- 0:00Speaker 1: This article is from Abcnews dot Go dot com. The
- 0:04author of the article is James Hill.
- 0:06Speaker 2: Headline.
- 0:08Speaker 1: Survivor's attorney accuses Epstein a state of attempts to stonewall lawsuit.
- 0:14An attorney for a woman who claims to be the
- 0:16first known child sex abuse survivor of Jeffrey Epstein and
- 0:20Elaine Maxwell is accusing the legal team representing Epstein's estate
- 0:24of withholding evidence and attempting to prevent the testimony of
- 0:28a key witness. According to a letter sent to the
- 0:31judge overseeing her lawsuit on Wednesday, that should chuck nobody.
- 0:36Like I just said in the opening statement, Darren Endyke
- 0:40and con both should be nowhere near this case. And
- 0:44I have a funny feeling that if prosecution pursues this
- 0:48case the way that they should, in a very robust
- 0:52and aggressive manner, then they could add they'd have no
- 0:56other choice but to bring Indike in as well for questioning.
- 1:00At the very least under oath. This man was involved
- 1:05in all sorts of financial transactions for Epstein and the
- 1:09rest of these morons, so he was facilitating a money
- 1:14laundering ring. How is he still part of the estate,
- 1:21How is he acting as an executor. This behavior flies
- 1:27in the face of fairness, professionalism, and much needed justice,
- 1:31wrote Robert Glassman, the lawyer for the accuser who filed
- 1:35the suit under the pseudonym Jane Doe. According to the letter,
- 1:39attorneys for the estate have failed to turn over a
- 1:41single page of evidence in the three months since being
- 1:44served with pre trial requests. That's what they've done from
- 1:48the beginning in this case, when it comes to Jeffrey
- 1:51Epstein and the people that are in his circle or
- 1:55were in his circle, they have attempted to delay, they
- 1:59have attempted to muddy the waters, and they have attempted
- 2:02to drag their feet every single step of the way.
- 2:08And you see that same strategy continuing here, and they're
- 2:11attempting to get away with it again. Let's hope that
- 2:15they get a taste of reality. Like their good friend
- 2:17Gilaine did. The estate miss to previously agreed upon deadline
- 2:24to begin producing documents in the possession of the estate
- 2:27that contained Doe's name and information, Glassman wrote, and heclaimed
- 2:31they abruptly called off a scheduled deposition of Darren Endyke,
- 2:35one of the estates co executors and a longtime lawyer
- 2:38for Epstein and his affiliated companies more than that friend confidant,
- 2:45not somebody that just has a business relationship with him,
- 2:49just a working relationship. As much as I think Epstein
- 2:52is the scum of the earth, I believe that everybody
- 2:55is entitled to legal defense, right, but this went way
- 2:59beyond that. This is a man who was facilitating things
- 3:02for Jeffrey Epstein by participating in the financial crimes. The
- 3:11estate is engaging in obstructionist litigation tactics intended to stonewall
- 3:16and deprive Jane Doe of plainly relevant discovery. Glassman wrote
- 3:20in asking for a conference with the court, it is
- 3:24clear that absent court intervention, the Epstein estate will not
- 3:27comply with its basic discovery obligations. And again that's part
- 3:33for the course with these people. They will try and
- 3:36do whatever they can to make sure that this goes
- 3:39all the way down to the eleventh hour. They don't
- 3:43want a timely trial, they don't want to produce discovery
- 3:47because then their scummy ass clients will have to answer
- 3:50for their behavior. So let's drag our feet a little bit,
- 3:55Let's wait longer, let's ask for a delay, all in
- 3:59hopes that they can somehow either a find a loophole
- 4:02or b find somebody to help them wiggle off the hook.
- 4:10Doe has already turned over more than one hundred and
- 4:12ninety pages of documents to the estate earlier this month,
- 4:15according to the letter, but balked at the estate's request
- 4:18for what Glassman called largely irrelevant and quite frankly outrageous
- 4:23information from Doe. Glassman claimed that among the requests were
- 4:30documents referencing any and all medical procedures and consultations she
- 4:35has ever had throughout her lifetime, including while she was
- 4:38a minor, even if such medical care was unrelated to
- 4:42Jeffrey Epstein's alleged abuse of her. This is what happens
- 4:47when you have a guy like Darren and Dyke and
- 4:49you have con in there, Okay, Indyke especially, this guy's
- 4:54no better than the rest of this criminal organization. In fact,
- 4:57he's right up there with the core four right underneath them,
- 4:59in my opinion, in the command structure, and in fact,
- 5:02in some other ways, this man would basically be the CONSIGLIERI.
- 5:07If we want to continue with our mob talk, obviously
- 5:10that's what you would have to talk about. This guy
- 5:12as right, something like that, Jeffrey Epstein's question, Guy, Hey
- 5:15can I do this?
- 5:16Speaker 2: What should we do about that?
- 5:17Speaker 1: Hey? Can I get some advice on this legal issue?
- 5:20And it was up to Indyke to find out how
- 5:22to finesse all of that. It was up to Indyke
- 5:24to find out how to facilitate all of that, and
- 5:29for him participating in Jeffrey Epstein's crimes. For that reason,
- 5:34Darren Endyke must be subpoenaed, must testify, and must be questioned.
- 5:44Bennett Moskowitz, a lawyer for Indyke and Richard Kahn, the
- 5:48estate's co executors, declined to comment on the allegations raised
- 5:51by Glassman's by Glassman when reached Wednesday by ABC News.
- 5:56Speaker 2: And that's just telling right there alone.
- 5:57Speaker 1: The executors of the estate had to go out and
- 6:00lawyer up themselves because there's such dirt bags that they
- 6:04know the slap back from the rubber band is on
- 6:08its way to crack them. These people are gross disgusting.
- 6:16Speaker 2: Almost not even human.
- 6:22Speaker 1: But in a response filed in court Thursday, and a
- 6:24state attorney called Glassman's letter very premature and a misrepresentation
- 6:29of what had occurred. Of course, it's always a misrepresentation.
- 6:32Oh no, no, that's not what mister you know what
- 6:35we thought here, mister Kahn thought, here, what mister Endyke
- 6:38thought here. No, it's not okay, it is not a misrepresentation.
- 6:47These executors in this estate have made a habit of
- 6:51not turning over documentation when required, of making the judge
- 6:54force their hand and dragging their feet the whole way.
- 7:04The estate claims that indikex deposition was taken off the
- 7:07calendar to allow time for Maxwell's lawyer, who had just
- 7:10entered the case, to confer with all parties about setting
- 7:13new schedules and contend and contended that the production of
- 7:17documents in their possession was being held up only because
- 7:21Doe's lawyers had yet to agree to a confidentiality order,
- 7:25which must occur before we produce documents that referred to Doe,
- 7:29who filed this case anonymously by her real name. And
- 7:33I think that's something that's pretty important that's buried in
- 7:36that paragraph is the fact that the estate claims that
- 7:40Indyke's deposition was taken off the calendar to allow time
- 7:43for Maxwell's lawyer, who had just entered the case entered
- 7:47the case. Why was why is Maxwell's lawyer in the case,
- 7:50Maybe because of the suit that she was going to
- 7:52bring against the estate for them to pay for her
- 7:55or is Maxwell's lawyer just pilfering around hoping to get
- 8:00information to help with her defense. Every single door must
- 8:05be kicked in, every rock turned over, and every tree
- 8:13must be given a good shake when it comes to
- 8:15this case. That is for missus, That is for Doe's benefit,
- 8:22wrote a state lawyer, Mary Grace Metcalf. Glassman told ABC
- 8:26News Thursday that he hadn't agreed to delaying Indyke's deposition
- 8:29and that he sees no need for a confidentiality agreement
- 8:33to predict the identity of his client because there is
- 8:36a prior court order which deals with that. And again,
- 8:39that's what they're trying to do. They'll try and make
- 8:41these assertions right when they know clearly they're not in
- 8:44the right, and they'll force the judge to decide. That way,
- 8:48they buy themselves more time, they can solidify their defenses,
- 8:52and they can be involved in whatever sort of sordid
- 8:54activities they think are going to help them behind the scenes.
- 9:00We're interested in taking this case to trial and getting
- 9:03the evidence that we need in order to prepare the
- 9:05case for that time, Glassman said, And it appears that
- 9:09they're more interested in sitting in their offices, writing letters
- 9:12and objecting to everything that we're trying to do. Glassman
- 9:15just fired them up right here with that statement. He
- 9:20just told the estate that he is ready to go
- 9:22to trial and bring this before a jury. That is
- 9:25the absolute worst thing for Jeffrey Epstein's associates, the worst
- 9:31thing for his estate, and it most certainly is not
- 9:34going to be a good situation for Indiker Khan. Can
- 9:37you imagine getting that Jerry summons and sitting on that
- 9:40jury pool and learning all of this stuff that we know,
- 9:44just the circumstantial stuff that we're privy to. Imagine you
- 9:48compound that with what the Feds already know, with the
- 9:51case that they're building, and you're sitting on the jury.
- 9:56Forget it. These dudes are in big trouble. They better
- 9:59figure this out, and they better appease these survivors. Lawyers
- 10:04for the estate have previously asked the court to dismiss
- 10:06some of Doe's claims as beyond the statue of limitations.
- 10:11The lawyers for the co executors have also encouraged Doe
- 10:14to participate in an alternative resolution program established by the
- 10:18Epstein Estate, which launched last month after protracted delays. Yeah,
- 10:23of course. Like I said, they do not want Discovery,
- 10:28no matter what they say. This includes Alan Dershowitz. This
- 10:32includes Prince Andrew, This includes George Mitchell, This includes Bill Richardson,
- 10:38This includes Glenn Dubin. This includes Lex Wexner. None of
- 10:43these people want Discovery because that is where the rubber
- 10:47meets the road. Do you think it's a coincidence that
- 10:50Glaine Maxwell settled out of court before Discovery with Virginia.
- 10:56Speaker 2: Of course it wasn't.
- 10:57Speaker 1: They all understand the stakes and they understand that if
- 11:00they go to Discovery it is absolute hammer time. The
- 11:08details in Doe's lawsuit, which was filed in January against
- 11:11the Epstein Estate and Maxwell, are substantially similar to the
- 11:15allegations pertaining to one of the three minor survivors included
- 11:19in the federal charges against Maxwell, who is accused in
- 11:22a six count indictment of assisting, facilitating, and contributing to
- 11:28Epstein's alleged abuse of three minor girls between nineteen ninety
- 11:32four and nineteen ninety seven this is significant as well.
- 11:36So if the claims are as similar as they appear
- 11:41to be, not only is Jane Doe spearheading, along with Annie,
- 11:48the criminal portion of Gulay Maxwell's downfall, she is now
- 11:53hammering their estate as well. So, Jane Doe, if you're
- 11:57listening to this podcast, by any off chance, good for you.
- 12:01Way to stand up for yourself and go for the throat.
- 12:05Get it all, whatever you can get out of these people.
- 12:08Speaker 2: You have earned it. Get it all.
- 12:13Speaker 1: Jane Doe is their first known victim and subsequently abused
- 12:16by Epstein and Maxwell for years as a young girl,
- 12:19suffering unimaginable physical and psychological trauma and distress. Her complaints said,
- 12:25I can only imagine. I can only imagine. And for
- 12:28people who act like, oh, it's about the money, the
- 12:31money is a small little part of what these girls
- 12:34are owed by these scumbags and society as a whole,
- 12:37if you want the truth of it, because all of us,
- 12:40me included, everybody who ignored this story when it was
- 12:44happening originally, well, I mean really, and to ignore it
- 12:51after you know about what has occurred, I can't even imagine.
- 12:55But what Jane Doe suffered at the hands of these
- 12:58people for years. Of course, she deserves whatever sort of
- 13:03compensation is coming her way. I hope it is seven
- 13:08figures for all of these girls, every last one of them.
- 13:11And I hope that the estate is left penniless when
- 13:14it's all said and done. Maxwell pleaded not guilty to
- 13:18the charges out of hearing earlier this week and was
- 13:21ordered held without bail pending trial Inly, pending trial in
- 13:25July twenty twenty one. That trial data set for July twelfth,
- 13:29twenty twenty one, a week after Maxwell's July second arrest
- 13:33in New Hampshire. Her attorney filed an answer to Doe's
- 13:36lawsuit denying the claims, while also noting the overlap between
- 13:40the lawsuit and the criminal case against Maxwell in New York.
- 13:44And now, remember the other case in Presca's court was
- 13:51also delayed for a while, so there was things going
- 13:55on behind the scenes that we weren't privy to. But
- 13:59when Maxwell got the case delayed and it was pushed
- 14:04back because of the criminal case, that is when you
- 14:07really knew the writing was on the wall and that
- 14:10Maxwell and the co conspirators were about to get got
- 14:16and the rumbling started.
- 14:19Speaker 2: A few weeks before the.
- 14:21Speaker 1: Arrest, but they were there. There were some clear signs
- 14:23that something was occurring. Miss Maxwell's denials of factual allegations
- 14:30in Endo's lawsuit shall be interpreted the same as pleading
- 14:34not guilty to the various counts in any criminal indictment,
- 14:37wrote Laura Meninger, a lawyer who has represented Maxwell in
- 14:41civil litigation for five years. And Laura Manager has been
- 14:45trying to run that same kind of story with Gilaine
- 14:48Maxwell since the beginning, right, and she has been unsuccessful
- 14:56in her pleading with the court for the most part.
- 15:00So I am not shocked to see that Gilaine Maxwell
- 15:04added a couple of high profile lawyers to help steer
- 15:07her clear of the charges. Hopefully in her mind right,
- 15:12she wants the best lawyers possible, and that's why they
- 15:14brought in Everdell and Cohen because Manager, well, she seems
- 15:20to be like to be a lawyer that mainly deals
- 15:23with civil litigation and not such high profile cases. But
- 15:28I do believe she is taking part as part of
- 15:30the team in the criminal defense as well. As you know,
- 15:34when you're facing a federal indictment such as Gilaine Maxwell is,
- 15:37and you have the means you usually have a pretty
- 15:40big team of lawyers working on your case. So I
- 15:43would not be shocked to see menager with a pretty
- 15:45prominent position. But of course she won't be the one
- 15:49that is the trial attorney, right, She won't be the
- 15:52one that is.
- 15:53Speaker 2: Going in there and arguing it out at the trial.
- 15:59Speaker 1: According to dose civil complaint, she first met Maxwell and
- 16:02Epstein in nineteen ninety four and as a thirteen year
- 16:05old student at a music camp in Michigan. A month's
- 16:08long grooming process continued, she alleges after she returned home
- 16:12to Florida, where Epstein had a seaside estate on Palm
- 16:15Beach Island. Doe's father had recently passed away, the complaint said,
- 16:20creating an opportunity for Epstein and Maxwell.
- 16:23Speaker 2: To fill the void. How often have we heard this story? Huh?
- 16:26Speaker 1: How many times have Gilain Maxwell and Jeffrey Epstein and
- 16:30the rest of their disgusting ass co conspirators preyed upon
- 16:35somebody from a disadvantaged home, somebody from a broken home
- 16:40due to, like here, a death in the family, or
- 16:43parents who have their own problems with drugs or alcohol.
- 16:46How many times have we seen it? And it is
- 16:48them o that they used continuously over and over and
- 16:54over again, and it is absolutely obscene. Epstein gave himself
- 17:03the name of Doe's godfather, while Maxwell acted like an
- 17:06older sister to her. Her complaints said, they took her
- 17:08to the movies, went shopping with her, and lounged around
- 17:11Epstein's estate with her. That's part of the grooming process
- 17:15for those of you out there that might not understand
- 17:17how that occurs. They're looking to get her to feel comfortable,
- 17:20to feel safe around them, and then to normalize their behavior,
- 17:24and they were very good at that. When you have
- 17:27people that are naive, and most people at that age are,
- 17:31and you have somebody like Elaine Maxwell that comes in
- 17:34and offers comfort to these young girls, they never thought
- 17:36in their wildest dreams that this well thought, i mean,
- 17:39this well spoken, prim and proper lady would be involved
- 17:43in any sort of abuse against them, and that was
- 17:46all part of the plot. Dough now thirty nine alleges
- 17:51the abuse escalated over the next few years as Epstein
- 17:54and Maxwell asserted more and more control over her life
- 17:57and aspirations. Stein paid for voice lessons, private high school tuition,
- 18:03and even co signed the lease on a New York
- 18:05City apartment for Doe and her mother, according to her complaint,
- 18:09And again, that's what he would do. He would use
- 18:11his money, he would use his power, and he would
- 18:14offer these these girls just a little sliver of something.
- 18:19And when you have never had nothing, and you've you've
- 18:23been poor your whole life, well even a little bit
- 18:26of nothing is better than nothing at all. Right, And
- 18:30a lot of these girls will lie to Oh, you're
- 18:32gonna get a job doing this, or we'll hook you
- 18:34up and you'll you'll be a model for Virginia's Secret
- 18:38or whatever it may be.
- 18:39Speaker 2: It was all part of the grooming process.
- 18:42Speaker 1: And that is why Elaine Maxwell is so so intricate
- 18:46in what went on with Jeffrey Epstein's criminal enterprise.
- 18:50Speaker 2: Do not let her get off as a victim.
- 18:52Speaker 1: Do not let her get off as somebody who was just,
- 18:55oh uh, a wilting lily, wilting lily, because that is
- 19:00not who she was. Kilaine Maxwell had a leadership role.
- 19:05Kilaine Maxwell was calling the shots from behind the scenes,
- 19:09the shadow boss. She claims the abuse occurred at Epstein's
- 19:16homes in Florida, New York and his ranch in New Mexico,
- 19:19and that she would often travel to those locations with
- 19:22Epstein and Maxwell on one of Epstein's private jets. Again,
- 19:26New Mexico is an absolute shit show. How is there
- 19:30not an investigation going on by the State of New Mexico?
- 19:35Are you people kidding me right now?
- 19:38Speaker 2: Hy way? You got better things to do.
- 19:41Speaker 1: What exactly is going on in New Mexico that you
- 19:45can't find the time to go kicking the door at
- 19:47Zoro Ranch? How many girls have to come out and
- 19:50say they were abused there? How many sources have to
- 19:53come forward and say this occurred, and yet on a
- 19:57local level, all we get from them is, oh, we're
- 20:00sharing information with the sdn Y.
- 20:03Speaker 2: I don't know about you, but.
- 20:05Speaker 1: If I was a local in New Mexico, I would
- 20:07be demanding a state investigation into this. Epstein's system of
- 20:15abuse was facilitated in large part by his co conspirator
- 20:18and accomplice, Maxwell, who helped supply him with a steady
- 20:21stream of young and vulnerable girls. The complaint said, many
- 20:25of whom were fatherless like Jane Doe and came from
- 20:28struggling families. I love that they call her a co
- 20:31conspirator and accomplice here, because that is the fitting terminology.
- 20:35Not socialite, okay, not ex girlfriend. Nice try setting up
- 20:40the defense for them, but it's not going to cut it.
- 20:44Those cases one of just a few civil actions against
- 20:47the Epstein estate that are being actively litigated. Most of
- 20:51the pending lawsuits have been put on hold by alleged
- 20:54survivors while they submit their claims to the Alternative Resolution program.
- 20:58And again, I'm all for that program, and as long
- 21:02here's the thing, it really doesn't matter what any of
- 21:05us think about it, as long as the as long
- 21:07as the survivors are okay with what goes on when
- 21:10it comes to the justice here, people getting arrested and
- 21:14the compensation program, that should be all that matters to anybody, honestly,
- 21:19because for so long they were told that they were liars,
- 21:22they were told that none of this ever happened. And
- 21:25now Jeffrey Epstein's estate is about to pay out six
- 21:30hundred and fifty five million dollars to these very same
- 21:35girls that they painted as liars. You know what that's called,
- 21:38my friends, That is called validation of claim. Epstein's estate
- 21:45is valued at more than six hundred and fifty five
- 21:47million dollars, according to a May fifth filing in probate
- 21:50court in the US Virgin Islands, where Epstein owned a
- 21:53private island compound that served as its primary residence since
- 21:56twenty ten. The criminal indict against Maxwell is likely to
- 22:02further complicate those efforts to obtain evidence and testimony necessary
- 22:07to pursue her civil claims. It is expected that Maxwell
- 22:11will eventually seek to pause the case, at least as
- 22:14it pertains to her, while the criminal case against her
- 22:17is pending. And that's pretty normal for situations like this, right,
- 22:23They'll they'll they'll suspend one of the trial, the trials
- 22:26obviously the civil the civil side, and they'll continue with
- 22:29the criminal side, and then after they can finish up
- 22:32the civil portion of it. But again, it's not like
- 22:37Elaine Maxwell was just some you know, uh passenger on
- 22:42this trip, okay. And Jane Doe explains very clearly how
- 22:48disgusting Glaine Maxwell was. Very clearly that Glaine Maxwell was
- 22:53part of the abuse, and all of the evidence that
- 22:58has been provided also paints the same picture. Gilaine Maxwell
- 23:07is looking at never seeing the light of day again, folks.
- 23:13And to be honest with you, I don't think she should.
- 23:21This is somebody who was involved in a reign of
- 23:24terror basically for decades, and she has no remorse. In fact,
- 23:29it looked like she was ready to bug out up
- 23:31in New Hampshire, two hours away from the Canadian border.
- 23:35You mean to tell me she has no contacts in Canada.
- 23:38You mean to tell me there are no private airfields
- 23:41that she could have been swooped away to and then
- 23:44off on a flight back to France. That's really out
- 23:47of the realm of possibility when we're dealing with people
- 23:50of means such as Gilaine Maxwell. Of course it's not.
- 23:54Of course, it's not so this criminal case. Her only
- 24:04out here is to serve up some huge names. And
- 24:08when I say out, I don't mean she's gonna get off,
- 24:11because she's not gonna get a plea deal like you're thinking,
- 24:13where she gives up names and she walks scott free.
- 24:16That's not going to occur.
- 24:17Speaker 2: In this case.
- 24:17Speaker 1: In my opinion, this lady's in big trouble. She's facing
- 24:21basically life in prison, and there is no hope on
- 24:26the horizon. As the allegations continue to come hot and
- 24:31heavy from every corner.
- 24:38Speaker 2: I wonder.
- 24:40Speaker 1: Is Prince Andrew sweating or has his disease gone away,
- 24:48because at this point where we are right now, the
- 24:54end is near for all of these people. If you'd

- 25:22on with some e So we've been talking a lot
- 25:25about the Department of just Us and their nonsensical internal
- 25:31review that was released to the survivors one week ago today.
- 25:37In fact, well, the question obviously became, what would the
- 25:43Eleventh Circuit Court of Appeals think about this new revelation. Well,
- 25:49it looks like the court is not going to consider
- 25:52this new report in the Epstein case, meaning this new
- 25:57information is not going to be at added to what's
- 26:01in front of them already and what's on the docket. Now,
- 26:05why that's the case, I'm not too sure. Maybe this
- 26:08article will clear that up for us, But you would
- 26:13think that a court would want to see all of
- 26:17the information and all of the evidence, right, that would
- 26:20probably be a good idea. No, But again, I'm certainly
- 26:24not a lawyer, and I don't really know how all
- 26:27of this stuff works, right, All of the ins and
- 26:29the outs of this nonsense certainly not my field of expertise,
- 26:35shall we say. And I'm just trying to make heads
- 26:38or tails of it with you folks at the same time. Right, So,
- 26:41I'm guessing the court has some sort of motivation behind it,
- 26:45But from the cheap seats over here and from the
- 26:49peanut gallery, I think it's a travesty that this bit
- 26:52of information wouldn't immediately be rushed onto the docket and
- 26:59into the court records. Right, So let's jump into this
- 27:02article and let's see what they have to say, and
- 27:05let's see if we can clear this up and try
- 27:07to understand what in the hell is going on here.
- 27:12This article is from CBS twelve dot com and the
- 27:17headline is court rejects considering new report in Epstein case.
- 27:23The author of this article is Dara kab And remember
- 27:27when we were talking, we knew that the government, the
- 27:31prosecutor's office and the federal government itself was against this
- 27:37new evidence being submitted. So it looks like their argument
- 27:41won the day. New information released in a US Department
- 27:47of just Us report last week shouldn't be considered in
- 27:50a lawsuit by one of Jeffrey Epstein's survivors that seeks
- 27:54to undo a non prosecution agreement that allowed the notorious
- 27:58sex offender to avoid federal charges, and Appeals Court ruled wednesday,
- 28:04And again, I don't understand how that could even be possible. Right,
- 28:09if you're going to hear this case, shouldn't you have
- 28:11all of the evidence before you. So when we talked,
- 28:16I figured that the court would totally accept this stuff,
- 28:20this evidence, and I figured with this new evidence that
- 28:23there was a better than good chance that the non
- 28:26prosecution agreement gets overturned. Now, with the court not accepting
- 28:31this stuff, I still think there's a good shot that
- 28:34it gets overturned. But this would this nonsense in this
- 28:37report certainly bolsters the argument that the federal government was
- 28:43negligent at best in their pursuit of justice in regards
- 28:48to Jeffrey Epstein. The Full Eleventh The Full eleventh US
- 28:54Circuit Court of Appeals is slated to hear arguments on
- 28:57December third in a lawsuit fil a dozen years ago
- 29:01by Courtney Wilde, a Florida woman who as a teen
- 29:05was among Epstein's numerous underage sexual abuse survivors. I mean,
- 29:11think about it for a second, right, think about if
- 29:14you were Courtney, how you would feel or any of
- 29:16these girls that were abused by Epstein. And this new
- 29:20information comes out about missing emails, all sorts of other nonsense,
- 29:26time gaps, data gaps, you would think that, you know, hey,
- 29:29this is a good deal, right. The Court's going to
- 29:31want to see this. This can only bolster my argument.
- 29:34But again, it just goes to show you that all
- 29:36of the different loopholes and the technicalities and the way
- 29:42they navigate the murky water that is the American judicial system.
- 29:47It's rigged, right, it is completely rigged. The government is
- 29:50never held accountable for anything it does. And here we are,
- 29:56here we are once again scratching our heads and asking
- 29:59ourselves the hell is going on with these people. Wild's
- 30:05lawyers this week told the court that the report by
- 30:07the Department of just US's Office of Professional Responsibility, two
- 30:12years in the making, sheds new light on the government's
- 30:15handling of Epstein, a wealthy financier pedophile who owned homes
- 30:20in Florida and elsewhere, and who died in a New
- 30:23York jail last year. Yeah, it most certainly does bring
- 30:26some stuff to light. Right, So again, I just don't
- 30:30understand why it would not be accepted by the court
- 30:36or why they wouldn't consider it. There has to be
- 30:39some sort of legal reason, right, There has to be
- 30:42some sort of I don't know scope of what they're
- 30:47looking for. Maybe that would be my guess, right, But again,
- 30:50I'm certainly not a lawyer, but I will continue to
- 30:54try and navigate these murky waters and figure it all
- 30:57out with you folks, right, because common sense says, and
- 31:03decency says that the court should accept whatever sort of
- 31:06evidence is being provided, at least you would think, right.
- 31:13Whild is fighting a non prosecution agreement struck by former
- 31:17South Florida US attorney Alex Acosta and his bosses, who
- 31:21over a decade ago, worked with Epstein's lawyers to craft
- 31:25the deal, allowing Epstein to sidestep federal charges. Under the agreement,
- 31:30Epstein pleaded guilty to two state prostitution charges in Florida,
- 31:34including procuring a minor for sex. Again, really, and even
- 31:40with say that was the only charge this guy was
- 31:43ever hit with, and there was nothing else that ever
- 31:45came out with Epstein. Imagine you have this charge procuring
- 31:49a minor for sex, and people like Leon Black and
- 31:53you know, Jess Staley and all of these other folks
- 31:57who are in so called polite society, they said, they
- 32:00have the audacity to say, I don't know what Jeffrey
- 32:02Epstein was. The dude was slapped with at the very
- 32:06least a procuring a minor for sex charge, okay, and
- 32:11went to jail for it. So don't tell us you
- 32:13don't know what he was, you bunch of lion bastards.
- 32:18The plea deal also provided immunity from federal prosecution for Epstein,
- 32:23four other named co conspirators, and any potential co conspirators.
- 32:28It's so wild every time we read that, I just
- 32:31shake my head and wonder how in the hell anyone
- 32:34could look at that deal and say it's right, say
- 32:38that it passes the sniff test. It does not. It
- 32:44smells to high Heaven and nobody else ever in the
- 32:48history of America. Think about that for a minute. All
- 32:50of the scum baggery we've had go on in our
- 32:52two hundred and fifty plus, no one else has ever
- 32:56caught themselves such a sweetheart deal like the one Epstein caught.
- 33:00And what did he catch it for? He was abusing children, folks.
- 33:05Let that sit in right, Let that sink in for
- 33:07a minute, chew on that, put that in your pipe
- 33:10and smoke it, and then turn your full attention with
- 33:15disgust to the Department of Justice. The full Atlanta based
- 33:21appellate decided to hear arguments in the case after reversing
- 33:25a three judge panels April ruling. The panel concluded that
- 33:29although the facts of the case were beyond scandalous and
- 33:32a national disgrace, the agreement did not violate the federal
- 33:37victim's rights law. Yeah, well, we know how that worked
- 33:40out for the three panel judge, the three judge panel, right.
- 33:45We know that Judge Hull wasn't having it. We know
- 33:48about the amicust briefs, and we know that Judge Hull's
- 33:51response was so fiery that the court decided to hear
- 33:56it with a fully unpaneled bench. And it is a travesty, honestly,
- 34:04that it's come to this far. This should have been
- 34:07able to be handled in a lower court. It shouldn't
- 34:10even have been kicked up to an appeals court. What
- 34:14sort of judge can look at this? You know. The
- 34:16thing about it too, is they'll sit there and they'll
- 34:20talk about, oh, this is the law, this is the law,
- 34:22this is this, this is that. But at the same
- 34:24time they'll let their politics dictate the way they the
- 34:30way they make their judgments from the bench, how they
- 34:32read the constitution, how they read the law. But in
- 34:36cases like this, when it's obvious these people are scumbags,
- 34:41it's obvious the federal government shit the bed. It's obvious
- 34:45the federal government worked on almost on behalf of Jeffrey
- 34:50Epstein against these girls. And you would think, after all
- 34:53these years, with all of this publicity and the spotlight
- 34:58turned on it, that now be the time to start
- 35:01restoring our faith in the Department of just Us. But
- 35:05instead it seems like we get more bullshit games. Huh.
- 35:13The Eleventh Circuit on the Eleventh Circuit on Wednesday refused
- 35:17Wilde's request to add the two hundred and eighty seven
- 35:20page report to the case record, saying the court's reconsideration
- 35:24of the case was limited to too limited to two issues,
- 35:28whether the Victim's Rights Act applies before charges are filed
- 35:32against a defendant, and if so, whether violations of the
- 35:36Act can be enforced with an independent court action. All right,
- 35:41so there's the reasoning behind it. It's the scope. It's
- 35:45the scope of what they're looking at. But I still
- 35:48don't think that's acceptable, to be honest with you. Increase
- 35:52your scope. You're a federal court, you're an appellate court,
- 35:54you're one of the highest courts in the land. Do
- 35:58what you gotta do to make sure you have this
- 35:59in from right. I would think that if you're sitting
- 36:04on this panel of judges, you would want everything in
- 36:08front of you. I know I would. I mean, when
- 36:10we're talking about something as serious as the law and
- 36:14possibly sending people to prison for their whole lives, I
- 36:17would think that every single bit of information should be
- 36:21digested by those who are going to render such a decision.
- 36:26That is a great amount of power and a great
- 36:30amount of responsibility. You would want to have everything lined
- 36:35up right, everything in context. But I guess according to
- 36:41the court, it's not within the scope. Although the court
- 36:49rejected the admission of the report, Wilde's legal team remained upbeat. Well,
- 36:55that's a positive right if the legal team remained upbeat,
- 36:57and they would know all all of this, you know,
- 37:01the nuance of all of this way better than I am. Again,
- 37:04I'm certainly no lawyer, folks. I'm just, you know, just
- 37:07a knucklehead who's a commentating on what's going on here.
- 37:12So if her legal team remains upbeat, then at least
- 37:15that's a little bit of silver lining in the cloud here.
- 37:19We're actually pleased that today's ruling narrows the case down
- 37:22to two issues, because we think those are two issues
- 37:26where this statute and the legislative history making it absolutely
- 37:30clear that the survivor should prevail in this case. University
- 37:35of Utah law professor Paul Cassell, who joined Fort Lauderdale
- 37:39attorney Brad Edwards in Wilde's legal battle shortly after her
- 37:43lawsuit was filed twelve years ago, told the New Service
- 37:46of Florida in a phone interview Wednesday. So I think
- 37:50that they might be onto something there, right. If the
- 37:54court is going to just strictly look at that's that
- 37:58particular part of the case, and that is the scope
- 38:01and the only thing that matters here for which they
- 38:05are going to make a ruling, then I think the
- 38:07survivors have a strong case no matter what, and I
- 38:10think Courtney has a very strong case here. I don't
- 38:14see how this appellate court could look at this and
- 38:18say that this is all above board and that this
- 38:21should not be overturned. I think that Judge Hull, again,
- 38:27who had the fiery response to her colleagues on the
- 38:31three person panel after they ruled in favor of the government,
- 38:35I think Judge Hull is going to be very critical
- 38:38of everything coming across her desk, for sure, and I
- 38:41am almost positive that she has multiple colleagues that will
- 38:45feel the same way. This is a travesty. The very
- 38:48people who wrote this law wrote amicist briefs telling the
- 38:53court that they were not using the law how it
- 38:56was written. How much more clear is it than that
- 39:04the report found that a Costa used poor judgment in
- 39:07striking the non prosecution agreement with Epstein's lawyers, showed that
- 39:11the government failed to provide documents to Wild's attorneys, and
- 39:15revealed the Justice Department's views on how a Costa treated
- 39:18Epstein's survivors, an element that plays a critical role in
- 39:22Wilde's lawsuit. For sure, it's a pattern. It just shows
- 39:27a pattern of how these gals were treated and how
- 39:30Courtney was treated. Right, There's no reason that the lawyers
- 39:34should have to wait ten years to know about a
- 39:36gap in emails. Why isn't the government being transparent? And
- 39:40I don't even want to hear about no glitch or
- 39:42no coincidence. Every time I hear the word glitch or
- 39:45coincidence in this case, it makes my skin crawl. At
- 39:48this point, I mean, you know, how much are you
- 39:55how much shit are you going to shovel us and
- 39:57expect us just to accept it and suck it down,
- 40:00because enough is enough at this point. Acosta served for
- 40:07two years as Secretary of Labor and President Donald Trump's administration,
- 40:11but he resigned last year amid criticism of his handling
- 40:14of the Epstein agreement. And again, look, Acosta deserved to resign.
- 40:20He didn't even deserve a place at the table when
- 40:22it comes to being involved in a president's cabinet. But
- 40:27we know that Trump has not shown the greatest judgment
- 40:31when it comes to having Epstein's buddies around him. Dershowitz, Minutchin,
- 40:35I mean, you know, so part for the course there.
- 40:38But in a perfect world, Acosta would have never had
- 40:42a seat at the table. With that said, anyone who's
- 40:46just looking to pin this on Acosta, and anybody who
- 40:50thinks it's just Acosta who is making these decisions is
- 40:55doing a disservice to the overall investigation and is not
- 41:00not digging deep enough. And addendum to the report revealed
- 41:06a data gap in Acosta's email inbox from May two
- 41:10thousand and seven through April two thousand and eight, the
- 41:14exact time period mister Acosta was most deeply involved in
- 41:18negotiating and approving the Epstein NPA non prosecution agreement. Wild's
- 41:24lawyers wrote in emotion filed this week, one hundred percent
- 41:29it is beyond a coincidence at this point. It is
- 41:33beyond strange. Okay, if you're looking at a building and
- 41:37you see, you know, smoke coming out of a window,
- 41:40chances are there's going to be fire. And that's what
- 41:45we have here. There's a lot of things that don't
- 41:48add up, and there's a lot of things that they
- 41:50would want us to believe as coincidence that I have
- 41:54a very very hard time buying. Government lawyers who opposed
- 42:02inclusion of the report in the lawsuit have raised a
- 42:04whole flurry of other objections against getting to the merits
- 42:08of the issues in the case, Kassel said, And of
- 42:11course the government lawyers are going to be smarmy. They're
- 42:14going harder against the survivors than they did against Epstein.
- 42:18It's a travesty to watch, right. It really is disgusting
- 42:21and disheartening and almost discouraging to watch shit like this occur.
- 42:25And then what can you do about it? All we
- 42:28can do about it is vote out all scumbags, all
- 42:32incumbents really, because when I say scumbag, that's what I mean,
- 42:35and send real people to DC. There has to be
- 42:39some sort of term limits. There has to be a
- 42:41limit on money coming in or actually zero money coming
- 42:44in from out of states for campaigns. There's a whole
- 42:47bunch of shit that we can do, but yet we
- 42:49don't ever push the issue. We just keep sending the
- 42:53same retreads back and back and back and back, and
- 42:56then when shit goes south, we wonder, whoa, whoa, what
- 42:58the hell? What happened? Well, we set the same morons
- 43:01back to DC. What do you think is gonna happen?
- 43:04And that's what we see here. We need to send
- 43:06better quality people with morals to Washington, DC. So we
- 43:10can get some quality lawmakers to write some quality laws.
- 43:13Wouldn't that be nice for a change, folks. But if
- 43:19the Eleventh Circuit sides with Wild on the alleged violations
- 43:22of the victim rights law, the missing emails and other
- 43:26information in the report are immediately ripe for consideration by
- 43:30the court. So all right, that's promising as well. If
- 43:36they side with Courtney and they feel like the government
- 43:39screwed up, which they should, then these reports and the
- 43:44missing emails and all the other garbage automatically becomes ripe,
- 43:49meaning the court will be interested in it very much so,
- 43:54and we'll probably get to see it be included from
- 44:00that point on. But again, that means the Eleventh Circuit
- 44:03has to side with Courtney first, right, So one battle
- 44:06out of time, one step out of time. One thing
- 44:09I've learned in this case is every single time you
- 44:11think that you're ahead in the count, they come back
- 44:15with some sort of curveball and it becomes a full
- 44:17count once again. After more than a decade of litigation,
- 44:22US District Judge Kenneth Mara ruled in February twenty nineteen
- 44:27that federal prosecutors broke the law when they struck the
- 44:30plea deal with a multi millionaire, but after Epstein died
- 44:34last year, the federal judge refused to undo the plea
- 44:37agreement or grant other remedies sought by wild who filed
- 44:41the lawsuits as Jane Doe and another victim. So it's
- 44:46pretty interesting, huh. After this stuff gets in February, it's
- 44:52you know, ruled that the government broke the law when
- 44:59they struck this deal with Epstein, meaning that the NPA
- 45:02was in serious jeopardy, and then Epstein just happens to
- 45:05get arrested and then kills himself. Huh. Pretty interesting how
- 45:08that happens. Just another coincidence, I would guess, though, right stops,
- 45:12don't think it's don't think he got murdered. He could
- 45:15never have gotten murdered, obviously a suicide man, Bill Barr
- 45:19told us. And so no name medical examiner from New
- 45:22York too. Okay, Yeah, I'm buying that the Act promised
- 45:28miss Wilde and other survivors the chance to confer with
- 45:31the prosecutor before any deal was done. That's what Judge
- 45:35Marrow ruled. So if we prevail, what we think should
- 45:38happen is the deal should be invalidated, including the immunity provision,
- 45:43which gives immunity not just to the now deceased Jeffrey Epstein,
- 45:47but his co conspirators. Cassell, a former federal judge, said Wednesday.
- 45:52And it's important right because it opens up a slew
- 45:55of well documented crimes. Then right now prosecutors are putting
- 46:00together other crimes that might not have been made public
- 46:03or on the books, whatever may have you. But if
- 46:06this NPA goes by the wayside, there's decades of information
- 46:09already compiled that can be automatically weaponized. So it's very
- 46:14crucial that this Eleventh Circuit Court decision comes down on
- 46:19the side of justice. And if it doesn't, I would
- 46:22hope and I would urge the survivors' lawyers to push
- 46:25this shit all the way to the Supreme Court. It's
- 46:27that important. After the earlier plea agreement on state charges,
- 46:33Epstein was arrested in July twenty nineteen and charged with
- 46:37federal sex trafficking offenses involving minor girls from Florida and
- 46:41other places. He was found dead in a jail cell
- 46:45a month later in what was deemed the suicide. In
- 46:48addition to Epstein, the agreement provided immunity to four women
- 46:53Sarah Kellen, Adrianna Ross, Leslie Groff, Nadia Marsonkova, and other
- 46:58unidentified people. So the Core four plus more is what
- 47:04I'm calling all of them. Now. Originally I dubbed the four.
- 47:08I just named the Core four, but everyone else added in.
- 47:11Now that's the Core four and more because you know
- 47:16where I'm coming from. All of these people need to
- 47:19get a big fat helping of Rico. That needs to
- 47:25happen asap, and this prosecution agreement is certainly an impediment
- 47:30in that occurring. It has to go by the wayside.
- 47:35Wilde is hoping the court will revoke the agreement so
- 47:38she can work with federal prosecutors to go after the
- 47:41conspirators who help Jeffrey Epstein abuse her in Florida, said Cassell,
- 47:45a former federal prosecutor. So we're hoping to get a
- 47:48recision of the immunity provision in the non prosecution agreement. Bam,
- 47:54that would be epic And I think that it would
- 47:59be nice if the eventh Circuit Court would accept all
- 48:02of the evidence that has been compiled. Don't you think
- 48:05that would be uh prudent? Even if it means they
- 48:09have to push the hearing back of a week or
- 48:12two or three weeks to get their ducks in a row.
- 48:15I don't understand why the court would rejected. Still, I
- 48:18get it the scope, and I understand the legal easee
- 48:21of it. That's not what I'm saying. The citizen in me,
- 48:25the taxpayer in me, the pissed off, agitated taxpayer in me,
- 48:32does not understand. However, so we'll see how this plays out.
- 48:36December third is a big day. Circle it on your calendar.
- 48:40I'll be calling in obviously to listen to the proceedings
- 48:44if that's possible. Like it has been in PRESCA and
- 48:47Judge Nathan's court rooms, I'm guessing it's the same procedure here,
- 48:52so I will definitely be calling in and listening to
- 48:56what goes on when they make the they hear the
- 49:00or arguments on December third. So there you have it, folks.
- 49:04That answers our question about the Department of Justice report
- 49:09and if the Eleventh Circuit of Appeals was going to
- 49:16bring that onto their plate as well. And the answer
- 49:20that we have received to this point sounds like a no.
