Speaker 1: would be directly west of the courtyard. Question okay, is
• 0:28

• 0:30
Speaker 1: the courtyard? Answer? I think it's kind of the courtyard.
• 0:34
Speaker 1: It butts up right against the courtyard, so it'd be
• 0:36
Speaker 1: the west side of the courtyard. Question okay, so the
• 0:40
Speaker 1: west of the courtyard. Is there a walkway across the
• 0:43
Speaker 1: Hall of Flags? Answer there is? Question okay, and what no?
• 0:48
Speaker 1: He gets cut off by the officer, an inside one
• 0:51
Speaker 1: and an outside one. Question okay, so what is the
• 0:54
Speaker 1: Hall of Flags then? Answer? The Hall of Flags is
• 0:57
Speaker 1: kind of like a bridge between two buildings, and all
• 1:00
Speaker 1: the flags throughout the world are represented in there, with
• 1:03
Speaker 1: some chairs where people sit down and relax, with windows
• 1:06
Speaker 1: so you can see through all the way to the
• 1:08
Speaker 1: Utah Lake. Question okay. What are those two buildings that
• 1:12
Speaker 1: are connected by this hall of Flags? Answer the Fugal
• 1:15
Speaker 1: Building over to the Science building area. Question okay, so
• 1:18
Speaker 1: you mentioned the Fugal building. Answer yes, Question where's the
• 1:22
Speaker 1: Fugal Building located in a relationship to the courtyard? Answer
• 1:25
Speaker 1: it's to the south of the courtyard? Question okay? Does
• 1:29
Speaker 1: it run up against the courtyard? Answer? It does? Question
• 1:33
Speaker 1: the building? Okay? What about the Woodbury Business Building? Where's
• 1:36
Speaker 1: that in a relationship to the courtyard? Answer it's kind
• 1:40
Speaker 1: of southeast and it runs up right against the courtyard
• 1:43
Speaker 1: also question okay. And in a relationship to the Fugal building,
• 1:47
Speaker 1: where's that Sorensen or excuse me, that business building the
• 1:50
Speaker 1: Woodbury Business Building? Answer? Woodbury Business is right directly east
• 1:55
Speaker 1: of the Fugal Question okay, And what about Sorenson Center?
• 1:59
Speaker 1: Where is that low with respect to this courtyard? Answer?
• 2:02
Speaker 1: The Sorenson Center is going to be kind of like
• 2:04
Speaker 1: northeast of the courtyard. Question okay, does it run again
• 2:11
Speaker 1: up against the courtyard? Answer yes it does. Question okay,
• 2:14
Speaker 1: and where is it in relationship to the business building? Answer?
• 2:18
Speaker 1: Woodbury Business Building is just directly south of Sorenson Question?
• 2:22
Speaker 1: Directly south okay, the LOCI Center. Are you familiar with
• 2:26
Speaker 1: that building? Answer? I am? Question and where is it
• 2:28
Speaker 1: located on campus? Answer? Directly east of the courtyard Amphitheater area.
• 2:34
Speaker 1: Question okay, does it run up to the courtyard the
• 2:36
Speaker 1: low CI Center? Answer no, not really, it doesn't run
• 2:40
Speaker 1: up against it. So the Sorenson Building is kind of
• 2:43
Speaker 1: like right between those two. Question okay, in relationship to
• 2:46
Speaker 1: the Sorenson Building. What direction is the LOSI Building? Answer east?
• 2:51
Speaker 1: Question east? Okay? Are you familiar with the LDS Institute
• 2:55
Speaker 1: building on campus? Answer yes, I am. Question where is
• 2:58
Speaker 1: that located? Answer that's going to be located north of
• 3:01
Speaker 1: the Losi Building and just kind of like northeast of
• 3:04
Speaker 1: the courtyard. Question okay, and there's a parking structure next
• 3:09
Speaker 1: to this institute building. Answer there is? Question and where
• 3:12
Speaker 1: is that? Answer that's going to be so you mentioned
• 3:16
Speaker 1: the Institute building, It's going to be north of the
• 3:19
Speaker 1: low CI Center. There's a parking structure that has several
• 3:22
Speaker 1: levels of parking. It's going to be directly west of
• 3:25
Speaker 1: the Institute building. And then they also have a parking structure,
• 3:29
Speaker 1: not parking structure, parking lot to the north across that
• 3:33
Speaker 1: across the road. Question okay, with respect to the parking structure,
• 3:37
Speaker 1: can you describe for the court how one would enter
• 3:40
Speaker 1: this parking structure driving and even walking? How do you
• 3:43
Speaker 1: enter and exit the structure? Answer? So, on the north
• 3:47
Speaker 1: end of the parking structure is Campus Drive. You can
• 3:50
Speaker 1: drive in and exit onto level one, so that's the
• 3:53
Speaker 1: ground level, and then you'd enter if you were driving in,
• 3:56
Speaker 1: we're exiting back out of the campus then goes up
• 3:59
Speaker 1: to level two, and on level two an exit is
• 4:03
Speaker 1: what's called the heat Plant Road. In between the Institute
• 4:06
Speaker 1: building and the garage is a little road and there's
• 4:09
Speaker 1: an exit right there that you can drive out. You
• 4:11
Speaker 1: can also if you were to park there, you could
• 4:14
Speaker 1: walk out right there and exit only where I was
• 4:17
Speaker 1: talking about on the southeast side you can walk out
• 4:20
Speaker 1: there or on the north end of the garage there
• 4:22
Speaker 1: are some stairs that go up all the levels and
• 4:25
Speaker 1: it goes down to the bottom level and across the
• 4:27
Speaker 1: street through a tunnel to the LDS Institute building, and
• 4:31
Speaker 1: then when you pop up on level two you can
• 4:33
Speaker 1: walk over to the Institute building. Question okay, can you
• 4:37
Speaker 1: describe how long of a walk it would have been
• 4:39
Speaker 1: from that parking structure to get to the courtyard on
• 4:42
Speaker 1: campus approximately. Answer a couple of minutes, because when you
• 4:47
Speaker 1: go that far southeast exit, you can walk directly almost
• 4:50
Speaker 1: to the courtyard. You can also walk along the south
• 4:53
Speaker 1: end of the LDS Institute building up towards loc building. Question. Okay, officer,
• 4:59
Speaker 1: I'm going to turn your t to state exhibit number one.
• 5:02
Speaker 1: It should come up on your monitor there. Let me
• 5:04
Speaker 1: know when you can see it. Answer, I can see it.
• 5:06
Speaker 1: Question and just for staff, let's go ahead and not
• 5:10
Speaker 1: publish it until it's admitted into evidence. So we're going
• 5:13
Speaker 1: to take it off the monitor. But for the witness,
• 5:15
Speaker 1: he should be able to see the exhibit. Judge graph.
• 5:18
Speaker 1: That's fine, so table monitors witness, but not the main monitor.
• 5:22
Speaker 1: Thank you. All right, mister Grunender, thank you, Thank you. Judge.
• 5:26
Speaker 1: Did you see plaintiffs exhibit number one? Officer? Answer? I do.
• 5:30
Speaker 1: Question and do you recognize that exhibit? Answer? Yes, I do.
• 5:34
Speaker 1: Question what is that? Answer? This is an area of
• 5:37
Speaker 1: the building plus the courtyard in the middle of all
• 5:40
Speaker 1: the grassy area, so this is an area of the
• 5:43
Speaker 1: campus at Utah Valley University. Question is it a photograph? Answer? Yes, sir,
• 5:48
Speaker 1: question Okay, are you familiar then with what's depicted in
• 5:52
Speaker 1: this photograph? Answer yes, i am. Question does it fairly
• 5:56
Speaker 1: and accurately portray this area of campus? Answer yes it does.
• 6:00
Speaker 1: Question Okay, can you tell the court what direction the
• 6:02
Speaker 1: camera's facing when this photograph was taken? Answer it's kind
• 6:06
Speaker 1: of facing north and a little to the east. Question okay,
• 6:10
Speaker 1: does it depict a number of the buildings that we've
• 6:12
Speaker 1: talked about today? Answer yes it does. Question for example,
• 6:16
Speaker 1: the Hall of Flags. Does it show the Hall of Flags?
• 6:18
Speaker 1: Answer yes, it does. Question the walkway of it the
• 6:22
Speaker 1: Hall of Flags? What about the Sorenson Center Does it
• 6:24
Speaker 1: show that? Answer yes it does. Question the Woodbury Business Building, Yeah,
• 6:29
Speaker 1: answer yes it does. Question the Fugal Building Yes. Question
• 6:34
Speaker 1: what about the low C Center? Can you see that
• 6:35
Speaker 1: from this photograph? Answer yes. Question is this photograph a
• 6:40
Speaker 1: fair and accurate depiction of this area of the UVU campus?
• 6:44
Speaker 1: On September tenth, twenty twenty five. Answer yes. Question, Your honor,
• 6:49
Speaker 1: the state offers State Exhibit number one. Kathy Nester jumps in,
• 6:53
Speaker 1: who is a lawyer or one of the lawyers for
• 6:55
Speaker 1: Tyler Robinson? Your honor? We would object a failure to
• 6:59
Speaker 1: lay a foundation for Oh I'm sorry, Judge Graf jumps in.
• 7:04
Speaker 1: It's a little bit tricky because that microphone, So she
• 7:07
Speaker 1: gets back to it, your honor, We would object to
• 7:09
Speaker 1: the inability to authenticate. There's not been a foundation laid
• 7:13
Speaker 1: that this officer took this photo can verify when it
• 7:16
Speaker 1: was taken or by whom it was taken, So we
• 7:18
Speaker 1: would object, Judge graph mister Grunader. Grunader, would you like
• 7:25
Speaker 1: us to argue now or approach the bench? Judge graph
• 7:28
Speaker 1: well as it relates to this all your argument, Grunander, Okay, Judge.
• 7:33
Speaker 1: First of all, it's very clear, well established law that
• 7:36
Speaker 1: the person who took the photograph is not required to
• 7:38
Speaker 1: be present to lay foundation for it. What's required for
• 7:42
Speaker 1: foundation is that the witness has knowledge of what's depicted
• 7:45
Speaker 1: in the photograph and can testify to its accuracy. And
• 7:49
Speaker 1: that's exactly what this officer has done. We laid an
• 7:52
Speaker 1: ample amount of foundation about this area of campus. He's
• 7:55
Speaker 1: confirmed that it depicts this area of campus that was
• 7:58
Speaker 1: previously described. He confirmed the buildings that he can see
• 8:01
Speaker 1: there be also confirmed that it was an accurate depiction.
• 8:04
Speaker 1: On September tenth, twenty twenty five. Judge Graff, thank you.
• 8:08
Speaker 1: Any further argument, Miss Nestor, Kathy Nester, we did file
• 8:15
Speaker 1: a standing objection at the beginning of the hearing. I
• 8:17
Speaker 1: would just refer to our standing objection as well. I
• 8:20
Speaker 1: know that this is not there's no written testimony in this,
• 8:23
Speaker 1: but just out of an abundance of caution, I would
• 8:25
Speaker 1: also refer to our standing objection. Judge Graf, thank you,
• 8:29
Speaker 1: Miss Nestor. All right, Having considered the arguments, I find
• 8:32
Speaker 1: I'm going to overrule the objection and admit exhibit one.
• 8:36
Speaker 1: This witness has firsthand knowledge of the location as well
• 8:39
Speaker 1: as the building locations the foundation has been laid. He
• 8:43
Speaker 1: also stated it was a fair and accurate representation of
• 8:46
Speaker 1: what's being depicted here, and for those reasons, the defense
• 8:49
Speaker 1: objection is overruled. State's Exhibit one is admitted into evidence
• 8:55
Speaker 1: and may be published to the courtroom. Grunader okay, So
• 8:59
Speaker 1: the state would move to publish that to the courtroom.
• 9:03
Speaker 1: Judge grass so granted. Gruner Grunader, Officer Bagley, are you
• 9:08
Speaker 1: able to see the monitor that's here in the court
• 9:11
Speaker 1: that's pointed towards the gallery? Answer? Yeah, question from where
• 9:15
Speaker 1: you're seated. Are you comfortable in describing where the courtyard
• 9:18
Speaker 1: is on that photograph on that exhibit answer yes, question
• 9:22
Speaker 1: and for the record, where's it located? Answer? So all
• 9:26
Speaker 1: the grass it looks like a triangle the amphitheater. Look,
• 9:29
Speaker 1: that's going to be the courtyard Amphitheater area. It's got
• 9:32
Speaker 1: the tent in it, the white tent that's at the
• 9:34
Speaker 1: bottom on the far left of the picture. That would
• 9:37
Speaker 1: be the courtyard area that's surrounded by buildings more of
• 9:40
Speaker 1: the grass area. Question I'm going to approach, Well, I'm
• 9:44
Speaker 1: just going to when you look at the exhibit. To
• 9:46
Speaker 1: the left of the photograph, there's a walkway there. What's
• 9:49
Speaker 1: that walkway? Answer? So the red brick walkway that's going
• 9:53
Speaker 1: north to the top of the picture on the far
• 9:55
Speaker 1: left is going to be the Hall of Flags the
• 9:57
Speaker 1: outside of it. Question okay. And on the bottom of
• 10:00
Speaker 1: this photograph there's a white roof building. It's the largest
• 10:04
Speaker 1: building at least as far as what's depicted in this exhibit. Answer, yeah,
• 10:08
Speaker 1: question what building is at answer? That would be the
• 10:11
Speaker 1: fugl building question okay. And just to the right of that,
• 10:15
Speaker 1: so that would be the east of the Fugle building.
• 10:17
Speaker 1: What building is at? Answer? The other red brick pathway area,
• 10:21
Speaker 1: that's the Woodbury Business Building. Answer okay. And if I
• 10:25
Speaker 1: were to walk north so left on this photograph with
• 10:28
Speaker 1: respect to that red brick walk way area, there's another
• 10:31
Speaker 1: building sort of a triangular in shape the rooftop. What
• 10:34
Speaker 1: building is at? Answer with the white rooftop, that would
• 10:37
Speaker 1: be the Sowrenson building. Question the Sowarrenson building. And what
• 10:41
Speaker 1: about the Low C building you've described that? Where's that
• 10:44
Speaker 1: located in this photograph? Question? If you go to the
• 10:47
Speaker 1: triangle white roof, if you go directly to the right,
• 10:50
Speaker 1: so the right side of the picture, that is going
• 10:52
Speaker 1: to be the Low C building. It's got several levels.
• 10:56
Speaker 1: Question is it to the right and up a little
• 10:59
Speaker 1: bit as well? And he yes? Question okay, And that
• 11:02
Speaker 1: would be east on this photograph. Is that correct? Answer?
• 11:06
Speaker 1: It's not the gravel rooftop. Question, gravel rooftop? Okay. I
• 11:09
Speaker 1: referred you to the LDS Institute building. Are you able
• 11:13
Speaker 1: to see that in the photograph? Answer? Yes you are.
• 11:15
Speaker 1: Question and where is that located? Answer? That's just going
• 11:19
Speaker 1: to be directly north of the Low C building. It's
• 11:21
Speaker 1: going to be that other white roof building on the
• 11:24
Speaker 1: far top of the picture. Question, okay, thank you, officer.
• 11:27
Speaker 1: We can take that down your honor. As far as
• 11:30
Speaker 1: the publication, Officer Bagley, I'm going to take you back
• 11:34
Speaker 1: to the date of September tenth, twenty twenty five. Do
• 11:37
Speaker 1: you recall that day? Generally? Answer I do. All right, folks,
• 11:42
Speaker 1: we're gonna wrap up right here, and in the next
• 11:44
Speaker 1: episode dealing with the topic, we're gonna pick up where
• 11:46
Speaker 1: we left off. All the information that goes with this
• 11:49
Speaker 1: episode can be found in the description box.
