Transcript
- 0:00Speaker 1: What's up, everyone, and welcome to another episode of the
- 0:03Epstein Chronicles. Pambondi and the DOJ sent Congress a letter
- 0:10stating that all of the records had been released and
- 0:13that nothing that wasn't supposed to be withheld was withheld.
- 0:18So in this episode we're going to take a look
- 0:21at that letter, and then in the next episode we're
- 0:24going to talk about this so called list. But first
- 0:27things first. February fourteenth, twenty twenty six Epstein File Transparency Act,
- 0:36Section three Report to Congress. Section three of the Epstein
- 0:40Files Transparency Act requires the Department of Justice, within fifteen
- 0:44days of completing the release required under the Act, to
- 0:48submit to the House and Senate Committees on the Judiciary
- 0:52a report listing one all categories of records released and
- 0:56withheld to a summary of redactions made, including legal basis,
- 1:01and three a list of all government officials and politically
- 1:04exposed persons or referenced in the released material. Consistent with
- 1:10Section three of the Act, the Department provides the following
- 1:13information categories of records released and withheld, Categories of records
- 1:19released in accordance with the requirements of the Act and
- 1:22as described in various Departments submissions to the Courts of
- 1:26the Southern District of New York assigned to the Epstein
- 1:29and Maxwell prosecutions and related orders. The Department released all records, documents, communication,
- 1:35and investigative material in the possession of the Department that
- 1:39relate to any of the nine different categories. One Jeffrey Epstein,
- 1:44including all investigations, prosecutions, or custodial matters. Two Glad Maxwell.
- 1:50Three flight logs or travel records, including but not limited to, manifests, itineraries,
- 1:56pilot records, and customs or immigration documentation for any aircraft, vessel,
- 2:02or vehicle owned, operated, or used by Jeffrey Epstein or
- 2:07any related entity. Four individuals, including government officials, named or
- 2:12referenced in connection with Epstein's criminal activities, civil settlements, immunity
- 2:18or plea agreements, or investigatory proceedings. Five entities corporate, nonprofit, academic,
- 2:25or governmental with known or alleged ties to Ebstein's trafficking
- 2:30or financial networks. Six any immunity deals, non prosecution agreements,
- 2:35plea bargains, or sealed agreements involving Epstein or his associates.
- 2:40Seven internal DOJ communication, including emails, memos, meeting notes concerning
- 2:47decisions to charge, not charge, investigate, or declined to investigate
- 2:51Epstein or his associates. Eight all communications, memoranda, directives, logs,
- 2:57or metadata concerning the destruction, deletion, alteration, misplacement, or concealment
- 3:04of documents, including recordings or electronic data related to Epstein,
- 3:08his associates, his detention and death, or any investigative files.
- 3:14And nine documentation of Epstein's detention or death, including incident reports,
- 3:20witness interviews, medical examiner files, autopsy reports, and written records
- 3:25detailing the circumstances and cause of death. Categories of records withheld.
- 3:32The only category of record withheld were those records were
- 3:35permitted withholdings under Section two S, and privileged materials were
- 3:40not segrable from material responsive under Section two A. As
- 3:45discussed in the Departments December nineteenth, twenty twenty five and
- 3:49January twenty ninth, twenty twenty six letter to Congress. The
- 3:52privileges that applied to the withheld records were deliberative process privilege,
- 3:57work product privilege, and attorney client privile No records were
- 4:01withheld or redacted on the basis of embarrassment, reputational harm
- 4:06or political sensitivity, including to any government official, public figure,
- 4:11or foreign dignitary. C Two be one summary of redactions
- 4:16made and legal basis Consistent with the Act, The Department,
- 4:21in consultation with Victims, Council and Victims directly engaged in
- 4:25an extensive process to identify and redact segrable portions of
- 4:30records that A contain personally identifiable information of victim or
- 4:35victims personal and medical files, and similar files, the disclosure
- 4:40of which would constitute a clearly unwarranted invasion of personal privacy.
- 4:45B depict or contain child sexual abuse material as defined
- 4:50under US Code eighteen, section twenty two to fifty six
- 4:54and prohibited under US Code eighteen Section twenty two, fifty
- 4:58two and twenty two to fifty two exis would jeopardize
- 5:03an active federal investigation or ongoing prosecution, provided that such
- 5:07withholding is narrowly tailored and temporary. And D depict Or
- 5:12contain images of death, physical abuse, or injury to any person.
- 5:18Although permitted by the Act, no materials were redacted or
- 5:21withheld on the basis that a record contained information specifically
- 5:25authorized under criteria established by an executive order to be
- 5:29kept secret. In the interest of national defense or foreign policy,
- 5:34and are in fact properly classified pursuing to such an
- 5:37executive order. As described in detail in the SDNY EFTA
- 5:42Orders and Submission and the prior EFTA letter, the Department,
- 5:46as permitted by the Act, undertook an extensive process to
- 5:50redact victim names and victim personally identifiable information, including extensive
- 5:56engagement with victims and their counsel. This engagement is ongoing,
- 6:01and the Department remains steadfast in its commitment of protecting
- 6:04the victims. The Department notes, and as discussed in the
- 6:09SDNY EFTA Order and submission, unredacted versions of the material
- 6:14are available for inspection at the Department by members of Congress,
- 6:18and certain members of Congress have come to the Department
- 6:21to inspect unredacted material. As discussed above and in the
- 6:26prior EFTA letter, the Department redacted a limited amount of
- 6:30information covered by various privileges, including deliberative process privilege, work
- 6:36product privilege, and attorney client privilege. The legal basis for
- 6:40these redactions and withholdings is that these privileges are long
- 6:44recognized and based in common law. Given the presumption against
- 6:48repeal of common law principle. The Supreme Court is recognized
- 6:52that such privilege should not be held to have been
- 6:56abrogated or limited unless Congress has at least use clear
- 7:00statutory language before any departure from the rule affirmed through
- 7:05the ages of the common law. A rule having its
- 7:08solid foundation in the best interest of society can be adjudged.
- 7:12The language declaring the legislative will should be so clear
- 7:17as to prevent doubt as to the intent and the limit.
- 7:21Congress expressed its intentions through statutory text passed by both
- 7:26houses and signed by the President. List of all government
- 7:30officials and politically exposed persons Below is a list of
- 7:34all government officials and politically exposed persons named or referenced
- 7:39in the release material. The term politically exposed person was
- 7:43not defined in the Act, but consistent with Section three
- 7:46of the Act, department reviewers were directed to notate all
- 7:50government officials and politically exposed persons named or referenced in
- 7:55any document, including videos and images, reviewed during the process.
- 8:00The list includes, as directed by the Act, all persons
- 8:04where one they are or were a government official or
- 8:08politically exposed person, and two their name appears in the
- 8:12files released under the Act at least once. Names appear
- 8:16in the files released under the Act in a wide
- 8:18variety of context. For example, some individuals had extensive direct
- 8:23email contact with Epstein or Maxwell, while other individuals are
- 8:27mentioned only in a portion of a document, including press reporting,
- 8:32and on its face is unrelated to the Epstein and
- 8:36Maxwell matters. All right, So here's the list, which is ridiculous,
