Why Do We Still Need Temporary Workers After 35 Years? · I Believe

• 0:03
SPEAKER_03: Welcome to I Believe, where we talk about governance and philosophy in America.
• 0:07
SPEAKER_03: I'm Joel Douglas, and I believe in America.
• 0:10
  SPEAKER_03: Thanks for joining me.
• 0:34
SPEAKER_00: Albert Einstein stepped off a passenger ship at the port of New York, carrying two suitcases and a violin case.
• 0:41
SPEAKER_00: He and his wife, Elsa, had fled Nazi Germany.
• 0:44
SPEAKER_00: His books were being burned.
• 0:46
SPEAKER_00: There was a bounty on his head, one million dollars.
• 0:49
  SPEAKER_00: He had to flee.
• 0:51
SPEAKER_00: The Institute for Advanced Study in Princeton, New Jersey, offered him refuge.
• 0:56
SPEAKER_00: American universities, including Harvard, Princeton, and Yale, kept Jewish faculty to a minimum under quotas that lingered into the late 1940s.
• 1:07
SPEAKER_00: In 1933, Germany barred universities from employing Jewish instructors.
• 1:13
SPEAKER_00: But Einstein's unparalleled scientific reputation made him an exception.
• 1:18
  SPEAKER_00: By 1940, he became a U.S.
• 1:20
  SPEAKER_00: citizen.
• 1:22
SPEAKER_00: A hunted mind found safety and gave its work to the country that offered it.
• 1:27
SPEAKER_00: His was the story of America's ability to attract extraordinary talent in times of global crisis, benefiting both the individual and the country.
• 1:37
  SPEAKER_00: Then a great war.
• 1:43
SPEAKER_00: Twelve years later, in September 1945, Werner von Braun arrived at Fort Strong, Boston Harbor, under very different circumstances.
• 1:52
SPEAKER_00: He was a prisoner under military control, not a welcome guest.
• 1:56
SPEAKER_00: Von Braun had been a key figure in Germany's rocket program.
• 2:00
SPEAKER_00: He surrendered to the U.S.
• 2:01
SPEAKER_00: Army in the Alps and denied Nazi allegiance.
• 2:05
SPEAKER_00: Through Operation Paperclip, the Army shifted his custody into contract work.
• 2:10
SPEAKER_00: In total, we brought over more than 1,600 German scientists in similar fashion.
• 2:16
SPEAKER_00: America faced a critical shortage of expertise in rocketry, and the Germans were good at rockets.
• 2:22
SPEAKER_00: Operation Paperclip prioritized strategic advantage in a rapidly escalating Cold War.
• 2:28
SPEAKER_00: We acquired technical skills to compete with the Soviet Union.
• 2:32
SPEAKER_00: Yes, von Braun's past and role in Germany's rocket program were controversial, but his expertise helped lay the foundation for America's space program, including the Apollo missions.
• 2:44
SPEAKER_00: Von Braun would lead teams that researched space programs and weapons technology.
• 2:48
SPEAKER_00: He later became the director of NASA's Marshall Space Flight Center in Huntsville, Alabama.
• 2:56
SPEAKER_03: Our stories highlight two phases of America's approach to global talent.
• 3:01
SPEAKER_03: Einstein's arrival was a humanitarian and intellectual triumph.
• 3:05
SPEAKER_03: We welcomed a persecuted genius.
• 3:08
SPEAKER_03: He enriched our scientific landscape.
• 3:11
SPEAKER_03: Operation Paperclip, by contrast, was a shortcut.
• 3:14
SPEAKER_03: We imported expertise rather than developing it.
• 3:18
SPEAKER_03: We chose to prioritize providing for the national defense over the longer work of creating homegrown American rocket scientists.
• 3:26
SPEAKER_03: It would not be the last time we brought in talent rather than built it here at home.
• 3:34
  SPEAKER_02: November 29, 1990, the White House.
• 3:39
SPEAKER_02: It was the day after Thanksgiving.
• 3:42
  SPEAKER_02: President George H.
• 3:43
  SPEAKER_02: W.
• 3:44
SPEAKER_02: Bush was about to sign what seemed like routine paperwork.
• 3:48
SPEAKER_02: The Immigration Act of 1990 sailed through Congress with bipartisan support.
• 3:53
SPEAKER_02: Democrats held strong majorities in both the House and Senate, but Republicans voted for it too.
• 3:59
SPEAKER_02: Senator Ted Kennedy shepherded it.
• 4:02
SPEAKER_02: Bush praised it as expanding basic entry rights beyond numbers.
• 4:07
SPEAKER_02: Buried in technical language was a new tool, an H-1B visa for temporary workers and specialty occupations, a cap of 65,000.
• 4:17
SPEAKER_02: It felt generous for the handful of firms that might need niche skills.
• 4:21
SPEAKER_02: The press barely noticed the H-1B provision.
• 4:25
SPEAKER_02: Nobody understood we had just created a constitutional time bomb.
• 4:29
SPEAKER_02: By 1998, the dot com boom raged.
• 4:32
SPEAKER_02: Tech companies begged for more skilled workers in STEM fields.
• 4:36
SPEAKER_02: For the first time, we reached the 65,000 visa cap.
• 4:40
SPEAKER_02: Instead of asking why American universities weren't producing the workers American companies desperately needed, Congress simply raised the cap.
• 4:49
SPEAKER_02: Then, we raised the cap again to one hundred and fifteen thousand.
• 4:54
SPEAKER_02: Today, the nominal cap is sixty five thousand plus twenty thousand for U.S.
• 4:59
SPEAKER_02: advanced degrees, with exemptions and extensions that let total approvals exceed the cap.
• 5:05
SPEAKER_02: It's the same pattern each time.
• 5:08
SPEAKER_02: Companies complain about shortages, and Congress increases the supply of foreign workers.
• 5:17
SPEAKER_03: Nobody asked the hard question.
• 5:23
SPEAKER_03: Thirty-five years later, that same temporary program turned constitutional failure, just got a hundred thousand dollar price tag.
• 5:30
SPEAKER_03: But the underlying problem, the broken infrastructure we need to develop human capability, remains untouched.
• 5:38
SPEAKER_03: If this is a temporary measure we've already had for thirty-five years, let's ask some easy questions.
• 5:45
SPEAKER_03: What conditions must we achieve to reach readiness?
• 5:49
SPEAKER_03: How will we know we achieved those conditions?
• 5:53
SPEAKER_03: How long is too long to keep the program?
• 5:55
SPEAKER_03: How much preference is too much?
• 5:58
SPEAKER_03: If the goal is a tech ready American workforce, who decides when we should kill the program?
• 6:04
SPEAKER_03: What Ted Kennedy and George Bush created in 1990 wasn't an immigration program.
• 6:11
SPEAKER_03: It was an admission of constitutional failure, a band-aid slapped over a bleeding cut, our inability to fulfill two of our founding promises, to promote the general welfare and establish justice.
• 6:26
SPEAKER_03: Our constitutional goals often compete.
• 6:29
SPEAKER_03: We sometimes ignore one to prioritize another.
• 6:33
SPEAKER_03: But not in this case.
• 6:34
SPEAKER_03: In this case, we just flat out ignore two of them at the same time.
• 6:38
SPEAKER_03: Call infrastructure what it is, the general welfare.
• 6:43
SPEAKER_03: If we expand H1B, we admit we failed to build the system that produces capability.
• 6:50
SPEAKER_03: Justice is the fierce guardian of opportunity.
• 6:53
SPEAKER_03: We withhold that protection when we keep Americans born in even our poorest areas from the system.
• 7:00
SPEAKER_03: And we're still overlooking our constitutional requirements today.
• 7:07
SPEAKER_00: September 25, 2025, Capitol Hill, Senators Chuck Grassley and Dick Durbin, Republican and Democrat, sent identical letters to America's biggest companies.
• 7:19
SPEAKER_00: Amazon, Apple, Microsoft, Google, JP Morgan Chase.
• 7:24
  SPEAKER_00: The question was simple.
• 7:26
SPEAKER_00: Why are you hiring foreign workers while laying off tens of thousands of Americans?
• 7:31
SPEAKER_00: The numbers told the story Congress refused to see for 35 years.
• 7:35
SPEAKER_00: Amazon alone got approval for more than 14,000 new H-1B hires in fiscal 2025, the most of any company, even as it announced layoffs affecting tens of thousands of American jobs.
• 7:49
SPEAKER_00: Microsoft, Meta, Google followed the same pattern.
• 7:53
  SPEAKER_00: Hire foreign, fire domestic.
• 7:55
SPEAKER_00: The senators wrote to CEO Andy Jassy, quote, with all of the homegrown American talent relegated to the sidelines, we find it hard to believe that Amazon cannot find qualified American tech workers to fill these positions, end quote.
• 8:11
SPEAKER_00: The median H1B salary hit$120,000 in 2024, nearly double what the average American worker earns.
• 8:19
  SPEAKER_00: These aren't low-skill jobs being outsourced.
• 8:22
SPEAKER_00: They are exactly the high-paying careers we promise American students they can achieve through education and training.
• 8:41
SPEAKER_03: Amazon can process 14,000 foreign visa applications, but claims it can't find qualified Americans.
• 8:48
SPEAKER_03: We've abandoned the infrastructure that should create American capability and the welfare in favor of global recruitment.
• 8:57
SPEAKER_03: There's another question we have to ask.
• 8:59
SPEAKER_03: Is there justice for small businesses?
• 9:02
SPEAKER_03: These big tech companies can absorb the$100,000 fee and keep hiring foreign workers.
• 9:08
  SPEAKER_03: Amazon processed 14,000 H1B applications.
• 9:12
  SPEAKER_03: What's another$1.4 billion to them?
• 9:15
SPEAKER_03: Microsoft, Google, and Meta can simply pay the tax and move on.
• 9:20
SPEAKER_03: But the startup in your town, the small software company trying to compete with Amazon, the local engineering firm bidding against Deloitte, they can't afford a$100,000 visa fee.
• 9:31
SPEAKER_03: Because we haven't built our necessary tech infrastructure, they get priced out of skilled talent entirely.
• 9:39
SPEAKER_03: When we create a two-tiered system where only the biggest corporations can access global talent, we're rigging the game against small business owners.
• 9:48
SPEAKER_03: The fee doesn't solve America's skill shortage.
• 9:51
SPEAKER_03: It hands Amazon an even bigger competitive advantage.
• 9:55
SPEAKER_03: The Constitution promises to establish justice, not auction it off to the highest bidder.
• 10:00
SPEAKER_03: We didn't fix the pipeline.
• 10:02
SPEAKER_03: We priced out the people who could.
• 10:05
SPEAKER_03: Eighty years of shortcuts have brought us here, but the Constitution offers a different path.
• 10:17
SPEAKER_02: In 1945, we imported German rocket scientists instead of training Americans.
• 10:23
SPEAKER_02: In the late 1990s, we imported H-1B tech workers instead of training Americans.
• 10:30
SPEAKER_02: In 2025, we raised H-1B fees instead of training Americans.
• 10:35
SPEAKER_02: Rather than decisive efforts to fix our deficiency, we bring in skilled immigrant workers from nations that do a better job of achieving our goals than we have.
• 10:46
SPEAKER_02: Each time we chose the shortcut over the constitutional path.
• 10:50
SPEAKER_02: Each time we treated symptoms instead of causes.
• 10:54
SPEAKER_02: Each time we failed to ask the fundamental question, what would it take to make these visas unnecessary?
• 11:06
SPEAKER_03: The answer isn't complicated, it's just hard.
• 11:09
SPEAKER_03: Lucky for us, America is a great nation with tremendous resources.
• 11:16
SPEAKER_03: If we're serious about reducing H1B dependency, not just making it more expensive, we need to address the infrastructure failure that created the problem.
• 11:26
SPEAKER_03: Three specific steps would transform our approach from band-aid to cure.
• 11:32
SPEAKER_03: First, measure H1B applications per capita.
• 11:36
SPEAKER_03: Stop tracking how much money we spend on training programs and start measuring whether they work.
• 11:42
SPEAKER_03: H1B applications are a direct measure of American workforce readiness.
• 11:47
SPEAKER_03: When applications drop, we're succeeding.
• 11:49
SPEAKER_03: When they rise, we're failing.
• 11:52
SPEAKER_03: Make this the primary metric for evaluating our education and training infrastructure.
• 11:58
SPEAKER_03: Second, require H1B companies to participate in local training.
• 12:04
SPEAKER_03: Any company filing H1B applications must demonstrate active participation in developing American talent.
• 12:12
SPEAKER_03: Partner with community colleges, host career days, present real world challenges to students.
• 12:19
SPEAKER_03: No participation, no visa applications.
• 12:22
SPEAKER_03: This aligns private profit with public need, exactly what the Constitution requires.
• 12:29
SPEAKER_03: Third, eliminate student loan interest for low income students.
• 12:33
  SPEAKER_03: The government isn't a for-profit institution.
• 12:37
SPEAKER_03: The nation benefits when its citizens improve their capabilities.
• 12:42
SPEAKER_03: Charging interest on federal student loans for low income students creates a barrier to the technical education we need.
• 12:50
  SPEAKER_03: Genius hides in poverty.
• 12:52
  SPEAKER_03: Remove that barrier.
• 12:55
  SPEAKER_03: These aren't radical proposals.
• 12:57
SPEAKER_03: They're constitutional obligations we've ignored for 35 years while wondering why we still need temporary foreign workers to fill permanent American needs.
• 13:08
SPEAKER_03: The question isn't whether we can afford to invest in American capability.
• 13:12
SPEAKER_03: The question is whether we can afford not to.
• 13:19
SPEAKER_03: So, why do we still need temporary workers after 35 years?
• 13:25
SPEAKER_03: Einstein's arrival was a triumph, for him and for America.
• 13:29
SPEAKER_03: Von Brown's expertise launched our space program.
• 13:33
SPEAKER_03: Both stories show immigration enriching our nation.
• 13:37
SPEAKER_03: But neither shows us building the infrastructure that creates American capability.
• 13:43
SPEAKER_03: The H-1B program continues this pattern.
• 13:46
SPEAKER_03: It fills immediate needs but doesn't address the underlying question.
• 13:51
SPEAKER_03: Why can't we systematically develop the talent we keep importing?
• 13:56
SPEAKER_03: It doesn't promote the general welfare because we're not building American capability.
• 14:02
SPEAKER_03: Nor does it establish justice because it ignores homegrown American tech workers and prices small businesses out of competition.
• 14:11
SPEAKER_03: Let's get back to our questions.
• 14:13
SPEAKER_03: Again, H1Bs are a temporary measure we've already had for 35 years.
• 14:19
SPEAKER_03: What conditions must we achieve to reach national tech readiness?
• 14:23
SPEAKER_03: How will we know we achieved those conditions?
• 14:26
SPEAKER_03: How long is too long to keep the program?
• 14:29
SPEAKER_03: How much preference to corporations is too much?
• 14:33
SPEAKER_03: If the goal is a tech ready American workforce, who decides when we should kill it?
• 14:38
  SPEAKER_03: These aren't rhetorical questions.
• 14:40
  SPEAKER_03: They are real questions.
• 14:42
SPEAKER_03: They demand specific answers from policymakers.
• 14:45
SPEAKER_03: They're the questions Congress should have been asking since 1998.
• 14:49
SPEAKER_03: They expose we've never planned to end H1B dependency.
• 14:54
SPEAKER_03: So instead of building infrastructure that lets every American kid lead the world in tech innovation, we're still asking the same question we've avoided for thirty five years.
• 15:04
SPEAKER_03: Why do we still need temporary workers after all these years?
• 15:08
SPEAKER_03: The constitutional violation is the infrastructure neglect, not the immigration.
• 15:14
SPEAKER_03: Immigration works when America offers opportunity.
• 15:18
SPEAKER_03: We should build the infrastructure that offers that same opportunity to Americans too.
• 15:24
SPEAKER_03: May God bless the United States of America.
