- 1:16Speaker 3: beautiful and fully.
- 1:18Speaker 4: Authentic in Christ.
- 1:20Speaker 3: So I wrote this book because too many people are
- 1:23Speaker 3: serving publicly but struggling privately with their identity and between
- 1:30Speaker 3: their title and who they are as a person. So
- 1:34Speaker 3: God even asked me a life changing question, who are
- 1:38Speaker 3: you when no one's watching? And that question transformed me
- 1:41Speaker 3: and I believe it can transform you to Now I
- 1:44Speaker 3: help others find healing and wholeness behind their titles and
- 1:48Speaker 3: their roles. So I ask you, when the anointing lifts,
- 1:52Speaker 3: who are you? Are you whole or hiding? Reflect on
- 1:56Speaker 3: that and share using hashtag one hundred author's voices. Let's
- 2:01Speaker 3: talk about living free and authentic, not just functioning in ministry.
- 2:06Speaker 3: So if this resonates, just visit me at y'all PUBLISHINGLLC

- 12:18Speaker 2: I appreciate less and the Thomas Smith for allowing us
- 12:21Speaker 2: this opportunity man to Dave, to have our voices heard
- 12:24Speaker 2: like this, So thank you very much. Man.
- 12:26Speaker 7: Yes, you know, without Angela giving us this space to
- 12:31Speaker 7: be a voice to speak out for the men and
- 12:35Speaker 7: women that's wrong, hopefully incarcerated over sentenced, have medical addition
- 12:43Speaker 7: issues going on with inside the prison system. You know,
- 12:50Speaker 7: our voices wouldn't be heard, you know, So I heard
- 12:55Speaker 7: that our voices was heard over there in Texas, in
- 12:59Speaker 7: at the unit that you're currently on.
- 13:03Speaker 4: What's going on over there?
- 13:06Speaker 1: Well, yes, ma'am, I would like to say that. In
- 13:09Speaker 1: the Aspine author's magazine Man, the January twenty twenty five
- 13:13Speaker 1: issue value number one, Man Missus angelas Thomas Smith, she
- 13:18Speaker 1: plays an artic goal satisfied as urgent appeal addressing unsanitary
- 13:23Speaker 1: conditions at the Stabian Deal the Minga stay jail, and
- 13:28Speaker 1: in this magazine Man miss outlines everything regard an unsanitary
- 13:32Speaker 1: living conditions because the inmates over here were complaining of
- 13:37Speaker 1: having only one parlet, one shower, no cold water food
- 13:42Speaker 1: chase being Washington cold slopping water Man, and the conditions
- 13:46Speaker 1: over here were very horrible, Man. And you know it
- 13:49Speaker 1: says that it may have reported it been subjected as
- 13:52Speaker 1: to deplorable conditions including only one functional shower of proctor
- 13:58Speaker 1: regtiate individuals. Situation is a celebrated to their prominent issues
- 14:04Speaker 1: which SWT backing up from the college and furnerals and
- 14:08Speaker 1: uh leaks from the ceiling, rendering the environment unsanitary and
- 14:12Speaker 1: un hypertension. Such conditions can promise the health and dignity
- 14:17Speaker 1: of enemies stripped them of basic human rights and resect
- 14:22Speaker 1: the state of despair that's the kill is the longer
- 14:25Speaker 1: and unacceptable. It is crucial that comprehendis and sections, their
- 14:30Speaker 1: comprehensive inspections are carried out by independent organizations to assert
- 14:35Speaker 1: the violations occurring.
- 14:36Speaker 2: Behind the walls. Immedia and INDEPENDI is required not only
- 14:41Speaker 2: to address these pernicious conditions, but also to ensure that
- 14:45Speaker 2: the state are designated for incorcerations uphold at least the
- 14:49Speaker 2: minimum standards of human rights and defence. Well.
- 14:54Speaker 1: Because of this article, man Uh, each of the state representatives,
- 15:00Speaker 1: director of TDC, the director of the Rehabilitation Division, everybody
- 15:05Speaker 1: that's responsible for these overseeing of the prison systems.
- 15:10Speaker 2: They can't over here.
- 15:11Speaker 1: Because the demin gets stay there. Felay do it man
- 15:14Speaker 1: this past week and they have made sure that they
- 15:18Speaker 1: see everything that has been complained about within this magazine.
- 15:24Speaker 1: So they got brand new sixty five TV, they got
- 15:28Speaker 1: brand new window panes, they got brand new shallows off,
- 15:31Speaker 1: they got brand new think, they got brand new tarlets
- 15:35Speaker 1: and they're turning the reacilitation division into in this tenant dorm,
- 15:40Speaker 1: each individual will in here. So with that, man, I
- 15:44Speaker 1: can say, man that we'll appreciates the thomass of advocacy
- 15:49Speaker 1: and we'll appreciate you for your afficacy.
- 15:51Speaker 2: Man. So yes, the issues within the demeanes they death
- 15:55Speaker 2: Felay has been had dressed.
- 15:57Speaker 9: Man.
- 15:57Speaker 2: So thank you very much man for that.
- 16:01Speaker 7: That's that's that's the power of being a voice and
- 16:08Speaker 7: also the power of a pinion.
- 16:12Speaker 4: Conversation. Hey, how are you all right?
- 16:22Speaker 9: Is this mister d S.
- 16:26Speaker 7: How are you doing, mister DZ. That's good, that's good. Yeah,
- 16:33Speaker 7: we was having a little trouble with the mike at first,
- 16:38Speaker 7: but we're good. Mister Legate is gonna call in at
- 16:42Speaker 7: five thirty, so, well, we don't get in with you tonight.
- 16:47Speaker 7: We're gonna welcome you back to let's talk about it.
- 16:53Speaker 7: I also have Cornell, which is the co host over
- 16:58Speaker 7: here as well. I don't know if you have ever
- 17:02Speaker 7: met mister if you had ever met Cornell, well, mister DS,
- 17:11Speaker 7: this is my co host, mister Cornell. Cornell, this is
- 17:15Speaker 7: mister d S. And uh, let's talk about it. So
- 17:19Speaker 7: mister Diz, let us know what you want to talk
- 17:24Speaker 7: about this evening.
- 17:27Speaker 8: I wanted to talk about it. H conviction committed and
- 17:32Speaker 8: they gave me an extensive time of thirty one years.
- 17:37Speaker 8: And I've been trying to go with the court and
- 17:40Speaker 8: everything like that, and there's no way not I don't
- 17:43Speaker 8: have no reason too much to get out there, and I.
- 17:47Speaker 2: Want to hear my story.
- 17:50Speaker 4: Uh, let me see what's gonna The third party calls
- 17:56Speaker 4: are alloud.
- 17:58Speaker 2: Well you know.
- 18:02Speaker 7: That right there, they be listening in and they and
- 18:06Speaker 7: it's hard for the men to get their get their
- 18:11Speaker 7: voices hurt. And that's another reason why I lend my
- 18:16Speaker 7: voice for them to to get their stories out. As
- 18:23Speaker 7: you was hearing, I don't know if you guys was
- 18:24Speaker 7: able to hear that he was wrongfully convicted. And then
- 18:28Speaker 7: all of a sudden they said no third party calls.
- 18:32Speaker 7: But it's not a third party call. They just don't
- 18:37Speaker 7: want their cases being hurt. They just really they just
- 18:42Speaker 7: want free labor out of them. And from what me
- 18:47Speaker 7: and him been talking about, a restraining order and he
- 18:51Speaker 7: gets thirty some years for a restraining order. I can't
- 18:58Speaker 7: wait for you guys to hear his story Cornell. Do
- 19:02Speaker 7: you know, I know I sent you his case. Do
- 19:06Speaker 7: you know a little about his case that what can share?
- 19:11Speaker 2: Well, yes, Sam I do, ma'am.
- 19:14Speaker 1: Alec Diaz was convicted of they classify as assault and
- 19:18Speaker 1: family violence and mister Dis was sentius to thirty one
- 19:23Speaker 1: years behind boss for the assault. And according to mister Dis,
- 19:28Speaker 1: he was complaining of the fact that the courts failed
- 19:31Speaker 1: to notify him about the day of a protective all
- 19:35Speaker 1: of hearing and that this thing is to notify him
- 19:39Speaker 1: interfear with his.
- 19:40Speaker 2: Rights to defend himself against.
- 19:41Speaker 1: The allegations against him, and that the allegants against him.
- 19:46Speaker 1: He said that these allegations of false allegations and that
- 19:49Speaker 1: he still to be you know, indicated from these allegations. Well,
- 19:55Speaker 1: the state is saying that mister Died did receive a
- 19:58Speaker 1: copy of the protective all and that it was up
- 20:01Speaker 1: to him to ensure that whatever issues he was related to,
- 20:07Speaker 1: whatever issues he was concerned about, the recording the order,
- 20:09Speaker 1: that it was his responsibility to make sure that you know,
- 20:12Speaker 1: he did a hearing. They through his representation of his attorney. Well,
- 20:17Speaker 1: he complained that his attorney failed to you know, do
- 20:21Speaker 1: his job, you know, to make sure that these issues
- 20:24Speaker 1: were related before the court, and his attorney.
- 20:29Speaker 2: Was trying to get his take back up in there
- 20:31Speaker 2: to whatever means necessary.
- 20:34Speaker 9: Will it see units this call is being recorded and
- 20:37Speaker 9: its subject to monitoring. To accept this free call, press
- 20:40Speaker 9: the one to reduce this free calls, press too to
- 20:44Speaker 9: thank you for using Curius. You may start the conversation now.
- 20:49Speaker 7: Okay, so we're back. So they said they hit you
- 20:52Speaker 7: with a third party call. So yeah, we already know
- 20:57Speaker 7: that it's hard for you guys to get your your
- 21:00Speaker 7: stories out there. So let's continue on, miss go ahead,
- 21:13Speaker 7: mister Das.
- 21:16Speaker 2: Oh yeah, I went off.
- 21:17Speaker 10: That's what I said.
- 21:22Speaker 4: Excuse me, Okay, we're we're listening.
- 21:27Speaker 1: We're losing, Okay.
- 21:31Speaker 2: I had I was out. I was up in the
- 21:34Speaker 2: world in in twenty sixteen. I had just came out
- 21:39Speaker 2: out of president from another another sement that I had did.
- 21:43Speaker 2: And when I came out of sixty sixteen, I was
- 21:45Speaker 2: having altercations with somebody because the mother of my kids
- 21:49Speaker 2: had an affair while I was locked up. That's how
- 21:52Speaker 2: everything started. That's how all this started. And the mother
- 21:56Speaker 2: of my kids had a new new baby, dad anyone,
- 22:01Speaker 2: and he told her to get me locked up because
- 22:04Speaker 2: she wanted me out of the way, and so she
- 22:07Speaker 2: put a protective order against me and said that I
- 22:09Speaker 2: had went over there and that I had bothered her.
- 22:12Speaker 2: And I never did go over there. And then I
- 22:15Speaker 2: went to court and they told me that she told
- 22:19Speaker 2: me that she didn't want to go do with it,
- 22:20Speaker 2: so we didn't go do with it. I went to court,
- 22:23Speaker 2: she didn't show up, and they rescheduled it, and then
- 22:27Speaker 2: all of a sudden, I never knew nothing else about it.
- 22:29Speaker 2: I was they want my number and everything like that,
- 22:31Speaker 2: and then they.
- 22:35Speaker 10: They never called me.
- 22:36Speaker 2: They never gave me, no no notice or anything for
- 22:39Speaker 2: me to appear at court. So I guess I thought
- 22:42Speaker 2: that the issue was sooking care of. And then all
- 22:45Speaker 2: of a sudden I ended up doing a shop flipping
- 22:49Speaker 2: and I ended up finding out that I have the
- 22:51Speaker 2: one for my arrest. And when I find out I
- 22:55Speaker 2: have a one for my arrest, they tell me I
- 22:58Speaker 2: was wanting for h violation of a restraining order of
- 23:05Speaker 2: a protective order by committing assault. And the truth I
- 23:12Speaker 2: took you to trial because I knew that I didn't
- 23:14Speaker 2: do it, and my my attorney felt to bring my.
- 23:18Speaker 10: Evidence to trial.
- 23:20Speaker 2: So I have every evidence, says back to white, that
- 23:24Speaker 2: shows that I did not commit the crime. My vehicle
- 23:29Speaker 2: was read August August third, and I was hit on
- 23:32Speaker 2: the driver sacked door, and August six I took out
- 23:36Speaker 2: my driver sacked door and never put it back on,
- 23:41Speaker 2: and I left the trunk part August nineteen, I left
- 23:44Speaker 2: my fo my rented my tires, and my brothers took
- 23:50Speaker 2: me to go from my writing desire. So I never
- 23:52Speaker 2: jumped in the turn van. And they they claimed that
- 23:57Speaker 2: I did this this crime on August on September tenth,
- 24:03Speaker 2: at eleven o'clock at night, the same in the same vehicle,
- 24:07Speaker 2: which the vehicle have been inoperabat ever since August nineteenth,
- 24:11Speaker 2: August third. And you know now they gave me.
- 24:17Speaker 10: I took it a trial and my thirty.
- 24:19Speaker 2: So to bring my evidence support, which was my cell
- 24:21Speaker 2: phone to show the proof of sixth messages and recorded messages,
- 24:27Speaker 2: and they gave me thirty one years. And this right
- 24:32Speaker 2: here has attected from me being able to have a
- 24:36Speaker 2: relationship with my kids that I have not had quite
- 24:40Speaker 2: a while. And I've already been gone, already had already
- 24:46Speaker 2: done eight and a half years on the thirty one year,
- 24:49Speaker 2: not a Senate for a violation of a little ticket
- 24:53Speaker 2: board that I did not have to make.
- 24:56Speaker 4: Look, I would like to jump in right quick.
- 25:00Speaker 2: What is.
- 25:02Speaker 7: For violating a protective order in Texas? What is this sentencing?
- 25:10Speaker 7: Is it thirty one years? Or you know how much
- 25:13Speaker 7: time can you get off of violating a protective order?
- 25:20Speaker 2: Honestly don't know how much signing to get for that.
- 25:23Speaker 2: But they gave me so much science because they hit
- 25:26Speaker 2: me with a high victual. They touched me with a
- 25:29Speaker 2: high visual and a trial, and so the DA asked
- 25:35Speaker 2: for fifty nine years because I went to trial by
- 25:38Speaker 2: by judge, I mean trial by jury and sentenced by judge,
- 25:43Speaker 2: and the DA asked for sixty nine years, no less
- 25:47Speaker 2: to fifty one when they found me guilty. And they
- 25:52Speaker 2: just was the one that gave me the thirty one
- 25:54Speaker 2: because he said that they didn't seem like an accessible
- 26:00Speaker 2: clients for that much of a frenishment for twenty nine years.
- 26:05Speaker 2: But since I had just got out that, I guess
- 26:10Speaker 2: I haven't earned my next cold to keep them thirty one.
- 26:14Speaker 7: I'm gonna go ahead and let my co host Cornell
- 26:17Speaker 7: jump in. Cornell, do you want to you have anything.
- 26:21Speaker 2: Well, I guess, ma'am. I'm looking at his case right now. Man, Okay, Yes,
- 26:25Speaker 2: he's correct.
- 26:25Speaker 1: They enhanced him based up from two poor family convictions.
- 26:29Speaker 4: Man.
- 26:29Speaker 1: And with that here in Texas, that santiplied you as
- 26:32Speaker 1: a hot fish bull, which means that his time starts
- 26:35Speaker 1: that twenty five ninety nine to life.
- 26:38Speaker 2: Okay.
- 26:38Speaker 1: Now, because the offense committed by itself, if it was acclivated,
- 26:42Speaker 1: it's a second degree pelapment, Okay. If it's enhanced, it
- 26:46Speaker 1: goes to a first degreevelament. So under circumstances, yes, they
- 26:51Speaker 1: enhanced him with this offense. So now he's saying that
- 26:55Speaker 1: you know he did not commit this offense, man, okay.
- 26:58Speaker 1: And because he did not commit at the office, the
- 27:00Speaker 1: evidence proof that he didn't commit the offense. And for
- 27:03Speaker 1: whatever circumstances leading up to the fact that he didn't
- 27:06Speaker 1: commit the offense, his lawyer presented that evidence and the
- 27:09Speaker 1: court still found him guilty. Now, he said that he went.
- 27:13Speaker 2: To a jury for the evidence to be considered, and
- 27:17Speaker 2: he went to the judge for the punishment to be assessed.
- 27:20Speaker 2: In this case, the judge in his case is mister
- 27:23Speaker 2: Stephens C. He'll be and mister Steven C. Hill Big
- 27:27Speaker 2: is one of the district attorneys from the nineteen nineties,
- 27:30Speaker 2: man who actually ran an evidence diction scandal to which
- 27:35Speaker 2: I myself is a party two. And he just now
- 27:40Speaker 2: coming back from the Court of Appeals as a judge
- 27:43Speaker 2: to go kill.
- 27:43Speaker 1: The one hundred and eighty seven district court to which
- 27:46Speaker 1: mister Died was propecuted in. Now, I don't know if
- 27:49Speaker 1: mister Died is a lawyer, is a farmer assistant district
- 27:52Speaker 1: attorney under these circumstances, but I was looking at his
- 27:57Speaker 1: name and uh in this case, and I'm thinking that
- 28:01Speaker 1: he is. He's a former assistant district attorney.
- 28:05Speaker 2: Matter of third, he is now the district attorney over
- 28:09Speaker 2: the conviction to take of the unit in San Antonio.
- 28:12Speaker 2: Right now. This is an appeal attorney.
- 28:14Speaker 1: So I don't know under what circumstances what they apply
- 28:17Speaker 1: a lawyer to mister Danger's case who was also assistant
- 28:22Speaker 1: district attorney under these circumstances.
- 28:24Speaker 2: Which is what I have always been complaining about.
- 28:27Speaker 1: Man, that these people are giving these individuals assistant das
- 28:31Speaker 1: to represent them, and these attorneys are being paid double
- 28:34Speaker 1: the amount of money to help get the conviction and
- 28:38Speaker 1: they're going to these judges like mister Stevens Hill big
- 28:41Speaker 1: now and the judges are sentence to these gods to
- 28:44Speaker 1: a lot of time because of the operation that they
- 28:48Speaker 1: have in San Antonio. Man, So this is what mister
- 28:51Speaker 1: bag is caught up in.
- 28:52Speaker 10: Man.
- 28:53Speaker 7: You know, he said he have evidence, Man, the proof
- 28:57Speaker 7: that he wasn't there. So is it legal to go
- 29:02Speaker 7: offer he says. She says things in the court of
- 29:06Speaker 7: law instead of you know, my you know, I'm kind
- 29:10Speaker 7: of puzzle that. You know, if his lawyer have proof
- 29:14Speaker 7: that he wasn't there and he can give a timeline
- 29:17Speaker 7: of the things work that that was that he.
- 29:21Speaker 4: Was doing, why wasn't that brought, you know to the
- 29:27Speaker 4: fore line. Why didn't the lawyer present that?
- 29:32Speaker 2: Okay, uh, the lawyer probably presented it. But here is
- 29:37Speaker 2: the process. Mister Diaz is called up into a scandal.
- 29:41Speaker 1: So because he's called up into the scandal, Man, the
- 29:44Speaker 1: only thing they wrote is for Jerry to say guilty.
- 29:47Speaker 1: So now mister died have to appeal the guilty brother
- 29:51Speaker 1: and go to the court of appeals. Now who's on
- 29:54Speaker 1: the court of appeals Another judge who probably said on
- 29:58Speaker 1: mister deed's escape. So he's not going to get a
- 30:01Speaker 1: fair decision, no way out.
- 30:04Speaker 5: Of this whole process.
- 30:05Speaker 1: Now, to answer your question, the standard of reduced the
- 30:09Speaker 1: exists to determine whether the evidence is leading decisions to
- 30:13Speaker 1: support their conviction. We must examine all of the evidence,
- 30:16Speaker 1: and delight must favorable to the verdict to determine whether,
- 30:20Speaker 1: based on that evidence, a reasonable experiences. Therefore, any racial
- 30:25Speaker 1: jury could have found the central elements of the crime
- 30:28Speaker 1: beyond the reason of doubt. Well, they can protect the evidence,
- 30:32Speaker 1: but it's the jury determination of what they choose to accept.
- 30:37Speaker 1: Mister case, they refuse to accept his.
- 30:45Speaker 2: Yeah, there's book, mister.
- 30:51Speaker 4: What what have what have you filed? Have you filed
- 30:55Speaker 4: any risk?
- 30:58Speaker 2: I got an appeal right and I was denied my appeal.
- 31:03Speaker 2: My my appeal attorney didn't he didn't even want to
- 31:07Speaker 2: fight for him more he put a pd R.
- 31:12Speaker 10: He didn't want to, he didn't want.
- 31:13Speaker 2: To put a Yeah, he didn't want to put a
- 31:14Speaker 2: PDR for me, He kept, he kept, you can't say, well,
- 31:17Speaker 2: we're just gonna leave it into their hands.
- 31:21Speaker 10: And I even also my attorney had put in a
- 31:26Speaker 10: emotion for new trial.
- 31:28Speaker 2: Which which is which is is under a c CT.
- 31:32Speaker 10: For a zero point zero zero one and it and
- 31:36Speaker 10: it states for UH one, two, three, four.
- 31:39Speaker 2: Reasons for UH for the new trial. One of them
- 31:44Speaker 2: say the defending was convicted in the in the inst
- 31:47Speaker 2: case on June sixth, seventeen for the offensive violation of
- 31:51Speaker 2: a protective boarder causing assault on just twenty second, twenty seventeen.
- 31:55Speaker 2: The defending was sixth sub second equipment and it's thirty
- 32:00Speaker 2: one years imprisonment is the institutional division. While in a
- 32:03Speaker 2: finding that he was an habitual offendent, his motion is
- 32:07Speaker 2: timey in less than thirty days have a less since
- 32:10Speaker 2: the trial court imposed.
- 32:11Speaker 10: Senate in his chief.
- 32:12Speaker 2: His motion has been timely presented by nctual delivering the
- 32:16Speaker 2: motions to the trial judge or otherwise bringing the motion
- 32:19Speaker 2: to the attention or actual notice of the trial judge.
- 32:23Speaker 2: The second one is the defending in this case should
- 32:25Speaker 2: be granted a new trial in this case because material
- 32:28Speaker 2: evidence favorable to the accused has been discovered since trial,
- 32:32Speaker 2: and the newly discovered evidence was unknown to the defendant
- 32:35Speaker 2: or defense counsel at the time of trial. The defending
- 32:39Speaker 2: or defended council staider to discover the new evidence is
- 32:42Speaker 2: not due to lack of new vinity. The new evidence
- 32:45Speaker 2: is a miserable and not meredy coma communicated cooperative collateral
- 32:50Speaker 2: or impeaching. And the new evidence is probably true and
- 32:54Speaker 2: will probably bring about a different result at trial. To
- 32:57Speaker 2: number three a very worn adam supporting the motion for
- 33:01Speaker 2: new trial in attack a dignivid aid. And then the
- 33:05Speaker 2: fourth one is defending requests the court to appoint you
- 33:08Speaker 2: counsel to prosecute this motion for new trial, that the
- 33:11Speaker 2: defendant will receive effective assistance of counsel from my attorney
- 33:15Speaker 2: that had experience pursuing both commission really and also so
- 33:19Speaker 2: that the undersigned council may be called as effect of
- 33:22Speaker 2: witness and emotion for new trial.
- 33:26Speaker 4: Wow did you man that?
- 33:28Speaker 2: And that was that was said? That was stamped and
- 33:32Speaker 2: followed by uh Donald K. McKinney in the District Fair
- 33:37Speaker 2: County on the seventeenth of July thirtieth at four twenty
- 33:41Speaker 2: four pm.
- 33:45Speaker 10: And I never, and I never and and.
- 33:47Speaker 2: I never received anything about my new trial. Only the
- 33:50Speaker 2: only thing they gave me it was a new pill.
- 33:55Speaker 10: Okay.
- 33:55Speaker 2: Of course, recognized the fact that you should have been
- 33:58Speaker 2: credited a new trials, the one the killers that were
- 34:01Speaker 2: raised by mister Rakon.
- 34:02Speaker 1: Okay, So are you saying that you've never received no
- 34:06Speaker 1: further notice of your emotions for new trial.
- 34:09Speaker 2: Yes, sir, I never see no further notice new trial
- 34:12Speaker 2: and it's shined by my Itornian.
- 34:15Speaker 10: Which was okay.
- 34:21Speaker 2: So now the new evidence that you're saying that is
- 34:24Speaker 2: presented in your case.
- 34:25Speaker 1: The court acknowledged the new evidence. So now because the
- 34:28Speaker 1: fact that you haven't been gifferent the new trial, yourcation
- 34:31Speaker 1: is still standing firmed on the fact that that motion
- 34:34Speaker 1: is a credible emotion that's binding.
- 34:36Speaker 2: On the court.
- 34:37Speaker 1: So now, how is it logically possible that your apkill
- 34:40Speaker 1: attorney went to an appeal and didn't acknowledged this to
- 34:44Speaker 1: the Court of Appeals about your emotions.
- 34:45Speaker 4: For new plum.
- 34:47Speaker 1: Instead he raised its regarding the protective all of being violated.
- 34:52Speaker 1: So why is it that that issue was not raised
- 34:54Speaker 1: on direct appeal about your emotion for new problem because
- 34:58Speaker 1: he said that the only thing that it could bring
- 35:00Speaker 1: up for what happened in the in the jury trial,
- 35:05Speaker 1: the new evid that the new evidence couldn't be brought
- 35:07Speaker 1: up because it was not brought up in jury trials.
- 35:12Speaker 2: Okay, but there was probably brought up on the most
- 35:14Speaker 2: of new trial. Is which this is the proper woman
- 35:17Speaker 2: to bring it up on the most of the new trial.
- 35:20Speaker 2: That ray is an issue on direct appeal because the
- 35:23Speaker 2: issue is preserved. I'm gonna review. So I follow eleven
- 35:28Speaker 2: or seven on your take. No, I haven't followed, and
- 35:32Speaker 2: I haven't followed. He never know seven because you only
- 35:35Speaker 2: get you only get one one.
- 35:38Speaker 7: You don't have the.
- 35:39Speaker 2: Resources for to follow, Okay. And you've been inclocerated for
- 35:45Speaker 2: how long? Right now, mister Dan, I've been incarcerated for
- 35:49Speaker 2: eighty and a half years. Okay, right, all right, now,
- 35:53Speaker 2: right right there, You're going to have to tell the
- 35:57Speaker 2: legal allities of your environment. And if you got evidence
- 36:01Speaker 2: of newiece, you can raise this etherness on your living
- 36:05Speaker 2: on Sunday.
- 36:06Speaker 10: You have to challenge it.
- 36:08Speaker 2: Okay. Now, I know you may not know what you're doing,
- 36:11Speaker 2: but I'm quite sure it's a lot of guys over
- 36:13Speaker 2: there that goes with the law, Oberary, that can place
- 36:15Speaker 2: you in the right direction. But if you feel that
- 36:18Speaker 2: you are not comfortable with them doing it, mister d
- 36:21Speaker 2: you know I can ask you to do this here,
- 36:24Speaker 2: give us a little time. Let's have to be able
- 36:26Speaker 2: to get to you because.
- 36:27Speaker 1: We're gonna stay with mister James Legate. And if you
- 36:30Speaker 1: know mister James Legate, you stay next to missus Dames Gate.
- 36:33Speaker 2: So we will get to you. Hate that, but you
- 36:36Speaker 2: have to keep it touch with.
- 36:43Speaker 4: Yeah, him and mister Legate. It's not on the same union.
- 36:50Speaker 1: Oh they're not.
- 36:55Speaker 2: It don't matter. Just so you stay in touch with
- 36:57Speaker 2: mister Sinnett Johnson. That's all we need. Okay.
- 37:01Speaker 10: So if we will fuck with you, what it did?
- 37:05Speaker 2: Okay? Okay, and right now I'm waiting for answer for
- 37:11Speaker 2: right right now, right and uh okay, but I think
- 37:15Speaker 2: the nice I think the nice four time. Okay, okay,
- 37:22Speaker 2: well that's good news. But it did.
- 37:23Speaker 4: You will get it.
- 37:24Speaker 7: He did.
- 37:25Speaker 1: They might give it to you this time, but either way,
- 37:27Speaker 1: so do not let nobody touch your cakes. If you
- 37:30Speaker 1: don't feel comfortable with that. And first chance we hit
- 37:33Speaker 1: I did, we will get to you. Pack up and
- 37:35Speaker 1: we will send you a happs to let us know
- 37:37Speaker 1: we're ready you okay, okay, okay, okay, okay.
- 37:42Speaker 10: Can you can you?
- 37:43Speaker 2: Can you deal with that? It's that I could deal
- 37:46Speaker 2: with that.
- 37:48Speaker 7: The most the most important thing is what Cartnell said,
- 37:54Speaker 7: do not let nobody mess with your case that you
- 37:59Speaker 7: don't trust, even if they say that they can do it, don't.
- 38:03Speaker 4: Don't.
- 38:04Speaker 7: Don't just give it to any oldbody that because you know, I've.
- 38:11Speaker 10: Had some people look at it right to try to
- 38:13Speaker 10: do the eleven or seven for me right, and the
- 38:16Speaker 10: people and some people that I have to.
- 38:20Speaker 2: They've they've both vote different teams. So that's all I
- 38:23Speaker 2: have been skeptical on even sending it end like.
- 38:26Speaker 5: That, you know what I mean.
- 38:29Speaker 2: Okay, I rather I'd rather have you. I'd rather have
- 38:32Speaker 2: a professional.
- 38:33Speaker 1: Professional Okay, that's what we're gonna do with you, mister.
- 38:38Speaker 1: We're gonna put you in the right track, mister d
- 38:40Speaker 1: I would see you. I would be on the other
- 38:42Speaker 1: side in two months.
- 38:43Speaker 2: Listing and we will be.
- 38:46Speaker 4: Okay, yes, sir, will you you have my number, you
- 38:51Speaker 4: know how to reach out to us and stuff. I
- 38:53Speaker 4: will be. I will keep in contact with you. I
- 38:57Speaker 4: will see you my work schedule.
- 38:59Speaker 7: My work schedule has changed, and I will let you
- 39:04Speaker 7: know when is the best time you can get in
- 39:07Speaker 7: contact with us. But okay, just continuously fighting, don't you know.
- 39:21Speaker 7: Don't let your voice or anything go silent In this
- 39:26Speaker 7: hour because you need to. You need to fight for yourself.
- 39:29Speaker 7: You're gonna be your best applicant. You're your best applicant.
- 39:38Speaker 9: You have one minute left, okay, so.
- 39:43Speaker 2: Six, so please give us enough time to beificate to
- 39:46Speaker 2: the side so we will be in touch with you,
- 39:49Speaker 2: keep in touch. She will keep in touch with you.
- 39:53Speaker 10: Okay.
- 39:54Speaker 2: Okay, So I appreciate it.
- 39:58Speaker 7: Okay, so try to call me one. I'll reach out
- 40:02Speaker 7: to you next week. Okay, Okay, thank you, thank you
- 40:08Speaker 7: for coming story.
- 40:11Speaker 2: Okay, okay, okay, okay. Wow. Well yes, ma'am, Yes, and
- 40:24Speaker 2: see he's dealing with mister Steve Big.
- 40:27Speaker 1: Mister Steven hell Big is the district attorney who were
- 40:30Speaker 1: in the Avenue Stixon scandal.
- 40:31Speaker 2: In Bear County but chills the d rep. See, these
- 40:34Speaker 2: are the people that mister the Game got convicted up
- 40:37Speaker 2: on them.
- 40:37Speaker 4: Okay, come on, wow, I mean, as you heard from
- 40:46Speaker 4: mister Diaz, he has proof oh you know where.
- 40:54Speaker 7: He's been, and he also has the documents where they're
- 40:59Speaker 7: sending his case back into court. But they want to
- 41:03Speaker 7: acknowledge that our system is very corrupt when it comes to.
- 41:13Speaker 4: Men of color.
- 41:15Speaker 7: Are our brothers? Oh my heart just goes out to him,
- 41:24Speaker 7: just hearing that you know, to be wrongfully falsely accused
- 41:28Speaker 7: of something you didn't do and you.
- 41:31Speaker 4: Have evidence that you haven't do it. Having did this,
- 41:36Speaker 4: We've seen and we read.
- 41:40Speaker 7: Of hundreds of men's and women that has been wrongfully
- 41:45Speaker 7: convicted of things that they haven't did.
- 41:49Speaker 4: When are we going to say enough is enough? When
- 41:52Speaker 4: are we going to.
- 41:52Speaker 7: Stand up and be our brother and sister keeper? You
- 41:57Speaker 7: know a lot of us say, oh, you know, I'm
- 42:00Speaker 7: there for you, and then ones they get that that
- 42:05Speaker 7: time a life sentence. You know, we know that life
- 42:11Speaker 7: goes on, but we can't. Let's not forget about our
- 42:17Speaker 7: our brothers and sisters that's wrongfully incarcerated, even the ones
- 42:22Speaker 7: that have committed their crime.
- 42:25Speaker 4: Let's not throw our forget about them.
- 42:30Speaker 7: You know all have come short.
- 42:34Speaker 4: We all come short every day at least one of us.
- 42:38Speaker 4: Are a couple of us.
- 42:41Speaker 9: We are.
- 42:45Speaker 4: Second is away.
- 42:49Speaker 7: Ending up where they are at. So let's not look
- 42:56Speaker 7: down our nose at them. Let's stand up and let's
- 43:00Speaker 7: be a voice for them. Let's speak for the voice
- 43:03Speaker 7: with you know, I mean, just hearing what he said
- 43:07Speaker 7: that he have they he's supposed to be back in
- 43:10Speaker 7: court that man is supposed to.
- 43:11Speaker 2: Be out, but they not.
- 43:16Speaker 4: It's like they don't care. What can we do as
- 43:26Speaker 4: a people. We already got a president that you know,
- 43:31Speaker 4: they that's a feeling.
- 43:33Speaker 7: He's out, he's just doing what he want to do.
- 43:38Speaker 4: But you have men and women that's currently incarcerated wrongfully.
- 43:45Speaker 7: They can't run for president, they can't even vote because
- 43:51Speaker 7: they are they quote unquote are feelings.
- 43:57Speaker 4: Some things have to change. We're voting for.
- 44:02Speaker 7: The wrong people. As judges, we see it in the
- 44:08Speaker 7: juvenile system. Either we don't care or hey, I don't know,
- 44:19Speaker 7: you know, my I just have so much compassion.
- 44:26Speaker 4: My co host Cornell is back. Cornell, Why yes, ma'am.
- 44:33Speaker 1: Misternette Johnson, thank you very much, ma'am for your compassion, ma'am.
- 44:37Speaker 1: But if people like you and missus Smith, ma'am, that
- 44:41Speaker 1: you know, give us the voices we need to be
- 44:43Speaker 1: able to applicate for these issues because our system is broken, ma'am,
- 44:48Speaker 1: and a lot of people that the office know that
- 44:50Speaker 1: our system is broken, and instead of them trying to
- 44:53Speaker 1: fix the problem now, they are only kicking the can
- 44:57Speaker 1: down the road in order to be able to allow
- 45:00Speaker 1: system to run the way it's running. Wow, because this
- 45:03Speaker 1: is a multi trillion dollar enterprise.
- 45:05Speaker 2: Man.
- 45:06Speaker 1: For people are being seminister to prison and serving countless years. Ma'am,
- 45:10Speaker 1: you know of their freedom, you know behind bars the
- 45:13Speaker 1: crimes they did not commit. Look at mister Spencer this
- 45:16Speaker 1: who did thirty four years to a clime he did
- 45:18Speaker 1: not commit.
- 45:20Speaker 2: Look at mister mister, mister Richard Moss and countless other
- 45:24Speaker 2: individuals have.
- 45:25Speaker 1: Done times for crimes that they did not commit. So
- 45:28Speaker 1: just see, that's got to be others in this system
- 45:31Speaker 1: at serving times for crimes they did not commit. And
- 45:34Speaker 1: not only in the system, but even on death row,
- 45:36Speaker 1: man wow.
- 45:37Speaker 2: Thing called the technical law parties.
- 45:39Speaker 1: Man, this is one of the most unconstitutional laws they
- 45:43Speaker 1: have on the ballot, maw wow, because people are being
- 45:47Speaker 1: convicted of being responsible for the come up of another person.
- 45:51Speaker 1: You cannot tell another person not to shoot somebody or
- 45:54Speaker 1: what to commit a crime.
- 45:55Speaker 2: You cannot do that.
- 45:57Speaker 1: But you would be held accountable and serve a capital
- 46:00Speaker 1: the lifestyles with alcohol or get the death penalty. The
- 46:04Speaker 1: issue of being convicted as a party to a clime. Man,
- 46:07Speaker 1: And this is unconstitutional. But our lawmakers are not doing
- 46:12Speaker 1: anything to change these laws.
- 46:13Speaker 5: Man.
- 46:13Speaker 7: But you know, I don't know.
- 46:16Speaker 4: I just want to jump in right quick. When you
- 46:18Speaker 4: say lawmakers, look at look what they're doing. They don't care.
- 46:27Speaker 4: A lot of them is too busy.
- 46:31Speaker 7: Kissing the ring of forty seven, because truly, I believe
- 46:35Speaker 7: that they're scared of him, because it's no way the
- 46:42Speaker 7: way he's running this country into the ground, the things
- 46:46Speaker 7: that he's doing and the hate that he's out there
- 46:52Speaker 7: throwing out there should be allowed. If it was let's say,
- 46:58Speaker 7: if it was Barack Obama, they would have been done
- 47:02Speaker 7: a peach him. They would have been they would have
- 47:07Speaker 7: been done through that got that man up out of office.
- 47:10Speaker 7: So why they can't Why if they're not fighting for
- 47:13Speaker 7: their constituents, Each one of them lawmakers that's sitting up
- 47:18Speaker 7: there in Congress, all of them need to be ashamed.
- 47:23Speaker 4: Of their self for what they're allowing.
- 47:29Speaker 10: All of them.
- 47:31Speaker 6: Wow, right, co And you know, and now.
- 47:39Speaker 4: We only got like ten minutes left, Cortnell. But I
- 47:42Speaker 4: want to I see that.
- 47:46Speaker 2: You know.
- 47:46Speaker 7: I try to stay on Facebook and Instagram and reading
- 47:51Speaker 7: the comments of people that always have negative things to say,
- 47:58Speaker 7: especially what's going on over there in Texas with.
- 48:02Speaker 4: That young man case.
- 48:05Speaker 7: I'm praying and that that young man yet a fair
- 48:10Speaker 7: case coming out of Texas. It was also see Texas
- 48:14Speaker 7: is dirt because.
- 48:17Speaker 4: They put his case out there, but didn't put the
- 48:21Speaker 4: other case out there. I believe that happened last year where.
- 48:27Speaker 7: A young Caucasian man wasn't he well, they was still
- 48:33Speaker 7: in school. I think he was like sixteen or seventeen.
- 48:36Speaker 7: He staffed, a young Hispanic man killed him. Did nobody
- 48:41Speaker 7: hear about that? Did nobody hear about that until what
- 48:46Speaker 7: just happened recently, and you haven't still haven't heard about that.
- 48:50Speaker 7: And I believe that he was not convicted. He went
- 48:56Speaker 7: to trial, but he was not convicted of murder. He
- 48:59Speaker 7: was ndicted of something else. Those two cases is coming
- 49:06Speaker 7: out of Texas. And you can see the difference that
- 49:12Speaker 7: they showing within with this young black man between what
- 49:19Speaker 7: happened with the young white man when he did what
- 49:22Speaker 7: he did. I see the the Caucasians they just want
- 49:32Speaker 7: to nail him to the cross, the young white the
- 49:36Speaker 7: young black men.
- 49:38Speaker 4: But they wasn't spilling that for the young white men.
- 49:45Speaker 10: Just man. You know clear Ms.
- 49:49Speaker 2: Johnson, that we do have a double system. Okay, It's
- 49:52Speaker 2: evident down here, especially in Texas. You know in other states, man, well,
- 49:56Speaker 2: racism is at the.
- 49:57Speaker 1: All time time with them, I come on the system
- 50:00Speaker 1: and within our institutions. But this is why it takes
- 50:03Speaker 1: people like us to keep a voice out there, to
- 50:07Speaker 1: be efficants, to be able to expose you know, the
- 50:10Speaker 1: truth to truth to power, because the power that we
- 50:14Speaker 1: are based with, maam, are people who are doing corrupt.
- 50:17Speaker 2: Things behind the scenes, ma'am. Okay.
- 50:20Speaker 1: And this is why we appreciate y'all for being able
- 50:23Speaker 1: to send up for us. Currently right now, the Texas
- 50:27Speaker 1: Prison Advocacy Group, they sent out a partly they're saying
- 50:32Speaker 1: that they're just now coming back to.
- 50:33Speaker 2: The platform, but they send out of parathy with all
- 50:36Speaker 2: of the laws on it that's being anthressed right here
- 50:38Speaker 2: in Texas, and they'll none of them deal with reforming
- 50:42Speaker 2: the criminal justice system, not one of them, okay.
- 50:45Speaker 1: And we have all these other afficacy groups now saying
- 50:48Speaker 1: that they want criminal justice reform and being of this nature.
- 50:52Speaker 1: But ma'am, we are not getting the issues on the
- 50:55Speaker 1: ballot that we need to be on the balance about corruption.
- 50:58Speaker 1: About corruption is about corrupt lawyers. About our system, even
- 51:03Speaker 1: with our.
- 51:03Speaker 2: Our parole board system, we have people making parole man
- 51:07Speaker 2: a year.
- 51:08Speaker 10: Ago and still in prison.
- 51:10Speaker 1: They stilled in our prison systems. They don't even have
- 51:13Speaker 1: a parole release date yet.
- 51:14Speaker 2: Man.
- 51:15Speaker 10: Some guys being parole a year ago and been here five.
- 51:20Speaker 1: Six, seven months after day completing data program, still don't
- 51:22Speaker 1: get a release date from.
- 51:23Speaker 2: The parole boards. So how can this be possible?
- 51:26Speaker 1: But our lawmakers are not saying anything about these issues. Wow,
- 51:30Speaker 1: because it's a multi billion dollar enterprise.
- 51:33Speaker 2: We are being marked out to private entities, man, right now.
- 51:38Speaker 10: So you're right.
- 51:39Speaker 1: We have a system that's broken and we need the pieces.
- 51:41Speaker 3: Man.
- 51:42Speaker 2: That's what let's talk about.
- 51:44Speaker 10: It is all about.
- 51:45Speaker 1: Come to this talk about it, and we can ask
- 51:47Speaker 1: us any issue that you have that you steel needs
- 51:50Speaker 1: to be acts regarding, and not just the criminal justice system.
- 51:54Speaker 1: We're not act just little health. We have just any
- 51:57Speaker 1: issue that you feel needs to be address to the
- 51:59Speaker 1: public and to any act, to any it all make
- 52:02Speaker 1: us whoever, just come out.
- 52:04Speaker 2: And have your voice. Herd On, let's talk about it

- 52:39Speaker 4: We don't have these voices for nothing. We use our
- 52:45Speaker 4: voices for negativity things.
- 52:49Speaker 7: We all you know you use your voice talking about
- 52:51Speaker 7: people instead of helping people. Hey, we can see the
- 52:58Speaker 7: young the lady that called an artistic black boyd baby
- 53:04Speaker 7: a nigger, Well.
- 53:06Speaker 4: Let me, I don't want to be censored.
- 53:08Speaker 7: But said the N word and they raised the Gold
- 53:13Speaker 7: Fund before her, so we can That's where that's where
- 53:20Speaker 7: we're at.
- 53:20Speaker 4: Now.
- 53:21Speaker 7: We can go around calling babies names that's artistic, and
- 53:28Speaker 7: we can get probably I think it was half a
- 53:30Speaker 7: million dollars or something, the hate.
- 53:35Speaker 4: But you claim that you love God, you love God,
- 53:38Speaker 4: You claim that this country was built, and.
- 53:43Speaker 7: You know what, that's a whole nother issue because you
- 53:45Speaker 7: guys gonna have me going straight left.
- 53:49Speaker 4: You claim that you love God, you don't. You don't
- 53:55Speaker 4: because God is not hate. God is loved. Go read
- 54:00Speaker 4: your bible, Go read it because what's going on now
- 54:06Speaker 4: it's a lot of hate.
- 54:08Speaker 7: And let me go ahead and just end, because we
- 54:10Speaker 7: got four minutes and we beat on spelled on to
- 54:13Speaker 7: something else, and you know, my blood pressure being shot up,
- 54:17Speaker 7: and you know, and because I have so much compassion
- 54:22Speaker 7: about what's going on, and we've got to use our
- 54:26Speaker 7: voices for positive.
