• 0:50
Speaker 1: and within the SBI. I've been on dozens of those
• 0:54
Speaker 1: scenes and within major crimes of SBI, we've worked a
• 0:57
Speaker 1: variety of cases. I work anything from violent crime, homicide,
• 1:01
Speaker 1: sex crimes, drug crimes, firearm crimes, white collar crime, fraud.
• 1:05
Speaker 1: I was also on a task force with an FBI,
• 1:08
Speaker 1: a public corruption task force as well. Question, was all
• 1:12
Speaker 1: of that on the job training or did you receive
• 1:14
Speaker 1: specific training or conferences, things like that? Answer, yeah, throughout
• 1:19
Speaker 1: the years, various trainings, conferences, and all those capacities over
• 1:23
Speaker 1: the years. Question, you mentioned that you've been part of
• 1:25
Speaker 1: homicide investigations. Answer, yes. Question, can you estimate how many? Answer,
• 1:31
Speaker 1: my guess would be 60 plus, where I've had some involvement.
• 1:35
Speaker 1: I'm currently working on a cold case unit within SBI,
• 1:38
Speaker 1: so we consult with agencies around the state of Utah,
• 1:41
Speaker 1: and I've probably consulted over 50 of those, as well
• 1:44
Speaker 1: in various capacities and roles. Question, have you received training
• 1:49
Speaker 1: specific to homicide investigations? Answer, yes, I have. Question, what
• 1:53
Speaker 1: types of things have you been trained on in that regard? Answer,
• 1:57
Speaker 1: just several different times, week-long courses, training conferences on homicides,
• 2:01
Speaker 1: from case studies to how to manage a case. Also,
• 2:05
Speaker 1: I've been on several trainings with crime scene investigation. I'm
• 2:08
Speaker 1: a pharaoh certified. It's a 3D pharaoh scan of crime scenes. Question,
• 2:13
  Speaker 1: what's a pharaoh scan? Answer, it's a 3D laser imaging
• 2:17
Speaker 1: that's used pretty commonly on crime scenes. It just accurately
• 2:20
Speaker 1: documents crime scenes. I've been certified as a forensic interviewer
• 2:25
Speaker 1: and forensic interview technique with more child victims. So just
• 2:28
Speaker 1: various trainings like that. Question, you mentioned currently that you're
• 2:31
Speaker 1: part of the Cole case team within SBI. Answer, correct. Question,
• 2:36
Speaker 1: have you been assigned as part of the investigation into
• 2:38
Speaker 1: the homicide of Charlie Kirk? Answer, yes. Question, and what's
• 2:43
Speaker 1: your role? Do you have a specific role in the investigation? Answer, yeah.
• 2:47
Speaker 1: I was assigned to be a case agent along with
• 2:49
Speaker 1: Dave Hull. Question, what does it mean to be a
• 2:52
Speaker 1: case agent? Answer, essentially you manage the case. Responsibility for it. Ultimately,
• 2:57
Speaker 1: you direct cases as you go along. You make assignments
• 3:00
Speaker 1: as needed. Ultimately, everything comes back to you in the
• 3:03
Speaker 1: form of reports, evidence, and such. And then ultimately, when
• 3:06
Speaker 1: you screen the case, if applicable, to the appropriate county, attorney,
• 3:10
Speaker 1: or DA. Question, you mentioned that you're a co-case agent,
• 3:15
Speaker 1: or were, with Agent Hull. Is it typical to have
• 3:18
Speaker 1: two case agents on a case? Answer, it can be,
• 3:21
Speaker 1: especially on a large case, yes. Question, has this particular
• 3:25
Speaker 1: case been large? Answer, yes, it has. Question, have other
• 3:29
Speaker 1: police agencies been involved in the investigation of the case? Answer, yes. Question,
• 3:34
Speaker 1: who has been designated as the primary investigative agency? Answer,
• 3:38
Speaker 1: the State Bureau of Investigation is the primary investigating agency. Question,
• 3:43
Speaker 1: I know that there are probably several or dozens, but
• 3:46
Speaker 1: what other agencies have you been working with? Answer, FBI,
• 3:50
Speaker 1: ATF as well. several local state agencies, UVU police, Orem police,
• 3:55
Speaker 1: Utah County Sheriff, Washington County Sheriff, St. George PD, most
• 4:00
Speaker 1: of all the agencies within Utah County, and even others
• 4:03
Speaker 1: outside the county. So we've worked with a lot of
• 4:06
Speaker 1: agencies in the case. It was a pretty large-scale investigation. Question,
• 4:11
Speaker 1: you mentioned ATF. What does that stand for? Answer, alcohol, tobacco,
• 4:15
Speaker 1: and firearms. Question, all right. I know a lot about
• 4:18
Speaker 1: what we've, so as a case agent, Have you been
• 4:21
Speaker 1: in court during this prelim hearing? Answer, yes. Question, you've
• 4:25
Speaker 1: heard prior testimony? Answer, yes. Question, we've talked a lot
• 4:29
Speaker 1: about the events of September 10th of 2025. I want
• 4:33
Speaker 1: to redirect your attention to September 11th, 2025. Do you
• 4:36
Speaker 1: remember that day? Answer, I do. Question, what happened on
• 4:40
Speaker 1: that day in relation to your investigation? Answer, I spent
• 4:44
Speaker 1: the day at command post with various assignments. That evening,
• 4:47
  Speaker 1: it was about 8.30 p.m. I believe... Of the 11th,
• 4:51
Speaker 1: I received a phone call from Sergeant Elsholes requesting that
• 4:54
Speaker 1: I travel to St. George. Question, who is Sergeant Elsholes?
• 4:58
Speaker 1: What agency is Sergeant Elsholes with? Answer, the SBI. Question,
• 5:04
Speaker 1: and when he requested that you travel to St. George? Answer, correct. Question,
• 5:09
Speaker 1: what was the reason stated for that? Answer, we received
• 5:13
Speaker 1: information that an individual was turning himself in or was
• 5:16
Speaker 1: going to turn himself in to police in regard to
• 5:18
Speaker 1: his involvement with the incident. The shooting on UVU campus. Question,
• 5:23
Speaker 1: I'm sorry, what time did you get that information, that call? Answer,
• 5:26
Speaker 1: about 8.30. Question, did you travel down to St. George? Answer,
• 5:30
Speaker 1: I did. Question, on what day? Answer, on September 11th. Question,
• 5:35
Speaker 1: did anyone else go with you? Answer, yeah. So we
• 5:38
Speaker 1: traveled to Salt Lake City Airport to a hangar there
• 5:42
Speaker 1: and we were flown down on a fixed wing aircraft.
• 5:44
Speaker 1: It was Sergeant Elsholz. It was Agent Folger with the FBI.
• 5:48
Speaker 1: Agent Anderson with FBI, Ryan McBride, and myself, and two pilots. Question,
• 5:54
Speaker 1: and who is Ryan McBride? Answer, with the Utah County's
• 5:56
Speaker 1: Attorney's Office. Question, what time did you arrive? In St. George. Answer,
• 6:01
Speaker 1: we landed probably about 11.30 p.m. at the St. George Airport.
• 6:06
Speaker 1: Question again, this would be the evening of September 11th, 2025? Answer,
• 6:10
Speaker 1: that's correct. Question, where did you go once you landed
• 6:14
Speaker 1: in St. George? Answer, there we were transported via ground
• 6:18
Speaker 1: to the Washington County Sheriff's Department. Question, did you coordinate
• 6:22
Speaker 1: at that time with any other law enforcement agency down
• 6:25
Speaker 1: in Southern Utah? Answer, we did. Question, you did. Answer,
• 6:29
Speaker 1: we did, yeah. Question, what other agencies? Answer, well, with
• 6:33
Speaker 1: FBI as we traveling and then along with mainly the
• 6:37
Speaker 1: Washington County Sheriff's Department. We also have agents with an
• 6:40
Speaker 1: FBI assigned to the Southern Utah area. So working with
• 6:44
Speaker 1: them as well. Just making sure plans and coordinating resources
• 6:48
Speaker 1: and manpower and personnel. Question and you stated you went
• 6:52
Speaker 1: to the Washington County Sheriff's Office. Answer, yes. Question, what
• 6:55
Speaker 1: time did you arrive there? Answer, probably somewhere close to midnight.
• 6:59
Speaker 1: Maybe just a little bit before midnight of the 11th. Question,
• 7:03
Speaker 1: what happened next? Answer, so we met several other investigators,
• 7:07
Speaker 1: agents and detectives there along with some other prosecutors. There
• 7:11
Speaker 1: were federal prosecutors as well that were present. And from there,
• 7:15
Speaker 1: we began kind of making plans, determining how to handle
• 7:19
Speaker 1: the situation there. Question, you mentioned the reason you went
• 7:22
Speaker 1: down there was you had been told that an individual
• 7:25
Speaker 1: wanted to turn themselves in. Answer, that is correct. Question,
• 7:28
Speaker 1: did you observe the individual? Answer, I did. Question, and
• 7:32
Speaker 1: where was the person at the time? Answer, so when
• 7:35
Speaker 1: he arrived, we went into the room that we were in.
• 7:38
Speaker 1: It was one of their offices, the cubicles there. On
• 7:42
Speaker 1: the wall, there was a television monitor. where I viewed
• 7:45
Speaker 1: an individual on the screen that was sitting in one
• 7:48
Speaker 1: of the soft interview rooms. That room was equipped with
• 7:52
Speaker 1: audio-video recording device, and so I observed him on the
• 7:55
Speaker 1: screen at the time. Question, were you aware or did
• 7:58
Speaker 1: you become aware? What time that individual arrived at Washington
• 8:02
Speaker 1: County Sheriff's Office? Answer, I was told that he arrived
• 8:07
Speaker 1: about 9 p.m. that evening. Answer, and was he with
• 8:10
Speaker 1: anybody else? Answer, yeah. He had come with his parents
• 8:13
Speaker 1: and a family friend. Question, did you speak with the
• 8:16
Speaker 1: individual that we've been talking about? Answer, yes, I did. Question,
• 8:20
Speaker 1: and did you get his name? Answer, yes, we obtained
• 8:24
Speaker 1: his name and date of birth. Question, what was his name? Answer,
• 8:28
Speaker 1: Tyler Robinson. Question, did he tell you that himself? Answer,
• 8:33
Speaker 1: he did. Question, you mentioned other individuals came there with him.
• 8:38
Speaker 1: And then you also said that you kind of coordinated
• 8:41
Speaker 1: with the team of law enforcement officers that were there.
• 8:44
Speaker 1: Were those other individuals spoken with by law enforcement? Answer,
• 8:48
Speaker 1: they were. Question, let's go through them, or I guess
• 8:51
Speaker 1: how did that happen? Who was spoken to first of
• 8:54
Speaker 1: the other individuals? Answer, so Tyler's mother was interviewed by
• 8:59
Speaker 1: SBI agent Holgren and FBI agent Cox, and then kind
• 9:03
Speaker 1: of simultaneously his father was being interviewed by SBI agent
• 9:07
Speaker 1: Terry and FBI agent Smith. Also at that time, the
• 9:11
Speaker 1: family friend Mike Mitchell was interviewed by by other agents
• 9:15
Speaker 1: as well. Question, and you said that these interviews were
• 9:18
Speaker 1: being conducted simultaneously? Answer, yes. Question, were you part of
• 9:22
Speaker 1: the interview with either of Tyler's parents? Answer, yes. Yes,
• 9:26
Speaker 1: myself and Agent Folger. Did I misspeak earlier? Myself and
• 9:29
Speaker 1: Agent Folger interviewed the mother. Question, all right, let's just
• 9:34
Speaker 1: make sure that the record's clear on that. So, Agent Folger,
• 9:36
Speaker 1: what agency is he with? Answer, with the FBI. Question,
• 9:41
Speaker 1: and yourself interviewed Tyler's mother? Answer. Yes, that's correct. Question.
• 9:46
Speaker 1: I just want to make sure that the record's clear.
• 9:48
Speaker 1: Who interviewed Tyler's father? Answer. Yeah, I think I might
• 9:51
Speaker 1: have misspoke. It was Agent Holgren, Agent Cox, that met
• 9:54
Speaker 1: with his father. Question. And then who spoke with the
• 9:57
Speaker 1: family friend, Mike Mitchell? Answer, Agent Terry Smith. Question, down
• 10:02
Speaker 1: in St. George, Washington County Sheriff's Office, was Mr. Robinson
• 10:06
Speaker 1: detained at the time? Answer, yes, he was. Question, was
• 10:09
Speaker 1: he formally arrested at that time? Answer, yeah, after all
• 10:13
Speaker 1: the interviews were completed and we talked to everybody, that
• 10:16
Speaker 1: he was formally arrested at that time. Question, I'm going
• 10:19
Speaker 1: to come back to that in a second. Well, excuse me,
• 10:22
Speaker 1: where did the arrest take place? Answer, at the Washington
• 10:25
Speaker 1: County Sheriff's Office. Question, what date did that happen on? Answer,
• 10:30
Speaker 1: it would have been September 12th, at about 4am, I believe,
• 10:33
Speaker 1: of September 12th. Answer, alright, I want to show just
• 10:37
Speaker 1: on your screen, not for the public yet, what's been
• 10:40
Speaker 1: marked for identification as State Exhibit 15. Let me know
• 10:43
Speaker 1: when you're able to see that. Answer, okay, it's there. Question,
• 10:48
Speaker 1: before I ask you about that, did you have an
• 10:50
Speaker 1: opportunity to, you stated that you observed Mr. Robinson at
• 10:54
Speaker 1: Washington County Sheriff's Office, is that right? Answer, yes, that's correct.
• 10:58
Speaker 1: And to this, the defense jumps in. Your Honor, could
• 11:02
Speaker 1: I have a moment with Ms. Hunt? May I have
• 11:04
Speaker 1: a moment with Ms. Hunt? Judge Graff, you may. You're
• 11:07
Speaker 1: just going to do the redacted version, thank you. Defense.
• 11:12
Speaker 1: That may happen a couple more times as we go
• 11:14
Speaker 1: through exhibits because of agreements and disagreements that we have.
• 11:18
Speaker 1: Judge Graff, thanks for the heads up. Question. At Washington
• 11:22
Speaker 1: County Sheriff's Office, where you initially observed Mr. Robinson, you
• 11:25
Speaker 1: stated that he was in a room. Is that room
• 11:28
Speaker 1: equipped with video recording? Answer. Yes, it is. Question. Is
• 11:31
Speaker 1: that standard practice for a facility like that to have
• 11:35
Speaker 1: video recording in such a room? Answer. Yeah, very common. Question.
• 11:39
Speaker 1: Have you reviewed that video? Answer. I have. Question, and
• 11:42
Speaker 1: in your review of that video, does it fairly and
• 11:45
Speaker 1: accurately depict Mr. Robinson at the time? Answer, it does. Question,
• 11:51
Speaker 1: you see on your screen that's been marked as State
• 11:53
Speaker 1: Exhibit 15, do you recognize that? Answer, I do. Question,
• 11:57
Speaker 1: what is it? Answer, the interview in which Mr. Robinson
• 12:01
Speaker 1: was seated and waiting. Question, State moves to admit Exhibit 15.
• 12:07
Speaker 1: Judge Graff, Ms. Hunt, and the other two steps, what's
• 12:10
Speaker 1: your request? Answer, O. We'd ask to admit it into evidence.
• 12:15
Speaker 1: We have defense counsel, and I have agreed upon, I guess,
• 12:18
Speaker 1: redaction of the video, and I would ask to publish it,
• 12:20
Speaker 1: both to the courtroom and to the media. Judge Graff, defense? Defense.
• 12:27
Speaker 1: It's silent, correct? Prosecution, yes. Defense, yes, Your Honor. Ms.
• 12:31
Speaker 1: Hunt is correct. The state had originally proposed a longer
• 12:34
Speaker 1: image with audio, and we've agreed to a shorter image
• 12:38
Speaker 1: with no audio. Prosecution, that's correct, yeah. Defense. So we're
• 12:43
Speaker 1: fine with all three steps as to this exhibit. Question.
• 12:49
Speaker 1: By the judge. All right. Does the state wish to
• 12:51
Speaker 1: review this to make sure that's queued up? Comports with
• 12:54
Speaker 1: what you believe? If not, we can move forward. I
• 12:56
Speaker 1: just want to allow all parties the opportunity to double check. Prosecution.
• 13:01
Speaker 1: Let me just confer with my paralegal. It has no audio,
• 13:04
Speaker 1: so I would like to admit and publish it at
• 13:07
Speaker 1: this time. Judge Graff. All right, state exhibit 15 is
• 13:11
Speaker 1: admitted pursuant to discussion and may be published in the
• 13:14
Speaker 1: courtroom and may be recorded or transmitted electronically. Defense, your honor,
• 13:20
Speaker 1: of course, this is subject to all of the objections
• 13:23
Speaker 1: which have previously been reserved in writing and reiterated over
• 13:27
Speaker 1: the last couple of days. I assume that we don't
• 13:29
Speaker 1: need to start over with that today. Judge Graff, thank you.
• 13:33
Speaker 1: I appreciate that. I note the standing objection by defense
• 13:37
Speaker 1: as previously made. and that objection is overruled, and this
• 13:40
Speaker 1: exhibit is admitted. Defense, in this case, it wouldn't be
• 13:43
Speaker 1: 1102 issues. It would be the electronic media coverage of
• 13:46
Speaker 1: the proceeding. Judge Graff, thank you for the clarification. I
• 13:50
Speaker 1: appreciate that. All right, with that, to the media, can
• 13:53
Speaker 1: you view that screen okay? All right, all right, states
• 13:56
Speaker 1: exhibit 15 may be played. All right, folks, we're going
• 13:59
Speaker 1: to wrap up right here, and in the next episode
• 14:01
Speaker 1: dealing with the topic, we're going to pick up where
• 14:03
Speaker 1: we left off. All the information that goes with this
• 14:06
Speaker 1: episode can be found in the description box.
