- 0:00Speaker 1: Prison is where it ends for all court gives where
- 0:05Speaker 1: it begins.
- 0:07Speaker 2: Show this is the real world.
- 0:11Speaker 3: And this is what's happening at the courthouse.
- 0:15Speaker 2: On KFM Mornings with Remis.
- 0:19Speaker 4: Okay, so out at the Goodwood Courts yesterday, REMI, yes,
- 0:24Speaker 4: I was. These are two real interesting stories. The last one,
- 0:31Speaker 4: you be the jury.
- 0:33Speaker 2: M hm, as we always are.
- 0:34Speaker 4: Yes, you be the jury in the last one.
- 0:39Speaker 2: That's the first one. Is that?
- 0:40Speaker 4: The first one? The guy? Yeah, okay, you be the
- 0:43Speaker 4: jury in the first one. This is what is going
- 0:46Speaker 4: to feel like being a judge. Okay, imagine yourself as
- 0:50Speaker 4: the judge and what would you decide in this instance?
- 0:55Speaker 4: Second stories also wow, yeah, okay, here we go. This
- 0:59Speaker 4: is what's me at the courthouse where Remis asked everybody
- 1:02Speaker 4: one simple question.
- 1:03Speaker 2: What are you doing at the courthouse today?
- 1:05Speaker 5: Okay, well yeah, because it was a case involved in drugs.
- 1:09Speaker 5: But I beat the guy up and yeah, so pretty
- 1:12Speaker 5: much it for what reason? He stole money from me,
- 1:15Speaker 5: actually asked me for money for food, and when I
- 1:17Speaker 5: gave him the money, he ran away.
- 1:18Speaker 2: So where does the drugs come in? I don't understand.
- 1:21Speaker 5: You had possession of huge drugs and while we had
- 1:23Speaker 5: the scuffle on the floor.
- 1:25Speaker 2: They whatever the case, maybe he ran away, and.
- 1:27Speaker 5: When they locked me up, whatever position was on the floor,
- 1:29Speaker 5: they thought it was yours. Yeah, pretty much. And whatever
- 1:32Speaker 5: positions were on the floor they locked me up.
- 1:34Speaker 2: Did you tell them obviously it's not yours. I have
- 1:36Speaker 2: to go to trial now with it. You should have.
- 1:38Speaker 6: Told him that it wasn't yours. I mean, that's a
- 1:40Speaker 6: worst case, obviously.
- 1:42Speaker 2: Yeah, exactly.
- 1:42Speaker 5: I did tell them, but they just didn't want to
- 1:45Speaker 5: understand it, like brutally, like forced me.
- 1:47Speaker 2: They didn't want to listen. What happened to the other guy?
- 1:49Speaker 2: Did he run away? He got away? I couldn't find him.
- 1:52Speaker 5: But then they got a call saying that there was
- 1:54Speaker 5: a fight going on out there and I was the
- 1:56Speaker 5: only one covered in blood. I had t shirt dripped
- 1:58Speaker 5: open and everything, obviously. And by the time, So why
- 2:01Speaker 5: why did you fight to this guy? What happened all
- 2:03Speaker 5: my money? He stole money from you? Because he asked
- 2:05Speaker 5: me for money for food and I gave it to
- 2:07Speaker 5: him and I told him to come back with my
- 2:08Speaker 5: change and he passed off with me.
- 2:10Speaker 2: Oh okay, So so why would you then just give
- 2:13Speaker 2: him give him money and then before.
- 2:15Speaker 5: I had given him money before, so you know him.
- 2:17Speaker 5: I know him, yeah, and was trusting so I'd given
- 2:20Speaker 5: it him before. He's come back with my money.
- 2:22Speaker 6: And then also he just wanted to ask him to
- 2:24Speaker 6: go buy maybe something.
- 2:25Speaker 2: And then bring the change. Yeah exactly. But now you
- 2:28Speaker 2: in the biggest situation because of this, exactly.
- 2:31Speaker 5: And it's stressing me out because now I just got
- 2:34Speaker 5: told I need to go to trial because I want
- 2:36Speaker 5: me to admit guild.
- 2:36Speaker 2: But I'm not going to so but you shouldn't. I won't.
- 2:39Speaker 5: So I'm going to go to trial and fight this
- 2:41Speaker 5: thing because I can lose my job, get a criminal record,
- 2:43Speaker 5: and I'm so far on the soul, better soul, breadwinner
- 2:46Speaker 5: of my family.
- 2:47Speaker 6: Now, you see, at the end of the day, it
- 2:49Speaker 6: doesn't look good to be honest with you.
- 2:51Speaker 2: Your tea shirts.
- 2:51Speaker 6: Covered in blood, the other guy is in there, and
- 2:54Speaker 6: the position of drugs on the floor, for example, and
- 2:57Speaker 6: you're the only person there.
- 2:58Speaker 5: How can I actually fight that but be genuine, just
- 3:02Speaker 5: tell the honest truth. That's how I feel. The truth
- 3:04Speaker 5: always somehow has a way of coming out. You know,
- 3:06Speaker 5: have you seen this guy again? Yeah, I seem all
- 3:09Speaker 5: the time. Now what now, then then he robbed my
- 3:11Speaker 5: landlord actually on Saturday, he stole money from his car.
- 3:14Speaker 6: So but then you can start tell the courtier that
- 3:16Speaker 6: you know where this guy is and bring him here is.
- 3:18Speaker 2: A warrant for his arrest as well.
- 3:20Speaker 5: I know for a fact, because just how this came
- 3:23Speaker 5: there to the situation, and we told him. He said
- 3:26Speaker 5: he couldn't go in there because he doesn't have warrant papers.
- 3:28Speaker 5: But he's a warrant out for his arrest. So my
- 3:29Speaker 5: landlord went to go and lay another charge of thefty.
- 3:32Speaker 6: I mean hopefully that this guy's the streak of this guy,
- 3:35Speaker 6: bad streak of this guy ends and he ends up
- 3:38Speaker 6: in court and you sort of get free.
- 3:40Speaker 2: I mean, this is not a good thing for you.
- 3:42Speaker 2: It's really not, you know.
- 3:43Speaker 5: And I come from Joeburgh for a better life for
- 3:45Speaker 5: me and my family. So I left the scrap in
- 3:48Speaker 5: Joburg for the same reason, you know.
- 3:50Speaker 2: So definitely, thank you very much for your time. So
- 3:53Speaker 2: thank you, thank you. What are you doing at the
- 3:55Speaker 2: courthouse today?
- 3:56Speaker 1: I am fighting my ex to increase our children's name.
- 4:00Speaker 1: Oh yes, I see, yeah, so we have three children together.
- 4:04Speaker 2: Well, he's not going to be playing eighteen dollars.
- 4:07Speaker 1: Well, he should be because he is an American citizen
- 4:09Speaker 1: and a South African, like all three of my children are.
- 4:12Speaker 1: But we moved here in twenty twelve. We were married
- 4:16Speaker 1: for twenty years, but we broke up in twenty twenty.
- 4:20Speaker 1: We only divorced in twenty twenty five. Great took five
- 4:23Speaker 1: years to get divorced, and the divorce decree that I
- 4:27Speaker 1: had agreed to, I only agreed to it because we
- 4:30Speaker 1: were fighting for five years. So the amount that was
- 4:33Speaker 1: stipulated in the divorce documents, my lawyer said, just agree
- 4:36Speaker 1: to it so you can get divorced. You can always
- 4:38Speaker 1: go back to maintenance court six months after to increase
- 4:41Speaker 1: the maintenance. But when we were here a week ago,
- 4:45Speaker 1: Shipsley said that my maintenance isn't able to be increased
- 4:50Speaker 1: because it was in a a high court divorce order.
- 4:53Speaker 1: I have to go back to the High court. But
- 4:55Speaker 1: my child in the meantime trying to fight him for
- 4:57Speaker 1: five years trying to get it increased, and we were
- 4:59Speaker 1: never successful to get him back into court. He had
- 5:02Speaker 1: eleven cancelations from twenty twenty two. I only got him
- 5:05Speaker 1: back into court in twenty twenty five, and so he
- 5:09Speaker 1: got away with paying the minimal amount for the three children.
- 5:13Speaker 1: I've been paying ninety five percent of their expenses this
- 5:15Speaker 1: whole time since he moved out. And so my oldest
- 5:19Speaker 1: daughter has turned eighteen in the maintime and is at
- 5:21Speaker 1: Stalinbolsh University studying becom law. And now she's bringing us
- 5:25Speaker 1: to court to be able to but I encourage her
- 5:29Speaker 1: to do so because she's only getting three thousand a
- 5:31Speaker 1: month from her father. Her expenses are about twenty five
- 5:34Speaker 1: thousand a month. So she's going to bring us both
- 5:37Speaker 1: to court on the twelfth of May. We're going to
- 5:39Speaker 1: be coming back. And then the maintenance officer said that
- 5:42Speaker 1: if she can prove that the court the divorce decree
- 5:46Speaker 1: was unfair, he should be paying a higher percentage than me.
- 5:50Speaker 2: Therefore, so there's a bit of a plot to us leap.
- 5:52Speaker 1: There's a huge plot.
- 5:53Speaker 2: Trust.
- 5:53Speaker 6: It's very interesting obviously, because your daughter is of age,
- 5:57Speaker 6: she can bring both of.
- 5:59Speaker 1: You to court, and I don't mind her bringing me
- 6:00Speaker 1: to court because I'm already paying. So we got a
- 6:03Speaker 1: court date on the twelfth of May. I can see
- 6:05Speaker 1: you again after that and hopefully we'll be successful.
- 6:08Speaker 2: But like I mean, he should.
- 6:10Speaker 6: Simply you and your daughter are basically like plotting against himail.
- 6:15Speaker 1: Not plotting against him. It's actually a father should want, yes,
- 6:18Speaker 1: but the father should actually want to support his children.
- 6:22Speaker 1: And I've got another one who's turning eighteen in June.
- 6:25Speaker 1: If I don't get it right with this one, the
- 6:26Speaker 1: same thing is going to happen with the next case
- 6:29Speaker 1: is going to happen. He's not going to get away
- 6:31Speaker 1: without paying child.
- 6:32Speaker 2: I'm gonna say flotting it. There's a wrong choice of work.
- 6:35Speaker 1: I mean just playing colluding, maybe.
- 6:40Speaker 6: Colluding basically to in order for him to do what
- 6:43Speaker 6: he's supposed to correct.
- 6:44Speaker 1: So we're just trying to make it right and fair.
- 6:47Speaker 1: And a father should want to support his children based
- 6:50Speaker 1: on their availability of income. So we're just trying to
- 6:54Speaker 1: make the wrongs right and hopefully the court will be
- 6:57Speaker 1: able to help us this time.
- 6:58Speaker 6: Thank you very much for your time, thank your stories.
- 7:03Speaker 4: You be the judge. We'll await your comments on two
- 7:06Speaker 4: none four five zero nine four zero good job, remiss,
- 7:10Speaker 4: Thank you very much. There was goodwood, Stacy ourco. There's
- 7:15Speaker 4: got to be more to life. It's KF morning, So
- 7:18Speaker 4: you be the judge.
- 7:20Speaker 3: I'm joining that wife and the daughter at the court.
- 7:23Speaker 3: We're going to get this money. We're going to get
- 7:25Speaker 3: this money. Honeys.
- 7:26Speaker 4: We we now don't have to love us.
- 7:29Speaker 2: It's fine, pay up.
- 7:31Speaker 4: All the law students are going to be co counseled here.
- 7:34Speaker 3: That's what I'm saying. It's not a fight that they're
- 7:36Speaker 3: going to let go of Kelly. They're going to tell
- 7:40Speaker 3: you what a long fighters more than five years, twenty
- 7:44Speaker 3: years together.
- 7:46Speaker 4: But your honor, your honor. I gave this homeless guy
- 7:50Speaker 4: a two hundred. That guy, I said, go get some
- 7:53Speaker 4: bread and bring me the change. There was trust there
- 7:57Speaker 4: and he didn't come back, and the trust had.
- 8:00Speaker 3: Been built because he lent him money before.
- 8:08Speaker 4: You see how hard it is being a judge, you know.
- 8:11Speaker 4: I mean the guys story could be legit absolutely, but
- 8:15Speaker 4: now you go, but would I do that?
- 8:17Speaker 2: I also see why doesn't have the jury system and
- 8:20Speaker 2: we'll be all over the show. Yeah.
- 8:22Speaker 4: I've never I've never asked for change from a beggar.
- 8:29Speaker 3: That twenty rand is gone, that that whatever it's his now,
- 8:34Speaker 3: always let them have it.
- 8:36Speaker 4: Yeah, I've got twenty give me ten backs.
- 8:41Speaker 2: No, it's just
- 8:42Speaker 4: It's just Yeah, your thoughts
