- 0:04Speaker 1: on demand on the iHeartRadio.
- 0:06Speaker 2: F you are listening to the bill Handle Show.
- 0:10Speaker 3: Welcome the.
- 0:13Speaker 1: COKI AM six forty bill Handle here on a Monday morning,
- 0:19Speaker 1: October sixth, and the new Supreme Court term begins today.
- 0:23Speaker 1: We'll talk a lot more about that. We're still waiting
- 0:27Speaker 1: for Israel Kamas ceasefire toox to see how those pan out.
- 0:31Speaker 3: And here's a fun story.
- 0:33Speaker 1: Disney's Disneyland's newest ride, and that is the truck up
- 0:37Speaker 1: Mount Everest. As hundreds of people are in line to
- 0:42Speaker 1: sum edit, around three hundred people three hundred fifty were evacuated.
- 0:48Speaker 1: The ride actually broke down at a certain point. It's
- 0:52Speaker 1: like other rides at breakdown, and two hundred other people
- 0:56Speaker 1: are still waiting to be rescued. Blizzard came in and
- 1:00Speaker 1: people who go to Mount Everest they die. It's the
- 1:02Speaker 1: death ride. Very impressive. Hoa's You know, most of us
- 1:08Speaker 1: live under HOA rules, regulations, and the HOA laws. Sixty
- 1:12Speaker 1: five percent of Californians live under HOA.
- 1:16Speaker 3: I have an HOA. I've lived under HOA for years
- 1:18Speaker 3: and year.
- 1:19Speaker 1: As a matter of fact, for a period of time,
- 1:21Speaker 1: I was living in a rental house that was on
- 1:24Speaker 1: a street.
- 1:24Speaker 3: It was a public street. There was an HOA there.
- 1:28Speaker 1: So Michael Kushner, who have known for thirty years, practices
- 1:32Speaker 1: HOA law that is his specialty, and we were talking
- 1:37Speaker 1: about a bill that sneaked through the legislature, AB one thirty,
- 1:43Speaker 1: and man, it changes everything, and how he got through
- 1:46Speaker 1: I don't know, Michael.
- 1:48Speaker 3: Thanks for joining us, no prom thanks for having me go.
- 1:52Speaker 1: Okay, So let's talk about AB one thirty, what it does,
- 1:55Speaker 1: what it undoes, and the big changes that we're looking at.
- 1:59Speaker 4: Okay, Well, let me give you a quick rundown. Then
- 2:02Speaker 4: AB one thirty basically made some changes to a few
- 2:06Speaker 4: different statutes in California, including a few in the Davis
- 2:11Speaker 4: Stirling Act, which is the law that governs hoas in California.
- 2:15Speaker 4: And there's a couple of good things that came from
- 2:17Speaker 4: ABY one to thirty, but for the most part, it's
- 2:19Speaker 4: a disastrous law that almost every attorney on both sides
- 2:22Speaker 4: of the issue don't like. So what it did, I'll
- 2:25Speaker 4: give you the good things. First. One thing that it
- 2:27Speaker 4: did is it froze or it eliminated and prohibited hoas
- 2:33Speaker 4: from charging interest or penalties on unpaid fines. I don't
- 2:36Speaker 4: have a problem with that, because that was a big
- 2:38Speaker 4: problem and it did resolve that. Another thing it did
- 2:42Speaker 4: is it, although this was useless because we already had
- 2:44Speaker 4: strong California law in support, is that it reaffirmed this,
- 2:48Speaker 4: you know, the public policy behind ADUs accessory dwelling units,
- 2:53Speaker 4: and it basically clarified what reasonable restrictions were or weren't.
- 2:59Speaker 4: But the best of it is the disastrous. So here's
- 3:02Speaker 4: one thing it did. It capped HA finds it one
- 3:04Speaker 4: hundred dollars per violation unless it unless the fine related
- 3:09Speaker 4: to health or safety issue. Okay, on its surface, that
- 3:12Speaker 4: sounds wonderful. The problem is in all the things that
- 3:15Speaker 4: bill didn't address, it left so many gaps, so many
- 3:19Speaker 4: unanswered questions, that the good hys out there are going
- 3:22Speaker 4: to do one of two things rather going to do nothing,
- 3:25Speaker 4: which means that they aren't going to be enforcing governing
- 3:27Speaker 4: documents because they're scared of being sued and losing and
- 3:31Speaker 4: having attorneys sees assessed against them, or they're going to
- 3:35Speaker 4: skip the finding process and just go right to litigation,
- 3:40Speaker 4: in which case everybody's fees are going to go way up.
- 3:43Speaker 4: Attorneys are going to be hired a lot more because
- 3:45Speaker 4: these aren't insurance cases. So the unanswered questions on top
- 3:50Speaker 4: of that, one good thing is what makes this a disaster?
- 3:54Speaker 4: And how you get the examples if you want.
- 3:56Speaker 1: Yeah, but one of the things we talked about, Yeah,
- 3:59Speaker 1: we'll talk about an example. But the one that we
- 4:00Speaker 1: talked about, which I thought was the most compelling, is
- 4:04Speaker 1: that heretofore if I owned a home within an HOA
- 4:08Speaker 1: and there were restrictions which they all have in terms
- 4:11Speaker 1: of the color of the house and what you can
- 4:14Speaker 1: do with the roof, if I go crazy and paint
- 4:18Speaker 1: my house neon purple, they can't do anything about it,
- 4:23Speaker 1: the HOA.
- 4:23Speaker 3: Except hit me with one hundred dollars. Is that correct?
- 4:27Speaker 4: Well, okay, so that's one of the problems finding wise,
- 4:30Speaker 4: you're actually right. And so if you have a neighbor
- 4:33Speaker 4: that paints their house purple or props up an old
- 4:36Speaker 4: car on their lawn, which every HOA says you can't do,
- 4:40Speaker 4: and the HOA wants to find the finding one hundred bucks,
- 4:44Speaker 4: which totally reasonable, I would take that. So I can
- 4:47Speaker 4: have a purple house if that's what I wanted. The
- 4:49Speaker 4: problem is a lot of hoas are not going to
- 4:53Speaker 4: do that. Instead, they're just going to sue you for
- 4:56Speaker 4: breaching the governing documents, which is gonna throw litigation through
- 5:00Speaker 4: the roof. We're gonna see we're already seeing it a
- 5:02Speaker 4: lot more cases being sent into a dr which is
- 5:06Speaker 4: a precursor to litigation when when an HOA is seeking
- 5:09Speaker 4: a jump to relief for example. And so we're already
- 5:12Speaker 4: seeing that that number multiply and it's only been a
- 5:15Speaker 4: few months.
- 5:16Speaker 1: Okay, so you can't you can't be too upset about that, Michael,
- 5:19Speaker 1: because that's what you practice, right.
- 5:21Speaker 4: That's right. But but at the same time, I tell
- 5:24Speaker 4: the truth to my to my listeners on my podcast,
- 5:26Speaker 4: and to my clients. I tell the truth and say,
- 5:28Speaker 4: here's here's the promise of the law. It's gonna hurt
- 5:31Speaker 4: good HSOA members people that follow the rules. It's gonna
- 5:36Speaker 4: hurt them because they're going to either be paying a
- 5:38Speaker 4: lot more money in dues to pay for all those lawyers,
- 5:42Speaker 4: or they're going to uh, they're going to be paying Uh.
- 5:45Speaker 4: They're gonna have to handle it themselves. They're gonna have
- 5:47Speaker 4: to be directly confrontation with neighbors by filing a lawsuit,
- 5:51Speaker 4: because unless you want to live next to the purple house,
- 5:54Speaker 4: somebody has to do something.
- 5:55Speaker 1: We're talking about Assembly Bill one thirty and how it
- 5:58Speaker 1: affects all of us who live in the land of
- 6:00Speaker 1: Hoa would just sixty five percent of homeowners and none
- 6:04Speaker 1: of us knew this bill AB one thirty was passed
- 6:08Speaker 1: and real quick, Uh, if you can just do a
- 6:12Speaker 1: real quick recap and let's go on with this and uh,
- 6:15Speaker 1: and we'll talk about what's happening and what we can
- 6:17Speaker 1: do with anything.
- 6:20Speaker 4: Sure. So AB one thirty, UH presumably was supposed to
- 6:24Speaker 4: cap Hoa finds at one hundred dollars, which on its
- 6:28Speaker 4: surface sounds great, but it's the it's the unotended consequences
- 6:31Speaker 4: that flow from that. All. You know, they didn't define
- 6:34Speaker 4: health and safety, They didn't define whether or not you
- 6:37Speaker 4: know what what per per uh violation means. So for example,
- 6:42Speaker 4: somebody's you know, continuously violating something every day not doing
- 6:46Speaker 4: something is each day a new violation? Do they have
- 6:48Speaker 4: to do they have to write a new letter each
- 6:50Speaker 4: time demanding a new hearing because that used to be
- 6:52Speaker 4: throuted upon. That was called stacking. Uh, it's robbed good.
- 6:56Speaker 4: HOA is of the ability to properly police their own hoas,
- 7:00Speaker 4: which is going to hurt everybody and it's going to
- 7:03Speaker 4: greatly increase everybody's hoadus. We're already seeing that starting to
- 7:07Speaker 4: happen now because there's gonna be a lot more lawsuits
- 7:10Speaker 4: being filed. So it did a lot of things related
- 7:15Speaker 4: to fines, but it handled it very wrong because it
- 7:17Speaker 4: was rushed through.
- 7:18Speaker 3: Yeah, now it's what happened before.
- 7:21Speaker 1: And I get this on handle on the law constantly
- 7:24Speaker 1: there's a neighbor down the street who is parking, as
- 7:26Speaker 1: you have said, parking a car on his driveway and
- 7:31Speaker 1: it's on. You know, the tires are off, the wheels
- 7:34Speaker 1: are off, or the yard is not being taken care of.
- 7:40Speaker 3: There are just weeds all over the place. And what
- 7:43Speaker 3: could we do? And I always said, well, this the
- 7:46Speaker 3: the HOA.
- 7:47Speaker 1: The board can start nailing people and finding per day
- 7:51Speaker 1: and you can get thousands of dollars worth of fines.
- 7:54Speaker 3: Those days are gone.
- 7:56Speaker 4: Well, we're not sure now because the law didn't didn't
- 7:59Speaker 4: explain what per incident means were per violation. So in
- 8:03Speaker 4: the olden days before you know, pre AB one thirty.
- 8:07Speaker 4: Some abuse of hoa's would do what's called stacking, so
- 8:09Speaker 4: they would send new fine letters every day and have
- 8:13Speaker 4: multiple hearings backed up and stacked up. And that was
- 8:16Speaker 4: frowned upon by the courts. That was a bad thing.
- 8:18Speaker 4: But now that would be the only way in HOA
- 8:21Speaker 4: could stop that behavior short of filing the lawsuit.
- 8:25Speaker 1: And so when the HOA files a lawsuit, I mean
- 8:28Speaker 1: that's a big one. The HOA does have money, your money,
- 8:32Speaker 1: and the homeowner has to basically hire his or her
- 8:38Speaker 1: own attorney and then effectively, just the threat of a lawsuit.
- 8:43Speaker 3: Doesn't that do it? Because of the monetary aspects of this.
- 8:47Speaker 4: One would hope, But you know, this is what we
- 8:50Speaker 4: do every day, and we litigate all the time, so
- 8:54Speaker 4: you know, because we represent only homeowners and look at
- 8:57Speaker 4: all the people that hire us and they're paying for us.
- 9:00Speaker 4: So it depends how stubborn the person is, and it
- 9:03Speaker 4: depends how big the deal it is. I don't think
- 9:06Speaker 4: on a car issue that would be the big deal.
- 9:08Speaker 4: But let's talk about real life. We've had multiple clients
- 9:11Speaker 4: who have current issues ongoing. Now. For example, one of
- 9:15Speaker 4: our clients wants to build a is trying to build
- 9:16Speaker 4: a new balcony and it has been denied, even though
- 9:21Speaker 4: there's other balconies very similar, and that's the issue. He
- 9:24Speaker 4: called up and said, why don't I just do it.
- 9:27Speaker 4: I'll just you know, I'll pay the fine cost of
- 9:29Speaker 4: doing business, no problem. And we talked him out of that,
- 9:33Speaker 4: and we explained why we don't think he should do that. Now,
- 9:36Speaker 4: if the HWA were to sue him and he were
- 9:38Speaker 4: to just start construction, I think we'd win. But on
- 9:42Speaker 4: something a big ticket item like that, I could see
- 9:43Speaker 4: people fighting. And remember, when it's the HOA filing lawsuit,
- 9:47Speaker 4: there's no insurance covering the bill, so that money is
- 9:51Speaker 4: coming from the coffers, and most stays don't have spare
- 9:55Speaker 4: money to the litigate. They're going to have to specially assessed.
- 9:59Speaker 3: So what is happen?
- 10:01Speaker 1: You have a situation, Nana, You've been involved, these cases
- 10:03Speaker 1: are certainly starting these cases. Owner says I'm doing this,
- 10:08Speaker 1: HOA says, no owner decides I'm doing this.
- 10:11Speaker 3: Do they go to court? Is that really the only
- 10:14Speaker 3: avenue that either one of them can take?
- 10:17Speaker 4: If it's a big enough deal for the HOA and
- 10:19Speaker 4: there's no negotiating, you know, if the home owner won't
- 10:22Speaker 4: back down and he's already started construction or already built it,
- 10:25Speaker 4: the HOA is going to go file the lawsuit and
- 10:27Speaker 4: they're going to seek conjunctive relief first. That's often denied
- 10:32Speaker 4: if it's already done, if it's in process, the court
- 10:34Speaker 4: might might grant that and say, okay, stop construction, you know,
- 10:38Speaker 4: pending the resolution of the case. And like I said,
- 10:42Speaker 4: that's that works. If they get the objunctive relief that
- 10:45Speaker 4: that does it. That works.
- 10:47Speaker 3: Okay, So it just changed, It just changes everything. Are
- 10:49Speaker 3: you getting rich on this, by the way, Michael, and
- 10:51Speaker 3: I know you do it well.
- 10:52Speaker 4: Anyway, we're doing what We're seeing a lot more people
- 10:55Speaker 4: come in because of AB one thirty, and we're seeing
- 10:58Speaker 4: a lot more people the ADR demands have been made
- 11:02Speaker 4: by their hoas, which means exactly what I what I
- 11:06Speaker 4: foresaw happening is starting to happen. Is that they're forgetting
- 11:09Speaker 4: the finds and they're moving just right into the pre
- 11:11Speaker 4: litigation stage, which is good for us.
- 11:13Speaker 3: But yeah, h I don't want that.
- 11:16Speaker 1: Yeah, And I've been involved with our ho as for
- 11:18Speaker 1: years and man, I can't just imagine what this is
- 11:22Speaker 1: going to go. So for those of you that live
- 11:24Speaker 1: within an hoa, which is almost everybody, watch out for this.
- 11:27Speaker 3: Michael, you have a podcast and a book. Tell us
- 11:30Speaker 3: about that.
- 11:32Speaker 4: The podcast is available on YouTube and every other major platform.
- 11:35Speaker 4: It's called hoa Hell, and it's doing very well. We're
- 11:40Speaker 4: getting lots of views. I cover all of these issues.
- 11:43Speaker 4: I cover anything, anything and everything that will come up
- 11:46Speaker 4: from the homeowner perspective, I cover it. And then my
- 11:49Speaker 4: book is also called hoa Hell California Homeowner's Definitive Guide
- 11:53Speaker 4: to Beating Bad hoas. But it's available on pre order
- 11:56Speaker 4: on Amazon. He's type in hoa Hell and you'll see
- 11:59Speaker 4: a picture of a house a pitchfork in a lake
- 12:01Speaker 4: of fire.
- 12:01Speaker 3: That's very fair, all right, got it, Manuel, it's a manual.
- 12:07Speaker 3: I got it, all right.
- 12:10Speaker 4: With your h A.
- 12:10Speaker 3: Yeah, thank you sir, all right, thanks, great talk later. Yeah.
- 12:15Speaker 1: You know, it's for those people that have ever been
- 12:17Speaker 1: in ho a hell as he says, it's it's god awful.
- 12:22Speaker 1: It's god awful, and a lot of us, well sixty
- 12:24Speaker 1: five percent of us are. And I brought that in
- 12:26Speaker 1: because I've been involved in litigation under HOA law and
- 12:30Speaker 1: it is it costs me a fortune.
- 12:32Speaker 3: Okay, Uh, what is going on at the White House.
- 12:36Speaker 1: Some stuff, as I said, is really important to where
- 12:40Speaker 1: the country is going and affects all of us deeply.
- 12:43Speaker 3: And then there's some stuff that the President is doing that's.
- 12:45Speaker 1: Just fun and crazy, a woven crazy guy, and that's
- 12:50Speaker 1: what the President can be. So this one, uh, he
- 12:53Speaker 1: announced the date of the anticipated Ultimate Fighting Championship that
- 12:58Speaker 1: he's hosting at the White House, June fourteenth.
- 13:02Speaker 3: And it's not just out of the blue, by the way.
- 13:05Speaker 1: He loves UFC and he has a friendship with the
- 13:09Speaker 1: CEO and President Dana White, who is a whole character
- 13:12Speaker 1: onto himself. And this is going to also mark the
- 13:15Speaker 1: president's eightieth birthday. And he is a big fan of
- 13:19Speaker 1: sporting events and has gone to a bunch of them
- 13:22Speaker 1: since his return to the White House. He went to
- 13:25Speaker 1: the FIFA Club World FIFA Club World Cup, the NCAA
- 13:30Speaker 1: Division One Men's Wrestling Championship, the Ryder Cup. He's attended
- 13:35Speaker 1: three UFC fights since winning the election, including one the
- 13:40Speaker 1: week right after his election.
- 13:42Speaker 3: He went there.
- 13:43Speaker 1: So all of this is meant to tie into the
- 13:45Speaker 1: two hundred and fiftieth anniversary of American Independence and Trump
- 13:50Speaker 1: has declared this the Great American State Fair, I guess,
- 13:55Speaker 1: the big beautiful Fair, and he is very heavily involved
- 13:59Speaker 1: in planning this thing.
- 14:02Speaker 3: It's going to be at the south lawn of the
- 14:04Speaker 3: White House.
- 14:07Speaker 1: UFC is going to spend around seven hundred thousand dollars.
- 14:10Speaker 3: To clean it up afterwards. Now I love this stuff.
- 14:16Speaker 3: I really am so, I really do so.
- 14:19Speaker 1: How big, Neil, do you think the portrait of Donald
- 14:22Speaker 1: Trump is going to be at the event?
- 14:24Speaker 5: Yeah, it's kind of funny when you think about them
- 14:27Speaker 5: making such a big deal about this sport. I don't
- 14:30Speaker 5: think it's any different than boxing or having a boxing
- 14:33Speaker 5: match there, which has been done before. But the fact
- 14:37Speaker 5: that it's his birthday and the two hundred and fiftieth
- 14:40Speaker 5: anniversary of the United States and our independence, and I
- 14:50Speaker 5: think it's going to be a massive amount of pomp
- 14:53Speaker 5: and circumstance. And you know, I can't help think, Bill,
- 14:56Speaker 5: you remember his first presidency, how they're were sports teams
- 15:01Speaker 5: that weren't that wouldn't go, would not go to the
- 15:03Speaker 5: White House, right, And there were the NFL.
- 15:07Speaker 2: You had people kneeling at the national anthem and all
- 15:10Speaker 2: these things.
- 15:11Speaker 5: I think he's he was dying to get some sort
- 15:15Speaker 5: of sport or some connection that to show the hey,
- 15:19Speaker 5: there are sport figures that support me as well.
- 15:22Speaker 1: Oh, he could have done croquet on the south lawn,
- 15:26Speaker 1: the big beautiful coke croquet matche, which was actually done
- 15:29Speaker 1: a bunch of times the last time bitten.
- 15:32Speaker 2: Yeah, just so he could have shuttlecocks on the field.
- 15:35Speaker 1: Loranda Rousey, former UFC and WWE star, she ruled herself out.
- 15:41Speaker 3: She's done.
- 15:43Speaker 1: She said she's got better crap, except she didn't use
- 15:46Speaker 1: the word crap to do when asked, I says I
- 15:49Speaker 1: ain't fighting at the fn White House.
- 15:51Speaker 4: Now in.
- 15:54Speaker 2: On the White House lawn, apparently.
- 15:56Speaker 3: In typical fashion.
- 15:58Speaker 1: Stephen Chung, who is the White House communications director this year,
- 16:02Speaker 1: told in an interview with The Wall Street Journal, I'm
- 16:04Speaker 1: going to quote this will be one of the greatest
- 16:07Speaker 1: and most historic sports events in history, far greater, for example,
- 16:13Speaker 1: than any Olympics that has ever occurred.
- 16:17Speaker 6: This is going to be this big, beautiful talking about
- 16:21Speaker 6: a huge and probably the fastest growing sport. So it's multifaceted.
- 16:30Speaker 2: Who knows what goes through President Trump's brain, Yeah.
- 16:33Speaker 3: You don't know. And by the way, this really is.
- 16:35Speaker 1: It's not wrestling, which is quote exhibition where the thing
- 16:39Speaker 1: is it's all manufactured and choreographed, because that's what wrestling
- 16:44Speaker 1: is about. This is a real match. People really do
- 16:49Speaker 1: get beat up, and you don't know who's going to win.
- 16:51Speaker 1: This is like a boxing match, as you said. Absolutely
- 16:54Speaker 1: so I'm sure it's going.
- 16:55Speaker 3: To be broadcast. I can't imagine that. It wouldn't help you.
- 16:58Speaker 1: So twenty five thousand people are gonna be there. I'm
- 17:02Speaker 1: sure it's going to be a ticket that everybody wants.
- 17:04Speaker 1: I don't know if they're gonna charge for tickets or not.
- 17:06Speaker 1: Do we have any idea at this point? Or is
- 17:09Speaker 1: this going to be by invitation? Twenty to twenty five
- 17:12Speaker 1: thousand people in attendance. That's massive. Yeah, and again I'm
- 17:15Speaker 1: there on the South Lawn. Yeah, it doesn't get better.
- 17:19Speaker 1: I mean, this is just entertainment with a capital E.
- 17:22Speaker 1: If they took tickets there, that would be hilarious. We
- 17:25Speaker 1: should give away tickets, so see if we can. You
- 17:28Speaker 1: should see if we can get hold of some tickets.
- 17:30Speaker 1: And let's see if we get hold of some tickets
- 17:32Speaker 1: and we'll have you know, the fifteenth callar or something
- 17:35Speaker 1: along those lines, or you can write in an essay
- 17:38Speaker 1: why you want to go?
- 17:39Speaker 2: Cono and I are going to be the opening fight.
- 17:43Speaker 2: He's gonna no public sale. Whimps.
- 17:48Speaker 3: Hey, here is an aside. Neil used to do mixed
- 17:52Speaker 3: martial arts.
- 17:53Speaker 2: Oh not like this.
- 17:55Speaker 5: Mine is glorified slap fighting. Compared to these guys, we're
- 18:01Speaker 5: coming back stuff. I mean they really they This has
- 18:05Speaker 5: gotten to a place where it is chess with consequences.
- 18:10Speaker 2: It's pretty impressive.
- 18:11Speaker 1: Okay, a story about married couples. I love talking about
- 18:15Speaker 1: this because well, I've sort of been around the block
- 18:18Speaker 1: on this one, and this is a shared bank account issue.
- 18:24Speaker 1: Nearly a quarter of all married couples no longer use
- 18:27Speaker 1: shared bank accounts.
- 18:28Speaker 3: According to data from the US Census Bureau.
- 18:31Speaker 1: The percentage of couples without any joint bank accounts grew
- 18:35Speaker 1: from fifteen percent in nineteen ninety six twenty three percent.
- 18:39Speaker 3: I mean, it came just short of doubling.
- 18:42Speaker 4: And why is that?
- 18:43Speaker 1: Well, first of all, let me go around the block here, Neil,
- 18:47Speaker 1: do you and Tracy have a shared bank account?
- 18:51Speaker 5: We have access to each others and were signers on
- 18:54Speaker 5: them and all of that, but I pretty much used
- 18:58Speaker 5: mine and she pretty much uses her, but we can
- 19:01Speaker 5: cross over. So yeah, they're all shared, I suppose, but
- 19:07Speaker 5: I you know, one was started by me years ago.
- 19:11Speaker 2: One was started by her. But yeah, we have access
- 19:13Speaker 2: to each other stuff, all right.
- 19:14Speaker 3: So you have shared bank accounts too, how about you?
- 19:17Speaker 3: What's your wife?
- 19:18Speaker 4: No?
- 19:19Speaker 3: No shared accounts. No, you are now a growing number
- 19:24Speaker 3: of married couples.
- 19:26Speaker 6: Uh.
- 19:26Speaker 1: And as far as I'm concerned, I have a shared account,
- 19:31Speaker 1: but only to pay for household accounts. I put into it,
- 19:34Speaker 1: Lindsey puts into it. And that's what we do, just
- 19:37Speaker 1: to pay for the ongoing expenses. I got my money,
- 19:42Speaker 1: she's got her money. You know, I got to touch
- 19:44Speaker 1: my money. Let me tell you, mine is mine? What's
- 19:47Speaker 1: let me here's what normally happens with married couples.
- 19:51Speaker 6: Uh.
- 19:51Speaker 1: And this is the wife in this case, or the
- 19:53Speaker 1: spouse who is not the breadwinner, says, here's the way
- 19:57Speaker 1: the bank accounts work. Uh, what's my is mine? What's
- 20:01Speaker 1: yours is mine? And that's how you live a married life.
- 20:05Speaker 1: And it is not pleasant. And why would the number
- 20:09Speaker 1: of people who are not sharing bank accounts growing? Well, because, well,
- 20:14Speaker 1: first of all, older people tend to be sharing accounts
- 20:17Speaker 1: because that's used to be the way the world worked.
- 20:20Speaker 1: And now more people are moving into the kono life,
- 20:24Speaker 1: and that is because they're getting married later. People already
- 20:28Speaker 1: are independent. They come to the marriage with their own accounts,
- 20:33Speaker 1: their own lives, and they're particularly interested in, you know,
- 20:37Speaker 1: having a bank account.
- 20:39Speaker 3: With other folks.
- 20:40Speaker 5: Weno's case, though, it's a little ceramic pig so, I
- 20:45Speaker 5: don't know that his wife needs to get into that.
- 20:47Speaker 2: Yeah, some bubblegum or something.
- 20:50Speaker 3: Now does it matter by the way shared bank accounts
- 20:53Speaker 3: or not?
- 20:54Speaker 1: In reality, it doesn't if you're in a community property
- 20:56Speaker 1: state like California. California doesn't care where the account is shared,
- 21:02Speaker 1: not shared. Where do the money come from to go
- 21:05Speaker 1: into the accounts, any money that's earned after marriage or
- 21:10Speaker 1: during the during the time that someone is married, it's
- 21:13Speaker 1: community property. If you're married, which means I've got my
- 21:16Speaker 1: money in my account, Lindsay has her money in her account.
- 21:20Speaker 1: Let me tell you it's all the same. It's community property.
- 21:24Speaker 1: Each of us own half of it.
- 21:25Speaker 3: Cono, did you know that?
- 21:28Speaker 2: Yeah, I knew that.
- 21:29Speaker 7: Okay, you don't like the hassle though my age, we
- 21:33Speaker 7: always like to get rid of the small hassles. You
- 21:35Speaker 7: know how hard it is to take your money out
- 21:37Speaker 7: of a bank. They try to keep you there, and
- 21:40Speaker 7: it's like, I don't want to have this conversation with you.
- 21:42Speaker 7: I'm just I'll just leave it. I'm fine.
- 21:44Speaker 3: Yeah, that's what you will do.
- 21:45Speaker 1: It's happening more and more so it has to do
- 21:49Speaker 1: right when Americans are getting married. The older, the more
- 21:52Speaker 1: you have shared bank accounts, the younger you don't. All right,
- 21:58Speaker 1: we're done for a Monday morning. That's it coming up.
- 22:02Speaker 1: It's Gary and Shannon and we're again back tomorrow like
- 22:07Speaker 1: we normally are. It starts with wake up call and
- 22:10Speaker 1: that's Amy and not Will. When does Will come back
- 22:16Speaker 1: a week from today? I keep on asking that because
- 22:18Speaker 1: that Will is the only name I can remember.
- 22:21Speaker 3: So what can I tell you? Who's our traffic eye again?
- 22:26Speaker 2: Mike Morris?
- 22:27Speaker 3: Mike Morris. I have to write that down. I have
- 22:29Speaker 3: to write that down. Mike.
- 22:31Speaker 1: I'm forgetting your name, but then I forget everybody else's
- 22:34Speaker 1: name for long periods of time. Okay, okay, yeah, well
- 22:39Speaker 1: only you should take it personally. And then kno Ann
- 22:44Speaker 1: and Neil and I are six o'clock to nine, and
- 22:46Speaker 1: you know how it goes. This is KFI AM sixty.
