- 0:00Enforcement is
- 0:01the most
- 0:01underrated
- 0:02ocean tool.
- 0:03You can declare
- 0:04an ocean
- 0:05protected in a
- 0:06single afternoon,
- 0:07but what you
- 0:08can't do is
- 0:08protect it
- 0:09without
- 0:09showing up.
- 0:11Rules without enforcement are
- 0:13just suggestions.
- 0:14This is the How
- 0:15to Protect the
- 0:15Ocean podcast,
- 0:16your weekday
- 0:16ocean
- 0:17news update.
- 0:18If you care about
- 0:19staying informed
- 0:20on the ocean
- 0:21every weekday,
- 0:22hit that follow
- 0:23button right now
- 0:24so you don't miss
- 0:24tomorrow's story.
- 0:26This week, we're
- 0:27gonna be talking
- 0:27a lot about
- 0:28enforcement
- 0:29and action, and
- 0:30so every episode
- 0:31this week
- 0:32is gonna be
- 0:32themed
- 0:33around that,
- 0:34so you don't
- 0:34wanna miss this.
- 0:36Marine protected
- 0:36areas with
- 0:37adequate
- 0:37staffing,
- 0:38monitoring, and
- 0:39compliance
- 0:40systems
- 0:40consistently show
- 0:41dramatically
- 0:42better ecological
- 0:43outcomes
- 0:44than those
- 0:45without
- 0:46enforcement
- 0:46capacity.
- 0:48The difference
- 0:48between success
- 0:49and failure
- 0:50is not the
- 0:50boundary.
- 0:51It is the budget.
- 0:52It is the
- 0:53patrol boat.
- 0:54It is the
- 0:54presence.
- 0:55This is gonna be
- 0:56a breakdown
- 0:57of what makes a
- 0:58marine protected
- 0:59area work.
- 1:00Last week, we
- 1:00talked about
- 1:01marine
- 1:01protected areas
- 1:02and what they are
- 1:03as paper parks
- 1:03and how useless
- 1:04they are.
- 1:05Today, we're
- 1:05gonna be
- 1:06focusing on
- 1:07what actually
- 1:07makes an
- 1:07MPA work.
- 1:08What actually is
- 1:09the key to saving
- 1:11the ocean?
- 1:13So the key
- 1:13question here is,
- 1:14why does
- 1:14enforcement
- 1:15predict
- 1:15ecological
- 1:16success
- 1:17better than the
- 1:18designation
- 1:18alone?
- 1:19Let's start
- 1:20looking at the
- 1:21enforcement
- 1:21gap here.
- 1:22So over 18,000
- 1:23MPAs exist
- 1:24globally, right?
- 1:25We talked about
- 1:25that last week.
- 1:27Coverage has
- 1:27expanded rapidly
- 1:29in the
- 1:29past decade,
- 1:30but enforcement
- 1:31capacity varies dramatically
- 1:32between regions.
- 1:33That's what we
- 1:34talked about with
- 1:34the paper parks.
- 1:36Many countries
- 1:36designate large
- 1:37offshore MPAs
- 1:38without
- 1:39increasing patrol
- 1:40budgets.
- 1:42Imagine any type
- 1:43of area in the
- 1:45ocean, especially
- 1:46offshore where
- 1:47you can't really
- 1:48see the coastline
- 1:49from that area.
- 1:50Imagine having
- 1:50one patrol boat
- 1:51to patrol that
- 1:53huge area.
- 1:53Papahana Makua
- 1:54Kia, for
- 1:55instance, that is
- 1:56a huge area
- 1:57to patrol.
- 1:58If you only have
- 1:59one patrol boat,
- 2:00you're never
- 2:00gonna be able to
- 2:01enforce the law
- 2:02because if
- 2:03anybody wants to
- 2:04fish in there
- 2:04illegally,
- 2:04they can do so
- 2:05without
- 2:06being caught,
- 2:06unless it's by
- 2:07satellite, unless
- 2:08they have their
- 2:08AIS or their GPS
- 2:09turned on
- 2:10and they're known
- 2:10to be in
- 2:11that area.
- 2:13But without the
- 2:14patrol boats,
- 2:14you're really not
- 2:15gonna be
- 2:15able to see it
- 2:16and attempt to
- 2:17attack or capture
- 2:20these boats to
- 2:21prevent them from
- 2:22doing it.
- 2:23A protected
- 2:24boundary on a map
- 2:25does not
- 2:26automatically
- 2:26change
- 2:27behavior at sea.
- 2:28Just because
- 2:29there's a
- 2:29protection
- 2:29doesn't mean that
- 2:30people aren't
- 2:30gonna go
- 2:31in and fish.
- 2:32So there was a
- 2:33study by Gail et
- 2:34al in 2017
- 2:35in nature,
- 2:36and they found
- 2:37that most MPAs
- 2:38suffer from a
- 2:38major shortfalls
- 2:39in staffing and
- 2:41funding.
- 2:42On average, many
- 2:43MPAs operate with
- 2:45less than half
- 2:46the recommended
- 2:46staffing levels.
- 2:48Enforcement
- 2:48capacity explains
- 2:49more variance in
- 2:50ecological
- 2:51outcomes than the
- 2:52size alone.
- 2:54That's how
- 2:54important
- 2:55enforcement is.
- 2:56Protection
- 2:56without presence
- 2:57invites
- 2:58non-compliance.
- 3:00So here's what
- 3:00the data shows
- 3:01about the
- 3:02staffing.
- 3:03So in these key
- 3:04findings from
- 3:05Gail et al in
- 3:062017 in nature,
- 3:08MPAs with
- 3:09adequate staff
- 3:10had significantly
- 3:11higher fish
- 3:12biomass.
- 3:13Sites with high
- 3:14staff capacity
- 3:15had biomass up to
- 3:17three times
- 3:18higher than the
- 3:19low
- 3:19capacity sites.
- 3:21Staffing and
- 3:21budget were
- 3:22stronger
- 3:22predictors of
- 3:24success than the
- 3:24actual area size.
- 3:26So imagine having
- 3:26just a small
- 3:27area, but you can
- 3:28patrol it better.
- 3:29The quality of
- 3:29that area is
- 3:30gonna be a lot
- 3:30better than the
- 3:31bigger area that
- 3:31you can't patrol
- 3:33because that
- 3:33means you are
- 3:33actually
- 3:34enforcing
- 3:34the area.
- 3:35You were saying
- 3:36to people, hey,
- 3:36we're
- 3:37gonna find you.
- 3:38Even if it's a
- 3:39small area, we're
- 3:39gonna protect
- 3:40this area because
- 3:40it's better than
- 3:41having just
- 3:42quantities,
- 3:43better than
- 3:43having just a
- 3:44bigger size.
- 3:45So instead of
- 3:45saying, hey, the
- 3:46bigger the MPA,
- 3:46the better we're
- 3:47gonna be able to
- 3:48have success.
- 3:49No, the smaller
- 3:50the, really it's
- 3:51the
- 3:51enforcement size.
- 3:52So the better the
- 3:53staffing and the
- 3:53funding for that
- 3:54staffing and the
- 3:55number of
- 3:55patrol boats,
- 3:56the better you're
- 3:57gonna have
- 3:57success.
- 3:58Doesn't matter
- 3:58the area.
- 4:00That's what it
- 4:00really
- 4:00comes out to.
- 4:02Size matters less
- 4:03than enforcement
- 4:03intensity.
- 4:04That's what it
- 4:05comes down to.
- 4:06So let's get into
- 4:07the funding
- 4:07mechanisms of
- 4:08everything.
- 4:10Stable line items
- 4:10and national
- 4:11budgets.
- 4:11So that's the
- 4:12line item that
- 4:13allots the
- 4:13number, the
- 4:14amount of money
- 4:15that goes towards
- 4:16these enforcement
- 4:18productions and
- 4:19staffing.
- 4:20Allow managers to
- 4:21plan long-term
- 4:23patrols and
- 4:24monitoring.
- 4:25So a strong
- 4:26examples of the
- 4:27Papahana Makua
- 4:28Kia monument or
- 4:29Marine National
- 4:30Monument
- 4:30in Hawaii.
- 4:31So it's managed
- 4:32by the National
- 4:33Oceanographic and
- 4:34Atmospheric
- 4:35Administration,
- 4:36NOAA, and the
- 4:37state of Hawaii.
- 4:38It receives
- 4:38federal funding
- 4:39that supports
- 4:40enforcement
- 4:41vessels, research
- 4:42expeditions, and
- 4:43operational
- 4:44continuity.
- 4:45So this monument
- 4:46is not just
- 4:47declared
- 4:47protected.
- 4:48It has officers,
- 4:49it has vessels,
- 4:50and it has the
- 4:51presence
- 4:51necessary to
- 4:53enforce the
- 4:53protections that
- 4:54are guaranteed
- 4:55within Papahana
- 4:56Makua Kia
- 4:57National, Marine
- 4:58National
- 4:58Monument.
- 4:59When governments
- 5:00actually commit
- 5:01real budget
- 5:01lines,
- 5:02enforcement
- 5:03actually happens.
- 5:05Now we look at
- 5:06tourism revenue
- 5:06and reinvestment
- 5:07for funding.
- 5:08Some MPAs fund
- 5:09themselves
- 5:10through visitors
- 5:11and like visitor
- 5:12fees and dive
- 5:12permits.
- 5:13I've gone diving
- 5:14in marine
- 5:14protected areas
- 5:15off of Costa San
- 5:16Martin, where you
- 5:17were actually
- 5:17allowed to dive,
- 5:18but you had to
- 5:19pay a
- 5:20certain amount.
- 5:21A little bit more
- 5:21than you would
- 5:21normally pay.
- 5:23And we were okay
- 5:23with that.
- 5:24At Bonaire
- 5:25National Marine
- 5:25Park, they even
- 5:26have divers
- 5:27purchase a Marine
- 5:28Park tag.
- 5:29That revenue
- 5:29directly supports
- 5:30reef monitoring,
- 5:31reef buoy
- 5:32maintenance, and enforcement.
- 5:33So healthy
- 5:34ecosystems
- 5:35attract visitors,
- 5:36visitor revenue
- 5:37funds protection,
- 5:38protection
- 5:39maintains
- 5:39ecosystem health.
- 5:41It is a
- 5:42reinforcing
- 5:42cycle.
- 5:44Now there's also
- 5:44NGO co-management
- 5:45systems for
- 5:46funding.
- 5:47So government
- 5:47agencies often
- 5:48lack sufficient
- 5:49technical or
- 5:50financial
- 5:51capacity alone.
- 5:52At Cabo Palmo
- 5:53National Park in
- 5:54Mexico, the local
- 5:55community worked
- 5:56with NGOs and
- 5:57federal
- 5:58authorities after
- 5:59fishing ended in
- 6:00the mid-1990s.
- 6:00Scientific
- 6:02monitoring
- 6:02supported
- 6:03adaptive
- 6:03management,
- 6:04community
- 6:04enforcement
- 6:05increased
- 6:05compliance.
- 6:06Within a decade,
- 6:07fish biomass
- 6:08increased by more
- 6:08than 400%.
- 6:11Community plus
- 6:11NGO involvement
- 6:13increases
- 6:13ecological
- 6:14results and
- 6:15political
- 6:15durability.
- 6:17Now long-term
- 6:17budget guarantees
- 6:18also help.
- 6:19So multi-year
- 6:19funding allows
- 6:20strategic
- 6:20planning instead
- 6:21of reactive
- 6:22crisis
- 6:22management.
- 6:23The Great Barrier
- 6:24Reef Marine Park
- 6:25is supported by
- 6:25federal
- 6:26allocations and
- 6:27reef trust investments,
- 6:27enabling
- 6:28continuous
- 6:29monitoring of
- 6:30coral cover,
- 6:31water quality,
- 6:31and fish biomass.
- 6:33Long-term funding
- 6:34creates long-term
- 6:35data sets.
- 6:36Long-term data
- 6:37sets creates
- 6:37accountability.
- 6:39Having that
- 6:40long-term funding
- 6:41is really going
- 6:42to help the
- 6:42long-term success
- 6:43of the Marine
- 6:44protected area.
- 6:45What happens when
- 6:46funding is
- 6:47unstable?
- 6:48So then you get
- 6:49patrol
- 6:49interruptions.
- 6:50In the last few years, in several
- 6:51West African
- 6:51coastal MPAs,
- 6:53patrol vessels
- 6:53lack the fuel
- 6:54budgets.
- 6:55It costs a lot of
- 6:56money to get
- 6:57boats on the
- 6:57water and be able
- 6:58to work
- 6:58all the time.
- 6:59When boats remain
- 7:00docked, illegal
- 7:00trawlers enter
- 7:01the protected
- 7:02areas, even short
- 7:03enforcement gaps
- 7:03can create
- 7:04opportunities for
- 7:05intrusion.
- 7:05These illegal
- 7:07fishers are not
- 7:07messing around.
- 7:08They will wait
- 7:09patiently
- 7:10out at sea.
- 7:11They have the
- 7:11money to be able
- 7:12to wait
- 7:13patiently at sea.
- 7:14Once those
- 7:14enforcement
- 7:15patrol boats go
- 7:15back in, they
- 7:16will come in and
- 7:17they will
- 7:17illegally fish as
- 7:18fast as they can.
- 7:20You also have
- 7:21monitoring gaps.
- 7:22You also have monitoring gaps.
- 7:22In parts of South
- 7:23Asia, if you
- 7:24don't have
- 7:24funded, donor
- 7:25funded monitoring
- 7:26programs collapse
- 7:27when grants end.
- 7:29Grants always
- 7:29have an end date
- 7:30to their funding.
- 7:31Although it's
- 7:32great, we've seen
- 7:32long-term data
- 7:33sets be really
- 7:34great, but you
- 7:35see data gaps in
- 7:37those long-term
- 7:38data sets.
- 7:38Because funding
- 7:39has run out or it
- 7:41came to the end
- 7:43of its period of funding.
- 7:44The people who
- 7:46are doing it are
- 7:47trying to get
- 7:47more funding.
- 7:48Sometimes you
- 7:48can't get the
- 7:49funding depending
- 7:49on how the
- 7:50economy is going
- 7:51and what the
- 7:51granting
- 7:52priorities are at
- 7:53that point from
- 7:54that foundation
- 7:54or many
- 7:55foundations.
- 7:57Data continuity
- 7:57breaks make it
- 8:00impossible to
- 8:01measure recovery.
- 8:02Without
- 8:02consistent
- 8:03monitoring,
- 8:03protection cannot
- 8:04be evaluated.
- 8:06You have loss of
- 8:08community trust
- 8:08when you don't
- 8:09have the proper
- 8:10funding.
- 8:10In some
- 8:11Mediterranean
- 8:11MPAs, uneven
- 8:12enforcement has
- 8:13undermined local
- 8:14confidence.
- 8:15Small-scale
- 8:15fishers have
- 8:16reported stricter
- 8:17enforcement
- 8:18against them than
- 8:19industrial
- 8:20fleets, which
- 8:21face weaker
- 8:22oversight.
- 8:23So when these
- 8:23rules appear
- 8:25inconsistently
- 8:26applied,
- 8:26voluntary
- 8:27compliance
- 8:28declines.
- 8:28So if you have a
- 8:30small-time
- 8:31fisher,
- 8:31small-scale
- 8:32fisher, who's
- 8:33just fishing for
- 8:33his local area
- 8:34and trying to
- 8:35make money for
- 8:35his family,
- 8:36if those are
- 8:37stricter because
- 8:37they're easier to
- 8:38enforce, then
- 8:39that's not going
- 8:40to really help
- 8:41while the bigger
- 8:42companies are
- 8:43coming and
- 8:43probably getting
- 8:43more fish
- 8:44affecting the
- 8:45capacity of the
- 8:47small-scale
- 8:47fishers to be
- 8:48able to get fish
- 8:49in the future.
- 8:50These industrial
- 8:50places, the
- 8:51companies are
- 8:52just coming in
- 8:52and doing
- 8:53whatever and they
- 8:53will not get
- 8:54prosecuted.
- 8:55Maybe because
- 8:55they have more
- 8:55money and the
- 8:56funding is not
- 8:56enough to pay for
- 8:57the court fees,
- 8:58who knows what that would happen.
- 9:00So trust is
- 9:03essential to
- 9:03enforcement. Once
- 9:04lost, it is
- 9:05difficult to
- 9:06rebuild.
- 9:07Now, if you want
- 9:08this type of real
- 9:09ocean protection
- 9:09stories backed by
- 9:11science, follow
- 9:12this show
- 9:12right now.
- 9:13Hit that follow
- 9:13button so you
- 9:14don't miss
- 9:15tomorrow's
- 9:15episode.
- 9:17So here is the
- 9:17final word on all
- 9:19of this.
- 9:19Enforcement is
- 9:20not optional when
- 9:21we're talking
- 9:21about marine
- 9:22protected areas.
- 9:23It is the
- 9:23mechanism that
- 9:24turns policy into
- 9:25ecological
- 9:26recovery.
- 9:26MPAs are
- 9:27necessity. They
- 9:28are crucial. They
- 9:29are critical to
- 9:30making sure that
- 9:31we are protecting
- 9:32the ocean, the
- 9:34most important
- 9:35parts of
- 9:36the ocean.
- 9:37Thirty percent of
- 9:37the ocean can be
- 9:38protected, but it
- 9:39has to be
- 9:39enforced.
- 9:41Fish do not
- 9:42recover because a
- 9:43law was passed.
- 9:44They recover
- 9:44because
- 9:45extraction stops.
- 9:46The science is
- 9:48consistent across
- 9:49ecosystems and
- 9:49continents. When
- 9:51enforcement is
- 9:51strong, biomass
- 9:52increases. When
- 9:53enforcement is
- 9:54weak, paper
- 9:55park fails.
- 9:56That's really
- 9:57what it comes
- 9:57down to.
- 9:58Governments can
- 9:58announce
- 9:59protections all
- 9:59day in a press
- 10:00conference, but
- 10:01ecosystems
- 10:01respond to only
- 10:03what happens on
- 10:04the water.
- 10:04Protection works
- 10:05when it's real.
- 10:07That's really the
- 10:07lesson today.
- 10:08Enforcement is
- 10:10absolutely
- 10:10critical on the
- 10:12water in marine
- 10:13protected areas.
- 10:14It is very
- 10:14difficult to get
- 10:15protection across
- 10:16different marine
- 10:18protected areas
- 10:19or outside of
- 10:20marine protected
- 10:20areas, but those
- 10:21boundaries that
- 10:21are designated by
- 10:22law should be
- 10:23enforced by law.
- 10:25That's really
