• 0:50
Speaker 2: the lawyer. Good morning, Tom. How you doing this morning?
• 0:52
  Speaker 2: I'm doing well.
• 0:53
  Speaker 4: How you doing?
• 0:53
Speaker 2: Hell, I'm doing okay. You got a little bit of
• 0:55
Speaker 2: a different open force this morning. I like it. It sounds good.
• 0:57
Speaker 4: Yeah. I put that together. I thought we'd oh, okay,
• 1:01
Speaker 4: that's my headphone cord. Yeah, that would change it up
• 1:04
Speaker 4: a little bit, lighten it up a little bit. We've
• 1:05
Speaker 4: had the same power of Peyton jingle for twenty years,
• 1:10
Speaker 4: which we like stuck. It's catchy. I'm told that's interesting
• 1:16
Speaker 4: that that jingle. You know, we we radio helped us
• 1:18
Speaker 4: do that. It was part of our deal probably in
• 1:21
Speaker 4: two thousand six, two thousand and seven, but there was
• 1:26
Speaker 4: a couple out in Vegas that helped you compose it.
• 1:29
Speaker 4: And the guy does the uh, let's see, he does
• 1:32
Speaker 4: the maybe the instrumentals, and the woman his wife would
• 1:37
Speaker 4: right the write it and we went over it and
• 1:40
Speaker 4: composed it. We've used it ever since, but it would
• 1:43
Speaker 4: just change it up for a little bit.
• 1:44
Speaker 2: Yeah, there's nothing wrong with that. I do hope that
• 1:46
Speaker 2: that profession, the jingle writers, especially the small batch like
• 1:50
Speaker 2: what you were just I hope that still exists because
• 1:52
Speaker 2: a lot of that stuff out there anymore is either
• 1:54
Speaker 2: handled large corporately just formed out to somebody and taking
• 1:57
Speaker 2: care of or unfortunately a lot of it's AI now.
• 2:00
Speaker 2: So I really hope that still exists, because there's nothing
• 2:02
Speaker 2: like a well crafted jingle.
• 2:03
Speaker 4: Yeah, they were in Las Vegas and it was you know,
• 2:06
Speaker 4: we had a few meetings and collaborated and it was
• 2:09
Speaker 4: an interesting process, which of course I've never been through
• 2:12
Speaker 4: and haven't been through since, because we keep using the
• 2:14
Speaker 4: same jingle over and over again. But yeah, so that's
• 2:17
Speaker 4: new and I kind of came up with that. And
• 2:19
Speaker 4: actually my daughter Grace, who does She works as the
• 2:22
Speaker 4: director of marketing for Village Caregiving, which is a pretty
• 2:26
Speaker 4: large company of personal care kind of home care folks
• 2:31
Speaker 4: for people who have medical issues. But it's headquartered don
• 2:34
Speaker 4: in Barber's Belt and she helped me put that together.
• 2:37
Speaker 4: So kudos to Grace for helping there.
• 2:39
Speaker 2: Yeah, that's great stuff. You can put the power of
• 2:40
Speaker 2: Peyton on your side this morning and give us a

• 3:07
Speaker 2: going on this week's what's to talk about?
• 3:09
Speaker 4: Well, I just got back from vacation. Yeah, I'm still
• 3:12
Speaker 4: catching up. So if anybody called the office last week,
• 3:15
Speaker 4: I didn't. I do do some work on vacation, but
• 3:17
Speaker 4: of course I try and limit it or else I
• 3:20
Speaker 4: get in trouble with the fan when we're down there
• 3:23
Speaker 4: at the beach. But not a whole lot in the
• 3:26
Speaker 4: news here lately locally at some criminal matters. One thing,
• 3:31
Speaker 4: we are getting some calls on and we're actively taking
• 3:35
Speaker 4: these cases, especially unless might have stretched into Saint Albans
• 3:40
Speaker 4: a little bit. But we had that really bad hail
• 3:42
Speaker 4: and we've talked about a little bit really bad hailstorm
• 3:44
Speaker 4: back in I think mid April something like that. So
• 3:48
Speaker 4: you know, your car gets hit, You've got issues about
• 3:52
Speaker 4: getting hail damage repaired, whether it's broken glass or pock
• 3:56
Speaker 4: marks all over your car. And then of course you
• 3:59
Speaker 4: have problems with your building or your home, and a
• 4:03
Speaker 4: lot of roofs are I mean I live down in
• 4:06
Speaker 4: Tays Valley and we were right in the heart of
• 4:08
Speaker 4: the really large heil. I mean I saw a couple
• 4:11
Speaker 4: that had to been slightly larger than golf ball size probably,
• 4:16
Speaker 4: and it's just been you have a new musical tomb.
• 4:18
Speaker 4: When you walk out of your door in the morning,
• 4:22
Speaker 4: it's bring bing ping ping. That's the nail gun. There
• 4:26
Speaker 4: are so many roofs being done and you get a
• 4:28
Speaker 4: lot of out of state uh contactors come in uh
• 4:31
Speaker 4: that that they just go door to door solict I
• 4:33
Speaker 4: have a client that does a good bit of roofing
• 4:36
Speaker 4: and uh so I'm using them. Uh local, local folks.
• 4:40
Speaker 4: Actually a fell I went to school with. Uh it's
• 4:43
Speaker 4: part owner from Saint albans. I'm I just listen to
• 4:46
Speaker 4: the slit citations to see what they tell you, and
• 4:49
  Speaker 4: and it's some of it's a little borderline. I mean
• 4:51
  Speaker 4: they'll they'll they'll tell you that. Well, I had somebody
• 4:54
Speaker 4: ask the ODAY, a door to door contractor salesperson was
• 4:58
Speaker 4: pushing them that they had to whatever they got for insurance,
• 5:02
Speaker 4: entire amount had to go to the contractor and things
• 5:04
Speaker 4: like that. Because there's there's nothing wrong your homeowners. Your
• 5:11
Speaker 4: auto cannot they can recommend they consider as preferred providers,
• 5:17
Speaker 4: but they can't mandate you use a particular company to
• 5:22
Speaker 4: do your repairs. And so there is nothing wrong if
• 5:26
Speaker 4: you get an adjustment by your insurance company's adjuster that
• 5:31
Speaker 4: comes up with an amount, Yeah, that's x amount of dollars.
• 5:34
Speaker 4: But then you are entailed to shop with different contractors
• 5:38
Speaker 4: to actually get the work done. And if you happen
• 5:41
Speaker 4: to get competitive bidding and you get somebody to do
• 5:45
Speaker 4: it for less than someone else, then you know, one
• 5:48
Speaker 4: hundred percent of what you got from the insurance company
• 5:50
Speaker 4: doesn't have to be paid over to that contractor. But
• 5:53
Speaker 4: that's what was being conveyed to someone in the Taye
• 5:57
Speaker 4: Valley area. Now we're we are seeing Now, we didn't
• 6:02
Speaker 4: see it at first because the insurance companies were generally
• 6:05
Speaker 4: pretty good. You know, when you get a big event
• 6:07
Speaker 4: like that, they send adjusters from out of the area
• 6:12
Speaker 4: because they know they've got so many claims to adjust.
• 6:14
Speaker 4: And you know, I think that was the initial wave
• 6:18
Speaker 4: was good. Now what we're seeing our disputes. You know,
• 6:21
Speaker 4: if you have a nice home and you have damage
• 6:27
Speaker 4: to your siding, are they entitled to just patch part
• 6:30
Speaker 4: of the siding so you have a patchwork looking side
• 6:34
Speaker 4: of your home. Are they able to say, well, your
• 6:40
Speaker 4: roof was damaged by hail, but only this one section
• 6:44
Speaker 4: was bad enough to be redone, so you know, we're
• 6:46
Speaker 4: only going to pay you for this one fifth of
• 6:49
Speaker 4: your roof, and then if your roof has any age,
• 6:52
Speaker 4: it's impossible to match ten year old shingles with brand
• 6:57
Speaker 4: new singles. At least in my estimation, you buy you
• 7:00
Speaker 4: singles to match the used ones that you already have.
• 7:03
Speaker 4: So we're screening these cases, and certainly if you have questions,
• 7:08
Speaker 4: you can call here, send us an email, or call
• 7:10
Speaker 4: the office. But the parameters kind of are you you
• 7:15
Speaker 4: need to if you have an estimate or maybe two
• 7:20
Speaker 4: or three estimates, and the amount that your insurance company
• 7:24
Speaker 4: paid you previously is insufficient to get the work done
• 7:29
Speaker 4: now not. It doesn't mean you're entitled to a new
• 7:32
Speaker 4: party plank siding if you had vinyl sighting. But if
• 7:35
Speaker 4: you're trying to repair your property with comparable but new
• 7:42
Speaker 4: materials and it costs, you know, two thousand dollars more
• 7:47
Speaker 4: than your insurance company paid you, generally, what should happen
• 7:52
Speaker 4: is they should just issue a supplemental payment and cover
• 7:55
Speaker 4: that that balance. But we're hearing a lot of people
• 8:00
Speaker 4: are going through the process and now they're running into
• 8:03
Speaker 4: trouble because they're getting contract or estimates that are more
• 8:08
Speaker 4: than what their insurance company initially paid them. And what
• 8:10
Speaker 4: I'm finding is once that initial adjustment gets done by
• 8:13
Speaker 4: the insurance company and they make that payment, it's sometimes
• 8:16
Speaker 4: hard to get them to communicate after that. They feel
• 8:18
Speaker 4: like they're you know, I guess they've gotten over that
• 8:20
Speaker 4: hunt made a payment and it's difficult. So communication is
• 8:24
Speaker 4: one thing. But if you have an actual denial of
• 8:28
Speaker 4: your claim, even a partial denial, they won't pay the
• 8:31
Speaker 4: extra money so you can actually get your property fixed.
• 8:35
Speaker 4: That's when we can step in and kind of some pointers,
• 8:41
Speaker 4: though you really need to. Pretty much all the major
• 8:45
Speaker 4: insurance companies, they almost steer you towards you know, website,
• 8:51
Speaker 4: chat or submitting things online or via email, and that's
• 8:55
Speaker 4: Email is fine. Chat is fine, as long as you
• 8:59
Speaker 4: can per deserve what you know, live chat. Lot of
• 9:03
Speaker 4: times you're not talking to a human on the other
• 9:05
Speaker 4: side anyway, it's a I or something. But you know,
• 9:07
Speaker 4: take a screenshot of that. If they're denying your claim,
• 9:11
Speaker 4: but you really need to make I'll say, not a
• 9:16
Speaker 4: wishy washy. Well, here's what I think you need to
• 9:19
Speaker 4: send them the quote from the contractor and I use
• 9:26
Speaker 4: the word demand, but say you know request and knowing
• 9:29
Speaker 4: certain terms, you want the difference between what they paid
• 9:33
Speaker 4: and what this will actually cost you to get it done.
• 9:37
Speaker 4: And generally one of the insurance regulations in West Virginia,
• 9:40
Speaker 4: I think I got the time for fifteen days to
• 9:43
Speaker 4: respond to you in writing, do not accept. If they
• 9:47
Speaker 4: try and call and say we can't do that, we'll say, well,
• 9:50
Speaker 4: that's fine, but I need a response from you in
• 9:52
Speaker 4: writing to my request and demand a written response, and
• 9:58
Speaker 4: you've already made a clear request for X amount of
• 10:01
Speaker 4: extra dollars. And if they write back and say no,
• 10:07
Speaker 4: we're not going to pay that, sometimes they'll you'll get
• 10:12
Speaker 4: a letter saying we our investigations still ongoing. But that
• 10:17
Speaker 4: is essentially a de facto denial if they drag it
• 10:19
Speaker 4: out for too long. I mean, there's no reason shouldn't
• 10:22
Speaker 4: take them more than thirty days just to analyze a
• 10:24
Speaker 4: contractor's estimate and give you a response about whether they're
• 10:28
Speaker 4: going to pay the extra funds or not. But when
• 10:30
Speaker 4: you get that denial correspondence in writing, either email or
• 10:35
Speaker 4: buy hard copy letter, that's generally the parameters when we
• 10:41
Speaker 4: can step in and handle the case for you, and
• 10:44
Speaker 4: of course, if we got to screen it and make
• 10:46
Speaker 4: sure it makes sense and what you're requesting from the
• 10:48
Speaker 4: insurance company is reasonable and it's not a highly inflated
• 10:53
Speaker 4: estimate for some reason, and it's it's apples to apples.
• 10:55
Speaker 4: You're trying to get the same type of materials to
• 10:57
Speaker 4: cover your home, and those are the type of cases
• 11:01
Speaker 4: we're working up and screening right now. And generally, if
• 11:06
Speaker 4: you get the scenario I just went through, even if
• 11:09
Speaker 4: it's a couple thousand dollars different, you think, well, how
• 11:11
Speaker 4: can I hire a lawyer for a two thousand dollars
• 11:16
Speaker 4: dispute in essence at that point, because lawyers are going
• 11:20
Speaker 4: to charge more than that just to hire them to
• 11:22
Speaker 4: do anything. Well, these type cases, the way the law works,
• 11:26
Speaker 4: if we accept them, we do all those on contingency fees,
• 11:29
Speaker 4: so you don't pay anything unless we recover for you.
• 11:34
Speaker 4: And generally, if you have that type of clear denial,
• 11:39
Speaker 4: there's an opportunity. And of course, our goal ultimately is
• 11:42
Speaker 4: to get our clients satisfied for us to get sufficient
• 11:45
Speaker 4: funds recovered that you have at least enough at least
• 11:49
Speaker 4: enough to get the repairs that you're entitled to done
• 11:52
Speaker 4: to your home or your car, and that's that's kind
• 11:58
Speaker 4: of you can juxtaple is that if a third part
• 12:01
Speaker 4: party hurts you and you're going it's their insurance company,
• 12:03
Speaker 4: you don't really have that opportunity. It's very difficult to
• 12:05
Speaker 4: get a lawyer to handle a property damage dispute if
• 12:09
Speaker 4: somebody rear ends you and you've got a dispute about
• 12:11
Speaker 4: what type of materials need to be used to repair
• 12:14
Speaker 4: your car, because you don't get lawyer's fees and things
• 12:17
Speaker 4: like that when you're dealing with another person's insurance company.
• 12:21
Speaker 4: But in this scenario, it's your own insurance company and
• 12:23
Speaker 4: they've got a heightened duty of good faith to say layment,
• 12:29
Speaker 4: behave nicer to you and treat you fairly. And if
• 12:34
Speaker 4: if you have to hire a lawyer and probably file
• 12:38
Speaker 4: a lawsuit to get your claim resolved, that's not why
• 12:40
Speaker 4: you buy insurance. You buy insurance for, as they say
• 12:43
Speaker 4: on all their commercials, to give you peace of mind
• 12:47
Speaker 4: and make sure you're taken care of when you have
• 12:49
Speaker 4: a situation where you have a weather event or something
• 12:53
Speaker 4: that causes damage or diminution and the value your property.
• 12:56
Speaker 4: And so because of that law, we're able to handle
• 12:59
Speaker 4: those claims that are a little smaller, but it still
• 13:03
Speaker 4: makes financial sense for the client and for us to
• 13:06
Speaker 4: handle those claims. So if you have an issue like that,
• 13:08
Speaker 4: you can send us, send us an email through the
• 13:11
Speaker 4: website and we can do a quick you know, get
• 13:13
Speaker 4: some documents. Just really we can do it all the email.
• 13:16
Speaker 4: Of course, you're welcome to stop by the office and
• 13:18
Speaker 4: provide documentation, but you really got to You can call
• 13:21
Speaker 4: and ask them and make inquiries, but you really got
• 13:23
Speaker 4: to set it. You really got to get in a
• 13:25
Speaker 4: position where you've demanded or asked them to pay the
• 13:30
Speaker 4: specific extra amount based on a written estimate from a contractor,
• 13:34
Speaker 4: and then demand they give you a response in writing
• 13:37
Speaker 4: and if that response and writing from your own insurance
• 13:39
Speaker 4: company is not sufficient, those are the parameters and that's
• 13:44
Speaker 4: when we can really step in and help. So it'll
• 13:48
Speaker 4: give you if you're in that situation, just go through
• 13:50
Speaker 4: that process and get to that point. And you know,
• 13:53
Speaker 4: maybe if you push them in writing instead of having
• 13:55
Speaker 4: somebody just call and say, well, we can't pay that,
• 13:57
Speaker 4: because a lot I'll tell you that it didn't. You
• 14:00
Speaker 4: used to be this way, but a lot of I
• 14:03
Speaker 4: know adjusters are not what I even think of as adjusters.
• 14:08
Speaker 4: You can tell when you're talking to folks they're just
• 14:11
Speaker 4: almost call center folks on the other end. I mean
• 14:13
Speaker 4: they're reading off screens and maybe clicking a little buttons
• 14:16
Speaker 4: that gives them results. There something you can hear, a pause, respond,
• 14:20
Speaker 4: and then they respond in a way that isn't responsive
• 14:25
Speaker 4: to what you were just telling them. It's like the
• 14:26
Speaker 4: next question on the list, instead of we ask you this,
• 14:30
Speaker 4: it's like, well that doesn't have anything to do with
• 14:31
Speaker 4: what I was just inquiring about. So you know, but
• 14:34
Speaker 4: if you make them put it in writing, one it
• 14:38
Speaker 4: it allows you to potentially have a claim we can handle,
• 14:41
Speaker 4: but to sometimes if you really push them to put
• 14:43
Speaker 4: it in writing, may get to a human that will
• 14:46
Speaker 4: properly adjust the claim and get it resolved for you.
• 14:48
Speaker 4: Which you're better off do that and get in a lawsuit.
• 14:52
Speaker 4: But you know, you get in that position and you
• 14:54
Speaker 4: hire us on a contingency fee so that you know
• 14:56
Speaker 4: we don't get paid, You don't pay any costs, you know,
• 14:59
Speaker 4: filing fees, these expert fees, things like that, and if
• 15:04
Speaker 4: it goes bad, it's it's and we don't recover, then
• 15:10
Speaker 4: you're not out financially and really work on those type cases.
• 15:15
Speaker 4: If you get in a civil action, in that regard,
• 15:17
Speaker 4: it's mostly lawyer work and you've got to deal with
• 15:19
Speaker 4: our office, which we think is we try and make
• 15:21
Speaker 4: as easy and comfortable as possible. But other than that,
• 15:25
Speaker 4: there's maybe some leg work, but we take over and
• 15:28
Speaker 4: we pretty much handle the entire litigation, and then you
• 15:32
Speaker 4: just deal with our office as far as answering questions
• 15:35
Speaker 4: and things like that. And of course, obviously if you
• 15:36
Speaker 4: get to you know, ninety percent of civil cases subtle,
• 15:40
Speaker 4: so it will probably never end up a trial. You
• 15:42
Speaker 4: might have to come in and participate a little bit
• 15:45
Speaker 4: in some settlement process and things like that, but it's
• 15:48
Speaker 4: really not so other than the stress of being involved
• 15:51
Speaker 4: in a lawsuit, which doesn't stress me because that's what
• 15:54
Speaker 4: we do, but for a regular person it can be
• 15:56
Speaker 4: a bit stressful. It's really not interest at all for
• 16:01
Speaker 4: the for the client, they just give us some initial
• 16:03
Speaker 4: information and we take over from there, so it's not
• 16:07
Speaker 4: that big a deal as far as time commitment or
• 16:09
  Speaker 4: anything like that.
• 16:10
Speaker 2: I find it to be a lot of what you
• 16:13
Speaker 2: just covered, for example, the mechanisms that you know, like
• 16:17
Speaker 2: your your civilians that are that aren't part of the
• 16:20
Speaker 2: legal profession may not know even where the mechanisms start,
• 16:23
Speaker 2: you know, and the steps that you just walked through
• 16:26
Speaker 2: there in giving folks like kind of a god, a
• 16:29
Speaker 2: guided path on what they should start with, what they
• 16:31
Speaker 2: should do, what's next. That's really a lot of the
• 16:33
Speaker 2: help that you can offer at the Peyton Law Froom
• 16:34
Speaker 2: as well is helping people steward what it is that
• 16:37
Speaker 2: they need to get. There's mechanisms in place that people
• 16:40
Speaker 2: can that people can use, they just know how to
• 16:41
Speaker 2: how to to access them.
• 16:43
Speaker 4: That's right, Just like what you need to do about
• 16:44
Speaker 4: pressing and writing and getting a written in response and
• 16:48
Speaker 4: demanding a specific amount and getting them the contactor's estimate.
• 16:51
Speaker 4: And I don't know how many dozens of people I've
• 16:54
Speaker 4: told that same thing too, and then most of them
• 16:57
Speaker 4: haven't called back. I think they end up getting their
• 16:58
Speaker 4: claim after that. So you really obviously not everybody's listening
• 17:03
Speaker 4: to the radio, so you know, anybody can call and
• 17:06
Speaker 4: that's they'll hear the same thing from us at the office.
• 17:08
Speaker 4: Well here's what you need to do. Then you have
• 17:09
Speaker 4: some insurance companies that just really won't risk communicate at
• 17:14
Speaker 4: all and if there's a zero communication, you can do
• 17:18
Speaker 4: one or two things. One you can go ahead and
• 17:20
Speaker 4: make sure you you can mail them a letter in
• 17:22
Speaker 4: writing with the contractor's estimate and say here's how much
• 17:25
Speaker 4: I need. Or you can and the Insurance Commissioner's office
• 17:29
Speaker 4: is really good at this, the Western Insurance Commissioner. You
• 17:31
Speaker 4: can file a complaint there for the insurance company's lack
• 17:35
Speaker 4: of communication. They haven't written back and said no, we're
• 17:39
Speaker 4: not going to pay that amount. They just won't. I've
• 17:42
Speaker 4: had insurance companies just ghosts there insured they just won't.
• 17:48
Speaker 4: You see multiple emails, clients have phone logs what they've called,
• 17:53
Speaker 4: and just no response whatsoever. Then, if you're in that situation,
• 18:00
Speaker 4: and I suggest initially you contact the Western Insurance Commissioner's Office,
• 18:04
Speaker 4: you can file a very brief complaint online at the
• 18:08
Speaker 4: Insurance Commissioner's office. They have a consumer division protection division
• 18:11
Speaker 4: there and they'll take the complaints, no charge. You don't
• 18:16
Speaker 4: need to be a lawyer to do it. You really
• 18:18
Speaker 4: just explaining, like, my insurance company will not communicate with
• 18:21
Speaker 4: me at all. Here are my number of attempts and
• 18:25
Speaker 4: times I tried to communicate with them, and the Insurance
• 18:28
Speaker 4: Commissioner's Office has in my experience, has been really good.
• 18:32
Speaker 4: Then they take the complaint, they send a lot of
• 18:35
Speaker 4: the insurance company, and then usually you get pretty good
• 18:37
Speaker 4: communication after that. Even though there's not a whole lot
• 18:40
Speaker 4: of teeth with the insurance commissioner regulations these days, necessarily, uh,
• 18:48
Speaker 4: they are really good at getting the insurance companies to
• 18:52
Speaker 4: start communicating with you because they they're the regulatory agency,
• 18:56
Speaker 4: and so when they get it, when they get an
• 18:59
Speaker 4: inquiry from the Western Insurance Commissioner's Office seems to take
• 19:02
Speaker 4: it to another level, and then you get better, better service,
• 19:05
Speaker 4: and then you can push it to the point when
• 19:07
Speaker 4: you get a person to actually communicate with you and
• 19:10
Speaker 4: see whether they're going to deny your claim or not.
• 19:12
Speaker 4: But you need that real specific denial. It's kind of
• 19:15
Speaker 4: a lunch ap pinned us getting involved where I mean,
• 19:17
Speaker 4: we can get involved before that, but if you haven't
• 19:19
Speaker 4: been denied, we're gonna have to if you hire us,
• 19:22
Speaker 4: you're gonna have to pay a retainer in that kind
• 19:23
Speaker 4: of thing. But when you get actually denied, that's something
• 19:25
Speaker 4: we can do it on contingency fee, which is no
• 19:30
Speaker 4: risk to the client.

• 23:46
  Speaker 4: Peyton Lawfirm dot com. It's p e y t you
• 23:49
Speaker 4: in and when you submit inquiries to the website. It
• 23:53
Speaker 4: doesn't go to an answering service, or you don't get
• 23:58
Speaker 4: a canned response. It goes directly to my email and
• 24:02
Speaker 4: Dad's email, and one of the two of us, or
• 24:04
Speaker 4: sometimes both of us will respond, and we try and
• 24:07
Speaker 4: respond the same day. Sometimes they get put in junk mail.
• 24:09
Speaker 4: It's rare. But if you don't get a response within
• 24:12
Speaker 4: a couple of days, just prompt us with another email
• 24:15
Speaker 4: and we'll get it because we always respond to them.
• 24:17
Speaker 4: We can't necessarily answer all of your questions online, but
• 24:20
Speaker 4: we can give you some basic information and a lot
• 24:23
Speaker 4: of times you don't need anything more than just a
• 24:25
Speaker 4: quick email response, and we don't start to It's just
• 24:28
Speaker 4: like an initial consultation when we get information through the website.
• 24:32
Speaker 4: So we're not going to charge you for emailing basic
• 24:35
Speaker 4: information or some simple equal advice back and forth. We
• 24:38
Speaker 4: all if you're going to hire us for something where
• 24:40
Speaker 4: you got to pay a retainer or an hourly fee,
• 24:43
Speaker 4: where of course going to formalize that and tell you
• 24:45
Speaker 4: what it is before we start start billing. But I
• 24:48
Speaker 4: always encourage people to just don't hesitate to send, you know,
• 24:51
Speaker 4: I find a lot of people are more comfortable sending
• 24:53
Speaker 4: an email versus calling on the phone. It's becoming more
• 24:56
Speaker 4: and more prevalent because some of the younger folks don't
• 24:58
Speaker 4: like to talk on the phone. There's not comfortable with
• 25:00
Speaker 4: it because they've grown up texting each other or emailing.
• 25:07
Speaker 4: Even many of them don't like to email. They like
• 25:09
Speaker 4: to text all the time.
• 25:10
Speaker 2: I'll be honest, if I didn't do talk radio for
• 25:12
Speaker 2: a living, where I had to talk and at least
• 25:14
Speaker 2: try to sort through my somewhat disheveled brain, I don't
• 25:19
Speaker 2: know how well I would be able to communicate in
• 25:20
Speaker 2: general in conversation, because I would never talk otherwise. I mean,
• 25:23
  Speaker 2: it's kind of I think it's a good exercise for
• 25:26
Speaker 2: me to be in talk radio because it allows me
• 25:28
Speaker 2: to communicate. I would be like, because everybody, all of
• 25:31
Speaker 2: my staff, communicates via text. We do so many emails
• 25:33
Speaker 2: and stuff here, it's hard to communicate anymore.
• 25:36
Speaker 4: Well, I'll tell you then it's not. I do an
• 25:38
Speaker 4: awful lot of texting too, of course, and emailing. I mean,
• 25:42
Speaker 4: I go the post office box, I get the mail myself.
• 25:44
Speaker 4: I just like to go get the mail. Gives me
• 25:45
Speaker 4: a break from the office. It's only two minute drive
• 25:48
Speaker 4: from my office, and you never know what's going to
• 25:50
Speaker 4: be in the box. But there's a lot less in
• 25:52
Speaker 4: the box these days than there was ten years ago
• 25:55
Speaker 4: because you hardly get anything from law courts because it's
• 26:01
Speaker 4: all email. Now it's all email. You don't get the
• 26:04
Speaker 4: so you can get a lot more junk mail anything else.
• 26:09
Speaker 4: But yeah, it's just a different dynamic now there, you know.
• 26:12
Speaker 4: Other than being uncomfortable calling, there is I think one
• 26:15
Speaker 4: of the good things about texting and emailing, like through
• 26:17
Speaker 4: the website, is that it's there, like I can read
• 26:21
Speaker 4: it and if you call say well, I'll call you tomorrow,
• 26:23
Speaker 4: I say, okay, I don't have any trials tomorrow. But
• 26:27
Speaker 4: you know, could be in with a client, could be
• 26:28
Speaker 4: on another line, and it might if you don't catch me,
• 26:32
Speaker 4: it could be a little delay where I get a
• 26:34
Speaker 4: chance to return the call. As opposed if you send
• 26:36
Speaker 4: an email in it's right there, and you know, if
• 26:40
Speaker 4: I'm of the evening or early morning and see the email,
• 26:43
Speaker 4: I try and get get it responded whenever I can,
• 26:45
Speaker 4: so I don't have to call you back at dinner
• 26:48
Speaker 4: time or something like that. I can just send you
• 26:49
Speaker 4: the email response and then you have the response in
• 26:51
Speaker 4: writing and if I think we're pretty good communicators at
• 26:54
Speaker 4: the Peyton Law Firm, so you know, hopefully our response
• 26:56
Speaker 4: is fairly clear and you can rely upon that information,
• 26:58
Speaker 4: go back and look at it again and I'll have
• 26:59
Speaker 4: to or remember what the lawyer told you on the phone.
• 27:03
Speaker 4: And of course we got a nice office there, twenty
• 27:07
Speaker 4: oh one First Avenue right on the main Dragon Nitro
• 27:10
Speaker 4: and we're our normal business hours or eight am to
• 27:14
Speaker 4: five pm, and of course we have staff take an
• 27:17
Speaker 4: hour lunch, but they stagger it so there's always somebody
• 27:20
Speaker 4: there all day long. And and if you want to
• 27:22
Speaker 4: stop by the office, that's perfectly fine. Most of our
• 27:25
Speaker 4: staff can. You know, we've got some longevity with staff,
• 27:29
Speaker 4: so if you have some basic common questions, they can
• 27:31
Speaker 4: usually steer you in the right direction. If DAT or
• 27:33
Speaker 4: I are there, we'll be glad to come out and
• 27:35
Speaker 4: chat for a minute and see if we can we
• 27:37
Speaker 4: can help you out. So there's some people love to
• 27:39
Speaker 4: just like to stop by and like to have people
• 27:42
Speaker 4: stop by as well. It's just kind of a hit
• 27:44
Speaker 4: or miss thing because you don't know whether we're going
• 27:45
Speaker 4: to be in with if you don't have an appointment,
• 27:47
Speaker 4: or whether we're going to have the type of time
• 27:49
Speaker 4: that you need to deal with with your issue. But anh,
• 27:52
Speaker 4: they're wrong with that calling emailing or stopping in. It's
• 27:55
Speaker 4: it's real easy and there's never any charge just for
• 27:58
Speaker 4: some basic inquiries or initial consultations, no matter what type
• 28:01
Speaker 4: of issue that you have.
• 28:03
Speaker 2: Yeah, so you can give the Peyton Law Firm a
• 28:04
Speaker 2: call and a lot of times you just need to
• 28:07
Speaker 2: put your mind at ease, or maybe sometimes you need
• 28:09
Speaker 2: to contract the lawyer and to help you take care
• 28:11
Speaker 2: of the problem whatever it is. You need to pick
• 28:13
Speaker 2: up the phone and ask the question first before you
• 28:15
Speaker 2: can determine what that is. And that seven five five
• 28:16
Speaker 2: fifty five fifty six. If you want to call the
• 28:18
Speaker 2: Paytent Law Firm three zero a four seven five five
• 28:20
Speaker 2: fifty six this morning for the next ten minutes or so,
• 28:22
Speaker 2: anyway you can call us. Threes are A four three
• 28:24
Speaker 2: four five fifty eight fifty eight. Three zero four three
• 28:26
Speaker 2: four five fifty eight fifty eight. You mentioned something there,
• 28:28
Speaker 2: and you and Harvey talk about this quite a bit.
• 28:30
Speaker 2: But I've been around long enough in businesses that had
• 28:33
Speaker 2: some maturity to understand just how valuable it is. You
• 28:36
Speaker 2: talk about relatively low turnover for employee rates, and some
• 28:39
Speaker 2: folks that you've had there for a while. The value
• 28:41
Speaker 2: that you get from institutional knowledge from employees that you've
• 28:44
Speaker 2: had for a while, that's been with you is irreplaceable.
• 28:47
Speaker 2: I mean, when you have people that know sort of
• 28:49
Speaker 2: the other side of your mind automatically, that's an efficiency
• 28:52
Speaker 2: of its own, that's right.
• 28:53
Speaker 4: You get better communication. You know, they know the process.
• 28:56
Speaker 4: And here's what like if you come in and call
• 28:58
Speaker 4: and inquire by a will, well, well, here's generally the
• 29:01
Speaker 4: range that it will cost. Now we don't it's not.
• 29:04
Speaker 4: Everybody's will is a little different. So if you call
• 29:08
Speaker 4: our office and say, well, what's it costs for a will? If?
• 29:10
Speaker 4: I mean, there's nothing wrong with shopping around between lawyers
• 29:12
Speaker 4: about prices and and it's it's better than going to
• 29:17
Speaker 4: the hospital the doctor where many times you have no
• 29:20
Speaker 4: clue what the ultimate cost is going to be. But
• 29:23
Speaker 4: we staff is trained not what's going to be X
• 29:26
Speaker 4: amount for sure, because they don't know. And I don't
• 29:29
Speaker 4: know what it's going to cost until you come in
• 29:31
Speaker 4: and meet and talk about it, because I don't know
• 29:33
Speaker 4: what all I'm going to have to do. Because you
• 29:36
Speaker 4: may have an idea. You know, they all, well, I've
• 29:38
Speaker 4: got a disabled child, or have you a grandchild, and
• 29:43
Speaker 4: so I want to know how to handle getting them
• 29:44
Speaker 4: money where it won't be wasted or where it's controlled
• 29:46
Speaker 4: beyond the age they're eighteen. And so we talk about
• 29:49
Speaker 4: that and it you know, may be more more or
• 29:52
Speaker 4: less work, but you know, we we do give you
• 29:54
Speaker 4: a ballpark figure and on a state planning, you know,
• 29:59
Speaker 4: basic power attorney wills. Our process is you come in
• 30:02
Speaker 4: and you need to come in unless you have a
• 30:05
Speaker 4: you know, a mobility issue or something where we have
• 30:07
Speaker 4: to do a conference by phone. You come and meet,
• 30:11
Speaker 4: we talk about your plan. Nine times out of ten,
• 30:14
Speaker 4: we move forward and get the documents done for you
• 30:16
Speaker 4: and you come back an other time. But if you
• 30:18
Speaker 4: meet and they're well, it's going to cost too much
• 30:22
Speaker 4: or you know, I need to think about this, you
• 30:24
Speaker 4: don't have that's an initial consultation. So we don't charge
• 30:27
Speaker 4: for coming in and talking about the state planning initially. Now,
• 30:30
Speaker 4: if you have very very basic questions, we just answer
• 30:32
Speaker 4: them over the phone real quick when your initial call,
• 30:34
Speaker 4: and you don't need to come in if you don't
• 30:36
Speaker 4: actually plan to have any work done so no harm,
• 30:39
Speaker 4: no harm in that. You know, it's one of those things,
• 30:42
Speaker 4: like people get their wills done. They're just just one
• 30:45
Speaker 4: thing they got to knock off their bucket list. And
• 30:47
Speaker 4: you can tell it weighs on their mind and nobody
• 30:49
Speaker 4: likes to think about it. But everybody that you hear,
• 30:55
Speaker 4: hear from community and hear from lawyers on the radio
• 30:57
Speaker 4: that you need to get this done, and you get
• 30:58
Speaker 4: it done, you just feel a lot better. And that's
• 31:00
Speaker 4: a pretty pretty easy process too. But not just a
• 31:03
Speaker 4: state planning private attorneys, other matters we've talked about, just
• 31:07
Speaker 4: a state administration issues, especially making some initial contact with
• 31:13
Speaker 4: a lawyer earlier is better. I've probably had a dozen
• 31:21
Speaker 4: calls this year where people run down and open probate
• 31:24
Speaker 4: on an estate, and then when they call me after
• 31:26
Speaker 4: the fact, once they've already opened the estate and got
• 31:29
Speaker 4: sworn in as either their executor administrator, they realized that
• 31:32
Speaker 4: they really didn't need to open that estate. They've just
• 31:34
Speaker 4: spent money and now they're going to spend time on
• 31:37
Speaker 4: a state administration process that was not really necessary. Oh,
• 31:42
Speaker 4: I said, well, the courthouse told me that I had to.
• 31:44
Speaker 4: But you know, courthouse is a building with people in it.
• 31:47
Speaker 4: And my experience with Canna and Putnam County what you
• 31:51
Speaker 4: think of as the private office, it's called the fiduciary
• 31:53
Speaker 4: supervisor's offices. Those folks are really helpful and they try
• 31:58
Speaker 4: and be helpful, but they're not lawyers and they can't
• 32:00
Speaker 4: give legal advice, and so that you get some I
• 32:03
Speaker 4: would say black and white responses because they can't give
• 32:09
Speaker 4: legal advice and they're not lawyers. And sometimes, you know,
• 32:12
Speaker 4: I pry a little more if you call like well
• 32:13
Speaker 4: what about this? What about that? And then go through
• 32:16
Speaker 4: a process to determine, you know, you don't really need
• 32:18
Speaker 4: to do probate in this particular situation. You can probate later.
• 32:21
Speaker 4: And but but folks just they wait to call as
• 32:25
Speaker 4: to after they get appointed. And then once that, once that,
• 32:30
Speaker 4: once you get a pointed, it's kind of a snowballs
• 32:33
Speaker 4: rolling and you can't really just back out of it
• 32:35
Speaker 4: and retire. So you got to do the you got
• 32:37
Speaker 4: to do the probate process once you get a point
• 32:38
Speaker 4: of it. That's just one of the mere examples where
• 32:40
Speaker 4: kind of earlier on initial contact is better. So if
• 32:43
Speaker 4: you're thinking about, you know, well, no, what a real
• 32:46
Speaker 4: comfortable with this, then don't hesitate to reach out.
• 32:49
Speaker 2: And that's the and that's another part of it as
• 32:52
Speaker 2: well as and we talked about that on the program.
• 32:54
Speaker 2: Before you really have to have a baseline, you have
• 32:56
Speaker 2: to overcome any discomfort that you have. It seems like
• 32:59
Speaker 2: that there are counter programming always running that they try
• 33:02
Speaker 2: to convince people not to access lawyers. You know, oh,
• 33:05
Speaker 2: you're litigious, well you know, I mean, and sometimes that
• 33:09
Speaker 2: might be the case with some people, but also sometimes
• 33:11
Speaker 2: it's people with other motives trying to convince people that
• 33:14
Speaker 2: it's litigious to try to protect themselves, or they think.
• 33:17
Speaker 4: That, you know, calling a lawyer means they're gonna have
• 33:18
Speaker 4: to pay a big retainer, they're going to pay a
• 33:20
Speaker 4: big hourly rate, and that's just not the way we operate.
• 33:22
Speaker 4: If we can answer some basic questions, so some law
• 33:25
Speaker 4: firms may, but that's just not the way we do it.
• 33:27
Speaker 2: That looks like we have one coming on in the
• 33:28
Speaker 2: news line, not the talk line. So if we have
• 33:30
Speaker 2: a couple of minutes left here, if you want to
• 33:31
Speaker 2: give us a call, three zero four three four five
• 33:33
Speaker 2: fifty to fifty eight three zero four three four five
• 33:34
Speaker 2: fifty eight fifty eight is the best the best number
• 33:38
Speaker 2: you can call to get ahold of Tom Payton on
• 33:39
Speaker 2: the Pathon Law firm. You often give us a call
• 33:41
  Speaker 2: this morning.
• 33:42
Speaker 4: Yeah, we do have an interesting issue kind of coming
• 33:45
Speaker 4: down the pipe here in West Virginia. And I think
• 33:47
Speaker 4: we talked about it before, but you know, this issue
• 33:50
Speaker 4: with the with the legislature passed a bill this session
• 33:55
Speaker 4: that's that's into law now saying that the legislature has
• 33:59
Speaker 4: final supervisory authority over state board of education policies and rules.
• 34:05
Speaker 4: But that's interesting because you know we had that well
• 34:08
Speaker 4: it's twenty twenty two or twenty twenty three, there was
• 34:13
Speaker 4: a referendum on amending the Western your Constitution because the
• 34:17
Speaker 4: WESTERNI Constitution has a couple article or sections that specifically
• 34:21
Speaker 4: address public education and who supervises it. And the amendment
• 34:27
Speaker 4: was to change the proposed of it. It was to
• 34:30
Speaker 4: change the westernir constitutional language to vest ultimate authority over
• 34:36
Speaker 4: state board of education policies and rules with the legislature.
• 34:41
Speaker 4: That was turned down pretty much resounding. I not only know,
• 34:45
Speaker 4: but Hecknoah, I think it was around sixty percent against
• 34:49
Speaker 4: and forty percent in favor. And I think per county
• 34:51
Speaker 4: it was like fifty of the fifty five counties voted
• 34:55
Speaker 4: against it, like, all right, well that's the voice of
• 34:57
Speaker 4: the voters, and well the all knowing legislature felt otherwise,
• 35:03
Speaker 4: And so then they just pass a bill this session
• 35:06
Speaker 4: saying that all in essence, in summary, all rules and
• 35:10
Speaker 4: State Board of Education policies must be approved by the
• 35:13
Speaker 4: legislature through some committee and ultimately I think the full
• 35:17
Speaker 4: legislature has to approve any proposed policies or rules. So
• 35:20
Speaker 4: what has happened in the past and what happens a
• 35:22
Speaker 4: lot of times with regulatory agencies like like the State
• 35:26
Speaker 4: Board of Education. They come up with policies or rules
• 35:30
Speaker 4: and then they put them in proper format and send
• 35:33
Speaker 4: them to the Western Secretary of State who registers them.
• 35:35
Speaker 4: And then they're because are the rules going forward? They
• 35:37
Speaker 4: can't conflict with rules aren't valid if they're in direct
• 35:40
Speaker 4: conflict with a statue. Uh, you know, a statue can't
• 35:44
Speaker 4: say A. And then a regulatory body tries to pass
• 35:47
  Speaker 4: a rule it says B. That's the opposite. That's not
• 35:50
Speaker 4: going to not going to fly. But so this time
• 35:54
Speaker 4: when the State Board of Education, I don't know if
• 35:57
Speaker 4: if they kind of reapprove all their policies are every year.
• 36:00
Speaker 4: I don't know enough about the practicalities of it, but
• 36:03
Speaker 4: they endorsed some rules and policies and presented them to
• 36:07
Speaker 4: the Westernian Secretary of State this summer, I think maybe
• 36:10
Speaker 4: just last month, and what happened then Secretary of State
• 36:15
Speaker 4: rejected them. So we can't these are not valid because
• 36:18
Speaker 4: we have a new law now that says that the
• 36:22
Speaker 4: legislature this has to go through the legislature for approval,
• 36:26
Speaker 4: and I think the State Board of Education did that
• 36:31
Speaker 4: on purpose because they're setting up a case in controversy.
• 36:34
Speaker 4: So now I think I read they've they've hired Ben Bailey,
• 36:39
Speaker 4: a local lawyer here in Charles outside council, not a
• 36:44
Speaker 4: government and employee lawyer, to help. But this is going
• 36:49
Speaker 4: to kind of filter through the courts now and we'll
• 36:50
Speaker 4: see how that litigation comes out because the constitution was
• 36:54
Speaker 4: not changed. Well, what does the westerni Constitution say about this?
• 36:58
Speaker 4: And of course, as you as we all know, the
• 37:01
Speaker 4: constitutional language is sometimes I wouldn't say vague, but can
• 37:07
Speaker 4: be rather broad and a lot of the languages rather.
• 37:10
Speaker 2: You can you can interpret the text and not just somewhat.
• 37:13
Speaker 4: Subject to interpretation and that's when you have courts coming
• 37:16
Speaker 4: in for some some interpretation. If it's if it's expressed
• 37:19
Speaker 4: and specific, the courts don't need to get involved. They
• 37:22
Speaker 4: just apply the law as it's set out. But uh,
• 37:25
Speaker 4: it's interesting because the legislatures are relying on language when
• 37:28
Speaker 4: they pass the bill on section one of of the
• 37:33
Speaker 4: Education Article in our Constitution, which says the legislatures shall
• 37:36
Speaker 4: provide by general law for a thorough and efficient system
• 37:40
Speaker 4: of free schools. My question whether they do that at all.
• 37:43
  Speaker 4: I don't think they need to. I mean, I just
• 37:46
Speaker 4: have friends that are teachers, and here in it go
• 37:48
Speaker 4: to information where teachers are begging for supplies or going
• 37:52
Speaker 4: out and buying them themselves. I mean, to me, that's ridiculous.
• 37:56
Speaker 2: I mean I've heard everything from that to like certain
• 37:58
Speaker 2: vetted subjects being like getting in trouble for teaching like
• 38:01
Speaker 2: certain sciences and stuff. I mean, I've heard all times.
• 38:04
  Speaker 4: That's the problem.
• 38:05
  Speaker 2: I mean.
• 38:06
Speaker 4: The underpinnings of the avesting the general supervision by the
• 38:12
Speaker 4: time general supervision with the State Board of Education is
• 38:15
Speaker 4: that it would be a political and the Constitution does
• 38:18
Speaker 4: set out specific members that have to be appointed from
• 38:22
Speaker 4: each political party, and that kind of thing. But maybe
• 38:23
Speaker 4: we'll fill up on that next BEE because it's an
• 38:25
  Speaker 4: interesting subject.
• 38:25
  Speaker 2: It is.
• 38:26
Speaker 4: They haven't foiled the lawsuit over it yet, but I
• 38:28
Speaker 4: want to monitor it because I think it'll have a
• 38:32
Speaker 4: significant effect on the public and the and the public
• 38:35
Speaker 4: education system, depending on which way it gets. Yeah, I am.
• 38:38
Speaker 2: I was planning on putting my kid back into public
• 38:40
Speaker 2: school this year, and now we're doing homeschooling for at
• 38:42
Speaker 2: least another year because I don't really want legislature education.
• 38:46
  Speaker 4: No, I think it's dangerous.
