  A federal judge has rejected X's attempt to halt a new California
• 0:24
  law, a decision that impacts how social media platforms manage

  and disclose their content moderation strategies.

  Now the law in question, EB587, was passed last year in
• 0:35
  California, and it mandates that large social media companies
• 0:39
  must publicly share their methods for moderating content,
• 0:42
  particularly content that involves hate speech, extremism,
• 0:45
  disinformation, and foreign political interference.

  Now, X challenged this law, arguing that it infringes on the
• 0:52
  1st Amendment rights. However, U.S.
• 0:54
  District Judge William Shubb disagreed with X's stance.
• 0:58
  In his ruling, he stated that while the law does not impose a
• 1:01
  significant compliance burden on social media companies, it does
• 1:05
  not unjustifiably or excessively burden them within the
• 1:08
  boundaries of the 1st Amendment law.

  He emphasized that the required disclosures are straightforward
• 1:13
  and uncontroversial. X's legal complaint had
• 1:17
  contended that the law's requirements were very vague and
• 1:19
  that it would compel social media platforms to censor
• 1:23
  constitutionally protected content.

  Now, Judge Chubb's decision clarifies that AB 587 simply
• 1:30
  requires social media companies to report their existing
• 1:32
  policies on content moderation. He noted that these reports are
• 1:36
  purely factual and that the fact that they might relate to
• 1:39
  controversial issues does not make the reports themselves
• 1:42
  controversial. X's internal dynamics have also
• 1:45
  been shifting. Since Elon Musk's takeover, the
• 1:47
  company has seen significant job cuts, particularly in its Trust
• 1:51
  and Safety team, and this downsizing in the company's
• 1:54
  moderation policies are now under scrutiny in Europe as
• 1:58
  well. And the European Union has

  initiated a formal investigation into X's compliance with the
• 2:04
  Digital Services Act of the DSA. This move, the first of its kind
• 2:08
  under the DSA, focuses on whether X has allowed the spread
• 2:11
  of illegal content, particularly in relation to the terrorist
• 2:14
  group Hamas's activities against Israel.

  Now, the lawsuit against California's law was filed by
• 2:21
  ACTS in September. The law, signed by Governor
• 2:23
  Gavin Newsom, requires social media firms to submit biannual
• 2:26
  reports on their moderation of hate speech, misinformation, and
• 2:30
  other harmful content. Now, Judge Chubbs, denial of X's
• 2:33
  motion to suspend the law underscores its significance and
• 2:37
  its enforceability. Now, X's argument in the law was
• 2:41
  that the law coerced companies into speech against their will
• 2:44
  and interfered with their editorial judgment.

  The company also argued that it pressured platforms to remove
• 2:50
  content that is protected by the Constitution.
• 2:53
  Now, the situation has also affected X's business relations.
• 2:57
  There has been a notable exodus of advertisers from the
• 2:59
  platform, including major companies like Apple, Disney,
• 3:03
  IBM and Lionsgate Entertainment. This is partly attributed to the
• 3:08
  increased levels of hate speech and misinformation on the
• 3:11
  platform, as well as Musk's other public statements.

  And further complications for X arise from the E US probe into
• 3:17
  its adherence to the DSA. This investigation is centered
• 3:20
  around content related to Hamas's attacks on Israel on
• 3:23
  October 7th, and the DSA aims to curb illegal online activity and
• 3:27
  disinformation. Now, Judge Shubbs Page ruling on
• 3:31
  the California law emphasized the particular aspect of the
• 3:35
  reporting requirement. He noted that while it does
• 3:37
  place a burden on social media companies, it is not excessive
• 3:41
  or unjustified in the context of the 1st Amendment.
• 3:43
  This ruling is a set back for X's argument that the law
• 3:46
  violated free speech rights. Now the law requires social
• 3:50
  media companies with substantial annual revenues to issue semi
• 3:53
  annual reports describing their content moderation practices,
• 3:56
  and this includes data on objectable posts and how they're
• 3:59
  addressed. California Governor Newsom had
• 4:01
  expressed the need for transparency and how social
• 4:04
  media influences public discourse, and since Musk's
• 4:07
  acquisition of Twitter in 2022 for $44 billion, he's faced
• 4:11
  challenges in maintaining advertiser relationships and
• 4:14
  managing content on the platform.

  Reports have indicated an increase in hate speech on the
• 4:18
  platform following his takeover, and Judge Chubb has scheduled a
• 4:22
  conference with the lawyers involved in the case for
• 4:24
  February 26th. He emphasized the importance of
• 4:27
  the law's terms of service requirements, noting their
• 4:30
  potential impact on user decisions and X's challenges
• 4:34
  extend beyond the US. In Europe, the company faces an
• 4:37
  investigation by the EU regarding its compliance with
• 4:40
  the DSA, particularly in response to content following

  Hamas's attack on Israel. X has stated its commitment to

  complying with the DSA and is cooperating with the regulatory
• 4:50
  process. X's legal battle in California

  and its ongoing challenges in Europe highlight that this is
