over Raul Modesto Castro where
- 59:35it's not mentioned there's no jurisdiction mentioned even
- 59:41if we were the aircraft happened to be
- 59:45in the Special Aircraft Jurisdiction of the United
- 59:48States the defendant wasn't Lorenzo Alberto Perez Perez
- 59:53maybe he was we don't know where he
- 59:56filed the missile fired the missile from do
- 59:58we that's not mentioned whether he was in
- 1:00:01that aircraft or not this is this is
- 1:00:02poorly written crap this is just some guy
- 1:00:06telling a story to 12 citizens going don't
- 1:00:08you want to get that Castro after all
- 1:00:10these years this is what's going on count
- 1:00:12three destruction of an aircraft same thing and
- 1:00:16they're the next aircraft by means of an
- 1:00:19air-to-air missile nothing different in that
- 1:00:21count just a different airplane count for murder
- 1:00:25count for murder paragraph 1 through 34 of
- 1:00:29general allegations paragraph 4 through 31 of the
- 1:00:32overt acts of count 1 are incorporated by
- 1:00:34reference honor about February 24 96 special maritime
- 1:00:38and territorial jurisdiction of the United States of
- 1:00:42course Raul Modesto Castro was not there do
- 1:00:48you think that if Donald Trump is in
- 1:00:50his office in in Washington D.C. and
- 1:00:54he killed Ayatollah which Khomeini was it well
- 1:01:00he killed one of the Khomeini's that and
- 1:01:03everybody else that he ordered killed over there
- 1:01:05well we just kill him we just we
- 1:01:07killed him he's admitted it he's put it
- 1:01:11out there I killed those guys and that's
- 1:01:13that I took him out I gave the
- 1:01:15order of course he gave the order who
- 1:01:16else gave the order that the special the
- 1:01:19special jurisdiction of Iran is going to take
- 1:01:23place and they'll arrest Trump in the White
- 1:01:26House through special action drag him on over
- 1:01:29to Iran and get him for murder under
- 1:01:32Iranian law you'd think that was third world
- 1:01:34country law that's what this is that I'm
- 1:01:37reading to you this is third world country
- 1:01:40bullshit law this is the king changing his
- 1:01:44mind and and you get a you get
- 1:01:46a die because I say you get a
- 1:01:48die why don't we just send over the
- 1:01:50special forces kill the guy like you did
- 1:01:53in Iran what why this joke I'd much
- 1:01:57more support the other stuff than going in
- 1:01:59or destroying a system that I like to
- 1:02:04think is meant to be above reproach this
- 1:02:09is not it this is bullshit and the
- 1:02:13lawyers playing these games are horseshit lawyers these
- 1:02:17aren't real lawyers this is crap and uh
- 1:02:21you can tell him I said so I
- 1:02:23don't care this is crap where you let
- 1:02:25me go in there and defend this guy
- 1:02:28no news no nothing and just keep going
- 1:02:30to the to the to let me ask
- 1:02:33a couple of questions but in front of
- 1:02:36the grand jury and see if they say
- 1:02:37same thing well wait a minute how are
- 1:02:40you gonna get jurisdiction where are you creating
- 1:02:44this jurisdiction in the U.S. you have
- 1:02:48to well well we can get once he
- 1:02:50shows up on American soil maybe if he
- 1:02:54committed murder in another country there are exceptions
- 1:02:56to the rule that you can get it
- 1:02:58or that you or that he committed murder
- 1:03:00or directed a murder while located in another
- 1:03:03country but the murder occurred on U.S.
- 1:03:07soil and he directed it you could get
- 1:03:09him for the crime of conspiracy to commit
- 1:03:11murder any of things would be fine if
- 1:03:13he traveled to visit his grandma in Florida
- 1:03:17and you chose to arrest him then you
- 1:03:20could arrest him and maybe take jurisdiction but
- 1:03:23using it as a basis for Donald Trump
- 1:03:25to engage in a military action to go
- 1:03:28and capture the guy and bringing to bring
- 1:03:31him to the joke of a process like
- 1:03:34this in America just like the idiots did
- 1:03:38up in New York to Maduro I'd rather
- 1:03:40you just killed the guy and moved on
- 1:03:43I'd have felt better about it you know
- 1:03:45because that at least it's a military action
- 1:03:48you know Saddam Hussein we need to just
- 1:03:50kill that guy who the hell else was
- 1:03:53the guy ran the terrorist organizations we chased
- 1:03:57him around forever you know and they killed
- 1:03:59him in Afghanistan somewhere blah blah blah that
- 1:04:02you you at least can say well they
- 1:04:04you know the CIA did the right thing
- 1:04:06but this is bullshit I mean this lawfare
- 1:04:10crap is what we fight what I fight
- 1:04:13this is this is the rules being twisted
- 1:04:15for you to create some kind of scenario
- 1:04:19and it no matter how you slice it
- 1:04:21it's bs okay so count five is also
- 1:04:24murder so we had murder account for the
- 1:04:28general allegations blah blah blah they did willfully
- 1:04:31and unlawfully with malice aforethought kill cc a
- 1:04:35human being with premeditation and during the perpetration
- 1:04:38of an attempt to perpetrate sabotage that is
- 1:04:42the destruction of an aircraft in violation of
- 1:04:45title 18 us code 32 so they're extrapolating
- 1:04:49the supposed jurisdiction of somebody that destroys an
- 1:04:52aircraft into murder not using the murder statute
- 1:04:58but using he destroyed the aircraft okay so
- 1:05:01this is this is creative writing 101 from
- 1:05:05your you know eighth grade literature class for
- 1:05:10your eighth grade teacher this is these facts
- 1:05:12are pretty solid right not they're bullshit the
- 1:05:16same thing goes for count number five they
- 1:05:18the same exact uh title just different person
- 1:05:21paragraph count six murder same thing same maritime
- 1:05:25special they destroyed an aircraft in violation of
- 1:05:29title 18 and somebody got killed count seven
- 1:05:31murder same thing and that is it um
- 1:05:35and they didn't say the juror signed they
- 1:05:38wiped his name out so you can't see
- 1:05:41it so it's a u.s attorney get
- 1:05:43this jason redding quinones wonder if he's a
- 1:05:47cuban uh yara lorenzo klukas first assistant u
- 1:05:52.s attorney and abby waxman assistant u.s
- 1:05:55attorney and michael gilfarb assistant u.s attorney
- 1:05:59these guys are the morons who signed this
- 1:06:03okay and uh they made sure to get
- 1:06:07rid of the jury for four person you
- 1:06:09know because that guy doesn't want to get
- 1:06:11killed by any of the spies from cuba
- 1:06:12that are around but they're the idiots that
- 1:06:15have been sucked into i mean imagine you
- 1:06:18got four u.s attorneys going yeah i'll
- 1:06:20sign this thing but boy it's much more
- 1:06:22important that you believe what we told you
- 1:06:25and you uh you uh you know help
- 1:06:29us get this bad guy sign this indictment
- 1:06:32so that we can get on tv and
- 1:06:34say well all we did was give the
- 1:06:36grand jury the facts you know the facts
- 1:06:39you know we told him in the grand
- 1:06:41jury doesn't understand jurisdiction that's for sure you
- 1:06:46know when when was castro located on the
- 1:06:52aircraft that killed these people you can't just
- 1:06:55destroy an aircraft and get and get picked
- 1:06:58up so that something so now they're just
- 1:06:59sitting there going well we indicted the man
- 1:07:01we indicted him for destroying an aircraft and
- 1:07:04by the way once we get him on
- 1:07:06u.s soil you know jurisdiction will will
- 1:07:10apply then and this is what happened in
- 1:07:122003 so what they're doing is they're taking
- 1:07:15the stuff from 2003 murder lasts forever i'll
- 1:07:18bet yes i'll bet you anything that the
- 1:07:20uh code provision of uh destruction of an
- 1:07:24aircraft in title 18 us code 32 let's
- 1:07:30see if we can find that title 18
- 1:07:34us code 32 where are we morons where
- 1:07:40are we let's see if it is somebody's
- 1:07:44selling you something wait i'm not creating a
- 1:07:46pdf i am researching this is what's happening
- 1:07:50okay these people are amazing lawyers aren't they
- 1:07:55wow wow these guys are geniuses title 18
- 1:08:02u.s code section 32a is a federal
- 1:08:06criminal statute defining the crime of destruction of
- 1:08:10aircraft or aircraft facilities also known as the
- 1:08:15aircraft sabotage act it criminalizes the willful damage
- 1:08:19destruction or disable disablement of civil aircraft and
- 1:08:23surrounding facilities this this statute let's see 18
- 1:08:29us code let's get to the actual code
- 1:08:33okay here's the code a whoever willfully sets
- 1:08:39fire to damages destroys and wait which paragraph
- 1:08:43did they use on us hang on a
- 1:08:45second they used paragraph six let's see 18
- 1:08:50u.s code 32a and a has jesus
- 1:08:56eight sub paragraphs okay first paragraph sets fire
- 1:09:02to damages destroys disables or wrecks any aircraft
- 1:09:06in the special aircraft jurisdiction of the united
- 1:09:09states or any civil aircraft use operated or
- 1:09:12employed in interstate overseas or foreign air commerce
- 1:09:16to place their cause to be placed a
- 1:09:19destructive device substance in or upon blah blah
- 1:09:21blah that one doesn't apply sets fire to
- 1:09:24damages destroys or disables an air navigation facility
- 1:09:27that one doesn't apply for with intent to
- 1:09:29damage destroy or disable an aircraft sets fire
- 1:09:31to damage destroys disabled or places destructive device
- 1:09:34inner approximately to nope that's a bomb in
- 1:09:37interferes with or disables with intent to endanger
- 1:09:40the safety of any person or with reckless
- 1:09:42disregard for the safety of life anyone engaged
- 1:09:45or operating an aircraft in any air navigation
- 1:09:47facility now that's not there either uh performs
- 1:09:51an act of violence against or incapacitates any
- 1:09:54vehicle or any individual on any such aircraft
- 1:09:56if such are active violation of incapacitation is
- 1:10:00likely to endanger the safety of the aircraft
- 1:10:02communicates information knowing the information to be false
- 1:10:07and their circumstance in which information may reasonably
- 1:10:10believed thereby endangering the safety of any aircraft
- 1:10:13in flight nope attempts to or conspires to
- 1:10:16do anything prohibited under sub paragraphs one through
- 1:10:19seven shall be fined under this title or
- 1:10:23imprisoned not more than 20 years or both
- 1:10:27okay that's if you committed any of these
- 1:10:30things it's 20 years and the special aircraft
- 1:10:33jurisdiction of the united states is defined as
- 1:10:39terms defined in other law in this chapter
- 1:10:43the terms aircraft engine air navigation appliance civil
- 1:10:47aircraft foreign air commerce interstate air commerce landing
- 1:10:50area overseas commerce propeller spare part special aircraft
- 1:10:54jurisdiction of the united states have the meanings
- 1:10:58given to those terms in four thousand and
- 1:11:02four forty thousand one oh two a of
- 1:11:06title 49 so now we're going to go
- 1:11:09to there and find out what title 49
- 1:11:14says t-i-t-l-e 49 u
- 1:11:21-s-c oops c and see what this
- 1:11:27says there is no statute uh you're thinking
- 1:11:34of which is the foundation definition section for
- 1:11:38aviation okay this section overview transportation aviation definitions
- 1:11:46this section defines where is it we need
- 1:11:53the full text general definitions here we are
- 1:11:57uh blah blah blah landing landing landing there
- 1:12:01are a lot of of paragraphs what was
- 1:12:06it special special was it was that title
- 1:12:10definition of special aircraft jurisdiction special that'll be
- 1:12:16in foreign well there's a lot of them
- 1:12:19person person small hub aircraft limited definitions come
- 1:12:27on it's gone public aircraft person predatory nope
- 1:12:36there's nothing here united states air traffic well
- 1:12:43we're gonna search because it looks like it
- 1:12:48might be uh it might be it'd be
- 1:12:52really funny if it wasn't even uh wasn't
- 1:12:55even there anymore um it'd be real hilarious
- 1:13:01if it wasn't even part of it anymore
- 1:13:04if it wasn't even part of the general
- 1:13:06definitions uh but i can't find it so
- 1:13:12far um definitions 41 102 policy wow
- 1:13:23this is huge though these titles go on
- 1:13:25forever i'll have to look that up for
- 1:13:28you and figure out tomorrow whether or not
- 1:13:30the special well this is the last show
- 1:13:33of the week sadly but uh we have
- 1:13:36um aviation we have these definitions that they
- 1:13:40put in there uh that is just we're
- 1:13:45not able to get their definition of special
- 1:13:48aircraft jurisdiction we're not able to get to
- 1:13:52it and uh let's see let's find this
- 1:14:01and see if we can can get to
- 1:14:03it i think we can but i'm not
- 1:14:04in my legal research thing i'm just in
- 1:14:06regular i'll google right now so i'll have
- 1:14:09to look this up when i'm um federal
- 1:14:12jurisdiction for crimes aboard aircraft okay um so
- 1:14:18certain aircraft outside the u.s foreign aircraft
- 1:14:22that have their next scheduled destination blah blah
- 1:14:25blah special aircraft jurisdiction um yeah
- 1:14:35added july it's it's it's not there it's
- 1:14:40uh department of justice this it'd be really
- 1:14:44funny if it just isn't there it'd be
- 1:14:48freaking hilarious if that jurisdiction uh sentence just
- 1:14:52doesn't work anymore but i'm gonna have to
- 1:14:54look it up i apologize for my diatribe
- 1:14:57this morning on reading this uh this craziness
- 1:15:01of charging people with murder i'm very much
- 1:15:05against the use of the legal system as
- 1:15:09a joke right and uh we do it
- 1:15:12far too often all the crap creation and
- 1:15:15now what do they do they honor these
- 1:15:18a-holes they oh geez these are great
- 1:15:20lawyers no they're idiots and what they're doing
- 1:15:24is is really not lawyerly behavior okay if
- 1:15:31you have a valid reasonable argument to put
- 1:15:34something out there i expect you to but
- 1:15:38using the law as a as a freaking
- 1:15:42club to beat people over the head with
- 1:15:45i don't like that it it drives me
- 1:15:48crazy and uh and i just don't like
- 1:15:51it up any person could read i mean
- 1:15:54my first thing that i found there was
- 1:15:56um remember what this said uh where to
- 1:16:00go overview this section defines terms by uh
- 1:16:06you know you're likely looking the foundation definitions
- 1:16:10for section of aviation and transportation law in
- 1:16:1340 usc 102 which contains general property and
- 1:16:18administrative definitions right and these definitions navigable airspace
- 1:16:25stuff like that where they get to uh
- 1:16:28put the transportation sections in there let's see
- 1:16:35uh let's see if this one has the
- 1:16:38the interstate air transport mail medium public aircraft
- 1:16:44small hub state authority ticket aid they have
- 1:16:50all kinds of limited definitions here and i
- 1:16:55want to find here in find law i
- 1:16:59want to search the special what was it
- 1:17:05called again let's get to it the special
- 1:17:07aircraft jurisdiction is where i was darn it
- 1:17:16where'd my my pdf go let's see here
- 1:17:22all of these things i mean these are
- 1:17:27important uh destruction of the aircraft in violation
- 1:17:31of title 18 us code is where they
- 1:17:34are and given the definition of the destruction
- 1:17:40of the aircraft in violation of this special
- 1:17:44jurisdiction the special aircraft jurisdiction special maritime honor
- 1:17:53about february 24 in the special maritime and
- 1:17:57territorial jurisdiction of the united states right special
- 1:18:02maritime and territorial jurisdiction okay it's not maritime
- 1:18:06they weren't on the water the territorial jurisdiction
- 1:18:11of the u.s doesn't apply to castro
- 1:18:16arguably if this uh lorenzo alberto perez was
- 1:18:20flying in u.s airspace maybe you could
- 1:18:24get him but all this joke of a
- 1:18:26document is is to give these people something
- 1:18:30to say to show that they are doing
- 1:18:33something these people have higher aspirations and so
- 1:18:38they have to take these you know and
- 1:18:40and the people with money now know that
- 1:18:43these guys these guys will um will uh
- 1:18:49uh file anything you know we'll file anything
- 1:18:54right and uh the penalty sheets are listed
- 1:18:58all this stuff is listed for for all
- 1:19:01these people so if they've what they're trying
- 1:19:04to do is name these pilots even the
- 1:19:08ones that didn't kill anybody the ones that
- 1:19:10just flew and escorted they're going to name
- 1:19:12these guys with the conspiracy so that they
- 1:19:15can go and maybe one of them ran
- 1:19:17away to the united states got on a
- 1:19:19boat and got here so they got him
- 1:19:21and so they arrested him and they're they
- 1:19:23got him and his family and everybody trying
- 1:19:25to figure out how they can coax uh
- 1:19:28castro to show up in the united states
- 1:19:31or give his whereabouts or spy inside or
- 1:19:34whatever to find out where he is so
- 1:19:37they can do a maduro type raid in
- 1:19:39uh in cuba and arrest a guy and
- 1:19:42this is donald trump cleaning up the world
- 1:19:44this is us i i object i i
- 1:19:48object overruled i strenuously object remember that anyway
- 1:19:54that's a movie reference sorry i strenuously object
- 1:19:58oh great you know that helps i strenuously
- 1:20:00object so well stress yourself out there strain
- 1:20:05will you go ahead strain there do it
- 1:20:07again no it's overruled uh that's funny um
- 1:20:12at any rate i believe this is a
- 1:20:15joke law 101 for those of you who
- 1:20:18didn't go to law school and uh you
- 1:20:21know they they taught jurisdiction on the one
- 1:20:23day that you were absent um you got
- 1:20:26to be there uh and even if i
- 1:20:29went to australia and killed somebody they might
- 1:20:35be how they're going to get jurisdiction there's
- 1:20:38extradition there are all kinds of ways to
- 1:20:40submit yourself to the jurisdiction you commit a
- 1:20:43crime in you commit a felony drug felony
- 1:20:46in i don't know pick a state pick
- 1:20:49it pick it pick it let's come up
- 1:20:50with something uh reasonable like georgia you create
- 1:20:53a crime you commit a crime in georgia
- 1:20:55a felony okay and then you immediately leave
- 1:20:58the state so can the german or german
- 1:21:03georgian police come to your home in wyoming
- 1:21:09and arrest you nope they got no authority
- 1:21:14no the feds could for something else if
- 1:21:16they charge you with a federal crime but
- 1:21:18that's not what happened you know you have
- 1:21:19your you have your drug crime that you
- 1:21:21committed in whatever the feds can go anywhere
- 1:21:23pick you up the the end they just
- 1:21:25pick you up that's what they do it's
- 1:21:26what they live for uh selectively of course
- 1:21:30and if they want to heck they go
- 1:21:32to other countries and arrest you there and
- 1:21:35uh drag you back but they don't really
- 1:21:36have jurisdiction over you until you get back
- 1:21:39okay now arguably if you're on an american
- 1:21:41uh airplane somewhere else there's probably limit you
- 1:21:47know limitations or extensions of authority with a
- 1:21:52u.s air person on a u.s
- 1:21:55aircraft but if you're on turkish airways i
- 1:21:59wonder when they take uh they take effect
- 1:22:01there do they take effect inside of uh
- 1:22:04the aircraft or is it when you cross
- 1:22:10into u.s airspace i'm not sure how
- 1:22:12that works maybe it's only in the airport
- 1:22:14i haven't read that i haven't studied that
- 1:22:15what i'm saying though is you cannot create
- 1:22:19jurisdiction that doesn't exist you just can't do
- 1:22:24it and so jurisdiction that doesn't exist you
- 1:22:28can't you can't cure bad um bad jurisdiction
- 1:22:34doesn't work a lack of jurisdiction is attackable
- 1:22:40any time if you don't have jurisdiction the
- 1:22:43first thing first thing that should be done
- 1:22:45is maybe see but if you hire a
- 1:22:47lawyer that lawyer has to limit because if
- 1:22:50a lawyer appears on your behalf to fight
- 1:22:53something they say you've submitted to the jurisdiction
- 1:22:56of the court just to make an argument
- 1:22:58so you got to limit the jurisdiction at
- 1:23:00the very beginning you say listen i want
- 1:23:02to um enter appearance for this guy only
- 1:23:06to fight jurisdiction and talk about the jurisdiction
- 1:23:10issue but i want to enter appearance on
- 1:23:13this guy uh you know or i want
- 1:23:16you know get a charitable organization to fight
- 1:23:20the jurisdiction in fact i have a charitable
- 1:23:22organization i had to hire a lawyer for
- 1:23:25castro just to go fight these guys um
- 1:23:29just to go how you getting jurisdiction let's
- 1:23:32have a fight over jurisdiction for maduro you
- 1:23:36can't take it the way that you've taken
- 1:23:38it and i wonder if anybody is really
- 1:23:40defending the guy or if you know well
- 1:23:43jeez look what they've done that's what the
- 1:23:45lawyers are saying look what they've done what
- 1:23:48a horrible fight what would be going against
- 1:23:50the entire group of people everybody hates castro
- 1:23:53who's going to defend defend him nobody nobody's
- 1:23:57going to defend him and that's the shame
- 1:23:59of our system right there the shame is
- 1:24:02it ain't about the law anymore it's about
- 1:24:05a system that doesn't exist and that they
- 1:24:08they use as a club and the people
- 1:24:12who are in it are part of a
- 1:24:14club that the that the clubbers are using
- 1:24:18the club the legal club to fight the
- 1:24:22people who would stand up for it like
- 1:24:25me by the way because i am not
- 1:24:27a member of the club that just buries
- 1:24:30my head in the sand to say that
- 1:24:32oh gee jurisdiction exists my ass jurisdiction doesn't
- 1:24:37exist and you aren't that stupid or that
- 1:24:40far gone that you think it does these
- 1:24:43uh whoever these uh a-holes are that
- 1:24:46signed this joke of a pleading you know
- 1:24:50this joke of an indictment and then you
- 1:24:53know why they really want the record sealed
- 1:24:55because they're creating a bs scenario that they
- 1:24:59don't want any yahoo to just be able
- 1:25:02to log on and pull down maybe that
- 1:25:05would be the fun part would be to
- 1:25:06send a request uh a freedom of information
- 1:25:11request or a court request can say hey
- 1:25:14i want these documents can you provide them
- 1:25:16please why can't i have them if you're
- 1:25:20not willing to give them up you know
- 1:25:22oh gee we have security measures in place
