- 0:19Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:22The topic is who prepares the settlement paperwork? And this
- 0:26episode today is based on an article on our blog
- 0:30Familylawheadquarters dot com dated September eighth, twenty twenty five, and
- 0:35the title of that article is who should draft the
- 0:38settlement paperwork? So as a follow up to the episode today,
- 0:41going over to Familawheadquarters dot com and read this blog
- 0:45article for more information. But let's go ahead and jump
- 0:47on into the topic at hand. Most individuals who are
- 0:51going through divorceert family law matter would like to settle
- 0:53their case. I mean, that's just the reality. Very few
- 0:57people want a long contested case where the case costs
- 1:01a lot of money and takes a bunch of time.
- 1:04I mean, nobody really wants that. Of course, the issue
- 1:07is the devil's in the details, and once you get
- 1:09into the details, lots of parties disagree on the substantive
- 1:14issues in the case, and that disagreement then leads to
- 1:17a lot of cases being very hard to settle. All right,
- 1:21but let's take a situation where the case has actually settled.
- 1:24The parties have an agreement on everything, which is a
- 1:26requirement in terms of all the relevant issues. The parties
- 1:29have to agree. Okay, So let's take a situation where
- 1:33the parties actually agree. And this could have taken place
- 1:35many different ways based on the case. In some cases,
- 1:39the parties just agree out of the gates. From my
- 1:42experience as a lawyer, this is really pretty rare. Most
- 1:46parties want this to be the case, but rarely is
- 1:49it the case. But in some situations this can actually happen.
- 1:53So take a case with the parties agree in the
- 1:55terms of a divorce right out of the gates. In
- 1:58other cases it might require settlement offers, going back and
- 2:02forth between the attorneys who are dealing with offers and counteroffers.
- 2:06And then let's take a situation where the parties eventually
- 2:10reach an agreement. In other cases, parties have to go
- 2:13to mediation and they work with a mediator, and then
- 2:15at mediation, the hope is that they can come up
- 2:18with a resolution or a compromise in order to settle
- 2:21their case. And I've seen countless cases, I should say,
- 2:24and this is sort of the majority, if you will,
- 2:27which is the parties either settle in court, like on
- 2:31the courthouse steps, or maybe they're in court on a
- 2:33settlement conference or a pre trial conference, and the judge
- 2:38gives some recommendations for settlement. And let's say the parties
- 2:41settle in this kind of scenario. Okay, Well, no matter
- 2:44how this takes place. When there's a settlement, then the
- 2:47issue is who's going to draft the settlement paperwork? And
- 2:50I think for a lot of parties this seems immaterial.
- 2:53Most would think this isn't a big deal, But it
- 2:56can actually turn into a bigger deal than most people
- 2:59can actually realize. All right, so this can take place
- 3:03quite a bit different in a lot of cases. But
- 3:06what I see quite a bit, and have seen this
- 3:10throughout my career, is the parties divide ups drafting the paperwork.
- 3:14So in other words, the lawyers for the husband and
- 3:16the lawyers for wife all draft different portions of the
- 3:19settlement paperwork and then they compile this together. All right.
- 3:23In some cases, the guardian at lighter might even get
- 3:26involved in terms of drafting the parenting plan, and then
- 3:29the party's lawyers draft the other portions of the paperwork.
- 3:32Of course, this sort of begs the question, why is
- 3:34there so much settlement paperwork that needs to be put
- 3:37together in order to resolve a case? And I understand
- 3:40why a lot of people would think that, but the
- 3:42truth is in terms of the legal requirement, So there's
- 3:44a lot of stuff that has to be put together
- 3:47in order to settle a case. So take a divorce,
- 3:50for example, there's going to be a judgment form or
- 3:53a divorce decree. And then if there's property and debt
- 3:57that has to be divided, there has to be a
- 3:59marital selling and separation agreement. And this can be tedious
- 4:03and ardulous because parties have to list all their property,
- 4:06all their debts. You've got to have last four digits
- 4:10of account numbers in the settlement paperwork. If there's real estate,
- 4:13you've got to have the real estate description, and if
- 4:16there's vehicles, you got to have the vehicle identification numbers
- 4:20and various other things. So the marital settlement separation agreement
- 4:24can involve a lot of work. And then we talked
- 4:27about this before, but where there's kids, then there has
- 4:31to be what's called a parented plan or custy schedule
- 4:34put together all right, and this has to denote who
- 4:37gets the kids when in terms of each day of
- 4:39the week, and then you're dealing with holidays, you're dealing
- 4:43with summer visitation in various other terms as well, in
- 4:48terms of you know, how decisions are made and if
- 4:51the parties can't agree, do they go to mediation, do
- 4:54they go to arbitration, do they have a parent coordinator
- 4:56or whatnot? And so all of that has to be
- 5:00in the parenting planter cussing schedule, and that can be
- 5:03quite arduous. And then in most states, child support calculations
- 5:08have to be done and attached to the judgment somehow
- 5:12or incorporate into the judgment somehow. And then you get
- 5:15into an issue of in a lot of cases, parties
- 5:19sign AffA David's so that they don't have to appear
- 5:22in court to have the judge sign the settlement paperwork.
- 5:25In some cases that might not be possible, but you've
- 5:27got these affi Davids as well, and you can translate
- 5:31this into different types of family law cases. If it's
- 5:34not a divorce, then you take out the marital settlement
- 5:37separation agreement. For example, if it's a paternity case or
- 5:41if it's a modification or something like that, then you
- 5:43wouldn't need that, but you're still going to need in
- 5:45most cases this other paperwork. And so the question gets
- 5:48into houses paperwork drafted, okay, and in some cases you're
- 5:54literally talking about three lawyers doing it. So you could
- 5:57have the attorney for the husband drafting part of paperwork,
- 6:00you could have the attorney for the wife drafting another
- 6:04part of the paperwork. And let's say the guardian at
- 6:06lighten wants to do the parenting plan. So now you've
- 6:08got three lawyers involved trying to draft this paperwork, okay.
- 6:13And so the issue is this, and this is why
- 6:16it can be a big issue. I mean, once you
- 6:17get three attorneys involved, this process can become slow. You know,
- 6:22one attorney might draft this paperwork pretty quick, another attorney
- 6:26might be busy and it might take them a while, okay.
- 6:29And so for parties who settle, most of the time,
- 6:32at least what I've seen is they want to then
- 6:34get the case done quick. But there can be a
- 6:36period of weeks or months where parties are taking their
- 6:40time to have the paperwork put together because their lawyers
- 6:43have other cases and other things that they're doing, so
- 6:46they're taking their time. And then even when the paperwork's prepared,
- 6:49then maybe one of the lawyers wants revisions or amendments
- 6:52or additions to the paperwork, So then you're going back
- 6:55and forth on these various drafts, and this can really
- 7:00slow the process down, all right. And hearing this, a
- 7:05lot of individuals think, well, was there a quicker way
- 7:07to do this? Is there a more efficient way to
- 7:10do this? And the truth is yeah, sometimes, And the
- 7:14way that can take place is if a party just
- 7:16tells their lawyer, look, just draft all the paperwork, just
- 7:21do it all, and do it quick, because I want
- 7:23to get this case done quick. All right. Well, what
- 7:25would be the downsides of that, potentially, Well, the party
- 7:29who's paying their lawyer to draft all the settlement paperwork
- 7:32then is going to incur more in fees if the
- 7:34lawyer is the one doing it all. So while it
- 7:37might be quicker to have their lawyer just do the paperwork,
- 7:41you know, themselves, and do it quicker if they're willing
- 7:44and able to do it, it's going to cost them
- 7:46some more money. So that can cause parties some pause
- 7:50where they want to have this divvied up. That way,
- 7:52they're not incurring all the fees for having the settlement
- 7:55paperwork drafted. Of course, the other issue is sometimes the
- 7:59other attorneys won't agree to this, Like the guardian at
- 8:02lighter might insist like, no, I'm going to do the
- 8:04parenting plan and I don't want another lawyer doing it.
- 8:07And another lawyer might object to the other lawyer drafting
- 8:10all the paywork. I mean, maybe they want to draft
- 8:12a certain portion of it themselves because they think it's important.
- 8:16Frank's Y or Z reason. All right, So even where
- 8:20a party's willing to pay their lawyer to draft all
- 8:22the settlement paperwork, you still have one or two other
- 8:25attorneys in the case too. If there's a guardian I
- 8:30light them and they have to agree to let the
- 8:32one lawyer draft everything, and they might not agree to it. Okay,
- 8:37So look, ultimately, who drafts a settlement paperwork That could
- 8:40be a big issue, and it could be something that
- 8:42lots of parties don't think about, They don't contemplate, they
- 8:46don't even realize it's such a big deal. But it
- 8:49can be a big deal. And the other thing I
- 8:52would say, apart from the cost and the speed, I've
- 8:54seen happen over the course of time, is that once
- 8:59it takes a while for the paperwork to get drafted. Okay.
- 9:02So if we're talking about a case where it takes
- 9:04weeks or months to have this paperwork put together after
- 9:07there is a purported agreement, what I've seen happen in
- 9:10some cases is that the agreement on ravels and a
- 9:13lot of listeners would say, well why is that? Well, look,
- 9:16there could be intervening events that take place that get
- 9:20the parties worked up or riled up, and now a
- 9:22party who was willing to settle doesn't want to settle anymore. Okay,
- 9:26So you know, I think time is important for parties
- 9:30who want to get the case done through settlement. If
- 9:33it's taken a long time to have this paperwork drafted,
- 9:36I think the chances grow by the day that the
- 9:39settlement agreement will never be put into play because intervening
- 9:42events will take place like fins, arguments, bickering, or new
- 9:47ambiguities occur, or new events occur, or circumstances change, and
- 9:53so now parties don't want to sign the settlement paperwork anymore.
- 9:55So look, at most instances I parties truly want to settle,
- 10:00it's important to have this paperwork done quickly and have
- 10:03both parties sign it and have the judge approve it
- 10:05before somebody gets cold feed or changes their mind. Of course,
- 10:08this is complicated for the reasons that I've just stated
- 10:12that once you get three attorneys involved in terms of
- 10:14draft and the paperwork, you know, hopefully it goes quick
- 10:18and for the listeners, obviously, I'm sure that's what you want,
- 10:21for it to go quick and for it to be executed,
- 10:26you know, by both parties in terms of signing it
- 10:28and the judge signing it, and so it's official. But
- 10:31in a lot of cases you just have to realize
- 10:33from the date that the case purportedly settles to the
- 10:36date that the agreement is put together and the judge
- 10:39approves that it could be weeks or months. And so
- 10:42that's sort of the disy part of settlement agreements and
- 10:46divorce or family law that I wanted to cover here today. Okay,
- 10:48definitely an interesting topic for parties. Looking for more information
- 10:53on this topic again going over to familaw headquarters dot
