- 0:00Speaker 1: What's up everyone, and welcome back to the program. Brian
- 0:04Speaker 1: Colberger and his team have decided that it's time to
- 0:08Speaker 1: launch their alternate suspect theory and file it with the court. However,
- 0:15Speaker 1: we don't have any information as the public yet as
- 0:18Speaker 1: to who this so called alternate suspect or suspects are,
- 0:22Speaker 1: so that's kind of a mystery as of now, and
- 0:25Speaker 1: according to the court documents, it's been sealed, so we're
- 0:30Speaker 1: not going to have any idea of who this alternate
- 0:33Speaker 1: suspect is at least for now. And honestly, this shouldn't
- 0:38Speaker 1: come as a shock to anybody. Brian Colberger's team has
- 0:41Speaker 1: been positing this for quite some time, and now that
- 0:44Speaker 1: everything else they've tried has failed, it's time to unleash
- 0:48Speaker 1: the final Hail Mary, and that is to try and
- 0:51Speaker 1: muddy the waters a bit by introducing this so called
- 0:55Speaker 1: mystery alternate suspect. Now, of course, Judge Hipler isn't just
- 0:59Speaker 1: going to accept Brian Colberger's word. They're going to have
- 1:03Speaker 1: to proffer evidence now that they filed this document, and
- 1:06Speaker 1: they're gonna have to show some proof of their alternate
- 1:10Speaker 1: suspect theory. And if they don't show any proof of it. Obviously,
- 1:14Speaker 1: Judge Hipler is going to tell them to kick rocks.
- 1:17Speaker 1: And I think you're going to see a lot more
- 1:18Speaker 1: of this moving forward in criminal cases in general, considering
- 1:23Speaker 1: how successful Karen Reid has been with her crazy ass
- 1:26Speaker 1: concocted story that John O'Keefe was jumped by a bunch
- 1:31Speaker 1: of police and ex police officers inside that home. And
- 1:35Speaker 1: there's been some traction, right, And the reason there's been
- 1:39Speaker 1: some traction, in my opinion, is because the investigation was
- 1:42Speaker 1: so porous, was so bad that it opened the door.
- 1:46Speaker 1: Now we haven't seen that here. However, with the new leaks,
- 1:50Speaker 1: it gives them a little bit of tread and it
- 1:52Speaker 1: gives them some tenable ground. Now, do I think they're
- 1:55Speaker 1: going to have the same kind of effect that we
- 1:58Speaker 1: saw in Massachusetts with Alan Jackson and mister Yanetti. No,
- 2:03Speaker 1: but it certainly gives Brian Colberger at least some kind
- 2:06Speaker 1: of defense, because short of this, I don't know how
- 2:10Speaker 1: anyone could think that Brian Colberger has any kind of
- 2:12Speaker 1: shot of getting off. Now, there might be some discipline
- 2:17Speaker 1: coming to the prosecution over the leaks, and if that's
- 2:20Speaker 1: the case, then Colberger might escape the death penalty. But
- 2:24Speaker 1: I don't know how anyone could possibly think with the
- 2:26Speaker 1: evidence we've seen that Brian Colberger is going to beat
- 2:29Speaker 1: these charges because it's certainly not looking good for him.
- 2:33Speaker 1: So what do you do when you're down by three
- 2:35Speaker 1: touchdowns and times running out? You throw that hell, Mary right.
- 2:41Speaker 1: Today's article is from Delhimel and the headline I had
- 2:45Speaker 1: a whole murder bombshell. Brian Colberger names another suspect. This
- 2:50Speaker 1: article was authored by Rachel Sharp. Brian Colberger is named
- 2:54Speaker 1: an alternate suspect who he claims is the real killer
- 2:57Speaker 1: of the University of Idaho's students in a bomb shell
- 3:00Speaker 1: move just weeks before he goes to trial for his life.
- 3:05Speaker 1: The quadruple homicide suspect returned to the courtroom in Ada County,
- 3:08Speaker 1: Idaho on Thursday morning, where a judge Stephen Hipler is
- 3:12Speaker 1: expected to make a series of last ditch decisions that
- 3:15Speaker 1: will shape his looming capital murder trial this summer. In
- 3:19Speaker 1: an eleventh hour move to save him from the firing squad,
- 3:22Speaker 1: the thirty year old suspected killers defense took the explosive
- 3:26Speaker 1: step of pointing the finger at another suspect. I don't
- 3:30Speaker 1: really think it's that explosive. The fact that he filed
- 3:33Speaker 1: it finally cool, that's great, But this is something that
- 3:37Speaker 1: I think anybody who is seasoned and who follows this
- 3:40Speaker 1: sort of thing expected. Brian Colberger said from the very beginning,
- 3:44Speaker 1: it wasn't him, So that automatically means there's an alternate suspect. Right, So,
- 3:50Speaker 1: where's the big bombshell? Now, if you gave it a name
- 3:53Speaker 1: up and you said so and so's the person, Yeah,
- 3:56Speaker 1: that's a big bombshell. But just filing the motion that
- 4:00Speaker 1: was expected. The question is what does Brian Cooberger have
- 4:04Speaker 1: to back up what he's saying. Who this suspect is
- 4:09Speaker 1: and what evidence the defense has that could tie them
- 4:12Speaker 1: to the brutal murders remains a mystery. The judge ordered
- 4:15Speaker 1: that the filing remains under seal, keeping it cloaked in
- 4:18Speaker 1: secrecy until trial. The Criminology PhD students defense team has
- 4:24Speaker 1: previously revealed plans to argue that he was framed and
- 4:27Speaker 1: that two killers must have committed the shocking crime. And
- 4:32Speaker 1: of course we all know that people are out here
- 4:34Speaker 1: saying that it was the two roommates Bethany and Dylan
- 4:37Speaker 1: who were involved and look, that makes for a great story,
- 4:40Speaker 1: right and as a content creator, that would be gold
- 4:44Speaker 1: something like that happens.
- 4:45Speaker 2: Forget it. I just don't believe it's true.
- 4:48Speaker 1: And I'm not going to sit here and pump some bullshit,
- 4:50Speaker 1: you know, into your tires and tell you folks, oh yeah, this,
- 4:53Speaker 1: this and this if I don't feel it's true, just
- 4:56Speaker 1: to get clicks. There's plenty other people that are out
- 4:59Speaker 1: there that are going to pitch you some bullshit. We're
- 5:01Speaker 1: not gonna do that here. What I will say is this,
- 5:05Speaker 1: I am more than willing to look at whatever evidence
- 5:07Speaker 1: Brian Colberger has. As I've said before, I don't just
- 5:11Speaker 1: believe the government. I believe the evidence. And if Colberger
- 5:15Speaker 1: has some evidence saying somebody else did this, let's see it.
- 5:22Speaker 1: Judge Hipler gave Colberger's attorneys a deadline of May twenty
- 5:25Speaker 1: third to hand over whatever actual evidence you have that
- 5:29Speaker 1: supports those allegations other than just allegations. So in court, right,
- 5:35Speaker 1: Brian Colberger, he doesn't have to prove anything. The burden
- 5:38Speaker 1: of proof is on the state. But the second that
- 5:41Speaker 1: you start talking about alternate suspects, that changes things a bit.
- 5:44Speaker 1: Now you have to show the court some evidence as
- 5:47Speaker 1: to why so and so should be involved. You can't
- 5:50Speaker 1: just say Tom Dick and Harry did it from down
- 5:52Speaker 1: the block. The judge is going to ask you what
- 5:54Speaker 1: evidence you have and if you say trust me, bro,
- 5:58Speaker 1: well we all know how that's gonna work. So they
- 6:00Speaker 1: better have some evidence to back up what they're saying.
- 6:03Speaker 1: And during that last hearing, Judge Hipler wasn't playing with
- 6:05Speaker 1: either side. He told them both they better not be
- 6:08Speaker 1: playing games and they better have the evidence to back
- 6:11Speaker 1: up the things that they're saying. He also ordered the
- 6:14Speaker 1: defense to provide for me how it is you believe
- 6:18Speaker 1: that what you're offering is admissible at trial. The state
- 6:22Speaker 1: will then have until June sixth to respond to the
- 6:25Speaker 1: defense claims before the two sides battle it out in
- 6:29Speaker 1: a hearing later that month. The judge will then rule
- 6:32Speaker 1: whether or not the jury can hear about this alternate
- 6:35Speaker 1: suspect that trial. And I can tell you right now,
- 6:39Speaker 1: all these goofy ass content creators are praying every night
- 6:42Speaker 1: that that's the case. They want another Karen Reid type
- 6:46Speaker 1: deal more than you can imagine. They want it to
- 6:49Speaker 1: be a circus. They want this to be thrown into chaos.
- 6:52Speaker 1: That's what they want and that's why they pitch all
- 6:55Speaker 1: this alternate bullshit. But the facts are what they are,
- 6:58Speaker 1: and wherever the facts leader us is where we're going
- 7:01Speaker 1: to go. And so far, what I can tell you,
- 7:05Speaker 1: and I can say this definitively, is I have seen
- 7:07Speaker 1: zero evidence of any alternate suspect, not one bit of it.
- 7:12Speaker 2: Now.
- 7:13Speaker 1: Of course, that doesn't mean that it doesn't exist. I'm
- 7:16Speaker 1: just telling you from my own experience covering this story
- 7:19Speaker 1: from literally the day after it happened, I haven't seen
- 7:23Speaker 1: one bit of evidence that points me to anybody else
- 7:26Speaker 1: but Brian Coolberger, Now, is there a big frame job happening.
- 7:30Speaker 1: I'll let you be the judge of that, but you
- 7:32Speaker 1: all know how I feel about those kinds of big claims, right.
- 7:36Speaker 1: If you're making big claims, you better have big evidence.
- 7:39Speaker 1: And if you don't, well we're not starting off on
- 7:41Speaker 1: the right foot. The explosive move from Coburger's team comes
- 7:45Speaker 1: less than a week after Bombshell. New details emerged in
- 7:49Speaker 1: the case, including his phone calls to a family member
- 7:52Speaker 1: after the murders, his chilling porn choices, and disturbing online
- 7:56Speaker 1: searches about serial killer Ted Bundy Colberger is facing the
- 8:01Speaker 1: death penalty if convicted of the brutal murders of Kailee Gonsalvez,
- 8:05Speaker 1: Madison Mogan, Xana Kernodle, and Ethan Chapin, which is in
- 8:09Speaker 1: jeopardy at this point in my opinion because of the leaks.
- 8:13Speaker 1: That's something to keep in mind, and I think that
- 8:15Speaker 1: it has some legs considering the penalty we saw with
- 8:18Speaker 1: Lori Vaalo and the prosecution slow walking evidence and discovery
- 8:23Speaker 1: in Idaho. So there's precedent for that already. And when
- 8:26Speaker 1: there's precedent, well, we all know how the courts love that.
- 8:30Speaker 1: Before University Idaho students were all slaughtered in Ahura knife
- 8:34Speaker 1: attack in the early hours of November thirteenth, twenty twenty two,
- 8:39Speaker 1: inside an off campus student home at eleven twenty two
- 8:42Speaker 1: King Rhoad in Moscow, Idaho that the three women shared
- 8:46Speaker 1: with two other roommates. The two roommates, Bethany Funk and
- 8:50Speaker 1: Dylan Mortenson, survived, with Mortensen coming face to face with
- 8:54Speaker 1: the mass killer inside the home that haunting Knight. On
- 8:58Speaker 1: December thirtieth, twenty twenty two, around six weeks from the massacre,
- 9:02Speaker 1: Colberger was arrested at his parents' home in all Brightsville, Pennsylvania,
- 9:06Speaker 1: and charged with the murders. He stood silent at his arraignment,
- 9:10Speaker 1: and a not guilty plea was entered on his behalf. Now,
- 9:14Speaker 1: after more than two years of delays and legal wrangling,
- 9:18Speaker 1: including the trial being moved to another county, the suspected
- 9:22Speaker 1: killer who struck terror into the heart of a safe,
- 9:25Speaker 1: tight knit college town is finally heading to trial. And
- 9:29Speaker 1: this is what I mean when I say Coburger has
- 9:31Speaker 1: gotten a fair shake. Then you changes delays, you name it.
- 9:35Speaker 1: So anybody saying that Colberger isn't getting a fair shake
- 9:39Speaker 1: is bullshitting. And if you don't believe me, just ask
- 9:42Speaker 1: El Choppo or El Mayo how they're being treated. Jerry
- 9:47Speaker 1: selection is slated to begin July thirtieth, with a trial
- 9:51Speaker 1: getting underway August eleventh. During Thursday's hearing, the judge began
- 9:55Speaker 1: by going through the nuts and bolts of how the
- 9:57Speaker 1: trial will take shape and warning both sides that he
- 10:01Speaker 1: doesn't want evidence issues to crop up and cause delays
- 10:05Speaker 1: once it is underway. Judge Hipler's not messing around, and
- 10:09Speaker 1: both sides better understand that Judge Hipler is not the
- 10:12Speaker 1: one to play with. We're not talking about Judge Beverly
- 10:16Speaker 1: Canoni here, of folks. I'm not a fan of surprises,
- 10:20Speaker 1: as you may have figured out by now, he warned.
- 10:22Speaker 1: The judge outlined jury selection process, revealing he plans to
- 10:26Speaker 1: have aid alternates as opposed to the typical number of six,
- 10:31Speaker 1: taking the full panel up to twenty. He said he
- 10:34Speaker 1: would not go into specific details about the jury questionnaires
- 10:38Speaker 1: and instructions during the public hearing so as not to
- 10:41Speaker 1: impact potential panelists. However, what potential jurors know about the case,
- 10:46Speaker 1: their views on the death penalty, and any media bias
- 10:49Speaker 1: they may have will all be key questions in selecting
- 10:53Speaker 1: the jury. The judge said that he does not intend
- 10:56Speaker 1: to sequester the jury, but that could change if necessary
- 11:00Speaker 1: once the trial gets underway. He also warmed both sides
- 11:04Speaker 1: that if they bump into any members of the jury
- 11:06Speaker 1: outside of court during the trial, to run the other
- 11:09Speaker 1: away and report it. The jury selection process will not
- 11:13Speaker 1: be live streamed, but the rest of the trial will be.
- 11:16Speaker 1: And you know what, I think we're going to live
- 11:18Speaker 1: stream this trial, considering it's being broadcast right from the
- 11:23Speaker 1: actual live stream of the courthouse. I think we might
- 11:27Speaker 1: just dive in and live stream this mofo as it happens.
- 11:31Speaker 1: I think that's going to be the only way to
- 11:33Speaker 1: really have a handle on everything that goes down in
- 11:36Speaker 1: that courtroom. So that's the way I'm leaning right now.
- 11:40Speaker 1: And I'm not usually big on live streams, but with
- 11:43Speaker 1: something like this, your boy is willing to make an exception.
- 11:46Speaker 1: And also, like I was saying, I'm going to be
- 11:49Speaker 1: heading up to Idaho for at least a little bit
- 11:51Speaker 1: of this trial. Whether it's during the ending or the
- 11:55Speaker 1: middle or whatever. I haven't decided yet, but you're a
- 11:58Speaker 1: boy will be at this trial at some point. Prosecutor
- 12:02Speaker 1: of Bill Thompson asked the judge for the live stream
- 12:04Speaker 1: video to be turned off for a number of the witnesses,
- 12:07Speaker 1: such as their surviving roommates, as well as members of
- 12:10Speaker 1: law enforcement whose identity should remain secret. The judge agreed
- 12:15Speaker 1: that his victims, Mortensen and Funk, can have their faces
- 12:18Speaker 1: shielded during the testimony if they wish. Seating will also
- 12:22Speaker 1: be reserved for the two survivors, as well as the
- 12:25Speaker 1: victims' families and Coburger's immediate family members in the courtroom
- 12:29Speaker 1: for the duration of the trial. Well, that's fair. Brian
- 12:33Speaker 1: Colberger is not guilty yet. He should have his family there, right,
- 12:37Speaker 1: he should have whatever support system is willing to come out.
- 12:40Speaker 1: So I'm glad to hear that Cohburger will have some
- 12:43Speaker 1: seats for his people. If Coleburger is convicted of the murders,
- 12:46Speaker 1: the penalty phase, where the jury will decide whether or
- 12:49Speaker 1: not to send him to death row, will likely start
- 12:52Speaker 1: the next day, the judge said. Jurors will be sequestered
- 12:55Speaker 1: for that phase. The judge also revealed that issues about
- 12:59Speaker 1: a potential violation of the gag order has been raised
- 13:03Speaker 1: during closed door hearing earlier Thursday. A gag order of
- 13:07Speaker 1: some sorts, known as a non dissemination order, has been
- 13:11Speaker 1: in place since the early days of this case. It
- 13:14Speaker 1: bands attorneys representing parties, victims, or witnesses from speaking about
- 13:20Speaker 1: the case in a way that could have a substantial
- 13:23Speaker 1: likelihood of materially prejudicing or otherwise influencing the outcome of
- 13:28Speaker 1: the case. It's not clear which side raised the issue
- 13:31Speaker 1: or why, but it comes days after a New Dayline
- 13:34Speaker 1: episode aired revealing never before seen details about Colberger's cell
- 13:38Speaker 1: phone records, calls, and photos found on his phone, and
- 13:42Speaker 1: we know now obviously that that has to do with
- 13:45Speaker 1: a alleged leak from the prosecution side that gave this
- 13:50Speaker 1: information to Dayline. So that's something that's being dealt with
- 13:54Speaker 1: right now by Judge Hipler, who has now launched this investigation.
- 13:59Speaker 1: So we'll see what where that all goes. Judge Hipler
- 14:05Speaker 1: said that he's ordering both sides to retain their records
- 14:08Speaker 1: in the case and is open to the appointment of
- 14:10Speaker 1: a special prosecutor who could subpoenal witnesses to dig into
- 14:14Speaker 1: the matter. As part of the hearing, the judge could
- 14:17Speaker 1: make a decision on some final pieces of evidence jurors
- 14:20Speaker 1: might see a trial. Among the final pieces of evidence
- 14:25Speaker 1: still at play is Cohberger's Eerie Criminology research paper, intricately
- 14:30Speaker 1: detailing the fictional crime scene about a woman being stabbed
- 14:33Speaker 1: to death at a trailer park. Phone records and bank
- 14:37Speaker 1: transactions for both the accused killer and some of the
- 14:40Speaker 1: alleged victims, as well as surveillance footage from locations close
- 14:44Speaker 1: to the crime scene, are also likely to be discussed.
- 14:48Speaker 1: The high profile trial is expected to last around three months,
- 14:51Speaker 1: barring the sentencing phase. If convicted, Colberger faces the death penalty, and,
- 14:57Speaker 1: following recent changes in Idaho's law, he may even face
- 15:02Speaker 1: the firing squad. To date, thirteen separate defense efforts to
- 15:06Speaker 1: take the death penalty off the table have been denied
- 15:09Speaker 1: by the judge, including one where they cited his autism
- 15:13Speaker 1: diagnosis as a reason to block capital punishment from the case.
- 15:18Speaker 1: The judge has also dealt the series of other blows
- 15:21Speaker 1: to Colburger's defense strategy in recent weeks, ruling that jurors
- 15:25Speaker 1: can hear the harrowing nine to one one call made
- 15:28Speaker 1: by the victim's surviving roommates and see their panic texts
- 15:32Speaker 1: after Mortensen saw the mass killer inside their home. The
- 15:36Speaker 1: judge also ruled against Colburger in allowing Mortensen to describe
- 15:40Speaker 1: the man inside her home using the term bushy eyebrows.
- 15:45Speaker 1: Jurors will also be able to see Colburger's Amazon shopping history,
- 15:49Speaker 1: which prosecutors say reveal he bought a k bar knife
- 15:53Speaker 1: sheath and sharpener from Amazon. Back in March of twenty
- 15:57Speaker 1: twenty two. A matching sheath was found next to Mogen's body,
- 16:01Speaker 1: with DNA on the sheath being traced back to Coburger.
- 16:04Speaker 1: The murder weapon has never been found. Since last court
- 16:09Speaker 1: hearing in April, it has come to light that Colberger
- 16:12Speaker 1: placed a series of phone calls to his dad, Michael Kolberger,
- 16:15Speaker 1: just two hours after the stabbing spree. The thirty year
- 16:19Speaker 1: old criminology PhD student called his dad three times on
- 16:23Speaker 1: the morning of November thirteenth, twenty twenty two, according to
- 16:27Speaker 1: explosive cell phone records obtained by NBC's Dateline. Now, I
- 16:32Speaker 1: wonder where they got all of this information. Obviously has
- 16:36Speaker 1: to be somebody that's close to the investigation, right you
- 16:38Speaker 1: would think anyway, But I guess we just have to
- 16:41Speaker 1: wait for this investigation that Judge Hipler has launched to
- 16:45Speaker 1: get some information and get some answers.
- 16:48Speaker 2: But as far as the rest of.
- 16:49Speaker 1: This article goes, it just goes over the stuff that
- 16:52Speaker 1: we've talked about already. So we're not going to dive
- 16:54Speaker 1: any deeper than where we did, and we're going to
- 16:57Speaker 1: finish up this article right here because it gives us
- 17:00Speaker 1: what we were looking for, and that was talking about
- 17:03Speaker 1: this alternate suspect. And honestly, that's something that I've expected
- 17:07Speaker 1: for quite some time. The fact that they're going to
- 17:11Speaker 1: launch this now and we're going to at least have
- 17:14Speaker 1: the motion filed and we're going to have it sealed.
- 17:17Speaker 1: Says that at least they have something cooking. The question
- 17:20Speaker 1: is is it going to be significant and be enough
- 17:24Speaker 1: to be admitted as evidence. So we'll continue to follow
- 17:28Speaker 1: along and when we have some more information of value,
- 17:31Speaker 1: will make sure we get it added to the catalog.
- 17:33Speaker 1: But until then, that's going to do it for this one.
- 17:36Speaker 1: All of the information that goes with this episode can
- 17:38Speaker 1: be found in the description box. S't up, everyone, and
- 17:42Speaker 1: welcome back to the program. Brian Kohberger's defense team is
- 17:47Speaker 1: claiming that there were DNA profiles of three other men
- 17:51Speaker 1: present at the scene of the crime. Now, when this
- 17:55Speaker 1: crime first occurred, if you go back, we were talking
- 17:58Speaker 1: about how the whole entire house is going to be
- 18:02Speaker 1: a DNA nightmare for the technicians trying to go through
- 18:05Speaker 1: all of this DNA, and we also discussed how it
- 18:08Speaker 1: could be pretty difficult considering that this was a party house.
- 18:12Speaker 1: So the fact that other DNA profiles were found here
- 18:16Speaker 1: doesn't shock me at all. The question that everybody should
- 18:20Speaker 1: be asking is how many of those DNA profiles were
- 18:23Speaker 1: found on that knife? Sheath, and that's going to be
- 18:26Speaker 1: the issue for Brian Koberger and his defense team. I
- 18:29Speaker 1: know we beat that dead horse all the time here,
- 18:32Speaker 1: but I want to keep reiterating the fact that that's
- 18:34Speaker 1: what they're going to have to do. And if the
- 18:37Speaker 1: DNA of those other three alleged people are not on
- 18:41Speaker 1: that knife sheath, then they can allege all of the
- 18:44Speaker 1: DNA profiles present at the scene that they want, But
- 18:48Speaker 1: that doesn't mean that those profiles were people that were
- 18:51Speaker 1: involved in these murders. Their DNA isn't on the knife sheath,
- 18:56Speaker 1: and until his defense team can explain that away, that's
- 18:59Speaker 1: going to be se the glue that binds all of
- 19:01Speaker 1: this together. Today we have an article from The Independent
- 19:05Speaker 1: and the headline Brian Coberger claims DNA from three other
- 19:09Speaker 1: men found that the scene of Idaho murders. Mister Coberger's
- 19:13Speaker 1: attorneys are fighting against the state's use of genetic genealogy
- 19:17Speaker 1: to tie him to the brutal murders of Klee Gonsalves,
- 19:21Speaker 1: Madison Mogan, Ethan Chapin, and Xana Kernodle. This article was
- 19:26Speaker 1: authored by Rachel Sharp. Accused killer Brian Coberger has insisted
- 19:32Speaker 1: that he has no connection to the Force Lane University
- 19:35Speaker 1: of Idaho students, and has claimed that DNA from three
- 19:39Speaker 1: other unidentified men was also found at the Grizzly crime scene.
- 19:44Speaker 1: And of course the defense doesn't elaborate about those other
- 19:47Speaker 1: profiles who they could be. Instead, like I said earlier,
- 19:51Speaker 1: they're going to try the unknown assailant route to try
- 19:54Speaker 1: and get people to think that somebody else could have
- 19:57Speaker 1: done this, the same way Alec Murda tried to say
- 20:00Speaker 1: that two people showed up to kill his wife and
- 20:02Speaker 1: his son, and there was a bunch of people that
- 20:05Speaker 1: bought into that bs before the child started talking about
- 20:09Speaker 1: how he was gonna get off, how the States case
- 20:11Speaker 1: was weak, it was all built on circumstantial evidence. Well,
- 20:16Speaker 1: how did that end up for him? And unless Brian
- 20:19Speaker 1: Coberger's legal team has something up their sleeve here and
- 20:22Speaker 1: they can prove something to us, well it's gonna be
- 20:25Speaker 1: the same fate for Brian Coberger. And I know he
- 20:28Speaker 1: doesn't have to prove that he's innocent. He's considered innocent
- 20:32Speaker 1: until he's proven guilty, But that doesn't mean you don't
- 20:35Speaker 1: have to back up your assertions in court. If you
- 20:38Speaker 1: say that there were other people who were involved here,
- 20:41Speaker 1: You're gonna have to provide a scenario that the jury
- 20:44Speaker 1: is going to believe. And if you don't have any
- 20:46Speaker 1: sort of evidence about these alleged unknown assailants, then why
- 20:51Speaker 1: would the jury believe anything that you're talking about, especially
- 20:55Speaker 1: when it's your DNA all over that knife sheath. So again,
- 20:59Speaker 1: that is the thing that looms large here when it
- 21:02Speaker 1: comes to getting a conviction against Brian Kolberger in my opinion,
- 21:07Speaker 1: and that's why you're going to see his defense go
- 21:09Speaker 1: so crazy to try and get this thrown out. They're
- 21:13Speaker 1: calling genetic genealogy a new science and they're going to
- 21:17Speaker 1: try and bust it with the technicality. That's what they're
- 21:20Speaker 1: trying to do here. They want this thrown out because
- 21:23Speaker 1: they understand this is the strongest piece of evidence that
- 21:26Speaker 1: the prosecution has unveiled thus far. Court documents filed by
- 21:32Speaker 1: the attorneys for the twenty eight year old PhD student
- 21:35Speaker 1: last week argue that DNA from two other men was
- 21:39Speaker 1: also found inside the off campus student home in Moscow, Idaho.
- 21:44Speaker 1: DNA from a third unknown man was also found on
- 21:48Speaker 1: a glove outside the property on November twentieth, one week
- 21:52Speaker 1: after the murders occurred, the document state, and remember that
- 21:56Speaker 1: glove was found by some investigator, podcaster, whatever, seven days
- 22:01Speaker 1: after these murders occurred. So that's what they're hanging their
- 22:04Speaker 1: hat on as the defense. Oh, we found this glove
- 22:07Speaker 1: out here, so it must belong to whoever committed these murders.
- 22:10Speaker 1: I mean, for real, that's what you're gonna pin your
- 22:13Speaker 1: hopes on. That and the unknown assailant theory. Huh okay,
- 22:17Speaker 1: I mean, I guess, but remember we just watched Lori
- 22:21Speaker 1: Valo get absolutely broadsided in Idaho court trying to bring
- 22:26Speaker 1: the same kind of defense. By December seventeenth, twenty twenty two,
- 22:32Speaker 1: lab analysts were aware of two additional males DNA within
- 22:36Speaker 1: the house where the deceased were located, and another unknown
- 22:40Speaker 1: male DNA on a glove found outside the residence on
- 22:44Speaker 1: November twentieth of twenty twenty two. Mister Cohberger's attorney, Jay
- 22:49Speaker 1: logsd In rights in the filing. To this date, the
- 22:52Speaker 1: defense is unaware of what sort of testing, if any,
- 22:56Speaker 1: was conducted on these samples other than str DNA profiles. Further,
- 23:02Speaker 1: these three separate and distinct male DNA profiles were not
- 23:06Speaker 1: identified through codis leading to the conclusion that the profiles
- 23:11Speaker 1: do not belong to mister Coburger. So you mean to
- 23:14Speaker 1: tell me that other DNA was found in this room
- 23:16Speaker 1: in this house. Wow, I'm shocked, considering it is a
- 23:21Speaker 1: well known house where people were partying, where there were
- 23:24Speaker 1: random people just showing up and hanging out, even while
- 23:28Speaker 1: the owners or the renters i should say, of this
- 23:31Speaker 1: property weren't home. So anyone should be shocked that there's
- 23:35Speaker 1: other DNA profiles present at the scene. We talked about
- 23:39Speaker 1: this when this all went down, and how it was
- 23:41Speaker 1: going to be quite the puzzle for them to figure
- 23:44Speaker 1: out who's who and if the person who's responsible's DNA
- 23:48Speaker 1: profile is present at the house. But the one thing
- 23:52Speaker 1: that they have again is that DNA on the knipe sheath,
- 23:56Speaker 1: and that is going to be very difficult for Coburger
- 23:59Speaker 1: and his team to explain, and in fact, with their
- 24:02Speaker 1: salvo of accusations here, they still haven't addressed the fact
- 24:07Speaker 1: that the DNA is on this knife sheath. Mister Coberger's
- 24:11Speaker 1: defense is fighting against the state's use of genetic genealogy
- 24:15Speaker 1: to tie him to the brutal murders of Kailee Gonsalves, Madison,
- 24:18Speaker 1: Mogen Ethan Chapin, and Xana Kernodle. According to prosecutors, the
- 24:23Speaker 1: killer left a military style knife sheath behind after the killings,
- 24:28Speaker 1: and the sheath was found next to Mogan's body in
- 24:31Speaker 1: her bed on the third floor of the student home.
- 24:35Speaker 1: DNA found on the sheath was later matched to mister
- 24:37Speaker 1: Colberger after the FBI checked the sample against genetic genealogy
- 24:42Speaker 1: databases and tipped off local authorities. After collecting trash from
- 24:48Speaker 1: the suspect's parents' home in the Pocono Mountains, a familial
- 24:52Speaker 1: match from mister Coberger's father was made to the knife sheath.
- 24:56Speaker 1: According to the criminal affet, David, So, what they're doing
- 24:59Speaker 1: is not disputing that that's his genealogy or his touch
- 25:03Speaker 1: DNA on that knife sheath. What they're disputing is the
- 25:07Speaker 1: method that this evidence was collected. And they're gonna go
- 25:11Speaker 1: hard here because they understand that this is the strongest
- 25:14Speaker 1: piece of evidence that has been unveiled. So they're gonna
- 25:17Speaker 1: do everything in their power to try and discredit the
- 25:19Speaker 1: way this was collected, the people who collected it, and
- 25:23Speaker 1: the technology overall. In the latest court filing, the accused
- 25:27Speaker 1: killer's legal team accused prosecutors of hiding its entire case
- 25:31Speaker 1: from the defendant by trying to keep its method of
- 25:34Speaker 1: genetic genealogy investigation secret. Hilarious coming from Coburger's team, who
- 25:40Speaker 1: have been fighting tooth and nell to keep all of
- 25:42Speaker 1: this under wraps with the gag order. If you think
- 25:45Speaker 1: Brian Colberger is getting railroaded as his lawyer, don't you
- 25:48Speaker 1: think that you'd want all of this public. You go
- 25:51Speaker 1: to the judge and say, look, get rid of that
- 25:53Speaker 1: gag order. My client is getting absolutely steamrolled by the
- 25:57Speaker 1: prosecution and I want the whole world to see it.
- 26:00Speaker 1: That hasn't happened though, has it. In fact, it's the opposite.
- 26:03Speaker 1: They want everything kept under wraps, and the reason for
- 26:06Speaker 1: that is they understand that the evidence that's already been
- 26:10Speaker 1: collected is strong as hell. There is no connection between
- 26:14Speaker 1: mister Cohberger and the victims, the filing states, unless, of course,
- 26:18Speaker 1: you count the trips to mad Greek allegedly, the trips
- 26:22Speaker 1: to the Idaho University campus allegedly, the following them on
- 26:27Speaker 1: Instagram allegedly. You see where I'm going with all of this.
- 26:30Speaker 1: The whole no connection thing that doesn't really carry weight
- 26:33Speaker 1: for me because I believe that the reporting from People
- 26:37Speaker 1: magazine was correct and true when they were talking about
- 26:41Speaker 1: Brian Cohberger going to the Mad Greek. I've said that
- 26:44Speaker 1: for how long that that's the likely spot where he
- 26:47Speaker 1: ran into Madison. Originally we're talking about a dude who's
- 26:51Speaker 1: a vegan. The Mad Greek makes vegan food. It wasn't
- 26:55Speaker 1: far away. And then the cherry on top for me
- 26:58Speaker 1: was how adamant the owner was coming out with her
- 27:01Speaker 1: denials that Coburger had ever even eaten there. So I'm
- 27:04Speaker 1: very curious to see an open court what they have
- 27:07Speaker 1: on the Mad Greek because I believe that that is
- 27:11Speaker 1: the genesis here for where Coburger first ran into these girls.
- 27:15Speaker 1: There is no explanation for the total lack of DNA
- 27:18Speaker 1: evidence from the victims in mister Coberger's apartment, off his
- 27:22Speaker 1: home or vehicle.
- 27:23Speaker 2: Well, how about the fact that he bleached the shit
- 27:26Speaker 2: out of the vehicle. Did that have.
- 27:28Speaker 1: Something to do with it?
- 27:29Speaker 2: Maybe? Why are you gonna bleach your vehicle? Who does that?
- 27:32Speaker 1: And then imagine being so creepy that your own sister
- 27:36Speaker 1: thinks that you might be responsible for this shit, So
- 27:38Speaker 1: she goes out and passes your car like the warden
- 27:41Speaker 1: in Shawshank Redemption. Yeah, that should make the rest of
- 27:44Speaker 1: us suspicious or anything like that. We should all just
- 27:46Speaker 1: think that's normal. How many of you out there believe
- 27:49Speaker 1: that that's normal behavior from someone's family members. And of
- 27:53Speaker 1: course that doesn't make Brian Colberger guilty, But when you
- 27:56Speaker 1: add everything up and the fact that his own people
- 27:59Speaker 1: are suspicious, that goes a long way for me. Mister
- 28:02Speaker 1: Coburger is scheduled to stand trial on the second of
- 28:05Speaker 1: October for the murders of Gonsalvis, Mogan, Kernodle, and Chapin
- 28:10Speaker 1: after he was indicted by a grand jury on four accounts,
- 28:14Speaker 1: a first degree murder n one burglary charge. Mister Koberger
- 28:18Speaker 1: is accused of breaking into an off campus student home
- 28:22Speaker 1: on King Road in the early hours of November thirteenth
- 28:25Speaker 1: and stabbing the four students to death with a large
- 28:28Speaker 1: military style knife. Two other female roommates lived with the
- 28:32Speaker 1: three women at the property and were home at the
- 28:35Speaker 1: time of the massacre, but survived. One of the survivors,
- 28:40Speaker 1: Dylan Mortensen, came face to face with the mass killer,
- 28:43Speaker 1: dressed head to toe in black and with bushy eyebrows
- 28:47Speaker 1: as he left the home. In the aftermath of the murders.
- 28:49Speaker 1: According to the criminal aff David, So this is going
- 28:53Speaker 1: to loom large as well. Now she might not be
- 28:55Speaker 1: able to identify the suspect's face, but the same body
- 29:00Speaker 1: style and them bushy eyebrows. You would think if you
- 29:04Speaker 1: commit some murders like this and you have an identifying
- 29:07Speaker 1: feature such as bushy eyebrows, you'd go and get them
- 29:10Speaker 1: bitches plucked right, show up at the local spot and
- 29:13Speaker 1: be like, hey, can you thread my eyebrows?
- 29:15Speaker 2: Please?
- 29:16Speaker 1: Imagine how pissed you'd be at yourself as a criminal
- 29:18Speaker 1: if it was your eyebrows that gave you away and
- 29:21Speaker 1: ended up getting you convicted. For more than six weeks,
- 29:24Speaker 1: the college town of Moscow was plunged into fear as
- 29:28Speaker 1: the accused killer remained at large, with no arrest made
- 29:32Speaker 1: and no suspects named. Then, on December thirtieth, law enforcement
- 29:37Speaker 1: suddenly swooped in on mister Coberger's family home in all Brightsville,
- 29:41Speaker 1: Pennsylvania and arrested him for the quadruple murders. The motive
- 29:46Speaker 1: remains unknown, and it is still unclear what connection the
- 29:50Speaker 1: Washington State University PhD student had to the University of
- 29:54Speaker 1: Idaho students, if any prior to the murders. The murder
- 29:58Speaker 1: weapon of fixed blade knife has still never been found,
- 30:03Speaker 1: and not even a mention of those rumors about Instagram
- 30:06Speaker 1: or the mad Greek or Idaho University. That's pretty poor reporting, honestly.
- 30:11Speaker 1: At the very least, it should be mentioned so people
- 30:13Speaker 1: are aware that that's out there. As a criminal justice
- 30:19Speaker 1: PhD student at Washington State University, mister Coberger lived just
- 30:24Speaker 1: fifteen minutes from the victims over the Idaho Washington border
- 30:28Speaker 1: in Pullman. He had moved there from Pennsylvania and began
- 30:32Speaker 1: his studies there that summer, having just completed his first
- 30:35Speaker 1: semester before his arrest. Before this, he studied criminology at
- 30:40Speaker 1: the Sallas University, first as an undergraduate and then finishing
- 30:45Speaker 1: his graduate studies in June of twenty twenty two. While there,
- 30:49Speaker 1: he studied under renowned forensic psychologist Katherine Ramsland, who interviewed
- 30:54Speaker 1: the BTK serial killer and co wrote the book Confession
- 30:59Speaker 1: of a Serial Killer. The Untold Story of Dennis Rader,
- 31:02Speaker 1: the BTK Killer. With him, he also carried out a
- 31:06Speaker 1: research project to understand how emotions and psychological traits influenced
- 31:12Speaker 1: decision making when committing a crime. And remember the Reddit
- 31:16Speaker 1: post that we found right after he was arrested, and
- 31:20Speaker 1: then look how quickly that post was scrubbed from Reddit
- 31:23Speaker 1: after the information was released. He is facing life in
- 31:28Speaker 1: prison or the death penalty for the murders that have
- 31:31Speaker 1: rocked the small college town of Moscow and hit headlines
- 31:35Speaker 1: around the globe. So the push is on by Brian
- 31:38Speaker 1: Kohberger and his defense team to try and change this narrative.
- 31:41Speaker 1: And now that the gag order has been paired back
- 31:44Speaker 1: a bit, hopefully we can get a little more clarity
- 31:47Speaker 1: from those involved in the case directly. But as of now,
- 31:51Speaker 1: Brian Koeberger and his team behind the scenes certainly are
- 31:55Speaker 1: making their move to try and challenge the strongest bit
- 31:57Speaker 1: of evidence that has been revealed against Brian Kolberger so far.
- 32:03Speaker 1: So it's the main point of their defense here to
- 32:05Speaker 1: try and challenge this evidence and try and make it
- 32:08Speaker 1: so that there's some reasonable doubt about the methods which
- 32:12Speaker 1: it was collected and how the technology is being used.
- 32:16Speaker 1: And their hope is if they can get rid of
- 32:19Speaker 1: that key piece of evidence that the rest of this
- 32:21Speaker 1: stuff just unravels, all right, folks. That's going to do
- 32:25Speaker 1: it for this one. All of the information that goes
- 32:27Speaker 1: with the episode can be found in the description box.
- 32:31Speaker 1: And for those of you who want to support the podcast,
- 32:34Speaker 1: I will be posting the Patreon link in the description
- 32:38Speaker 1: box from here on out and will be doing a
- 32:41Speaker 1: non commercial variety of the show on the Patreon page.
- 32:46Speaker 1: For those of you who don't want to deal with
- 32:47Speaker 1: the commercials and still want to help keep the lights
- 32:49Speaker 1: on around these parts, that's the way to do it.
- 32:52Speaker 1: So that link will be in the description box, and
- 32:56Speaker 1: starting July first, all of the non look back episodes
- 33:00Speaker 1: are going to be available there without commercial interruption. So
- 33:04Speaker 1: if that's something you're into and you want to help
- 33:06Speaker 1: support the podcast, that's the way to do it. So
- 33:09Speaker 1: moving forward, that link will be available in the description box.
- 33:13Speaker 1: All right, folks, we'll be back with a little bit
- 33:15Speaker 1: more in a little while. What's up everyone, and welcome
- 33:19Speaker 1: back to the program. As we continue to make our
- 33:22Speaker 1: way through the court documents up here at Moscow, it's
- 33:25Speaker 1: becoming quite apparent that the prosecution has built a very
- 33:29Speaker 1: very strong case against Brian Colberger, and this evidence hasn't
- 33:34Speaker 1: come in just one form. We're not talking about just
- 33:37Speaker 1: circumstantial evidence here. We're not talking about just the DNA
- 33:41Speaker 1: on the knife sheath, but all of the evidence combined.
- 33:44Speaker 1: And when you combine all of this evidence, it builds
- 33:47Speaker 1: a very very strong case against Brian Kolberger. And every
- 33:52Speaker 1: vector of attack that has been used by his attorneys
- 33:55Speaker 1: has been met and challenged by the prosecution and headed off.
- 34:00Speaker 1: So Brian Colberger really doesn't have any sort of pathway
- 34:03Speaker 1: to victory here, at least in my opinion. Now, there
- 34:08Speaker 1: is always the chance that there is going to be
- 34:10Speaker 1: some sort of prosecutorial misconduct that is found along the
- 34:13Speaker 1: way or that occurs, but I doubt it at this point.
- 34:18Speaker 1: I highly doubt that that's what we're going to see.
- 34:21Speaker 1: And if Brian Kolberger and his team think that it's
- 34:24Speaker 1: going to be loopholes and technicalities that get them off,
- 34:27Speaker 1: I think that they're really grasping at straws because the
- 34:31Speaker 1: only way to get your guy off is to prove
- 34:34Speaker 1: to the jerry that he's not the one who did it,
- 34:36Speaker 1: and I have zero idea how they plan to do that.
- 34:39Speaker 1: Considering this evidence that we're seeing and all of these
- 34:42Speaker 1: core documents that we're going through, I haven't found anything
- 34:46Speaker 1: that's beneficial to Brian Kolberger yet, not one single thing. Now,
- 34:51Speaker 1: his team has made some, you know, quality arguments, there's
- 34:54Speaker 1: no doubt that his legal team has been on their game.
- 34:57Speaker 1: But when it comes to actually substantial movement, evidence presented,
- 35:03Speaker 1: evidence challenged, I haven't seen anything that makes me sit
- 35:07Speaker 1: up and say, oh, you know what, Brian Colberger might
- 35:10Speaker 1: have a path to victory here. And I know that
- 35:12Speaker 1: this has been frustrating for a lot of people considering
- 35:15Speaker 1: how long this is taking. But I said at the
- 35:17Speaker 1: very beginning that they're being very, very meticulous because they
- 35:21Speaker 1: don't want to deal with an appeal.
- 35:23Speaker 2: They don't want.
- 35:24Speaker 1: Brian Colberger showing up after he maybe gets convicted and
- 35:29Speaker 1: starts talking about how the process was stacked against him
- 35:32Speaker 1: and how he deserves an appeal. Nobody wants to go
- 35:35Speaker 1: through this again. And while I certainly don't speak for
- 35:37Speaker 1: these family members, I'm sure that they don't want to
- 35:40Speaker 1: deal with this, you know, a second trial. Who the
- 35:43Speaker 1: hell wants to deal with one? Never mind too, But
- 35:46Speaker 1: make no mistake that that's what Brian Colberger's team is
- 35:49Speaker 1: setting up for they're definitely gunning for that appeal, and
- 35:52Speaker 1: they're hoping that there's going to be some hiccups along
- 35:55Speaker 1: the way that helps them get there. Unfortunately for them,
- 35:59Speaker 1: I haven't seen anything that even comes close to an
- 36:02Speaker 1: issue that would be overturned on an appeal. So today
- 36:06Speaker 1: we have an article from the US Sun and the
- 36:08Speaker 1: headline lone killer. Two pieces of Brian Coolberger evidence can
- 36:12Speaker 1: completely bring down murder trial by casting doubt about guilt,
- 36:16Speaker 1: lawyer warns. The legal expert praised the prosecution for building
- 36:21Speaker 1: a strong case.
- 36:22Speaker 2: Oh, there's zero doubt. And when this was first happening, when.
- 36:26Speaker 1: The murder first occurred, I was very very critical of
- 36:29Speaker 1: the authorities. If you recall, I was talking about how
- 36:32Speaker 1: they're messaging and the way that they were going about
- 36:35Speaker 1: their business talking to the public and the families was terrible.
- 36:40Speaker 1: The whole entire thing was just bad. But the actual
- 36:43Speaker 1: police work that was going on behind the scenes obviously
- 36:47Speaker 1: was productive and it was good. And if there was
- 36:50Speaker 1: any glaring Brady Jillio issues, if there was any glaring
- 36:54Speaker 1: prosecutorial issues, we'd already see it. There would already be
- 36:58Speaker 1: a gigantic fight about that. Because Colberger's team knows that
- 37:03Speaker 1: they could use that and they could parlay that into
- 37:06Speaker 1: getting him off the death penalty at the very least,
- 37:08Speaker 1: But unfortunately for Colburger, that doesn't seem like it's going
- 37:11Speaker 1: to materialize. So if you notice now they're starting to
- 37:15Speaker 1: readjust and now they're talking about alternative suspects that might
- 37:18Speaker 1: be responsible for what happened. And my comment to that
- 37:21Speaker 1: is good luck. This article was authored by Israel Solis Rodriguez.
- 37:28Speaker 1: New evidence in the quadruple murder case against Coberger thirty
- 37:32Speaker 1: is coming to light as the high profile trial is
- 37:34Speaker 1: scheduled to begin later this summer in Boise, Idaho. And
- 37:38Speaker 1: this trial is scheduled to go on for like four months.
- 37:42Speaker 1: We're talking about a gigantic proceeding here, and there is
- 37:47Speaker 1: going to be so much evidence that's presented that it's
- 37:50Speaker 1: going to be very difficult to keep track of all
- 37:52Speaker 1: of it unless you follow along every single day. The
- 37:56Speaker 1: good news is that's exactly what we're going to do.
- 37:59Speaker 1: With less than five five months before opening statements or
- 38:01Speaker 1: slated to begin, Colberger's defense counsel is fighting tooth and
- 38:05Speaker 1: nail to convince Judge Stephen Hipler to allow them to
- 38:08Speaker 1: present their alternative perpetrator's argument at the trial over the
- 38:12Speaker 1: death of four students in their college home. The defense
- 38:16Speaker 1: claims that because DNA from five different individuals was found
- 38:20Speaker 1: on one of the victims and at the scene, the
- 38:22Speaker 1: actual perpetrator may have planted Colburger's DNA on the knife
- 38:26Speaker 1: sheath found in one of the bedrooms. Oh yeah, that
- 38:29Speaker 1: sounds real plausible to me. Some rando decided to get
- 38:33Speaker 1: the knife sheath from Brian Colberger, broke into his house, first,
- 38:36Speaker 1: got the knife sheath, got Brian Colberger's DNA on it,
- 38:40Speaker 1: then went and killed those girls and put the knife
- 38:42Speaker 1: sheath underneath Madison Mogan's body. Is that what you're trying
- 38:46Speaker 1: to convince me of? Because if that's the case, boy,
- 38:49Speaker 1: you're in for a long day and you better be
- 38:52Speaker 1: glad that I'm not a juror, because your ass would
- 38:55Speaker 1: be getting set up for a date with the firing squad.
- 38:58Speaker 1: Mark Najami of Florida trial attorney told the US son
- 39:02Speaker 1: that that argument by the defense is a stretch. Alternative
- 39:06Speaker 1: perpetrators theory the sheath.
- 39:09Speaker 2: With his DNA on it. It's critical. Why would the
- 39:11Speaker 2: sheath of.
- 39:11Speaker 1: A knife that has his DNA be in their place. Najami,
- 39:16Speaker 1: who gained notoriety in two thousand and eight by representing
- 39:19Speaker 1: the parents of Casey Anthony and their murder trial, told
- 39:21Speaker 1: the US Son, Yeah, exactly. It is just ridiculous. And
- 39:26Speaker 1: they've literally provided no evidence that points to anybody else.
- 39:31Speaker 1: And I know it's up to the state to provide
- 39:33Speaker 1: the evidence. I get it, Okay, but if you decide
- 39:35Speaker 1: that you're going to introduce an alternative perpetrator theory, you
- 39:40Speaker 1: have to have some evidence of that. You can't just say, oh,
- 39:43Speaker 1: well it was Joe from down the block. Okay, Well
- 39:46Speaker 1: what's your evidence? Where's Joe at? Did anyone investigate into
- 39:50Speaker 1: Joe's whereabouts that day? So if you don't have all
- 39:53Speaker 1: of your ducks in a row and you just show
- 39:55Speaker 1: up with these unnamed perpetrators, good luck, because guess what, buddy,
- 40:00Speaker 1: it's your DNA that's on that knife sheath. So all
- 40:03Speaker 1: of your other nonsense, all of the other historyonics that
- 40:07Speaker 1: might be great for a narrative in the media, but
- 40:11Speaker 1: in real life inside of that courtroom in front of
- 40:14Speaker 1: them jurors, good luck trying to get that one a stick.
- 40:17Speaker 1: The defense has got a hard road they're in their
- 40:20Speaker 1: position is somebody just set this guy up. But then
- 40:23Speaker 1: you have got to have a basis. Why would they
- 40:24Speaker 1: set him up, Why would they go to that particular
- 40:27Speaker 1: individual They said they set the accused up and left
- 40:31Speaker 1: the sheet there.
- 40:32Speaker 2: That's a stretch.
- 40:33Speaker 1: The touch DNA found on the knife sheath was ninety
- 40:36Speaker 1: nine point nine to eight percent match to trash Colberger
- 40:39Speaker 1: disposed of at his family's house in Scranton, Pennsylvania. And
- 40:43Speaker 1: that's exactly where I'm at. You can say whatever you want, right,
- 40:46Speaker 1: but you have to have some sort of tangible evidence
- 40:48Speaker 1: to back it up. And if you're gonna be the
- 40:51Speaker 1: one that introduces this alternative perpetrator theory, then you're going
- 40:56Speaker 1: to have to back it up. And if you can't
- 40:58Speaker 1: do that, I think it's going to be even worse
- 41:01Speaker 1: on you come trial time. Because the jurors aren't stupid,
- 41:05Speaker 1: and I highly doubt they're going to take kindly to
- 41:07Speaker 1: being taken on a fishing expedition when they've already sacrificed
- 41:11Speaker 1: four months of their lives to sit at this trial
- 41:14Speaker 1: and be jurors in.
- 41:14Speaker 2: The first place.
- 41:15Speaker 1: But that said, I understand why the defense is doing
- 41:18Speaker 1: what they're doing. They have nothing to go on. I
- 41:21Speaker 1: have told you guys this from the very beginning. You
- 41:24Speaker 1: cannot make chicken salad out of chicken shit. In addition
- 41:28Speaker 1: to the knife sheath, investigators recovered to blood samples at
- 41:31Speaker 1: the off campus home in Moscow, Idaho, on the morning
- 41:34Speaker 1: of November thirteenth, twenty twenty two. Blood was found on
- 41:38Speaker 1: a handrail inside the home where roommates Madison Mogan, Kaylee Gonsalves, Xanakernodle,
- 41:44Speaker 1: and Ethan Chapin were fatally stabbed to death in November
- 41:47Speaker 1: of twenty twenty two. Well that's a big chakhuh a
- 41:51Speaker 1: party house in somebody's DNA was found on the railing.
- 41:55Speaker 1: I am just blown away. How many times have you
- 41:58Speaker 1: had a cut finger? How many times have you know
- 42:01Speaker 1: your partying or whatever you hurt yourself might be bleeding
- 42:04Speaker 1: a little bit. So again, it's a great narrative for
- 42:07Speaker 1: people on the internet that want to believe that Brian
- 42:09Speaker 1: Colberger is innocent. But when it gets down to the
- 42:12Speaker 1: scrutiny that it's going to face inside of a courtroom,
- 42:15Speaker 1: well we all know how that's going to go. In fact,
- 42:18Speaker 1: this kind of stuff is not even gonna make it
- 42:20Speaker 1: into evidence, is my guess. So you got five unnamed
- 42:24Speaker 1: people in a party house whose DNA show up, Well,
- 42:27Speaker 1: that's a big shock, huh. Moscow investigators recovered more blood
- 42:31Speaker 1: on a glove outside the home. The blood samples came
- 42:34Speaker 1: from two unidentified but different men, not Coburgers. Recent court
- 42:39Speaker 1: filings also showed that DNA evidence from three different men
- 42:43Speaker 1: was allegedly found under the left fingernails of Mogan. Test
- 42:46Speaker 1: showed a three person mixture and none of the DNA
- 42:49Speaker 1: was linked to Coburger. Najam told the US Sun those
- 42:52Speaker 1: details are critical areas for the defense to include to
- 42:56Speaker 1: create reasonable doubt by showing that other people could have
- 43:00Speaker 1: or would have been there, that arguably starts casting doubt
- 43:03Speaker 1: on the suspect, the primary suspect, the accused. As to
- 43:06Speaker 1: whether it was him who did it, he added, well
- 43:09Speaker 1: sure if there wasn't all this other evidence pointing to
- 43:13Speaker 1: Coburger circumstantial and otherwise, it does bring in an ancillary area,
- 43:19Speaker 1: and that is were there are more than one person
- 43:21Speaker 1: who was involved in this situation in these horrific murders,
- 43:25Speaker 1: No Jam believes the judge may allow the DNA evidence
- 43:28Speaker 1: from the blood samples to be present at trial, but
- 43:30Speaker 1: question the findings collected from Mogan's fingernails. Blood is a
- 43:34Speaker 1: critical part of the evidence here. Sadly, it's gruesome, but
- 43:38Speaker 1: you have blood spattering throughout the bedrooms of the victims,
- 43:40Speaker 1: Najam said, you have clear DNA. It's going to be
- 43:44Speaker 1: your breadcrumbs that are going to lead you to either
- 43:46Speaker 1: the person or people that did it or didn't do it.
- 43:50Speaker 1: Nojam called the fingernail DNA unrelated in the case because
- 43:54Speaker 1: the four victims were out the night before and in
- 43:56Speaker 1: various places Bingo, if you hug somebody, you have somebody's hand, whatever,
- 44:01Speaker 1: that DNA can easily end up under your fingernails. It's
- 44:05Speaker 1: entirely possible when you hug someone, when you give them
- 44:07Speaker 1: a light scratch, or when you're just affectionately, when you're dancing,
- 44:11Speaker 1: and if you're holding hands and in a fun situation,
- 44:15Speaker 1: all those things potentially leave DNA. Nachamp said, we don't
- 44:19Speaker 1: know if it was fresh skin, which would arguably be
- 44:22Speaker 1: much more critical than some shedding that simply happened because
- 44:25Speaker 1: somebody went and got their nails done earlier that day
- 44:28Speaker 1: by a nail tech. You could have that person's DNA
- 44:32Speaker 1: under your nails and just because you're going to have
- 44:34Speaker 1: some minor shedding. But nevertheless, with the complexity in the
- 44:38Speaker 1: technology being what it is today, you could arguably pick
- 44:41Speaker 1: up some DNA from some ancillarysources that are completely unrelated.
- 44:46Speaker 1: So again, I think that without us knowing more, both
- 44:49Speaker 1: sides are going to be making their arguments because obviously
- 44:52Speaker 1: the defense wants it in, but the prosecution would say
- 44:55Speaker 1: it's irrelevant in material and they want it out. Nevertheless,
- 45:00Speaker 1: the gen believe state prosecutors have built a strong case
- 45:03Speaker 1: to score a conviction despite the murder weapon never being recovered.
- 45:07Speaker 1: The state's done a really strong job of making sure
- 45:10Speaker 1: that they've dotted their eyes and crossed their t's, he said,
- 45:13Speaker 1: And that's something I've talked about from the beginning. It's
- 45:17Speaker 1: been a very very long road. There's zero doubt that
- 45:20Speaker 1: it has been a slog But if everything works out
- 45:24Speaker 1: in the end, they get the conviction they're looking for,
- 45:26Speaker 1: they get the right guy, and then that guy can't appeal. Well,
- 45:30Speaker 1: everything was worth it, right, I mean, just take a
- 45:33Speaker 1: look at what's going on with the Karen Reid case
- 45:36Speaker 1: and Judge Canoni. What a shit show. We got going
- 45:39Speaker 1: on up there. Just look at the shit show that
- 45:41Speaker 1: happened in Indiana with Richard Allen. So I'm grateful, honestly
- 45:45Speaker 1: for the process here in Idaho so far and how
- 45:48Speaker 1: professional things have been. They've gotten search warrants across the board.
- 45:53Speaker 1: It doesn't look like they've tripped over themselves. From what
- 45:56Speaker 1: I can see. We don't know everything. We're not in
- 45:58Speaker 1: the courtroom every day, but from what I can see
- 46:01Speaker 1: is they covered themselves. They got warrants, they got it
- 46:04Speaker 1: done properly, they collected the evidence properly. With that said,
- 46:09Speaker 1: they even went as far back as getting the search
- 46:11Speaker 1: records on the computer and showing that Amazon purchases were
- 46:14Speaker 1: made of the knife, that unique knife and that sheath,
- 46:18Speaker 1: and so those are the links which put a case
- 46:21Speaker 1: together for the prosecution. I think the prosecution has done
- 46:25Speaker 1: its homework. Coburger was arrested in charge with the murder
- 46:28Speaker 1: of the four students in early twenty twenty three. A
- 46:32Speaker 1: judge entered and not guilty plea on Coburger's behalf during
- 46:35Speaker 1: his arraignment in May of twenty twenty three. His trial
- 46:38Speaker 1: is currently scheduled to start in August of twenty twenty five,
- 46:42Speaker 1: and it's interesting to see now as we get closer
- 46:44Speaker 1: to trial that the loopholes and technicality strategy is going
- 46:48Speaker 1: by the wayside, and now they want us to believe
- 46:51Speaker 1: that there's an alternative perpetrator out there that isn't Brian Coberger.
- 46:56Speaker 1: And unfortunately for them, at least in my opinion, they
- 46:59Speaker 1: haven't even come clear to offering us any sort of
- 47:02Speaker 1: tangible information or evidence that would point us in the
- 47:06Speaker 1: direction of somebody else. So I'm certainly in agreement here
- 47:10Speaker 1: with the lawyer mister Najami when he says that he
- 47:13Speaker 1: thinks they've built a very strong case, because I feel
- 47:16Speaker 1: the same way. And unless there is some sort of
- 47:19Speaker 1: egregious prosecutorial misconduct on earth from now until the time
- 47:23Speaker 1: of the trial, then I really don't see any path
- 47:26Speaker 1: for Brian Coohberger to get off on these charges. Instead,
- 47:30Speaker 1: what I see is the prosecution not only continuing to
- 47:33Speaker 1: build its case, but also fortifying the information that they've
- 47:37Speaker 1: already released and what we already know. One thing's for sure,
- 47:41Speaker 1: there are certainly some twists and turns remaining in the
- 47:44Speaker 1: road as we continue on the journey of the trial
- 47:47Speaker 1: of Brian Kohberger. All of the information that goes with
- 47:51Speaker 1: this episode, including my contact information, can be found in
