- 0:03Speaker 1: This is a Bramble Jam podcast.
- 0:12Speaker 2: This week on your Gabble gabble. If you're in a
- 0:14Speaker 2: funeral home plan in your grandma's funeral and you fight
- 0:17Speaker 2: your aunts, do you have to pay for the damages?
- 0:20Speaker 2: Judge Million tells us.
- 0:21Speaker 3: And if you find out that your lover's wife isn't black,
- 0:25Speaker 3: can you sue them? Judge Ross Doll's real fetal say
- 0:30Speaker 3: justice this, Come on, stand up, get up.
- 0:35Speaker 2: On your feet. Everybody, sit down, stand up, sit stand
- 0:41Speaker 2: anybody welcome to yo gab gavel. I would see the
- 0:43Speaker 2: answer to yours is no. If you find out someone
- 0:47Speaker 2: is not black or is black, can you get money
- 0:50Speaker 2: from that? No? I think should be the unequivocal answer there, right, Brand,
- 0:53Speaker 2: Am I wrong here? But I don't know, you don't know.
- 0:55Speaker 4: Just gonna tell us, man, you know, we're going to
- 0:59Speaker 4: brand Dan and we watched TV courtroom shows for fun
- 1:03Speaker 4: and then we tell you about them. I watched one
- 1:06Speaker 4: Dan's gonna try to guess the verdict, and then Dan's
- 1:08Speaker 4: gonna do the exact same thing to me, and I
- 1:09Speaker 4: will guess the verdict and you at home can play along.
- 1:12Speaker 1: Trying to figure out.
- 1:13Speaker 4: How these TV court judges are gonna rule in these cases.
- 1:17Speaker 4: Two good ones today, two good ones today. It's like it,
- 1:20Speaker 4: can I go first?
- 1:21Speaker 1: Sure you want to? I don't care, I'll go. I'll
- 1:26Speaker 1: go first. What are you ready for? Judge?
- 1:29Speaker 4: Right?
- 1:29Speaker 1: Sure man?
- 1:31Speaker 4: Kelsey Hummingway is humming humming Way positive. Kelsey Hummingway is
- 1:38Speaker 4: suing Brandon and Lisa Styles for six hundred and seventy
- 1:43Speaker 4: two dollars and seventy five cents for a hotel room.
- 1:48Speaker 2: You ready, I'm ready.
- 1:50Speaker 1: I think this is important to say. I don't typically
- 1:53Speaker 1: do this.
- 1:54Speaker 4: Kelsey is a black woman, Brandon is a black male.
- 1:59Speaker 1: Lisa is not black, okay.
- 2:03Speaker 4: Kelsey met Brandon on what she calls a safe dating
- 2:07Speaker 4: site called Field. Apparently this is for polyamorous couples, people
- 2:11Speaker 4: that are down to clown. That's exactly right. This is
- 2:17Speaker 4: not the first time she's used this site. She's very
- 2:20Speaker 4: familiar with it.
- 2:22Speaker 1: She likes it. This is what she's into.
- 2:23Speaker 4: Brandon and Lisa have been married for two years and
- 2:27Speaker 4: they are both on the site of separate accounts, so
- 2:32Speaker 4: they're both okay with each other playing the field. Kelsey
- 2:37Speaker 4: and Brandon started talking and he says that if things
- 2:43Speaker 4: go well between them, he will bring his wife into
- 2:46Speaker 4: the mix. Okay, well, okay, Kelsey and brandonating this, Kelsey,
- 2:55Speaker 4: I do this to myself, Kelsey and Brandon.
- 3:00Speaker 2: You couldn't pronounce it.
- 3:01Speaker 1: Imagine I'm I'm in the clear here, howming way and all?
- 3:05Speaker 4: Uh So, Kelsey and Brandon start meeting up twice a
- 3:09Speaker 4: week for three months.
- 3:12Speaker 1: All right?
- 3:13Speaker 2: Uh.
- 3:13Speaker 4: Lisa says that she knew about these meetups and was
- 3:17Speaker 4: all about it. She only heard good things about Kelsey.
- 3:22Speaker 4: Kelsey says that, uh, I didn't know much about Lisa.
- 3:25Speaker 4: It's good to know that Bradon was talking to you
- 3:27Speaker 4: about me, because I know much about you. And so
- 3:30Speaker 4: when I met her, it was a bit of a
- 3:32Speaker 4: surprise that she was not black. Lisa is half white,
- 3:37Speaker 4: half Hispanic. Kelsey was not down with that. In fact,
- 3:44Speaker 4: she always wears a necklace which has like a I
- 3:50Speaker 4: don't know, like a medallion on it, and Ross says,
- 3:53Speaker 4: so this is like the key of key.
- 3:54Speaker 1: Of life symbol.
- 3:55Speaker 4: And apparently people wear this necklace so that that that
- 4:01Speaker 4: you know when you see it that they are only
- 4:04Speaker 4: going to date inside of their race.
- 4:09Speaker 2: That's it. There's a symbol, a universal symbol for only
- 4:12Speaker 2: dating inside your race.
- 4:13Speaker 1: This is what I was news to me.
- 4:16Speaker 4: I don't know if this I don't know if this
- 4:17Speaker 4: is only uh like for like Kelsey and the black community,
- 4:23Speaker 4: if this is like a symbol that's important to them,
- 4:25Speaker 4: I don't know. We didn't get into the specifics of
- 4:27Speaker 4: the symbol, but apparently there's a necklace with a symbol
- 4:30Speaker 4: on it, and you know it if you know it.
- 4:32Speaker 2: All right?
- 4:33Speaker 4: So Ross asked Brandon if he was aware of this
- 4:38Speaker 4: and her beliefs and only dating with inside her own race,
- 4:42Speaker 4: and he says, with a smirk, yes, I did so.
- 4:48Speaker 2: Uh.
- 4:48Speaker 4: He says, he assumed that if she's in the me,
- 4:54Speaker 4: she'd also be in the my wife, regardless of whether
- 4:57Speaker 4: she's black, even.
- 4:59Speaker 1: Though know that.
- 5:00Speaker 2: Judge Ross asked Kelsey.
- 5:03Speaker 4: Uh, like why why why is?
- 5:06Speaker 1: Why?
- 5:06Speaker 4: Why do you why are you only comfortable uh dating
- 5:11Speaker 4: black people? And she says, I'm not comfortable sharing my
- 5:15Speaker 4: body with anybody outside of my own race, and I
- 5:17Speaker 4: had many conversations about that with Brandon. Brandon says they
- 5:22Speaker 4: did have these conversations, but just didn't think that she'd
- 5:27Speaker 4: have a problem with my wife. If my wife's cool
- 5:30Speaker 4: with me, she should be cool with you. Is basically
- 5:34Speaker 4: his understanding. Lisa speaks up and says, I just want
- 5:39Speaker 4: it known that I do I do support black people,
- 5:43Speaker 4: to which Ross says, yeah, we see that, which is great,
- 5:49Speaker 4: great line, Judge Ross. Lisa says when Kelsey saw her,
- 5:55Speaker 4: she freaked out and called her a snow bunny, something
- 6:00Speaker 4: that she found to be very offensive. Kelsey says, this
- 6:03Speaker 4: is true, but I was upset because I had had
- 6:06Speaker 4: many conversations with Brandon about not marrying outside of my race,
- 6:11Speaker 4: and Brandon says, Kelsey did say that. I never I
- 6:16Speaker 4: didn't know that we were talking about marriage here. I
- 6:18Speaker 4: just I didn't know that extended to just having Yep,
- 6:23Speaker 4: if you will, she's not getting married to us, she's
- 6:28Speaker 4: just having a relationship with us. So Kelsey met them
- 6:35Speaker 4: at the airport to head to Hawaii. That's where they
- 6:37Speaker 4: were gonna go. They're gonna go to Hawaii for a
- 6:40Speaker 4: trip together. They meet the airport and that's when she
- 6:44Speaker 4: freaked out. Brandon is like, she could have still come
- 6:48Speaker 4: and had sex just with me, and Lisa is like, Yep,
- 6:52Speaker 4: she could have come and she could have had sex
- 6:54Speaker 4: with Brandon. Judge Ross cannot contain his laughter at that
- 7:00Speaker 4: while Lisa says that she was excited to meet Kelsey
- 7:04Speaker 4: and have a great trip, and uh, Brandon and Lisa
- 7:07Speaker 4: still ended up going and having a great time. So
- 7:11Speaker 4: the money that Kelsey spent, they like went splitsy go
- 7:14Speaker 4: Daisy's on the hotel And the money Kelsey's asking for
- 7:18Speaker 4: is for her portion of the hotel room because it
- 7:20Speaker 4: was past the refund time. Okay, something that she could do,
- 7:24Speaker 4: but she does have proof of payment.
- 7:25Speaker 2: He's like two thousand bucks. She wants a third of
- 7:27Speaker 2: it back.
- 7:28Speaker 4: Yeah, yeah, yeah, I got it, And so uh gets
- 7:32Speaker 4: a She shows the proof of payment that she spent
- 7:35Speaker 4: and a text message that she sent that she shows
- 7:39Speaker 4: that she sent to Brandon after the fact asking for
- 7:41Speaker 4: the money back. She calls him a snake. He texts
- 7:44Speaker 4: back saying that he didn't know that she would be
- 7:47Speaker 4: uncomfortable with his wife. Thought that that was the whole plan.
- 7:51Speaker 4: Jud Ross, this is tough.
- 7:54Speaker 2: If she was never told that she couldn't come on
- 7:58Speaker 2: the trip, then I guess in theory she doesn't get
- 8:02Speaker 2: any money. But if she felt unwanted, I don't know,
- 8:06Speaker 2: don't I don't know. I'm gonna say no money, but
- 8:08Speaker 2: I don't feel super confident about it. Brand Uh, fair enough.
- 8:11Speaker 1: Now.
- 8:11Speaker 4: I don't know what Judge Ross would have done had
- 8:15Speaker 4: she not presented this text message, Oh.
- 8:18Speaker 2: Here we go.
- 8:19Speaker 4: Part of her evidence is a text message that Judge
- 8:22Speaker 4: Ross says proves that he wasn't aware that she would
- 8:27Speaker 4: be uncomfortable with it far before today. This isn't a
- 8:31Speaker 4: story that he made up for the courtroom. It's a
- 8:33Speaker 4: story that he apparently had right away. I wasn't aware
- 8:36Speaker 4: that you would be uncomfortable with her being in the mix.
- 8:39Speaker 1: And so since he.
- 8:41Speaker 4: Is on the record having that understanding, justice has to fall.
- 8:46Speaker 4: The gable has to fall in favor of the defendant.
- 8:50Speaker 4: His text response shows that he it is in line
- 8:54Speaker 4: with what he has said here today. And so you
- 8:57Speaker 4: should have asked more questions, more questions before deciding to
- 9:01Speaker 4: go to a trip.
- 9:04Speaker 1: With a couple.
- 9:05Speaker 4: You should, even though you think that you are making
- 9:08Speaker 4: it clear by sharing your beliefs and wearing the necklace,
- 9:12Speaker 4: that might not be clear to someone else. Boys an
- 9:17Speaker 4: important lesson in polyaminine polyamorous it's important to be clear
- 9:25Speaker 4: upfront with your expectations and what you're comfortable with.
- 9:28Speaker 2: And that's that's exactly right.
- 9:32Speaker 4: No one is more understanding and learned about this topic
- 9:38Speaker 4: than your rant. That's right, Dear God, well read.
- 9:42Speaker 2: Hey brand, Let's go over to the people's court show.
- 9:45Speaker 2: But while we head over to the people's court, I
- 9:48Speaker 2: want you to imagine that it's personal injury court, because
- 9:51Speaker 2: this feels like personal injury court. But now we get
- 9:55Speaker 2: judgment on instead of judge Gino. That's what it feels like.
- 9:58Speaker 2: Freaking Finally, this case has all of the trappings, yeah,
- 10:04Speaker 2: of a personal injury court case.
- 10:06Speaker 1: And not the big what it doesn't have the big money.
- 10:10Speaker 2: It does not have the big money in the geno sense,
- 10:12Speaker 2: but it's bigger than a typical all ten came backs.
- 10:16Speaker 2: It is seventy five hundred and then a five thousand
- 10:18Speaker 2: counter okakay. Alicia Smith is suing her niece seventy five
- 10:24Speaker 2: for seventy five hundred bucks in medical expenses, pain and suffering.
- 10:28Speaker 2: Danielle Smith, her niece, is suing counter suiting her, suing
- 10:32Speaker 2: her for five thousand dollars in pain and suffering, which
- 10:34Speaker 2: is the max? Alicia says, your honor. We were planning
- 10:37Speaker 2: a funeral for my mom and her grandmother. We were
- 10:41Speaker 2: at the funeral home. My mom died of pancreas cancer,
- 10:44Speaker 2: and we were at the funeral home with the folks
- 10:47Speaker 2: at the funeral home and we were planning the funeral.
- 10:51Speaker 1: You get herd at a funeral home.
- 10:53Speaker 2: So Alicia then gets to go up to the big board,
- 10:56Speaker 2: not the plasma, not the plasa, A big big board,
- 10:59Speaker 2: four at the tables, different court, a table with chairs
- 11:02Speaker 2: and where everybody was sitting. So Alicia basically goes through
- 11:05Speaker 2: and it's like, yeah, it's a meeting room where you're
- 11:09Speaker 2: planning in a funeral.
- 11:10Speaker 1: So this is the plan.
- 11:11Speaker 2: So Alicia has like a brother, a sister, and a
- 11:14Speaker 2: sister in law there and then one one of the grandkids.
- 11:18Speaker 2: Something like that. There's a good mix all the siblings
- 11:20Speaker 2: and then two grandkids. I think, uh oh no, no,
- 11:23Speaker 2: all the siblings, a sister in law and a grandkids.
- 11:27Speaker 2: That's who's there. Alica shows where everybody's sitting and she's
- 11:31Speaker 2: like and when we sat down, I recognized Danielle's attitude immediately.
- 11:35Speaker 2: Oh million, says why. Alicia says, the night before she
- 11:41Speaker 2: has custody of her sister and my niece, my other
- 11:45Speaker 2: niece who is younger than Danielle. So Danielle is is
- 11:48Speaker 2: the legal guardian of her younger sister. The other niece
- 11:51Speaker 2: asked to stay with me. I told her that was fine.
- 11:54Speaker 2: Had no clue that Danielle would be upset about that,
- 11:56Speaker 2: but she was. Okay. Million's like, so basically you took
- 11:59Speaker 2: her child from her, and she was like, well, yeah,
- 12:02Speaker 2: kind of. She's why do you have custody of your sister?
- 12:05Speaker 2: Danielle says, my mother had drugs in her system during delivery.
- 12:08Speaker 2: My sister's now fourteen. And Million's like, why do you
- 12:10Speaker 2: still have custody of her? That should be a temporary thing,
- 12:13Speaker 2: and she goes, well, I got her when she was
- 12:15Speaker 2: three out of foster care, took her straight.
- 12:19Speaker 1: How old was she when she got custody.
- 12:21Speaker 2: I think very young, like seventeen or eighteen. And then
- 12:24Speaker 2: basically mom never got clean. Serious drug problem not in
- 12:26Speaker 2: the picture. Okay, Okay, it's gonna get funny from here,
- 12:29Speaker 2: I promise.
- 12:30Speaker 1: Okay.
- 12:30Speaker 4: So just to be clear, she has custody of her sister,
- 12:34Speaker 4: that's right, and that sister for some reason.
- 12:37Speaker 2: We wanted to stay with Auntie.
- 12:38Speaker 4: We wanted to stay with Auntieth for the night, and
- 12:39Speaker 4: that made her mask That's right, okay, And now they
- 12:41Speaker 4: show up, yes to the play.
- 12:43Speaker 2: They're the funeral home. So she's like, I get to
- 12:45Speaker 2: the funeral home, Alicia does the daughter and says, the
- 12:48Speaker 2: lady the funeral home handed me three different bills, handed
- 12:51Speaker 2: me one for seven some thousand dollars, one for nine
- 12:53Speaker 2: hundred something for the pastor, and one for three thousand
- 12:56Speaker 2: and something for other fees. Now, my mom had a
- 13:00Speaker 2: ten thousand dollars policy, and I knew I couldn't afford
- 13:04Speaker 2: any more of this, and I knew I didn't have
- 13:05Speaker 2: the money. And so this lady at the funeral home
- 13:08Speaker 2: is trying to get me to sign these papers that
- 13:10Speaker 2: I don't understand. And since I didn't understand it, and
- 13:13Speaker 2: I knew that I didn't have the money past ten
- 13:14Speaker 2: thousand dollars, I said that I was not going to
- 13:17Speaker 2: sign these right now because I'm not putting my name
- 13:19Speaker 2: on anything that I could be held accountable for, especially
- 13:21Speaker 2: if I don't have the funds. I'm not going to
- 13:23Speaker 2: do it.
- 13:23Speaker 4: Yes, So I said, what is so what are you
- 13:25Speaker 4: doing a situation like that? Because I know it's a
- 13:29Speaker 4: great question. I think death is a tricky business. It's
- 13:31Speaker 4: a tricky business, and it shouldn't be a business, but
- 13:33Speaker 4: it is. But yeah, so she said so before I
- 13:37Speaker 4: was going to leave.
- 13:38Speaker 2: And then I said, I'll sign the one for seven thousand,
- 13:40Speaker 2: which is the process the body cremate it. The policy
- 13:43Speaker 2: I knew would cover that. I'm not going to sign
- 13:46Speaker 2: the other two. So I get up to the table
- 13:48Speaker 2: and said, I wasn't signing anything else but the big one.
- 13:50Speaker 2: That's all I'm signing. Danielle, her my mom's granddaughter and
- 13:55Speaker 2: my niece, says, give me the damn papers. I'll sign them.
- 14:00Speaker 2: And I looked at her and I said, this is
- 14:02Speaker 2: for children only of the disease. You're not even supposed
- 14:05Speaker 2: to be here.
- 14:06Speaker 1: Oh.
- 14:07Speaker 2: Danielle said something. I don't know exactly what she said,
- 14:10Speaker 2: but then she got up out of her chair and
- 14:12Speaker 2: she threw a punch and it landed right here in
- 14:14Speaker 2: my head. While Alicia's talking, Danielle is smiling.
- 14:18Speaker 1: Oh, she loves it.
- 14:19Speaker 2: She loves it, she said. I went to her and
- 14:22Speaker 2: I grabbed her. She hit me by the arm. I
- 14:24Speaker 2: tried to remove my arm. She bit my fingers, oh no,
- 14:29Speaker 2: and grabbed my hair, which is why I have no
- 14:31Speaker 2: hair right here to this day. She ripped it out
- 14:34Speaker 2: of my skull. And then my brother came and finally
- 14:38Speaker 2: split us up. But why is she there? If she's not,
- 14:43Speaker 2: we'll get there or Million says, you have any witnesses?
- 14:46Speaker 2: She says no. She's like, all right, Danielle, let's hear
- 14:48Speaker 2: from you. Danielle says, all right. She goes to the board.
- 14:51Speaker 2: She goes, here we go, there was another grand daughter.
- 14:54Speaker 2: I was wrong. It wasn't an in law, it was
- 14:55Speaker 2: another granddaughter in the room. She goes, there was another
- 14:57Speaker 2: granddaughter in the room as well. I just wanted to
- 14:59Speaker 2: be clear like this, I'm not supposed to be there.
- 15:01Speaker 2: The other granddaughter was there too. She said. What happened
- 15:04Speaker 2: was there was a disagreement over whether we should bury
- 15:07Speaker 2: her or cremate her. And now my grandma have four kids,
- 15:11Speaker 2: they're supposed to agree on this together. And I'm trying
- 15:14Speaker 2: to tell Alicia to stop making a scene. You can't
- 15:17Speaker 2: make this decision by yourself. All four siblings get to
- 15:20Speaker 2: agree on this, and Million goes, what do you think
- 15:24Speaker 2: your grandmother would think watching this from up above the funeral?
- 15:29Speaker 2: And Daniel's like, oh, she'd be rolling over in a grave.
- 15:32Speaker 2: And she is rolling over in a grave, because she's
- 15:34Speaker 2: still bothering me. Million's like, what do you mean? She goes,
- 15:36Speaker 2: her spirit's in my house. My grandma's spirit is inside
- 15:40Speaker 2: my house. I'll come home. My lights are on. I'm
- 15:43Speaker 2: trying to move because her spirit is actively bothering me.
- 15:46Speaker 1: Right now, we're supposed to hang.
- 15:48Speaker 2: Million's like, did you get along with her? And she goes, yeah,
- 15:50Speaker 2: but what we're doing to her was wrong, and Alicia
- 15:53Speaker 2: said she and Alicia said she wasn't going to sign
- 15:55Speaker 2: the papers, and I said, I'll sign the papers. And
- 15:57Speaker 2: I was walking to the table to get the to
- 16:00Speaker 2: sign the papers, and I don't have money to sign it,
- 16:03Speaker 2: but I would have done anything to make sure that
- 16:06Speaker 2: it got paid eventually because it was the right thing
- 16:07Speaker 2: to do.
- 16:08Speaker 4: So, just to be clear, there though some important information.
- 16:12Speaker 4: She was a believed that what they were agreeing to
- 16:16Speaker 4: was wrong. Alicia did, yes, okay, Danielle believes, and I'm
- 16:21Speaker 4: getting ahead a little bit. Danielle believes that Alicia's trying
- 16:24Speaker 4: to pocket the money. She believes that that policy is
- 16:27Speaker 4: paid out and she doesn't want to spend the money.
- 16:30Speaker 2: That's what she believes. Interesting, So Danielle says, as I
- 16:34Speaker 2: go to sign these Alicia charges toward me. She says,
- 16:37Speaker 2: I don't know who hit first, but she grabbed me
- 16:40Speaker 2: and tried to take me down. Then, Danielle says this,
- 16:43Speaker 2: I wasn't trying to bite her arm. I was trying
- 16:45Speaker 2: to bite her booby, because you know, women's boobies are
- 16:48Speaker 2: the most sensitive spot. And then she let go of
- 16:51Speaker 2: me immediately, but her arm got in the way, so
- 16:54Speaker 2: I bit her arm. That was the strategy of Danielle.
- 17:00Speaker 2: I was trying to bite my aunt's booby. That's what
- 17:03Speaker 2: happens sometimes in the heat of a battle. You know,
- 17:07Speaker 2: you go for booby and you get armed, go for booby,
- 17:09Speaker 2: you get on you know what I mean.
- 17:11Speaker 1: You know what I mean, I know what you can do.
- 17:16Speaker 2: So Danielle says, once I did that, my uncle jumped
- 17:18Speaker 2: in and he broke up the fight. Million says who
- 17:22Speaker 2: hit first. Daniel says, I don't know, but she grabbed
- 17:25Speaker 2: me first. Million goes, if you guys fought previously. Danielle goes, oh, yeah,
- 17:30Speaker 2: all the time. Our family fights all the time. And
- 17:34Speaker 2: she you know, she grabbed me floor. That's why I
- 17:38Speaker 2: bit her arm. And she said, and then my uncle
- 17:41Speaker 2: tried to get me off of her, and I grabbed
- 17:44Speaker 2: a pin and started stabbing my uncle in the leg
- 17:46Speaker 2: with the pin. Why because I was telling him to
- 17:49Speaker 2: get off of me. I was fighting my aunt. Million's like,
- 17:51Speaker 2: he's trying to stop a fight in a funeral home.
- 17:54Speaker 2: This guy's a hero.
- 17:56Speaker 1: Also, don't like give up that information? Willing?
- 17:58Speaker 2: Yeah, weird that you would say. Then Million said, that's
- 18:01Speaker 2: why her spirits bothered you. You're trying to fight people
- 18:03Speaker 2: in a funeral right there. M And she goes, so
- 18:07Speaker 2: you think that.
- 18:07Speaker 4: You're gat your grandma wouldn't be haunting you if you're
- 18:10Speaker 4: doing the right thing, right, That's what I'm getting at.
- 18:12Speaker 4: She thinks that she said, we're doing the right thing.
- 18:13Speaker 4: Why would grandma be haunting you?
- 18:15Speaker 2: So Million says, Danielle, you think that your aunt was
- 18:19Speaker 2: trying to keep the money, And daniel goes, of course,
- 18:23Speaker 2: that's what the funeral home will tell you as well.
- 18:25Speaker 2: They were trying to do this for the policy. She
- 18:27Speaker 2: was trying to keep the money. Million Uh asked if
- 18:31Speaker 2: she has any witnesses. She goes, I have two statements,
- 18:33Speaker 2: one from Alicia's sister, so one of her aunts is
- 18:39Speaker 2: actually giving a statement for the niece. And I have
- 18:43Speaker 2: a statement from the other granddaughter. She brings two affidavits
- 18:45Speaker 2: to court. Milion reads them and both basically it says
- 18:49Speaker 2: something to the effect of Alicia threw the chair back
- 18:51Speaker 2: and escalated things and basically started the fight right. She said, Alicia,
- 18:57Speaker 2: you're suing for what are your medical damages? Her cartilage
- 19:00Speaker 2: in her wrist, She had to have surgery on her hand.
- 19:03Speaker 2: And then Million said, did you guys attend the funeral?
- 19:06Speaker 2: Danielle said, yeah, with no issues. She apologized to me.
- 19:09Speaker 2: I apologized to her when we got over it. I'm
- 19:11Speaker 2: not the first one. She did the same thing to
- 19:14Speaker 2: her daughter and to my sister. This is not something
- 19:16Speaker 2: new for Alicia. She does this on a regular basis.
- 19:19Speaker 1: Fighting.
- 19:19Speaker 2: Yeah. She asked for medical records, and then she asked
- 19:23Speaker 2: Alicia why she didn't bring any witnesses in her favor.
- 19:25Speaker 2: Alicia says, your honor. Between me and my brother and sisters,
- 19:28Speaker 2: they all thought I was the favorite. They all have
- 19:30Speaker 2: something against me. I have a fracture here of the
- 19:33Speaker 2: records to prove that. And mill Yon says, what's your counterclaim?
- 19:38Speaker 2: Danielle says, my counterclaim is for five thousand dollars pain
- 19:41Speaker 2: and suffering. She took a picture, a baby picture of
- 19:45Speaker 2: me that she had. She put it on Facebook and
- 19:49Speaker 2: wrote the following, I was there when you were only
- 19:53Speaker 2: a confused child, and now this little baby is supposed
- 19:56Speaker 2: to be my niece, where I sacrificed a lot of
- 19:59Speaker 2: time to make sure she was nurtured and loved. She's
- 20:01Speaker 2: the cause of my left finger. Today, all I can
- 20:03Speaker 2: say is wow. So Alicia's take it was gonna be
- 20:08Speaker 2: puts it up and basically it's like, I can't believe
- 20:10Speaker 2: my niece did this to me. Yeah, So Danielle is
- 20:13Speaker 2: suing for five thousand dollars for paying and suffering because
- 20:15Speaker 2: of that post. Alicia is suing Danielle for her seventy
- 20:17Speaker 2: five hundred dollars of injuries past and present.
- 20:20Speaker 4: Did she have the medical she did, does have the
- 20:23Speaker 4: medical records, the bills.
- 20:24Speaker 2: She has the bills and the medical records. You know,
- 20:26Speaker 2: the thing that she read to roll, she's ready to roll.
- 20:28Speaker 4: The thing that's tricky about this is it makes sense
- 20:32Speaker 4: to me that you would say, okay, I have my
- 20:36Speaker 4: mom had a ten thousand dollars policy and I can't
- 20:40Speaker 4: spend more than that. So I will then look at
- 20:44Speaker 4: what the bills are and say I can pay this one,
- 20:47Speaker 4: I can pay this one, which is like the burial,
- 20:49Speaker 4: the big one, like what are we going to do
- 20:50Speaker 4: with the body? And then and that's what I'm going
- 20:52Speaker 4: and I'm not going to take on any any debt.
- 20:55Speaker 4: What the defendant seems to be stating is that is
- 21:01Speaker 4: she claiming that the total that she's claiming was owed
- 21:04Speaker 4: is not correct.
- 21:06Speaker 2: We don't get super specific, but the way said that,
- 21:09Speaker 2: the way that I understand it is is that Danielle
- 21:12Speaker 2: believes that Alisha was trying to pocket three ish thousand dollars.
- 21:18Speaker 2: That's the way that I understand it is that but
- 21:20Speaker 2: these all needed to be done. Yes that they added
- 21:24Speaker 2: up to over ten thousand dollars, but not much some
- 21:27Speaker 2: over ten thousand dollars, probably maybe a thousand more. And
- 21:30Speaker 2: Alisha signed the Big Dog and then she tried to
- 21:33Speaker 2: walk and pocket the rest of that money. Per Danielle,
- 21:36Speaker 2: Alisha is saying, I signed the Big Dog and the
- 21:39Speaker 2: other two I couldn't afford, so I needed to wait.
- 21:42Speaker 2: It's interesting, yeah.
- 21:47Speaker 4: And we don't there's disagreement over who punished first.
- 21:53Speaker 1: It was a squabble. I'm throwing out the countersuit for the.
- 21:57Speaker 4: Easy for that, I think that's easy easy. I think
- 22:04Speaker 4: that this would have been u uh. I think she's
- 22:08Speaker 4: gonna get the money. I think she can prove she's
- 22:12Speaker 4: proven that these injuries were as of a result of
- 22:16Speaker 4: her niece. Her niece did not countersue her for for
- 22:20Speaker 4: injuries injuries. She kind of sad for something else. I
- 22:22Speaker 4: think if you come with injuries and bills, then we
- 22:25Speaker 4: can kind of split it down the middle or whatever.
- 22:27Speaker 1: This is.
- 22:28Speaker 4: Hey, she injured me, I want money. I think she's
- 22:30Speaker 4: gonna get the money.
- 22:31Speaker 2: She's not gonna get a dime brand uh, basically million,
- 22:34Speaker 2: says your niece brought two affidavits to the courtroom that
- 22:39Speaker 2: says that you instigated and started this fight. I forgot
- 22:42Speaker 2: about the witnesses, and you brought me no witnesses that
- 22:46Speaker 2: say that she instigated and started the fight. Based upon that,
- 22:50Speaker 2: I have to rule that you started this fight and
- 22:53Speaker 2: means you don't get any money for your your injuries.
- 22:56Speaker 4: That's tough though, Like if if, if what she says
- 22:58Speaker 4: is true about her sibling believing that she was the face,
- 23:01Speaker 4: it's a tough spot. Then of course they would take
- 23:04Speaker 4: like but she didn't have any witnesses. I mean, this
- 23:06Speaker 4: is familial uh strife, and that's always tricky, always tricky,
- 23:10Speaker 4: It's always so tricky.
- 23:12Speaker 3: I don't know.
- 23:13Speaker 1: I think it's a fine.
- 23:14Speaker 2: I thought it was a fair ruling considering all involved. Yes,
- 23:17Speaker 2: you think she was pocketing the money. I think she
- 23:20Speaker 2: probably wanted to keep some of the money. I think,
- 23:24Speaker 2: but I don't know. I don't know for sure. That's
- 23:26Speaker 2: all I got. That's all I can tell you.
- 23:28Speaker 4: All Right, well we did it. Great, congratulations to us.
