- 0:00Speaker 1: But first, joining us, legal journalist Christian Farias, co-creator of
- 0:04Speaker 1: The Circus and former advisor to President George W. Bush
- 0:08Speaker 1: and Senator John McCain, Mark McKinnon, co-founder of Punchbowl News
- 0:13Speaker 1: and MSNOW political contributor Jake Sherman, along with progressive strategist
- 0:17Speaker 1: Nomiki Konst. All right, everybody. Let's begin with the Supreme
- 0:24Speaker 1: Court decision itself. Christian, you said yesterday that it was
- 0:27Speaker 1: going to come down yesterday or late today even. You
- 0:31Speaker 1: were spot on. Are you surprised by the decision?
- 0:35Speaker 2: I am not surprised by the decision. I am not
- 0:37Speaker 2: surprised that I was right because this is a flatly
- 0:40Speaker 2: unlawful rule by the U.S. Postal Service that we even
- 0:44Speaker 2: are having this conversation. The president directing the Postal Service
- 0:47Speaker 2: to issue a rule impacting all 50 states and everyone
- 0:51Speaker 2: who votes in this nation is something that we have
- 0:52Speaker 2: never seen. So I'm not surprised that the justices stopped
- 0:55Speaker 2: this thing in its track. I'm kind of disappointed that
- 0:59Speaker 2: it was a very short order. They didn't speak much.
- 1:01Speaker 2: It's only three sentences. Those three sentences are hugely important
- 1:05Speaker 2: because they put the nail in the coffin of this thing.
- 1:08Speaker 2: And they said, nope, this thing does not succeed on
- 1:11Speaker 2: the merits. And there's no way that this thing is
- 1:14Speaker 2: going to move forward before the election. So yay for democracy.
- 1:17Speaker 2: But stay tuned, because who knows what Todd Blanch is
- 1:20Speaker 2: going to surprise us with.
- 1:21Speaker 1: Well, let me ask you, let's go toward Election Day.
- 1:24Speaker 1: Let's go to Election Day or the days after. If
- 1:27Speaker 1: the president tries to claim fraud again and asks his AG,
- 1:31Speaker 1: his DOJ to seize voting machines, can he do that?
- 1:36Speaker 2: Well, yeah, he can do many things. And unfortunately, we
- 1:39Speaker 2: have a DOJ and an FBI that will do the
- 1:41Speaker 2: president's bidding on so many things, beginning with the 2020 election,
- 1:45Speaker 2: which is still being litigated and investigated, despite the fact
- 1:49Speaker 2: that there was no fraud and that he lost it.
- 1:51Speaker 2: So anything that he loses, he tends to investigate. So
- 1:54Speaker 2: we're not out of control. out of danger here. They
- 1:58Speaker 2: will continue probing anything that needs to be probed. And
- 2:01Speaker 2: if they have to go to the mats again, and
- 2:02Speaker 2: if they have to reissue the rule, they will try
- 2:05Speaker 2: to do anything in their power to do so. This
- 2:07Speaker 2: is a trial run for 2028. And I wouldn't be
- 2:11Speaker 2: surprised if they keep... just hammering the point that fraud
- 2:16Speaker 2: is rampant because by creating that perception that there's lawlessness
- 2:20Speaker 2: in our elections with which there isn't, that's how you
- 2:23Speaker 2: create the recipe. And basically you create the conditions so
- 2:27Speaker 2: that then the president can go and deputize not just
- 2:30Speaker 2: DOJ and the FBI, but so many other agencies. And
- 2:33Speaker 2: we're seeing it right now to basically create chaos, confusion
- 2:37Speaker 2: and to disenfranchise voters, which is the ultimate goal.
- 2:40Speaker 1: Let me play Todd Blanche on CBS News yesterday talking
- 2:44Speaker 1: about the potential for voter fraud.
- 2:50Speaker 3: If you're using mail-in voting, the potential for fraud is
- 2:54Speaker 3: greater than in-person voting with ID. What is the evidence
- 2:57Speaker 3: for that? Well, it's common sense. And any honest broker
- 3:02Speaker 3: will concede that mail-in voting, even though there are benefits,
- 3:05Speaker 3: especially for people in the military, people who can't go
- 3:08Speaker 3: to the polling stations, the potential for fraud is obvious.
- 3:12Speaker 1: So much potential, Jake. Never any evidence. And they've been looking.
- 3:16Speaker 1: Never any evidence. I wonder how Republicans are reacting to
- 3:20Speaker 1: all of this, because there was there were Republicans who
- 3:23Speaker 1: were talking about this postal service rule really doing a
- 3:29Speaker 1: lot of damage, being very disruptive. There was also the
- 3:33Speaker 1: governor of Wyoming talking about how the election monitors that
- 3:38Speaker 1: the DOJ sent for their election were also hugely disruptive.
- 3:42Speaker 1: So it seems like there might be some interesting reactions
- 3:46Speaker 1: to this.
- 3:48Speaker 4: The irony is that Republicans are actually very good at
- 3:51Speaker 4: mail-in balloting. This is something they've excelled in over the
- 3:55Speaker 4: last decade. They've created programs to chase ballots and to
- 3:58Speaker 4: get people to vote by mail, and it's been a
- 4:02Speaker 4: huge success for them. It's led them in the 2010s
- 4:07Speaker 4: to huge majorities in the House of Representatives because— they've
- 4:11Speaker 4: played that game pretty well. And so there is fear
- 4:14Speaker 4: and there has been fear, Katie, over the last couple
- 4:17Speaker 4: of years, dating back even to the first Trump administration,
- 4:20Speaker 4: that the Trump team's, you know, antipathy or opposition to
- 4:26Speaker 4: mail-in voting is going to hurt them. And again, we are,
- 4:30Speaker 4: you know, 49 days until Election Day. If you tell people,
- 4:34Speaker 4: especially Republican voters or any voters, that if they vote
- 4:37Speaker 4: by mail, then their vote won't be counted or it's
- 4:39Speaker 4: less secure or it could be lost or whatever. That's
- 4:42Speaker 4: not a great motivation for people to vote. And again,
- 4:45Speaker 4: a lot of Republicans vote on top of that. There
- 4:47Speaker 4: are a lot of states around the country that have,
- 4:51Speaker 4: Republican states, by the way, that have secure mail-in balloting programs,
- 4:56Speaker 4: Oklahoma being one of them, where I believe it has
- 4:59Speaker 4: to be notarized or it's very, very strict to So
- 5:03Speaker 4: cutting back on things like that could hurt Republicans. So,
- 5:07Speaker 4: you know, I think the in the Supreme Court decision,
- 5:11Speaker 4: it said Justice Kavanaugh said that it's too close to
- 5:14Speaker 4: the election for any of these changes. And obviously, that's right.
- 5:17Speaker 4: That's the opinion of the court or it's the opinion
- 5:19Speaker 4: of Kavanaugh and some people on the court. So I
- 5:22Speaker 4: would you know, I don't think obviously I think the
- 5:24Speaker 4: administration is going to keep trying to put new restrictions
- 5:27Speaker 4: on this. I don't know that they're going to be successful.
- 5:29Speaker 4: And most people up here, Katie, are focused on getting
- 5:33Speaker 4: Republicans are focused on getting people to vote and winning elections,
- 5:37Speaker 4: not necessarily these these schemes or these new restrictions on
- 5:43Speaker 4: mail in voting.
