- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:04In this episode, we're going to pick up where we
- 0:06left off with a memorandum of law and support of
- 0:09John Dejeong's motion to dismiss the lawsuit brought against him
- 0:13by the survivors of Jeffrey Epstein. No long armed jurisdiction.
- 0:19CPLR Section three oh two A is New York's long
- 0:23arm statute for non domicillaries. None of the bases for
- 0:27personal jurisdiction appear in the fac There are no allegations
- 0:31that mister Dejeong Junior himself transacted any business within New York,
- 0:35contracted anywhere to supply goods or services in New York,
- 0:39committed a tortious act within New York, or owned or
- 0:42used or possessed any real property situated within New York
- 0:46CPLR three oh two A one and two and four.
- 0:50Nor have plaintiffs alleged facts supporting personal jurisdiction under CPLR
- 0:55three two A three, which requires first, mister DeJong committed
- 0:59a tortious act outside of New York. Second, the cause
- 1:02of action arose from that act. Third, the act caused
- 1:05injury to plaintiffs in New York. And fourth mister DeJong
- 1:09expected or should reasonably have expected the out of state
- 1:12act to have consequences in New York. And fifth mister
- 1:15DeJong derives substantial revenue from interstate or international commerce. The
- 1:20first and second requirements are not met. The fac does
- 1:24not allege the out of state tortious act is the
- 1:26approximate cause of injury in New York. I e. The
- 1:29act must be so close to the injury that reasonable
- 1:32people would regard it as a cause of the injury.

- 1:43out of state tortious acts by mister DeJong, let alone
- 1:46one that is so close to the injury as required
- 1:49by the Southern District. The third element is not met.
- 1:52The only specific allegations of sexual assault occurred in the
- 1:56USVII in Gilbert. The tortious act of rape occurred in Etiquette,
- 2:00and the first effects of that rape were felt in Connecticut,
- 2:04not New York as in Gilbert, although plaintiffs undoubtedly continued
- 2:08to experience pain and suffering from the rape upon their
- 2:11return to New York. A litigant may not carry an
- 2:14injury home for purpose of sanction. It is firmly established
- 2:17that the domicile or residence of an injured party within
- 2:21New York is not enough to establish personal jurisdiction. Rather,
- 2:25a more direct injury must have occurred within New York State.

- 2:39also group pleads nonspecific communications and transactions directed to New
- 2:44York by unnamed co conspirators and the defendants. Generally, the
- 2:48co conspirators are not necessarily the defendants, even if they were.
- 2:52Such nonspecific group allegations are not sufficient, even if group
- 2:56pleading was sufficient. Telephone calls, facts, transmission, and correspondence in
- 3:01connection with negotiations, and conduct that have a center of
- 3:04gravity well outside the state do not create personal jurisdiction.
