The DOJ Gets Smacked Down By Judge Englemayer As He Denies The Grand Jury Request · The Vault: The Epstein Files

• 0:00
Speaker 1: What's up everyone, and welcome to another episode of the
• 0:02
Speaker 1: Epstein Chronicles. So Judge Ingelmeyer has given a stamp of
• 0:07
Speaker 1: approval to the Department of Justice and their emotion to
• 0:11
Speaker 1: unseal the Glen Maxwell files from the investigation into her
• 0:15
Speaker 1: that led to her arrest and her conviction. And this
• 0:19
Speaker 1: comes after previously denying the request for these same files
• 0:23
Speaker 1: made by the Department of Justice. So what's changed, Well,
• 0:28
Speaker 1: there's a new law that's been passed by Congress and
• 0:30
Speaker 1: the Senate and signed by the President, so that certainly
• 0:34
Speaker 1: changes things. So today we have a quick article from
• 0:37
Speaker 1: CNN and then I'll go a little bit deeper about
• 0:40
Speaker 1: what I think is really going on under the surface.
• 0:43
Speaker 1: All right, So first things first, Like I said, this
• 0:46
Speaker 1: article was published by CNN and the author of this
• 0:50
Speaker 1: article is Hannah Rabinowitz. A federal judge in New York
• 0:55
Speaker 1: on Tuesday granted the Justice Department's request to unseal records
• 0:58
Speaker 1: from the investigation and criminal prosecution of Glenn Maxwell. The
• 1:03
Speaker 1: ruling from Judge Paul Engelmeyer opens the door for the
• 1:06
Speaker 1: Department to publicly release evidence it had gathered against Maxwell,
• 1:11
Speaker 1: an associate of sex offender Jeffrey Epstein, an associate, How
• 1:15
Speaker 1: about co conspirator? How about fellow child abuser? Probably want
• 1:19
Speaker 1: to go somewhere in that direction. The trove of documents,
• 1:23
Speaker 1: which will be redacted to protect victim's identities and other
• 1:27
Speaker 1: identifiable information, includes grand jury transcripts, financial records, travel documents,
• 1:32
Speaker 1: and notes from victim interviews obtained during the investigations. It's
• 1:38
Speaker 1: not yet clear when the Department plans to make the
• 1:40
Speaker 1: documents public or how much of the material will be new.
• 1:44
Speaker 1: Some of the evidence in the case came out during
• 1:46
Speaker 1: Maxwell's trial, and Congress has released a trove of records
• 1:50
Speaker 1: in recent weeks. Contrary to the do Jay's depiction, the
• 1:55
Speaker 1: grand jury materials would not reveal new information of any
• 1:59
Speaker 1: conscot quins, Angelmeyer wrote. Angle Meyer's the second judge to
• 2:04
Speaker 1: order investigative files be made public since the Epstein Files
• 2:09
Speaker 1: Transparency Act was signed into law last month. A judge
• 2:12
Speaker 1: in Florida made a similar ruling last week. The Justice
• 2:16
Speaker 1: Department has also filed a request unsealed records to a
• 2:19
Speaker 1: third judge who oversaw epstein short lived prosecution in New York.
• 2:24
Speaker 1: That judge has not yet issued a ruling. All right,
• 2:27
Speaker 1: so there's the story, right, The grand jury files are
• 2:31
Speaker 1: coming out, But of course the ruling comes wrapped in
• 2:35
Speaker 1: a very deliberate warning label. He went out of his
• 2:38
Speaker 1: way to tell the public not to expect fireworks, revelation,
• 2:41
Speaker 1: or some magic key that suddenly unlocks the entire Epstein labyrinth.
• 2:46
Speaker 1: And that warning's not just judicial modesty, it's expectation management
• 2:50
Speaker 1: born from experience. The Grand jury records rarely read by
• 2:54
Speaker 1: confessions or exposed secret villains, twirling mustaches, their procedural uneven
• 2:59
Speaker 1: and alle often frustratingly narrow. That doesn't mean they're meaningless,
• 3:04
Speaker 1: just that they don't function as narrative. Closure courts don't
• 3:08
Speaker 1: exist to satisfy a public outrage, even when that outrage
• 3:11
Speaker 1: is completely justified. Angelmeyer knows this, and he made sure
• 3:15
Speaker 1: everyone heard it before the document hit daylight. What makes
• 3:19
Speaker 1: the ruling notable is in the judge's caution. It's the speed.
• 3:22
Speaker 1: Grand jury secrecy is one of the most stubborn doctrines
• 3:25
Speaker 1: in the federal system, and it usually bends only after
• 3:28
Speaker 1: prolonged resistance. Here it cracks surprisingly fast that follows closely
• 3:34
Speaker 1: on the heels of another judge approving similar releases in
• 3:37
Speaker 1: a separate jurisdiction that back to back timing is not
• 3:41
Speaker 1: random or coincidental. Judges don't operate in a vacuum, and
• 3:46
Speaker 1: they are acutely aware of institutional context. When two different
• 3:50
Speaker 1: courts move quickly on similar transparency questions, it signals something
• 3:54
Speaker 1: larger at work, and at a minimum, it suggests to
• 3:57
Speaker 1: me in patience with delay tactics. At maximum, it reflects
• 4:02
Speaker 1: a judiciary unwilling to be used as a shield. The
• 4:06
Speaker 1: Trump administration clearly believed that invoking executive authority, national security fog,
• 4:11
Speaker 1: and procedural delay would slow this entire process to a crawl.
• 4:15
Speaker 1: That assumption wasn't unreasonable given how often these moves have
• 4:19
Speaker 1: succeeded in the past. Delay has always been the friend
• 4:22
Speaker 1: of scandal management. Every month that passes dulls public attention
• 4:26
Speaker 1: and fractures momentum. The administration played that familiar hand again here.
• 4:32
Speaker 1: What they didn't account for was a judiciary increasingly skeptical
• 4:35
Speaker 1: of being drafted into political stall campaigns. These judges aren't deaf, blind,
• 4:41
Speaker 1: or immune to pattern recognition. When delay smells like strategy
• 4:44
Speaker 1: instead of necessity, tolerance drops quickly and it looks like
• 4:49
Speaker 1: Ingelmeyer's ruling fits squarely into that broader judicial mood. Didn't posture, grandstand,
• 4:54
Speaker 1: or moralize, which is exactly why the decision matters. It
• 4:58
Speaker 1: was clean, procedural, devastatingly simple, no endless briefing schedule, no
• 5:03
Speaker 1: procedural purgatory, no theatrical hand ringing. He acknowledged the limits
• 5:08
Speaker 1: of what the documents would reveal while still authorizing their release.
• 5:12
Speaker 1: That combination undercuts every argument against transparency at once. You
• 5:17
Speaker 1: can't accuse the court of feeding conspiracy while also being
• 5:19
Speaker 1: denied secrecy. And hopefully this decision leaves obstruction with nowhere
• 5:24
Speaker 1: to hide. Hopefully it's a quiet dismantling rather than a
• 5:28
Speaker 1: dramatic blow. The warning that there will be nothing new
• 5:31
Speaker 1: also deserves to be read carefully rather than dismissed. What
• 5:35
Speaker 1: judges consider new and what the public considers new are
• 5:38
Speaker 1: two different things. Courts look for novel facts that alter
• 5:42
Speaker 1: legal conclusions. The public looks for patterns, confirmations, and omissions
• 5:46
Speaker 1: that tell a story of institutional behavior. A document doesn't
• 5:50
Speaker 1: need a shocking revelation to be damning. Sometimes repetition is
• 5:54
Speaker 1: the indictment. Sometimes what isn't there matters more than what is.
• 6:00
Speaker 1: Judges know this, even if they don't say it out loud.
• 6:03
Speaker 1: Grand jury material can illuminate who has asked questions, what
• 6:06
Speaker 1: lines of inquiry mattered, and what angles were ignored entirely.
• 6:10
Speaker 1: It shows priorities, not just outcomes, and in a case
• 6:14
Speaker 1: like Maxwell's, those priorities are everything. The Epstein case has
• 6:19
Speaker 1: never been about a lack of evidence. It's been about
• 6:21
Speaker 1: selective curiosity. When you see what prosecutors pursued vigorously and
• 6:26
Speaker 1: what they stepped around politely, the shape of the system
• 6:29
Speaker 1: becomes visible. That visibility is uncomfortable for institutions that survive
• 6:34
Speaker 1: on opacity. Transparency doesn't have to reveal monsters to expose misconduct.
• 6:39
Speaker 1: Sometimes it just reveals indifference, and in my opinion, the
• 6:44
Speaker 1: rapid approval of these releases suggests judges are done indulging
• 6:48
Speaker 1: the myth that secrecy equals stability. For decade, secrecy has
• 6:52
Speaker 1: been defended as necessary to protect institutions from erosion of trust.
• 6:57
Speaker 1: In practice, it's done the opposite. Each withheld document becomes
• 7:01
Speaker 1: its own scandal. Each delay fuels deeper suspicion. Courts are
• 7:06
Speaker 1: not blind to this dynamic. They see how quickly legitimacy
• 7:09
Speaker 1: burns when information is hoarded. Transparency becomes not a concession
• 7:14
Speaker 1: but a defensive act. And it looks like the judiciary
• 7:17
Speaker 1: understands that credibility is easier to keep than to rebuild.
• 7:22
Speaker 1: From an institutional perspective, this is a judge reclaiming control
• 7:25
Speaker 1: of their own authority. The executive branch does not get
• 7:29
Speaker 1: to decide and definitely what the public can see just
• 7:31
Speaker 1: by invoking tradition. Grand jury secrecy is a tool, not
• 7:35
Speaker 1: a weapon. When that tool is used to obstruct accountability,
• 7:38
Speaker 1: courts have every right to intervene, and these rulings make
• 7:42
Speaker 1: that boundary explicit. They remind everyone that no administration owns
• 7:47
Speaker 1: the justice system. Judges do not answer to political strategy.
• 7:51
Speaker 1: They answer to the law. The Trump administration's apparent miscalculation
• 7:56
Speaker 1: lies in underestimating how exhausted the courts are with Epstein
• 7:59
Speaker 1: adjacent mavering. This case has become a stress test for
• 8:03
Speaker 1: institutional patients. Every delay feels less defensible than the last,
• 8:08
Speaker 1: Every claim of necessity brings more hollow with repetition, and
• 8:12
Speaker 1: judges shouldn't be ideological actors here. They're referees tired of
• 8:17
Speaker 1: watching one team refuse to stop the clock. When that happens,
• 8:20
Speaker 1: penalties follow, not dramatic ones, but decisive ones, and calling
• 8:25
Speaker 1: this account down to D day, I don't think hyperbole.
• 8:28
Speaker 1: I think it's process reality. Once grand jury materials begin
• 8:31
Speaker 1: to unseal, the momentum builds. Each release generates pressure for
• 8:36
Speaker 1: the next. Each disclosure reframes what secrecy was supposedly protecting.
• 8:40
Speaker 1: The dam never breaks all at once, it cracks incrementally.
• 8:44
Speaker 1: Courts understand this trajectory better than anyone. They've seen it
• 8:48
Speaker 1: in corruption cases, civil rights cases, and organized crime prosecutions.
• 8:53
Speaker 1: Once transparency starts, reversal is politically and legally difficult. That's
• 8:58
Speaker 1: why the first crack matters most. And look, it's important
• 9:03
Speaker 1: not to confuse judicial caution with judicial retreat. Ngelmeyer didn't
• 9:08
Speaker 1: say that the files were unimportant. He said expectations should
• 9:11
Speaker 1: be realistic, and I think that that distinction matters because
• 9:15
Speaker 1: it preserves the seriousness of the process. Courts don't want
• 9:19
Speaker 1: to be turned into entertainment platforms. They also don't want
• 9:22
Speaker 1: to be accomplices to concealment. This ruling walks that line intentionally.
• 9:27
Speaker 1: It releases information without promising drama, and of course, the
• 9:32
Speaker 1: broader implication is that Epstein related secrecy is no longer
• 9:35
Speaker 1: being treated as sacred. For years, every attempt to pry
• 9:39
Speaker 1: open these records was met with reflexive resistance. Now the
• 9:42
Speaker 1: reflex appears reversed. Judges are increasingly asking why secrecy still applies,
• 9:48
Speaker 1: rather than why transparency should be denied. That inversion is seismic,
• 9:53
Speaker 1: and legal terms, it means the burden is shifted. Instead
• 9:57
Speaker 1: of journalists and advocates fighting uphill, institute utions must now
• 10:01
Speaker 1: justify continued concealment. That's a fundamental change in the terrain,
• 10:06
Speaker 1: and the shift also signals something about the judiciary's view
• 10:09
Speaker 1: of public interest. Courts traditionally resists arguments grounded and public curiosity.
• 10:15
Speaker 1: They're more receptive to arguments grounded in systemic harm. Epstein
• 10:20
Speaker 1: represents systemic harm in concentrated form. This is not a
• 10:24
Speaker 1: single defendant story, It's a network story. Judges know that
• 10:28
Speaker 1: shielding network behavior under the guise of tradition undermines the
• 10:31
Speaker 1: justice system itself, and in that form, transparency becomes a corrective,
• 10:36
Speaker 1: not a concession. And when you look at it through
• 10:38
Speaker 1: that lens, these rulings make sense for observers who have
• 10:42
Speaker 1: followed this case closely. The real value lies in corroboration.
• 10:46
Speaker 1: The public doesn't need surprises anymore, it needs confirmation of
• 10:49
Speaker 1: what long has been suspected. Seeing the official record align
• 10:53
Speaker 1: with years of reporting matters. It validates scrutiny that was
• 10:56
Speaker 1: once dismissed as speculation. Court's release seeing these documents implicitly
• 11:01
Speaker 1: acknowledge that suspicion alone did not drive the demand for transparency.
• 11:06
Speaker 1: Evidence did, even if it was fragmented and buried. And
• 11:10
Speaker 1: I think it's also worth noting what this means for
• 11:12
Speaker 1: future high profile secrecy fights. Precedent isn't just written in opinions.
• 11:17
Speaker 1: It's written in patterns of decision making. Other judges see it.
• 11:21
Speaker 1: Future litigants will cite it. Secrecy arguments will face stiffer
• 11:25
Speaker 1: skepticism going forward. Epstein era exceptionalism is eroding. Courts are
• 11:31
Speaker 1: signaling that notoriety does not grant perpetual silence. That may
• 11:35
Speaker 1: be the most lasting impact of all, because in the end,
• 11:39
Speaker 1: this isn't about whether new name surface or shocking quotes emerge.
• 11:42
Speaker 1: It's about whether the machinery of justice remains accountable to
• 11:46
Speaker 1: the people it claims to serve. Angelmeyer's ruling answers that
• 11:50
Speaker 1: question quietly but firmly. The courts are no longer interested
• 11:54
Speaker 1: in protecting the comfort of powerful actors through endless delay.
• 11:57
Speaker 1: The Trump administration's gambit assume time was on its side.
• 12:01
Speaker 1: The judiciary just indicated otherwise. The clock is ticking, and
• 12:05
Speaker 1: this time it isn't slowing down. All of the information
• 12:09
