- Ben: Good morning and welcome to your short term rental bulletin. And this morning you joined me from Leon because the European short term rental industry has descended on Leon for VRWS, which obviously offers a lot. One of my favorite conferences of the year. I'll be there milling around. So please come and find me if you're about, but there's a more important story that I want to talk about that seems to be developing all the time. And that is Spain. So the kind of big news this morning is that Spain's changed the rules overnight. So six days ago, and we covered this story at the time, it's lower house throughout the 10 % VAT charge on short-term rentals, but that is back. So it was published yesterday, wording unchanged, same 1st of December date and enforced this morning. So the Royal Decree Law 29 slash 2026, Gazette 249. Prolongated on Tuesday. Differed its short-term length paragraph against the one the chamber killed on Friday. Identical down to the punctuation. So the hotel services test is not new and that has been in the VAT Act for years. We know about this. What the decree adds is an alternative trigger. A stay of 30 nights or fewer for the same tenant. either limb alone removes the exemption and the escape, the property being the landlord's habitual residence, sits inside that 30-day night limb. It also carries an article the repeal one did not. Article 20 requires a letting advert to show the unit's identifying number, a code or a title where applicable. The preamble offers the regional tourist use code as its example. That matters because the state's own consolidated text records in the Supreme Court are nulling the registration number machinery in 2024, rentals registry decree last spring. So that duty is being rebuilt. at statutory rank and it started this morning, not in December. The decree assigns constitutional compliance title to every article except one. as 10 points of margin is a taxable supply and unlocks input VAT on cleaning, linen and commission. And look at your payment terms because the tax accrues when the price is due and deposits when you take them. The vote does not touch that lever. So a repealed tax is not dead while the government still holds the pen and it holds it until polling day 54 days to go until the Spanish tax date. And if you're here, let me know. Come find me. I always love to chat about this stuff. Thanks for watching. And I'll see you hopefully later on today, but also tomorrow. Bye bye.
