Latest / The Jon and Marc Podcast / The $495 Million NEC Victory & The Bard PowerPort Setback
Transcript
- 0:00Welcome to Tortalk. I'm Mark Rieu alongside John
- 0:03Robinson and Joe Fan TV. This week, a defense verdict
- 0:07shakes up the Bard power port litigation, a major tow trial
- 0:12gets underway in Los Angeles, The weight loss MDL hits a
- 0:15critical Daubard hearing, and key rulings loom in Depo Rivera.
- 0:20A lot to unpack. Let's get into it, guys.
- 0:22Yeah. And even before we touched on
- 0:24those items, Mark, we had an appeal decision in the NEC case
- 0:30in Missouri State Supreme Court. Joe, it looks like that verdict
- 0:33was upheld in that $495 million NEC case.
- 0:37What can you tell us about what went on there?
- 0:39Stop what you're doing, stop work, stop everything you're
- 0:41doing. This roadshow is is not
- 0:43stopping, by the way. We're going to pivot and we have
- 0:45another event where we will be live at the Grow or Die
- 0:48conference hosted by Morgan and Morgan.
- 0:50It is the first and only time John Morgan will take the stage
- 0:53in Las. Vegas.
- 0:54Nothing like Vegas in June. It's the last time you'll speak
- 0:56of that conference ever again, so if you want to see exactly
- 0:59how John Morgan plans to grow or die and get all the inside scoop
- 1:02on your biggest competitor and how he does it, it's probably a
- 1:05great time to attend that conference.
- 1:06And Dan Martel, I know you're. A big fan.
- 1:08Big fan. I have a scheduled meet up with
- 1:10Dan. I'm looking forward to running
- 1:11into him. Keynotes are excellent.
- 1:13I'm interested to see this format.
- 1:14This is inside the theater. Yeah, single track.
- 1:17Everyone hears the same thing. Should be a great event.
- 1:19Thanks. John and Mark.
- 1:21Grow or die? June 9th through 10th in Las
- 1:25Vegas. Use code.
- 1:27JM20 for 20% off tickets back to the show.
- 1:34Yeah. So that was in the state court
- 1:36action. The the biggest verdict to come
- 1:38out in this litigation. Basically the the court on
- 1:42appeal found that the defendants knew that their product could
- 1:47have caused these injuries and they they failed to warn the
- 1:50mother and even her providers about it.
- 1:53And because of that, they upheld the verdict.
- 1:56And then also, they found that the conduct was willful or
- 2:01reckless and that warned it the punitive damages.
- 2:04So we expect this to get appealed up, probably the
- 2:07Supreme Court, but it's unlikely to get taken up.
- 2:11So this $495 million verdict's going to stand.
- 2:15And we had a lot of success in state court.
- 2:19Also a recent development last week and the MDL, you guys
- 2:23remember we talked a lot about how each one of the cases coming
- 2:27up for trial has been getting kicked out on summary judgement
- 2:31recently. The court and the MDL denied the
- 2:34most recent motion for summary judgement.
- 2:37So it looks like we'll be able to get that case to trial before
- 2:40the end of the year. Yeah, no, it's good to see some
- 2:43positive news especially come out of of NEC where it's a very
- 2:48low volume, but potentially a high value cases is evident by
- 2:53that $495 million verdict. And there were some comments by
- 2:56the judge and I encourage everyone to read the Chicago
- 2:59Tribune article that covers it pretty much in depth, but that
- 3:02the judge made some skating comments about the the defense
- 3:07there regarding the punitive damages and and why they are
- 3:10justified. Yeah, not a huge volume case
- 3:12like you said, maybe 2000 cases total between the MDL and very
- 3:17state courts, but very deserving clients, you know, traumatic
- 3:22case that this new one that we just talked about in the MDL
- 3:26surviving the motion for summary judgement is a wrongful death
- 3:29case. So we'll see how that plays out.
- 3:31On to the next one bar Power Port.
- 3:33We were all awaiting the results of the initial Bella trial and
- 3:37the jury came back with a disappointing defense verdict.
- 3:41How did this verdict impact the litigation going forward and
- 3:45what should we be focusing on next?
- 3:46Jail. Definitely a set back in the
- 3:48litigation. Overall, this case involved the
- 3:51infection and basically what the defendants argued was that the
- 3:56plaintiff and his significant other who was kind of using the
- 4:01device at home didn't follow the proper training.
- 4:05And because of that, that's what caused the infection.
- 4:09Plaintiff obviously contested that, but unfortunately the jury
- 4:12came back with the defense verdict.
- 4:14Like you mentioned, a set back for sure.
- 4:17But fortunately in this MDL, we have a number of bellwether
- 4:20trials stacked coming up later this year, the second bellwether
- 4:24trial, unfortunately that case ended up being dismissed.
- 4:28So we're going to have to wait till later this year in the end
- 4:31of the summer to get the next bellwether trial up a little
- 4:35bit. Interesting.
- 4:35In this case, we're kind of focusing on two separate
- 4:39theories. This initial bellwether case was
- 4:42an infection case. The other one's going to be more
- 4:45your traditional defective design case.
- 4:48So we'll see how that plays out. But we should have two other
- 4:51bellwether trials this year. We always learn from our
- 4:54mistakes or really what the jury had to say.
- 4:58We got some good input on them. So these trials go pretty
- 5:02quickly, about two weeks in length.
- 5:04I'm hoping we can win these next two and get this litigation back
- 5:07on track. A little over 3500 cases
- 5:10pending, so not a huge MDLI. Don't think it's going to
- 5:14explode, but if we can get some positive rulings, hopefully we
- 5:17can get some more numbers on there.
- 5:20And pressure barred, which is always a difficult defendant to
- 5:23deal with. Yeah, I've always liked this
- 5:26case. I I feel like the science is
- 5:27there. The infection cases are are
- 5:30obviously different from the other cases.
- 5:33And so we'll see how it plays out still very early on in that
- 5:36MDL. Yeah, it's, it's still a ways to
- 5:39go in that really tough case, you know, tough venue sometimes.
- 5:44We we had this judge in the Bard IVC filter case.
- 5:48They, they had some success there.
- 5:50So it's really going to be a battle.
- 5:52But all's not lost. I think we can turn it around in
- 5:55this next bellwether. One should have that result
- 5:58before the end of the summer. We also have more trials.
- 6:02We've got another bellwether trial kicking off in Los Angeles
- 6:05Superior Court for talc. This involves the families of
- 6:08three women who said they died from ovarian cancer.
- 6:11What are some of the issues everyone should be watching for
- 6:14as this case begins? Yeah.
- 6:17So it's a lot of the same story. The plaintiff side is that the
- 6:21defendants knew going back 60 plus years at this point that
- 6:26their products were, you know, dangerous, contained asbestos
- 6:30that leads to ovarian cancer. Defense side obviously is
- 6:34arguing it's safe. There's never been any concrete
- 6:38studies linking asbestos to any type of ovarian cancer.
- 6:42So we'll see what the jury decides.
- 6:44If you guys remember, in the last case, that was a plaintiff
- 6:48when it was only a $250,000 verdict out of Philadelphia.
- 6:53But at the end of 2025, we had a verdict in the same court, a $40
- 6:58million verdict. So it hasn't really been
- 7:01reported much, but the plaintiffs really are on a roll
- 7:04in this litigation. We got some good momentum going.
- 7:08A lot of trials are stacked. So this case, it involves 3
- 7:11different plaintiffs like you mentioned.
- 7:13John, interesting enough, we have Beasley Allen in this case.
- 7:17If you remember, they've been excluded from New Jersey State
- 7:20court and the MDL, but they're representing one of the
- 7:23plaintiffs. So we got some really strong
- 7:26attorneys. We got a pretty favorable venue.
- 7:29We're all looking a pretty big number.
- 7:32Expect to hear more about this towards the end of the month,
- 7:35beginning of next month, but this is another win for
- 7:38plaintiffs. Hopefully we can keep building
- 7:40on the momentum that we finally have in this litigation after
- 7:44about 15 years. Moving on to a litigation is a
- 7:48lot younger than the talc litigation weight loss well, not
- 7:53as interesting as a trial. The second most important part
- 7:56of any mass tort is upon us with a dauber hearing for the weight
- 7:59loss MDL what should we expect? Yeah, Really exciting time in
- 8:03this litigation. We had the parallel litigations
- 8:07going on in the MDL and in New Jersey State court.
- 8:10We have two type of injuries that we're focusing on the
- 8:13gastro injuries and then also the vision loss cases.
- 8:17This is focusing in on the MDL. It's really focusing on those
- 8:21gastrointestinal injuries. We'll see if anything survives
- 8:25beyond the gastroparesis, but that's really the focus of the
- 8:29litigation. More than 85% of those cases
- 8:33that are pending there involve that type of injury.
- 8:36We'll have a hearing this week. Expect to get a ruling rather
- 8:39quickly, I'd say 60 to 90 days. Then we'll be able to start
- 8:43teeing these cases up for bellwether trials.
- 8:46I think we could get the first trial in the gastro injuries in
- 8:492027. I, I think this litigation has a
- 8:53lot of space to to grow in the numbers.
- 8:56I think we could get to over that 10,000 case threshold.
- 9:00Some firms may be waiting on the sidelines a little bit till we
- 9:03get this all important Dolber rolling and that's really going
- 9:06to build the momentum and shape this litigation going forward.
- 9:10Anything in particular that you're concerned about during
- 9:13the Dolber hearing? The concerns going to be those
- 9:16secondary injuries, right? Is hospitalization going to stay
- 9:20in? Is the bowel obstruction
- 9:22injuries going to stay in? Which ones really can survive?
- 9:26We had a limiting ruling earlier from this judge we talked about
- 9:30last year where the judge was requiring the gastric emptying
- 9:34studies to prove the gastro precess.
- 9:37We were a little bit surprised by that.
- 9:39So I don't think we're going to get everything we want just
- 9:41based upon the judges prior rulings, but we'll definitely
- 9:44get enough. We feel really confident our
- 9:46experts are going to be able to come in, but just how?
- 9:49How much are the injuries going to be limited?
- 9:52A lot is happening in the Depo Provera litigation.
- 9:55What are some of the key rulings that could shape the litigation
- 9:59that we're currently waiting on? Yeah, We have a big case
- 10:02management conference this week. We've already seen the parties
- 10:06filed their competing Dahlberg motions.
- 10:09So the motions to exclude the experts from plaintiff side and
- 10:13then also for the defense side, we're going to have briefing
- 10:16throughout this month and then towards the end of June is when
- 10:19we're going to have the Dahlberg hearing.
- 10:21They're interesting enough we we still have pending the
- 10:25preemption motion. We all would have thought that
- 10:28would have been ruled upon by this point.
- 10:30I think maybe maybe the judge is just going to discuss it with
- 10:33the parties briefly at the hearing and then we should have
- 10:36the ruling on the preemption before the end of the month.
- 10:39We feel real confident on that. And then like I said, we'll get
- 10:42the Dolbra briefing wrapped up before the end of the month and
- 10:46towards the end of June, we'll have that.
- 10:47Right now, the December 7th initial bellwether trial is
- 10:52holding. We'll report back to everybody
- 10:55to see if there's going to be any sort of settlement
- 10:57discussions before that initial trial, but right now that day's
- 11:00holding and that's what we're really focusing on a.
- 11:03Lot of movement going on. I'm interested in to see how
- 11:06this effects our next power rankings.
- 11:08We've got social media, another social media trial coming up too
- 11:12in about a month, a lot going on.
- 11:16Yeah, that trial then also we're we're still waiting to see
- 11:19what's going to come out of New Mexico with the that second
- 11:23phase of the trial with the AG there could be a huge number, so
- 11:27a lot. That's the nuisance trial,
- 11:28right? Yep.
- 11:29So, so a lot going on in the world of mass torts.
- 11:33Always exciting times. When we get some of these trials
- 11:35going, I expect they'll be a little bit of a rush year,
- 11:39summertime sometimes can be a little bit slow, but hopefully
- 11:43some of these trial dates hold and then we'll see, you know
- 11:46what's going on. But pretty good developments
- 11:49here, pretty positive things, a lot of litigations going on.
- 11:53So we'll keep everybody updated week to week here and Tort talk.
- 11:57All right, that's a wrap for this week.
- 11:59Another exciting week with Joe Fantini, the Oracle or the
- 12:04Great. Also other names available for
- 12:07nicknames. Comment down below if you think
- 12:09Joe's nickname should be. Those are the two leading with
- 12:11John Robinson. I think next week we might do
- 12:14Tor talk. I mean the power rankings.
- 12:17Let's see. I vote we do it because the week
- 12:19after that I'm on vacation so I want to get it in before I leave
- 12:22because I want to know what is #1 after the last power
- 12:26rankings. But that is all.
- 12:27Thank you for all the listening in.
- 12:28Don't forget to like and subscribe.
- 12:30Thank you for tuning in.
