Transcript
- 0:00Coming up today on Mini Scroll, the Demilio family drama, the
- 0:04Nashville coffee shop under fire for its drink sizes and
- 0:08Patagonia versus Patagonia clarified.
- 0:12Hi everyone. Welcome to Mini Scroll, the
- 0:15daily Internet culture podcast bringing you the biggest stories
- 0:18from social media, the creator economy and the digital space.
- 0:21Every Monday through Thursday and sometimes Fridays, I'm your
- 0:25host, Lauren Meisner, the founder of the youth digital
- 0:28media brand Centennial World. Welcome back to Mini Scroll,
- 0:31everyone. I can't lie, I am really annoyed
- 0:35right now because I just recorded this and I forgot to
- 0:38hit stop on the record. And so I just pulled the memory
- 0:42card out and the whole files corrupted and I literally just
- 0:45finished. Oh, I'm so annoyed.
- 0:48But hopefully that means this recording will go well because I
- 0:51literally just did it. All right, before I get into it,
- 0:54Please remember to rate review and subscribe.
- 0:57Please Spotify star rate US. It helps us so much.
- 0:59It helps us grow, it helps us chart and it helps us keep
- 1:01going. All right, let's get into the
- 1:03stories for today. So the first story that I have
- 1:06for you guys today, we haven't spoken about the D'amelio family
- 1:10in so long, but they are in the headlines after Dumois posted a
- 1:14blind item about the family feud this weekend.
- 1:17So yesterday Dumois post a blind item that read quote.
- 1:19Sources allege that TikTok and Broadway star Charlie D'amelio
- 1:23discovered millions of dollars had been transferred out of
- 1:27accounts that were established during the years her career was
- 1:29managed by her parents. Insiders claim the transfers
- 1:32allegedly occurred over an extended period and involved
- 1:35funds that were intended for Charlie Savings.
- 1:38According to sources, Charlie became aware of the situation
- 1:41after her parents were allegedly supposed to be removed from
- 1:43certain accounts. The matter is now reportedly in
- 1:46the hands of attorneys. Sources further allege the
- 1:48dispute has caused a major rift within the family, with
- 1:51Charlie's sister Dixie Dimaglio reportedly siding with their
- 1:54parents. OK, so obviously a grain of salt
- 1:57with Dumois as always, but it's not totally shocking to hear
- 2:00something like this about the Demilios, considering it's
- 2:03pretty obvious that there's a major rift or a major fracture
- 2:06in the family, and there has been for over a year.
- 2:10The first signs that Charlie had possibly gone no contact or low
- 2:13contact with her family were last year when she didn't attend
- 2:16Dixie's birthday party. And since then, she's been very
- 2:18publicly distant from her family.
- 2:21She did her Broadway stint, and I don't think they went to any
- 2:25of her shows after October 2024, including her closing night.
- 2:30It's like one of those facts, those, like pop culture Internet
- 2:33facts that are just like, seeped into my brain and they come to
- 2:36the forefront when I have a story like this.
- 2:37I'm like, how do I know that? I don't know, but I do.
- 2:39Oh, and also, she unfollowed her parents on Instagram.
- 2:41So Charlie's father Mark wrote this on the Dumois post.
- 2:46No one called me for an interview.
- 2:47OK, well Dumois does not call for interviews.
- 2:50Mark. No one called me for an
- 2:52interview. This is not true.
- 2:53We love Charlie, but she is being manipulated and I have the
- 2:56receipts. Over the last six years we have
- 2:59remained silent and never addressed gossip, but the time
- 3:02has come to set the record straight.
- 3:04I fear framing this as like receipts, gossip, saying
- 3:08Charlie's being manipulated publicly on this post.
- 3:11Like none of that is good vibes for me.
- 3:14All of that is giving red flags. Your daughter going no contact
- 3:19with you, only speaking to you through lawyers, which he later
- 3:22confirms. Like that's not gossip.
- 3:25That's not something to like bring the receipts over.
- 3:27OK, so then he was asked if he's heard from her in the comments
- 3:31and he said absolutely not. She's always had a team in
- 3:33place, lawyers, business manager, manager, agent.
- 3:36We purposely set it up that way. Not sure if you know anything
- 3:39about her family, but we were doing fine before TikTok.
- 3:42Again, just like a weirdly kind of slimy response.
- 3:46Just because you were doing fine financially before TikTok blew
- 3:50up your entire life doesn't mean that after TikTok blew up your
- 3:54entire life and you moved to LA and your lifestyle inflated by
- 3:58like 100% that you wouldn't have needed more money.
- 4:02And I'm not saying that they took her money.
- 4:04I'm not saying that this blind item is true.
- 4:06Obviously grain of salt like I said, but I don't really think
- 4:09that necessarily proves anything.
- 4:11So he then went on TikTok live and it was very long, but
- 4:15essentially he confirmed that Charlie isn't speaking to her
- 4:17family right now and says he always set out to protect her.
- 4:21And like, the initial example that he gives of this of him
- 4:25protecting Charlie is that he would protect her from like
- 4:27creepy predators and her DMS and emails, which like, I hope so.
- 4:33I hope as her father, you were the 1 monitoring your teenage
- 4:37daughter's accounts when she became the most famous girl on
- 4:40the Internet at 15 years old. Like I hope she did not have
- 4:44just complete unfettered access to her DMS where I am sure there
- 4:48were lots of creepy men in the life.
- 4:49He goes on to say that she's being manipulated by the people
- 4:52around her, implying her business manager, and he alleged
- 4:54that this person views her as a cash cow.
- 4:57All I want to do is I'm going to protect my name and protect when
- 5:00people talk shit about me and it's not happening.
- 5:03So and everybody knows who they are and I and I have, I have the
- 5:06receipt. She, she hasn't reached out to
- 5:08me and sometimes she's mad at me for something.
- 5:10Gave my daughters everything, everything they, they, I thought
- 5:14they wanted and needed. And now you got a bunch of team
- 5:16around around them that think they know what's best for
- 5:19Charlie and I Dude, I have all the receipts.
- 5:22The problem is what am I going to do?
- 5:23What am I going to do? If I, if I, if I sue someone,
- 5:26What's that going to do? Drag my drag my family into a
- 5:28lawsuit? It's emails I sent.
- 5:30I sent one to her business manager.
- 5:32He didn't respond back. Maybe I'll post that one later.
- 5:35We guys should look into everybody associated with
- 5:37Charlie. These dumb fucks don't
- 5:39understand that I can use AI and search 330,000 emails and I have
- 5:45everything. So you want to come after us?
- 5:47What did our business manager, Ron Starr say?
- 5:49Mark, you give yourself too much credit that we took money and
- 5:52put it offshore. I don't even I don't even know
- 5:54how to do that. I don't even know like come on,
- 5:57dude, we got our own money. Going through this process was
- 5:59never about money. It was always just about having
- 6:01this crazy awesome experience with my family.
- 6:03And as far as stealing money, if anything, I'm owed money.
- 6:07I wouldn't put everybody on on on blast, but it's it's just
- 6:10not, it's not accurate. And then he said that he only
- 6:13communicates with Charlie through her lawyer.
- 6:15Quote, we're destroyed, man. We're freaking devastated.
- 6:18We want Charlie back. We love her.
- 6:20OK? Obviously this is like, so sad.
- 6:22I mean, I do believe that Charlie has cut them off for a
- 6:25reason. One of the weirdest things about
- 6:27all of these OG TikTok families like the D'amelios, like Addison
- 6:31Ray's family, is that the parents really wanted to be
- 6:34involved like in their content and in their careers from a fame
- 6:39perspective rather than like a parental or like guardian
- 6:42perspective. Like we saw these parents get so
- 6:46obsessed with being famous themselves.
- 6:48Like they all launched their own accounts, they would do their
- 6:50own paid appearances, all their own sponsorships.
- 6:53They moved their families to LA. Like 6 months into TikTok
- 6:56blowing up. I feel like it was red flag
- 6:58central. These were thirsty parents, and
- 7:01we saw a lot of that on the Demilio show, too.
- 7:03Like Charlie and Dixie were not doing well when we watched them
- 7:07on that show. And there definitely were
- 7:08moments where Heidi and I was going to say Heidi and Spencer,
- 7:12Heidi and Mark were supportive of the girls.
- 7:14But I would say it was still shocking to see how little
- 7:18control they took over those moments to ensure that their
- 7:22daughters felt protected and safe mentally and emotionally.
- 7:27There was definitely an air of like, put your head down and
- 7:30deal with this for the sake of the family brand.
- 7:33But it's clear that Charlie still feels like to an extent, I
- 7:36assume that they didn't show up for her in a way that they
- 7:38should have to protect her mentally, physically,
- 7:41emotionally, while she became literally the most famous person
- 7:44in the world overnight at the age of 15.
- 7:46And I understand that is not normal waters to be navigating.
- 7:51OK. I also understand that Heidi and
- 7:54Mark and like everybody involved, the whole family would
- 7:56have had no idea see how to go about this.
- 7:59It's an incredibly specific situation.
- 8:01But it seems Despite that, she clearly feels like they made a
- 8:04big mistake or some big mistakes and she's having a hard time
- 8:07forgiving them. All right, the next story that I
- 8:08have for you guys today is there is some coffee shop drama with a
- 8:13Nashville coffee shop and an influencer.
- 8:15So a TikTok creator named Katie Wood is going viral after
- 8:18calling out a popular Nashville Cafe Prickly Pear Coffee for
- 8:22essentially ripping off consumers with the size and
- 8:24price of their refresher drinks. So for contact next.
- 8:27Prickly Pear Coffee Co is a Nashville based coffee business
- 8:30founded by Anika Ballas. The company has grown from a
- 8:33mobile coffee cart to multiple locations around Nashville.
- 8:37I think they have 4:00. So Katie made a video a few days
- 8:39ago sharing that their refresher drinks, which have two types of
- 8:42drinks in one split cup. They were selling them for
- 8:45$12.00 and they basically contain as much liquid as a
- 8:48single Starbucks Venti refresher which costs around $6.
- 8:52If you live in Nashville and you know what prickly Pear coffee
- 8:54is, I'm going to do a little experiment real quick just so
- 8:56you can be pissed off with me, OK?
- 8:58They have these thing called split cups, OK?
- 9:00I usually get a refresher from them.
- 9:02It's like, give or take 5 or 6 bucks for a refresher.
- 9:05The split cup is supposed to be two full drinks.
- 9:07She goes to ring it up. It's so you could try two
- 9:08different flavors. She goes to ring it up and it's
- 9:10like $12.00 and some change. And I go, wait, is that for one
- 9:13drink? And she's like, yeah, because
- 9:14it's 2 drinks. I was like, oh, it's 2 full
- 9:16drinks. And she was like, yeah, I was
- 9:18like, OK, I'll try it. It's like I'm making a video.
- 9:20Anyway. I was like, whatever, I'll try
- 9:21it. I was like, I'm going to do
- 9:22something. When I get home after I drink
- 9:24them, I'm going to put it in a Venti Starbucks cup because this
- 9:26is what I usually get, like my refreshers.
- 9:28This cup is $6. If I get a Venti refresher, it's
- 9:31usually about $6 and some odd change, right?
- 9:34This was $12.00. This is not full all the way
- 9:37with water because there's no ice in this.
- 9:38They put ice in it when they give you a refresher.
- 9:40Venti Starbucks cup, $6 and some change when I get a refresher.
- 9:44Look at this, add ice to that. That's just as much as you get a
- 9:51split cup thing for half of the price.
- 9:54I'm never going to prickly pear again.
- 9:57I'm so irritated about it. Katie has over 300,000 followers
- 9:59and this video got over 2.7 million views.
- 10:03So Prickly Pear commented on Katie's video writing.
- 10:07It's $10 because we have to make two separate drinks.
- 10:10If it was 12, you likely added a different milk, extra shot,
- 10:13etcetera. It's also the same amount that
- 10:15you would get in a venti, if not less.
- 10:17So Katie that after her video and after they commented this,
- 10:21the cafe blocked her and then she made this follow up video.
- 10:24I posted my video being like hey this is insane because I'm
- 10:28getting about 16 to 20 ounces of liquid for $12.00 and it has no
- 10:33caffeine in it and you don't have to make it.
- 10:35It's a pre made mixture that they just pour into the cup and
- 10:38add either water or lemonade. And they commented this response
- 10:42and they said it's $10. No, it's not bad.
- 10:46It's not $10. It was 12 plus.
- 10:48If it was 12, you'd like to add a different milk extra shot,
- 10:51etcetera. Hey did you watch the video?
- 10:53Because I ordered every. Pressure.
- 10:55That's not. Coffee I didn't add anything.
- 10:57It's juice. Juice.
- 10:58That is also the same amount you would get in a venti if not less
- 11:01because they would add ice. You also added ice.
- 11:04That's a crazy thing to say. Second of all, there were people
- 11:07that commented and they're like, if you went to Starbucks and you
- 11:09got to Grande's, you would get you, it would be $12.00 too.
- 11:13And I to that, I want to say something so true, Bessie.
- 11:17If I went to Starbucks and I got their Grande, which is 16
- 11:20ounces, I would pay about $12.00 for two of them.
- 11:25Prickly pears drinks are there's they say in their own comments
- 11:2812 ounces. So I'm already getting less
- 11:30liquid and the 216 ounce drinks I would get from Starbucks.
- 11:35They would have caffeine. Then Annika from Prickly Pear
- 11:38made a response video where she went through the itemization of
- 11:41their pricing. Video going around talking about
- 11:44how we. Are scamming.
- 11:45People with the price of our split cups and I wanted to just
- 11:48explain on the back. End about the pricing of these.
- 11:53Cups and also why I responded the way that I did.
- 11:55The first part of this is I I'm not mad.
- 11:58Everyone has the right to their opinion.
- 12:00I there is no hate towards the girl who made this video.
- 12:03I blocked her because honestly my son was with hate comments
- 12:08and it has already been honestly like some of the hardest.
- 12:12Like the last six weeks have just been brutal in business and
- 12:14personal and so I I apologize if that was perceived as rude or
- 12:19immature. It may have.
- 12:20Been all those things. I was not in a place to be able
- 12:23to receive these hate comments and let it roll off my back.
- 12:26She has been unblocked because I am no longer on our TikTok.
- 12:30Someone else has taken that over.
- 12:32Next and the most important part as far as the price breakdown,
- 12:36the split cups are 212 ounce drinks.
- 12:38So I never want to from the classes line to our customers
- 12:41and same area full size drinks. There are two 12 ounce drinks in
- 12:44total. That is 24 ounces of whatever
- 12:46drink you choose. They were designed to be half
- 12:48matcha, half coffee. That's how we post about them,
- 12:51that's how we advertise them. And So what you decide to put on
- 12:54the other side is totally up to you, but the goal and intention
- 12:56is that they would be half much a half coffee.
- 12:58That's what the pricing is based off of.
- 13:00These cups are a dollar and 18 each, including two straws.
- 13:04So this makes it over a dollar more than our large 24 oz ice
- 13:07cups. This did not go over well.
- 13:09Let me read you some of the top comments.
- 13:11So this comment has 47,000 likes and it says by your logic
- 13:15Neapolitan ice cream should be triple the price because it's 3
- 13:17flavors. This comment has 14,000 likes
- 13:20and it says if you're giving people half of 2 drinks, the
- 13:23drinks should be priced as one drink.
- 13:25This comment has 65,000 likes and it says not.
- 13:28It's the attitude you have, not the pricing.
- 13:31And then there's a lot of people in the comments saying that for
- 13:35like split refresher drinks like this, the kind of going price is
- 13:38around $7.00. The main sentiment here is that
- 13:42Prickly Pear should have just doubled down on their pricing.
- 13:46You know, like you're a small business, you're entitled to
- 13:48charge whatever you want and it's up to the consumer if they
- 13:51actually want to pay for that. But a lot of people feel like
- 13:54this would have gone down better for Annika and her brand if she
- 13:57came on TikTok and instead of kind of getting defensive and
- 14:00trying to get you in the weeds of like defending why she
- 14:03charges this and whatever, if she just said, look, we're like
- 14:05a small business, this is what we have to charge and this is
- 14:08our pricing. And just like stand firm on it.
- 14:10I don't know if that would have gone over well, but that is what
- 14:14a lot of the feedback says. Because I understand from her
- 14:17perspective feeling very defensive in the sense that
- 14:20like, she's being accused of like being greedy of ripping
- 14:24people off. Like those are big accusations.
- 14:26I know why she wanted to defend her pricing or give an itemized,
- 14:29I guess, explanation to her pricing.
- 14:32But a lot of people feel like maybe she should have just been
- 14:35like, this is the price and like unapologetic about it.
- 14:38Anyways, because this didn't go over well.
- 14:39Annika made another video in response.
- 14:42We have reached out to Katie and apologized and refunded her
- 14:47drinks and she acknowledged that and and said thank you for that.
- 14:50I did not respond well. I got defensive and I completely
- 14:53own that. I haven't been on the TikTok,
- 14:55but I've been hearing that there are good suggestions as well.
- 14:58And so we've taken those suggestions just as far as
- 15:01advertising goes and writing in the description like, hey, this
- 15:03is priced for coffee and a matcha and our team as people
- 15:07are ordering or. Will probably recommend that.
- 15:09To as well if this is priced for that.
- 15:11It really is just so sad to see people capitalizing on that and
- 15:16capitalizing on hurting a small business on directly coming
- 15:21after me for my mental health. You know, as a woman owned
- 15:25business, I would expect that we would encourage each other.
- 15:29At the end of the day, I hate that the prices have to be what
- 15:34they are as well. I posted a video on this
- 15:35actually recently about how hard it was for me to raise prices,
- 15:39but that we had to if we wanted to keep the doors open.
- 15:41And now the final piece of this, and I do believe it is the final
- 15:44piece, is Katie has made one final video saying she's going
- 15:48to stop talking about this. And she actually kind of like
- 15:51pretends that she's going to address Anika's final video.
- 15:55And then she's like, actually, can you go watch this playlist
- 15:57of mine? So she's trying to drive traffic
- 15:59to her other videos. All right.
- 16:00And the last story that I have for you guys today, I'm going to
- 16:04cover the Patagonia versus Patagonia lawsuit again.
- 16:08So last week I covered it and there is a lot of discourse
- 16:11right now about how this lawsuit is being misrepresented.
- 16:14So I thought it was right to talk about that.
- 16:17I hesitate too. And I really debated if this was
- 16:20the right story to cover because as I mentioned on Thursday, this
- 16:24is a very bad time in history for a giant corporation to be
- 16:27suing a drag queen. Like the LGBTQ communities, the
- 16:31drag community, they are under such attack right now.
- 16:33And I want to protect those communities.
- 16:35Like I don't want anything that I say to be able to be used as
- 16:39like ammo for people to be hateful.
- 16:42Classic. I'm on the last story and
- 16:44Pumpkin starts growling at me because she wants up.
- 16:47If you guys are watching pumpkins on my lap now, I hope
- 16:49you guys can see her behind my laptop.
- 16:51So just know I thought about this a lot, but the reason that
- 16:53I chose to discuss this is because the other side of the
- 16:56lawsuit looks at the protection of creatives and artists and
- 17:00that is also so important in this time.
- 17:03So I feel like I did not give enough information on Thursday
- 17:05when I covered this about the true, I guess, reality behind
- 17:10the lawsuit. You know, I said was trademark
- 17:11infringement. I didn't really explain
- 17:13specifically what they meant by that in the lawsuit.
- 17:16And there's a lot of people online who are saying, you know,
- 17:19like Patagonia, they don't own the name.
- 17:23That's like a region. There's a lot more to this.
- 17:25It's not just a name. There's actually a lot of issues
- 17:28with like the parody logo and things like that.
- 17:30So let's get into it. To catch you up real quick,
- 17:32Patagonia is suing drag queen and climate activist Patagonia
- 17:36for $1.00 for trademark infringement.
- 17:39Patty made a video last week calling on fans to help her get
- 17:42Patagonia to drop the lawsuit and said that Patagonia is
- 17:45trying to permanently take away her name and threaten her with
- 17:48more than $1 million in legal fees.
- 17:50The lawsuit accuses Patty of breaching an agreement they
- 17:53reached in 2022 that, quote, restricted Patty Gonia from
- 17:57selling branded products or using designs that were
- 18:00substantially similar to the company's logo, per NBC.
- 18:04So this agreement happened when Patty was going to collaborate
- 18:08with Hydroflask. So quote in February 2022, when
- 18:12Hydroflask was discussing A collaboration with Patty, Hydro
- 18:15Flask asked Patagonia to ensure the company did not object to
- 18:18the proposed collaboration. The parties met and discussed
- 18:22restrictions around the use of Patagonia to avoid confusion
- 18:26about the source of products or advocacy connected to Patagonia.
- 18:30Patty confirmed an understanding that she must refrain from
- 18:33selling Patagonia branded products or using fonts or
- 18:36designs that copy or are substantially similar to
- 18:38Patagonia's logos, according to the suit.
- 18:41That is from NBC as well. So now there are photos
- 18:43throughout the lawsuit of Patty wearing the copycat logo,
- 18:47including at an award ceremony for Out magazine.
- 18:50So this would be where they were both saying that they've been
- 18:53trying to come to some agreement for years.
- 18:55OK, so that was something that Patty said, and that's also
- 18:58something that Patagonia was saying.
- 18:59But this all came to a head when Patty filed A trademark to use
- 19:03her name for, quote, apparel, marketing and events.
- 19:06Now, Patty claimed that she only trademarked her name to ensure
- 19:09she never loses the right to use it as that recently just
- 19:13happened to another drag queen. And I forget which drag queen it
- 19:15was. And all the articles that I was
- 19:17reading about this didn't reference which drag queen it
- 19:19was. But Annabelle told me about it
- 19:21on Thursday when we were talking about the initial story.
- 19:23So I'm sorry, Annabelle, that is disappointing.
- 19:25I know for you to hear, OK, so I still stand by what I said on
- 19:29Thursday, this is a very bad time in history to be filing
- 19:32this lawsuit. But I understand that brands
- 19:35also have to protect their trademarks, otherwise they do
- 19:38risk losing them. So trademark attorney Josh
- 19:40Gerbin told journalist Minnevon Burke of the situation that U.S.
- 19:44companies have a, quote, obligation under U.S. law to
- 19:47police their trademarks. Quote, if they were just to
- 19:49allow Patagonia to use his name in an unfettered way, they would
- 19:52actually potentially lose rights around the name.
- 19:55So the next person that came around that wanted to do
- 19:57something, they would point to Patagonia and say you're letting
- 20:00her sell shirts and you're letting her do all this stuff.
- 20:02And the business of trade marking is so important in the
- 20:05creative industry. So I understand why there is
- 20:07this kind of growing concern online from people talking about
- 20:11this lawsuit specifically and saying like 2 truths can exist
- 20:14here. This can be a very bad time for
- 20:17this lawsuit to be filed against her.
- 20:18And like, we don't want her to lose her organization.
- 20:22We want her to be able to continue her advocacy.
- 20:25We don't. Want her to have to pay over
- 20:26$1,000,000 in legal fees like all of those things can be true
- 20:30while also it can be true that it's important to protect the
- 20:34arts and to protect creatives and original content in this
- 20:38time. And that is some of the context
- 20:40that was missing when I reported on this story on Thursday.
- 20:44Anyways, guys, that's it for mini school today.
- 20:46Thank you so much for listening. I love you guys.
