- 0:18Speaker 2: Welcome to Family Law Talk. We have an interesting topic today.
- 0:21The topic is the value of trust during your family
- 0:25law case. And this episode today is based on an
- 0:28article on our blog Familylawheadquarters dot com dated September twelfth,
- 0:34twenty fifteen, and the title of the article is why
- 0:39having faith can pay off for a FAMI lag client. So,
- 0:42as a follow up to the episode today, go on
- 0:45over to Familawheadquarters dot com and read this article for
- 0:48more information on this topic. But let's go ahead and
- 0:51jump on in. The reality is that FAMI law litigation
- 0:55could be gut wrenching for those going through it. A
- 0:59friend of going through it, it can in many ways
- 1:02feel like their whole life is on pause. It can
- 1:05often feel like their whole life is even hanging in
- 1:08the balance, which could be very tough for an individual.
- 1:12Individuals going through divorce or family all matters can have
- 1:14all kinds of worries and anxiety. The worries and anxiety
- 1:19can revolve around child custing in terms of how it's
- 1:21going to work, when they're going to get their kids,
- 1:24how decisions are going to be made. They may be
- 1:27worried about the finances in terms of the outcome of
- 1:31the case, So how is property and debt going to
- 1:33be divided, how are bills going to be paid, and
- 1:37these kinds of things. Individuals can also be worried about
- 1:40child support, and it doesn't matter if they're the party
- 1:43paying child support or the party receiving child support. They
- 1:48can be worried about whether it's going to be too
- 1:51much and they're not going to be able to afford it,
- 1:53or whether what they gets not enough and they're not
- 1:55going to have the income or the revenue to meet
- 1:59the kids need. Some individuals are worried about spousal maintenance
- 2:03also called alimony, so and again this could come down
- 2:08to either end of the spectrum. If it's an individual
- 2:10who's going to have to pay, they might be worried
- 2:12about how they're going to be able to afford this
- 2:14when they have all these other expenses that they have
- 2:17on the flip end. An individual who's receiving spousal maintenance
- 2:20might be worried about is this going to be enough?
- 2:23Am I going to be able to find a place
- 2:24to live and meet my needs with the spousal maintenance
- 2:28that I'm receiving. And obviously a lot of individuals can
- 2:31be overwhelmed at the thought of attorney fees as well.
- 2:35For most individuals when they contemplate attorney fees in these
- 2:38kinds of cases, this can be troublesome for them to
- 2:41think about how they're going to be able to afford
- 2:43it all right, Some parties are also not able to
- 2:46resolve their case in mediation or collaborative law, even though
- 2:52they want to. This is definitely a good option to
- 2:55consider for a lot of individuals who want the case
- 2:58to end as quickly as possible. They want to be
- 3:00able to move on with their life. But the reality
- 3:02is is that settling in mediation or collaborative law isn't
- 3:06always easy, particularly out of the gates where parties are
- 3:09still sort of emotionally charged up about the initiation of
- 3:12the case. And one of the other things lots of
- 3:15individuals really obsess over is the results of the case.
- 3:21So they might think, you know, look, I want X,
- 3:24Y or Z result to happen and it could be
- 3:26about property and debt, division, could be child custody, child supports,
- 3:31sponsor maintenance. But there might be specific results that they're
- 3:34really attached to and they really feel as if they need.
- 3:39But their concern is this going to happen and is
- 3:42this going to happen quickly? Because a lot of individuals
- 3:45just want the pain and the expense of these kinds
- 3:49of cases to end as quickly as possible. And so
- 3:51what a lot of individuals can do is just sort
- 3:54of spin thinking about these things. Think about when you're
- 3:57on a computer and you hit a button two do
- 4:00something and you see the hourglass kind of spin it right,
- 4:03the computer's thinking. A lot of individuals figuratively do this
- 4:08about their case, worried about the outcome, the expenses, and
- 4:13they're just thinking and they're just sort of spinning and
- 4:16they feel kind of stuck, like when the computer's stuck
- 4:19trying to do something and it's not moving quickly. Okay,
- 4:23this is common for anybody going through divorce or FAMI
- 4:26law matter. But one of the most important things an
- 4:28individual can do, if they're able to sort of reframe
- 4:32this whole situation, is to have faith, to have trust
- 4:36that the case is going to work out. They might
- 4:39not understand how exactly it's going to work out. But
- 4:42if an individual can have faith and trust that no
- 4:45matter what the outcome is, they're going to move on
- 4:47with their life, it's going to work out. They're going
- 4:50to figure out a way to make it work. For
- 4:52a lot of individuals, this can make this process a
- 4:55lot better. It can cause them less stress, anxiety worrying
- 5:02about these things. Okay, So for most individuals going through
- 5:05these kinds of cases, this is this is difficult. Okay.
- 5:09Some individuals might stress more than others. Some individuals might
- 5:13be in more of a zend place where they just
- 5:15have faith and trust that's going to work out. But
- 5:18I'll tell you if anybody going through these cases, this
- 5:21is going to test anybody's patients. This would test anybody's
- 5:26faith and trust, and certainly a divorce or family law
- 5:29case you know, can bring out negative emotions and negative
- 5:34mindsets that an individual ordinarily wouldn't have. Okay, So look,
- 5:40what individuals need to try to do is want hire
- 5:42an attorney who they trust, Hire an attorney who they're
- 5:45comfortable with, Hire an attorney who they feel like has
- 5:48their back. And they need to let the process play out.
- 5:52Understand that it's probably going to take longer than they want.
- 5:56It might even be more expensive than they want it
- 5:59to be. And I hate to say that, but where
- 6:01lawyers bill hourly on these kinds of cases, these cases
- 6:05can be expensive. And the other thing individuals have to
- 6:09understand is that with fifty percent divorce rates and then
- 6:13forty percent out of wedlock birth rates in the country,
- 6:16and all these cases ending up in the family court system,
- 6:22court dockets are often backed up and there are often
- 6:25not enough judges to hear these cases. Some individuals have
- 6:28to understand that these cases can take months, sometimes many months,
- 6:32sometimes more than a year, but they just have to
- 6:35let it play out. And if they have it that
- 6:38mindset that it's going to work out and they let
- 6:40it play out, from my experience, what individuals then do
- 6:45is they have more peace while going through the process.
- 6:49They also behave in a way that is more positive,
- 6:54that is more constructive, and this ultimately looks much better
- 6:58to most family court judges are most guarding at items
- 7:02is opposed to somebody who's worried and stressed and anxious.
- 7:06This is where individuals could make mistakes in family law
- 7:09cases by lashing out, by doing things that paint them
- 7:13in a negative light. And so just having this faith
- 7:18in this positive mindset can be very important for individuals
- 7:22who are going through these processes. Otherwise, what individuals can
- 7:25do is they can be consumed by the what ifs.
- 7:28You know, what of this and what of that? And
- 7:31if individuals get consumed by the what ifs, this is
- 7:33where individuals can just sort of torture themselves emotionally. And
- 7:38this obviously isn't a good thing in terms of somebody's
- 7:41psychological mindset. And again it can cause individual to make
- 7:44some mistakes in a case that paint them in a
- 7:47bad light. Okay, for individuals who were kind of thinking
- 7:50about this and contemplating this, and they think, well, how
- 7:54do I put myself in a positive place, a place
- 7:58of faith, a place of trust when going through these
- 8:00kinds of cases. Let me give you some tips. Obviously
- 8:03these tips are outside the article, by the way, and
- 8:07this is going to be different for everybody, right, so
- 8:10everybody's going to do this a little bit different. But
- 8:13some good things individuals can do in many respects might
- 8:17be see a counselor seeing a counselor who's positive, who's upbeat,
- 8:21who helps put you in a good mindset can be
- 8:25very vital and then can help you work through the
- 8:28stresses and the anxiety that you might have. I think
- 8:30that's definitely a positive thing. I think watching and listening
- 8:34to positive things can be very important. Could be podcasts,
- 8:38could be videos, it could be things on TV. Always
- 8:41feeding yourself with positivity can be an important thing. Reading
- 8:46can be a good thing. Reading books that are positive
- 8:49and upbeat. That can be great in terms of feeding
- 8:54your brain on a regular basis. Some individuals find a
- 8:57lot of peace through exercise. You know, exercise, there's a
- 9:05lot of research that shows can release, you know, good
- 9:09positive energy within your body, which can be helpful. Other
- 9:13individuals find peace through like meditation, through prayer, through spirituality
- 9:21and these kinds of things. Obviously this is going to
- 9:23be look, you know, something that looks different to other individuals,
- 9:26But that's definitely something to think about, and that just
- 9:28surrounding yourself with positive and upbeat people can be a
- 9:31very good thing. Be careful about surrounding yourself with people
- 9:35who fan flames, people who are negative, people that are angry,
- 9:40typically through divorce, or FAMI law matter. This isn't what
- 9:43you want around you. You want people that make you
- 9:45feel better, that keep your faith up, that keep your
- 9:48trust up, and keep you in a good psychological mindset. Okay,
- 9:52so that's the topic today. Definitely an interesting topic and
- 9:55one I wanted to cover. Is a follow up to
