- 0:00Speaker 1: Administration officials are ramping up their criticism of judges who
- 0:04Speaker 1: rule against the president. Take a look at this exchange
- 0:07Speaker 1: yesterday on Fox Business.
- 0:11Speaker 2: These are rogue judges that are basically I was appointed
- 0:16Speaker 2: by Donald Trump.
- 0:17Speaker 3: That's a rogue judge.
- 0:18Speaker 2: It was one appointed by career bureaucrat over at USTR.
- 0:22Speaker 2: But more importantly, the person who wrote the decision, Rostani
- 0:27Speaker 2: was appointed by Reagan. Free Trader. She's the one who
- 0:31Speaker 2: took the league trying to stop the Section two thirty
- 0:34Speaker 2: two chaffs and got overruled in the appeals courts.
- 0:39Speaker 4: I mean rogue judges. Judge appointed by Ronald Wilson Reagan
- 0:45Speaker 4: and a judge appointed by Donald J.
- 0:47Speaker 5: Trumph. And time and time again we hear the people
- 0:50Speaker 5: inside the administration acting shocked.
- 0:52Speaker 4: Oh, this is a judicial coup, this is a rogue No. No,
- 0:57Speaker 4: it's the constitution of the United States law. We are
- 1:00Speaker 4: a constitutional republic. And if you don't like what they did,
- 1:05Speaker 4: then you appeal it to the United States Supreme Court.
- 1:08Speaker 1: So that came moments before President Trump's tariffs were reinstated.
- 1:13Speaker 1: It's one example of how the Trump administration appears to
- 1:16Speaker 1: be trying to undermine confidence in the judiciary. After that
- 1:21Speaker 1: three judge panel ruled against the presidents sweeping tariffs Wednesday evening,
- 1:25Speaker 1: Stephen Miller, the White House Deputy chief of Staff, posted
- 1:29Speaker 1: on social media, calling the decision a judicial coup.
- 1:35Speaker 5: It's just so inflammatory and so wrong.
- 1:38Speaker 1: And then yesterday he wrote, quote, we are living under
- 1:42Speaker 1: a judicial tyranny.
- 1:44Speaker 4: That is also again, there is a reason why threats
- 1:48Speaker 4: against federal judges of skyrocketing, and speaking of threats that
- 1:52Speaker 4: sort of language does exactly that.
- 1:56Speaker 1: Miller, along with his post, put up photos of the
- 1:59Speaker 1: three Trade Court judges. White House Press Secretary Caroline Levitt
- 2:04Speaker 1: also addressed the ruling.
- 2:05Speaker 6: Yesterday, three judges of the US Court of International Trade
- 2:10Speaker 6: disagreed and brazenly abused their judicial power to usurp the
- 2:14Speaker 6: authority of President Trump to stop him from carrying out
- 2:17Speaker 6: the mandate that the American people gave him. These judges
- 2:20Speaker 6: failed to acknowledge that the President of the United States
- 2:23Speaker 6: has core foreign affairs powers, an authority given to him
- 2:26Speaker 6: by Congress to protect the United States economy and national security.
- 2:30Speaker 6: The courts should have no role here. There is a
- 2:33Speaker 6: troubling and dangerous trend of unelected judges inserting themselves into
- 2:37Speaker 6: the presidential decision making process. America cannot function if President
- 2:41Speaker 6: Trump or any other president for that matter, has their
- 2:44Speaker 6: sensitive diplomatic or trade negotiations railroaded by activist judges.
- 2:51Speaker 3: And the trumpdministration is far from the first to have
- 2:54Speaker 3: frustrations with the court's federal courts. We know that whether
- 2:58Speaker 3: it's Bush or Obama or Biden, it's a bipartisan endeavor. However,
- 3:03Speaker 3: this administration, the Trump administration, our first time to sort
- 3:06Speaker 3: of vilify the judiciary in this way, to put out names, photographs,
- 3:12Speaker 3: accuse them of being part of the deep state, as
- 3:15Speaker 3: we talked about yesterday when this news was breaking, suggesting
- 3:19Speaker 3: that it was a judicial coup, that this was something
- 3:22Speaker 3: an effort to thwart not just the will of the
- 3:24Speaker 3: presidency but the people, and talking about it sort of
- 3:27Speaker 3: incendiary terms that I know worries quite a few folks.
- 3:32Speaker 7: I think the theme of the last two stories that
- 3:34Speaker 7: we've been talking about are welcome to democracy, Welcome to
- 3:39Speaker 7: our system. It's not a judicial coup. Our system, for
- 3:45Speaker 7: as long as these short memoried people may or may
- 3:49Speaker 7: not remember, has been a three branch system of government
- 3:52Speaker 7: in which other branches have a say, and when you
- 3:56Speaker 7: go back to the Elon Musk story, it's the same story.
- 4:00Speaker 7: He was. He didn't just leave. He's not He's not
- 4:02Speaker 7: just slipping out of Washington. He was chased out of
- 4:06Speaker 7: Washington by democracy, by people saying no, by people protesting
- 4:13Speaker 7: so much around his cars and dealerships that he lost
- 4:16Speaker 7: billions and billions of dollars, by people raising their voices,
- 4:19Speaker 7: by people filing lawsuits. And by the way, you know,
- 4:23Speaker 7: Donald Trump was saying, I think he wrote he will
- 4:25Speaker 7: always be with us. That's something that rev might say
- 4:28Speaker 7: in a eulogy for someone. So so he will always
- 4:32Speaker 7: be with us, I mean, you know, And I just
- 4:35Speaker 7: want to say, we can tell the Elons story and
- 4:38Speaker 7: this kind of disciplining by democracy as a story of
- 4:42Speaker 7: someone leaving. But there is pain in the wake of
- 4:45Speaker 7: these tariffs, and there's pain in the wake of what
- 4:48Speaker 7: Elon did. He talked about bringing the wood chipper to usaid.
- 4:54Speaker 7: Brooke Nichols, Boston University professor of mathematician, figured out what
- 4:58Speaker 7: is the effect of this A tracker three hundred thousand deaths,
- 5:06Speaker 7: according to a Boston University professor, because of the AID
- 5:09Speaker 7: cuts so far, two hundred thousand of them children. Okay,
- 5:12Speaker 7: Vietnam War, y'all remember that sixty thousand US service members died.
- 5:17Speaker 7: This is five times more deaths according to the Boston
- 5:21Speaker 7: University study because of aid cuts since January of this year.
- 5:27Speaker 7: So Elon Musk is leaving, but he's also leaving a legacy.
- 5:31Speaker 7: But I think it's really important that people remember the
- 5:34Speaker 7: Court's work. Joe and I have been having a ten
- 5:36Speaker 7: year conversation about our institution standing up or not. The
- 5:39Speaker 7: courts work. Still not perfectly, there's problems, but courts work,
- 5:43Speaker 7: lawsuits work, and pressure works, and people raising their voice works.
- 5:49Speaker 7: And it's not just that Washington always wins. I think
- 5:51Speaker 7: the people always win.
- 5:54Speaker 4: Yeah, well it is you look and see and again
- 6:00Speaker 4: talk about US a idea. I'm hoping that Republicans who
- 6:03Speaker 4: supported George W. Bush with Pep Fharr, who supported evangelical
- 6:11Speaker 4: institutions UH and and and and and Catholic institutions and
- 6:17Speaker 4: other institutions to to help the poorest among not only
- 6:23Speaker 4: US but across the world, will will put the funding
- 6:27Speaker 4: back in UH for for these these desperately needed services.
- 6:31Speaker 4: I also also, again Elon Musk obviously going back to
- 6:36Speaker 4: take to take care of of Tesla because he did,
- 6:40Speaker 4: face of course, such backlash, some of it way overboard.
- 6:45Speaker 4: The violence uh uh and vandalism uh at Tesla dealerships
- 6:51Speaker 4: just absolutely shameful. That only hurts the cause. David Drucker,
- 6:55Speaker 4: though I want to I want to talk though about
- 6:57Speaker 4: the administration attack judges. They have to know this. First
- 7:03Speaker 4: of all. All you do is you actually get other
- 7:09Speaker 4: federal judges angry that the administration doesn't respect the separation
- 7:17Speaker 4: of powers and Article three powers. But also closer to
- 7:21Speaker 4: home for this White House is very dangerous, but closer
- 7:24Speaker 4: to home politically. Whenever they start talking this way, you
- 7:28Speaker 4: have Republican senators, MAGA senators like Josh Holly, like John.
- 7:35Speaker 5: Kennedy from Louisiana. You've got shot Grass. So you've got
- 7:38Speaker 5: other Republican senators going whoa whoa, whoa, Hey, older horses
- 7:43Speaker 5: going to win. If you don't like a judge's ruling,
- 7:47Speaker 5: that's too bad, you can appeal it, and then you
- 7:50Speaker 5: have to respect the outcome of it. Talk about how
- 7:53Speaker 5: these these attacks on federal judges, the talk of judicial
- 7:58Speaker 5: kup who's that doesn't even play with most Republicans on
- 8:03Speaker 5: Capitol Hill.
- 8:05Speaker 8: Well, they're going to be here a lot longer than
- 8:07Speaker 8: any president, and so I think they tend to take
- 8:09Speaker 8: the judiciary a little bit more seriously. But look, we
- 8:13Speaker 8: have a very active as president, and since the supreme branch,
- 8:17Speaker 8: the legislative branch, is choosing to do nothing, it's understandable
- 8:21Speaker 8: that you're going to have the only other branch of government,
- 8:24Speaker 8: the judiciary, pushback. I mean, that's why the administration finds
- 8:28Speaker 8: itself in this boat. If they were working with Congress
- 8:32Speaker 8: to legislate on a lot of the different things they
- 8:34Speaker 8: want to do, whether you like them or not, the
- 8:37Speaker 8: dismantling of USAID for instance, if they had gone to
- 8:41Speaker 8: Congress taken this statutory program and changed the law, there'd
- 8:45Speaker 8: be no lawsuits. But instead they come in with a sledgehammer.
- 8:50Speaker 8: They challenge and obfuscate the law. Congress does nothing, and
- 8:54Speaker 8: so the courts are the only recourse and the only
- 8:56Speaker 8: ones willing to do anything about this. We have seen this,
- 9:00Speaker 8: as Jonathan mentioned, from presidents on the right and presidents
- 9:03Speaker 8: on the left. They all think they're emperors. They don't
- 9:05Speaker 8: like judges thwarting their agenda. But in this case, this
- 9:10Speaker 8: president is going to be thwart at time and again
- 9:13Speaker 8: because he's stretching the bounds of executive power. And on
- 9:16Speaker 8: Capitol Hill they do cringe. Republicans don't like it because
- 9:20Speaker 8: they rely on the courts when they're in the minority,
- 9:23Speaker 8: and Republicans were recently in the minority and they know
- 9:25Speaker 8: they'll be in the minority again and vice versa with
- 9:28Speaker 8: the Democrats. But this is standard Washington speak. And what
- 9:33Speaker 8: this president knows how to do is not finesse but bully.
- 9:36Speaker 8: It's the way he operates. What will be fun Joe
- 9:41Speaker 8: is eventually when this term ends and they'll be a
- 9:44Speaker 8: Democratic president, whether in the next term or the term
- 9:47Speaker 8: after that. And a lot of Trump administration officials that
- 9:50Speaker 8: are still active in politics will be going to court
- 9:54Speaker 8: and using these same courts to block democratic presidents from
- 9:58Speaker 8: doing things they don't White
