- 2:02West Virginia Turnpike right now, and you've heard Chris and carrying the team talking
- 2:07about it throughout the morning. Turn practice effectively shut down and because of an
- 2:10accident there and probably possibly some hazardous materials there in an area around well,
- 2:15let me tell you this. Just go to the Facebook page, to the
- 2:17go to the x artist formly notice Twitter, and Chris has got it all
- 2:22laid out there for you as to exactly where it is. But if you
- 2:23could be traveling on the turnpike and down to Beckley or wherever this morning,
- 2:28it's gonna I don't want to say it's gonna be a slow go, it's
- 2:30gonna be a no go. So just know that before you go it again,
- 2:32We've got everything laid out for you on the website and also on our
- 2:37social media pages as well. In a situation on the West Virginia Turnpike coming
- 2:40up a little bit later on, and the one of Greg Thomas is going
- 2:43to join us and we're going to talk a little bit. Well we always
- 2:46talk politics from Greg Thomas, but there's something else that we want to get
- 2:49into with Greg, and that has to do with this opioid settlement that was
- 2:54announced and uh, well, Gregg and a few others are a little upset
- 2:58about the amount of money going to a turn and specific attorneys that are benefiting
- 3:01from that. Greg Thomas is going to join us to talk about that a
- 3:05little bit later on, but before we do that, it is homecoming weekend
- 3:07in Hunteyton Marshall getting ready to take on Old Minion Saturday afternoon at the Jone.
- 3:13Matt James is the executive director of Alumni Relations of Marshall. When he
- 3:15joins us, now, Matt, good morning, Welcome to the show.
- 3:19Hey Dave, good morning, Thanks for having me, Thank you for being
- 3:22here. You know, I almost feel guilty for having you on. The
- 3:24show is latest Thursday, because homecoming activities, Matt have been going on all
- 3:29week on campus and all around Honeyton. Talk about what's already gone on around
- 3:32the Jewel City as it relates to homecoming. Hey, yeah, you know,
- 3:37we've had a great week already and we're only halfway through, to be
- 3:39honest. And so Monday we kicked off our annual homecoming festivities with the twelfth
- 3:45annual Unity Walk and that is basically one big family reunion for all of our
- 3:51Herd family. We gather at the rec Center, we split into two and
- 3:53half of the family marches down third avenue, the other half down fifth,
- 3:57we converge on the plause at the fountain and we ounce the homecoming court.
- 4:00So that was pretty exciting. Our student organizations have been competing all week in
- 4:04the annual thunder Cup competition, which is pretty fun. They raised money throughout
- 4:08the week for local charities. They also compete in trivia. They had chalcoa
- 4:13Walk because we have I think a cool theme this year at super Marco level
- 4:15Up, so we're playing off of the recent Mario movie also leveling yeah,
- 4:20and leveling up to you know everything. With our new president, Brad Smith,
- 4:25he's really taking Marshall to the next level. So we've had a lot
- 4:27of fun so far, and we've got a big two days coming up too.
- 4:30So yeah, here we are on Thursday. So what's happening over the
- 4:32next couple of days leading up to game time. Yeah, so tonight we're
- 4:35gonna be Our athletics family is actually going to be putting rolling out the outdoor
- 4:42basketball court again. I think it's the second time they've done this. It's
- 4:45called Hookston Huntington, and so our student athletes will be downtown at six o'clock
- 4:48for some pregame festivities. And signing some autographs down at Pullman Plaza here in
- 4:54downtown Huntington, and then at seven o'clock they'll do a little showcase with the
- 4:58basketball teams. For you. It's going to be a lot of exciting things
- 5:00going on there this evening. You actually, I plan I'll be in there
- 5:03this evening. So what do we got going on Tomorrow and into Saturday?
- 5:06As I said leading up to kick off, Yeah, so tomorrow is our
- 5:10big day. So for about the past ten years, we've had our parade
- 5:13on Thursday night, and that wasn't really you know, conducive for many of
- 5:15our alumnis. So that's what's exciting for the folks I get to work with
- 5:18every day this year is many of them will be in town tomorrow night.
- 5:21So our parade we'll kick off at six o'clock. It starts downtown on Fourth
- 5:26Avenue around the Keith Albey Theater. It's going to come all the way down
- 5:29Fourth Avenue, take a right at campus at Old Maine, and then an
- 5:31immediate left on the fifth Avenue, coming all the way down until you get
- 5:35to Harless Field. There's a bonfire that follows the parade, and you know
- 5:39the community is invited to all of these events. We hope they'll come out.
- 5:42The weather's supposed to be great. I should mentioned too, we're bringing
- 5:45back the twenty fifth and fiftieth class reunions. Those are at four o'clock tomorrow.
- 5:48We've got about one hundred folks that are registered for those. What's exciting
- 5:51about that is the pandemic, you know, kind of killed those events for
- 5:55a while, and we didn't we weren't able to have those. We're really
- 5:57excited to bring back the classes of nineteen seventy three and nineteen ninety eight.
- 6:00Yeah, that's good stuff. Director any Here, we're talking with Matt James,
- 6:02who is the executive director of Alumni Relations at Marshall University. Is the
- 6:06Herd and everyone around there gets ready for homecoming. Matt this weekend. Now,
- 6:11what about Saturday? What about game Day? Well? You got yeah,
- 6:14so game days are big day. Kickoff's at three thirty. We've got
- 6:15a great conference opponent, no du We're gonna get a Herd win. But
- 6:19before that, at twelve thirty, we have our family and alumni Telgate and
- 6:24that'll be taking place in the green space between Edwards Stadium and the football practice
- 6:29facility. It's right behind McDonald's. It's twenty dollars a person. It's all
- 6:32you can eat and all you can drink beer, and we hope folks will
- 6:34join us. We're going to be back there from twelve thirty until kickoff at
- 6:38three thirty. And again there's a game in there somewhere. As we said,
- 6:41the Herds have been looking really good this season. And I will say
- 6:44this Matt as a as a son of Marshall, you know, homecoming.
- 6:46With all due respect to all the other colleges in the state, it hits
- 6:50a little different at Marshall. And I don't know that there's any school that
- 6:57values it's alumni more than what Marshall University does. Talk about that, Yeah,
- 7:03man, I couldn't agree more. I was actually having this conversation with
- 7:06one of our alumni yesterday, Lucy and Call. She's actually the daughter of
- 7:13the athletic director who was on the plane in nineteen seventy and so I think
- 7:15everything goes back to what happened on that day right in November of nineteen seventy,
- 7:19but it's everything that's happened since then. We haven't let that define us.
- 7:23And so we talked about you know, homecoming is that time of the
- 7:26year for us, with our unique story that we get to pause and celebrate.
- 7:30You know, November is really somber and we pause and reflect and remember.
- 7:32But there is so much positive going on right now on our campus.
- 7:36Much of it is coming from the leadership of Bratt Smith and Christian Spears and
- 7:40athletics, and you know, I'm just excited to be a part of it.
- 7:43But yeah, man, it does hit differently, and I think it's
- 7:45because there's just something unique about our story. I would agree with that.
- 7:48And you know you can. I can tell you I've been on vacation places
- 7:54and I'll have a Marshall baseball cap on or Marshall jersey or something, and
- 7:57somebody will This actually happened to me. I'll beach a couple of years ago.
- 8:01I'm walking down the boardwalk and I've got a Marshall baseball cap on,
- 8:05and someone stopped me and started talking about Marshall University, you know, and
- 8:09Myrtle Beach because and and Marshall also has a lot of alums all over all
- 8:13over the country. They get together, even the ones that can't come in
- 8:16for homecoming, they get together and they watch games and they and a lot
- 8:20of other colleges do that too, and I certainly respect that. But it's
- 8:24just amazing, you know, to me when when when you believe Green and
- 8:28white, you really believe Green and white. Oh yeah, man. And
- 8:30our alumni base is powerful just over the last year since I've been in this
- 8:33job, so I'm like two weeks shy of being in this job for a
- 8:35year, it's slown by. We've doubled the number of alumni chapters. Again.
- 8:39I think it's just because our folks want to be a part of this
- 8:43excitement. They want to be a part of what's going on. So,
- 8:45like you said, we're rallying around athletics. There's a lot of excitement going
- 8:48there. So we have game watching parties. But piece folks were also raising
- 8:50money for scholarships for the next generation of students. You know, President Smith,
- 8:56our Marshall for all Marshall Forever plan. You know, in fifteen years
- 9:00we're gonna have students graduating debt free, and that's going to take all of
- 9:03us, you know, towing in the same direction. And so I just
- 9:05can't say enough about where we are as a school and where we're going.
- 9:09Yeah, exactly right. And I'll tell you as somebody who was a Marshall
- 9:11student back in the early nineteen nineties, it's I was here when they built
- 9:16the stadium, when they built the jone, and and how much it's grown
- 9:20even since then. And a couple of years ago in a former job I
- 9:24had, I had got a chance to get people a tour of Huntington and
- 9:28I was going, I was driving town like you know how greer at a
- 9:31third Avenue when I was appointing that this wasn't here when I was here.
- 9:33This wasn't here when I was here, This wasn't here. It's it's totally
- 9:37it's totally changed now. On the field, Marshall, of course, coming
- 9:39off that big one over Virginia Tech last week, our running back Rachine Ali
- 9:45is the reigning Sun Belt Conference offensive player of the week. It's going to
- 9:48be a great, great game I think this weekend against as you said,
- 9:52a conference foe in Old Dominion that's kind of kind of turned into our one
- 9:56of our newest rivals because it's really not that far away, so they're probably
- 9:58gonna bring some people pulled up too. Is there a convenient place, Matt
- 10:01where people can go online your website or social media or whatever where people can
- 10:05kind of see all these activities that we talked about. Yeah, that's a
- 10:09great question. So they can find us on Facebook. All of our stulves
- 10:11on Facebook. It's alumni and foundation. The university also has a website where
- 10:16everything is listed. It's Marshall dot etu slash homecoming. If you just go
- 10:20to the Marshall page and type in homecoming, you'll find everything we just talked
- 10:24about. Matt. I appreciate you taking time out of your schedule to be
- 10:26here. I know it's a very, very busy day. I didn't dare
- 10:28to try to get you on the show tomorrow because I know you're going to
- 10:30be really tied up. The only reason I got you on this morning is
- 10:33because it's relatively early. You just getting things going there. Matt. I'll
- 10:35be down there tonight and through the weekend. I will see you later,
- 10:39my friend. Thanks for being here, all right, man, I appreciate
- 10:41you. Go hurt nay absolutely. Matt James, Executive director of Alumni Relations
- 10:45at Marshall University. Five eighty Lives brought to you a part by General Hardware
- 10:48and Lumber of Winfield from kitchens, to paint Sedeck's straight framing wood, roofing
- 10:52metal at anything else you need, you're gonna find it at General Hardware and
- 10:56Lumber of Winfield. I started the segment by talking about this accident on the
- 11:01turnpike. It just got some more information here. This tractor trailer that crashed
- 11:05this morning was carrying several thousand pounds of hazardous material forty four thousand pounds of
- 11:11ammonium nitrate, which the Parkways Authority says is hazardous and if of course,
- 11:18is a flammable compound. Several agencies, including the West Virginia Department of Environmental
- 11:24Protection, the state Police, and others are currently on the scene and the
- 11:26road is expected to be closed until crews can clear the scene. There is
- 11:31no timetable available for that now. The crash was reported in the northbound lanes
- 11:37around six forty this morning near mile marker sixty two in Fayette County. It's
- 11:43according to the Parkways Authority, and there are saying that the driver thankfully was
- 11:48not hurt in the incident. No more information is being released at this time.
- 11:52So again that's what we're looking at right now, And of course Jeff
- 11:56and Chris and carrying their crew. Will keep you updated throughout the day on
- 12:00this, But don't plan on traveling the turnpike. That would be the best
- 12:03device I had for you. This was a tractor trailer carrying around forty four
- 12:07thousand pounds of ammonium nitrates and the crash happening around six forty this morning,
- 12:13and so again just just a serious situation there. So if I were you,
- 12:18I just simply would not plan on traveling in that area today. And
- 12:22we'll keep you updated on the air, on the websites, to social media's

- 15:48talk to Greg here in just a couple of moments, if you'll bear with
- 15:50me for just a moment. You know, from time to time I do
- 15:52something I call daviatorials, where I attempt to wax poetically. I've never succeed
- 15:58on a ticular topic that I feel kind of passionately about. Yesterday it was
- 16:03announced that one of my brethren in a world of talk radio, one of
- 16:07the best. More than that, at a moment, Tom Rotten of w
- 16:10VHU Radio and Huntington, was relieved of his duties really through no fault of
- 16:15his own, more because it works for an evil company in iHeart Radio,
- 16:19that couldn't care less about quality programming or being a part of the community.
- 16:23In fact, if you listen to their stations in a variety like we do,
- 16:27of different stations and their abuilding in different formats and whatnot, but what
- 16:30you may find interesting is that very few of those people are actually located in
- 16:33West Virginia. They've basically, again my opinion only mine, basically destroyed an
- 16:41industry that I've been a part of for thirty five years. Their ultimate goal
- 16:45is to eliminate all local radio programming, because they think that radio consumers would
- 16:49rather hear announcers out of Dallas or somewhere rather than in their own hometowns.
- 16:52Now, Tom Rotten and I could not be any more different politically. I
- 16:56consider myself to be a more moderate Republican. Tom is and was so far
- 17:03right that Greg Thomas Mark Tarr may say, Man, that guy's really really
- 17:07far right. But Tom was one of the brotherhood. He and I met
- 17:11in college at Marshall on the college radio station WMUL. I was a news
- 17:15guy, he was a sports guy, and we remained friends after that.
- 17:18Again, Roten and I were very different politically, and even though I didn't
- 17:22agree with him on about ninety percent of what he said on the radio,
- 17:26he was a true home grown radio guy. Then companies like that want a
- 17:32silence, not for political reasons, some would think, but for the bottom
- 17:36line. And and you know, I'm the king of capitalists. People know
- 17:38that. You know that about me, but not at the expense of crapping
- 17:41all over quality local programming which love him or hate him, Tom Roten offered,
- 17:48So I just say, you know, Shame on you, iHeart.
- 17:51Shame on you for what you've done to this industry, and shame on you
- 17:53for doing what you did to a guy again that I couldn't be anymore different.
- 18:00He'll be fine, Tom Rotten will will rebound. I hurt you Suck.
- 18:06Five eighty Live has brought to you and parted by Husbands Pizza this month
- 18:07get yourself at large eighteen hitch Pepperoni Pizza and to strong Bowli only twenty two
- 18:11ninety nine. Visit Husbands Pizza dot com forward to tell us. Greg Thomas
- 18:17is here. How are you, my friend? Doing real well, doing
- 18:18real well? How are you? Thank you? Thank you for being here.
- 18:22You know you and I get to talk political stuff. We'll get that
- 18:23a little bit later on, but we'll talk about this opioid UH settlement and
- 18:30and and some of your your criticism and Citizens Against Lawsuit Abuse, the group
- 18:34that you're a part of, and their criticism towards the millions of dollars and
- 18:37attorneys fees, and that's subtle. But now i'd like for you, Greg,
- 18:41if you would to take the story from the top how this whole thing
- 18:45came about. Then we're going to kind of break it down and tie some
- 18:49other people into it. But but but take the story from the top.
- 18:52So so this lawsuit, this isn't a typical lawsuit like you would call down
- 18:56to you know, somebody on the Yellow Pages and call up and say,
- 19:02hey, I you know, uh, you know, I was in a
- 19:04carrect I need you to sue somebody. This this is what's called a public
- 19:08nuisance lawsuit. And what these are. These are filed on behalf of governments.
- 19:14And this in this particular lawsuit was you know, a catch all of
- 19:19everybody in the opioid industry that had done anything to kind of promote the opoid
- 19:26you know, devastation that that hit our state. So the state of West
- 19:30Virginia, UH filed suit. And that's you know, through the Attorney General's
- 19:34office. A lot of different cities and counties filed suit. And and Patrick
- 19:41Morseley he's filed a lot of these claims like this. You know, he
- 19:45this this isn't the first public nuisance lawsuit he's filed. He's he you know,
- 19:49he this is a tactic that he uses quite a bit. Uh.
- 19:55There was actually this this same claim was filed in federal court, but was
- 20:00dismissed if you remember, I think that was like last summer and it was
- 20:03dismissed. So, but the way it worked on the state level, it
- 20:07was filed in state court and the State Supreme Court sent it to what's called
- 20:11a mass litigation panel. So they essentially signed three judges to a panel to
- 20:15say, hey, here's this really really big case that's going to take a
- 20:19lot of a time, a lot of attention, and you know, we
- 20:22want to make sure we have uh, you know, season judges that will
- 20:26be on this. And there were and there were three judges on it.
- 20:27Initially there was Judge Alan Moates, Judge Derek Swope who's from down in Mercer,
- 20:33and there was actually Judge Hutchinson who's now on the State Supreme Court,
- 20:36so he was initially on it, but once he was appointed to the State
- 20:40Supreme Court, they removed him from this panel and they just left the two
- 20:42judges. So at that point, Judge Moates was the lead that was sort
- 20:48of the head judge on it, and he appointed Morrissey to sort of be
- 20:52the lead attorney. Right. It was like, okay, look, you're
- 20:53you represent the states, you're the biggest, you have the biggest client.
- 20:57When you're the attorney general, you're basically the top Yeah, and and and
- 21:00you know and you you know, so you're you know, the claims that
- 21:03you are making of damages so to speak, or you know, hey,
- 21:07here's all the bad stuff that you've done to the state, and this is
- 21:11why we need uh, you know, compensation for for what's been done for
- 21:15us through this opoids. And so he had two roles in that. One
- 21:19role was to negotiate the settlement, right like, you know, you know,
- 21:25head the case once they said, hey, we're going to settle this.
- 21:29You know, you negotiate the settlement with all the defendants. But the
- 21:33second part of it was to work out the attorney's fees. And so that's
- 21:37you know, we're not here to you know, we we don't get involved
- 21:41in cases like while they're going on. Yeah, in our organization, we
- 21:45don't go in and say, hey, you should have filed it. Should
- 21:48you know, maybe after the whole thing's over, we really go in and
- 21:51say, hey, gosh, that was whatever. But that's that's not what
- 21:53we're doing here. What we're doing here is saying, okay, you know,
- 21:56this was a nearly billion dollars settlement nine hundred mill and so, uh,
- 22:04you know, there was a this was a this was a five week
- 22:07trial and at the end of it, we we ended up with this settlement.
- 22:11Uh. And so the way it works with the Attorney General's office like,
- 22:15uh, he essentially sends out like an RFP. Right, it's like,
- 22:18okay, you know we're gonna hire. You know that he doesn't do
- 22:22it internally. You know, these are pretty complex cases. They don't do
- 22:23it internally. So they say, hey, who can do this? And
- 22:26so four different law firms submitted RFPs. He picked two. Uh. Those
- 22:32two firms were Rusty Webb here in Charleston. Uh, and then a firm
- 22:37named Motley Rice, which is a big national firm out of South Carolina that
- 22:41does this kind of stuff all over the country. There's actually a big national
- 22:45lawsuit with the same issues that were also part of and Motley Rice is the
- 22:52lead attorney on the national lawsuit, which would essentially be the same kind of
- 22:55things. Right, it's the same elements, the same you know, the
- 22:57same legal theories that they have. And that's that's actually going on at at
- 23:02a federal court up in Cleveland. So what what's happened though kind of to
- 23:07update everybody. So all that goes on. So last Friday, Judge Wilkes,
- 23:12who was a you know, a judge that used to serve in the
- 23:18in the Eastern Panhandle, must be like senior status or something now, came
- 23:22in and essentially reviewed all of the information about the attorney's fees and approved it
- 23:30right so that there was a settlement and this is what I this is actually
- 23:36what something we're trying to get a little clarification on is exactly like you know,
- 23:40what information is sent to Wilkes for him to say, Okay, yeah,
- 23:41I approve this or don't approve it. But Wilkes essentially approved it on
- 23:45Friday and sent out a thing saying, you know, one hundred and forty
- 23:51one million dollars are going to attorneys for their work on this cases. One
- 23:56hundred and forty one million dollars. Repeat that, one million dollars, which
- 24:06is literally like about what you know, we keep talking about flatline budgets in
- 24:11the state, and like, that's how much money the state didn't spend every
- 24:15year to over the last five or six years to give us the biggest tax
- 24:18cut in state history. So we're talking about a lot of money. Two
- 24:22of the firms, the Rusty Web Firm and Motley Rice, received nearly fifty
- 24:29million dollars each. And so, uh, you know that came out on
- 24:33Friday. We put out a statement on Monday essentially saying like, hey,
- 24:37we think this is we think this is outrageous, this is an excessive amount
- 24:41of money. We were very critical of former and not all your listeners will
- 24:47remember, but many will. But you know, former Darrel mcgrawl, this
- 24:49is what he did, right, So, like our organization was very critical
- 24:53of mcgrawl when he did this stuff. Uh, it was a big campaign
- 24:57issue with mcgrawl when Morrisey was elected, right, so this was something that
- 25:00was like, hey, elect our guy and we won't do this kind of
- 25:03stuff. Well that that didn't end up to turn it out to be the
- 25:07case, uh, as often often is with the career politicians. So you
- 25:12know, we come out with a statement saying, hey, this is crazy.
- 25:17Uh, you know, and Morrisey responds with, you know, as
- 25:21he often does with personal attacks and things like that, because that's sort of
- 25:23his style. But but the other thing he did was he sort of threw
- 25:27the other attorneys under the bus. Right, So, like he hired two
- 25:30attorneys, but all those cities and counties that we talked about, they hired
- 25:33their own attorneys and so they get money too. So then you know,
- 25:37some Morrisey goes on Hoppy yesterday and kind of he defends he's essentially I think
- 25:42his position at this point is he's defending his lawyers, but saying the other
- 25:47lawyers they may not deserve all the money they got. My lawyers do,
- 25:48but I don't know about the others. Let me let me champion, let
- 25:52me read the statement, okay from this was a statement that his office put
- 25:56out. And as you said, Greg, and again we're talking with Greg
- 25:57Thomas H. Morrisey was on Hoppy yesterday, but this was a statement he
- 26:02said. It's absurd and flat out asinine for an uninformed and conflicted individual,
- 26:08I'm presuming that would be you, Sir Gregory, to give his take on
- 26:12something he knows nothing or very little about. Learn the fact before making assumptions.
- 26:19Uh. It sounds like I knows a lot of the facts and the
- 26:23one that you know, the things that I don't know, we're asking questions
- 26:26on and getting information on. But that's that's what you know. That's what
- 26:30bullies do, right, I mean that's the kind of sting coman. Patrick
- 26:33Morrisey a bully, absolutely, you know, that's what bullies do, and
- 26:37that's his style. Uh, you know, he's just he's trying to one
- 26:41hundred million dollars to two lawyers. Is indefensible. It just is. It's
- 26:45not it's not a defense. I mean that that is. It shocks the
- 26:48conscience. It's such an outrageous thing to say, and and for him to
- 26:52go out and continue to do this. So anyway, So so that's what
- 26:56he'd been doing. But all of a sudden, now the pressure is building
- 26:59up, right, and he is having a go on hoppy and you know,
- 27:00everybody's talking to him, and there's stories on Metro News and the Record
- 27:04and ever, you know all, you know, all I'm getting all kinds
- 27:07of comments and people I hadn't heard from in five years. I saw on
- 27:10TV last I was like, my wife said, Greg's on TV. Well,
- 27:14and so a good segue to this part. So, so Mark Kurtis
- 27:17calls me and says, hey, do you want to talk about this now?
- 27:19Political WWK? So I go on and do it. And so he
- 27:23had interviewed Morrisey, right, before me. So as he's interviewed me,
- 27:27and he's like, what do you have to say about it? And I'm
- 27:29like, look, you know, uh, one hundred and forty one million
- 27:32dollars is outrageous. The fifty million dollars, you know, fifty million dollars
- 27:34to an out of state, big time Democrat law firm is outrageous, you
- 27:38know. And so he says to me, what do you think we should
- 27:42do about it? And I'm like, well, I don't know if there's
- 27:45anything we can do about it right now. What at a minimum, we
- 27:49need to, you know, revisit this process, figure out how it's done,
- 27:53you know, make sure that this kind of thing doesn't happen again.
- 27:56Right And and the point of this, everybody is for the hundred and forty
- 28:00one million dollars. Like we're not saying it goes back to the defendants.
- 28:03It should go to the public. This was a public nuisance lawsuit. There
- 28:07are a lot of people impacted by this, and that's where the money deserves
- 28:10to go. So essentially, Patrick Morrisy is saying, I think the money
- 28:15deserves to go to lawyers and not the people. That's what he's saying.
- 28:17There's no other. You can be uninformed if you want to be uninformed.
- 28:22But that's the own that's the way that this goes. And so Mark Curtis
- 28:26says to me, he goes and I said, and he goes, Well,
- 28:29he says to me, well, you know, Patrick Morrisey told the
- 28:32Attorney General told me that he wants these fees cut in half. And you
- 28:36know, I stepped back in my eyes get wide, and I'm like,
- 28:38well, you know that's interesting because he's the one that negotiated the attorney's fees
- 28:42with the with the court. And so the story so Mark's you know,
- 28:47so the WWK story comes out last night and Morrissey said in the story that
- 28:52he wants the fees cut. They did not say by the fifty percent,
- 28:56as Mark had told me kind of personally when we were doing the interview that
- 29:00he won him cut in half, but he did say he wanted him cut.
- 29:02And I've had a bunch of people call me last night in this morning
- 29:04and say, how would we even do that now? And what I have
- 29:08found out, uh, you know, not being you know, if I'm
- 29:12uninformed out something, I can go and become informed on it. And I've
- 29:17found out that the there will be a hearing on October thirteenth at two o'clock
- 29:22in Courtroom four. That's the Ceremonial courtroom on the second floor of the Cana
- 29:27County Courthouse. Uh. And it's a notice of hearing regarding the distribution of
- 29:32settlement proceeds from the West Virginia First Qualified Settlement Fund. So essentially, you
- 29:38know, they they you know, they there's this settlement of the what kind
- 29:44of fees they're supposed to have. It's been kind of preapproved by Judge Wilkes
- 29:48and now it has to get the final approval by by Moats and uh and
- 29:52Swope here and so you know, we've got a little time. You know.
- 29:56So for those people out there that think that, you know, not
- 29:59all all of this one hundred and forty one million dollars should go to you
- 30:03know, personal injury lawyers and big time Democrat out of state firms like Motley
- 30:07Rice. Uh. You know, I'd call the Attorney General's office, I'd
- 30:11call your local legislator. I mean, I think there's you know, I
- 30:14think there is a little bit of time to get some information in here.
- 30:18And if Morrissey truly believes what he said about you, know, hey,
- 30:19I think the settlement funds need to be cut. You know, maybe there's
- 30:22something he can do. Maybe maybe he is helpless here. You know,
- 30:26maybe he is, but maybe he isn't right, And so I think there's
- 30:30an opportunity for our leaders to get involved and try to make sure we secure
- 30:36as many funds as possible to help those that have been affected by this opioid
- 30:40crisis. Talk about this the law firm of Motley Rice, not to be
- 30:45confused with Motley Crewe, which that would make an awesome law firm, by
- 30:48the way, But talk about this law firm and a little digging that that
- 30:52you did on them and some of their ties. Well it doesn't take much
- 30:56digging. You know, you can google Motley Rice, uh political affiliation or
- 31:00Democrats or whatever there are. Motley Rice is one of the biggest law firms
- 31:04in the country South Carolina basin, Yeah, outside of Charleston, South Carolina.
- 31:08They handle big time lawsuits like this right there. You know they come
- 31:14in and that you know, they were very involved in the tobacco legislation from
- 31:18twenty years ago or whenever it was. They are They are the lead counsel
- 31:22on this open would legislator the federal openwood legislation right now. But they're also
- 31:27the largest. Uh. Their law firm donates more to Democrats and liberal interest
- 31:34than any other law firm in the country. So this is a very very
- 31:38liberal, big time democrat law firm. Uh that you know that Patrick Morrisey
- 31:44is is you know, hired to do work on behalf of the state of
- 31:47West Virginia. And but now why, now, how does that process work?
- 31:49Greg Because I am totally ignorant on this, How does that? How
- 31:52does that process work? That that he that he chose you of this law
- 31:56firm. Because I say this because you know, mister Morrissey, when he's
- 31:59been on this show in other places, has said he's the only true conservative
- 32:04running for governor. So as if he is the only true conservative running for
- 32:07governor, why would he, I mean, how would he go about employing
- 32:12this particular law firm out of out of South Carolina. It's known, it's
- 32:15known for that's that'd be a good question for him and voters, I guess,
- 32:20I mean, I you know the way it works, and I talked
- 32:22about this earlier. You know, he puts you know, Morsey essentially puts
- 32:24out an RFP that says, hey, yeah, we're gonna do this,
- 32:27We're gonna do this lawsuit. They would come in though, and say,
- 32:31you know, hey, we're the national expert on this. That's why you
- 32:35need to hire us. Right, But would he have the right to again
- 32:37explain this, I apologize for my ignorance here, but so would he have
- 32:42the right if he did his research to say, no, we don't want
- 32:45to utilize ya. Yeah, No, he wouldn't have to utilize him.
- 32:47He could have hired somebody else. I mean, I think he'll you know,
- 32:50I mean, I'll let him, you know, say why he hired
- 32:52him. You know. But look, this is a you know, this
- 32:54is a national law firm that knows how to do this stuff, you know.
- 32:58And I look, I've to a lot of low I've actually talked to
- 33:00a lot of attorneys on both sides of this, you know. You know,
- 33:06Uh, this is something that we certainly followed while it was going on,
- 33:08but it's something that we have obtained a lot of information on in the
- 33:12last week. And I've had people on both sides of it kind of reach
- 33:15out and give me some background on what's going on with it. I look
- 33:19and and I'm not trying. Look, I'm not trying to say here that
- 33:22there aren't attorneys that did a lot of work, right. I mean there's
- 33:24even Tony Magestro, Who's somebody I'm politically opposed to. You know, nine
- 33:30times out of ten, and as I've called around about it, people are
- 33:34like, hey, man, Tony did a lot of work, yes,
- 33:36right, like you know, and and yesterday yeah, and you know.
- 33:39Look, so I'm not we're not throwing everybody. You know, now Majestra
- 33:45would be one of the ones that Morsey was thrown under the bus during his
- 33:47hoppy interview. So I'm not Look, I'm not I'm not trying to say
- 33:52they didn't do a good job. I'm not trying to say they didn't do
- 33:55a lot of work. I just don't think they did. One hundred and
- 33:58forty one million dollars is worth the work, right, Like That's what it
- 34:01is. So I you know, that's all we're saying. I think we
- 34:04need to review this process. If there's anything we can do now before October
- 34:07thirteenth at two pm, uh, if there's anything we can do to to
- 34:14change this, we need to try to do that. And if and if
- 34:16we fail and if you know, we come up short and one hundred and
- 34:20forty one million dollars goes to personal injury lawyers instead of to affect it people
- 34:23affected by the opoyoids in cities and counties in the state, you know,
- 34:28as they try to fund to to overcome this crisis, then what can you
- 34:32know, the legislature needs to step in and figure out what do we do
- 34:36to make sure something like that doesn't happen again? Right, And so you
- 34:39know, so that's just you know, we're uh, we appreciate the opportunity
- 34:44to bring attention to it. We know, you know obviously it's you know,
- 34:47it's on the TV, it's on you know radio, it's on the
- 34:50news. I mean, it's it's out there. And I would think it's
- 34:52going to continue to be out there until October thirteenth to two pm, because
- 34:57you know that'll be when it finally goes down. And and I'm I've heard
- 35:00people involved with this West Virginia first, you know organization that are like,
- 35:05hey, you know, thanks for kind of doing this, you know what
- 35:07I mean, it's uh, you know, so you know it's it's it's
- 35:12not something that's uh, you know, there could be political aspects to this.
- 35:15You know, nobody else has sort of chimed in on that, uh,
- 35:19you know, and I think there'll be a time and place for that.
- 35:21I think right now it just needs to be how can we make sure
- 35:24as much money as possible goes to those affective That's that's what we need to
- 35:28focus on at this point. Eighteen and it's away from ten to five eighty

- 39:07getting paid by anybody in the governor's race. And that's a follow up text.
- 39:10Another tech says, ask Greg which gubernatorial candidate that he's working for.
- 39:15I'm not working for any of them, not working for any of them.
- 39:19I'm look, I'm personally friends with Chris and uh and Moore and Mac.
- 39:24I like them all. I think they're all deserving of the opportunity to serve
- 39:30as governor. Tex says shameful that what these attorneys have done this is the
- 39:37people's money. And I wouldn't go as far to say shameful. I like
- 39:44they're doing their job. They're doing a lot of work. I mean,
- 39:45it's not it really is the system in the way this goes. It's just
- 39:52do we have to continue to do that? Right? I mean that like,
- 39:53that's the thing. It's like. And I think the part that people
- 39:58are missing here is that it a public nuisance lawsuit like this isn't Hey,
- 40:02there's a bad company that that spilled something into the water, or here's a
- 40:07you know, here's somebody that that sold a product that's defective and you got
- 40:12hurt by it. That's not what they're doing. They're saying that, look
- 40:15that you know, just what you did caused all this public turmoil and all
- 40:19this stress and all these things. You know, caused the police and the
- 40:22fire and the hospitals to spend all this money and do all these things to
- 40:28you know, kind of fix the problems you created. So you owe us
- 40:30some money, right like. But but that's the thing. It's it's a
- 40:34public nuisance lawsuit. It's not like a Hey, I'm trying to get money,
- 40:37and if I get money for you, I get I get paid to
- 40:38do it. You're you're filing the litigation on behalf of the public. It
- 40:43is, and that that collar is right. It is the public's money.

- 41:20Morrissey's campaign got texting that to you, but like I have no idea.
- 41:23Well, it wouldn't be any of his friends because he doesn't have any,
- 41:25but like it would be promo, it would be this would be uh,
- 41:31I'm not working for a candidate. If I was working for a If I
- 41:35were working for a candidate, I would say, I'm working for a candidate
- 41:37and here's what I'm on behalf of. But I'm not doing that like this
- 41:40is but lawsuit abuse is something I've done for twenty years. I mean,
- 41:45we did the report on more on mcgrawl when he did all this stuff before
- 41:50Morrissey got elected. I mean, this is everybody. I mean, I've
- 41:53said this on your show before. I recruited Patrick Morrissey to run for Attorney
- 41:58General because we didn't like Darryl mc all because of stuff like this, and
- 42:00now you're tying Patrick Morsey. It's you know, look at you can't.
- 42:07It happens to politicians when they're in office, you know, and they see
- 42:10opportunities to do stuff and and you know, it's a tough cycle to break,
- 42:15you know what I mean. Look, Patrick Morsey isn't the first person
- 42:17that did this, right. I'm not blaming Patrick Morrisey for the opraold crisis.
- 42:22I'm not blaming Patrick Morrisey for uh, you know, the way this
- 42:25all is structured. I mean, he was on the radio yesterday essentially saying
- 42:30like, hey, you know, if it wasn't me, they'd have gotten
- 42:32paid thirty percent. Well maybe so right, maybe under mcgrawl they would have
- 42:37gotten thirty percent. But but the state what voters said, we don't want
- 42:40that, right, we don't want that. We want something else. And
- 42:44so that's that's where that's why we're going to continue to speak out and and
- 42:49the goal we have a goal here, and we have it when we actually
- 42:52have a deadline. In the deadline, as I said earlier, is October
- 42:55thirteenth at two o'clock at the Ceremonial Courthouse. And if anybody out here that
- 43:00says, we need more of that money to go to people that deserve it
- 43:05and not to out of state personal injury law firms that are the biggest Democrat
- 43:07law firms in the country. You should do something about it. You should
- 43:10call somebody who will that go in front of who who will here, That'll
- 43:14be the That'll be Swopes, and that'll be those two. That'll be the
- 43:16two judges on that mass litigation panel. That'll that'll be who oversees that tech
- 43:21says, Facts says, no one was held to canable, no one with
- 43:22the jail if it was a drug dealer, that would take all your cash
- 43:27and property. The two tiered system, Uh, there's one for the rich
- 43:30and one for the poor. I look and that's what I'm saying earlier,
- 43:35Like our organization we can't get we don't know, we don't get involved into
- 43:39the legal theory of all these cases. What we do is we look at
- 43:43it when it's all said and done and say, hey, is this something
- 43:45that you know they you know, you know, what is the public effect
- 43:51of this? Right? Like we can't get in the middle of every case.
- 43:52And when we don't get in the middle cases, but it's just you
- 43:55know, are. We are singularly focused. This has nothing to do with
- 44:00politics. We are singularly focused on making sure that as much money can go
- 44:07to the public as possible and not to these personal these out of state personal
- 44:12injury law firm tex says day one hundred forty million plus would go a long
- 44:15way towards repaying the eight hundred million dollars A legislatures siphoned or stolen from West
- 44:21Virginia State University over the past several decades. University deserves better. The legislature
- 44:25is in the wrong. They don't. Okay, I don't really know what
- 44:29that has I saw a headline about that the other day, but I don't
- 44:31have any idea what it's about. It all right, Okay, we answered
- 44:36that one day for once Thomas actually made sense. Well, well got that,
- 44:43buddy, even a blind squirrel man. Yeah, don't get that.
- 44:46Debate started because Hobby did that a couple of weeks ago. And what the
- 44:49exact phrase. Let me ask you this before we go to break how much
- 44:52of an issue. I know you said you're not taking sides into gubermentorial ranging,
- 44:55but do you see a Chris Miller more cap oh, Mac Warner do
- 45:00you see any of the other leading Republicans using this in a campaign. Is
- 45:07this something that they would consider using if you were. You said you're not
- 45:09working for him, but if you were, is this something that you may
- 45:13use against Morrisey in a campaign? I would, But I'm an attack dog
- 45:16man. I use everything. So as Hoppy said, you'd run over your
- 45:21mother if you thought you could get a vote. That's what Obby said about
- 45:23you. I would. Here's what I think I would. I think this
- 45:29is a little down in the weeds and you'd have to spend some time thinking
- 45:32about it. I think when it would become clear cut is if the law
- 45:37firms receiving the money all of a sudden are giving campaign contributions to Patrick Morrissey.
- 45:43Like that's where you know what I mean? Like, I think this
- 45:45is this is policy, this is how do we do this? This is
- 45:49you know, you could go to saying like, well, he should have
- 45:52handled it better. You could you could do that politically, and maybe you
- 45:55could you can make some ground up on it. I think that it's a
- 45:59political no brainer. Is if you see all these and we have all the
- 46:02names, right, so I think if you would get all the names of
- 46:05all the law firms, and then go back and look at the next couple
- 46:08campaign finance reports and look at some of his outside independent expenditure groups like that
- 46:14Black Bear Pack and others, and say, if you start seeing the same
- 46:17names of the lawyers that got the money that are given money back in campaign
- 46:21contributions, that's probably the political opportunity that the candidates, the campaigns would have.

- 48:22from ten. Greg Thomas is here, Texas. Is it possible that this
- 48:25law firm, Motley Rice Law Firm, is great at their job? Does
- 48:30Greg think we should base every aspect of our daily life at our own political
- 48:35persuasions? Sounds like Motley Rice did their job. News flash, Lawyers are
- 48:38expensive. I do think. I do think Motley Rice did their job.
- 48:44And I think that throughout this I haven't said that. I just what I
- 48:47don't think is they did fifty million dollars worth of a job, right and
- 48:52like whatever, like and not only that, but this is a copycat lawsuit
- 48:55that they're doing in other places, right, like, so how many times
- 48:59how many times do they need to be fift paid fifty million dollars for the
- 49:01same idea? Right? And so do I think they deserve to be paid?
- 49:07Absolutely? Do I think they did a good job. Absolutely. You
- 49:10know, you've got a big you know, they're the lead counsel on this
- 49:14big federal thing. They're going to get a whole lot more than fifty million
- 49:16dollars out of that too, Right, So it's not I understand, it
- 49:22is expensive. I understand they deserve to get paid. I understand and admit
- 49:25that they did a good job. But if you want to go out there
- 49:30and I just I think that if you took the average person, not an
- 49:36average person, if you took anybody and we grabbed a hundred people and we
- 49:39brought we brought one hundred people off the street into this two pm October thirteenth
- 49:44in the ceremonial courtroom of the Canon County Courthouse and had them sit there and
- 49:49listen to the lawyers say I deserve one hundred and forty one million dollars.
- 49:52I don't think you could find one of the hundred people that would would defend
- 49:55it. I just don't. It's one hundred and forty one million dollars.
- 50:00I don't know what the number is, but I know what it isn't and
- 50:02it's one hundred and forty one million dollars. Let me ask you. I'm
- 50:05gonna play Devil's advocate here from moment. You're a capitalist, I'm the ultimate
- 50:07capitalist. I say that all the time on the show. Why should you
- 50:10put a cap on things? I mean, it's because it's it's because because
- 50:15it's public money. If this was a it goes back to Dave, I
- 50:19think it's a good question. It goes back to the fact that this is
- 50:22a public nuisance lawsuit. Okay, this isn't This isn't private. This isn't
- 50:27a private thing like this isn't like if this were purely capitalists and it was
- 50:30a private lawsuit, that's you know, based on plainiffs against a defendant and
- 50:36then and then they got to negotiate it. But the Attorney General is negotiating
- 50:39on behalf of Yeah, okay, that's what this is about. That's why
- 50:45we're here. If this is you know, hey, if it had been
- 50:47a private thing whatever, probably complain about it. But the reason that we're
- 50:52so intent on this and the reason that I'm not going to let up until
- 50:57two pm on October thirteenth at the ceremony. Can you hit that one more
- 51:00time. It's just it's important. It's important to know that there's a deadline
- 51:04on this. Whether you're a politician listening, or an elected official or whoever,
- 51:07there is a deadline. We have a couple of weeks to try to
- 51:09do something to get these resources into people that need the resources. Tech says,
- 51:16the dollar amount is as ridiculous just paying a million dollars to someone who's
- 51:20spilled hot coffee on themselves. It's the same kind of thing. But but
- 51:23even that, right, that's McDonald's. That's not the taxpayer. Yeah,
- 51:27this is a tax payer acounts our money. This is a public nuisance lawsuit
- 51:30if that's what it's supposed to be for, and we're going to continue to
- 51:34file these, we need to make sure that they're not huge financial windfalls for
- 51:37out of state personal injury law firms. Tech says, listening to these text
- 51:40sounds like Fag's office workers are busy texting. I don't for the record,
- 51:45I've said before, I have no idea who's sending these tax out I mean,
- 51:49I just get a text on the screen so yeah, look, it's
- 51:52and I think that right. I mean, I've talked to one hundred people
- 51:54about this, and one hundred out of one hundred thinks it's outrageous. And
- 51:58I guarantee you that one hundred out of one hundred listeners that aren't working for
- 52:01the Attorney General's office or a personal injury law firm getting money from this think
- 52:05the same thing. All right, Greg Thomas, I appreciate you being here.
