Latest / Beyond The Horizon / Mega Edition: Chad Daybell Trial (Part 22-23) (10/24/26)
Transcript
- 0:00Speaker 1: What's up, everyone, and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to get back to the Chad
- 0:05Speaker 1: Daybell trial, and we're going to check out what went
- 0:08Speaker 1: down on day number 22. Once again, we're using EastIdahoNews.com,
- 0:15Speaker 1: and the author of this article is Nate Eaton. 8.20 a.m.
- 0:20Speaker 1: We're entering week six of Chad Daybell's murder trial, and
- 0:23Speaker 1: FBI tactical specialist Nicole Heidemann will be back on the
- 0:27Speaker 1: stand this morning, continuing her testimony about James and Elena's
- 0:31Speaker 1: love story. 8.27 a.m. Chad Daybell is wearing a light
- 0:36Speaker 1: checkered dress shirt with a tie and is sitting next
- 0:39Speaker 1: to John Pryor, his attorney. Rob Wood, Madison County Prosecutor
- 0:43Speaker 1: Lindsey Blake, Fremont County Prosecutor Rocky Wixom, Fremont County Deputy Prosecutor,
- 0:48Speaker 1: and Ingrid Beatty, AG Special Attorney, are at the prosecution table. 8.32 a.m.
- 0:55Speaker 1: Judge Stephen Boyce is on the bench and the jurors
- 0:58Speaker 1: are being brought in. 8.34 a.m. Heidemann is on the stand.
- 1:02Speaker 1: Blake will be questioning her. 8.35 a.m. Heidemann found additional
- 1:08Speaker 1: text messages regarding the James and Elena story. Blake has
- 1:12Speaker 1: them on paper for her to review. The messages are
- 1:15Speaker 1: from the Lollitime iCloud and the contents of the Lollitime
- 1:19Speaker 1: iCloud account have been admitted for evidence. Blake asks Heidemann
- 1:24Speaker 1: to review some of them. And this is all the
- 1:26Speaker 1: same evidence we've seen in the Lori Vallow trial. As
- 1:29Speaker 1: far as these accounts go, we saw all of this previously. 8.38 a.m.
- 1:36Speaker 1: He kissed her deeply as their breathing slowed. He held
- 1:39Speaker 1: her tightly before they began another round of pleasurable bonding.
- 1:44Speaker 1: Reads one of the texts from Chad to Lori. That
- 1:47Speaker 1: is pretty incredible. Followed by fire emojis. On August 9th, 2019,
- 1:52Speaker 1: the intensity of each encounter on my mind. Each one
- 1:56Speaker 1: greater than the last. Fire emoji. Fire emoji. From Chad Delory.
- 2:00Speaker 1: Chad says, I completely agree. We were definitely in new
- 2:04Speaker 1: territory in your bedroom. And the mere thought of the
- 2:08Speaker 1: Stunad and the Skafuza copulating is just enough to make
- 2:12Speaker 1: me want to vomit all over the studio. 8.41am. Elena's
- 2:16Speaker 1: magic hand gripped the storm and they stare into each
- 2:19Speaker 1: other's eyes as intense waves wash over them. A text reads,
- 2:23Speaker 1: Blake asks Heidemann what storm meant. It appeared to be
- 2:26Speaker 1: a name for Chad's penis. Chad is smiling. Can you
- 2:30Speaker 1: imagine this idiot? Oh yeah, let me call my package
- 2:34Speaker 1: The Storm. What are you, 12 years old? The Storm.
- 2:37Speaker 1: And then the audacity of Chad Daybell to sit here
- 2:39Speaker 1: in this courtroom smiling, with these little kids dead and buried. Helicopters, volcanoes. 8.42am.
- 2:48Speaker 1: Heidemann reads more messages between Lori and Chad. I love
- 2:51Speaker 1: you more. That's so hot. I just need you more
- 2:54Speaker 1: than ever. Lori writes to Chad. On August 10, 2019,
- 2:59Speaker 1: Chad sends Lori, You are amazing. Please save that segment.
- 3:03Speaker 1: I want to read it with you naked and then
- 3:05Speaker 1: relive it all. 8.43 a.m. Blake has nothing further. Pryor
- 3:10Speaker 1: will now cross-examine. 8.44 a.m. Pryor asks Heidemann if she
- 3:15Speaker 1: could determine whether there were chapter breaks in the Chad
- 3:18Speaker 1: and Elena story. She says in the emails that were sent,
- 3:22Speaker 1: it appeared... There were chapter breaks in some, but not others.
- 3:25Speaker 1: Pryor asks if this could have been another book Chad
- 3:28Speaker 1: was writing. I don't know if he intended to publish it,
- 3:31Speaker 1: Heidemann says. And if any of you out there are
- 3:34Speaker 1: aspiring authors and you get down on yourself and you
- 3:37Speaker 1: don't think you can publish a book, I have news
- 3:39Speaker 1: for you. If Chad Daybell can publish a book, anybody can. Now,
- 3:44Speaker 1: having anyone read that book, well, that's a whole different conversation. 8.45 a.m.
- 3:51Speaker 1: Heidemann says she could not tell if Chad's intent was
- 3:53Speaker 1: to write a book. Pryor asks about Chad searching for
- 3:57Speaker 1: a Malachite in March of 2018. He didn't know Lori
- 4:00Speaker 1: Vallow at that time. Pryor asks if Lori Vallow did
- 4:03Speaker 1: most of the Google searching for the Malachite. Heidemann says
- 4:07Speaker 1: she would need to check her records. Heidemann says Chad
- 4:10Speaker 1: regularly attended the temple regardless of his infidelity or his affair. Well,
- 4:16Speaker 1: that's because the best lies have some truth sprinkled in, right?
- 4:19Speaker 1: So if he keeps on keeping on with his regular routine,
- 4:23Speaker 1: people aren't going to be wiser to the nonsense he's
- 4:25Speaker 1: up to. Or at least that's what he hopes. 8.47 a.m.
- 4:29Speaker 1: Pryor asks if people who Chad and Lori knew joined
- 4:31Speaker 1: them at the temple. Heidemann only looked at the temple
- 4:34Speaker 1: records of Chad and Lori. Pryor has nothing else. 8.48 a.m.
- 4:39Speaker 1: Blake follows up by asking if both Chad and Lori
- 4:42Speaker 1: were looking for Malachite when their spouses were still alive.
- 4:45Speaker 1: Heidemann says they did. Nothing further. 8.50 a.m. Angie Christensen,
- 4:51Speaker 1: FBI forensic anthropologist, is called to the stand. Wixom will
- 4:55Speaker 1: be questioning her. Boyce asks for a brief sidebar. 8.54 a.m.
- 5:00Speaker 1: Christensen works at the FBI laboratory in Quantico, Virginia. She
- 5:04Speaker 1: analyzes human skeletal remains. 8.56 a.m. Wixom says the skeleton
- 5:11Speaker 1: can be analyzed visually and under microscope to determine if
- 5:14Speaker 1: they were damaged. Thermally altered means bones have been damaged
- 5:18Speaker 1: by heat or fire. Signs include discoloration and easily fractured. 8.58 a.m.
- 5:24Speaker 1: Biomechanically fresh bones still have the bending quality. Older bones
- 5:28Speaker 1: fracture in different ways. She compares it to a fresh
- 5:31Speaker 1: twig versus a dry branch, Christensen says. 9 a.m. Christensen
- 5:37Speaker 1: did an analysis of Tylee's remains. She examined the remains visually, microscopically,
- 5:42Speaker 1: by taking measurements, and by using x-rays. 9.02 a.m. Wixom
- 5:47Speaker 1: moves to admit photos of Tylee's remains. and a demonstrative exhibit.
- 5:51Speaker 1: Boyce asks for a quick sidebar. The attorneys leave the
- 5:54Speaker 1: courtroom with the judge. 9.05 a.m. Boyce is back on
- 5:59Speaker 1: the bench. The photos will be shown to jurors and
- 6:02Speaker 1: those of us in the courtroom, but they will not
- 6:04Speaker 1: be shown on the live stream, and the first pictures
- 6:07Speaker 1: show Tylee's left femur and right femur. Look, I don't
- 6:10Speaker 1: think we need to see those. Obviously, they exist. They've
- 6:14Speaker 1: been admitted into evidence, and frankly, I don't need to
- 6:17Speaker 1: see those pictures again. We saw them during the Lori
- 6:20Speaker 1: Vallow trial, or at least some of them, and I'm
- 6:23Speaker 1: straight on seeing those ever again, honestly. 909 AM. Wixom
- 6:28Speaker 1: shows a diagram of a skeleton. Christensen points out where
- 6:31Speaker 1: the femur are on the graphic. The bones are burned,
- 6:35Speaker 1: and Christensen says that it's consistent with thermal damage. It's discolored, black,
- 6:39Speaker 1: and gray. Christensen is not able to say whether the
- 6:42Speaker 1: burns happened before or after Tylee's death, but she says
- 6:46Speaker 1: burning normally happens after death. One of the femurs have
- 6:50Speaker 1: evidence of carnivore scavenging. This is a little child we're
- 6:54Speaker 1: talking about. Keep that in mind if you ever have
- 6:56Speaker 1: any sort of feelings of compassion for Chad Daybell or
- 7:01Speaker 1: Lori Vallow. Remember, they showed no feelings of compassion, no
- 7:05Speaker 1: feelings of sorrow for what they did to these children,
- 7:08Speaker 1: and they still have not shown any bit of remorse. So, helicopters, volcanoes.
- 7:15Speaker 1: And the only thing that sucks is that Alex Cox
- 7:17Speaker 1: isn't with them to take that ride. 9.13 a.m. I'm
- 7:21Speaker 1: aware there is no sound on the live feed. We
- 7:24Speaker 1: have court staff. We see part of the upper and
- 7:26Speaker 1: lower jaw on the screen. There are signs that the
- 7:29Speaker 1: bones have been burned. 9.15 a.m. Wixom asked Christensen to
- 7:34Speaker 1: describe trauma as photos of the upper left hip bone
- 7:38Speaker 1: are shown on the screen. They are brown and black.
- 7:41Speaker 1: Christensen says they were numerous sharp traumas on Tylee's bone.
- 7:46Speaker 1: On the photo on the screen, there are five blunt,
- 7:49Speaker 1: and sharp trauma locations. 9.17 a.m. We now see a
- 7:54Speaker 1: CT scan of the pelvic bone and the Christensen points
- 7:57Speaker 1: out sharp trauma locations. There are several spots. 9.19 a.m.
- 8:03Speaker 1: The next photos document detail of views of the same
- 8:06Speaker 1: sharp trauma locations we saw on the previous slide. The
- 8:10Speaker 1: bone was in a fresh state, Christensen said. She does
- 8:13Speaker 1: not know whether the trauma occurred before or after death.
- 8:17Speaker 1: The marks are consistent with both. 9.20 a.m. Wixom asks
- 8:21Speaker 1: if the sharp trauma could have occurred naturally or because
- 8:24Speaker 1: of disease. Christensen says no. Sharp trauma happens from an
- 8:28Speaker 1: external force. Wixom asks Christensen if she has experience identifying
- 8:33Speaker 1: injury to bone that could occur from dismemberment. She does. 9.21 a.m.
- 8:39Speaker 1: None of the marks were consistent with dismemberment, Christensen says.
- 8:43Speaker 1: You wouldn't see sharp trauma On the pelvis area, if
- 8:46Speaker 1: someone was trying to dismember. 9.22 a.m. More than 100
- 8:51Speaker 1: bones were submitted to Christensen. Some were more broken and
- 8:55Speaker 1: thermally damaged than others. 9.23 a.m. Christensen gave an item
- 9:00Speaker 1: number to every bone. There were thermal alteration to the
- 9:03Speaker 1: top part of the hip bone. 9.24 a.m. We now
- 9:06Speaker 1: see photos of the right hip bone. There are six
- 9:09Speaker 1: sharp trauma locations on that bone. 9.26 a.m. There is
- 9:14Speaker 1: thermal damage on this bone consistent with fire or heat. 9.28 a.m.
- 9:20Speaker 1: The next exhibit shows a sharp trauma from the previous bone.
- 9:23Speaker 1: The photo also shows the bone was in a fresh state. 9.30 a.m.
- 9:28Speaker 1: We now see photos of the sacrum, the bottom of
- 9:30Speaker 1: the spine, which is still attached to some vertebrae. 9.31 a.m.
- 9:36Speaker 1: Wixom asks if it's common for tissue to still be
- 9:39Speaker 1: attached to the bones when they are received. Christensen says
- 9:42Speaker 1: it's not common, but it happens. Christensen did not remove
- 9:46Speaker 1: the soft tissue from the bone because she could see
- 9:49Speaker 1: everything she needed to see. 9.32 a.m. Christensen did remove
- 9:54Speaker 1: tissue from the ankle and foot, but not of the
- 9:57Speaker 1: bones we have seen so far. 9. 9.35 a.m. Christensen
- 10:02Speaker 1: prepared a report after she received and evaluated Tylee's remains.
- 10:06Speaker 1: Christensen turned her report over to the Idaho Medical Examiner. 9.36 a.m.
- 10:12Speaker 1: Wixom moves to admit the FBI lab report issued by Christensen.
- 10:16Speaker 1: This is a summary of her findings. And Wixom has
- 10:19Speaker 1: nothing further. 9.39 a.m. Pryor will now cross-examine. Christensen says
- 10:26Speaker 1: she has published the book with Dr. Eric Bartolink. He
- 10:30Speaker 1: is the defense expert. She has reviewed his report and
- 10:33Speaker 1: says there were no significant discrepancies with her report. 9.41 a.m.
- 10:39Speaker 1: Christensen says that what she and Bartolink do is highly specialized.
- 10:44Speaker 1: Pryor asks about the carnivore Marks. Christensen says typically it's post-mortem,
- 10:49Speaker 1: after someone dies. She does not know where the carnivore
- 10:52Speaker 1: animal made the marks on the bones. 9.43 a.m. Christensen
- 10:57Speaker 1: says a number of parts of the skull were missing.
- 10:59Speaker 1: She does not know why they are missing. Portions of
- 11:02Speaker 1: the bones had burn marks on them. 9.44 a.m. Pryor
- 11:06Speaker 1: has nothing further. Wixom has some brief redirect. He asks
- 11:10Speaker 1: if some of the bones had been severely damaged. She
- 11:13Speaker 1: says there was a number that were so thermally damaged
- 11:17Speaker 1: that she couldn't tell if they were human or not. 9.45 a.m.
- 11:22Speaker 1: Parts of the body were more thermally altered than others.
- 11:24Speaker 1: Wixom has nothing further. 9.46 a.m. Morning break. Back in
- 11:31Speaker 1: 20 minutes. Alright, we're going to stop here as well.
- 11:34Speaker 1: And in the next episode, we'll pick up where we
- 11:36Speaker 1: left off. And we'll get to the rest of the testimony.
- 11:40Speaker 1: All of the information that goes with this episode can
- 11:42Speaker 1: be found... in the description box. What's up, everyone, and
- 11:47Speaker 1: welcome back to the program. In this episode, we're picking
- 11:50Speaker 1: up where we left off with the Chad Daybell trial.
- 11:53Speaker 1: And to do that, we're using eastidahonews.com once again. The
- 11:59Speaker 1: author of this article is Nate Eaton. 10.11 a.m. Next
- 12:04Speaker 1: witness is Ashlyn Rind. She'll be questioned by Ingrid Beatty.
- 12:08Speaker 1: Ashlyn lives in Chandler, Arizona. She knew Tylee. We were
- 12:11Speaker 1: best friends in high school, she says. They met in 2016. 10.14 a.m.
- 12:17Speaker 1: Ashlyn visited Tylee a few times a week. She met Charles, Lori, Tylee, JJ,
- 12:23Speaker 1: and Alex. Ashlyn says Tylee's relationship with JJ was maternal.
- 12:28Speaker 1: She was always caring for her little brother. 10.15 a.m.
- 12:32Speaker 1: Ashlyn might see Alex once every six months. Alex and
- 12:35Speaker 1: Tylee joked around a lot, and Alex offered her a
- 12:38Speaker 1: place to stay when she needed it. She felt comfortable
- 12:41Speaker 1: with Alex. 10.16 a.m. Ashlyn says Tylee moved to Texas
- 12:46Speaker 1: and then returned to Arizona. She then said they were
- 12:50Speaker 1: moving to Idaho. Ashlyn tried to stay in touch with
- 12:53Speaker 1: Tylee after she moved to Idaho, but it was only
- 12:56Speaker 1: for two weeks. Beatty has nothing further. Pryor will now cross-examine. 10.17 a.m.
- 13:02Speaker 1: Pryor asks how many times Ashlyn saw Alex interact with Tylee.
- 13:06Speaker 1: She says more than six times because Alex was living
- 13:09Speaker 1: with them. Pryor asks if JJ relied on Tylee. for
- 13:13Speaker 1: a lot of his basic needs. I would say he
- 13:15Speaker 1: wasn't relying on her, but she was there for him.
- 13:18Speaker 1: He was going for anybody who was going to provide
- 13:21Speaker 1: for him, but Tylee was the one who would always
- 13:23Speaker 1: show up, Ashland says. 10.19 a.m. Prior is nothing else.
- 13:28Speaker 1: Beatty has no redirect. 10.20 a.m. Next witness is David Sinserbaugh.
- 13:34Speaker 1: He will be questioned by Rocky Wixom. Sinserbaugh is retired
- 13:37Speaker 1: from Idaho State Police and was a forensic chemist. He
- 13:41Speaker 1: did the type of work for 26 years. 10.22 a.m.
- 13:45Speaker 1: Sinterbaugh was responsible for investigating suspected arson cases. Cans would
- 13:50Speaker 1: come into his office containing burned stuff, and then he
- 13:54Speaker 1: would do an analysis on it to determine if it
- 13:56Speaker 1: contained an ignitable liquid. 10.24 a.m. Sinterbaugh explains how products
- 14:03Speaker 1: were tested to see if they had ignitable liquids. He
- 14:06Speaker 1: says a special oven was used. 10.26 a.m. Sinterbaugh has
- 14:11Speaker 1: been involved in 50 to 100 cases where he had
- 14:14Speaker 1: to determine the accelerant of a fire. He worked on
- 14:17Speaker 1: the Tylee Ryan case. He received a can from law
- 14:20Speaker 1: enforcement and asked if he could find any ignitable liquids
- 14:24Speaker 1: on the inside of the can. The interior contained decomposing
- 14:28Speaker 1: flesh and debris. 10.28 p.m. The can contained gasoline and
- 14:33Speaker 1: compounds indicative of decomposing flesh. 10.29 a.m. Wixom has nothing further.
- 14:39Speaker 1: Pryor has no questions since her ball is free to go. 10.30 a.m.
- 14:45Speaker 1: State calls Rexburg detective Chuck Kunisitis to the stand. He
- 14:50Speaker 1: previously testified in the trial and Wood will question him. 10.33 a.m.
- 14:55Speaker 1: Kunisitis has worked at Rexburg police for 34 years. Wood
- 14:59Speaker 1: asked Kunisitis if he reviewed satellite imagery of Daybell's property.
- 15:03Speaker 1: He did. He monitored social media. and found an image
- 15:06Speaker 1: of a satellite photo of Chad's land. Concitus followed up
- 15:10Speaker 1: on it and reached out to Apollo Mapping, the company
- 15:13Speaker 1: that did the satellite photo. 10.36 a.m. Wood moves to
- 15:17Speaker 1: admit an exhibit. There were four photos of satellite images.
- 15:21Speaker 1: The first one was taken August 27, 2019 at 12.33 p.m.
- 15:26Speaker 1: The second image is from the same satellite company. It's
- 15:29Speaker 1: a high-resolution image of Daybell's property. The third image is
- 15:33Speaker 1: from September 9, 2019. A high-resolution image was taken at 12.32 p.m.
- 15:39Speaker 1: That's the day Tylee was buried. 10.39 a.m. The last
- 15:44Speaker 1: image was taken on October 25, 2019 at 12.42 p.m. 10.41 a.m.
- 15:52Speaker 1: Wood displays the first image on the screen, the one
- 15:54Speaker 1: from August 22, 2019. We see a picture of Chad's
- 15:58Speaker 1: property from a satellite. Wood then shows the image from
- 16:01Speaker 1: September 2, 2019. The third image is from September 9th, 2019.
- 16:07Speaker 1: On the third image, Concitus uses a laser to point
- 16:10Speaker 1: out the area where Tylee was discovered. There is a
- 16:13Speaker 1: discolored mark on the map. The previous two photos did
- 16:17Speaker 1: not have the discoloration. 10.43 a.m. Concitus says he personally
- 16:22Speaker 1: removed the remains of Tylee Ryan as he wipes tears
- 16:25Speaker 1: from his eyes. He points to the area of discoloration
- 16:29Speaker 1: on the map. We now see an image. From October 25th, 2019.
- 16:34Speaker 1: Wood has nothing further. Pryor will now cross-examine. 10.45 a.m.
- 16:39Speaker 1: Pryor asks Considus about the number of images from Apollo.
- 16:43Speaker 1: He says there were four. Pryor asks if the area
- 16:45Speaker 1: Considus pointed to was close to the fire pit. Considus
- 16:49Speaker 1: says it's about 10 to 15 yards from the fire pit. 10.48 a.m.
- 16:54Speaker 1: Pryor shows a satellite map on the screen. He asks
- 16:56Speaker 1: Considus to point to the White Barn. He asks what
- 16:59Speaker 1: The dark mark is near the barn. Considus says it's
- 17:03Speaker 1: a hitching post. He asks for his glasses. 10.50 a.m.
- 17:07Speaker 1: Pryor asks Considus to point out a few things on
- 17:09Speaker 1: the map and asks what they are. There is a
- 17:11Speaker 1: standalone section of fence and the fire pit. 10.52 a.m.
- 17:16Speaker 1: Pryor shows another satellite map and asks about a round
- 17:19Speaker 1: circle north of the tree. It's the fire pit. Pryor
- 17:22Speaker 1: asks where the remains of Tylee were found. Considus points
- 17:25Speaker 1: it out on the map. 10.53 a.m. We now see
- 17:29Speaker 1: a satellite image showing snow on the property. Pryor asks
- 17:32Speaker 1: Concitus to point out the fire pit and the location
- 17:36Speaker 1: of Tylee's remains. 10.57 a.m. Pryor asks about an email
- 17:41Speaker 1: between Chad and Tammy regarding burning some limbs. Pryor has
- 17:44Speaker 1: nothing further. Wood will read direct. 10.58 a.m. Wood shows
- 17:50Speaker 1: the satellite image from September 9th, 2019. He flips back
- 17:52Speaker 1: to September 2nd, 2019. Wood points out a small bush, tree,
- 17:59Speaker 1: a standalone fence, the fire ring, and the hitching post.
- 18:02Speaker 1: On the September 9th image, there are clouds that obscure
- 18:05Speaker 1: some features. Wood points to the hitching post. There was
- 18:09Speaker 1: no discoloration in the previous two photos on this spot. 11.02 a.m.
- 18:14Speaker 1: Wood has nothing further. Next witness will be called and
- 18:16Speaker 1: questioned by Rocky Wixom. 11.04 a.m. Doug Halipaska is an
- 18:22Speaker 1: FBI forensic examiner in the Firearms and Tools Division. 11.05 a.m.
- 18:27Speaker 1: Halipaska says the majority of cases he works concern firearms,
- 18:32Speaker 1: but over the year he has worked a number of
- 18:34Speaker 1: tool mark cases too. 11.06 a.m. Halipaska says evidence often
- 18:40Speaker 1: arrives via FedEx. Sometimes law enforcement drop it off. It
- 18:43Speaker 1: is inventoried and entered into an evidence management system. 11.07 a.m.
- 18:49Speaker 1: Halipaska performed a tool mark analysis on the tools found
- 18:53Speaker 1: on Chad's property. He says there are two types of
- 18:55Speaker 1: tool marks. Impressed and striated. Impressed are like a hammer
- 19:00Speaker 1: hitting a surface, and striated tool mark is produced when
- 19:03Speaker 1: a tool is placed against another object and moved parallel
- 19:07Speaker 1: to and across the object with pressure applied. 11.12 a.m.
- 19:11Speaker 1: Wixom moves to emit photos of Tylee Ryan's remains. Boyce
- 19:14Speaker 1: calls for a sidebar. 11.15 a.m. Boyce says we will
- 19:18Speaker 1: take a brief recess while the courtroom is shifted around
- 19:22Speaker 1: because the photos are graphic. 11.32 a.m. We are back.
- 19:26Speaker 1: The photos will be shown to the jurors and parties,
- 19:29Speaker 1: but not on the live stream, or to those of
- 19:32Speaker 1: us in the courtroom. 11.33 a.m. Wixom asks what a
- 19:37Speaker 1: pattern examination is. The exam process is broken into two
- 19:41Speaker 1: separate levels. Doing the first, he makes an observation using
- 19:44Speaker 1: a low-level magnifying glass. He is making notes and documenting
- 19:48Speaker 1: what he sees. The second half is to make the identification.
- 19:52Speaker 1: He uses a comparison microscope and looks at two samples
- 19:55Speaker 1: under the same viewing field. 11.35 a.m. Wixom moves to
- 20:00Speaker 1: admit an exhibit showing a photo. Halipaska says the image
- 20:05Speaker 1: of two portions of hip bone and an intact portion
- 20:08Speaker 1: of a spine. 11.37 a.m. Halapaska describes an image showing
- 20:13Speaker 1: tool marks that were on the hip bone. They are
- 20:16Speaker 1: action type tool marks, stabbing and chopping. 11.39 a.m. Halapaska
- 20:21Speaker 1: generated a digital box around each of the tool marks
- 20:24Speaker 1: and labeled them. The first one was from a stabbing action.
- 20:28Speaker 1: Halapaska says he uses a casting substance, puts it on
- 20:31Speaker 1: top of the tool marks and then removes it. He
- 20:34Speaker 1: can then compare the tools that have caused the actions. 11.43 a.m.
- 20:39Speaker 1: Halapaska says the tools consistent with producing this type of
- 20:42Speaker 1: mark was a single-bladed knife or a comparable tool. Other
- 20:46Speaker 1: possibilities cannot be ruled out. 11.45 a.m. Another tool mark
- 20:51Speaker 1: is pointed out and Halapaska says it was a chopping
- 20:54Speaker 1: type action. This could have come from a machete or
- 20:57Speaker 1: another type of similar tool. 11.48 a.m. The marks were
- 21:01Speaker 1: such that even if he had the tools to produce
- 21:05Speaker 1: the marks, he couldn't 100% say which tools were used. 11.49 a.m.
- 21:10Speaker 1: Halipaska described a zoomed-in image of a fracture line and
- 21:14Speaker 1: cracks on the hip bone. You can see the fracture
- 21:17Speaker 1: of the bone caused by the tool. 11.51 a.m. All
- 21:21Speaker 1: the bones were labeled when they came into the FBI office.
- 21:25Speaker 1: Wixom shows another photo of fracture marks caused by a
- 21:28Speaker 1: tool with a chopping action. 11.53 a.m. This particular injury
- 21:34Speaker 1: could have come from a cleaver, machete, etc., Halipaska describes
- 21:37Speaker 1: more bones that have fracture marks caused by tools. 11.56 a.m.
- 21:43Speaker 1: Another photo is shown of the hip bone. Halipaska says
- 21:46Speaker 1: there was stabbing action performed on the bone, and it
- 21:49Speaker 1: was so hard it caused a fracturing on the backside.
- 21:53Speaker 1: The hip bone cracked. 12.01 p.m. Halipaska goes on to
- 21:57Speaker 1: describe more injuries on the bones that were caused from
- 22:00Speaker 1: the chopping type actions. He was unable to determine if
- 22:04Speaker 1: the injuries matched individual characteristics of a specific tool. 12.03 p.m.
- 22:10Speaker 1: Halipaska describes the next item on the screen, a portion
- 22:13Speaker 1: of the hip bone that was black and burned. A
- 22:16Speaker 1: number of tool marks were located on the item. 12.06 p.m.
- 22:20Speaker 1: Halipaska continues to describe more chopping and stabbing type actions
- 22:24Speaker 1: on the bones. 12.08 p.m. The jury now sees a
- 22:28Speaker 1: photo of a bone that was fractured and shattered. Halipaska
- 22:33Speaker 1: says the tool that was used to cut into the
- 22:35Speaker 1: soft tissue. It was consistent with being from a cleaver, machete, hatchet, etc. 12.13pm.
- 22:42Speaker 1: The next image shows tool marks that were generated on
- 22:45Speaker 1: bones using excessive force. Another mark was caused by a
- 22:48Speaker 1: stabbing type motion. 12.14pm. A small channel was formed in
- 22:53Speaker 1: one part of the bone that was consistent with an
- 22:55Speaker 1: ice pick being used. 12.17pm. Most of the injuries to
- 23:00Speaker 1: the hip, came from the front side, not the back,
- 23:03Speaker 1: Halipaska testifies. 12.18 p.m. Overall, the majority of injuries came
- 23:09Speaker 1: from a chopping-type action. Halipaska says if he had been
- 23:13Speaker 1: provided tools, he would have been able to make tests
- 23:16Speaker 1: to mark narrow down the tools, but he would not
- 23:18Speaker 1: have been able to conduct the second level of the exam.
- 23:21Speaker 1: Wixom has nothing further. 12.21 p.m. Lunch for the jury
- 23:26Speaker 1: is late, so Pryor is going to cross-examine now. 12.23 p.m.
- 23:31Speaker 1: Pryor asks about Halipaska not being able to make source determinations.
- 23:35Speaker 1: He says he couldn't do any source determinations, tracking the
- 23:39Speaker 1: marks back to an individual tool. Halipaska says individual characteristics
- 23:43Speaker 1: are critical. 12.26 p.m. Pryor has nothing further. Wixom has
- 23:49Speaker 1: a brief redirect. He asks if there is no question
- 23:52Speaker 1: that some type of tool was used to injure Tylee
- 23:54Speaker 1: and her bones. He says absolutely. That is correct. So
- 23:59Speaker 1: the judge here calls for a lunch break, but we're
- 24:01Speaker 1: just going to power through. 1.31 p.m. Court is back
- 24:04Speaker 1: in session. Jurors are being brought in. Caitlin Hart is
- 24:07Speaker 1: now taken over because Nate's feeling a little bit under
- 24:10Speaker 1: the weather. Hopefully Nate's feeling better. 1.32 p.m. The state
- 24:15Speaker 1: has called FBI cast agent Nick Balance to the stand.
- 24:18Speaker 1: Balance has previously testified. 1.34 p.m. Wood will be questioning Balance. 1.35 p.m.
- 24:26Speaker 1: would ask Balance about September 9th and September 23rd. He
- 24:29Speaker 1: brings up two dates on the screen, October 8th and 9th, 2019.
- 24:34Speaker 1: We now see the screen a receipt provided to Balance
- 24:37Speaker 1: that is associated with Boyd Dial. Balance says this was
- 24:41Speaker 1: attributed to Chad Daybell. 1.37 p.m. The receipt is from
- 24:46Speaker 1: AT & T from October 8th, 2019 for changes made
- 24:50Speaker 1: to an account. Balance says this shows a return from
- 24:54Speaker 1: TrackPhone Accompany that provides wireless service. They don't have towers,
- 24:58Speaker 1: so they rely on a larger provider with a cellular
- 25:01Speaker 1: infrastructure to carry calls on their network. 1.39 p.m. Balance
- 25:05Speaker 1: says the phone was purchased from Walmart in Rexburg. The
- 25:09Speaker 1: number was attributed to Alex Cox. 1.41 p.m. The Homer J.
- 25:14Speaker 1: Maximus email, Homer J. Jackoff, Alex Cox email account was
- 25:18Speaker 1: associated with the track phone. We now see a map
- 25:21Speaker 1: of the Walmart in Rexburg showing the location of the phone. 1.42 p.m.
- 25:27Speaker 1: The phone was at Walmart between 2.59 p.m. and 3.37 p.m.
- 25:32Speaker 1: According to Wi-Fi GPS data, Ballant says this does not
- 25:36Speaker 1: include all of the activity of the phone because there
- 25:38Speaker 1: is a margin of error. 1.44 p.m. We now see
- 25:43Speaker 1: the text messages from a cell phone with an Idaho
- 25:45Speaker 1: area code, 208. Ballant says these were returns from Verizon
- 25:50Speaker 1: showing the text messages that are associated to Chad Daybell.
- 25:53Speaker 1: The text says, Gonna stop by the store right now
- 25:56Speaker 1: to get that other number working. Hopefully won't take long. 1.45 p.m.
- 26:02Speaker 1: The following text was sent at 10.26 a.m. I will
- 26:05Speaker 1: call right now from a 401 number. They were sent
- 26:08Speaker 1: out to a cell phone associated with Lori Vallow. 1.46 a.m.
- 26:14Speaker 1: At 10.27 a.m., there was an outgoing call from Chad
- 26:17Speaker 1: to Lori. Chad's phone later received a call from the
- 26:20Speaker 1: number that Balan says he doesn't recognize. 1.48 p.m. Balance
- 26:25Speaker 1: says Verizon did not include the cell site and sector
- 26:29Speaker 1: associated with the text messages. This means if a customer
- 26:33Speaker 1: sends a text message, you're not able to see what
- 26:35Speaker 1: tower was used to send it. 1.49 p.m. Two phones
- 26:39Speaker 1: associated with Lori Vallow were being used southeast of Chandler,
- 26:43Speaker 1: Arizona around this time. 1.50 p.m. Balance says there was
- 26:47Speaker 1: an incoming call received at 1.11 p.m. from Lori to Chad.
- 26:52Speaker 1: The call was 513 seconds, which is about 10 minutes.
- 26:56Speaker 1: There were then 10 text messages between Chad and Alex
- 26:59Speaker 1: Cox on October 9th, 2019. 1.52 p.m. Balance is showing
- 27:05Speaker 1: how cell phone towers work and describing a slideshow showing
- 27:08Speaker 1: the overlap in cell phone tower coverage in Rexburg. 1.53 p.m.
- 27:14Speaker 1: The next slide shows more Google location history on October 9th,
- 27:17Speaker 1: 2019 between noon and 1.23 p.m. Balance says Alex Cox's
- 27:23Speaker 1: Google account showed him at Lori Vallow's residence during those times.
- 27:28Speaker 1: Balance says he was asked to look at this due
- 27:30Speaker 1: to an attempted assault on Tammy Daybell that occurred that day. 1.55 p.m.
- 27:36Speaker 1: That day, Alex Cox searched for Auburn, Alabama zip code.
- 27:40Speaker 1: Balance says this is significant because the track phone he
- 27:43Speaker 1: was using had an Auburn, Alabama area code. 1.57 p.m.
- 27:48Speaker 1: Alex's phone then traveled from Lori's apartment to his own apartment.
- 27:52Speaker 1: His phone then traveled northwest away from his apartment. Then
- 27:55Speaker 1: around 3.14 p.m., the phone went from Rexburg to Idaho Falls. 1.58 p.m.
- 28:02Speaker 1: Alex's phone then was seen at Sportsman's Warehouse in Idaho
- 28:05Speaker 1: Falls between 3.42 and 4.12 p.m. 1.59 p.m. Around 4.47,
- 28:12Speaker 1: Alex's phone was tracked around U.S. Highway 20 toward Chad
- 28:16Speaker 1: Daybell's house. 2.01 p.m. The next slide shows that Alex
- 28:20Speaker 1: Fohn was on Highway 20 at 4.57 p.m., then was
- 28:24Speaker 1: driving westbound at 5.03 p.m., ending at the Salem Church
- 28:28Speaker 1: near Chad Daybell's house. The church and Chad's house are
- 28:32Speaker 1: about two and a half miles apart. 2.02 p.m. Alex
- 28:36Speaker 1: Fohn is at his own apartment between 5.16 p.m. until 11.53 p.m.
- 28:38Speaker 1: that night. 2.04 p.m. Chad, Lori, and Alex are all
- 28:45Speaker 1: exchanging text messages around 5 p.m. that night, 2.05 p.m.
- 28:50Speaker 1: Ballant says Chad's phone and Alex's phone were both activated
- 28:53Speaker 1: between October 8th and 9th, 2019, 2.06 p.m. There are
- 28:58Speaker 1: multiple texts between all three people that night. There are
- 29:01Speaker 1: four texts sent between Chad and Alex's phones between 5.28
- 29:06Speaker 1: and 8.43 p.m. At 9.30 p.m., there are texts between
- 29:10Speaker 1: Chad and Lori. There are more than 10 texts between
- 29:14Speaker 1: Chad and Lori. 2.08pm. On October 19th, Balance heard Tammy
- 29:19Speaker 1: had been found dead. Chad's phone was at his house
- 29:22Speaker 1: between 10.40am and 11.22am. Chad texted Alex Cox around 10.40am.
- 29:29Speaker 1: He later called Lori Vallow around 11am. Between 11.21am and 12.11pm,
- 29:35Speaker 1: Chad's phone made an outgoing call to a number Balance
- 29:37Speaker 1: does not know. On October 18th, Lori and Chad were
- 29:30Speaker 1: texting on the day Tammy Daybell died. Lori was also
- 29:32Speaker 1: texting Alex Cox. The next slide shows more texts and
- 29:34Speaker 1: phone calls exchanged between Lori, Chad, and Alex. 2.11 p.m.
- 30:00Speaker 1: The next slide shows the Google location history of Alex
- 30:03Speaker 1: Cox between 10.05 and 10.07 p.m. He moved from Rexburg
- 30:08Speaker 1: up to the Salem Church near Chad's house. 2.13 p.m.
- 30:12Speaker 1: Looking closer, Alex's phone was near the Salem Church between 10.07
- 30:16Speaker 1: and 10.45 p.m. Chad was texting Lori around the same time. 2.15 p.m.
- 30:22Speaker 1: There was also a 16-minute call between Alex and Lori
- 30:25Speaker 1: around the same time. Lori's phone was in Hawaii. 2.17 p.m.
- 30:30Speaker 1: Alex Cox's phone was last near the Salem Church around 10.45 p.m.
- 30:35Speaker 1: Tammy Daybell died either late that night or early the
- 30:38Speaker 1: next morning. 2.19 p.m. Chad's phone was near a cemetery
- 30:42Speaker 1: and a holiday inn on the day of Tammy's memorial.
- 30:45Speaker 1: He was texting Lori that day. 2.20 p.m. Balance was
- 30:49Speaker 1: asked to look at Tylee Ryan's phone, and for any
- 30:52Speaker 1: instances in which it was used in the same place,
- 30:55Speaker 1: Lori Vallow's phone was used. Lori and Tylee's phones were
- 30:58Speaker 1: both used in Northeast Kansas. On October 16th, Lori and
- 31:02Speaker 1: Tylee's phones were both used in Rexburg. 2.22 p.m. Tylee
- 31:08Speaker 1: and Lori's phones were used days later in Arizona, then
- 31:11Speaker 1: on November 4th in Hawaii. 2.23 p.m. Balance says Lori
- 31:17Speaker 1: and Tylee's phones were consistently together after Tylee was believed
- 31:20Speaker 1: to be deceased. 2.24 p.m. Lots of back and forth
- 31:25Speaker 1: with the dates and times of phones and text messages.
- 31:28Speaker 1: On October 15th, Alex Cox was near Chad's house around 1.41
- 31:32Speaker 1: and 1.52 p.m. 2.25 p.m. Wood is done questioning, Pryor
- 31:38Speaker 1: has no questions, and balance will remain under subpoena. Wood
- 31:41Speaker 1: has asked for a sidebar, and Boyce is meeting with
- 31:44Speaker 1: the attorneys. 2.30 p.m. Attorneys are back at the table,
- 31:48Speaker 1: and the state says their witnesses have gone more quickly
- 31:51Speaker 1: than they anticipated, so they are concluding court for the day.
- 31:55Speaker 1: They will pick up in the morning with Dr. Marsden.
- 31:58Speaker 1: All right, folks, so there it is, day number 22
- 32:00Speaker 1: of the Chad Daybell trial. And that hole we talk
- 32:03Speaker 1: about when it comes to Chad Daybell, well, it just
- 32:05Speaker 1: keeps getting deeper and deeper. And by the end of
- 32:08Speaker 1: all of this, Chad Daybell is going to be buried
- 32:11Speaker 1: in it. All of the information that goes with this
- 32:13Speaker 1: episode can be found in the description box. What's up, everyone,
- 32:17Speaker 1: and welcome back to the program. In this episode, we're
- 32:20Speaker 1: heading back out to Idaho for day number 23 of
- 32:23Speaker 1: the Chad Daybell trial. Today's article was published by EastIdahoNews.com,
- 32:29Speaker 1: and the author of this article is Nate Eaton. 8.28 a.m.
- 32:33Speaker 1: at the defense table, John Pryor and Chad Daybell in
- 32:36Speaker 1: a blue shirt and red tie. At the prosecution table,
- 32:40Speaker 1: Fremont County Prosecutor Lindsey Blake, Madison County Prosecutor Rob Wood,
- 32:45Speaker 1: Fremont County Deputy Prosecutor Rocky Wixom, and Special Prosecutor Ingrid Beatty. 8.35 a.m.
- 32:52Speaker 1: Judge Boyce is on the bench and the jurors are seated.
- 32:55Speaker 1: The first witness today is Dr. Lily Marsden. 8.36 a.m.
- 33:00Speaker 1: Marsden is the Deputy Chief Medical Examiner at the Utah
- 33:04Speaker 1: Medical Examiner's Office. She is a forensic pathologist and explains
- 33:08Speaker 1: her background and training. 8.38 a.m. Marsden attended the exhumation
- 33:13Speaker 1: of Tammy Daybell. She followed the body during transport to
- 33:16Speaker 1: her office. She worked with Dr. Eric Christensen in performing
- 33:20Speaker 1: Tammy's autopsy. 8.40 a.m. Lindsay Blake is questioning Marsden and
- 33:26Speaker 1: asks her to talk us through the autopsy process. As
- 33:28Speaker 1: soon as the body arrives, an x-ray is performed. They
- 33:32Speaker 1: then do an external examination of the body looking for
- 33:35Speaker 1: traumatic injuries or other noticeable marks. An internal exam is
- 33:39Speaker 1: then done where all major organs are dissected to look
- 33:42Speaker 1: for anything that may have contributed to death. 8.42 a.m.
- 33:47Speaker 1: Tammy has been embalmed. There were bruises on her chest
- 33:51Speaker 1: and arms. There were no immediate or noticeable cause of
- 33:54Speaker 1: death from the external exam, Marsden says. 8.44 a.m. After
- 34:00Speaker 1: the external exam, the torso was opened to review all
- 34:03Speaker 1: the major organs. They were removed and inspected. The head
- 34:07Speaker 1: was then opened through incision. The brain was removed to
- 34:10Speaker 1: be dissected at a later date. No cause of death
- 34:13Speaker 1: was able to be determined, for Tammy's cause of death
- 34:17Speaker 1: through the internal exam. Tammy had a lot of fluid
- 34:19Speaker 1: in her lungs, pulmonary edema, and fluid in her trachea. 8.45 a.m.
- 34:25Speaker 1: Blake asks what causes pulmonary edema. Marsden explains natural things
- 34:29Speaker 1: can cause it, like pneumonia and heart failure. Non-natural causes
- 34:33Speaker 1: could be asphyxia, drownings, or drug overdose. 8.46 a.m. Samples
- 34:39Speaker 1: for toxicology testing were obtained. Most of the blood had
- 34:43Speaker 1: been removed from Tammy's body during the embalming process. Liver
- 34:47Speaker 1: tissues and eye fluid were taken as well as urine
- 34:49Speaker 1: from the bladder. The samples were sent to labs for
- 34:52Speaker 1: various testing. The only thing found in Tammy's system was
- 34:58Speaker 1: fluoxetine in her liver. Fluoxetine is an antidepressant Tammy had
- 35:03Speaker 1: been on for several years. There was no explanation in
- 35:06Speaker 1: the toxicology for the cause of death. Marsden had information
- 35:11Speaker 1: that Tammy may have been experiencing seizures or shaking. It
- 35:15Speaker 1: is extremely unusual for a 49-year-old woman to just spontaneously
- 35:19Speaker 1: develop seizures without a reason like a tumor, Marsden says.
- 35:23Speaker 1: Tammy's heart was structurally normal. It was the normal size
- 35:26Speaker 1: and all of her organs were normal as well. 8.51 a.m.
- 35:30Speaker 1: Marsden says cause of death was asphyxia. Manner of death, homicide.
- 35:35Speaker 1: There are five manners of death, natural, accident, suicide, homicide,
- 35:39Speaker 1: or cannot be determined. 8.52 a.m. Marsden has conducted 2,000
- 35:44Speaker 1: autopsies in her career. She separates asphyxia in four categories.
- 35:50Speaker 1: Exclusion of oxygen, choking, drowning, bag over face, neck compression, hanging,
- 35:55Speaker 1: chemical asphyxia, carbon monoxide poisoning, mechanical, something placed on the
- 35:59Speaker 1: chest that prevents breathing. 8.54 a.m. Marsden says the bruises
- 36:05Speaker 1: on Tammy's arms could be consistent with someone being restrained.
- 36:08Speaker 1: Blake asks if anything was done to determine the age
- 36:11Speaker 1: of the bruises. Marsden says samples of the bruises were
- 36:15Speaker 1: looked at under a microscope. All of the bruises were acute,
- 36:19Speaker 1: just bleeding, and no inflammatory response. This means the bruises
- 36:23Speaker 1: were paramortem bruises. They occurred within a few minutes to
- 36:27Speaker 1: a few hours of her death. 8.56 a.m. Marsden says
- 36:32Speaker 1: there was lividity on Tammy's body, on her back, and
- 36:35Speaker 1: posterior surfaces. 8.57 a.m. Blake asks the difference between a
- 36:40Speaker 1: coroner and a medical examiner. A medical examiner is a
- 36:44Speaker 1: forensic pathologist. Coroners are either elected or appointed. In some places,
- 36:49Speaker 1: coroners don't need any medical training. Idaho has a coroner system.
- 36:53Speaker 1: Utah has a medical examiner system. 9 a.m. When Marsden
- 36:58Speaker 1: determines whether or not to do an autopsy, additional factors
- 37:01Speaker 1: are considered like police reports, medical records, etc. 9.01 a.m.
- 37:07Speaker 1: Blake asks about rigor mortis, stiffening of the joints and
- 37:10Speaker 1: muscles of a body a few hours after death. The
- 37:13Speaker 1: stiffening starts in the smaller muscles and moves to the
- 37:16Speaker 1: larger muscles. 9.02 a.m. Blake asks if someone is described
- 37:21Speaker 1: as stiff and dead for a few hours, would she
- 37:23Speaker 1: expect bruises on the body from external factors? Marsden says
- 37:27Speaker 1: not at that point. 9.03 a.m. Marsden reviewed Tammy's medical records.
- 37:32Speaker 1: There was nothing to explain her sudden death and nothing
- 37:35Speaker 1: indicating seizures. There was nothing abnormal about possible low blood pressure.
- 37:40Speaker 1: Marsden says she would not expect someone with anemia to
- 37:43Speaker 1: just suddenly pass away. She would not expect someone using
- 37:47Speaker 1: homeopathic medicines to just suddenly pass away. And that's because people,
- 37:51Speaker 1: for the most part, are hardy, right? Folks aren't just
- 37:55Speaker 1: going to drop dead for no reason. Now, that doesn't
- 37:57Speaker 1: mean it doesn't happen. It most certainly does. But in
- 38:00Speaker 1: this case, zero chance that Tammy Daybell just happened to die. 9.04 a.m.
- 38:06Speaker 1: When a person dies, blood stops flowing through vessels. A
- 38:09Speaker 1: bruise is caused by the rupture of blood vessels beneath
- 38:12Speaker 1: the skin, so Marsden said a dead person cannot bruise
- 38:15Speaker 1: because there is no blood circulation. 9.06 a.m. Marsden says
- 38:19Speaker 1: there are a number of reasons seizures would be an
- 38:22Speaker 1: unlikely cause of her death. Most people who have seizure
- 38:24Speaker 1: disorder experience grand mal seizures. It's unlikely a woman of
- 38:30Speaker 1: Tammy's age would suddenly have one seizure and die. Yeah,
- 38:33Speaker 1: there's no doubt that if you're having an issue with seizures,
- 38:37Speaker 1: it's something that's going to be apparent. It doesn't just
- 38:39Speaker 1: come on one day and you drop dead from it,
- 38:42Speaker 1: especially after there's an autopsy and they look at what's
- 38:46Speaker 1: going on inside of you and they can't find anything.
- 38:49Speaker 1: So the whole entire Tammy Daybell died of natural causes.
- 38:53Speaker 1: That shit's DOA. 9.07 a.m. Blake is nothing further. Pryor
- 38:58Speaker 1: will now cross-examine. Pryor asks how long the exhumation took.
- 39:02Speaker 1: Marsden says two to three hours. She was present for
- 39:05Speaker 1: the exhumation, but not when she was reburied. She understood
- 39:09Speaker 1: that the court order required exhumation and burial on the
- 39:12Speaker 1: same day. Marsden did not see anyone from the family
- 39:16Speaker 1: who was present for the process. I have to tell you,
- 39:19Speaker 1: if my mom was being dug up, I'm showing up.
- 39:22Speaker 1: I'm going to be there, on the scene, present, and
- 39:25Speaker 1: I want to know what's going on. So I find
- 39:27Speaker 1: it baffling that these kids are just so willing to
- 39:29Speaker 1: trust what Chad has to say when the evidence is
- 39:32Speaker 1: pointing us in a completely different direction. 9-10 a.m. Pryor
- 39:37Speaker 1: asks about the suspicious circumstances Marsden was aware of. She
- 39:41Speaker 1: says the fact that the deceased husband has recently remarried
- 39:44Speaker 1: and the fact two children were missing. 9-11 a.m. Marsden
- 39:48Speaker 1: says Tammy's death was suspicious, mostly because it was a
- 39:51Speaker 1: healthy 49-year-old woman who died without any explanation. 9.12 a.m.
- 39:57Speaker 1: Marsden says she can't determine exactly when the bruises were
- 40:00Speaker 1: placed on the body and how they got there. Pryor
- 40:03Speaker 1: asks about heavy lungs. Marsden says microscopic examinations are done
- 40:08Speaker 1: of the lungs. Pryor asks if this was the first
- 40:10Speaker 1: autopsy Marsden has done outside of a lab environment. She
- 40:14Speaker 1: says no. She has done around 500 more. 9.15 a.m.
- 40:19Speaker 1: Pryor asks about her heart rhythm disorders and the phone
- 40:21Speaker 1: found in Tammy's airways. Pryor asks if the phone could
- 40:25Speaker 1: have caused the heart to stop. Marsden says, when you
- 40:28Speaker 1: have a sudden cardiac death, you don't have enough time
- 40:31Speaker 1: for the pulmonary edema to develop because your lungs essentially
- 40:35Speaker 1: stop at the same time the heart stops. And this
- 40:38Speaker 1: is all devastating testimony. This sort of testimony is sinking
- 40:41Speaker 1: Chad Daybell, or, as I like to say, digging that
- 40:44Speaker 1: hole even deeper. 9.19 a.m. Prior asks if in the
- 40:48Speaker 1: situation where a person dies, they could have an absolutely
- 40:51Speaker 1: healthy heart, lungs, organs, and yet the person could still die.
- 40:55Speaker 1: Marsden says that's correct. 9.20 a.m. Prior asks about the
- 40:59Speaker 1: notation on Tammy's medical records about her family having a
- 41:03Speaker 1: history of heart issues. Marsden says she recalls seeing that.
- 41:07Speaker 1: He inquires about the bruises on her arms and her chest. 9.21 a.m.
- 41:13Speaker 1: Prior asks if there was any damage to bones or
- 41:15Speaker 1: muscles involved. in Tammy's neck. There were not. There were
- 41:19Speaker 1: no signs that her neck had been squeezed. There was
- 41:21Speaker 1: no indication of chemical asphyxiation. Prior asked Marsden if she
- 41:25Speaker 1: did a cross-check to see if the essential oils or
- 41:28Speaker 1: homeopathic remedies could have caused medical issues. Marsden says most
- 41:32Speaker 1: of those substances have a very low chance of overdose.
- 41:36Speaker 1: There was no evidence at the scene that she was
- 41:38Speaker 1: overtaking any of them. 9.24 a.m. Prior asks about a
- 41:42Speaker 1: mechanical asphyxia. This could be like if someone was working
- 41:46Speaker 1: under their car and their car falls on their chest.
- 41:49Speaker 1: The person can no longer breathe. Pryor asks if they
- 41:52Speaker 1: checked under the fingernails or if there was any indication
- 41:55Speaker 1: of any sign of struggle. The bruises could indicate sign
- 41:58Speaker 1: of struggle, Marsden says. The fingers were cleaned prior to
- 42:01Speaker 1: burial and there was some mold growing on them. 9.27 a.m.
- 42:05Speaker 1: Pryor asks about the cause of death being a subjective
- 42:07Speaker 1: determination by her. Marsden says that's correct. Pryor asks what
- 42:12Speaker 1: medical record she reviewed. Marsden says she looked at primary
- 42:15Speaker 1: care and urgent care records from 2007 to 2019. She
- 42:20Speaker 1: never saw any treatment for low blood pressure. 9.28 a.m.
- 42:24Speaker 1: Pryor asks about what was found in Tammy's stomach. Marsden
- 42:27Speaker 1: says she had three and a half ounces of substance
- 42:30Speaker 1: that appeared to be potatoes and peanuts. Pryor has nothing further.
- 42:34Speaker 1: Blake will now redirect. 9.29 a.m. Blake asks if the
- 42:38Speaker 1: contents in the stomach tell you whether someone is thrown
- 42:41Speaker 1: up or not. Marsden says no. Blake asks if a
- 42:44Speaker 1: Big Mac appeared to be in Tammy's stomach. Marsden says no.
- 42:48Speaker 1: Blake asks about Tammy having dizzy or fainting spells. That
- 42:52Speaker 1: information was from the police report that contained information given
- 42:56Speaker 1: to them from Chad Daybell. 9.30 a.m. Blake asks Marsden
- 43:00Speaker 1: if she learned the missing kids were Chad's new wife's children.
- 43:03Speaker 1: She did. Blake asked if there were any signs of
- 43:06Speaker 1: a medical condition that would cause heavy lungs. Marsden says no.
- 43:10Speaker 1: The heavy lungs were the result of the cause of
- 43:12Speaker 1: deaths but not the cause of death, Marsden says. 9.32 a.m.
- 43:16Speaker 1: Tammy's records do not have any sign of young cardiac
- 43:19Speaker 1: deaths in her family that would indicate a genetic sign
- 43:23Speaker 1: of heart disease. Blake says if someone could asphyxiate someone
- 43:27Speaker 1: without leaving signs, Marsden says smothering with pillow, putting plastic
- 43:31Speaker 1: bag overhead, putting weight on chest, etc. 9.33 a.m. Blake
- 43:36Speaker 1: asks if the bruises could indicate there were more than
- 43:38Speaker 1: one person there. Marsden says yes. It could also indicate
- 43:42Speaker 1: someone kneeling on the chest and holding someone down. 9.34 a.m.
- 43:47Speaker 1: Blake has no further questions, but ends with one. In
- 43:50Speaker 1: your experience, do dead bodies roll out of bed? Marsden
- 43:54Speaker 1: says no. Pryor asks for recross, but Boyce says no.
- 43:58Speaker 1: The redirect did not go beyond the scope. 9.36 a.m.
- 44:02Speaker 1: The state calls their next witness, Rick Wright. Detective Ray
- 44:06Speaker 1: Hermosillo walks in and Pryor says, That looks like Officer Hermosillo.
- 44:10Speaker 1: Everyone laughs, Hermosillo leaves, and in walks Wright. 9.37 a.m.
- 44:15Speaker 1: Wright is a contractor special investigator for the FBI in Pocatello.
- 44:20Speaker 1: He was an FBI agent for 24 years. 9.41 a.m.
- 44:24Speaker 1: Wright explains his professional background and training. He has an
- 44:28Speaker 1: extensive career with the FBI. 9.42 a.m. Wright worked with
- 44:32Speaker 1: five agents in Pocatello. He focused on criminal work. Three
- 44:36Speaker 1: did criminal work. The other two did national security work.
- 44:40Speaker 1: Wright says the FBI was contacted by Rexburg police on
- 44:44Speaker 1: November 27, 2019, about a missing child named J.J. Vallow. 9.43 a.m.
- 44:50Speaker 1: The FBI assists in missing children because of the Federal
- 44:53Speaker 1: Kidnapping Act. When Rexburg police described the circumstances under which J.J.
- 44:57Speaker 1: was missing, it met the requirements of the FBI getting involved. J.J.
- 45:01Speaker 1: was seven at the time. 9.44 a.m. The FBI immediately
- 45:06Speaker 1: became involved in the investigation. It was classified as a
- 45:09Speaker 1: kidnapping in the beginning, and related investigations by other agencies
- 45:14Speaker 1: were also happening at the same time by Rexburg Police,
- 45:17Speaker 1: Fremont Sheriff, Gilbert Police, and the Chandler Police. 9.48 a.m.
- 45:22Speaker 1: A number of digital devices were recovered and turned over
- 45:25Speaker 1: to the FBI cellular analysis team. 9.52 a.m. Wright's investigation
- 45:30Speaker 1: focused on one of Alex Cox's devices. Wright requested that
- 45:34Speaker 1: Nick Balance, Look into the location information from the device
- 45:38Speaker 1: from September and October of 2019. 9.55am, morning recess, back
- 45:44Speaker 1: in 20. So like usual, this is where we're going
- 45:47Speaker 1: to take our break as well, and in the next
- 45:49Speaker 1: episode we'll pick up where we left off. All of
- 45:53Speaker 1: the information that goes with this episode can be found
- 45:56Speaker 1: in the description box. What's up everyone and welcome back
- 45:59Speaker 1: to the program. In this episode we're picking up where
- 46:02Speaker 1: we left off, with day number 23 of the Chad
- 46:05Speaker 1: Daybell trial. 10.30 a.m., back in court, and a presentation
- 46:11Speaker 1: is shown on the screen. This information came from Alex
- 46:14Speaker 1: Cox's cell phone and the Homer J. Maximus account via Wi-Fi, GPS,
- 46:20Speaker 1: and cell phone data. 10.34 a.m., the device associated to
- 46:25Speaker 1: Alex Cox first arrived in Rexburg on September 1, 2019.
- 46:30Speaker 1: The morning of the 1st, it was in St. George, Utah,
- 46:32Speaker 1: and then it moved at driving speed toward Rexburg, where
- 46:35Speaker 1: it arrived that evening. It went to an apartment complex,
- 46:38Speaker 1: Unit 175. It stayed at 175 until the evening of
- 46:43Speaker 1: September 5th, when it began to spend nights at apartment
- 46:46Speaker 1: number 107, his apartment. 10.37 a.m. We see a slide
- 46:51Speaker 1: that shows a series of activities on September 8th, 2019.
- 46:55Speaker 1: Alex's device was at the following locations. 11.32 a.m., Maverick
- 46:59Speaker 1: Gas Station on Main Street in Rexburg. 129 p.m. West
- 47:03Speaker 1: Entrance of Yellowstone National Park. 230 p.m. Old Faithful. 304
- 47:08Speaker 1: to 322 p.m. Old Faithful Lodge. 342 to 404 p.m.
- 47:14Speaker 1: Old Faithful Rim. 415 to 427 p.m. Old Faithful Parking Lot.
- 47:18Speaker 1: 512 p.m. South of Lewis Lake. 640 p.m. West Entrance
- 47:23Speaker 1: of Yellowstone National Park. 645 p.m. to 702 p.m. Buckaroo
- 47:28Speaker 1: Barbecue in West Yellowstone. 10.43 a.m. Surveillance video at the
- 47:33Speaker 1: park entrance caught Alex, Lori, Tylee, and JJ entering the park.
- 47:38Speaker 1: Blake shows a new slide that shows a satellite image
- 47:41Speaker 1: of the Old Faithful geyser, cafeteria, and the parking lot. 10.47 a.m.
- 47:46Speaker 1: The photo on the left was taken at 3.49 p.m.
- 47:49Speaker 1: at Old Faithful. This was the last known photo of Tylee.
- 47:53Speaker 1: And in this picture, it's Tylee holding JJ. And right
- 47:57Speaker 1: next to them is that beaver-faced loser Alex Cox. And
- 48:01Speaker 1: in the background, you see Old Faithful. But this is
- 48:04Speaker 1: the last known photo of Tylee. 10.49 a.m. Wright describes
- 48:09Speaker 1: a new slide that shows data points of Alex's travel
- 48:12Speaker 1: in Yellowstone. Wright says investigators were concerned that something may
- 48:16Speaker 1: have happened to Tylee in Yellowstone, and they were prepared
- 48:19Speaker 1: to conduct searches in the park for the missing teen.
- 48:23Speaker 1: Wright worked with the National Park Service to prepare potential
- 48:25Speaker 1: searches based on Alex's cell phone locations. 10.51 a.m. After Yellowstone,
- 48:31Speaker 1: the device went to Buckaroo Bill's BBQ from 6.45 to 7.02,
- 48:35Speaker 1: the apartment 175 in Rexburg from 8.37 to 9.35, the
- 48:38Speaker 1: Maverick in Rexburg from 9.43 to 9.53 p.m., the apartment
- 48:41Speaker 1: 175 in Rexburg from 10.44 to 11.15 p.m., and then
- 48:43Speaker 1: the apartment 107 in Rexburg at 11.44 p.m., 10.56 a.m.
- 49:00Speaker 1: Wright was trying to prepare a timeline of Tylee's activities
- 49:03Speaker 1: based on digital media, financial transactions, people who may have
- 49:07Speaker 1: seen her, etc. The last known location for Tylee was
- 49:11Speaker 1: at Apartment 175 in Rexburg at 8.37pm on September 8th. 11.01am
- 49:18Speaker 1: We now see an overhead satellite image showing the apartment complex.
- 49:22Speaker 1: Wright points out the apartments of Lori and Alex. There
- 49:25Speaker 1: are data points on the map that show where Alex's
- 49:27Speaker 1: device was the early morning hours of September 9th. 11.04am
- 49:33Speaker 1: On September 9th, Alex's device was tracked here. Approximately 9am
- 49:38Speaker 1: leaves the apartment and 107 in Rexburg, 9.15 a.m., arrives
- 49:42Speaker 1: at Chad Daybell's house, 9.15 a.m. to 11.45 a.m., in
- 49:47Speaker 1: the area of the Daybell residence, 9.21 a.m., behind Daybell residence, 9.22 a.m.,
- 49:53Speaker 1: by gate on northwest corner of property, 10.39 a.m., behind residence, 10.57 a.m.,
- 49:57Speaker 1: behind residence, 11.45 a.m., leaves residence, 11.52 a.m., Del Taco
- 49:59Speaker 1: in Rexburg. Nothing like, you know, working up an appetite
- 50:08Speaker 1: by killing some kids, huh? This sick, demented bastard. 1110 a.m.
- 50:14Speaker 1: We now see an overhead image of the Daybell property.
- 50:17Speaker 1: Wright points out where Alex's device was that morning. 1113 a.m.
- 50:22Speaker 1: The raccoon text is now on the screen. The message
- 50:25Speaker 1: that Chad sent to Tammy at 1153 a.m. Well, I've
- 50:29Speaker 1: had an interesting morning. I felt I should burn all
- 50:31Speaker 1: the limbed debris by the fire pit before I got
- 50:34Speaker 1: too soaked by the coming storm. While I did so,
- 50:37Speaker 1: I spotted a big raccoon along the fence. I hurried
- 50:40Speaker 1: and got my gun, and he was still walking along.
- 50:43Speaker 1: I got close enough that one shot did the trick.
- 50:45Speaker 1: He's now in our pet cemetery. Fun times. 11.16 a.m.
- 50:50Speaker 1: Wright points out the spot on the map where investigators
- 50:53Speaker 1: found Tylee Ryan buried near the fire pit. 11.17 a.m.
- 50:57Speaker 1: On Sunday, September 22, 2019, Alex Cox Device was here. 4.26 a.m.
- 51:05Speaker 1: To 5.08pm, apartment 175. 5.09 to 5.11pm, apartment 107. 5.12
- 51:07Speaker 1: to 6.45pm, apartment 175. 6.46 to 8.03pm, apartment 107. 8.04
- 51:09Speaker 1: to 8.09pm, apartment 175. 8.11 to 9.56pm, apartment 107. 11.21am
- 51:11Speaker 1: on Monday, September 23rd, 2019. Alex's device is here. 1211 a.m.
- 51:36Speaker 1: to 941 a.m. apartment 107. 941 a.m. to 955 a.m.
- 51:42Speaker 1: travels from apartment to Daybell's residence. 955 a.m. to 1012 a.m.
- 51:47Speaker 1: device in vicinity of Daybell residence. 955 a.m. front porch
- 51:52Speaker 1: of property near the garage. 956 a.m. by pond on property.
- 51:57Speaker 1: 1002 a.m. by pond on property. 1005 a.m. next to
- 52:01Speaker 1: the front of the house. 1007 a.m. near the front
- 52:04Speaker 1: of the house. 10.12 a.m. at intersection of Salem Road
- 52:08Speaker 1: and 200 North, headed south. 10.22 a.m. at apartment 175
- 52:13Speaker 1: in Rexburg. 11.29 a.m. Wright describes where the grave for J.J.
- 52:19Speaker 1: Vallow was found, on Chad's property, and near the tree.
- 52:23Speaker 1: Here is when Alex Device was at or around Chad's property. Friday,
- 52:27Speaker 1: September 6th. Monday, September 9th. Monday, September 23rd. And Wednesday,
- 52:32Speaker 1: September 25th. 11.30 a.m. Alex visited Dan's window tinting on Monday,
- 52:39Speaker 1: September 23rd at 1.53 p.m. after the device was at
- 52:43Speaker 1: the Daybell home and on Wednesday, September 25th at 9.02 a.m.
- 52:48Speaker 1: and 11.57 a.m. 11.33 a.m. We now see an image
- 52:53Speaker 1: of Tylee's Jeep. Wright says it was used in connection
- 52:56Speaker 1: to the attempted shooting of Brandon Boudreau. There were two
- 52:59Speaker 1: receipts inside of the Jeep to lost favorites in Mesa, Arizona.
- 53:04Speaker 1: on October 1, 2019, at 1.12 p.m., and a Chick-fil-A
- 53:08Speaker 1: in Ammon, Idaho, on October 18, 2019, at 8.05 p.m. 11.35 a.m.
- 53:16Speaker 1: The photos on the screen show the Jeep windows were tinted.
- 53:19Speaker 1: Alex got a prepaid cell phone from Walmart in Idaho
- 53:22Speaker 1: Falls on September 25. It was associated with the Homer J.
- 53:26Speaker 1: Maximus account. On Tuesday, October 8, another prepaid phone was
- 53:30Speaker 1: purchased from Walmart in Rexburg. And all of this is
- 53:34Speaker 1: just building that foundation that they told us they were
- 53:37Speaker 1: going to build. They have a complete digital makeup of
- 53:41Speaker 1: what Alex Cox was up to, where he was, where
- 53:44Speaker 1: his phone was located, and I'm telling you right now,
- 53:48Speaker 1: all of this is going to lead to a conviction.
- 53:51Speaker 1: I feel like everything we're doing now, we're just going
- 53:53Speaker 1: through the motions because I don't see how Chad Daybell
- 53:57Speaker 1: or his team thinks that they're going to be able
- 54:00Speaker 1: to challenge all of the evidence that we have already seen.
- 54:03Speaker 1: And for me at this point, it's not a matter
- 54:06Speaker 1: of if he's going to be convicted, it's when. 11.43 a.m.
- 54:11Speaker 1: Blake moves to admit the receipts showing the phones were
- 54:14Speaker 1: purchased at Walmart. 11.48 a.m. Right work with FBI analyst
- 54:19Speaker 1: Nick Balance, who testified yesterday in putting together all of
- 54:22Speaker 1: the cell phone data. The only time Alex's phone stayed
- 54:25Speaker 1: at Lori's apartment all night was on September 30th. Through
- 54:28Speaker 1: October 1st and October 2nd, the attempted shooting of Brandon
- 54:32Speaker 1: Boudreau was on October 2nd in Arizona. The device did
- 54:36Speaker 1: not leave Idaho during that time period. September 27th, 2019, 3.54
- 54:40Speaker 1: to 6.45, Unified Sportsman's Gun Club. September 26th, 2019, 4.54
- 54:42Speaker 1: to 6.58 PM, Unified Sportsman's Gun Club. September 3rd, 2019, 1.45
- 54:44Speaker 1: to 1.46 PM, Unified Sportsman's Gun Club. 2.05 to 2.36 PM, Walmart.
- 54:47Speaker 1: 259 to 451, Unified Sportsman's Gun Club. 11.53 a.m. We
- 55:09Speaker 1: now see a GPS photo of the gun range, and
- 55:11Speaker 1: Wright plots out Alex Cox's movements on Saturday, September 28, 2019,
- 55:16Speaker 1: where he stayed for two and a half hours. 11.56 a.m.
- 55:20Speaker 1: Lunch is called, but we're just going to power through. 1.05 p.m.
- 55:24Speaker 1: We're back in the courtroom. Blake continues questioning Wright about
- 55:27Speaker 1: location data he examined in regards to Alex Cox's device
- 55:31Speaker 1: at the gun range. 106 p.m. Alex device went to
- 55:34Speaker 1: the Fremont County Sportsman Club shooting range at three different
- 55:38Speaker 1: times on October 7th. The device also went to the
- 55:41Speaker 1: Unified Sportsman's Club the next day. On October 8th, the
- 55:45Speaker 1: device went to both shooting ranges in the morning. 109 p.m.
- 55:49Speaker 1: On October 12th and 13th, the device went to the
- 55:52Speaker 1: Fremont County Sportsman Club shooting range. It was there for
- 55:55Speaker 1: around two hours each of those days. 110 p.m. The
- 55:59Speaker 1: device went to the Fremont shooting range on October 15th
- 56:02Speaker 1: in the morning and then again in the evening. The
- 56:05Speaker 1: device also went back and forth between Alex and Lori's apartment,
- 56:09Speaker 1: and there was a stop at Chad Daybell's house for
- 56:11Speaker 1: 15 minutes in the afternoon, 1.13 p.m. We now see
- 56:15Speaker 1: an overhead map of Sportsman's Warehouse in Ammon, Idaho. This
- 56:18Speaker 1: shows data points inside the store where Alex's device was located.
- 56:23Speaker 1: Wright retrieved receipts from Sportsman's Warehouse that showed camo pants, gloves,
- 56:27Speaker 1: a Dr. Pepper, and other items were purchased with cash. 1.21 p.m.
- 56:32Speaker 1: A camouflage beanie was purchased. We see a slideshow that
- 56:35Speaker 1: shows large mitt fingerless gloves bought at the store. A
- 56:39Speaker 1: dark gray three-hole ski mask was also purchased. 1.26 p.m.
- 56:44Speaker 1: A FrogTog brand black pair of rain pants was also purchased.
- 56:48Speaker 1: Warrant showed the Homer J. Maximus account search for FrogTog
- 56:52Speaker 1: sizing for pants on Google. 1.27 p.m. Pants found at
- 56:57Speaker 1: the apartment complex matched the pants on the receipt. On
- 57:00Speaker 1: October 9, 2019, Alex's device was in the vicinity of
- 57:04Speaker 1: Daybell's residence from 4.50 to 5.03 p.m., but didn't seem
- 57:09Speaker 1: to stop, Wright says. The device was then at apartment
- 57:12Speaker 1: 107 from 5.16 to 11.53 p.m. 1.32 p.m. Blake displays
- 57:19Speaker 1: GPS maps showing where Alex's device was located near the
- 57:23Speaker 1: Daybell residence on the evening of of October 9th, 2019.
- 57:27Speaker 1: There aren't a lot of places for a vehicle to
- 57:29Speaker 1: pull off on a road running near the house, but
- 57:32Speaker 1: there is one spot near a canal. That's where Alex's
- 57:35Speaker 1: device registered a data point. 1.37 p.m. Alex Cox's device
- 57:40Speaker 1: was at Walmart the same time a new device was
- 57:43Speaker 1: purchased on October 8th. The new device was activated the
- 57:46Speaker 1: next day on October 9th, and there were 10 text
- 57:49Speaker 1: messages between the new device and Chad Daybell between 7.13 p.m.
- 57:54Speaker 1: and 10.30 p.m. 1.39 p.m. Alex's device takes a trip
- 57:59Speaker 1: to Hurricane Utah on October 16th and 17th. The device
- 58:03Speaker 1: is at the Las Vegas airport. On October 18th, the
- 58:06Speaker 1: device is back in Rexburg in the apartments. Lori flew
- 58:09Speaker 1: to Hawaii on October 17th. 1.42 p.m. On October 18th,
- 58:15Speaker 1: Alex's device was at Chick-fil-A in Amman from 7.58 to 9.32 p.m.
- 58:20Speaker 1: The device was then at the Salem Church in From 10.07
- 58:23Speaker 1: to 10.45 p.m., the next data point is on U.S.
- 58:27Speaker 1: Highway 20 in Rexburg. 1.49 p.m., we see an overhead
- 58:31Speaker 1: GPS image of the LDS Church building in Salem. Alex
- 58:35Speaker 1: Device was there from 10.07 to 10.45 p.m. on Friday,
- 58:39Speaker 1: October 18th. 1.52 p.m., Blake has no further questions. Pryor
- 58:44Speaker 1: will now cross-examine. 1.56 p.m., Pryor asks who was present
- 58:49Speaker 1: at the search of Daybell's property In January 2020, Wright
- 58:53Speaker 1: says multiple investigators were at the home. The sheriff's office
- 58:57Speaker 1: collected 43 items at the time. 1.58 p.m. Pryor asks
- 59:01Speaker 1: if Wright was present when the Rexburg apartments were searched.
- 59:05Speaker 1: He was not. Prior asks about items seized during that
- 59:08Speaker 1: search and who was the lead detective on the case.
- 59:10Speaker 1: Detective Ray Hermosillo and Detective Ron Ball were leading the
- 59:14Speaker 1: case for Rexburg police. Prior asks about the Yellowstone trip.
- 59:20Speaker 1: He shows the cell phone activity of Alex's device in
- 59:23Speaker 1: the Old Faithful area of the park. Wright walks through
- 59:26Speaker 1: the movement of the device and notes the data show
- 59:29Speaker 1: nothing of significance during the trip. 2.10 p.m. Pryor asks
- 59:34Speaker 1: follow-up questions about data points and the accuracy of the
- 59:37Speaker 1: device movement. 2.12 p.m. Pryor asks about the margin of
- 59:40Speaker 1: error on the data points. We will now take an
- 59:43Speaker 1: afternoon recess back in 20 to 30 minutes. 2.42 p.m.
- 59:47Speaker 1: We're now back in the courtroom, and the jurors are
- 59:50Speaker 1: in their seats. Pryor shows a slide showing Alex's device
- 59:53Speaker 1: placements on September 8th and 9th. 2.45 p.m. Pryor asks
- 59:58Speaker 1: where Alec's phone was between 1144 p.m. and 242 a.m.
- 1:00:03Speaker 1: on September 8th and 9th. Wright doesn't recall, but believes
- 1:00:07Speaker 1: it's in his report. Pryor asks for him to review
- 1:00:09Speaker 1: the report. Bailiff takes him the report. 246 p.m. There
- 1:00:14Speaker 1: were data points until 1155 p.m. on September 8th in
- 1:00:18Speaker 1: Unit 107. There were more data points in the same
- 1:00:21Speaker 1: apartment going into September 9th. 2.48 p.m. As Wright testifies,
- 1:00:26Speaker 1: Chad Daybell is typing on the computer and scrolling on
- 1:00:29Speaker 1: the computer in front of him. 2.52 p.m. Pryor reviews
- 1:00:33Speaker 1: the activity on Alex's device on September 9th. There are
- 1:00:36Speaker 1: gaps in the timeline, and Wright is unable to say
- 1:00:39Speaker 1: where Alex's device was during the gaps. Pryor puts up
- 1:00:42Speaker 1: a GPS map showing the Daybell property. There is a
- 1:00:45Speaker 1: long driveway behind the residence. 2.58 p.m. Pryor asks Wright
- 1:00:50Speaker 1: who is living at the Daybell residence on September 9th.
- 1:00:53Speaker 1: To his knowledge, it was Chad, Tammy, and Garth. He
- 1:00:56Speaker 1: asked Wright if he knows their work schedules. Wright was
- 1:00:59Speaker 1: aware that Tammy worked at the school and worked school
- 1:01:02Speaker 1: hours on weekdays. Garth had two jobs. 3 p.m. Pryor
- 1:01:07Speaker 1: asked if Wright was familiar with Chad's habit of going
- 1:01:09Speaker 1: to the Salem Church or BYU-Idaho. Wright was not aware
- 1:01:13Speaker 1: of Chad's schedule. Pryor asked what vehicle Alex drove to Yellowstone.
- 1:01:17Speaker 1: He responds it was a silver-gray Ford F-150 pickup truck. 3.01 p.m.
- 1:01:23Speaker 1: Pryor asks if Wright was involved in chemical testing at
- 1:01:26Speaker 1: the apartments in Rexburg. He says the evidence response team
- 1:01:30Speaker 1: went to the apartment at one time and took swabs
- 1:01:32Speaker 1: of an unknown substance. He doesn't know the results of
- 1:01:35Speaker 1: the testing. 3.02 p.m. Pryor asks how many times Alex
- 1:01:39Speaker 1: was at or near the property between September and November.
- 1:01:42Speaker 1: Seven times total, four times in September, and three times
- 1:01:46Speaker 1: in October. 3.03 p.m. Pryor shows the raccoon text on
- 1:01:50Speaker 1: the screen. He asks Wright if anyone heard a gunshot
- 1:01:52Speaker 1: in the area. Wright believes some of the neighbors were
- 1:01:55Speaker 1: spoken to, but the police didn't have this text until
- 1:01:58Speaker 1: eight months later. Animal remains were found with the human remains.
- 1:02:02Speaker 1: Wright doesn't recall what type of animals were found in
- 1:02:05Speaker 1: the pet cemetery. There seemed to be at least one
- 1:02:07Speaker 1: animal near where Tylee's remains were found. 3.06 PM. Pryor
- 1:02:12Speaker 1: shows the slide displaying Alex's device activity on September 22nd.
- 1:02:17Speaker 1: Pryor asks who was staying at Lori's apartment on that day.
- 1:02:20Speaker 1: Wright is aware J.J. Vallow was at the apartment, and
- 1:02:23Speaker 1: so were Melanie Gibb and David Warwick. 3.12 p.m. Pryor
- 1:02:27Speaker 1: asks Wright if he looked into any correspondence between Lori,
- 1:02:30Speaker 1: Melanie Gibb, and David Warwick from the early morning hours
- 1:02:34Speaker 1: of September 22nd. Wright says he did not, but believes
- 1:02:38Speaker 1: other investigators did. Pryor asks to publish an exhibit. 3.13pm.
- 1:02:43Speaker 1: The exhibit is shown on the screen. It's from September 23rd,
- 1:02:47Speaker 1: 2019 at 4.39am UTC time. It appears to be a
- 1:02:52Speaker 1: message from Melanie Gibb to Lori. We sent this to
- 1:02:54Speaker 1: Chad about 2 this morning. David woke up with great
- 1:02:57Speaker 1: pain and sorrow in his heart. He felt something big
- 1:03:00Speaker 1: was going to happen. It was going to happen now
- 1:03:03Speaker 1: or soon. Please call when you can. Maybe you can
- 1:03:06Speaker 1: help him understand it. Whatever it was, it was immediate.
- 1:03:09Speaker 1: He can't get to these people and there's nothing he
- 1:03:12Speaker 1: could do for them. 3.18 p.m. Pryor asks Wright if
- 1:03:16Speaker 1: he knows where J.J. Vallow was on the evening of
- 1:03:18Speaker 1: September 22nd. Wright says he has heard from reports that J.J.
- 1:03:23Speaker 1: was with Alex that night. 3.20 p.m. Pryor asks if
- 1:03:27Speaker 1: there was any electronic information or evidence that Chad Daybell
- 1:03:30Speaker 1: was at his property on September 23rd at 9.41 a.m.
- 1:03:34Speaker 1: Wright reviewed no information showing Chad's whereabouts that morning. 3.22 p.m.
- 1:03:40Speaker 1: Pryor asks Wright to point to the garage on a
- 1:03:42Speaker 1: GPS map and asks the distance from the garage to
- 1:03:45Speaker 1: the barn in the back. Wright doesn't know the exact
- 1:03:48Speaker 1: size of the property, but he believes it's at least
- 1:03:50Speaker 1: 100 yards. 3.24 p.m. Pryor asks Wright if he's familiar
- 1:03:56Speaker 1: with the shallow grave where JJ was found. Wright is aware. 3.26 p.m.
- 1:04:02Speaker 1: Pryor reviews the timeline of data points where Alex Cox's
- 1:04:04Speaker 1: phone was tracked on the Daybell property on September 23rd, 3.27 p.m.
- 1:04:10Speaker 1: Pryor has nothing further today. He will continue cross-examining the
- 1:04:14Speaker 1: witness tomorrow. Judge Boyce calls for a recess. All right,
- 1:04:18Speaker 1: so there it is. Another day and another terrible one
- 1:04:22Speaker 1: at that for Chad Daybell. And the way things are going,
- 1:04:25Speaker 1: I can hear the helicopter gassing up now and looking
- 1:04:28Speaker 1: for the volcano that this dude's going to get tossed in.
- 1:04:31Speaker 1: Because there's no doubt in my mind that when all
- 1:04:33Speaker 1: is said and done, not only is he going to
- 1:04:35Speaker 1: be convicted, but he's going to get the death penalty.
- 1:04:38Speaker 1: And he deserves it, in my opinion. Anytime you murder anyone,
- 1:04:42Speaker 1: it's vile. But when you start murdering children, that's next
- 1:04:45Speaker 1: level shit. And if the death penalty is on the books,
- 1:04:48Speaker 1: then it should be applied to somebody who's going to
- 1:04:51Speaker 1: murder children. And hopefully when this is all said and done,
- 1:04:54Speaker 1: we see that for Chad Daybell. But until that glorious day...
- 1:04:58Speaker 1: That's going to do it for this one, and all
- 1:05:00Speaker 1: of the information that goes with this episode can be
- 1:05:02Speaker 1: found in the description box.
