Speaker 1: What's up, everyone, and welcome back to the program. In
• 0:03
Speaker 1: this episode, we're going to pick up where we left
• 0:05
Speaker 1: off with the Tyler Robinson prelim hearing from day one.
• 0:10
Speaker 1: Judge Graff, all right. Given my previous rulings on exhibits,
• 0:14
Speaker 1: I apply the same analysis and find that state exhibit 12.2,
• 0:17
Speaker 1: I believe, is admitted over the objection and may be
• 0:20
Speaker 1: published in the courtroom and by the media if so chosen. Prosecution. Okay,
• 0:25
Speaker 1: so before we play the video again, what is it
• 0:27
Speaker 1: that leads you to believe that That, this is Mr. Robinson. Answer.
• 0:32
Speaker 1: The shape of the vehicle can clearly be seen as
• 0:34
Speaker 1: it pulls up, and the distinctive wheels on the vehicle also. Question.
• 0:39
Speaker 1: We'll go ahead and play it. Judge Graff, is there
• 0:41
Speaker 1: any sound associated with this? Answer. There is, Judge, but
• 0:44
Speaker 1: it's night sounds. It's crickets chirping. Judge Graff. Okay, I
• 0:48
Speaker 1: just wanted to see if there was. I just wanted
• 0:50
Speaker 1: to see if there was sound or not. Prosecution. Okay. Judge,
• 0:54
Speaker 1: all right, you may play the video. Prosecutor. So, on
• 0:58
Speaker 1: the first part of that video, what do you see? Answer,
• 1:00
Speaker 1: the vehicle, we believe to be driven by Mr. Robinson,
• 1:04
Speaker 1: pulling up to the parking in front of, across the street,
• 1:07
Speaker 1: but in front of the residence. Question okay. And the
• 1:10
Speaker 1: next video, what do you believe, is displayed in that video? Answer,
• 1:15
Speaker 1: there's an individual who gets out of the vehicle, you
• 1:17
Speaker 1: can hear the door close, and then that individual moves
• 1:20
Speaker 1: away from the front of the vehicle. There's actually two
• 1:22
Speaker 1: reflective panels on a dumpster, and you can see the
• 1:25
Speaker 1: individual moving Pass those reflective panels. Question. And the last
• 1:31
Speaker 1: of those series of videos? Answer. The second to last one,
• 1:34
Speaker 1: the individual comes back across those reflective panels to the vehicle,
• 1:38
Speaker 1: unlocks the vehicle, and gets into it. And then, in
• 1:41
Speaker 1: the last video, the vehicle is started and the individual
• 1:44
Speaker 1: drives away. Prosecution. Just one moment, Judge. Judge Graff, yes. Prosecution. Judge,
• 1:52
Speaker 1: could we approach? Judge Graff, you may. Now the judge announces,
• 1:57
Speaker 1: ladies and gentlemen, we're going to take a 10-minute break
• 1:59
Speaker 1: for the attorneys to confer and come back at, well,
• 2:02
Speaker 1: roughly 4.30. So court is in recess. Now they come back.
• 2:07
Speaker 1: Judge Graff seats them. And the prosecutor has some more questions. Judge,
• 2:12
Speaker 1: I think I just have a couple of questions for
• 2:14
Speaker 1: Sergeant Hull to finish out the day. I think we're
• 2:16
Speaker 1: in agreement that once we've sorted out these few questions,
• 2:20
Speaker 1: we're all in agreement. We want a break for the day.
• 2:22
Speaker 1: Is that right, Ms. Nestor? Kathy Nestor? Me and you. Prosecutor. Well, sure.
• 2:29
Speaker 1: Judge Graff, you may proceed with your questions and we'll
• 2:32
Speaker 1: take it from there. Question. All right. Agent Hall, I
• 2:36
Speaker 1: asked you earlier after you had testified about all the
• 2:39
Speaker 1: video that you've watched and video that you believe depicts Mr.
• 2:43
Speaker 1: Robinson from the UV surveillance and that combined with the
• 2:46
Speaker 1: driver's license and the DMV records. whether or not you
• 2:50
Speaker 1: believe that the person that you have seen in the
• 2:52
Speaker 1: video and on the driver's license record is in the
• 2:55
Speaker 1: courtroom today, and I believe your answer was yes. Answer, yes,
• 3:00
Speaker 1: that's correct. Question, and then I asked if you wouldn't
• 3:03
Speaker 1: mind pointing him out and describing something that he's wearing,
• 3:06
Speaker 1: and I don't believe that I allowed you to do that. Answer, okay. Question,
• 3:11
Speaker 1: would you do that right now? Kathy Nestor jumps in,
• 3:13
Speaker 1: Your Honor, just for the record, we would impose an
• 3:16
Speaker 1: objection based on the 14th Amendment. for a due process
• 3:19
Speaker 1: due to an unduly suggestive in-court ID. Also, we believe
• 3:24
Speaker 1: there's a lack of foundation establishing his ability to interpret
• 3:27
Speaker 1: the surveillance video, and based on that, we would object.
• 3:31
Speaker 1: Judge Graff, all right, well, to the state, do you
• 3:33
Speaker 1: wish to be heard on what was just stated? Answer, well, Judge,
• 3:37
Speaker 1: I think we had this discussion, and I think you
• 3:39
Speaker 1: ruled on that specific objection. And then after you ruled,
• 3:43
Speaker 1: I just neglected to come back and follow through with
• 3:45
Speaker 1: the question and the answer. That's my recollection of the
• 3:48
Speaker 1: bench meeting. Judge Graff, I believe I stated for the
• 3:51
Speaker 1: purpose of this hearing that identification by Agent Hull of Mr.
• 3:54
Speaker 1: Robinson was made. Prosecution, well, I just wanted to clarify that, Judge,
• 3:59
Speaker 1: because there was some question about whether that, in fact,
• 4:02
Speaker 1: did happen. And so if that's your recollection of what happened,
• 4:05
Speaker 1: and if you're willing to put on the record that
• 4:07
Speaker 1: Agent Hull was identified the defendant, I think we're done.
• 4:11
Speaker 1: Judge Graff, does the defendant want to be heard? No,
• 4:15
Speaker 1: Your Honor. Judge Graff, well, for the benefit of the
• 4:17
Speaker 1: record and for thoroughness, if you wish to re-ask the question,
• 4:20
Speaker 1: you certainly, well, we can see what happens. Prosecution, if
• 4:25
Speaker 1: you could hold, Judge, I'd like to. Would you please
• 4:27
Speaker 1: point him out and identify something that he's wearing? Answer, yeah.
• 4:31
Speaker 1: I believe that Mr. Robinson is between Ms. Nestor and
• 4:34
Speaker 1: the other counsel wearing a gray suit, a jacket with
• 4:37
  Speaker 1: a dark tie, and a light-colored shirt. Question, Judge, I
• 4:42
Speaker 1: would like to ask for the record to reflect that
• 4:44
Speaker 1: Agent Hull has identified the defendant. Prosecution, I mean, I
• 4:49
Speaker 1: made my objection already. Judge Graff, okay, I just wanted
• 4:52
Speaker 1: to check. Defense, no, thank you, Your Honor. Judge Graff,
• 4:56
Speaker 1: all right, for the purposes of this hearing, I find
• 4:59
Speaker 1: that Agent Hull has identified Mr. Robinson. Again, this is
• 5:03
Speaker 1: only for the prelim hearing. You may proceed. Prosecution, Judge,
• 5:07
Speaker 1: I think for today with Agent Hull, we're done for today.
• 5:10
Speaker 1: We'd ask at this point, we take a break until tomorrow.
• 5:13
Speaker 1: Judge Graff, all right, so are you saying that you're
• 5:16
Speaker 1: going to recall Agent? Well, we're going to resume with Mr.
• 5:19
Speaker 1: Hull tomorrow morning. Answer, tomorrow morning. And I was going
• 5:22
Speaker 1: to explain this, but let me explain why. Judge, our
• 5:25
Speaker 1: intent is to prepare an original version of the video
• 5:28
Speaker 1: that's been in dispute today without the circles, without the blur,
• 5:32
Speaker 1: and without the zooming in. And our intent is to
• 5:35
Speaker 1: introduce that tomorrow as a different exhibit, and we just
• 5:38
Speaker 1: can't prepare that in the next hour or so. So
• 5:40
Speaker 1: we're just going to need the evening to prepare the
• 5:43
Speaker 1: exhibit And we'd like to return with that. Judge, I
• 5:46
Speaker 1: would also suggest... Well, I guess let me get your
• 5:48
Speaker 1: take on that, Judge. Judge Graff, all right. Does the
• 5:51
Speaker 1: defense wish to be heard about the ending for today?
• 5:54
Speaker 1: We have about 19 minutes until 5. What's the defense?
• 5:58
Speaker 1: The defense jumps in. Your Honor, we're happy to accommodate
• 6:01
Speaker 1: the state on that. Judge Graff, all right. So for today,
• 6:04
Speaker 1: Agent Hull, you may step down and we'll resume with
• 6:07
Speaker 1: your testimony tomorrow morning. Anything further? Prosecution? Well, Judge... Just
• 6:13
Speaker 1: one other thing, and it's a suggestion. Kathy Nestor, Agent Hull,
• 6:17
Speaker 1: can you wait just one second? I'm sorry, go ahead. Prosecution,
• 6:21
Speaker 1: I'm sure Ms. Nestor may have a position with regards
• 6:24
Speaker 1: to this, but Judge, we would invite you to review
• 6:26
Speaker 1: the exhibit that we've been talking about today. It is 12.1.
• 6:30
Speaker 1: We suggest that you look at it between today and
• 6:33
Speaker 1: tomorrow because our intent is to seek to admit the
• 6:36
Speaker 1: version where it doesn't have the circle or the blur
• 6:39
Speaker 1: or the zoom-in. And if that's admitted, we do intend
• 6:42
Speaker 1: to introduce that exhibit 12.1 as well. And I think
• 6:45
Speaker 1: it would be helpful if you saw that in advance,
• 6:48
Speaker 1: and you could compare that to the version that doesn't
• 6:50
Speaker 1: have the circle, the blur, and the zooming in. I
• 6:53
Speaker 1: would ask that you do that. I don't know if Ms.
• 6:55
Speaker 1: Nestor has a different opinion about that, but I think
• 6:58
Speaker 1: it would be helpful in determining whether or not that
• 7:00
Speaker 1: particular exhibit 12.1 is admissible. Judge Graff, Ms. Nestor, Kathy Nestor,
• 7:07
Speaker 1: I don't have anything to add to that. I defer
• 7:09
Speaker 1: to what the court prefers to do on that. I
• 7:11
Speaker 1: do have another matter before Agent Hull is released that
• 7:14
Speaker 1: I do want to address with the court, but I
• 7:16
Speaker 1: don't have any concern if the court wants to look
• 7:18
Speaker 1: at it in advance. It's kind of a long bit
• 7:21
Speaker 1: of a long video. I think it's just about five minutes, maybe.
• 7:24
Speaker 1: It's not very long, so if you want to wait
• 7:26
Speaker 1: until tomorrow, it's not going to slow the matter down
• 7:29
Speaker 1: very much, but it's up to the court on that.
• 7:31
Speaker 1: Judge Graff, all right, I appreciate the party's What I'm
• 7:35
Speaker 1: going to do is I'm going to wait until it's
• 7:37
Speaker 1: properly before me and a motion has been made for
• 7:39
Speaker 1: either of the videos and I'm happy to entertain the
• 7:42
Speaker 1: motion to review both of them or however the parties.
• 7:45
  Speaker 1: I don't want to issue a pre-ruling, so I'll wait
• 7:48
Speaker 1: till it's properly before me and I can take it
• 7:51
Speaker 1: from there. Being that it's about five minutes, I'm not
• 7:54
Speaker 1: too concerned about how much time is needed. I also
• 7:57
Speaker 1: want to be thorough, so I'll wait till it's brought
• 7:59
Speaker 1: before me and we can address it from there. and
• 8:03
Speaker 1: turning to Ms. Nestor as it relates to your request.
• 8:06
Speaker 1: Kathy Nestor. Thank you, Your Honor. Your Honor, I recognize
• 8:09
Speaker 1: that Agent Hull is a case agent and is working
• 8:12
Speaker 1: with the state preparing for this, but he's still on
• 8:15
Speaker 1: the stand, and I would ask that he be instructed
• 8:17
Speaker 1: that he can't discuss his testimony. Even though he's a
• 8:20
Speaker 1: case agent, I don't think it's proper for him to
• 8:22
Speaker 1: discuss his testimony while he's excused for the night. Judge Graff. Agent.
• 8:29
Speaker 1: Reply by the agent. It's not a problem, Judge. Judge Graff,
• 8:32
Speaker 1: all right, so agent, from this moment on until we
• 8:34
Speaker 1: come back in court, you're instructed not to discuss your
• 8:37
Speaker 1: testimony with anyone as you are still on the stand
• 8:40
Speaker 1: for all intents and purposes. And if the state recalls
• 8:43
Speaker 1: you this tomorrow morning, then we'll proceed, okay? Agent, okay,
• 8:48
Speaker 1: Your Honor. Judge Graff, all right. May this witness be excused?
• 8:53
Speaker 1: Kathy Nestor, for now, Your Honor. Judge Graff, for today,
• 8:56
Speaker 1: all right. Thank you, Agent Hull. Anything further from the parties,
• 9:00
Speaker 1: or do either party need the benefit of the record
• 9:02
Speaker 1: before we adjourn? Kathy Nestor, no, Your Honor. Prosecution, not
• 9:07
Speaker 1: from the state judge. Judge Graff, all right. Noting that
• 9:12
Speaker 1: neither party wishes the benefit of the record, court is
• 9:14
Speaker 1: in recess until 9 a.m. tomorrow morning. All rise. Okay,
• 9:19
Speaker 1: so we're going to cut it short here, a little
• 9:21
Speaker 1: bit shorter than our usual 10, 12, 15 minutes, but
• 9:25
Speaker 1: I want to try and keep it uniformed. And we'll
• 9:26
Speaker 1: start day two. in the next episode dealing with the
• 9:30
Speaker 1: topic nice and fresh. All the information that goes with
• 9:34
Speaker 1: this episode can be found in the description box.
