- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're diving right back in to day number
- 0:06Speaker 1: four of the Tyler Robinson prelim transcript. And we're picking
- 0:11Speaker 1: back up with the state doing the questioning. Question. All right.
- 0:16Speaker 1: Back to the wooded area. Was anything found in the
- 0:18Speaker 1: wooded area of evidentiary value that you can sit down?
- 0:22Speaker 1: Thank you. Answer. May you repeat your question? Question. Was
- 0:27Speaker 1: anything of evidentiary value found in the wooded area? Answer, yeah,
- 0:31Speaker 1: in the wooded area. A right rifle that was wrapped
- 0:34Speaker 1: in a dark colored towel was found there. Question, and
- 0:37Speaker 1: how did you learn about that? Answer, I found that
- 0:41Speaker 1: out because just a little bit before 6 p.m. that day,
- 0:44Speaker 1: I received a call from Utah County Sheriff's Office who
- 0:47Speaker 1: was tasked with searching that area. Question, do you know
- 0:51Speaker 1: why they searched that area in the first place? Answer, yeah,
- 0:54Speaker 1: so they searched that area because I received a video
- 0:57Speaker 1: that was from UVU Security Footage. This was received by
- 1:01Speaker 1: our command post on scene. And it showed who we
- 1:04Speaker 1: believe was the shooter on the rooftop run from the
- 1:07Speaker 1: southwest corner all the way to the northeast corner, jump down,
- 1:11Speaker 1: and then continue to the northeast side of the campus,
- 1:14Speaker 1: and then cross the street to Campus Drive. And then
- 1:17Speaker 1: the suspect was out of camera's view after that. Question, okay,
- 1:22Speaker 1: so he ran basically toward and into that wooded area? Answer, yeah. Question,
- 1:27Speaker 1: all right. What were you told from the sheriff's office? Answer,
- 1:30Speaker 1: I was told that they found a gun. And from there,
- 1:33Speaker 1: I asked them to hold it at the scene. And
- 1:35Speaker 1: then myself and the FBI ERT team, the lead special
- 1:40Speaker 1: agent Kamek, would be en route. Question, okay, FBI ERT,
- 1:45Speaker 1: FBI evidence response team, right? Answer, yes. Question, all right,
- 1:50Speaker 1: did you go to the area? Answer, yes, I did. Question,
- 1:53Speaker 1: did you observe the weapon? Answer, yes. Question, will you
- 1:57Speaker 1: describe what you saw? Answer, yeah. What I saw was
- 2:00Speaker 1: a rifle that was, or at the time, before even
- 2:03Speaker 1: having removed it, we found, or in the bushes we found,
- 2:06Speaker 1: all you could really see was just a dark towel there.
- 2:09Speaker 1: So pictures were taken of that, and then eventually the gun,
- 2:13Speaker 1: or the towel, was removed. And then once we removed
- 2:16Speaker 1: the towel from the bushes, is when we uncovered that
- 2:19Speaker 1: the towel was actually used to wrap the gun in. Question,
- 2:24Speaker 1: have you reviewed State Exhibit 10, 10.1, 10.2, and 10.3?
- 2:28Speaker 1: Do you remember reviewing these? Answer, yes. Question, and are
- 2:33Speaker 1: they accurate photographs of the weapon when it was recovered
- 2:36Speaker 1: and shortly thereafter? Answer, yes. Question, I move the admission
- 2:40Speaker 1: of State Exhibit 10, 10.1, 10.2, and 10.3. Judge Graff, defense?
- 2:47Speaker 1: The defense, no additional objections, Your Honor. Judge Graff, all right,
- 2:51Speaker 1: and as it relates to publication, if any. The state, yeah.
- 2:55Speaker 1: I would ask that these be published at all three levels.
- 2:57Speaker 1: Judge Graff, all right. Any input from the defense? The defense,
- 3:01Speaker 1: same objections. Judge Graff, all right. I'll note the standing
- 3:05Speaker 1: objection from defense. Those are overruled. 10, 10.1, 10.2, 10.3
- 3:12Speaker 1: are admitted into evidence and may be published both in
- 3:16Speaker 1: the courtroom and through the use of the camera. Prosecution,
- 3:20Speaker 1: if we can please publish number 10, thank you. You
- 3:22Speaker 1: have in front of you on the screen plaintiff exhibit
- 3:25Speaker 1: number 10. Will you describe what we're looking at here?
- 3:28Speaker 1: Answer yeah. What we're looking at here is actually the
- 3:31Speaker 1: bushes where the dark colored towel and the gun were found.
- 3:35Speaker 1: You can kind of see the dark colored towel towards
- 3:37Speaker 1: the right hand side of the screen in the middle
- 3:40Speaker 1: right middle. Question. Can you zoom in on that area please?
- 3:46Speaker 1: So they zoom in Alright, is this a better view
- 3:49Speaker 1: of the towel? Ask the prosecution. Answer, yes it is. Question,
- 3:54Speaker 1: if we can go to Exhibit 10.1, will you describe
- 3:57Speaker 1: what we're looking at in Exhibit 10.1? Answer, yeah. This
- 4:01Speaker 1: is a mid-range shot of, again, the towel that was used,
- 4:05Speaker 1: or of the towel within the bushes. Question, alright. When
- 4:08Speaker 1: this was found and you arrived on the scene, what
- 4:11Speaker 1: happened with the weapon? Answer, no. We moved it from
- 4:14Speaker 1: the bushes, or say, FBI Special Agent Kamek moved it
- 4:18Speaker 1: from the bushes. We then placed it on a cardboard box,
- 4:21Speaker 1: took pictures of it, and then we removed the towel,
- 4:24Speaker 1: packaged the towel separately, took additional pictures of the gun,
- 4:28Speaker 1: and then rendered it safe on the scene. Question okay,
- 4:31Speaker 1: I'll ask you more about that in a minute, but
- 4:33Speaker 1: let's go to number 10.2. Will you describe what we
- 4:36Speaker 1: see here? Answer yeah, so what you see here now
- 4:40Speaker 1: is the dark colored towel and the rifle that's in
- 4:43Speaker 1: the towel, And it's in a cardboard box. Question. Why
- 4:47Speaker 1: is the towel still around the gun? Answer. We wanted
- 4:50Speaker 1: to document it as to how we found it. Question.
- 4:54Speaker 1: All right, let's go to 10.3. Is this the rifle? Answer. Yes,
- 4:58Speaker 1: it is. Question. You described making the rifle safe. Will
- 5:03Speaker 1: you describe what that is? Answer. Yes. So what that is,
- 5:07Speaker 1: is that we ensure that there isn't anything in the
- 5:08Speaker 1: chamber and that no other cartridges in the gun that
- 5:12Speaker 1: would have it go off. So to do that, because
- 5:14Speaker 1: it's a bolt action gun, we would have manipulated the
- 5:17Speaker 1: bolt or the lever back and then from there, see
- 5:19Speaker 1: if anything was in the chamber. And then I would
- 5:22Speaker 1: say carefully remove anything that was in the chamber and
- 5:25Speaker 1: below it. Question, all right, what's the difference between a
- 5:29Speaker 1: bolt action and an auto ejecting gun? Answer, yep, a
- 5:34Speaker 1: bolt action is one where the user actually has to
- 5:37Speaker 1: manipulate the bolt. So they would actually have to pull
- 5:39Speaker 1: it back and forward to whether it to be loaded
- 5:43Speaker 1: lock it, as well as extract anything that's in it.
- 5:46Speaker 1: Unlike a semi-auto gun, that is one every single time
- 5:49Speaker 1: you pull the trigger, a bullet will be fired. And
- 5:52Speaker 1: then from there, a casing will be extracted out as
- 5:55Speaker 1: well as a new cartridge will then be automatically fed
- 5:58Speaker 1: into the chamber. Question, so if you shoot a bolt
- 6:01Speaker 1: action rifle, does that spent shell casing automatically exit the gun? Answer, no,
- 6:06Speaker 1: it does not. It will stay in there until the
- 6:08Speaker 1: person that's handling the gun actually removes the bolt or
- 6:11Speaker 1: actually pulls the bolt back And then the casing will
- 6:14Speaker 1: be extracted out. Question, were you present when this weapon
- 6:18Speaker 1: was made safe? Answer, yes, I was. Question, will you
- 6:21Speaker 1: describe what was found when that happened? Answer, yes. So
- 6:25Speaker 1: when we rendered the gun safe, we found in it
- 6:28Speaker 1: and we removed the bolt back and found one 30-06
- 6:31Speaker 1: cartridge case or say fired cartridge case. And we also
- 6:35Speaker 1: found three unfired cartridges with engravings on them. Question, okay,
- 6:39Speaker 1: I want to make sure we understand the language that
- 6:42Speaker 1: you're using. When you say cartridge case and you say cartridge,
- 6:47Speaker 1: what do you mean? Answer, so a cartridge is basically
- 6:50Speaker 1: the round itself, right? The whole round. And the round
- 6:52Speaker 1: consists of the cartridge case and then the powder and
- 6:55Speaker 1: then the bullet on top. So the cartridge case, the
- 6:58Speaker 1: term is used for something that has been fired already.
- 7:02Speaker 1: A cartridge is an unfired round. Question, okay, cartridge is
- 7:06Speaker 1: the unfired round that still has the bullet, the powder
- 7:08Speaker 1: and all that. Answer, yes. Question, cartridge case is found
- 7:13Speaker 1: That has been fired and it's just the empty brass casing.
- 7:16Speaker 1: Is that right? Answer, yes. Question, okay, so I just
- 7:21Speaker 1: want to make sure I understand. A fired cartridge and
- 7:25Speaker 1: three unfired cartridges. Answer, yes. Question, was there anything distinctive
- 7:30Speaker 1: about these items? Answer, all four of them had engravings
- 7:34Speaker 1: on them. Question, did you observe those engravings? Answer, yes,
- 7:38Speaker 1: I did. Question, did you observe them right there on
- 7:41Speaker 1: the scene? Answer, yes, I did. And question, and what
- 7:46Speaker 1: was done with? Let's talk about each of those things. First,
- 7:49Speaker 1: the towel. What was done with the towel? Answer, the
- 7:52Speaker 1: towel was packaged and then it was eventually provided to
- 7:55Speaker 1: the FBI. Question, what was done with the firearm? Answer,
- 7:59Speaker 1: the firearm was also packaged and then provided to the
- 8:02Speaker 1: FBI as well. Question, did the firearm go to the
- 8:05Speaker 1: FBI or the ATF? Answer, oh, sorry, correction. First, it
- 8:10Speaker 1: went to the FBI to be in their capacity. And then,
- 8:12Speaker 1: it was sent to the ATF lab. Question, okay, in
- 8:16Speaker 1: the rounds. The cartridge and the cartridge cases? Answer, yes.
- 8:20Speaker 1: The cartridge and the cartridge cases? Answer, all those were packaged,
- 8:26Speaker 1: originally provided to the FBI. Then, they were sent to
- 8:29Speaker 1: the ATF lab. Question, all right. And were each of
- 8:33Speaker 1: those items tested? Answer, yes, they were. Question, and in
- 8:37Speaker 1: the testing, were they all photographed? Answer, yes. Question, yes.
- 8:41Speaker 1: And were they photographed by ATF when they were tested? Answer, yes,
- 8:46Speaker 1: they were. Question, have you reviewed their photographs? Answer, yes. Question,
- 8:51Speaker 1: and were you previously shown State Exhibit 19, 20, 21,
- 8:55Speaker 1: and 22? Answer, yes. Question, and are those photographs that
- 9:00Speaker 1: the ATF, or that you received back from the ATF
- 9:03Speaker 1: of those cartridges and the cartridge cases? Answer, yes. Question,
- 9:08Speaker 1: did they have the same appearance and etchings? That you
- 9:10Speaker 1: saw when you observed them removed from the gun? Answer yes. Question.
- 9:15Speaker 1: And did those photographs accurately capture those etchings? Answer yes. Question.
- 9:21Speaker 1: I move to admit State Exhibit 19 through 22. Judge Graff. Defense. Defense.
- 9:27Speaker 1: Additional objections, Your Honor. Judge Graff. All right. I'll note
- 9:31Speaker 1: the standing objections. Those objections are overruled. And 19, 20, 21,
- 9:35Speaker 1: and 22 are admitted. And as to your publication, prosecution,
- 9:43Speaker 1: I move to publish these exhibits at all three levels.
- 9:46Speaker 1: Judge Graff, all right. Any further objections? Defense, no further objections.
- 9:51Speaker 1: Judge Graff, thank you again. I note the standing objections.
- 9:54Speaker 1: Those are overruled. They may be published both in the
- 9:57Speaker 1: courtroom and captured by the media. camera. Question, let us
- 10:03Speaker 1: start with Exhibit 19, please. What are we looking at here?
- 10:06Speaker 1: Exhibit 19. Answer, this is the cartridge case that was
- 10:11Speaker 1: recovered from the gun. Question, and what position was this
- 10:14Speaker 1: in the gun? Answer, or this was what was in
- 10:18Speaker 1: the chamber? Question, okay, and the chamber meaning? That's where
- 10:21Speaker 1: a cartridge is when it's fired, correct? Answer, yes. Question,
- 10:25Speaker 1: do you notice an inscription or an etching on this
- 10:28Speaker 1: cartridge case? Answer, yes, I do. Question, will you read
- 10:32Speaker 1: what it says? Answer, yes, notices bulge. Question, and if
- 10:37Speaker 1: we go down the page to two of the exhibit,
- 10:39Speaker 1: will you read what this says? Answer, O-W-O, what's. Question,
- 10:47Speaker 1: and to page three? Answer, this. Question, and question mark, correct? Answer, yes,
- 10:54Speaker 1: question mark. Question, all right, if we go to state
- 10:58Speaker 1: exhibit 20, is this a photograph of one of the
- 11:01Speaker 1: cartridges that was found in the gun? Answer, yes, it is. Question,
- 11:05Speaker 1: what are we looking at here in this view of
- 11:07Speaker 1: page 1, exhibit 20? Answer, this is the head stamp
- 11:11Speaker 1: of it, and it says, according to the head stamp,
- 11:13Speaker 1: it's a Remington. 30- 06 Springfield. Question, and is that different caliber?
- 11:18Speaker 1: Then a 2-23 round. Answer, yes it is. Question, will
- 11:22Speaker 1: you look at page 2 of exhibit 20? Will you
- 11:24Speaker 1: read the markings here? Answer, a fascist. And page 3? Answer, catch. Question,
- 11:32Speaker 1: and page 4? Answer, up arrow, right arrow, down arrow,
- 11:36Speaker 1: down arrow, down arrow, down arrow. Question, alright, let's go
- 11:40Speaker 1: to exhibit 21. And was this another round that was
- 11:42Speaker 1: found in the gun? Answer, yeah. Question, will you read
- 11:46Speaker 1: the inscription? Answer, oh, Bella Chow. Question, page two. Answer,
- 11:52Speaker 1: chow chow. Question, all right, let's go to exhibit 22.
- 11:56Speaker 1: Another round that was found from the gun, correct? Answer, yes. Question,
- 12:00Speaker 1: will you read, please? The letter is here. Answer, if
- 12:03Speaker 1: you read this or this, you are gay. Question, end
- 12:09Speaker 1: page four. Answer, LMAO. All right, folks, we're going to
- 12:12Speaker 1: wrap up right here. And in the next episode dealing
- 12:14Speaker 1: with the topic, we're going to pick up where we
- 12:16Speaker 1: left off. All the information that goes with this episode
