- 0:00Speaker 1: What's up everyone and welcome back to the program. Over
- 0:04Speaker 1: the past few days, we've been talking about some of
- 0:06Speaker 1: the developments when it comes to Tyler Robinson and the
- 0:10Speaker 1: state of Utah's case that they're making against him. But
- 0:13Speaker 1: lurking in the background, we have other people who want
- 0:17Speaker 1: to intervene in the case who say that they have
- 0:20Speaker 1: rights that need to be respected. And mainly those people
- 0:24Speaker 1: are the attorneys for the media. And according to them,
- 0:29Speaker 1: Removing cameras from that courtroom is a non-starter. So they
- 0:35Speaker 1: have petitioned the judge to keep the cameras in the
- 0:38Speaker 1: courtroom and to keep the cameras rolling during this hearing
- 0:42Speaker 1: on September 1st. So today we have an article from KSL.com
- 0:47Speaker 1: and the headline. What is public is public. Media attorneys
- 0:52Speaker 1: argue in the Tyler Robinson hearing. This article was authored
- 0:56Speaker 1: by Pat Reavey. Attorneys for the media say Tyler Robinson's
- 1:01Speaker 1: request to keep cameras out of the courtroom for the
- 1:04Speaker 1: final day of his prelim hearing next week is a
- 1:06Speaker 1: question that has already been asked and answered. Look, if
- 1:11Speaker 1: I was somebody who was being falsely accused, if I
- 1:13Speaker 1: was somebody that was a patsy, I'd be asking for
- 1:17Speaker 1: more cameras. Fuck, I'd be asking for flock cameras. I'd
- 1:21Speaker 1: want everybody to see how I'm getting railroaded. So whenever
- 1:26Speaker 1: we have these people like Tyler Robinson Brian Koberger, etc.,
- 1:30Speaker 1: who cry about cameras being present and then, between sobs,
- 1:35Speaker 1: want to tell us how they're being framed or how
- 1:37Speaker 1: they're not the right person is always comical. Because if
- 1:41Speaker 1: you were somebody that was actually being set up, if
- 1:44Speaker 1: you were somebody that was being railroaded, you'd want those
- 1:48Speaker 1: cameras in there. You'd want people to see because you
- 1:51Speaker 1: know it would become a gigantic shitshow and that's only
- 1:54Speaker 1: going to improve your chances of walking, right? Robinson's request
- 2:01Speaker 1: repeats generalized policy arguments against electronic media coverage that this
- 2:05Speaker 1: court has already rejected. Those arguments are not sufficient to
- 2:09Speaker 1: overcome the presumption favoring electronic media coverage and should be
- 2:13Speaker 1: rejected yet again. Media attorneys state in their response, and
- 2:17Speaker 1: if there's no cameras, forget it. All the morons and idiots,
- 2:22Speaker 1: they'll be running around making shit up. And when I
- 2:24Speaker 1: say that, I don't mean theorizing, right? It's one thing
- 2:27Speaker 1: to have some theories. It's another thing to just be
- 2:30Speaker 1: talking nonsense. And the vast majority of people that think
- 2:34Speaker 1: they're some kind of investigator or researcher when it comes
- 2:37Speaker 1: to this case, my friends, they're just talking nonsense. And
- 2:41Speaker 1: it's readily apparent to me who has never followed a
- 2:44Speaker 1: complex case before. Robinson, 23, is accused of shooting and
- 2:49Speaker 1: killing conservative political activist Charlie Kirk on the campus of
- 2:53Speaker 1: the Utah Valley University on September 10th, 2025. prosecutors have
- 2:58Speaker 1: stated that they'll seek the death penalty if he's convicted.
- 3:02Speaker 1: And I think that when we get to the point
- 3:04Speaker 1: where we're looking at trial, we're going to see a
- 3:07Speaker 1: plea deal. Tyler Robinson's going to cop to this shit
- 3:11Speaker 1: so he doesn't get the death penalty. Same thing that
- 3:13Speaker 1: Kohlberger did. Now, of course, we know that there are
- 3:17Speaker 1: some issues up in Idaho, considering Kohlberger's trying to get
- 3:20Speaker 1: that deal thrown out. But I see the same kind
- 3:23Speaker 1: of game plan forming for Tyler Robinson and his lawyers.
- 3:28Speaker 1: And if you go through the filings, the motions, it
- 3:31Speaker 1: really resembles what Koberger's team was doing early on. And
- 3:34Speaker 1: I think it's going to be that same approach. On Tuesday,
- 3:39Speaker 1: Robinson will be back in 4th District Judge Tony Graff's
- 3:41Speaker 1: courtroom for final closing arguments in his prelim hearing. And obviously,
- 3:45Speaker 1: we'll be covering that. I mean, it's going to be
- 3:48Speaker 1: pretty interesting to see what Judge Graff comes up with.
- 3:51Speaker 1: And in my opinion, there is no way that this
- 3:54Speaker 1: doesn't go to trial. With all the evidence that we've seen,
- 3:57Speaker 1: With all the evidence we've heard, I think that there
- 3:59Speaker 1: is certainly enough that we at the very least get
- 4:02Speaker 1: a trial. Now what happens at that trial, we don't
- 4:05Speaker 1: know yet. There's a lot of people that are certain
- 4:09Speaker 1: one way or the other about the outcome. Me personally,
- 4:12Speaker 1: I am not. A lot of shit can change. Who
- 4:15Speaker 1: knows what they find in discovery? What if a witness
- 4:18Speaker 1: shows up? What if they find somebody else who knew
- 4:21Speaker 1: as they're investigating? Because remember, we're only seeing a fraction
- 4:26Speaker 1: of what's going on. There's a lot going on behind
- 4:28Speaker 1: the scenes, and when you look at the discovery, and
- 4:31Speaker 1: how much of it's been passed over to Tyler Robinson's
- 4:34Speaker 1: people already, there's a lot there, and it's going to
- 4:37Speaker 1: take them a ton of time to go through it all.
- 4:42Speaker 1: Last week, Robinson renewed his request to keep cameras out
- 4:45Speaker 1: of the courtroom during the hearing, claiming it could tank
- 4:47Speaker 1: the future jury pool and potentially jeopardize his right to
- 4:51Speaker 1: a fair trial. Yo, there is no way to get
- 4:54Speaker 1: around it. The jury pools are going to be quote-unquote
- 4:56Speaker 1: tainted anyway. Everybody has social media. Everybody has access to
- 5:01Speaker 1: media on demand. And people are following important cases. Cases
- 5:06Speaker 1: that are, you know, interesting to the public. And this
- 5:11Speaker 1: is certainly one of them. And what I always say
- 5:14Speaker 1: is this. If they were able to find a jury
- 5:16Speaker 1: for Donald Trump's crazy ass, I think they can find
- 5:19Speaker 1: a jury for anybody. And these are all just the
- 5:23Speaker 1: motions that you have to go through as a defense team.
- 5:28Speaker 1: And who knows if they're going to try and change
- 5:30Speaker 1: the venue. I wouldn't be shocked if they do because,
- 5:32Speaker 1: of course, that's another tool that the defense can use
- 5:35Speaker 1: to slow things down. And the more time they have,
- 5:38Speaker 1: the better off it's going to be because, again, they
- 5:41Speaker 1: have a lot to go through. They have to deal
- 5:43Speaker 1: with experts. They have to deal with breaking down these
- 5:46Speaker 1: reports that were sent to them as discovery reports. going
- 5:49Speaker 1: through the Celebrite, going through the phone records. There is
- 5:52Speaker 1: a lot. So it's going to be very interesting to
- 5:56Speaker 1: see what their defense ends up being. But if I
- 6:00Speaker 1: was a betting man, which I am, I would bet
- 6:03Speaker 1: that this ends up being a plea deal at some point.
- 6:06Speaker 1: Maybe not right away. Hell, maybe it'll take a couple
- 6:09Speaker 1: of years. But I have a hard time believing that
- 6:12Speaker 1: we're going to get to trial here. In their response,
- 6:15Speaker 1: attorneys for the media note that Robinson contends prejudice is
- 6:19Speaker 1: reasonably likely because hearsay testimony will be presented, and that
- 6:22Speaker 1: graph has already rejected the notion that having cameras in
- 6:26Speaker 1: the courtroom will distract hearing participants and place added pressure
- 6:29Speaker 1: on them. Look, it should never even be a question.
- 6:32Speaker 1: There should be cameras in every courtroom, including federal courtrooms,
- 6:36Speaker 1: by the way. The people, you and I, we deserve
- 6:41Speaker 1: to see the process unfold, make sure everything's on the
- 6:44Speaker 1: up and up, and the court should have no problem
- 6:46Speaker 1: with that. They should be A-OK with it, as long
- 6:49Speaker 1: as everything's being done the right way. What do you
- 6:52Speaker 1: have to worry about? Moreover, the evidentiary portion of the
- 6:56Speaker 1: preliminary hearing, held in July, was open to the public
- 6:59Speaker 1: and live-streamed, so the hearsay testimony is already available to
- 7:02Speaker 1: the public. Denying electronic media coverage now would only fuel
- 7:08Speaker 1: speculation and erode trust in the criminal justice system, the
- 7:11Speaker 1: media stated, and I agree with that wholeheartedly. This is
- 7:15Speaker 1: not the time for less transparency. It's the time for more.
- 7:19Speaker 1: And as much transparency as can be given by the
- 7:22Speaker 1: court should be given. Because there's way too many people
- 7:26Speaker 1: that just aren't buying the narrative. And look, I don't
- 7:28Speaker 1: blame regular people for not buying the narrative. Please don't
- 7:32Speaker 1: get it confused. My problem is with people who are
- 7:36Speaker 1: trying to pitch you a bunch of bullshit that they
- 7:38Speaker 1: can't prove. That there's not even circumstantial evidence to back up. Now,
- 7:43Speaker 1: if you show up with circumstantial evidence... I'm willing to listen.
- 7:46Speaker 1: Let's see it. What do you have to back up
- 7:49Speaker 1: the allegations that you're making? What's your sources source, right?
- 7:53Speaker 1: But we're at a point where people hear shit on
- 7:55Speaker 1: the internet or hear some, you know, influencer or whatever,
- 7:59Speaker 1: say it. And they think it's the truth. But a
- 8:03Speaker 1: lot of times you're being bullshitted because they have to
- 8:05Speaker 1: keep the gravy chain rolling, right? Drip, drip, drip. I'm
- 8:08Speaker 1: going to give you some more information, but you have
- 8:10Speaker 1: to tune in tomorrow. And it's all just a big
- 8:13Speaker 1: ass hustle. And when all is said and done, the
- 8:16Speaker 1: people that are engaging in it are going to look
- 8:18Speaker 1: dumb as fuck. Mark my words. Additionally, online speculation, including
- 8:23Speaker 1: conspiracy theories about the case, will continue whether cameras are
- 8:28Speaker 1: in the courtroom or not. Regardless of whether there is
- 8:31Speaker 1: electronic media coverage, members of the public will discuss the case.
- 8:36Speaker 1: That fact does not by itself prejudice Robinson's fair trial rights. Indeed,
- 8:40Speaker 1: the public's constitutional right of access acknowledges the benefits of
- 8:44Speaker 1: of public discussion, according to the response. So you have
- 8:47Speaker 1: to find the balance, right? How do we respect Tyler
- 8:51Speaker 1: Robinson's constitutional rights while the public is still having their
- 8:55Speaker 1: rights respected to a transparent process? So it's the balancing
- 8:59Speaker 1: act that the court is going to have to engage in.
- 9:03Speaker 1: And there's going to be people that aren't happy no
- 9:05Speaker 1: matter what. The media is also opposing Robinson's request to
- 9:12Speaker 1: classify his original motion to keep cameras out of the
- 9:15Speaker 1: courtroom as private. In a redacted version of their motion
- 9:18Speaker 1: released to the public, a paragraph that follows the sentence,
- 9:21Speaker 1: additional evidence of bias developing, as a result of the
- 9:25Speaker 1: widespread publication of this case, can be tracked in real time,
- 9:28Speaker 1: is blacked out. Quora filings are presumptively public, and both
- 9:32Speaker 1: the U.S. Supreme Court and the Utah Supreme Court have
- 9:35Speaker 1: recognized the public's right of access to criminal proceedings. including
- 9:40Speaker 1: pretrial filings. The media stated in their response, Robinson cannot
- 9:45Speaker 1: overcome the presumption favoring public access. He attempts to make
- 9:49Speaker 1: secret information that is publicly available and that was in
- 9:52Speaker 1: fact created by the public. What is public is public.
- 9:57Speaker 1: And Robinson cannot change that by putting public information in
- 10:01Speaker 1: a court filing. And Robinson's alarmist predictions about the effect
- 10:05Speaker 1: of this public information remaining public are unsubstantiated and improperly
- 10:10Speaker 1: based on generalized concerns about public access, the media continues. Now,
- 10:14Speaker 1: does that sound like the argument of somebody who's innocent
- 10:17Speaker 1: or somebody who's being set up? And what I want
- 10:22Speaker 1: you to avoid is all emotion. Don't come at this
- 10:25Speaker 1: from an emotional perspective. What does the evidence say? And
- 10:29Speaker 1: where does the evidence lead us? Because at the end
- 10:32Speaker 1: of the day, that's what's going to matter. Not narratives, facts,
- 10:36Speaker 1: and evidence. That's what it's going to come down to.
- 10:39Speaker 1: And so far, I haven't seen very much from the
- 10:42Speaker 1: side of Tyler Robinson when it comes to evidence. Also
- 10:48Speaker 1: this week, Graf issued an order banning cell phones and
- 10:51Speaker 1: other electronic devices in the courtroom during Tuesday's hearing. Attorneys
- 10:55Speaker 1: and support staff, or the victim representative legal counsel, are
- 10:59Speaker 1: exempt from the ban. Reporters were already not allowed to
- 11:03Speaker 1: have laptops, cell phones, Apple Watches, and other electronic devices
- 11:07Speaker 1: during the week-long hearing in July. They didn't want leaks.
- 11:11Speaker 1: And that's why they ban all of the devices that
- 11:14Speaker 1: could transmit or stream. And that's something that you see
- 11:18Speaker 1: quite a bit these days. But I don't think that
- 11:20Speaker 1: Judge Graff is going to go any further than that.
- 11:23Speaker 1: And I don't think that he's going to ban cameras
- 11:26Speaker 1: or photography from the courtroom. Because I think that if
- 11:28Speaker 1: he was going to do that, he would have done
- 11:30Speaker 1: it already. And with this hearing scheduled for tomorrow, my
- 11:34Speaker 1: guess is that Judge Graff will have a ruling sometime today.
- 11:38Speaker 1: And once we get that information, obviously, we'll get it
- 11:41Speaker 1: added to the catalog. And then after tomorrow's hearing, we'll
- 11:44Speaker 1: do a postmortem of what went down at that hearing.
- 11:48Speaker 1: And I think that when all is said and done tomorrow,
- 11:52Speaker 1: we're going to be moving into the next phase. And
- 11:54Speaker 1: the next phase is the trial of Tyler Robinson. All
- 11:59Speaker 1: the information that goes with this episode can be found
- 12:02Speaker 1: in the description box.
