Latest / Beyond The Horizon / Mega Edition: The Chad Daybell Trial (Part 4) (10/19/26)
Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:04Speaker 1: this episode, we're going to continue on with our recap
- 0:07Speaker 1: of the Chad Daybell trial and we're going to see
- 0:10Speaker 1: what went down in the courtroom during day number four.
- 0:15Speaker 1: And so far, there really haven't been too many surprises
- 0:18Speaker 1: or anything that I would call unexpected. And the prosecution
- 0:23Speaker 1: continues to hammer their point home with each and every
- 0:26Speaker 1: witness that they call And each exhibit that they show
- 0:29Speaker 1: is evidence. So they continue on continuing on with the
- 0:33Speaker 1: same pattern that we saw with Lori Vallow. And that's
- 0:36Speaker 1: just bled over here into the Chad Daybell trial. So today,
- 0:41Speaker 1: once again, we're going to be using an article from EastIdahoNews.com.
- 0:46Speaker 1: And the author of this article is Nate Eaton. 826 a.m.
- 0:52Speaker 1: We're back in the courtroom. People in the gallery are seated.
- 0:55Speaker 1: Prosecutors are at their tables. John Pryor is at his table,
- 0:58Speaker 1: but Chad Daybell is not in the courtroom yet. FBI
- 1:02Speaker 1: tactical specialist Nicole Heideman will be back on the stand
- 1:06Speaker 1: this morning. 8.31 a.m. Chad Daybell just walked in. He's
- 1:11Speaker 1: wearing khaki pants, a dress shirt, and tie. He does
- 1:14Speaker 1: not have on handcuffs or leg shackles, but appears to
- 1:17Speaker 1: be wearing an ankle monitor on his right leg. And
- 1:21Speaker 1: there's a lot of talk about Brian Kohlberger and the
- 1:24Speaker 1: way he shows up to court. without any restraints. So
- 1:28Speaker 1: this seems to be something that they do up here
- 1:30Speaker 1: in Idaho relatively often, it would seem. And remember, Brian Koberger,
- 1:36Speaker 1: Chad Daybell, these guys haven't been convicted of anything yet.
- 1:40Speaker 1: So I could understand why their legal teams wouldn't want
- 1:43Speaker 1: them showing up in shackles, looking like Hannibal Lecter. 8.40 a.m.
- 1:48Speaker 1: Jurors take their seats. Boyce reminds everyone in the courtroom
- 1:52Speaker 1: to follow the conduct order. He says a few members
- 1:55Speaker 1: of the public did not comply yesterday and were not
- 1:58Speaker 1: able to come back in the afternoon. 8.42 a.m. Heidemann
- 2:03Speaker 1: says the case of the missing children quickly expanded into
- 2:06Speaker 1: the deaths of Tammy Daybell and Charles Vallow, as well
- 2:09Speaker 1: as the attempted shooting of Brandon Boudreau. 8.43 a.m. Heidemann
- 2:15Speaker 1: looked at web searches done by Lori Vallow and Chad Daybell.
- 2:18Speaker 1: Blake asked to admit a PowerPoint exhibit on a thumb drive.
- 2:22Speaker 1: And those are the things that are really going to
- 2:25Speaker 1: sink Lori Vallow with the jury. These exhibits, they were
- 2:29Speaker 1: invaluable to the prosecutors. When we're talking about Lori Vallow,
- 2:33Speaker 1: and it's going to be the same story this time around.
- 2:36Speaker 1: Rinse and repeat.
- 2:37Speaker 2: 8.46 a.m.
- 2:40Speaker 1: The first slide shows the summer of search activity from
- 2:43Speaker 1: Chad Daybell at gmail.com beginning October 1st, 2018. And on
- 2:47Speaker 1: January 28th, 2019, The email user searched for Ned Schneider,
- 2:54Speaker 1: 1996 death, and other searches revolving around Ned Schneider. There
- 3:01Speaker 1: was also a search for bodies possessed after original occupant dies, 8.49 a.m.
- 3:07Speaker 1: Heidemann says he reviewed multiple documents, reports, and phone data.
- 3:11Speaker 1: She learned of the name Ned Schneider, Schneider, from Chandler
- 3:15Speaker 1: and Gilbert police. Charles Vallow made comments that Lori referred
- 3:19Speaker 1: to him as Ned Schneider, or Schneider. The name also
- 3:23Speaker 1: appeared in Laurie's iCloud account in connection to Charles. And again,
- 3:27Speaker 1: if you haven't watched that documentary about Laurie Vallow on Netflix,
- 3:32Speaker 1: I suggest you do. It gives you a lot of
- 3:34Speaker 1: background information, and I'll tell you what, all you have
- 3:38Speaker 1: to do is take a look at the way this
- 3:39Speaker 1: lady reacted to Charles being shot, and that tells me
- 3:43Speaker 1: everything I needed to know about who she is and
- 3:47Speaker 1: about the callous nature of her personality. I don't care
- 3:50Speaker 1: what the situation is. If your ex-husband, your husband, they
- 3:54Speaker 1: get shot and killed by your brother, there's going to
- 3:57Speaker 1: be a reaction. But for Lori Vallow, it was just
- 4:01Speaker 1: like business as usual. Like it was expected. And you
- 4:04Speaker 1: know why? Well, that's because her and Alex Cox, they
- 4:09Speaker 1: conspired to kill Charles Vallow. And that's why ratty-ass, busted-ass,
- 4:14Speaker 1: skafooza Lori Vallow is facing charges in Arizona now as well.
- 4:18Speaker 2: 8.52 a.m.
- 4:22Speaker 1: The Chad Gmail account searched Ned Schneider, Louisiana obituary, 1997
- 4:27Speaker 1: on January 31st, 2019. The next search on March 6th,
- 4:33Speaker 1: 2019 was about cancer and Leo being compatible. Heidemann says
- 4:37Speaker 1: Lori's birthday is a cancer and Chad's birthday makes him
- 4:40Speaker 1: a Leo. Well, what are the odds, huh? An actual
- 4:44Speaker 1: physical embodiment of cancer is a cancer as far as
- 4:48Speaker 1: her astrological sign as well? Pretty ironic.
- 4:51Speaker 2: 8.54 a.m.
- 4:54Speaker 1: On May 5th, 2019, there was a search for Malachite
- 4:58Speaker 1: eBay Malachite jewelry. Chad and Lori purchased Malachite wedding rings. 8.55 a.m.
- 5:05Speaker 1: The Chad email account also searched for Hiplos on June 21st, 2019.
- 5:09Speaker 1: On July 9th, 2019, the day Charles was shot and killed,
- 5:14Speaker 1: there was a search for when you surprise someone with accusations.
- 5:18Speaker 1: There was a search on September 8th, 2019 for SSW Wind.
- 5:24Speaker 1: What is the definition of SSW direction? It's believed Tylee
- 5:28Speaker 1: Ryan was killed September 9th. The last search on October 8th,
- 5:33Speaker 1: 2019 was for Rhode Island area code. Heidemann says one
- 5:37Speaker 1: of the phone numbers belonging to Chad had a Rhode
- 5:40Speaker 1: Island area code.
- 5:41Speaker 2: 8.57 a.m.
- 5:44Speaker 1: The next slideshow searches from lollitimeforever at gmail.com between March 7th,
- 5:50Speaker 1: 2019 and December 14th, 2019. The first search on May 7th,
- 5:56Speaker 1: 2019 was for malachite. There was a search on July 21st,
- 6:00Speaker 1: 2019 for life insurance for children, the grow up plan.
- 6:05Speaker 1: Heidemann says to the best of her knowledge, there was
- 6:07Speaker 1: no life insurance on the children. And honestly, I'm shocked
- 6:10Speaker 1: by that. Considering how Lori Vallow tried to get her
- 6:14Speaker 1: disgusting ass claws into everybody else's money all the time,
- 6:17Speaker 1: I'm shocked that she didn't have an insurance policy on
- 6:20Speaker 1: these kids. 9 a.m. There were a lot of searches
- 6:24Speaker 1: for information on service dogs and selling service dogs on
- 6:27Speaker 1: July 26, 2019. On August 25, 2019, there was a
- 6:32Speaker 1: search for wedding bands made of malachite. There were searches
- 6:36Speaker 1: for Kennedy Elementary, the school JJ attended in Rexburg, on
- 6:40Speaker 1: September 20th and 24th of 2019, 9.01 a.m. There was
- 6:46Speaker 1: a search on September 30th, 2019, how to get the
- 6:50Speaker 1: backseat of my Jeep Wrangler, Jeep Wrangler JK rear seat removal,
- 6:55Speaker 1: how to DIY YouTube. On October 2nd, 2019, there was
- 7:00Speaker 1: a search for Gilbert, Arizona News, On October 22, 2019,
- 7:05Speaker 1: three days after Tammy Daybell died, there was a search
- 7:08Speaker 1: for wedding dresses, wedding dresses in Kauai. 9.05 a.m. Blake
- 7:13Speaker 1: has no further questions for Heidemann. Pryor will now cross-examine. 9.07 a.m.
- 7:18Speaker 1: Pryor asks Heidemann if she's aware Chad is not implicated
- 7:22Speaker 1: in Charles Vallow's death or attempted murder of Brandon Boudreau.
- 7:26Speaker 1: Heidemann says that's correct. 9.08 a.m. Pryor says he notices
- 7:31Speaker 1: there is an FBI agent in the court who has
- 7:34Speaker 1: been there a number of times. He asks Heidemann if
- 7:36Speaker 1: that's her supervisor. She says he is not her direct supervisor.
- 7:40Speaker 1: Heidemann says she has not discussed her testimony in detail
- 7:44Speaker 1: with him. Pryor asks Heidemann if she has spoken with
- 7:47Speaker 1: the FBI agent, if she has spoken with him over
- 7:50Speaker 1: the last week about the testimony in the case. She
- 7:52Speaker 1: says possibly.
- 7:53Speaker 2: 9.12 a.m.
- 7:54Speaker 1: Heidemann says says she is not communicating with the agent
- 7:58Speaker 1: in any significant way. Pryor asks Heidemann if she believes J.J.
- 8:03Speaker 1: Vallow was murdered the afternoon of September 22nd up until
- 8:07Speaker 1: late morning of September 23rd. Heidemann says yes. Pryor asks
- 8:13Speaker 1: Heidemann if she's aware J.J. was murdered either in an
- 8:16Speaker 1: apartment of Lori Vallow or close proximity. Heidemann says she
- 8:20Speaker 1: isn't sure if we know exactly where he was killed.
- 8:23Speaker 1: And that's the truth. All we know is that he
- 8:26Speaker 1: was killed. And it's my guess, my speculation, that Alex
- 8:30Speaker 1: Cox was the one who actually did the killing. And
- 8:33Speaker 1: I've said that from the very beginning. When all of
- 8:36Speaker 1: this started, when I first started looking at this, and
- 8:39Speaker 1: I first started hearing about their relationship, I knew that
- 8:42Speaker 1: old beaver face was a piece of shit. Anyone who
- 8:45Speaker 1: has Lannister-like feelings for their sister is somebody that is disturbed.
- 8:50Speaker 2: 9.13 a.m.
- 8:53Speaker 1: Pryor says Lori Vallow, Alex Cox, Melanie Gibb, and David
- 8:56Speaker 1: Warwick were all around J.J. Vallow on the day that
- 8:59Speaker 1: he died. Pryor says he doesn't see any Google searches
- 9:03Speaker 1: on Gibb or Warwick. Why don't I have any Google
- 9:06Speaker 1: search information on Melanie Gibb or David Warwick? Heidemann says
- 9:10Speaker 1: she doesn't write the search warrants. And that's true. She
- 9:14Speaker 1: just carries them out, right? The investigators and the prosecutors
- 9:18Speaker 1: and the judge, they're the ones who decide what's going
- 9:20Speaker 1: to be in a search warrant. Certainly not the FBI
- 9:24Speaker 1: agent that's doing the raid. They're just there to follow
- 9:28Speaker 1: the search warrant to a T. But I happen to agree.
- 9:31Speaker 1: Melanie Gibb, David Warwick, all of these people that were
- 9:35Speaker 1: around them, I've had my suspicions of. And my guess
- 9:38Speaker 1: is they helped out with the investigation and it made
- 9:41Speaker 1: it a lot easier on them. Because if I was
- 9:44Speaker 1: an investigator and these people were all palling around doing
- 9:47Speaker 1: podcasts together and the rest of it, oh, you better
- 9:50Speaker 1: believe I'd have some questions.
- 9:51Speaker 2: 9.15 a.m.
- 9:55Speaker 1: Pryor asks Heidemann about Chad and Lori being in a
- 9:58Speaker 1: romantic relationship. He says, the relationship was happening while Charles
- 10:02Speaker 1: and Tammy were both alive. Heidemann says that's correct. Pryor
- 10:06Speaker 1: asks if some of the Google searches could be explained
- 10:09Speaker 1: by the fact that Chad was trying to hide his
- 10:11Speaker 1: affair with Lori. Heidemann says she's unsure she understands. Oh yeah,
- 10:16Speaker 1: he's looking for other wedding rings because he's trying to
- 10:19Speaker 1: hide his relationship. I don't know about you, but being
- 10:21Speaker 1: a married man and out here talking about I need
- 10:25Speaker 1: to find prices on wedding dresses and wedding rings and
- 10:28Speaker 1: the rest of it, probably not a good look. Especially
- 10:32Speaker 1: if you and your wife haven't been talking about any
- 10:34Speaker 1: of that stuff. 9.17am. Pryor shows the slide of the
- 10:38Speaker 1: Chad Daybell wedding. At gmail.com searches, Pryor asks Heidemann if
- 10:43Speaker 1: we know for sure Chad did the searches. She says no.
- 10:46Speaker 1: She doesn't know for sure that it was Chad typing
- 10:49Speaker 1: in the searches, but someone with access to his account.
- 10:52Speaker 1: Pryor asks Heidemann if she's aware three to four other
- 10:55Speaker 1: people were living in Chad's house at the time. So
- 10:58Speaker 1: they all had access to his account? They all know
- 11:00Speaker 1: his passwords? I highly doubt that, considering the stories that
- 11:04Speaker 1: Stunad was sending over to Scafusa Highly doubt his children
- 11:09Speaker 1: had the passwords. Then again, who knows? Like I said before,
- 11:13Speaker 1: they give me that whole hills have eyes vibe anyway,
- 11:17Speaker 1: so maybe they're all Lannistering around the neighborhood. What the
- 11:20Speaker 1: hell do I know? 9.19 a.m. Heidemann is not sure
- 11:24Speaker 1: where the searches were done from, a phone or a computer.
- 11:28Speaker 1: Pryor asks about the search on March 6, 2019, about
- 11:32Speaker 1: Leo and cancer being compatible. 9.21 a.m. Pryor asks if
- 11:37Speaker 1: it's possible Lori... could have been dropping hints about one
- 11:40Speaker 1: day getting married and having a Malachite ring. Heidemann says
- 11:43Speaker 1: ultimately they purchased Malachite wedding bands. Pryor asks Heidemann if
- 11:48Speaker 1: she's aware there were discussions between Alex and Zulima about
- 11:52Speaker 1: Malachite rings. She isn't sure about that. Well, probably. Alex
- 11:57Speaker 1: wanted to do whatever Lori and Chad were doing, and
- 12:00Speaker 1: since he couldn't have Lori for himself, the sick degenerate bastard,
- 12:04Speaker 1: wanted to be as close as possible.
- 12:06Speaker 2: 9.24 a.m.
- 12:09Speaker 1: Pryor asking about Ned Snyder, Schneider. Heidemann says Chad regularly
- 12:14Speaker 1: did searches for different people, but the Ned Snyder, Schneider
- 12:17Speaker 1: was directly connected to this case. Pryor says Chad's history
- 12:21Speaker 1: shows there are a lot of inquiries into a lot
- 12:24Speaker 1: of names and topics. Thousands of searches. 9.27 a.m. Pryor
- 12:29Speaker 1: says days after Chad searched for the wind details, he
- 12:33Speaker 1: emailed his wife saying he was going to burn some
- 12:35Speaker 1: limbs in the backyard. Pryor now asking about track phones
- 12:39Speaker 1: and how, if you were having an affair, wouldn't it
- 12:42Speaker 1: be logical to buy different phones to hide it from
- 12:44Speaker 1: his wife? Heidemann says it's possible. Well, yeah, there's no
- 12:47Speaker 1: doubt that that's possible.
- 12:50Speaker 2: 100%.
- 12:50Speaker 1: If you're having an affair, getting a burner phone is
- 12:53Speaker 1: probably a good idea. Unless your wife catches you with
- 12:56Speaker 1: that shit, like Walter White.
- 12:58Speaker 2: 9.30 a.m.
- 13:00Speaker 1: Pryor directs Heidemann to look at the lolly time forever slide.
- 13:04Speaker 1: He asks Heidemann about Lori's children watching their father be killed.
- 13:08Speaker 1: Pryor says we don't know what JJ or Tylee saw.
- 13:12Speaker 1: The evidence goes both ways. Pryor says one of Tylee's
- 13:15Speaker 1: close friends was interviewed and provided information on what Tylee says. 9.34 a.m.
- 13:22Speaker 1: Pryor says he didn't see anything where Chad Daybell searched
- 13:25Speaker 1: for life insurance on the kids. Heidemann says he didn't.
- 13:28Speaker 1: Pryor asks if there was any emails that said, let's
- 13:31Speaker 1: kill two kids. Heidemann says there were not. Pryor says
- 13:35Speaker 1: Lori searched for life insurance information. Pryor asks about Elena
- 13:39Speaker 1: and Hiplos, and if there are religious meanings. Heidemann says
- 13:43Speaker 1: not necessarily. It got confusing because Chad and Lori called
- 13:47Speaker 1: each other different names. I'm telling you the best names
- 13:50Speaker 1: for these two. Scafusa, Stunad.
- 13:53Speaker 2: 9.36 a.m.
- 13:56Speaker 1: Pryor says Chad and Lori have strong religious beliefs, but
- 13:59Speaker 1: so do Melanie Gibb, David Warwick, Alex Cox, and Zaluma Pastanis. 1,000%
- 14:04Speaker 1: and like I've said a million times and not to
- 14:08Speaker 1: beat a dead horse here, all of these weirdos should
- 14:11Speaker 1: have been charged with something. 9.37 a.m. Pryor asked about
- 14:16Speaker 1: the search on removing the backseat of the Jeep. That
- 14:19Speaker 1: was on Lori's account. Pryor asked if there was any
- 14:22Speaker 1: search done by Chad about moving a seat. Heideman says no.
- 14:26Speaker 1: Pryor clarifies that Chad has not been charged in Arizona.
- 14:31Speaker 1: Heideman says that's correct.
- 14:34Speaker 2: 9.38 a.m.
- 14:35Speaker 1: Pryor asks Heideman if she's aware Lori Vallow was in
- 14:38Speaker 1: Hawaii with Audrey Baratiero and Melanie Boudreau on October 22, 2019.
- 14:46Speaker 1: Pryor asks Heideman if she's aware the ladies were looking
- 14:49Speaker 1: for wedding dresses on that day. Heideman is unaware of that.
- 14:52Speaker 1: Pryor has no further questions. Blake will now read direct. 9.40 a.m.
- 14:59Speaker 1: Blake asks Heidemann if she is aware Audrey is married.
- 15:02Speaker 1: Heidemann says at the time she was not married. Blake
- 15:05Speaker 1: asks about the attempted shooting of Brandon Boudreau and the
- 15:08Speaker 1: death of Charles Vallow. She asks Heidemann if she is
- 15:12Speaker 1: still involved in the active investigations regarding those incidents. Heidemann
- 15:16Speaker 1: says she is not.
- 15:19Speaker 2: 9.42 a.m.
- 15:20Speaker 1: Blake asks Heidemann if she is aware who designated Charles
- 15:23Speaker 1: as Ned. Heidemann says Lori calls Charles Ned, but she
- 15:26Speaker 1: doesn't know where the name comes from. The searches for
- 15:29Speaker 1: Ned were done around the same time Lori was calling
- 15:32Speaker 1: Charles Ned. Blake says Heidemann found any searches in Chad's
- 15:36Speaker 1: email regarding divorce or separation. Not that I recall, she responds. 9.43 a.m.
- 15:44Speaker 1: Blake asks about the statement that people having affair changed
- 15:47Speaker 1: their phone numbers. She asks Heidemann if people involved in
- 15:50Speaker 1: criminal activity also changed phone numbers. Heidemann says yes. Yeah,
- 15:54Speaker 1: basically any activity that you're up to where you don't
- 15:57Speaker 1: want other people to be aware of what you're doing,
- 15:59Speaker 1: having a burner phone is the way to go. And
- 16:02Speaker 1: that's what good criminals anyway tend to do. 9.44 a.m.
- 16:07Speaker 1: Blake asks Heidemann if she's aware that Melanie Gibb or
- 16:10Speaker 1: David Warwick profited from JJ's death. She says no. Blake
- 16:14Speaker 1: has no further questions. She's done testifying at this point,
- 16:18Speaker 1: but will be recalled by the state later in the trial. 9.47 a.m.
- 16:24Speaker 1: Chandler Police Detective Nathan Duncan is the next witness on
- 16:27Speaker 1: the stand. 9.49 a.m. Blake asked Duncan if he was
- 16:31Speaker 1: working on July 11th, 2019. She asked if he responded
- 16:36Speaker 1: to a report of a shooting. He did. The call
- 16:38Speaker 1: came in around 8.36 a.m. He arrived 20 to 30
- 16:42Speaker 1: minutes after the original call. 9.51 a.m. Alex Cox made
- 16:47Speaker 1: the 911 call. He said he shot his brother-in-law, Charles Vallow,
- 16:50Speaker 1: in self-defense. Before this day, Duncan had never heard of
- 16:54Speaker 1: Alex or Charles. Duncan was assigned to document the crime scene. 9.52 a.m.
- 17:00Speaker 1: Duncan was assisted by crime scene technicians. Patrol officers gave
- 17:04Speaker 1: him a briefing, and the technician then entered the crime
- 17:07Speaker 1: scene to take photos. The crime scene in this case
- 17:10Speaker 1: was very simple relative to other crime scenes, Duncan says.
- 17:14Speaker 1: They entered through the front door, and there was a
- 17:16Speaker 1: small foyer that opened into a large living room. There
- 17:20Speaker 1: was a wood plank floor, no furniture, mirrors on the walls,
- 17:24Speaker 1: and an open window. It was very sparse, he says. 9.54 a.m.
- 17:29Speaker 1: Charles was lying on the wooden floor next to a
- 17:32Speaker 1: baseball bat. By this point, Charles had been pronounced dead.
- 17:35Speaker 1: Duncan said there were reports Alex had done CPR. The
- 17:39Speaker 1: fire department had placed pads on his chest to determine
- 17:42Speaker 1: whether life-saving measures were needed. Duncan says he noticed a
- 17:46Speaker 1: bullet wound in the lower left quadrant of his torso.
- 17:50Speaker 1: His t-shirt was cut open and AED pads were put
- 17:53Speaker 1: on for medical intervention. Duncan did not notice a lot
- 17:57Speaker 1: of blood on the floor surrounding the body, which is
- 18:00Speaker 1: not consistent with someone who has been given CPR. 9.58 a.m.
- 18:05Speaker 1: Duncan and the crime scene techs did not touch the body.
- 18:08Speaker 1: The medical examiner arrived and the AED pad was removed.
- 18:12Speaker 1: Another wound was noticed in the center of Charles' chest.
- 18:15Speaker 1: There were two additional wounds on his back consistent with
- 18:18Speaker 1: bullet holes. Blake asks if the wounds in the back
- 18:21Speaker 1: and front appeared to be linked. Duncan says they try
- 18:24Speaker 1: not to immediately determine that, but Alex mentioned Charles had
- 18:28Speaker 1: been shot twice, so they assumed they were entry wounds
- 18:31Speaker 1: and exit wounds. 10 a.m. Alex told police he was
- 18:35Speaker 1: standing in the southwest corner of the living room, and
- 18:38Speaker 1: he and Charles were face-to-face with each other. Alex said
- 18:42Speaker 1: he shot Charles twice standing up. As police were clearing
- 18:46Speaker 1: up the scene, Duncan said, Noticed an indentation in the
- 18:49Speaker 1: floor that would have been consistent with Charles being shot
- 18:52Speaker 1: while lying on the ground. 10.03 a.m. Blake asks if
- 18:56Speaker 1: any additional blood was located in the home. Duncan says
- 19:00Speaker 1: there was. Alex told him he washed his hands in
- 19:03Speaker 1: the sink so there was some blood on the faucet.
- 19:05Speaker 1: Duncan says the shooting was investigated as a homicide. He
- 19:09Speaker 1: was assigned as a lead agent in June of 2020. 10.05 a.m.
- 19:14Speaker 1: Duncan determined Charles' phone was a catalyst of an argument
- 19:17Speaker 1: that happened between him and Lori the day of the shooting.
- 19:21Speaker 1: Shortly after the shooting, Lori left the house with Charles' phone.
- 19:25Speaker 1: She returned the phone to police and they did an
- 19:27Speaker 1: extraction on the device. 10.07 a.m. Blake moves to admit
- 19:32Speaker 1: a PowerPoint exhibit prepared by Duncan. 10.09 a.m. Voice calls
- 19:37Speaker 1: for a morning recess. We will be back in 30
- 19:39Speaker 1: minutes with the PowerPoint. So we're going to wrap up
- 19:42Speaker 1: right here too, like usual. And in the next episode,
- 19:44Speaker 1: we'll pick up with the next portion and see what transpires.
- 19:50Speaker 1: all of the information that goes with this episode can
- 19:52Speaker 1: be found in the description box what's up everyone and
- 19:56Speaker 1: welcome back to the program in this episode we're going
- 19:59Speaker 1: to pick up where we left off during day number
- 20:02Speaker 1: four of chad daybell's trial The article that we're using
- 20:08Speaker 1: is from EastIdahoNews.com, and the author of this article is
- 20:12Speaker 1: Nate Eaton.
- 20:14Speaker 2: 10.40 a.m.
- 20:15Speaker 1: We are back in the courtroom. Attorneys at their tables
- 20:18Speaker 1: and voices on the bench. Jurors are being brought in. 10.43 a.m.
- 20:23Speaker 1: Blake shows a slide on the screen that says Charles
- 20:25Speaker 1: Vallow cell phone extraction data. Duncan reads an email, purportedly
- 20:30Speaker 1: from Charles to Chad, inviting him to visit Arizona to
- 20:34Speaker 1: help him write a book. 10.44 a.m. The email says
- 20:37Speaker 1: Charles will pay Chad well to be his ghostwriter. He
- 20:40Speaker 1: asked Chad to come visit him for a few days
- 20:43Speaker 1: to talk about the book project and the publishing business. 10.45 a.m.
- 20:48Speaker 1: Duncan says this was the document that Charles said he
- 20:51Speaker 1: found on Lori's computer. This was the first letter where
- 20:55Speaker 1: he suspected Lori was having an affair with Chad. All
- 20:59Speaker 1: indications in Charles' phone is the letter was fictitious and
- 21:03Speaker 1: not created by him, Duncan says. So she creates this
- 21:07Speaker 1: whole entire letter, right? Purportedly from Charles Vallow that says
- 21:13Speaker 1: he wants to have Chad Daybell as a ghostwriter on
- 21:17Speaker 1: a project he's working on. The only problem is, none
- 21:21Speaker 1: of that ever happened. And Charles Vallow had no project
- 21:25Speaker 1: that he was trying to get Dumbass Do Not involved in.
- 21:28Speaker 1: It was all just more of a cover from Lori
- 21:30Speaker 1: Vallow in pursuit of her carnal desires. and her desire
- 21:36Speaker 1: to have more money. And as we saw during her trial,
- 21:39Speaker 1: there's no length that she wasn't willing to go. 10.46 a.m.
- 21:43Speaker 1: Blake asked Duncan if he's aware of other investigations as
- 21:47Speaker 1: he was working on Charles' case. He says he was
- 21:50Speaker 1: aware of Tammy's death, the attempted shooting of Brandon Boudreaux,
- 21:54Speaker 1: and the missing kids. 10.47 a.m. Blake asked Duncan if
- 21:58Speaker 1: Lori had brothers named Alex and Adam. Duncan says she did.
- 22:03Speaker 1: He says Adam was never a suspect in the investigation,
- 22:06Speaker 1: but Alex was. The next slide shows messages between Charles
- 22:10Speaker 1: and Lori. Charles confronts Lori about the affair in the
- 22:14Speaker 1: text and calls Lori evil. Yeah, I would say she
- 22:17Speaker 1: fits that description, huh? Everything that we learned about her
- 22:21Speaker 1: at her trial literally is vomit-inducing. The way she carried herself,
- 22:27Speaker 1: the way she conducted herself, and the grand finale, of course,
- 22:30Speaker 1: her killing her children. 10.49am. Charles tells Lori in another
- 22:36Speaker 1: text that he has Tammy Daybell's email address and he
- 22:39Speaker 1: will email her. He tells Lori he better explain. Charles
- 22:43Speaker 1: sends another text saying he has Tammy's cell and Lori
- 22:47Speaker 1: has until noon to explain or he will email and
- 22:50Speaker 1: text Tammy. Wait a minute, I thought that Chad Daybell
- 22:52Speaker 1: and Lori Vallow had magical powers that were granted to
- 22:55Speaker 1: them by the angels and by God himself. Why don't
- 22:59Speaker 1: they just, you know, whip up a little spell here
- 23:02Speaker 1: and make everything go away? Oh, that's right. All that
- 23:05Speaker 1: nonsensical bullshit they were talking about is exactly that. Nonsensical bullshit. 10.50 a.m.
- 23:11Speaker 1: Blake asked Duncan if he learned Charles tried to make
- 23:14Speaker 1: contact with Tammy. He says Charles did send emails to Tammy,
- 23:18Speaker 1: but there is no indication she looked at the emails
- 23:20Speaker 1: or received them. We now see more messages from Charles
- 23:23Speaker 1: to Lori. He tells Lori he has emailed Tammy and
- 23:27Speaker 1: their game is up. He later texts, please stop spending
- 23:30Speaker 1: money on their credit cards. I appreciate it. 10.52 a.m.
- 23:34Speaker 1: Duncan says there is no evidence Charles tried to visit
- 23:37Speaker 1: Tammy in person. We now see an email. Charles sent
- 23:41Speaker 1: Tammy's work email on June 29th, 2019. Charles says he
- 23:46Speaker 1: has some vital and disturbing information about her husband and
- 23:49Speaker 1: his wife. I apologize to be the one sending this,
- 23:52Speaker 1: but something has to be done. I feel it's best
- 23:56Speaker 1: if I shed some light on this issue, he wrote.
- 23:59Speaker 1: So he found out what was going on. He clues
- 24:02Speaker 1: Tammy in. by sending her this email to her work
- 24:05Speaker 1: email address, and from there, everything snowballs. Once Lori Vallow
- 24:10Speaker 1: understands that Charles knows, it becomes very important that Charles
- 24:16Speaker 1: gets taken out of the equation, and that's where beaver
- 24:18Speaker 1: face Alex Cox comes in. He steps up to the
- 24:22Speaker 1: plate and does what his sister wants him to do
- 24:25Speaker 1: once again, and this time.
- 24:27Speaker 2: It's kill Charles Vallow. 10.55 a.m.
- 24:32Speaker 1: Duncan now reads an email Charles sent to Chad. He
- 24:34Speaker 1: confronts Chad about the fake email, about Charles wanting to
- 24:38Speaker 1: write a book and come visit. Either you or Lori
- 24:41Speaker 1: need to tell me what's going on, or this will
- 24:44Speaker 1: be exposed for all to see. Regards, Charles Vallow, he wrote.
- 24:48Speaker 1: Then he adds, and does your wife know you have
- 24:51Speaker 1: several of Lori's dance videos? She sent them to you
- 24:54Speaker 1: at your request in January. Explain how that is in
- 24:58Speaker 1: any way appropriate. And can you blame the guy? You
- 25:01Speaker 1: find out that your wife's out here emailing some dude
- 25:04Speaker 1: dance videos, all sorts of crazy shit. Of course, you're
- 25:07Speaker 1: going to confront them both if you find out, right?
- 25:11Speaker 1: And that's what Charles Vallow was doing. And he even
- 25:13Speaker 1: went to the police. And when all was said and done,
- 25:16Speaker 1: Charles Vallow ended up dead. 10.56 a.m. The next slide
- 25:20Speaker 1: is a message from Charles to Lori on June 3rd, 2019.
- 25:24Speaker 1: He confronts Lori about the affair and says, There really
- 25:27Speaker 1: is something wrong with you. You have to be exposed
- 25:30Speaker 1: for what you are, he says. He tells her lying
- 25:33Speaker 1: has become her second nature, to her, and he has
- 25:36Speaker 1: blamed her for everything. 10.58 a.m. Duncan was not aware
- 25:40Speaker 1: of any divorce proceedings between Charles and Lori around this time,
- 25:44Speaker 1: but there was an indication they had separated and were
- 25:47Speaker 1: living in different locations. The next slide shows more messages
- 25:51Speaker 1: found on Charles' devices. These are text messages between Charles
- 25:55Speaker 1: and Lori. He tells Lori he's going to Idaho. to
- 25:58Speaker 1: meet with Tammy. Lori says Tammy won't listen to him
- 26:02Speaker 1: as she is her friend. Imagine having that much cognitive dissonance.
- 26:07Speaker 1: Somebody shows up and says, look, your husband is bagging
- 26:11Speaker 1: my wife and they're hanging out at these weird ass
- 26:14Speaker 1: conferences and then shows you evidence and you still don't
- 26:18Speaker 1: believe them. I wish I had that kind of faith
- 26:20Speaker 1: in people because friend or not, somebody shows up with
- 26:24Speaker 1: those kinds of text messages and and talking about dance
- 26:28Speaker 1: videos and shit, you're gonna have some explaining to do
- 26:30Speaker 1: when I get home from work, you better believe it.
- 26:32Speaker 1: 11 a.m. There is back and forth between Charles and
- 26:36Speaker 1: Lori about the fake letter found on Charles' phone. The
- 26:40Speaker 1: next slide shows messages between Charles and Adam Cox around 7.30 a.m.,
- 26:44Speaker 1: the day Charles was shot. The messages show they were
- 26:47Speaker 1: both concerned as Alex was at Lori's house. 11.02 a.m.
- 26:52Speaker 1: After this text exchange, communication ceased on Charles' phone. He
- 26:56Speaker 1: was shot and killed right after these messages were sent. 11.04 a.m.
- 27:02Speaker 1: Duncan says he reviewed Lori's iCloud accounts, Lori for Style,
- 27:06Speaker 1: and Lollitime. There was a significant amount of information in
- 27:10Speaker 1: those accounts. Duncan has an exhibit that caught his attention
- 27:14Speaker 1: about what was in her account. Blake asked to admit
- 27:16Speaker 1: the exhibit. And these exhibits and PowerPoints are very powerful
- 27:21Speaker 1: when it comes to evidence for the prosecution. And having
- 27:25Speaker 1: these exhibits displayed in court really slams home a lot
- 27:28Speaker 1: of these points that the prosecutors are trying to make.
- 27:31Speaker 2: 11.07 a.m.
- 27:34Speaker 1: Boyce says the PowerPoint can be admitted. The presentation shows
- 27:38Speaker 1: what was found on the Lori for Style account and
- 27:40Speaker 1: the phone numbers associated with her. The first slide shows
- 27:44Speaker 1: messages between Lori and Alex in March 2019 about Ned
- 27:48Speaker 1: being gone. Alex messages Lori about getting rid of Ned
- 27:52Speaker 1: and Ned still being alive. Laurie responds at one point
- 27:56Speaker 1: saying it's not Ned and it's a new one. 11.12 a.m.
- 28:01Speaker 1: Duncan says through his investigation, Charles was designated as Garrett
- 28:06Speaker 1: and Hiplos. He says the phrase it's a new one
- 28:09Speaker 1: refers to a dark spirit that had entered his body.
- 28:12Speaker 1: Dark spirit. All this nonsense they were cooking up, all
- 28:15Speaker 1: this BS they were talking about was nothing more then
- 28:19Speaker 1: cover for them to do what they wanted to do
- 28:22Speaker 1: so they could be together. And if that meant killing
- 28:24Speaker 1: Lori Vallow's children and Chad Daybell's wife, so be it.
- 28:28Speaker 1: They're going to do whatever they have to do to
- 28:30Speaker 1: make sure that they could be together and they had
- 28:33Speaker 1: all the money that they could possibly get their grubby
- 28:35Speaker 1: ass hands on. 11.13 a.m. Duncan reads a message from
- 28:39Speaker 1: a lady named Nicole to Lori on October 19th, 2019,
- 28:44Speaker 1: saying Chad's wife had died. Lori says, oh my gosh,
- 28:48Speaker 1: I'm in Hawaii. The lady asks Lori what happened and
- 28:51Speaker 1: Lori says, Tammy woke up in the night coughing, threw up, collapsed,
- 28:55Speaker 1: and passed away. Yeah, I'm sure that all of that
- 28:58Speaker 1: was natural. She was just stricken overnight with a bout
- 29:02Speaker 1: of Marburg and passed away because of it. 11.14 a.m.
- 29:07Speaker 1: We now see a message from Melanie Gibb to Lori
- 29:10Speaker 1: on the same day saying, I heard what happened to
- 29:12Speaker 1: Chad's wife. Oh my gosh. Lori responded, Hello, what? 11.15 a.m.
- 29:19Speaker 1: The message indicates that Lori was unaware Tammy had passed away,
- 29:23Speaker 1: even though she had communicated with Nicole earlier in the
- 29:26Speaker 1: day about the death. We now see a text from
- 29:29Speaker 1: November 22, 2019, from Lori to Colby Ryan, her son.
- 29:34Speaker 1: I text Ty to send it, but I haven't heard
- 29:37Speaker 1: back yet. She will probably just do it before she
- 29:40Speaker 1: tells me. Hope you got the Venmo. Ty said she
- 29:43Speaker 1: sent it late. I'll call you when I get a break.
- 29:46Speaker 1: Tylee had been dead for over two months at this point.
- 29:50Speaker 1: So Lori Vallow's talking to her son Colby and making
- 29:53Speaker 1: pretend Tylee was going to send him a little bit
- 29:56Speaker 1: of dough. Imagine how evil you have to be to
- 30:00Speaker 1: keep up this whole entire charade. 11.17 a.m. We now
- 30:05Speaker 1: see a slideshow showing lolly time at iCloud.com. It was
- 30:10Speaker 1: created on July 1st, 2019. And the next slideshow shows
- 30:14Speaker 1: a text from Lori to Alex on July 9th, 2019.
- 30:18Speaker 1: So the plot thickens. Call me when you can. On
- 30:22Speaker 1: July 9th, 2019, she sends another message to Alex. about
- 30:26Speaker 1: how he needs to stay close to him, and they
- 30:29Speaker 1: are planning some kind of intervention. Thank you for standing
- 30:32Speaker 1: by me. It's all coming to a head this week.
- 30:36Speaker 1: I will be like Nephi, I am told, and so
- 30:38Speaker 1: will you. Nephi, another one of their, you know, people
- 30:41Speaker 1: from their crazy religious nonsense. They had all of these
- 30:45Speaker 1: different angels and spirits and yada yada yada that they
- 30:49Speaker 1: would use and say were part of whatever sort of
- 30:53Speaker 1: prophecy they were having. or that so-and-so angel showed up
- 30:57Speaker 1: and gave them a message. And people actually believe this shit.
- 31:01Speaker 1: Can you imagine buying this shit hook, line, and sinker
- 31:05Speaker 1: and thinking that Chad Daybell and Lori Vallow are some
- 31:08Speaker 1: sort of prophet? It always amazes me when people are
- 31:11Speaker 1: so gullible that they'll believe this sort of BS. 1120 AM.
- 31:16Speaker 1: These messages were sent two days before Charles died. Charles
- 31:20Speaker 1: and Adam were planning an intervention... based on the disturbing
- 31:23Speaker 1: things Lori was doing and saying. 11.20 a.m. The next
- 31:26Speaker 1: slide shows there were messages between Chad and Lori the
- 31:30Speaker 1: morning of July 11th, the day of Charles' death, but
- 31:33Speaker 1: there is no content of what the actual texts were.
- 31:37Speaker 1: There's a record they occurred, but we don't know what
- 31:39Speaker 1: they said. One is sent at 6.12 a.m., another at 7.01 a.m.,
- 31:44Speaker 1: another at 7.33 a.m. Charles arrived at the home that
- 31:47Speaker 1: morning around 7.30 a.m. based on location data on his phone. 11.22 a.m.
- 31:54Speaker 1: We now see text messages between Lori and Chad on
- 31:57Speaker 1: July 18th, 2019. Lori sent Chad a message saying she
- 32:01Speaker 1: got a letter from the insurance company saying she is
- 32:04Speaker 1: not the beneficiary. It's a spear through my heart. Who
- 32:07Speaker 1: do you think he changed it to? Brandon or probably Kay?
- 32:11Speaker 1: Chad responds. Wow, that's terrible. There is no way to
- 32:14Speaker 1: find out. Lori to Chad.
- 32:16Speaker 2: Nope.
- 32:16Speaker 1: They go back and forth with Chad saying, I love you.
- 32:19Speaker 2: This is terrible.
- 32:20Speaker 1: But it's probably another step in bringing down the Gadiantans,
- 32:24Speaker 1: especially Brandon. 11.24 a.m. Chad writes, it will be interesting
- 32:30Speaker 1: if it got changed after he had two bullets in
- 32:33Speaker 1: his chest. As Duncan is reading these messages, Chad Daybell
- 32:36Speaker 1: stares up at the screen and does not show much
- 32:39Speaker 1: of a reaction.
- 32:41Speaker 2: 11.25 a.m.
- 32:43Speaker 1: At the time Charles was killed, Lori believed she was
- 32:45Speaker 1: getting insurance money. The next message was sent from Lori
- 32:48Speaker 1: to Chad on July 18th, 2019. So I talked to
- 32:52Speaker 1: the insurance company. He changed it in March. So it
- 32:55Speaker 1: was probably Ned before we got rid of him. They
- 32:58Speaker 1: can't tell me who, of course, but it's done. I
- 33:02Speaker 1: still get the 4Gs a month from Social Security.
- 33:04Speaker 2: 11.26am.
- 33:07Speaker 1: We now see a message from Chad to Lori on
- 33:09Speaker 1: July 26th, 2019. It's the Harry Potter text. Tonight, I
- 33:14Speaker 1: figured out who I feel like. I'm a grown-up version
- 33:17Speaker 1: of Harry Potter, who has to live with the Dudleys
- 33:20Speaker 1: in his little space under the stairs. Every few weeks,
- 33:24Speaker 1: I get to escape and have an amazing adventure with
- 33:26Speaker 1: my goddess lover, but then I have to return to
- 33:29Speaker 1: my place under the stairs, feeling trapped. But I sense
- 33:32Speaker 1: permanent freedom is coming. 1128 AM We now see a
- 33:37Speaker 1: text that Alex sent to Lori on September 3rd, 2019.
- 33:40Speaker 2: Alex to Lori.
- 33:43Speaker 1: Network name is Auntie Layman. PW is TooManyKids. Lori to Alex, funny.
- 33:49Speaker 1: The last known sighting of Ty Lee, around September 8th.
- 33:52Speaker 1: And the last known sighting of JJ, oh, around September 22nd.
- 33:57Speaker 1: And the password to that is TooManyKids?
- 34:00Speaker 2: Really?
- 34:02Speaker 1: Again, I hope that Alex Cox is burning in the lowest,
- 34:06Speaker 1: deepest depth of hell, if hell does exist. And hopefully
- 34:09Speaker 1: Chad Daybells is bunkmate real soon. 11.30 a.m. Blake asked
- 34:15Speaker 1: Duncan if he reviewed content from Zulima Pastina's phone. He did.
- 34:20Speaker 1: Zulima was married to Alex. Duncan said there was a
- 34:23Speaker 1: large amount of content on her phone. Blake asked to
- 34:26Speaker 1: admit an exhibit showing the content of Zulima's phone.
- 34:31Speaker 2: 11.33 a.m.
- 34:31Speaker 1: Duncan reads messages between Zulima and Lori. Lori messaged Zulima
- 34:36Speaker 1: on May 22, 2019 about Hiplos being a level 4.
- 34:41Speaker 1: Lori sends another message about going to the truck and
- 34:44Speaker 1: hovering over it. More messages. Zulema says she was given
- 34:48Speaker 1: instructions to rip, tar, or burn the aura of Hiplos
- 34:52Speaker 1: to let the body energy out. Chad sends a message
- 34:55Speaker 1: to Zulema saying Mother Earth is grateful for Lori and Zulema.
- 34:59Speaker 1: He offers to give Zulema a blessing on July 11th
- 35:03Speaker 1: after saying it's crazy about Charles, but such a relief.
- 35:06Speaker 1: And this is what I mean about Zulema and the
- 35:08Speaker 1: rest of them. They're all out here engaging in seances
- 35:11Speaker 1: and all kinds of wild bullshit, don't tell me you
- 35:14Speaker 1: don't know what the deal was, and don't tell me
- 35:16Speaker 1: that you didn't know that Lori and Chad were up
- 35:18Speaker 1: to no good. 11.36 a.m. Duncan says he never saw
- 35:23Speaker 1: indications of grief about the loss of Charles in any
- 35:26Speaker 1: of the phone messages that he observed.
- 35:28Speaker 2: 11.38 a.m.
- 35:29Speaker 1: We now see an email sent on April 21st, 2019,
- 35:31Speaker 1: if reportedly from Karen at Aval. The letter is inviting
- 35:38Speaker 1: Chad to come and speak at a youth conference in
- 35:40Speaker 1: Houston about the temple. The lady says 400 kids will
- 35:44Speaker 1: be attending, and she wants him to come speak about
- 35:46Speaker 1: his book. Is there any chance you could come? A
- 35:49Speaker 1: high councilman is currently the main speaker, but he says
- 35:53Speaker 1: he would be happy to let you speak in his place.
- 35:55Speaker 1: The letter offers Chad a flight and a place to stay.
- 35:59Speaker 1: Imagine having Chad Daybell come out and be your light
- 36:01Speaker 1: keystone speaker. oh yeah, let's have this fucking moron come
- 36:05Speaker 1: out and talk to the children of tomorrow. And furthermore,
- 36:09Speaker 1: you're not going to tell me that there's not more
- 36:10Speaker 1: psychopaths going to these conferences and talking about this nonsense.
- 36:16Speaker 1: There most certainly are. 11.40 a.m. The email came from
- 36:22Speaker 1: KK Walker Yahoo account, which was linked to Lori. The
- 36:25Speaker 1: email was sent from the area of Katy, Texas, where
- 36:28Speaker 1: Lori was staying at the time. So Lori writes the
- 36:30Speaker 1: whole letter, saying that Chad's going to come to this conference,
- 36:33Speaker 1: they want him to speak, but really, in reality, it
- 36:36Speaker 1: was no such conference. And it was all just a
- 36:40Speaker 1: ruse to get them together. 11.41 a.m. Chad responded to
- 36:44Speaker 1: the email, saying he would be able to come and
- 36:46Speaker 1: to let the wards know. Duncan does not know whether
- 36:49Speaker 1: Chad went to Texas. 11.42 a.m. Blake asked if Duncan
- 36:53Speaker 1: was contacted about a call made to a mortuary in Arizona.
- 36:57Speaker 2: He was.
- 36:59Speaker 1: It was the Valley of Sun Mortuary. Blake asks to
- 37:01Speaker 1: admit the phone call made from Chad to the mortuary. 11.45 a.m.
- 37:06Speaker 1: Blake plays the call. Chad says he just had a
- 37:09Speaker 1: death in the family and they don't want anything out,
- 37:12Speaker 1: but they want a cremation. He says they want to
- 37:15Speaker 1: send the remains to the family in Louisiana. He asks
- 37:19Speaker 1: for a simple cremation and asks the price. The operator
- 37:22Speaker 1: asks for the caller's name. He says Chad Daybell. Daybell
- 37:26Speaker 1: is how he spells his last name. D-A-B-E-L. The lady
- 37:31Speaker 1: asks how he was related to the person who died.
- 37:33Speaker 1: He says he's his nephew and lives in Iowa. She
- 37:37Speaker 1: asks for the name of the uncle. He says John
- 37:39Speaker 1: Myron Dable. D-A-B-E-L. 11.47 a.m. The lady asks for Chad's number.
- 37:46Speaker 1: He says he doesn't know and he needs to look.
- 37:49Speaker 1: The operator asks if he passed away in a nursing home, hospital,
- 37:52Speaker 1: or residence. Chad says he died in a hospital but
- 37:55Speaker 1: doesn't know the details. The lady asks what city in Louisiana.
- 37:59Speaker 1: Chad says New Orleans. The call is then transferred to
- 38:02Speaker 1: the director.
- 38:04Speaker 2: 11.49 a.m.
- 38:05Speaker 1: The call continues with the funeral director. Chad says he's
- 38:08Speaker 1: just starting the process of helping the family with the
- 38:11Speaker 1: cremation and needs a price. The lady tells him cremations
- 38:15Speaker 1: are $ 1, 695 and it includes transportation to the crematory and
- 38:19Speaker 1: other fees. 11.51 a.m. The total price is close to $ 2, 000
- 38:21Speaker 1: with all the fees. Chad says he's going to call
- 38:30Speaker 1: one or two other funeral homes, and the call ends. 11.52 a.m.
- 38:35Speaker 1: Attorneys are having a sidebar with the judge in Chambers. 11.54 a.m.
- 38:41Speaker 1: Boyce dismisses jurors for lunch, but we will now have
- 38:44Speaker 1: a motion hearing before the public goes to lunch. 11.56 a.m.
- 38:49Speaker 1: Boyce says a motion in Lamine was filed yesterday by prosecutors.
- 38:54Speaker 1: It says John Pryor plans to call Rob Wood. As
- 38:57Speaker 1: a witness in the state is opposed, the hearing will
- 38:59Speaker 1: happen after the lunch break. Right now, the hearing to
- 39:02Speaker 1: determine whether the hearing after lunch will be sealed and
- 39:05Speaker 1: closed to the public. 1158 a.m. Blake argues that the
- 39:10Speaker 1: motion should be sealed as there are concerns. All right,
- 39:14Speaker 1: we're going to take our break here. And then when
- 39:17Speaker 1: we come back, we'll pick up with the rest of
- 39:19Speaker 1: the day's proceedings and what went down after lunch. All
- 39:25Speaker 1: of the information that goes with this episode can be
- 39:27Speaker 1: found in the description box. What's up everyone and welcome
- 39:32Speaker 1: back to the program. In this episode, we're going to
- 39:34Speaker 1: finish off day four of the testimony during Chad Daybell's trial.
- 39:41Speaker 1: Once again, we'll be using an article published by the
- 39:44Speaker 1: East Idaho News and the author of that article is
- 39:47Speaker 1: Nate Eaton. 1.11 p.m. Boyce is on the bench. Blake
- 39:52Speaker 1: begins by saying a discovery request was given to prosecutors
- 39:56Speaker 1: from the defense. She says she has concerns the defense
- 40:00Speaker 1: may make Rob Wood a witness in relation to Melanie Gibb. 1.15 p.m.
- 40:06Speaker 1: Blake says they don't want to get through the case
- 40:09Speaker 1: and have it be an issue if Pryor plans to
- 40:11Speaker 1: call Wood. Blake says if the court has concerns, a
- 40:14Speaker 1: hearing could be held to determine whether whether or not
- 40:17Speaker 1: any prospective testimony would be relevant to the case. Blake
- 40:21Speaker 1: says a defense attorney can call a prosecutor in a case,
- 40:24Speaker 1: but it's disfavored and should be disclosed well in advance
- 40:28Speaker 1: of the trial. And that's a good idea, right? Make
- 40:31Speaker 1: sure everybody has their ducks in a row and make
- 40:34Speaker 1: sure that the prosecution isn't going to call somebody whose
- 40:37Speaker 1: testimony is quote-unquote tainted. So it's a great idea to
- 40:41Speaker 1: make sure you disclose this well in advance, and a
- 40:44Speaker 1: lot of times if you don't, a judge is going
- 40:47Speaker 1: to say no and not rule in your favor.
- 40:53Speaker 2: 1.17 p.m.
- 40:54Speaker 1: Blake says it is very, very rare for courts to
- 40:57Speaker 1: find that a prosecutor should be a witness. In the
- 40:59Speaker 1: cases they found, it involved prosecutors being a witness to
- 41:03Speaker 1: the actual facts or they are a witness to a
- 41:06Speaker 1: statement that contradicts a later statement and they are the
- 41:09Speaker 1: only available witness to that statement. 1.19 p.m. Blake asks
- 41:14Speaker 1: Boyce to exclude Wood as a witness, and if the
- 41:17Speaker 1: court has additional concerns, asks that a hearing be held.
- 41:21Speaker 2: 1.20 p.m.
- 41:24Speaker 1: Boyce asks Blake if she is seeking a specific court
- 41:27Speaker 1: ruling prohibiting certain types of cross-examination. Blake responds that if
- 41:31Speaker 1: the defense is allowed unfiltered cross, should Wood not be
- 41:35Speaker 1: allowed as a witness.
- 41:37Speaker 2: It could cause problems.
- 41:38Speaker 1: 1.22 p.m. Pryor says prosecutors provided him with notice of
- 41:44Speaker 1: their motion on Sunday around 11 p.m. Pryor says he's
- 41:47Speaker 1: concerned the state is suggesting they can dictate where he
- 41:51Speaker 1: can go on cross-examination. They're trying to handcuff me from
- 41:55Speaker 1: going to areas that may find a little sensitive to
- 41:58Speaker 1: their case, he says. So he's inferring that the reason
- 42:02Speaker 1: that they don't want this to go down is because
- 42:04Speaker 1: it might touch a nerve and change the narrative into
- 42:08Speaker 1: Chad Daybell's favor. 1.23 p.m. Pryor says he has no
- 42:12Speaker 1: desire to put Wood on the stand. Boyce clarifies that
- 42:15Speaker 1: he does not intend to call Wood. Pryor says he
- 42:18Speaker 1: does not intend to call him. Pryor says that the
- 42:21Speaker 1: state gave him 342 emails and texts between Wood and
- 42:25Speaker 1: Melanie Gibb regarding the case. Pryor says the state is
- 42:32Speaker 1: trying to circumvent Idaho Code regarding witnesses and devices. He
- 42:37Speaker 1: says the prosecuting attorney engages in discussion with the witness
- 42:40Speaker 1: over 8 months, and 340 texts, it can create concerns. Well,
- 42:45Speaker 1: unless they're building a case and they flip that person.
- 42:49Speaker 1: And my guess is Melanie Gibb has given them plenty
- 42:52Speaker 1: of information, because there's a lot there as far as
- 42:55Speaker 1: Melanie Gibb's concerned, where she probably could have been charged.
- 43:00Speaker 1: Maybe not with murder or anything like that, but other
- 43:03Speaker 1: charges for sure. 1.29 p.m. Pryor says there is one
- 43:08Speaker 1: defense attorney and four prosecuting attorneys He says he gave
- 43:11Speaker 1: them notice three weeks ago of all of his exhibits
- 43:15Speaker 1: and they are filing a last-minute hearing to keep an
- 43:17Speaker 1: exhibit out. Pryor says he doesn't appreciate their tactics. 1.30 p.m.
- 43:23Speaker 1: Pryor reaffirms he does not intend on calling Wood. He
- 43:27Speaker 1: says when Melanie Gibb is called, he is going to
- 43:29Speaker 1: question her about her contact he has had with Wood
- 43:32Speaker 1: and the nature of those discussions. I have copies of
- 43:35Speaker 1: all the emails and I can question her. And that's
- 43:38Speaker 1: what cross-examination's for, right? If you want to question Melanie
- 43:42Speaker 1: Gibb about her involvement or not being involved or whatever,
- 43:47Speaker 1: the time to do it is when she's on the stand.
- 43:49Speaker 2: 1.31 p.m.
- 43:52Speaker 1: Prior says if Gibb remembers her conversations with Wood, he
- 43:56Speaker 1: doesn't need to admit the messages. If she doesn't, he
- 43:59Speaker 1: can admit the messages to refresh her memory. Boyce reminds
- 44:02Speaker 1: Prior that a subpoena for Wood was quashed before the
- 44:05Speaker 1: trial began. 1.33 p.m. Boyce asks for additional argument from
- 44:10Speaker 1: the state about the exhibit, the communication between Wood and Gibb.
- 44:15Speaker 1: Blake says the state is not trying to stop the
- 44:18Speaker 1: defense from conducting appropriate cross-examination. She says the concerns are
- 44:22Speaker 1: about any attempt from the defense to misconstrue the content
- 44:26Speaker 1: of testimony. 1.35 p.m. Blake says if proper foundation is laid,
- 44:32Speaker 1: witnesses can be asked about the messages. Pryor says Idaho Code...
- 44:36Speaker 1: allows him to ask witnesses about their communication with the
- 44:40Speaker 1: prosecuting attorney. 1.37 p.m. Pryor says Gibb is the witness
- 44:45Speaker 1: in the case and her testimony is crucial in the
- 44:47Speaker 1: state trying to prove its case. He says he's allowed
- 44:51Speaker 1: to ask her about communication between her and Wood. 1.38 p.m.
- 44:56Speaker 1: Pryor again says he does not intend to call Mr.
- 44:59Speaker 1: Wood and he isn't planning a scheme to call him.
- 45:02Speaker 1: It sounds a little paranoid to me, he says. So
- 45:05Speaker 1: this is a real point of contention for the prosecution,
- 45:08Speaker 1: and Judge Boyce has already stated that he's not going
- 45:11Speaker 1: to call Mr.
- 45:12Speaker 2: Wood.
- 45:14Speaker 1: So any sort of messing around here from Pryor is
- 45:18Speaker 1: probably going to be frowned upon by Judge Boyce.
- 45:21Speaker 2: 1.40 p.m.
- 45:24Speaker 1: Boyce explains some evidence can be excluded if it's inflammatory,
- 45:28Speaker 1: and it's up to the court to determine the relevance
- 45:31Speaker 1: to the case. Boyce says he has not gone through
- 45:33Speaker 1: the messages between Wood and Gibb. He says without knowing
- 45:37Speaker 1: what is in them, he can't make a ruling completely
- 45:40Speaker 1: eliminating it. He says the whole might or might not
- 45:43Speaker 1: be relevant. He can't say until Gibb testifies. So that's
- 45:47Speaker 1: still up in the air. We don't know one way
- 45:48Speaker 1: or the other what's going to happen there. But what
- 45:51Speaker 1: we do know is that Mr. Wood is not going
- 45:54Speaker 1: to be testifying as far as being called as a
- 45:57Speaker 1: witness by Mr. Pryor.
- 45:59Speaker 2: 1.42 p.m.
- 46:01Speaker 1: Boyce is denying the motion to exclude the exhibit, but
- 46:04Speaker 1: says he will be watching carefully if there is any
- 46:07Speaker 1: relevance to the testimony of Gibb. He says attorneys are
- 46:10Speaker 1: entitled to talk with witnesses and get ready for trial,
- 46:13Speaker 1: not to change their testimony or not tell the truth,
- 46:16Speaker 1: but help them. 1.43 p.m. Boyce says the court has
- 46:21Speaker 1: already ruled that Wood will not be called. Absent some
- 46:25Speaker 1: really surprising development, Boyce says Wood will not be called
- 46:29Speaker 1: as a witness. So that's the end of that. Unless
- 46:32Speaker 1: we have some sort of monumental movement, don't expect Mr.
- 46:35Speaker 1: Wood to be called as a witness. 1.45 p.m. The
- 46:40Speaker 1: motion hearing is over. Jurors will now be brought in. 1.48 p.m.
- 46:46Speaker 1: Jurors have taken their seats. Detective Nathan Duncan will be
- 46:49Speaker 1: back on the stand this afternoon. We will be in
- 46:52Speaker 1: session until 3.30 with no afternoon break. 1.50 p.m. Blake
- 46:57Speaker 1: references the calls he made to the funeral home. She
- 47:00Speaker 1: asked Duncan if she recognized the voice on the call.
- 47:03Speaker 1: He says yes, Chad Daybell. Duncan says on the call,
- 47:07Speaker 1: Chad said he intended to send the cremains to Louisiana.
- 47:11Speaker 1: Duncan never found any indication Chad was in Iowa, even
- 47:15Speaker 1: though he said he was on the phone call. 1.51 p.m.
- 47:20Speaker 1: Blake references a patriarchal blessing that was found on Lori's iCloud.
- 47:25Speaker 1: Patriarchal blessings are used in the Church of Jesus Christ
- 47:28Speaker 1: of Latter-day Saints. Duncan says he has some basic knowledge
- 47:32Speaker 1: of the LDS church and a stake patriarch is authorized
- 47:36Speaker 1: to give a patriarchal blessing. Chad was not authorized to
- 47:39Speaker 1: give the blessings. Well, you know what? Maybe I should
- 47:42Speaker 1: just start my own church and we'll call it the
- 47:45Speaker 1: Church of the Inflamed Foot. And if you want a blessing,
- 47:47Speaker 1: you can come over and get one. That's about how
- 47:50Speaker 1: meaningful the blessing from Chad Daybell was, right? Bro's not
- 47:54Speaker 1: out here as any sort of real representation of any
- 47:57Speaker 1: real religion. Instead, like countless other charlatans before him, he
- 48:02Speaker 1: uses religion to get what he wants. And that was
- 48:05Speaker 1: the theme throughout this whole thing with him and Lori Vallow.
- 48:09Speaker 1: The whole entire, oh, God's telling us to do this,
- 48:13Speaker 1: these are demons, light and dark, yada yada yada. That
- 48:16Speaker 1: whole entire story was crafted to manipulate people. That's all
- 48:20Speaker 1: it is. And this kind of charlatan was old when
- 48:24Speaker 1: Moses was young. People like Chad Daybell and Lori Vallow
- 48:27Speaker 1: have been using religion to justify all kinds of evil
- 48:31Speaker 1: shit for a very long time. 1.53 p.m. Blake moves
- 48:35Speaker 1: to admit a recording of the blessing. Chad gave this
- 48:38Speaker 1: blessing to Alex Cox. 1.54 p.m. Chad gives the blessing
- 48:43Speaker 1: to Alex and says he's part of the Church of
- 48:45Speaker 1: the Firstborn. Chad says Jesus Christ has authorized this blessing.
- 48:50Speaker 1: As the blessing is playing in court, Chad is looking
- 48:52Speaker 1: at the blue screen above the witness stand and looks down.
- 48:56Speaker 1: Jesus Christ, huh? So with all of the issues in
- 49:00Speaker 1: the universe, never mind on earth, Jesus Christ was busy
- 49:04Speaker 1: coming down and giving Chad Daybell blessings and having conversations
- 49:09Speaker 1: with him. Like how stupid do you have to be
- 49:12Speaker 1: to believe some shit like this? Imagine one of your
- 49:15Speaker 1: homies showing up and giving you this line of BS.
- 49:18Speaker 1: Oh yeah, you know, I was hanging out and Jesus
- 49:21Speaker 1: showed up and he was like, hey, here's what we're
- 49:23Speaker 1: gonna do. I mean, for real, unless you dudes are
- 49:27Speaker 1: sitting around eating a bag of mushrooms, that person's batshit crazy.
- 49:31Speaker 2: 1.56 p.m.
- 49:35Speaker 1: Chad says he wants to open the portals of time
- 49:38Speaker 1: and sees Alex on the third creation, being a warrior,
- 49:41Speaker 1: always seeking to do what is right. Yeah, killing children,
- 49:44Speaker 1: that's right, huh? According to Chad Daybell's bitch ass it is.
- 49:48Speaker 1: Chad says Alex was selected by the savior himself to
- 49:52Speaker 1: be part of the fourth creation. He says great warriors
- 49:55Speaker 1: and powerful goddesses were needed. You were selected to help
- 49:58Speaker 1: protect your sister. You helped her in numerous probations to
- 50:01Speaker 1: be a defender. Oh yeah, that's exactly what went down
- 50:05Speaker 1: Jesus was sitting around and he said, you know what?
- 50:08Speaker 1: I think Alex Beaverface Cox is my kind of guy. 1.58 p.m.
- 50:14Speaker 1: Chad tells Alex he had already assisted him and Lori
- 50:18Speaker 1: in ways you can never be repaid. 1.59 p.m. The
- 50:22Speaker 1: jurors are listening intently as Chad tells Alex he had
- 50:26Speaker 1: to go to great depths to achieve tremendous heights. 2 p.m.
- 50:30Speaker 1: Chad says the Savior is saying to him, to Alex,
- 50:34Speaker 1: well done. Thy soul is cleansed.
- 50:36Speaker 2: All is well.
- 50:37Speaker 1: Chad blesses Alex with the knowledge he will now move
- 50:40Speaker 1: forward as a true warrior in ways that can be
- 50:43Speaker 1: demonstrated through physical action and spiritual power. 2.01pm Chad tells
- 50:49Speaker 1: Alex that he will be known throughout the world for
- 50:52Speaker 1: his good heartedness and willingness to save souls all over
- 50:55Speaker 1: the world through portals. You will begin to gather the
- 50:58Speaker 1: souls who come until Christ. I see you in New Jerusalem,
- 51:03Speaker 1: but more importantly, I see you as a messenger of
- 51:06Speaker 1: the Lord, Chad says. 2.02 p.m. Chad begins to cry
- 51:11Speaker 1: and says Alex will be a prophet and shares his
- 51:14Speaker 1: own experiences of overcoming adversity. Chad says Alex will give
- 51:18Speaker 1: tremendous blessings to people and raise their vibrations. Oh yeah,
- 51:22Speaker 1: tremendous blessings to people, huh? Unless you're those two little kids.
- 51:26Speaker 2: 2.03 p.m.
- 51:30Speaker 1: Chad tells Alex he will know where to be before
- 51:33Speaker 1: natural disasters happen. He will be on location to protect
- 51:36Speaker 1: church leaders and save little children from floodwaters. Chad is
- 51:40Speaker 1: crying and sniffling. He says Alex will literally glow. What
- 51:44Speaker 1: an absolute clown. Oh, Alex, you're going to be there
- 51:48Speaker 1: when natural disasters happen and you're going to save the children. Meanwhile,
- 51:52Speaker 1: this dude's murdering children literally as we speak.
- 51:55Speaker 2: 2.05 p.m.
- 51:59Speaker 1: Chad says as the second coming approaches, Alex will know
- 52:03Speaker 1: when it's time to move to the other side. His
- 52:05Speaker 1: spirit will leave his body and he will be welcomed
- 52:08Speaker 1: by the Savior. Alex died less than a month after
- 52:10Speaker 1: this blessing on December 12, 2019. Oh, he was welcomed,
- 52:15Speaker 1: but not by the Savior he was thinking. More like
- 52:18Speaker 1: a Savior with some horns. Some goat's legs. 2.08pm. Chad
- 52:23Speaker 1: blesses Alex with protection and says nine angels are now
- 52:26Speaker 1: assigned to him from all sides because of his faithfulness.
- 52:30Speaker 1: I know you will stay faithful. You have a great
- 52:32Speaker 1: mission and protection, Chad says. All of this was to
- 52:36Speaker 1: make sure that Chad and Lori weren't ratted on by
- 52:39Speaker 1: Alex Cox. This was all part of the manipulation. And
- 52:44Speaker 1: this is showing just how deep Chad was in the conspiracy.
- 52:48Speaker 1: And for those of you who have followed conspiracy cases before,
- 52:52Speaker 1: you understand just how deep the jeopardy is for Chad
- 52:55Speaker 1: Daybell here with the conspiracy charge. You know how many
- 52:58Speaker 1: people are rotting in prison as we speak who were
- 53:01Speaker 1: never even on the phone call with their so-called conspirator
- 53:04Speaker 1: and they ended up being charged anyway? Chad tells Alex
- 53:10Speaker 1: he will have protection from Satan and says he will
- 53:13Speaker 1: rise to an eternal glory with an eternal family and
- 53:16Speaker 1: the blessing is over. More like Hitler's treatment by Satan
- 53:21Speaker 1: in the movie Little Nicky. That's what Alex Cox has
- 53:25Speaker 1: coming to him down in hell. There's no protection from
- 53:28Speaker 1: Satan if there is such thing as Satan. Alex Cox
- 53:32Speaker 1: is a resident and a guest of him. Blake asked
- 53:37Speaker 1: the detectives if he heard the voices of Lori Vallow
- 53:40Speaker 1: on the recording. He says he did. Duncan says a
- 53:43Speaker 1: lot stood out to him in The Blessing. The date
- 53:46Speaker 1: was November 24th, 2019. Duncan says the Church of the
- 53:50Speaker 1: Firstborn stood out to him and the statement, Chad said Alex,
- 53:54Speaker 1: has already helped him. 2.12 p.m. Blake asked Duncan if
- 53:59Speaker 1: the Church of the Firstborn is affiliated with the LDS Church.
- 54:03Speaker 1: He says they are not affiliated. Blake asked Duncan when
- 54:07Speaker 1: Alex Cox died. He says December 2019. Blake asked about
- 54:12Speaker 1: the statement. Chat said about Alex knowing when it is
- 54:15Speaker 1: time to move to the other side. 2.14 p.m. Blake
- 54:19Speaker 1: has no further questions for Duncan. Pryor will now cross-examine. 2.15 p.m.
- 54:25Speaker 1: Duncan says he was born in the LDS faith. Pryor
- 54:28Speaker 1: says he doesn't have that background. He asked Duncan about
- 54:31Speaker 1: the doctrine and the covenants. Pryor says the church of
- 54:34Speaker 1: the firstborn is discussed in the doctrine and the covenants.
- 54:39Speaker 2: 2.16 p.m.
- 54:40Speaker 1: Pryor asked Zulema. saying light and dark. Duncan is unfamiliar
- 54:44Speaker 1: with that term. Pryor asks about death percentages and vibrations.
- 54:48Speaker 1: Duncan says he has never heard about that in the
- 54:51Speaker 1: LDS faith. Pryor asks about removing evil spirits from bodies,
- 54:55Speaker 1: and if the LDS faith, you can pray to have
- 54:58Speaker 1: possessed spirits removed. Duncan is unfamiliar with that. Yeah, you
- 55:03Speaker 1: have to go see your homies over in the Catholic
- 55:05Speaker 1: Church for all of that. 2.18 p.m. Pryor brings up
- 55:09Speaker 1: the information found on Lori's iCloud. He says it wasn't
- 55:12Speaker 1: unusual for Chad and Lori to communicate with each other
- 55:15Speaker 1: because they were having an affair. Pryor asks Duncan if
- 55:19Speaker 1: he knows the prosecutor in Maricopa County. Duncan says he
- 55:22Speaker 1: knows many prosecutors. 2.19 p.m. Pryor asks about the statement
- 55:28Speaker 1: the Arizona prosecutor issued about the decision not to charge
- 55:32Speaker 1: Chad Daybell in connection to Charles Vallow's death.
- 55:34Speaker 2: 2.21 p.m.
- 55:37Speaker 1: Pryor asks if it's unusual for a prosecutor to tell
- 55:40Speaker 1: witnesses how to testify. Duncan says there is witness preparation
- 55:44Speaker 1: in cases, and it's not highly unusual. 223. Pryor asks
- 55:49Speaker 1: to approach. Attorneys are having a sidebar with the judge.
- 55:52Speaker 1: 224 p.m. Pryor is back questioning Duncan. Duncan says in
- 55:57Speaker 1: Maricopa County, they submit their recommended charges to the prosecutor.
- 56:01Speaker 1: The prosecutor then decides whether to pursue charges or not. 2.27 p.m.
- 56:07Speaker 1: Pryor asked Duncan if he received a copy of the
- 56:10Speaker 1: prosecutor's statement on whether or not to charge Chad Daybell
- 56:13Speaker 1: in connection to Charles Vallow's case. Duncan remembers getting the report.
- 56:18Speaker 1: Pryor asked Duncan to review the document and asked the
- 56:21Speaker 1: reason the prosecutor did not charge Chad. He says there
- 56:25Speaker 1: is no reasonable likelihood of a conviction. so there wasn't
- 56:29Speaker 1: enough there. Doesn't mean they think he's innocent, but they
- 56:32Speaker 1: can't prove, beyond a reasonable doubt, that Chad was involved
- 56:35Speaker 1: with what happened to Charles Vallow. 2.29 p.m. Duncan says
- 56:40Speaker 1: right now, Chad is not being charged, but there is
- 56:43Speaker 1: no statute of limitations for homicide in Arizona.
- 56:46Speaker 2: 2.30 p.m.
- 56:49Speaker 1: Pryor says, this is an unusual case because there's a
- 56:53Speaker 1: lot of talk about religion. Duncan says, I agree. Pryor
- 56:56Speaker 1: asks Duncan if Chad was reading off something during the blessing.
- 57:00Speaker 1: Duncan says he's not sure. Pryor asks Duncan if he
- 57:03Speaker 1: knows what Chad did for his job. He was an author.
- 57:07Speaker 1: Pryor says it sounds like Chad was writing a book
- 57:09Speaker 1: during the blessing. Oh, so it was just a book.
- 57:12Speaker 1: He didn't mean any of that. All of this is
- 57:14Speaker 1: just make-believe. 2.33 p.m. Duncan says he left the LDS
- 57:20Speaker 1: faith to practice another religion when he was 18. Pryor
- 57:23Speaker 1: says he's not trying to disparage the LDS church. 2.35 p.m.
- 57:28Speaker 1: Pryor circles back to the patriarchal prayer and asks if
- 57:31Speaker 1: it's a crime in Maricopa County to give a blessing.
- 57:34Speaker 1: Duncan says no. Pryor says because you give someone a prayer,
- 57:38Speaker 1: it doesn't insinuate they committed a crime. Duncan says that's correct. Well, yeah,
- 57:43Speaker 1: that's true, but when you look at all of the
- 57:45Speaker 1: other factors, it all starts to add up. and you
- 57:48Speaker 1: have to look at the evidence in its totality and
- 57:51Speaker 1: not piecemeal. 2.36 p.m. Prior asks Duncan who Zalima Pastanis is.
- 57:58Speaker 1: Duncan says she was married to Alex Cox and was
- 58:00Speaker 1: a friend of Lori Vallow. Prior asks Duncan if the
- 58:03Speaker 1: relationship between Lori and Cox was close. He agrees. Prior
- 58:08Speaker 1: says oddly close. Duncan says he doesn't know much about
- 58:11Speaker 1: the intimacy between the two and he's heard it described
- 58:14Speaker 1: as such, but he doesn't know personally. Yeah, some Lannister
- 58:17Speaker 1: type shit. 1,000%. I'm convinced of that. 2.37pm. Pryor asks
- 58:25Speaker 1: about the day Charles was shot. Duncan says on the
- 58:27Speaker 1: day of the shooting, Alex, Lori, Tylee, and JJ were
- 58:30Speaker 1: all present at her home. Alex told police there was
- 58:34Speaker 1: an argument between Charles and Lori over his phone. An
- 58:37Speaker 1: argument continued. Tylee came out of the bedroom with a bat.
- 58:41Speaker 1: Alex says he was hit in the head with a
- 58:43Speaker 1: bat and Lori left the house with Tylee and JJ.
- 58:46Speaker 1: Oh yeah, I'm sure all of that happened. What a
- 58:49Speaker 1: bunch of BS, man. And it's convenient, isn't it, for
- 58:53Speaker 1: Lori Vallow and for everybody involved that Tylee happens to
- 58:56Speaker 1: be dead. 2.40 p.m. Lori went outside with the kids
- 59:01Speaker 1: and then Alex shot Charles. Duncan says two days before
- 59:05Speaker 1: the shooting, he uncovered messages between Lori and Melanie Boudreau.
- 59:09Speaker 1: Lori sent a message to Melanie saying she needed five
- 59:12Speaker 1: minutes to try and figure out what to do. 2.44 p.m.
- 59:17Speaker 1: Pryor circles back to the funeral home. Pryor asks when
- 59:20Speaker 1: the call was made. It was made the night Charles died.
- 59:23Speaker 1: Pryor says Lori and Chad were having an affair at
- 59:26Speaker 1: the time. Pryor asks if the phone call means Chad
- 59:29Speaker 1: was connected to the death of Charles Vallow, Duncan says no. 2.46 p.m.
- 59:35Speaker 1: Pryor asks if Duncan was aware the blessing was two
- 59:37Speaker 1: weeks before Alex died. Duncan says yes. Pryor says Alex
- 59:42Speaker 1: Cox died of natural causes and there was no funny business.
- 59:45Speaker 1: Duncan says, that we know of. Pryor asks Duncan if
- 59:48Speaker 1: he's aware Alex traveled to Mexico for cheap prescription drugs
- 59:52Speaker 1: before he died. Duncan is aware. Pryor has nothing further.
- 59:56Speaker 1: I am telling you, this man died of an opioid overdose.
- 1:00:02Speaker 2: 1,000%.
- 1:00:03Speaker 1: Did they even bother looking for fentanyl back then? Of
- 1:00:06Speaker 1: course they didn't. Who knows what he was getting down
- 1:00:08Speaker 1: in Mexico? 2.48pm. Blake has some follow-up. She asks if
- 1:00:13Speaker 1: Duncan was involved in investigating Alex Cog's death. He was not.
- 1:00:17Speaker 1: Blake asks if Duncan is aware of what drugs Alex
- 1:00:20Speaker 1: bought in Mexico. Dunk doesn't know. Blake says on November 24th,
- 1:00:25Speaker 1: Chad spoke to Alex about crossing over and his time
- 1:00:28Speaker 1: being done. On December 12th, Alex dies. 2.50 p.m. Duncan
- 1:00:34Speaker 1: revisits the text between Melanie and Lori where Lori said
- 1:00:38Speaker 1: giving me five minutes as she was trying to figure
- 1:00:40Speaker 1: out what to do. Duncan says at the time Lori
- 1:00:43Speaker 1: was talking to Chad. Blake asks if he thinks Alex
- 1:00:46Speaker 1: Cox killed Charles. He says he did. Blake asks if
- 1:00:49Speaker 1: Duncan believes Alex acted alone. Duncan believes he did not. 2.52 p.m.
- 1:00:56Speaker 1: Blake has no further questions. Pryor asks for more time
- 1:01:00Speaker 1: with the witness. Blake objects. Boyce says as long as
- 1:01:03Speaker 1: it stays within the scope, he will permit it. 2.53 p.m.
- 1:01:07Speaker 1: Pryor asks if Duncan knows everything about Chad, Lori, and Alex.
- 1:01:11Speaker 1: Duncan says he does not. The evidence in this case
- 1:01:15Speaker 1: is large. Pryor has nothing further.
- 1:01:17Speaker 2: 2.54 p.m.
- 1:01:19Speaker 1: State and Defense do not intend to call Detective Duncan again.
- 1:01:23Speaker 1: He's free to go. 2.55 p.m. Next witness is Social
- 1:01:27Speaker 1: Security Special Agent Mark Sari. 2.57 p.m. Rob Wood is
- 1:01:32Speaker 1: questioning Sari. Sari says his investigation and his investigators investigate
- 1:01:37Speaker 1: fraud and abuse in the Social Security office. 2.58 p.m.
- 1:01:42Speaker 1: Sari says in January 2020, the FBI contacted his office
- 1:01:47Speaker 1: to determine the whereabouts of J.J. and Tylee and to
- 1:01:50Speaker 1: find out if fraud was involved. Sari met with law
- 1:01:53Speaker 1: enforcement and the FBI. 2.59 p.m. Tylee received $ 1, 859 a
- 1:02:00Speaker 1: month because of her father, Joseph Ryan, died in 2018.
- 1:02:04Speaker 1: Lori Vallow received the payments because Tylee was a minor.
- 1:02:08Speaker 1: Sari says her social security benefits went to a JPMorgan
- 1:02:12Speaker 1: Chase account. Lori was also on the account. Sari says
- 1:02:16Speaker 1: the bank account changed to a BBVA account on or
- 1:02:20Speaker 1: about August 20th, 2019. 3.01 p.m. Wood asked to admit
- 1:02:26Speaker 1: a notice sent to Lori Vallow notifying her of the
- 1:02:28Speaker 1: bank change. The letter was sent on August 27th, 2019. 3.02 p.m.
- 1:02:35Speaker 1: Tylee Ryan stopped receiving benefits in January 2020 due to
- 1:02:39Speaker 1: the fact that she could not be located.
- 1:02:41Speaker 2: 3.03 p.m.
- 1:02:43Speaker 1: J.J. Vallow started receiving $ 1, 951 a month in September 2019
- 1:02:48Speaker 1: due to the death of his father. Lori Vallow was
- 1:02:52Speaker 1: the representative receiving the Social Security benefits. The benefits stopped
- 1:02:57Speaker 1: due to his whereabouts being unknown. Lori Vallow received mother, child,
- 1:03:02Speaker 1: and care benefits for taking care of J.J. following Charles' death. 3.04 p.m.
- 1:03:07Speaker 1: Lori received $ 1, 951 a month. In January 2020, the amount
- 1:03:14Speaker 1: was lowered due to debt she had to the U.S. Treasury.
- 1:03:17Speaker 1: The benefits then ended due to JJ's whereabouts being unknown. 3.06 p.m.
- 1:03:23Speaker 1: Wood asks if people are required to notify the S.S.
- 1:03:26Speaker 1: administration if they have a change of circumstances. Sari says
- 1:03:30Speaker 1: they are, if they move, if someone dies, gets married, etc. 3.07 p.m.
- 1:03:36Speaker 1: Wood asked to admit an exhibit and shows it to
- 1:03:38Speaker 1: the jury. It's a copy of the reporting responsibilities given
- 1:03:42Speaker 1: to Lori Vallow when she began receiving payments for J.J. Vallow. 3.08 p.m.
- 1:03:48Speaker 1: If a beneficiary dies or moves, S.S. Administration needs to
- 1:03:52Speaker 1: be notified. Wood asks if a person such as Lori
- 1:03:55Speaker 1: Vallow remarries, are they required to tell S.S. Administration? Sari
- 1:03:59Speaker 1: says they are. Sari says Lori never reported Tylee and J.J.
- 1:04:03Speaker 1: died or were missing. She never reported that JJ and
- 1:04:07Speaker 1: Tylee moved from Arizona to Rexburg. She never reported she
- 1:04:11Speaker 1: married Chad Daybell. She never reported she moved to Hawaii.
- 1:04:14Speaker 2: 3.10 p.m.
- 1:04:17Speaker 1: Social Security funds belong to the U.S. Treasury. Wood has
- 1:04:21Speaker 1: no further questions. Pryor will now ask some questions. Again,
- 1:04:24Speaker 1: it was all about the money for Vallow. Let's be
- 1:04:27Speaker 1: very clear. She wanted her hands on all of this dough,
- 1:04:30Speaker 1: and she was going to do whatever she could to
- 1:04:31Speaker 1: get it.
- 1:04:32Speaker 2: 3.11 p.m.
- 1:04:37Speaker 1: Pryor says he heard a lot about Lori Vallow. Are
- 1:04:40Speaker 1: any of these documents in regards to Chad Daybell? Sari
- 1:04:43Speaker 1: says no. Daybell is not listed on any of the documents.
- 1:04:47Speaker 1: Pryor says Chad is not under any obligation to notify
- 1:04:50Speaker 1: anyone in SS administration that he was married to Lori.
- 1:04:54Speaker 1: Sari says if Chad was aware of she had the
- 1:04:56Speaker 1: responsibility to report it and did not, that could be
- 1:04:59Speaker 1: a problem. 3.12 p.m. Pryor clarifies how much Lori was receiving.
- 1:05:04Speaker 1: Due to JJ and Tylee.
- 1:05:07Speaker 2: 3.14pm.
- 1:05:08Speaker 1: Pryor asks when the social security payments end for Tylee.
- 1:05:11Speaker 1: Sari says in January 2020. The benefits would have stopped
- 1:05:15Speaker 1: automatically when she turned 18.
- 1:05:19Speaker 2: 3.15pm.
- 1:05:20Speaker 1: Pryor adds up how much Lori was receiving a month
- 1:05:22Speaker 1: from SS. It was around $ 5, 700 to $ 5, 800 a month.
- 1:05:27Speaker 1: And that wasn't good enough for her. She had to
- 1:05:29Speaker 1: kill to get some more money. Kill her own kids.
- 1:05:32Speaker 1: Mother of the year over here, folks. More like Scafusa
- 1:05:35Speaker 1: of the century. 3.17 p.m. Pryor has no further questions,
- 1:05:40Speaker 1: neither does Wood. The witness will not be recalled. 3.20 p.m.
- 1:05:45Speaker 1: Boyce says we're going to break for the day, and
- 1:05:47Speaker 1: that's going to be a wrap. All right, so that's
- 1:05:49Speaker 1: going to be a wrap for us as well, as
- 1:05:52Speaker 1: day four of Chad Daybell's trial is now in the books.
- 1:05:57Speaker 1: All of the information that goes with this episode can
- 1:06:00Speaker 1: be found in the description box.
