- 3:31Speaker 4: Good to be here.
- 3:33Speaker 1: Thank you, thank you.
- 3:34Speaker 4: Okay, Well, first, well let me let me let me
- 3:37Speaker 4: introduce myself. I convin James Legate. Uh. In nineteen ninety eight,
- 3:43Speaker 4: I used to work for a company called Advantage All
- 3:45Speaker 4: the Finance. What it was was like a broker who
- 3:48Speaker 4: we try to help individuals try to reatavatter credit by
- 3:52Speaker 4: putting them in certain videful vision again and how vituals
- 3:56Speaker 4: or we have vendors and would uh that will give
- 3:59Speaker 4: them credit. Wellstead this time that I was there, I
- 4:02Speaker 4: was there for about two years before this incident. I
- 4:05Speaker 4: started the reposition center and I started the collection agency
- 4:08Speaker 4: called my boss mister James Walker. Well. On one particular
- 4:13Speaker 4: day of the year about ninety eight, we were located
- 4:16Speaker 4: room sports Comers, where the owner, Holly Kalia, introduced me
- 4:20Speaker 4: to this woman by the name of beryland Made. He
- 4:23Speaker 4: asked if I could do a favor and take her
- 4:26Speaker 4: down the street on ten Pens to see if I
- 4:28Speaker 4: can have her car register at the DMP down her. So,
- 4:31Speaker 4: of course I agreed, and as I entered the car,
- 4:35Speaker 4: I noticed that she had a tepiscope on her rearview minerals.
- 4:38Speaker 4: So to break the eydy type of said, so you're
- 4:40Speaker 4: in the medical field and she said yeah, So I
- 4:43Speaker 4: thought they did around in the neighborhood. She goes, no,
- 4:45Speaker 4: it's towing up a pool in front. Kelln Well, it
- 4:49Speaker 4: just happened to be that the pool Liver Kellahan, a
- 4:51Speaker 4: friend of mine owned the club there called the Texas
- 4:54Speaker 4: to Chance, and in ninety six I remember when I
- 4:57Speaker 4: go over there, they were doing some construction right now
- 5:00Speaker 4: store to it, and I asked the people what what
- 5:03Speaker 4: are y'all making? And it's going to be a home
- 5:05Speaker 4: health center. So automatically I thought, well, if they're right there,
- 5:09Speaker 4: if I Texas jam and she like, don at me surprise,
- 5:13Speaker 4: She goes, yeah, how do you know and I express
- 5:15Speaker 4: how I knew, uh, you own her next door texta
- 5:18Speaker 4: chams so we don't did like that, And then you know,
- 5:20Speaker 4: we talked about other stuff, but we got her father,
- 5:22Speaker 4: rich Stern, came on back to the office. Never heard
- 5:25Speaker 4: from her again. Right then a few months later mister
- 5:28Speaker 4: Kalia at Kalia came to me and asked me if
- 5:31Speaker 4: I remembered this girl and I said yeah, and uh,
- 5:34Speaker 4: he goes, well, look said default can you look at me?
- 5:37Speaker 4: Can you find the car for me? I said sure, so, uh,
- 5:41Speaker 4: I well, just so it'll be clear, I didn't represent
- 5:45Speaker 4: the cars myself. What I did is I hunted them down.
- 5:48Speaker 4: I found them and I called a record which was
- 5:51Speaker 4: Springer towing the record would come and then he took
- 5:54Speaker 4: up the car after I heard reported it to the
- 5:56Speaker 4: San Antonia Police Department. So on this particular day, which
- 6:00Speaker 4: is September to third, and I kept on riding around
- 6:02Speaker 4: trying to see if maybe she goes to the office.
- 6:06Speaker 4: So then I stuck at the bar which is uh
- 6:09Speaker 4: which was called Players. Now I didn't know that because
- 6:12Speaker 4: I hadn't been there for a while. So I go
- 6:14Speaker 4: in there and I started talking. I heard one of
- 6:16Speaker 4: the ex waitresses. Was the manager now, and I talked
- 6:19Speaker 4: to make a small up and made a few ball
- 6:22Speaker 4: allSome there and I'm sitting there just waiting and waiting.
- 6:24Speaker 4: I got there for you know, a few hours, and
- 6:27Speaker 4: uh then I went next door and I went up
- 6:30Speaker 4: and walked him to go down there, and told myself,
- 6:31Speaker 4: I'm going to go down there. So when I got
- 6:34Speaker 4: to the to the office. As I walked in, there's
- 6:37Speaker 4: a little reception to desk right there, I saw a
- 6:40Speaker 4: man on the pole. He told me to stop and
- 6:42Speaker 4: wait until I did. Then he waited to follow him.
- 6:45Speaker 4: So I followed him into the into his office, and
- 6:50Speaker 4: he was as deaf. While there, I had my freecase
- 6:53Speaker 4: with me. I had everything in there. I had my
- 6:55Speaker 4: driver's signers, I had dealership cards, I had dealer teddy,
- 7:00Speaker 4: I had off my nose everything. So as I tried
- 7:04Speaker 4: to hand in one of my business cards, everything just
- 7:07Speaker 4: happened so fast that he threw the table over. Next
- 7:10Speaker 4: thing I know, I'm just running out the store and
- 7:12Speaker 4: I'm done. You know, I don't know what happened. It
- 7:15Speaker 4: fel like if I went through a twilight zone, because
- 7:18Speaker 4: next thing i know, I'm coming out of a Burger came.
- 7:20Speaker 4: That's about twenty five minutes the way where they said
- 7:23Speaker 4: I got off the bus and it takes about that much.
- 7:26Speaker 4: You can do that burger game. Well, when I got there,
- 7:29Speaker 4: it's like if I just like somebody, I'm blind forward
- 7:31Speaker 4: with me and I'm like, okay, go wait a minute,
- 7:33Speaker 4: because you know, I was drinking at the club next store,
- 7:35Speaker 4: and I want to call it a functioning alcoholic. So uh,
- 7:41Speaker 4: as I walked down, I was like, hey, where's my
- 7:44Speaker 4: car at? You know, because I have my car and everything.
- 7:46Speaker 4: So I go up to the street to see where
- 7:48Speaker 4: I'm at, and all of a sudden I heard somebody yelling, hey, hey,
- 7:52Speaker 4: So I turned around and I see about maybe I'll
- 7:55Speaker 4: say like about maybe, I mean, uh, maybe be hard.
- 8:00Speaker 4: So there was an officer calling me, okay, well I
- 8:03Speaker 4: walked to him.
- 8:04Speaker 1: I walked straight to him.
- 8:06Speaker 4: I didn't I didn't argue, I didn't do nothing. I
- 8:08Speaker 4: didn't TIMES went from hey, what's going on? He says,
- 8:11Speaker 4: where are you going from? I said I'm coming from
- 8:13Speaker 4: the the Burger king, and which wouldn't verify. They said
- 8:18Speaker 4: they saw me walk in and he just started wrong
- 8:19Speaker 4: and walked straight back out. Well, he had the extended.
- 8:23Speaker 4: He said, well, you know you got the tickets that
- 8:24Speaker 4: they desire. You know that I didn't mean to take
- 8:26Speaker 4: care of but I haven't. So uh, by the time
- 8:29Speaker 4: that happened, he brought another car. I've stood there for
- 8:32Speaker 4: a while and they they took me and took me
- 8:35Speaker 4: to a little sub station down the street, and I
- 8:38Speaker 4: was there if they could call my clothes, but spin
- 8:41Speaker 4: because then I s ticket quite taking my clothes. They said,
- 8:44Speaker 4: don't worry about it, and they see your heads and
- 8:46Speaker 4: they did a swap on my left and right hand
- 8:49Speaker 4: or then I made the frond that was gun shop
- 8:51Speaker 4: river and uh, they have to the Tensis for so
- 8:56Speaker 4: then after that they took me downtown and at what's
- 8:58Speaker 4: going on? I said, what do you mean? I mean,
- 9:00Speaker 4: I don't know what you're talking about. I just I
- 9:02Speaker 4: was got up person and uh, the next thing I know,
- 9:06Speaker 4: I'm coming down to the perfect team. And so it happened.
- 9:09Speaker 4: It's like if I want to grow a black guy.
- 9:11Speaker 4: So they had been stand this one room by myself,
- 9:14Speaker 4: and I never found out was a one man find
- 9:16Speaker 4: them all right? When it came out to two individuals,
- 9:20Speaker 4: whether both of them foot ups are even identifying me.
- 9:24Speaker 4: I hear the person in the club next door. The
- 9:26Speaker 4: other one said that I looked similar to the guy
- 9:28Speaker 4: that he saw, and he's coming after like to gratified
- 9:32Speaker 4: the shirt they said, Uh, they said, Frank, the chefs
- 9:35Speaker 4: he had dart clothes on. The guy they had right
- 9:38Speaker 4: there had a shirt on. So uh you know which
- 9:41Speaker 4: which I did have, because they have it in eminence. Uh. Well,
- 9:46Speaker 4: as I go on, and the fact that they tell
- 9:48Speaker 4: me that I'm being charge for murder, which really blew
- 9:51Speaker 4: my mind down. What do you mean murder? I didn't
- 9:53Speaker 4: murder no more. I mean maybe I'm here tickets so
- 9:56Speaker 4: you know, pushed up the sheets. They knocked me up
- 9:58Speaker 4: with double stuff.
- 9:59Speaker 5: I governed the count.
- 10:00Speaker 4: Uh. I never got on the bar. I had been
- 10:03Speaker 4: locked up, like they blocked up.
- 10:05Speaker 2: Uh.
- 10:06Speaker 1: I hired an attorney.
- 10:07Speaker 4: I pave a description more of what you know, because
- 10:09Speaker 4: later on during my time, I came and what happened,
- 10:12Speaker 4: what happened? What happened? And little bit of keep on
- 10:15Speaker 4: coming to my mind, and I said, okay, so I
- 10:16Speaker 4: go a little skitch somebody that was behind me. Of
- 10:19Speaker 4: course I'm let a, I'm not an artist or anything
- 10:22Speaker 4: like that, but I gave him there was somebody behind me,
- 10:25Speaker 4: and uh, when this guy shot, he wants to shadow me.
- 10:28Speaker 4: And I mustn't be because all my stuff, they said,
- 10:30Speaker 4: all my stuff except my free kid was thrown on
- 10:34Speaker 4: the floor and stone on the floor, which can be
- 10:36Speaker 4: seen in the documentary because see all my stuff.
- 10:39Speaker 1: On the floor.
- 10:40Speaker 4: What the crazy part is is right be happening me far?
- 10:46Speaker 4: And uh and then oh, healthcare senators in a bandoned apartments.
- 10:50Speaker 4: They said, if they found my brief piece just right there,
- 10:53Speaker 4: and you don't kid stick there with a gun, just
- 10:56Speaker 4: talked like inches away from it, you know, like hey, hey,
- 10:59Speaker 4: you're a get So they told that it was like
- 11:02Speaker 4: brecase and the only thing they had toase was one.
- 11:06Speaker 1: Pre set and it had Okay, so.
- 11:12Speaker 3: I want to jump in real quick because you know,
- 11:15Speaker 3: I want to be able to get some questions.
- 11:18Speaker 2: And because I did look at part one and part
- 11:24Speaker 2: two of.
- 11:24Speaker 3: The documentary, I didn't get to the other rest of them.
- 11:29Speaker 3: So in in the documentary, the second one that I
- 11:35Speaker 3: was looking at, you said that they found your papers
- 11:40Speaker 3: through all over the over the on the floor, on
- 11:45Speaker 3: the office floor. So in the documentary they what I
- 11:50Speaker 3: heard them say was that.
- 11:55Speaker 2: Only how I believe it was, your lawyer said.
- 11:58Speaker 3: Only how they made an I D got your name
- 12:02Speaker 3: and information was because they found uh copy of your.
- 12:09Speaker 2: ID your drivers.
- 12:11Speaker 3: Like a copy of it, and they didn't you know
- 12:15Speaker 3: that was that was laying on the floor. And then
- 12:18Speaker 3: also they were saying the witnesses. I heard you say
- 12:26Speaker 3: about the witnesses. The witnesses said they couldn't describe you.
- 12:30Speaker 3: Some of them said you had on a they seen
- 12:33Speaker 3: a man wearing a black shirt, and then other.
- 12:36Speaker 2: Ones said they seen a man in a white shirt.
- 12:43Speaker 2: How did your maybe I'm.
- 12:47Speaker 3: Jumping ahead, how did your defensive turn and handle that?
- 12:51Speaker 4: You know, well, that kind of crazy because during all,
- 12:59Speaker 4: you know, we brought that. In fact, we even had
- 13:02Speaker 4: the heavidence by my clothes brought into the into uh
- 13:05Speaker 4: at an extippet and uh he thought, he said, y'all
- 13:09Speaker 4: are pointed as somebody who had a dark post, because
- 13:11Speaker 4: this is what there was. There was a guy by
- 13:12Speaker 4: the name of Adolf Salazar. He said he was driving
- 13:16Speaker 4: up to the bar. As soon as he was getting
- 13:18Speaker 4: up his car, he'd seen a guy running out and
- 13:23Speaker 4: behind him was mister Garcia's and deceased like trying to
- 13:27Speaker 4: grab him and the guy can fine, he's cann turn
- 13:31Speaker 4: like around the movie. Okay, so he said, uh uh,
- 13:35Speaker 4: but the guy was wearing car closing right now there
- 13:39Speaker 4: was another guy uh so mingo comminians. I think his
- 13:43Speaker 4: saying was he was on the cor writer of the
- 13:46Speaker 4: of the for the ballers that they have a telephone writer.
- 13:50Speaker 4: He was on the phone. He said, did he see
- 13:52Speaker 4: the guy who went past him going straight across the
- 13:55Speaker 4: park and I going to the street that was wearing
- 13:58Speaker 4: a white shirt. He didn't he looking in the guy's
- 14:01Speaker 4: hands or nothing like that, but that he he didn't
- 14:03Speaker 4: run for cleever road. So that gave two descriptions. But
- 14:08Speaker 4: during so it's like if you're trying to say that
- 14:11Speaker 4: I had a flat shirt or I had my white
- 14:12Speaker 4: shirt on, when you know, basically didn't patch it and
- 14:16Speaker 4: just put on the flat shirt and went back and
- 14:19Speaker 4: put it on a white shirt. You were saying, so
- 14:21Speaker 4: we could never figured that out, and my remy didn't
- 14:25Speaker 4: put him a good defense against that, like an argument
- 14:28Speaker 4: another word or being more passive than appressive. Y. You know,
- 14:36Speaker 4: so that's something never really got.
- 14:40Speaker 2: And then you know, also.
- 14:44Speaker 3: I've seen where the prosecution said that you just you
- 14:48Speaker 3: just gave yourself away that when you was running that
- 14:52Speaker 3: you was yelling that I'm here, look at me, and
- 14:56Speaker 3: you made some other stagments. So that made people bring
- 15:01Speaker 3: focus directly on you. What you know, Yeah, that's in
- 15:10Speaker 3: the documentary. That's in the documentary.
- 15:14Speaker 1: It's crazy.
- 15:15Speaker 4: That's the first I ever heard of that. I never
- 15:18Speaker 4: heard of it change you were youngters that you were
- 15:26Speaker 4: running here, look at me, look at me. That'll that'll
- 15:28Speaker 4: be yes.
- 15:29Speaker 3: You know, it's in your from the documentary. Cornell. Have
- 15:35Speaker 3: a question for you, Okay.
- 15:37Speaker 5: Okay, let's be okay, Okay, check this out, okay, based
- 15:42Speaker 5: upon the record, Okay, the records hendy came that she
- 15:45Speaker 5: was intoxicated, okay, and the police officer saying that she
- 15:48Speaker 5: was sweating and you seem nervous when they came towards
- 15:51Speaker 5: you or whatever.
- 15:51Speaker 4: Okay.
- 15:52Speaker 5: So here's my question. Okay, when you ran out of
- 15:56Speaker 5: the office, okay, So you did not see anyone fire?
- 16:00Speaker 5: Did you see anyone with a gun? Did you see
- 16:02Speaker 5: anyone behind you with a gun or whatever? If you
- 16:06Speaker 5: did not see that, my question to you is that
- 16:08Speaker 5: when you ran out of the office and you ran
- 16:10Speaker 5: and left the scene, okay, why did you leave the
- 16:14Speaker 5: scene and never come back or why did you not
- 16:17Speaker 5: call nine one one or something of something that happened,
- 16:19Speaker 5: you know, because they're making the scene that because you
- 16:22Speaker 5: were intoxicated, it under the influencers, and that you said
- 16:25Speaker 5: that you was at the further team and that you
- 16:27Speaker 5: walked in and walked out. They turned to make a
- 16:29Speaker 5: scene that you were suspicious, okay of the crime, right
- 16:33Speaker 5: because you left the part the fire scene and you
- 16:36Speaker 5: didn't come back to try to clear your matters up.
- 16:38Speaker 5: So you know, with that being said, now, you just
- 16:41Speaker 5: said that they took you from the Burger team, put
- 16:44Speaker 5: you in the car, took me to a sub station,
- 16:46Speaker 5: and they did a parap.
- 16:47Speaker 1: In test on your hand, and that it came.
- 16:50Speaker 5: Back inclusive that there was gunpowder on your hands.
- 16:54Speaker 1: Is that true?
- 16:55Speaker 4: No, I'm not no sure, no sense to deal. They
- 16:59Speaker 4: didn't into the substation, took the kid. But later on
- 17:03Speaker 4: during trial we learned no touchout residue on my left
- 17:08Speaker 4: the right hand. In fact, I had laws on the
- 17:10Speaker 4: shirts off. I had a white piety shirt. There was nothing,
- 17:14Speaker 4: no cuch eber to do stole. But what they do
- 17:17Speaker 4: is they did kind of slick and they're kind of
- 17:20Speaker 4: uh uh the POETICI and and told me. What they
- 17:24Speaker 4: do is when they said during so such up residue
- 17:27Speaker 4: found no utch porticles outed the subject just the right
- 17:30Speaker 4: hand and they put a period. Then they go on
- 17:33Speaker 4: and take a kidney German to say that the subject
- 17:36Speaker 4: prior to weapon what the proximity of a weapon being
- 17:40Speaker 4: discharged or handled a discharged weapon, which I mayor saw
- 17:45Speaker 4: when I got to and I never seem to the
- 17:47Speaker 4: report until I think it was about the salvage scatter
- 17:50Speaker 4: or something like that. This is when I shurned around.
- 17:52Speaker 4: I followed the lawsuit again, they're kind of FORENSICI but
- 17:57Speaker 4: uh at all. Basically because I asked for for monetary damage.
- 18:01Speaker 4: That really I wanted them to correct their their their
- 18:03Speaker 4: their report, because if you're saying that there's no guns,
- 18:07Speaker 4: got residue power found on your left the right hand
- 18:10Speaker 4: on the judging, why do you even include that in
- 18:14Speaker 4: the report? Something like that the prosecutors take and they
- 18:19Speaker 4: twisted around, well that's okay, Uh, there's so you know,
- 18:23Speaker 4: they said that they can't kill to be power of
- 18:25Speaker 4: the weapons. I mean, I think nobody gets dead before
- 18:27Speaker 4: which the detective said, I couldn't get dead or there's
- 18:30Speaker 4: no good night. I said no, but that's the way
- 18:33Speaker 4: it works. If such a cruise or science technology crews
- 18:39Speaker 4: and there is no big work, no, no gun shot
- 18:43Speaker 4: particles count on the subjects left or right hand. That
- 18:47Speaker 4: that's a bro they're tying me of no gunshot residue,
- 18:51Speaker 4: So there was no guntown residue bottom. Okay, okay, we
- 18:57Speaker 4: okay to okay.
- 18:58Speaker 5: Now we want to try to get everything we can,
- 19:00Speaker 5: try to ask all the questions that we can. So
- 19:02Speaker 5: watch this, okay. You said the suitcase was left then
- 19:05Speaker 5: in the office building. Right now you saying if they
- 19:08Speaker 5: found your suitcase down the street around the corner with
- 19:12Speaker 5: a gun next to it and only a receipt inside
- 19:15Speaker 5: of the suitcase. So are you indicating that witnesses after
- 19:20Speaker 5: knowing that something had happened, because you just said that
- 19:23Speaker 5: mister witnesses said that, mister Garia say somebody else trying
- 19:26Speaker 5: to grab them by the sirtain. So are you indicating
- 19:29Speaker 5: that the suitcase come across the floor and ended up
- 19:32Speaker 5: down the street, down the corner around the corner after
- 19:35Speaker 5: mister guard Field was in an altercation with whoever his
- 19:38Speaker 5: killers was So is that a.
- 19:40Speaker 1: Question that needs to be addressed right there?
- 19:42Speaker 4: Is? How is that.
- 19:44Speaker 5: Possible that your suitcase can end up waying down the
- 19:46Speaker 5: street with you know, somebody's cramming you?
- 19:51Speaker 4: Is that what? Yes?
- 19:54Speaker 1: Yes, look and everything.
- 19:57Speaker 4: Why did I just stop for but the thing happened?
- 20:01Speaker 4: Like you're right, I was. I was kind of intoxicated,
- 20:04Speaker 4: Like I said, I'm not. I was a kidding alcoholic,
- 20:07Speaker 4: you know. I mean, I can function property when I'm
- 20:09Speaker 4: drinking and stuff. I don't. I'm not the type of well,
- 20:12Speaker 4: I wasn't the type of person who would just get
- 20:14Speaker 4: all super drunk. I mean I drank, I drank. I
- 20:17Speaker 4: know how to function, and especially when I'm doing business
- 20:20Speaker 4: with people. Well, when did happen? I had driven and
- 20:24Speaker 4: I guess was so high that it threw my mind
- 20:28Speaker 4: that and I left. I couldn't remember hearing the shot,
- 20:31Speaker 4: but I found a paper where I called my friend.
- 20:34Speaker 4: I said, all who was buddying by? And I he said, man,
- 20:38Speaker 4: what happened? Look, I don't know. I was over here
- 20:40Speaker 4: looking for a merlond matic. Next thing, you know, I hear,
- 20:43Speaker 4: it's not I got scared that I ran, which is
- 20:46Speaker 4: body truth. I did run. I did get scared. Now,
- 20:49Speaker 4: how all my content, all my freecase all on the
- 20:53Speaker 4: floor is beyond my understanding because when I had it,
- 20:57Speaker 4: I had it, and I set it on top of
- 20:58Speaker 4: the table and I'm in my business card at that time.
- 21:03Speaker 4: The benefits guard Shia was just like like broke. I
- 21:07Speaker 4: just threw my mind to shot up and tossed the table.
- 21:11Speaker 4: So and I'm sallowing like back, I'm like going back
- 21:14Speaker 4: and and yeah there was somebody in this, but then
- 21:17Speaker 4: are the time, you know, it wasn't like in my
- 21:19Speaker 4: frame of mind and to see because you know what
- 21:21Speaker 4: I said, it would be so bad then I drop off.
- 21:24Speaker 4: Now I couldn't come back or anything like that because
- 21:28Speaker 4: uh the street officers stop because he got me and
- 21:31Speaker 4: for me there, which was twenty five to thirty minutes
- 21:34Speaker 4: after the set. Okay, okay, now briefcasee no, the briefcage,
- 21:40Speaker 4: the bree fitsess found be hunt at the abandoned apartment
- 21:45Speaker 4: around some little fist in area. The girl was tall
- 21:49Speaker 4: okay side there and the and the briefcate was just
- 21:52Speaker 4: playing in the open, just in the open, like they're
- 21:54Speaker 4: like like, hey, hey see me. I did tell my
- 21:57Speaker 4: attorney that says, how does this flu? And my opened
- 22:00Speaker 4: on the floor and then all of a sudden, my briefcase.
- 22:04Speaker 4: He just should have just, I said, somebody has to
- 22:06Speaker 4: put it to.
- 22:09Speaker 3: Because you don't remember our throwing it up once you
- 22:15Speaker 3: heard the shot, or once you got started whatever happened.
- 22:18Speaker 2: You didn't throw your briefcase or or anything.
- 22:24Speaker 4: No, man, I can't remember of that. And like I said,
- 22:26Speaker 4: everything happened so fast anything I know, I'm coming out
- 22:28Speaker 4: of us. I don't even remember getting on the bus,
- 22:30Speaker 4: they said, I thought on the bus. People said that
- 22:33Speaker 4: I got on the bus and take us about fifteen
- 22:34Speaker 4: to twenty minutes to get to the burger king and
- 22:37Speaker 4: and I've been third positioned bus, so their dad and
- 22:40Speaker 4: everything happens that right, I didn't even remember that. But
- 22:43Speaker 4: what you're saying, if I did that, okay, fod but
- 22:47Speaker 4: you get the brie pa. Like I said, when I
- 22:50Speaker 4: said they throwing down in the white shirt run he
- 22:52Speaker 4: went straight straight to COLTB suite. They can I see
- 22:56Speaker 4: the guy in the black shirt run passive, but turned
- 22:59Speaker 4: towards toward the apartment, to the path. And you.
- 23:05Speaker 2: Know what's kind of strange.
- 23:06Speaker 3: When I looked at the documentary, and the prosecution was
- 23:11Speaker 3: saying that how you was bringing attention to yourself, allegedly
- 23:17Speaker 3: bringing attention to yourself, and they have it written down
- 23:21Speaker 3: on the paper and it was they was highlighting that
- 23:24Speaker 3: you were saying, look at me, I'm here, I'm here,
- 23:26Speaker 3: you know, and ask how the witnesses said pointed you
- 23:30Speaker 3: out that you know, because you was bringing allegedly attention
- 23:34Speaker 3: to yourself. And I'm said to myself while looking at
- 23:37Speaker 3: the documentary, who does that if you're doing something? Are
- 23:42Speaker 3: you gonna did something? Are you going to bring attention
- 23:45Speaker 3: to yourself?
- 23:46Speaker 2: Or are you going to just try to walk away
- 23:48Speaker 2: without nobody.
- 23:49Speaker 3: Noticing you and stuff? But in the documentary it just
- 23:52Speaker 3: says that you was running saying look at me.
- 23:57Speaker 5: Okay, okay, yeah, you said that you follow lost it
- 24:03Speaker 5: against Ballistic Division or the Bear County Medical Examiners Office
- 24:07Speaker 5: for the client, still right, But and you and you
- 24:11Speaker 5: challenge the issue regarding the ballistics in your case are
- 24:15Speaker 5: saying that the evidence in your case was tamped with
- 24:18Speaker 5: off the foual that the ballistic experts and the chief
- 24:20Speaker 5: letical examine then they fought testimony in favor of the
- 24:23Speaker 5: stake to help them secure your conviction. Right, Okay, do
- 24:27Speaker 5: you recall the name of the individual ballistic expert in
- 24:31Speaker 5: your case?
- 24:34Speaker 1: Yeah?
- 24:34Speaker 4: Well so just so what we get the residue test
- 24:37Speaker 4: was David Garcia and Himmothy Pallent, who was over David Garcia. Now,
- 24:44Speaker 4: David Garcia, of my tone. In my case, it wasn't
- 24:47Speaker 4: a damps chief. I mean he was, he was, he
- 24:49Speaker 4: wasn't working there at the time. But what got to
- 24:52Speaker 4: me is when we got the cabbage even had it
- 24:55Speaker 4: because they said I was time bar right. But when
- 24:58Speaker 4: I got these tablet I noticed that under my cage
- 25:03Speaker 4: it said that they died. Because I knew about this
- 25:06Speaker 4: because David Garcia had testified at my twelve. And I
- 25:10Speaker 4: was like, wait a minute, he never testified at my twelve.
- 25:13Speaker 4: Had I had he give me a a an opinion
- 25:16Speaker 4: of the court. Had it said that at this point
- 25:19Speaker 4: of leave me? I was praised to challenge you that
- 25:22Speaker 4: because I have all my transcripts, I had the master
- 25:25Speaker 4: indents to show everybody who testified at my trout, and
- 25:29Speaker 4: David Garcia is not one of them. So I could
- 25:32Speaker 4: have fobably gotten.
- 25:32Speaker 1: Relieved on that, But I don't know how.
- 25:35Speaker 4: So I don't know what happened there, because.
- 25:40Speaker 5: Okay, what's the issue with mister Thorne just amendez, Okay,
- 25:46Speaker 5: why is he saying that he overheard you and mister uh,
- 25:51Speaker 5: mister mister speaking so missus tomorrow speaking to you as
- 25:55Speaker 5: the other guys telling y'all that he need a protection
- 25:58Speaker 5: and that you have access to God. Let's let's uh
- 26:02Speaker 5: canandous for a gun, okay, and that he said he
- 26:05Speaker 5: gave you a weapon. So now my question to you
- 26:08Speaker 5: is this, during the case of the trial, they introduced
- 26:13Speaker 5: reaping in court as being the murder weapon, okay, because
- 26:16Speaker 5: they say they did ballistics and they concluded it. Now,
- 26:20Speaker 5: yet Lester cananis give you a weapon? And if he
- 26:22Speaker 5: did in trial, would that have been the same weapon
- 26:26Speaker 5: that they introduced in court? If you can recall then
- 26:29Speaker 5: I'm God said, don't incriminate yourself if you should, you know,
- 26:33Speaker 5: think if that's what you might do. Don't answer no
- 26:35Speaker 5: questions that we ask you that can incuminate you. Right now,
- 26:39Speaker 5: we don't want you to do that. We just go
- 26:40Speaker 5: the truth. That's all we're fine to do.
- 26:42Speaker 1: So you know, just no, that's a weapon you did.
- 26:50Speaker 4: He never gave me a weapon. Whatsoever. And I'm not
- 26:53Speaker 4: afraid they answer no questions because I have nothing to hide.
- 26:56Speaker 4: So there anything, I'm going to be truthfully offering. Let
- 26:59Speaker 4: they call you right fact, so we continue the conversation. Okay,
- 27:05Speaker 4: a couple of minutes. Okay, Okay, let's call y'all back.
- 27:13Speaker 6: Okay, all right, the caller head hound up, the caller
- 27:19Speaker 6: head tund up.
- 27:21Speaker 4: M hm. This is.
- 27:24Speaker 3: If you guys would like to know the title of
- 27:27Speaker 3: the documentary that the mister legate is.
- 27:31Speaker 2: You can go watch it. It's on YouTube.
- 27:35Speaker 3: It's called Conviction the Let me get I want to
- 27:39Speaker 3: make sure I'm giving you the right information. It's called
- 27:49Speaker 3: Conviction that the Bingo Killer, the Big Murderer. Let me
- 27:56Speaker 3: get that right. I do apologize. I'm in the process
- 28:04Speaker 3: of moving and I got themes all over the place.
- 28:07Speaker 3: And yes, it's called Conviction the Bingo Killer, the Bingo
- 28:14Speaker 3: King Murderer. You can go and you can check it out.
- 28:20Speaker 3: It's in six parts. Each part is like thirteen minutes
- 28:24Speaker 3: and you will see what the defense say and what
- 28:31Speaker 3: the prosecutor said. The prosecutor went in the second part
- 28:37Speaker 3: of the documentary just said it was in so many words,
- 28:41Speaker 3: there was a slam duck case that you know, this
- 28:44Speaker 3: was the easiest case they had, you know, and they
- 28:48Speaker 3: just sit there.
- 28:49Speaker 2: His defense team said that they didn't have.
- 28:54Speaker 3: They believe he didn't have they didn't have enough evidence and.
- 28:59Speaker 6: He didn't have to the free call from hey, very
- 29:04Speaker 6: very give me one minute please an inmate at This
- 29:08Speaker 6: call is being recorded and it is subject to monitoring.
- 29:12Speaker 6: To accept this free call, thank you, forducing to cu Us.
- 29:15Speaker 6: You may start the conversation now, thank you.
- 29:19Speaker 3: Okay, So now we're just waiting on mister uh, mister
- 29:23Speaker 3: Cornell to call. Yes, so was just ship hold on here,
- 29:29Speaker 3: here we go. It's a little hotline going over here.
- 29:32Speaker 3: We got him coming in.
- 29:37Speaker 6: Cornell an inmate at Connolly Unit. This call is being
- 29:43Speaker 6: recorded and it is subject to monitoring. To accept this
- 29:46Speaker 6: free calls to thank you for ucing. Okay, Curris, you
- 29:50Speaker 6: may start the conversation.
- 29:52Speaker 2: Now, okay, okay, now, yes, and we have mister Legate
- 29:57Speaker 2: is back with us.
- 30:00Speaker 4: Okay, okay, so okay, prekant questions, okay, list all right.
- 30:12Speaker 5: Jesse Hernandez is basically a witness against you, Okay, in
- 30:16Speaker 5: the case, thank witness was witness qualified. Okay, he was,
- 30:22Speaker 5: I mean a case code defendant. Anyway, he was the
- 30:25Speaker 5: one who was going to qualify themmunity to testify, okay,
- 30:28Speaker 5: And they he made two statements, and you're questioning the
- 30:31Speaker 5: credibility of one statement that they said that was never taken.
- 30:35Speaker 4: But you are questioning that.
- 30:36Speaker 5: My question now is this mister Fernando's is indicating that
- 30:41Speaker 5: you he overheard mister sam or will tell you and
- 30:45Speaker 5: some other guys that he needs protection, okay, And they
- 30:48Speaker 5: highlighted that end their statement. The state did as if
- 30:52Speaker 5: he was talking about, you know, he needs hibouty to
- 30:55Speaker 5: protect him from being killed. Anyway, Listen, Hernando's is saying
- 30:59Speaker 5: that he gave you a okay, And now here the
- 31:02Speaker 5: weapon being found next to your suitcase, and now they're
- 31:05Speaker 5: indicating that it's a murdered weapon, and now here it is.
- 31:08Speaker 5: This weapon is what's linking you to the crime along
- 31:11Speaker 5: with your suitcase.
- 31:13Speaker 4: Now, if you.
- 31:14Speaker 5: Saying that mister Ananda's never gave you a weapon, right.
- 31:19Speaker 1: Right, that's room okay.
- 31:22Speaker 5: So if we never gave you a weapon right in
- 31:26Speaker 5: this case, did nobody see anybody pick your suitcase up
- 31:31Speaker 5: and take your suthcase down the street with a weapon
- 31:34Speaker 5: and drop it right there out of all I mean,
- 31:36Speaker 5: because we're talking about a quime scene and were talking
- 31:39Speaker 5: about we're talking about people that right here looking at
- 31:42Speaker 5: something that you know, dramatic, and you know people are
- 31:45Speaker 5: gonna be looking. So my question is that did nobody
- 31:48Speaker 5: see anybody take that suthcase along with that gun and
- 31:52Speaker 5: drop it off right there and you know, take off
- 31:55Speaker 5: running away from the crime scene. You see what I'm saying,
- 31:58Speaker 5: because right now it's taking it look like there's no
- 32:00Speaker 5: second person right and everybody's identifying you, even the Boston
- 32:06Speaker 5: identifying you as okay, so you see what important I'll
- 32:10Speaker 5: tell you, how do we cost Dick? What the safe
- 32:14Speaker 5: case is that somebody else put the suitcase? Then, because
- 32:17Speaker 5: you say the suitcase was in the office, Now, why
- 32:20Speaker 5: would you going MIT's office number one? I don't know
- 32:23Speaker 5: that's something there. But now the suitcase is on the floor.
- 32:27Speaker 5: But the suitcase end up way down the street next
- 32:30Speaker 5: to a girl they classify as the mother weapon and
- 32:33Speaker 5: mister Hernandos the send that he gave you a weapon.
- 32:37Speaker 4: So how do we clean that up? What's the bookcase? Well? Well,
- 32:41Speaker 4: like I said earlier, I was looking for a miss Melinmatics, right,
- 32:46Speaker 4: she supposedly she told me she worked at that home
- 32:49Speaker 4: bill people who at the home healthcare center right there
- 32:52Speaker 4: on who in callahad or like I mentioned earlier, the
- 32:55Speaker 4: one I remembered from nineteen ninety six was the one
- 32:58Speaker 4: right next to my friend club. Okay, now when when
- 33:04Speaker 4: I can't hit it that anybody had seen anybody taking
- 33:08Speaker 4: the brief keys or or anything else and goal and planet,
- 33:11Speaker 4: I can't hit it because I don't know effectively it
- 33:14Speaker 4: is if you have police officers there and they can
- 33:17Speaker 4: grabbed this stuff and walk, Nobody's gonna questioned them.
- 33:20Speaker 1: Nobody's couldn't see anything about that.
- 33:22Speaker 4: Now, Jesse Hernandez, I got all my paperwork, which is
- 33:25Speaker 4: called the prosecution guide to report that that was written
- 33:28Speaker 4: by to take the kidnall Bright. He wrote out everything
- 33:31Speaker 4: that transpired. That gun was actually trained to five different
- 33:35Speaker 4: people until they hit Jesse Hernandi or John Hernanda's actually, uh,
- 33:41Speaker 4: he was under the name of Jesse Hernandez.
- 33:45Speaker 1: Which is a false name. Okay, it's his mother's name.
- 33:47Speaker 4: He even testified before the grand jury under a false name,
- 33:51Speaker 4: which the state knew about, but they never corrected. Okay,
- 33:54Speaker 4: So during twelvel he said he gave me a gun, right,
- 33:58Speaker 4: And I asked my attorney ask him if anybody saw
- 34:01Speaker 4: him give me a gun, and he said no. Well,
- 34:04Speaker 4: when I thought my transcripts, dat portions was edited well
- 34:09Speaker 4: removed by my transcripts. I even went on a bed
- 34:13Speaker 4: board back. So if you haven't ever adventure hearing regarding
- 34:16Speaker 4: that testimony like what happened to him? So what happened
- 34:20Speaker 4: is the car reporter says, well, she don't know. She
- 34:23Speaker 4: did have a tape recorder there just for instances like
- 34:27Speaker 4: that if she missed something, well we asked for that.
- 34:30Speaker 4: If they dismissed it, so without any prove I cannot prove,
- 34:34Speaker 4: and that question was asked, So if they did, And
- 34:37Speaker 4: I've been trying to get some footage from ABC, NBC,
- 34:42Speaker 4: TB in all these different television stations were at my crowd,
- 34:49Speaker 4: but I can't ever get it.
- 34:50Speaker 1: I don't have to help.
- 34:51Speaker 4: Anymore, like somebody to help me actually get me, So
- 34:53Speaker 4: I do things on my own. Oh and these reports,
- 34:58Speaker 4: he said, Jessie her Nanda tell Detective all Right well
- 35:02Speaker 4: Ia to change the gate because he was looking for
- 35:08Speaker 4: a car a week before the murder. Further down down
- 35:12Speaker 4: the line, he said I didn't the gate a gun
- 35:15Speaker 4: a month before the murder because he got into a
- 35:18Speaker 4: contract with Federal Tomota to protect him. Right, Okay, so
- 35:23Speaker 4: now we're looking at this discrepancy there. So then later
- 35:27Speaker 4: on the executive said, we asked us if we asked
- 35:30Speaker 4: for Naner if we take a test, a polygraph test,
- 35:34Speaker 4: and he refused every time. So he wasn't being cooperative, right,
- 35:39Speaker 4: he wanted to be cooperative. To what they did is
- 35:41Speaker 4: he kind of hold of miss barlows Us just the prosecutor,
- 35:44Speaker 4: and they said, we want you to subpete on him
- 35:46Speaker 4: to the Grand Tourer.
- 35:48Speaker 1: So when they supeted him to the Grand.
- 35:50Speaker 4: Cur they had they gave him immunity to test the time.
- 35:54Speaker 4: Now I also learned which is it's part of the documentary.
- 35:58Speaker 4: I believe I've never seen the docum every but I
- 36:00Speaker 4: got to the vin from Meryl who who produced the
- 36:04Speaker 4: document that told me everything. She said that she found
- 36:07Speaker 4: out that that I think it was in November of
- 36:11Speaker 4: nineteen ninety eight, Jesse r. Nineis was charged and it
- 36:13Speaker 4: died it for cocaine. That same charge was dropped for
- 36:17Speaker 4: his testimony, so to me, he gave they said he
- 36:21Speaker 4: also gave that safe name because he was on probation
- 36:24Speaker 4: in Godala County. Now, okay, I'm like, well trou so
- 36:30Speaker 4: he had enough reasons toly why I I really don't know.
- 36:35Speaker 4: I just all that I was looking for Meriton manage.
- 36:40Speaker 2: So he testified against you.
- 36:43Speaker 3: When he testified against you, the charges from his other case,
- 36:48Speaker 3: they dropped that in order to get him to testify
- 36:52Speaker 3: on every hand.
- 36:55Speaker 4: Right right. But they did find out that that cage
- 36:59Speaker 4: that ten K, the same case somewhere that I have
- 37:01Speaker 4: which I've been trying to get a copy of and
- 37:03Speaker 4: I can't is killed on his brother's record because he
- 37:07Speaker 4: was using his brother's name at the time. During twelve
- 37:11Speaker 4: he actually gave it real namy. I don't know if
- 37:13Speaker 4: he did it at the Dentley or or he made
- 37:16Speaker 4: a mistake because he thinks that what is your name?
- 37:18Speaker 4: Because one not on your herd dansage. But the prosecutor
- 37:21Speaker 4: right away it was you put by Chesse also go
- 37:24Speaker 4: by Chessea goes yes, And they asked him did he
- 37:27Speaker 4: did they ever give you any deal whatsoever? He said, pull,
- 37:36Speaker 4: you know, but if you got that CHECKI hernanzis he
- 37:40Speaker 4: got a cocaine charge under his brother's name, who is
- 37:45Speaker 4: over there close to Illinois, Chicago, somewhere out that way,
- 37:49Speaker 4: and he's never put down here, so he don't know
- 37:51Speaker 4: nothing about the case or anything like that. So that
- 37:55Speaker 4: shows at the discrepancy there also about that that case
- 37:58Speaker 4: in existence. So there's a lot of boss.
- 38:03Speaker 5: Okay, you're here today because I picked you, I handkicked you,
- 38:08Speaker 5: because I've been following your case. Okay, And the reason
- 38:12Speaker 5: I've been following your case is because of the interesting
- 38:15Speaker 5: dynamics to your case number one. The bingo teams who
- 38:18Speaker 5: was connected at to like congress Member Mr Boostermontag and
- 38:22Speaker 5: noting Edge who says that his client is the one
- 38:27Speaker 5: who told him that he had information that somebody else
- 38:31Speaker 5: was put was said to put a hit out on
- 38:33Speaker 5: mister Garfield. Okay, so all that information that came out,
- 38:37Speaker 5: but mister Delaney said that he did not believe mister
- 38:40Speaker 5: Rodriguez's theory about somebody else putting the hit out on
- 38:44Speaker 5: mister Garfield. So my point to you is this, you
- 38:48Speaker 5: know I am been here today and still to tell
- 38:52Speaker 5: you straight up that I will be one to go
- 38:54Speaker 5: and re looking for your case number one. So you're
- 38:56Speaker 5: not work, You're ready for that much because you have
- 38:58Speaker 5: been handticked now on the shelternight that you're trying to
- 39:01Speaker 5: get the tooth now true enough, you have been You
- 39:04Speaker 5: was intoxicated at the time of the commission of the office.
- 39:07Speaker 5: So it's a lot of things that you don't remember
- 39:09Speaker 5: that took place. But it's a lot of things that's
- 39:12Speaker 5: incriminating to you. You know in your case, that's making
- 39:15Speaker 5: it look like you committed decline because you got witnesses
- 39:19Speaker 5: who are saying things that put you out.
- 39:21Speaker 1: He had a ponytail, that's mister, mister, mister.
- 39:24Speaker 5: You know, so everybody putting you out, they're not fourteen
- 39:28Speaker 5: of second individual out as there's somebody who took the
- 39:32Speaker 5: truthcase down the street put a gun. You know that
- 39:34Speaker 5: they're not doing that. So now the issue right now
- 39:37Speaker 5: is that how do you convince the audience that you
- 39:41Speaker 5: are actually inner and this is what we're here for.
- 39:44Speaker 4: Okay the tooth. Okay, now, now you can I pulled
- 39:49Speaker 4: out of the evidence. There's a lot of evidence that
- 39:51Speaker 4: they trying to use to get when it came out
- 39:53Speaker 4: and everything the gunshot, resident can, the blood art, can
- 40:00Speaker 4: the nation right paper bridge, there's nothing there was no
- 40:02Speaker 4: fingerprints on the bullet, no fingerprints on the gun. Nothing.
- 40:05Speaker 4: Now the the I s on the tape was when
- 40:08Speaker 4: jessere and that his heady overheard Pedro Simora is telling
- 40:12Speaker 4: me I needed to take care of the Tabogabo even
- 40:14Speaker 4: though the devinsic Garcia was no attorney did they argued
- 40:18Speaker 4: at that school they were talking about again. There was
- 40:21Speaker 4: two other guys that Robert Bunters and the Gilbert Coyers
- 40:24Speaker 4: that were supposed to be at the so called meeting,
- 40:27Speaker 4: but the state never called the sithify the only thefto
- 40:31Speaker 4: the night mount on Robert Wilkins, but still they never
- 40:34Speaker 4: got a potifi. Now Fred crow And came out that
- 40:39Speaker 4: Pedro Simura was quill in Mexico and something like that.
- 40:43Speaker 4: But I know that he was cute. So now a
- 40:46Speaker 4: less se jurors and the court only evidence said when
- 40:50Speaker 4: he couldn't we couldn't. We could at the Feda Sima,
- 40:53Speaker 4: I couldn't pretty amned to get his testimony. We couldn't
- 40:56Speaker 4: do nothing. No dis was placed on him on something,
- 40:59Speaker 4: so he was he had while he was dead.
- 41:02Speaker 1: The using jesse Rnandis's.
- 41:04Speaker 4: Uh testimony or I overheard about heard I overheard him.
- 41:08Speaker 4: So that is the honesty on the chase that I
- 41:10Speaker 4: believe was very material to my conviction. Well, twenty years later,
- 41:15Speaker 4: when they came out with a documentary, when beholds Romero
- 41:20Speaker 4: and her team signed mister Simona alive and a picture
- 41:27Speaker 4: of him as his son and his wife wouldn't be
- 41:30Speaker 4: right now, I got to figure how it cooks. Right now,
- 41:33Speaker 4: twenty years later, he's alive, but remember he was supposed
- 41:37Speaker 4: to be dead. Now when they shared this information with
- 41:40Speaker 4: the prosecutors of my cake, Janyamascus Gardner and federal prosecutor
- 41:45Speaker 4: uh Joey Contreda, now their whole there changed all. It's
- 41:51Speaker 4: more than likely that did uh uh a federal Simota
- 41:56Speaker 4: was what would would likely ever made any criminal charges
- 42:00Speaker 4: because there is no independent cooperation to bring a case
- 42:05Speaker 4: to get it. In other words, they're saying there's something
- 42:07Speaker 4: to bring a case to gettison now that he found alive.
- 42:11Speaker 4: But when he was dead, oh he could be. He
- 42:13Speaker 4: hadn't submitted murder. He hadn't submitted murdered. His guy said
- 42:16Speaker 4: he heard him. There is an all single different in
- 42:20Speaker 4: the cage light here.
- 42:22Speaker 2: Why why did get him the comeback to court? Why
- 42:27Speaker 2: don't say getting the comeback.
- 42:31Speaker 4: Well, I don't know, but after I filed out more
- 42:34Speaker 4: than that's where he left, where he lived. I don't
- 42:37Speaker 4: know how to write Spanish, but I wrote a letter
- 42:39Speaker 4: in English and I had somebody like copy in Spanish.
- 42:43Speaker 4: And I don't even know if he went to invite
- 42:45Speaker 4: actress or not, but I wrote the letters and tell him, look,
- 42:49Speaker 4: you were accused of hiring me to do it here
- 42:53Speaker 4: you were accused. I mean you were said to be dead.
- 42:55Speaker 4: But now they found a line, which you know because
- 42:57Speaker 4: he did enough. He did an interview off camera with
- 43:02Speaker 4: the with the music media down there anyway, he uh,
- 43:06Speaker 4: I said, look, I don't know what's going on on
- 43:09Speaker 4: the YouTube, but you need to talk to your lord.
- 43:12Speaker 4: You got a loader does to talk to him if
- 43:14Speaker 4: you want brit clumps in the nutcut and if you
- 43:17Speaker 4: can't fet in effidavit about what's going on, because even
- 43:21Speaker 4: he told him that he went, he goes man.
- 43:23Speaker 1: I don't know nothing about the taste.
- 43:24Speaker 4: He was card.
- 43:25Speaker 1: He was my friend.
- 43:26Speaker 4: In fact, I was at his funeral. So if somebody
- 43:29Speaker 4: had this man Keel Piggy sent voter his shoogle. So anyway,
- 43:34Speaker 4: so I did that, and I even said a copy
- 43:36Speaker 4: of that letter. He is Romero, so she could see
- 43:39Speaker 4: what I was doing because I told her, look, if
- 43:41Speaker 4: anything comes to life, I'm going to give you the
- 43:44Speaker 4: story because you set out for me and you're doing it.
- 43:47Speaker 4: So everything I did I said for her. When I
- 43:49Speaker 4: tried to get the you know, the rest third minutes
- 43:52Speaker 4: against just your nanadus. I can't a copy of the
- 43:55Speaker 4: emotion that I fought. Of course he denied everything, but
- 43:58Speaker 4: the fact of the matter is, and now that or
- 44:02Speaker 4: the border is alive, I'm still I'm still here twenty years, say,
- 44:06Speaker 4: twenty six years later. They don't want to give me
- 44:09Speaker 4: an effidant you're hearing, don't want to take me back,
- 44:11Speaker 4: and I can't be nobody to help me. I don't
- 44:14Speaker 4: know why, so I can't. I just got I just
- 44:17Speaker 4: led up.
- 44:18Speaker 2: Excuse me.
- 44:20Speaker 4: We are done the same thing.
- 44:22Speaker 5: Your case is identicalte to a lot of cases out
- 44:24Speaker 5: of Bear County, mister mcgaton. And with that being said,
- 44:29Speaker 5: I'm saying this, the correction of Bear County is at
- 44:31Speaker 5: an all time high. Okay, So it's not gonna be
- 44:33Speaker 5: hard about this case opened up again. So you know,
- 44:36Speaker 5: just know that that's what we're doing because I find
- 44:39Speaker 5: a lost through.
- 44:39Speaker 4: To against them.
- 44:40Speaker 2: Two.
- 44:40Speaker 1: Right now, My point now to you is this, Okay, Uh,
- 44:45Speaker 1: mister Delaney is.
- 44:48Speaker 5: Saying that mister Roberts, mister Rodriguez is indicating that someone
- 44:52Speaker 5: else has came to him to put a hit. Hoigh on,
- 44:54Speaker 5: mister guard for you. Okay, So what right type of
- 44:57Speaker 5: barroyas did you have in this case? Well your your
- 45:00Speaker 5: thrown up pointed it?
- 45:01Speaker 4: Or were they had attornament? Well, William I hired William,
- 45:09Speaker 4: that hired My family hired him. He was fresh out
- 45:13Speaker 4: of law school. I figured, you know what, I'd rather
- 45:15Speaker 4: have somebody who fresh out of laws because he's don't
- 45:18Speaker 4: want to make a diame ourselves and he wanted to
- 45:20Speaker 4: getting the assistance of a Jesus attorney by the name
- 45:24Speaker 4: of Bill Berchaman, who was tut the chief. Now, Charlos
- 45:27Speaker 4: Rodrigez did come. He was a surprise surprise witness, right.
- 45:31Speaker 4: He came in and he said he had knowledge of
- 45:33Speaker 4: the uh of the incident. Right, Well, he removed the
- 45:36Speaker 4: turps and would get it in camera review of Charlos Rodriguez. Well,
- 45:41Speaker 4: my coincidence the super prosecutor prosecuting my cake with the seat.
- 45:47Speaker 4: Just have to have somebody that was at the point
- 45:50Speaker 4: into another throut that he said that was set to
- 45:53Speaker 4: find out another. So that you about Rodrigus right. Well,
- 45:57Speaker 4: at the time, mister Rodrigus didn't want to give up
- 45:59Speaker 4: no day because he was afraid for his life. But
- 46:02Speaker 4: the judge said, well, it doesn't matter. You see these
- 46:04Speaker 4: cameras over there, they're gonna see you do it anyway.
- 46:06Speaker 4: So this is when, uh, it was payble to Richard
- 46:11Speaker 4: Burt Richton, who at this time is now I believe
- 46:17Speaker 4: on the court the technical criminal Bautis of the justice.
- 46:21Speaker 4: But when he came into testify, he said, look, I
- 46:24Speaker 4: went in there, I was sitting there and I'm listening
- 46:27Speaker 4: to mister Rodriguez. Mister Naga was going on and on
- 46:30Speaker 4: about gas, about trying to get a deal and making money.
- 46:33Speaker 4: He goes to me with his five minutes, I considered
- 46:36Speaker 4: him a cook. So he didn't believe it. So my
- 46:39Speaker 4: attorneys answer was dissolved because he said he was trying
- 46:43Speaker 4: to educate Albert Bustamonte, which was the Es congressman who
- 46:48Speaker 4: the deceived mister Farcia. He writes, Albert Bustamanti supposed to
- 46:54Speaker 4: be bribed him to try to get a contract at
- 46:56Speaker 4: the at the at the Lackman Air Force Base. I
- 46:58Speaker 4: think it was. And because he's look in his congressmanship
- 47:03Speaker 4: and his wife could have went to prison also, he
- 47:05Speaker 4: would head into the deal a three years to center.
- 47:07Speaker 4: He said he met him in the halfway house. Richard
- 47:10Speaker 4: Richard said, would say, well, wait a minute, committed my
- 47:13Speaker 4: attorney's dead. Well did you could investigate the case? And
- 47:17Speaker 4: he said no, He goes, I was just invited to
- 47:19Speaker 4: kidd and you gotta talk to Jack Stick, which is
- 47:22Speaker 4: Jonathan uh d Stick. Uh, that Jack Stick, And I've
- 47:29Speaker 4: been trying.
- 47:29Speaker 5: To find trying to find him.
- 47:31Speaker 4: He did become a take representative one time and now
- 47:34Speaker 4: he's uh, he's a private offer call uh show. In fact,
- 47:39Speaker 4: I just wrote him a letter trying to ask him
- 47:41Speaker 4: beause I just want the truth. You know, do you
- 47:44Speaker 4: have paperwork if you remember this? Were you an assistant
- 47:47Speaker 4: Federal box computer because the time at this time and
- 47:50Speaker 4: we haven't got that a response back to him, But
- 47:53Speaker 4: this is how that all came to play.
- 47:55Speaker 2: I need to I'm gonna need to jump in real
- 47:59Speaker 2: quick because we're eight minutes before our hour is up.
- 48:06Speaker 2: So I'm gonna have to invite you back on the
- 48:10Speaker 2: eighth of August because you were scheduled to.
- 48:13Speaker 3: Come on the eighth originally, but I would like for
- 48:16Speaker 3: you to come back so we can finish this conversation up,
- 48:20Speaker 3: and I know my co hosts have some more questions
- 48:23Speaker 3: and I get to go and finish watching the documentary
- 48:29Speaker 3: and the audience we'll be able to go watch the
- 48:33Speaker 3: documentary and then we can open it up on the
- 48:37Speaker 3: eighth if they want to call in and ask you questions.
- 48:40Speaker 3: Would you be willing to answer any of the audience questions?
- 48:46Speaker 4: Of course, that would any question they asked. I have
- 48:48Speaker 4: nothing to hide, like I said, don't like that is
- 48:50Speaker 4: to choose again, and that's all I'm gonna do. I
- 48:53Speaker 4: don't have nothing to hide. I'm going to answer anybody's questions.
- 48:56Speaker 3: Okay, So I'm gonna give you two minutes to close,
- 49:01Speaker 3: and then I'm gonna go over to my co host
- 49:03Speaker 3: and I'm gonna give him two minutes, and then we're
- 49:06Speaker 3: gonna close it out and we're gonna meet right back
- 49:08Speaker 3: here on August eighth.
- 49:11Speaker 2: So go ahead with your two minutes, mister Legay.
- 49:16Speaker 4: Okay, one thing I like to I like to address it,
- 49:19Speaker 4: call learning matter to what she works. He was always
- 49:23Speaker 4: argument no that she don't work there, She don't work there.
- 49:25Speaker 4: You're you, you went there, get to do the hits?
- 49:26Speaker 4: You want to do the hits. Well, it came out
- 49:29Speaker 4: later on that she did work okay, But the fact
- 49:32Speaker 4: that they failed to realize how did I know? How
- 49:36Speaker 4: did I know where she worked? I just picked it
- 49:38Speaker 4: out of the blues. How did I even know Meridon
- 49:40Speaker 4: matters even existed when I wasn't eleven? Because we're talking
- 49:44Speaker 4: to me or she said he didn't do it? Just
- 49:47Speaker 4: take no investigator. But I understand that later on we
- 49:50Speaker 4: can get to this question, to the the answer to
- 49:53Speaker 4: this question. But I want mister Gillett to think about
- 49:55Speaker 4: that too. Just with it said I didn't do it.
- 49:59Speaker 4: But two thousand and two she died and they had
- 50:02Speaker 4: the case. Well, every day that she told her would
- 50:04Speaker 4: have it would have perfect rather than healthy. So the
- 50:07Speaker 4: point is, well, why hide it? Why did they hide
- 50:10Speaker 4: the switches for me? Why did they hide it from everybody?
- 50:14Speaker 4: And I still can't get that answer, and I've just
- 50:16Speaker 4: put it out there right now. So maybe later on
- 50:18Speaker 4: food for thought, people might want to generate questions or
- 50:21Speaker 4: re evaluate this.
- 50:22Speaker 2: Yeah, because I had a question.
- 50:24Speaker 3: I had a question about that. But I'm a whole
- 50:26Speaker 3: minds until the eighth co host Cornell.
- 50:32Speaker 5: Well, Yes, sir, Yes, sir, Yes, sir, Thank you, ma'am.
- 50:35Speaker 5: Mister mcgage, you have a very complicated situation you're dealing
- 50:38Speaker 5: bit okay, and here in the fact that there's a
- 50:41Speaker 5: lot of inconsistencies in your case and a lot of
- 50:44Speaker 5: evidence that tended to connect to you but tending to
- 50:48Speaker 5: implicate other people in your case. The issue right here
- 50:52Speaker 5: is that when we have to try to do, mister mcgay,
- 50:54Speaker 5: to try to figure out what is the new and
- 50:56Speaker 5: the hate stack of this case on how to get
- 50:59Speaker 5: you a review to kitch you and evidentiary hearing to
- 51:02Speaker 5: find some type of eviness to prove that the ballistics
- 51:05Speaker 5: is no good. The thing a prison's never done. You
- 51:08Speaker 5: know what I'm saying, Something in your fish that has
- 51:10Speaker 5: to open the key open your case, and we want
- 51:13Speaker 5: to find that out, sir.
- 51:14Speaker 4: That's why we're here.
- 51:15Speaker 5: And I'm not gonna stop with your case until we
- 51:17Speaker 5: do that. Missus Sennett is not gonna stop with your
- 51:20Speaker 5: k and you do that, Missus Angela is not gonna
- 51:23Speaker 5: stop with Jr. Case you do that, our hands kicked
- 51:25Speaker 5: you for a reason. Okay, just know that, thank you,
- 51:28Speaker 5: and we're gonna do this. So all we can ask
- 51:30Speaker 5: for you to do is to be patient with us.
- 51:32Speaker 5: And you know, like she said, you'll be back on
- 51:34Speaker 5: the eighth, and I pray to be here, you know,
- 51:36Speaker 5: to be.
- 51:37Speaker 1: Able to ask the questions.
- 51:39Speaker 5: And no matter where I go, you will continue to
- 51:40Speaker 5: know where I'm at because they will make sure that
- 51:42Speaker 5: you know exactly where I'm at. And I will continue
- 51:45Speaker 5: to keep in touch with you.
- 51:46Speaker 4: Is that okay? With you?
- 51:47Speaker 1: Thank you so much, Thank you so much, all right,
- 51:50Speaker 1: so much.
- 51:50Speaker 4: I do appreciate all your Oh I do appreciate you.
- 51:54Speaker 4: Thank you.
- 51:55Speaker 3: I would like to say thank you to mister Legate
- 51:58Speaker 3: for coming on and sharing your story.
- 52:02Speaker 2: I would like to say thank you to my co
- 52:04Speaker 2: host for now one you guys, soon is going to
- 52:10Speaker 2: see my co host next to me.
- 52:12Speaker 3: We're gonna be standing on somebody capital, as he said,
- 52:15Speaker 3: like he can telling me, we're gonna be standing on
- 52:18Speaker 3: somebody's capital, so soon he could be tomorrow, he can
- 52:23Speaker 3: be standing next to me.
- 52:24Speaker 2: I am so excited that I will finally get to
- 52:27Speaker 2: meet him a person.
- 52:30Speaker 3: Thank you guys once again for tuning in to let's
- 52:34Speaker 3: talk about it.
- 52:36Speaker 2: Tune in on.
- 52:39Speaker 3: August eighth, when we will continuously talk to mister Legate
- 52:43Speaker 3: about his conviction.
- 52:47Speaker 4: Hey, thank you.
- 52:48Speaker 2: Were an election here, we are an election.
- 52:52Speaker 4: Yere.
- 52:53Speaker 3: You guys get out there and vote. Please do not
- 52:56Speaker 3: say that you're not gonna vote, because if you don't,
- 53:01Speaker 3: that voat goes to the other person. Don't do that,
- 53:05Speaker 3: don't do our Let's let's get out there and make
- 53:08Speaker 3: a difference. Let's get out there and.
- 53:09Speaker 2: Use our voice.
- 53:11Speaker 3: And even though our if our voices is shaky. You
- 53:14Speaker 3: know it's hot out here in California. So if you
- 53:19Speaker 3: in California, if you in Vegas, wherever you at watching,
- 53:27Speaker 3: don't forget to drink your water, stay hydrated, stay in.
- 53:32Speaker 2: Your own lane. If you're not going to use your
- 53:35Speaker 2: voice to speak against an injustice or anything.
- 53:41Speaker 3: Else, it don't have to be in justice, but if
- 53:44Speaker 3: you're not going to speak up, then stay in your
- 53:47Speaker 3: own lane.
- 53:49Speaker 2: I love you, and have a good night. You're welcome,
- 53:53Speaker 2: mister Legate. All things that they used to be
