- 0:04Speaker 1: Yeah, buddy, here we go. Second hour radio program effectually
- 0:08Speaker 1: known as Common Sense Amplified. It is the Morning Show
- 0:11Speaker 1: with Me. I am Preston Scott. He is Jose and
- 0:15Speaker 1: it's great to be with you on this Friday. That
- 0:18Speaker 1: of course means it's time. He is the gun Writer.
- 0:24Speaker 1: You can find his work at the gunwriter dot substack
- 0:27Speaker 1: dot com. Lee Williams joins us, Good morning, Lee, how
- 0:30Speaker 1: are you?
- 0:32Speaker 2: Good morning? How are you?
- 0:33Speaker 1: I'm doing fine, you know, I must say, and I'm
- 0:37Speaker 1: betting you feel the same way that sometimes you almost
- 0:40Speaker 1: feel guilty being in a good place because you look
- 0:44Speaker 1: at what's happened with Patrick Taya Domiak and you're like,
- 0:49Speaker 1: it is so infuriating to read what has happened to
- 0:54Speaker 1: this young man. So before you update everybody on the latest,
- 0:58Speaker 1: reset the story. For those that are new to the
- 1:01Speaker 1: program and haven't heard. Who is Patrick Tay Doomiak.
- 1:06Speaker 2: Well, he was an active duty sailor. He's about to
- 1:09Speaker 2: start his third year of his twenty year federal prison
- 1:12Speaker 2: sentence based on charges that do not exist atf It
- 1:18Speaker 2: tells you everything you want to know about atf they
- 1:20Speaker 2: can come in and charge you and throw you in
- 1:22Speaker 2: federal prison when everything you own is completely legal. He
- 1:26Speaker 2: had a website and was doing pretty well. Actually was
- 1:30Speaker 2: one of the top one hundred sellers of parts not guns.
- 1:35Speaker 2: He sold gun parts atf hooked up with a terrible informant.
- 1:40Speaker 2: The informant bought some stuff from them, which are perfectly legal.
- 1:43Speaker 2: You can buy him online right now today, and he
- 1:46Speaker 2: is in the slam. He was sentenced to twenty years.
- 1:49Speaker 2: They wanted thirty. They wanted to send him to prison
- 1:52Speaker 2: for thirty years. Man has never done anything wrong. In
- 1:55Speaker 2: addition to being maybe e six, He was headed to
- 1:58Speaker 2: seal School in orders to report to San Diego, which
- 2:05Speaker 2: just I cannot tell you how angry that makes.
- 2:07Speaker 1: Me part of this entire prosecution, though in fact most
- 2:12Speaker 1: of it hinged on the literal manufacturing of evidence.
- 2:18Speaker 2: Explain that right, well, once they kicked down all his
- 2:23Speaker 2: doors and searched all his safes, they must have at
- 2:26Speaker 2: some point realized, hey, we got nothing, we've got nothing,
- 2:30Speaker 2: so they put stuff together. They used cut up parts
- 2:35Speaker 2: parts from a PPSh forty one machine gun, which are
- 2:38Speaker 2: not a gun. They charged them with machine guns. They
- 2:41Speaker 2: used RPGs rocket hotel grenade launchers, which were not even
- 2:46Speaker 2: one of them wasn't even made to shoot, it was
- 2:48Speaker 2: just display. They charged them with having rocket launchers and
- 2:53Speaker 2: they put forty millimeter grenade launchers together. He had parts
- 2:57Speaker 2: there that were one hundred percent illegal. They put them
- 3:00Speaker 2: together and they made an unregistered SBR, a short bail rifle.
- 3:05Speaker 2: It's it's just the craziness that they went through to
- 3:08Speaker 2: get him. I mean, the guy sold parts, the parts
- 3:11Speaker 2: he can still buy online right now without any kind
- 3:14Speaker 2: of information.
- 3:15Speaker 1: And to clarify its crazy lead to clarify the parts
- 3:19Speaker 1: were legal that they took to put together and make
- 3:24Speaker 1: something illegal.
- 3:27Speaker 2: Absolutely correct, sir, Absolutely correct.
- 3:31Speaker 1: And most of this was done by an ATF Firearms
- 3:34Speaker 1: Enforcement officer named Jeffrey Bodell.
- 3:36Speaker 2: Correct, yes, yes, he turned legal RPGs into destructive devices.
- 3:44Speaker 2: Heate had some very expensive legal semi autos that shot
- 3:47Speaker 2: from an open bolt. I mean we're talking four or
- 3:50Speaker 2: five thousand dollars a pistol. Of course, he called all
- 3:53Speaker 2: of them machine guns, even though he could only get
- 3:54Speaker 2: them to shoot one round. He took a toy sten
- 3:58Speaker 2: and turned it into what he said as a machine.
- 4:00Speaker 2: The thing's a toy. You buy it online for about
- 4:02Speaker 2: one hundred and fifty bucks. It's crazy what this guy did,
- 4:07Speaker 2: and the judges just went okay. I mean, it is
- 4:11Speaker 2: the worst I've ever seen. I've been an investigator reporter
- 4:15Speaker 2: for more than twenty years, as a policeman for ten
- 4:16Speaker 2: before that. I've never seen an innocent man in prison.
- 4:20Speaker 2: This guy needs to get let go. Lee.
- 4:24Speaker 1: His case ended up finally before the US Court of
- 4:27Speaker 1: Appeals for the Fourth Circuit. How is it possible the
- 4:31Speaker 1: attorneys that you know and have talked to, how is
- 4:33Speaker 1: it possible that they did not order a new trial
- 4:38Speaker 1: given the manufactured evidence.
- 4:41Speaker 2: Well, I talked to Matt Laisir, his attorney now his
- 4:47Speaker 2: Appellett attorney, and quite frankly, Matt said he doesn't believe
- 4:50Speaker 2: they read all the paperwork the judges. If you read
- 4:54Speaker 2: everything about the case, you understand, hey, this guy's innocent.
- 4:58Speaker 2: Matt doesn't think they read everything. But at least at
- 5:01Speaker 2: least they found that they had the trial court violated
- 5:07Speaker 2: the double jeopardy clause at a fifth Amendment. Basically, they
- 5:11Speaker 2: hit him twice for the same thing. The Rozier said,
- 5:14Speaker 2: it'd be the same as charging someone with murder and manslaughter. Okay,
- 5:18Speaker 2: so he gets another hearing in front of him, where
- 5:21Speaker 2: he's going to try and heep in all this other
- 5:24Speaker 2: crap and how everything else in this case nothing is illegal,
- 5:29Speaker 2: So hopefully the judges will we'll take a look at
- 5:33Speaker 2: that and do the honest work that they're hired to do.
- 5:37Speaker 1: Who hears this next level of the re sentencing.
- 5:41Speaker 2: Who listens, Well, he's got a he wants to appear
- 5:46Speaker 2: before the entire Court of Appeals, not just the three members,
- 5:51Speaker 2: and we'll see what happens after that. Brother, I really
- 5:54Speaker 2: got a good feeling about the Rosier. He's an experienced guy.
- 6:01Speaker 2: He's the perfect appellate attorney. You know, I'll tell you
- 6:04Speaker 2: a pellet attorneys, as you probably know, are kind of weird.
- 6:07Speaker 2: But because they're dealing with so much paperwork and they
- 6:11Speaker 2: you know, they work on their own. They sit in
- 6:14Speaker 2: their office for twenty five hours a day and write.
- 6:17Speaker 2: And I got to tell you, Matt is exactly what
- 6:19Speaker 2: Tate needs. Well.
- 6:21Speaker 1: And what's interesting is, you know, you talk about the
- 6:23Speaker 1: appellate process, it is so much about technicalities, and this
- 6:28Speaker 1: case is not just riddled with bad technicalities, it's riddled
- 6:33Speaker 1: with fraudulent technicalities.
- 6:36Speaker 2: People should go to jail for what was presented to
- 6:39Speaker 2: the court and called factual. That's where this needs to go.
- 6:44Speaker 1: What kind of timeframe are we looking at for him
- 6:47Speaker 1: to perhaps get that second second?
- 6:50Speaker 2: Try months, This will take months. But you know, Tate's
- 6:55Speaker 2: already been in prison for damn near three years. And
- 7:00Speaker 2: you know, I go to bed at night, I wake
- 7:01Speaker 2: up and I think, man Tate is sleeping in a
- 7:05Speaker 2: room with nineteen other guys. There's no out for him.
- 7:09Speaker 2: There's no you know, let's go walk outside. There's there's
- 7:12Speaker 2: no He's focused on his case one percent of the time. Brother,
- 7:18Speaker 2: and that's just kinda suck horribly.
- 7:21Speaker 1: I'm curious. It's interesting to me that the United States
- 7:25Speaker 1: Navy gave Tate a domiak an honorable discharge. Doesn't that
- 7:32Speaker 1: in and of itself speak volumes.
- 7:36Speaker 2: If he committed an actual crime as an E six
- 7:40Speaker 2: while he's sitting in prison, he would have been reduced
- 7:42Speaker 2: to E one and booted out of the Navy. They
- 7:46Speaker 2: let his enlistment expire while he was in it. He
- 7:48Speaker 2: was paid while he was in prison, So what does
- 7:53Speaker 2: that tell you about the Navy. I think the Navy
- 7:57Speaker 2: did a real good job on this, and hopefully if
- 8:00Speaker 2: he gets sprung and pardoned or sprung and found not guilty,
- 8:04Speaker 2: they'll take him back because he really wants to go
- 8:06Speaker 2: to seal school.
- 8:08Speaker 1: Yeah, that's that's how I'm praying. That's for sure, Lee,
- 8:10Speaker 1: stand by. It's about sixteen minutes past the hour.
- 8:14Speaker 2: Friends.
- 8:14Speaker 1: You need to know the name Patrick Tate a Domiak.
- 8:17Speaker 1: You need to know the story. You'll find all kinds
- 8:20Speaker 1: of articles written about it. Facts, facts, facts, and we're
- 8:26Speaker 1: pulling every lever we know to pull. But the best
- 8:30Speaker 1: thing that can happen is for you to write your congressman,
- 8:34Speaker 1: your senator and to ask for justice for Patrick Tate
- 8:37Speaker 1: to Domiak and if they go, who link him to?
- 8:41Speaker 1: The gunwriter? Just told Lee Williams thegunwriter dot substack dot
- 8:52Speaker 1: com in the break. I have over the years see
- 8:55Speaker 1: people on our side, Conservatives, the right. We love debate,
- 9:01Speaker 1: we love to have discussion. I've invited folks from every
- 9:04Speaker 1: town to come on the show, and the Brady Group
- 9:08Speaker 1: that these are anti gun, anti Second Amendment organizations, I
- 9:12Speaker 1: invite them to come on the show. Hey, you got
- 9:14Speaker 1: all kinds of people to talk to, so come on
- 9:17Speaker 1: convince everybody that you're right. None of them will come
- 9:20Speaker 1: on this program, of course, they won't. But Lee Williams, Lee,
- 9:25Speaker 1: you actually took a course from Every Town.
- 9:30Speaker 2: I am a graduate of the Smart Guide to Buying
- 9:33Speaker 2: a Gun. It's a one point five hour video class
- 9:36Speaker 2: put on by train Smart, which is every Town Firearms Training.
- 9:40Speaker 2: So I got that going for me, brother.
- 9:43Speaker 1: I mean, you're you're hanging that up on your wall, right,
- 9:46Speaker 1: that goes on the resume, moving forward.
- 9:49Speaker 2: Something like that. Something like that. Yeah, it's a one
- 9:52Speaker 2: point five hour course. It costs twenty bucks, it's online.
- 9:57Speaker 2: Every Town offers two additional firearms training horses, including an
- 10:02Speaker 2: eight hour trip to the range that watch you watch
- 10:06Speaker 2: on your computer. You can't go to the range with
- 10:09Speaker 2: the instructors. And I got to tell you their instructors,
- 10:13Speaker 2: Nellis and Jake were a joke. I don't know their
- 10:16Speaker 2: last names. Brother. I mean, I take firearms classes for
- 10:20Speaker 2: a living, and I go to the websites of the
- 10:22Speaker 2: guys that are going to teach me, and everything's there,
- 10:25Speaker 2: you know, including their full name. But all of their
- 10:29Speaker 2: background is there, every course they've ever taken, every military
- 10:32Speaker 2: unit they've ever served in. But these cats Nellis and Jake,
- 10:36Speaker 2: I mean Jake said that. I'm quoting him here, As
- 10:39Speaker 2: an instructor, Jake strives to create welcoming spaces where everyone
- 10:43Speaker 2: can learn to feel safer and more confident with firearms.
- 10:47Speaker 2: Oh gosh, it was an incredible time. The class lasted
- 10:52Speaker 2: an hour and a half. I probably just sat there
- 10:55Speaker 2: and thought for an hour after I was done. It
- 10:57Speaker 2: was an incredible confusing mix of anti gun propaganda. I mean,
- 11:04Speaker 2: they're making up stuff like you have never heard in
- 11:08Speaker 2: your life, and they're they're citing it all their crazy
- 11:14Speaker 2: statistics and everything. I mean, if when a male abuser
- 11:18Speaker 2: has access to a firearm, the risk he's going to
- 11:20Speaker 2: shoot and kill a female increase increases by one thousand percent,
- 11:24Speaker 2: what the help they get that? And it's just nuts.
- 11:31Speaker 2: It was crazy. They try and scare you. The only
- 11:35Speaker 2: the only realistic data that they presented during an hour
- 11:39Speaker 2: and a half was Colonel Jeff Cooper's four General Firearm
- 11:42Speaker 2: Safety Rules and that's it. And of course they never
- 11:48Speaker 2: gave Colonel Cooper any credit. They act like they came
- 11:52Speaker 2: up with it on their own. So overall it the
- 11:56Speaker 2: whole thing is just so chock full of fear brother
- 11:59Speaker 2: that they used. They want to scare folks. They never talked,
- 12:02Speaker 2: they never mentioned in AR. They never mentioned concealed carry.
- 12:06Speaker 2: They just want to scare you away from firearms. If
- 12:10Speaker 2: you have a gun, you have to completely disassemble it
- 12:12Speaker 2: and store it in a safe well, for example, where
- 12:14Speaker 2: the bad guys will come and get you.
- 12:16Speaker 1: I was just going to say, we talked earlier in
- 12:18Speaker 1: the week, and I probably didn't do some of our
- 12:22Speaker 1: programming people any favors, but we have, you know, we
- 12:25Speaker 1: have to air PSAs that get pushed down to us.
- 12:27Speaker 1: And one of them was about keep your gun stored
- 12:30Speaker 1: and locked and unloaded it. And I'm like, you're an
- 12:33Speaker 1: idiot if you do that. If you have a gun,
- 12:35Speaker 1: if you have a firearm now with children around, and
- 12:38Speaker 1: you don't use it for personal defense, you obviously need
- 12:41Speaker 1: to be smart about that. And if you have children
- 12:44Speaker 1: for personal defense, if you have it for personal offense,
- 12:47Speaker 1: you've got to be smart about that. But to leave
- 12:48Speaker 1: it in a locked safe unloaded is just patently stupid.
- 12:54Speaker 2: With the magazines and the AMMO at a different point
- 12:57Speaker 2: in your home, and they said that if somebody comes
- 12:59Speaker 2: in and actually presents a threat, you're going to have
- 13:03Speaker 2: time to get your gun out of your safe and
- 13:05Speaker 2: then go and load a magazine with the rounds and
- 13:08Speaker 2: then load the magazine into the firearm. And I'm like,
- 13:10Speaker 2: what I mean we're talking seconds? Boom, the front door's
- 13:14Speaker 2: kicked in. Yes, I have to have a gun in
- 13:16Speaker 2: my hand. Yeah.
- 13:17Speaker 1: I was going to say the number of stories we
- 13:20Speaker 1: recount on this program in a given year about people
- 13:23Speaker 1: breaking into homes, armed invasions, home burglaries, where they're you
- 13:28Speaker 1: know whatever. It's like, you've you've lost your mind. There's
- 13:31Speaker 1: no common sense in any of it.
- 13:34Speaker 2: I'm sitting right next to a small gun safe with
- 13:37Speaker 2: my loaded staccato in it that I have to put
- 13:40Speaker 2: my finger on and it'll pop open. It takes about
- 13:43Speaker 2: a second and the gun's ready to go. I just
- 13:46Speaker 2: take the safety off. That to me is almost too slow.
- 13:51Speaker 2: Sometimes my stories will create a little hate and discontent.
- 13:55Speaker 2: I'll open carry in my house just for a just
- 14:00Speaker 2: to be have, just to have peace of mind.
- 14:02Speaker 1: Brother, I don't have a firearm more than a second
- 14:05Speaker 1: or two away from me at any point in my home,
- 14:08Speaker 1: at any entry of my home. And I've had I've
- 14:12Speaker 1: had a firearm by my bedside on my nightstand for
- 14:16Speaker 1: twenty plus years and it hasn't shot me yet.
- 14:20Speaker 2: Well, it's just a matter of time. I said, yeah
- 14:25Speaker 2: it was, but I got I got my diploma, and
- 14:28Speaker 2: I'm really happy. Yeah it was just I mean a
- 14:34Speaker 2: quick example. They stress the false benefits of home security systems,
- 14:39Speaker 2: you know, alarms, deals, signs, doorbell cameras. These are great ideas,
- 14:44Speaker 2: you know, until some a bad guy breaks in your house.
- 14:47Speaker 2: When they break into the house, their solution adopted dog.
- 14:52Speaker 2: I'm like, oh my god, oh my god. We have
- 14:54Speaker 2: a dog, a little Boston Terrier who would bark. But yeah, no,
- 15:01Speaker 2: better to have a gun.
- 15:02Speaker 1: I'm curious, are you going to do any follow up
- 15:05Speaker 1: with every town? Reach out to him, tell him you
- 15:07Speaker 1: took the gun course and you'd like to interview him.
- 15:10Speaker 2: I have tried and tried and tried, and every town
- 15:15Speaker 2: will never call back. Isn't that interesting? Yeah, and you
- 15:19Speaker 2: would love to chat with him. I have a friendly conversation.
- 15:22Speaker 1: And you gave him twenty bucks and it took the course.
- 15:26Speaker 2: I know, better than the fifty. They wanted to watch
- 15:29Speaker 2: somebody shoot at the range man for eight hours. And
- 15:34Speaker 2: I got to tell you, I mean, I am an
- 15:37Speaker 2: instructor NRA certified need to Train law enforcement. A long
- 15:42Speaker 2: time ago I have never seen anything so bad in
- 15:45Speaker 2: my life. It wasn't firearm safety. It was firearms scary.
- 15:50Speaker 2: Let's scare people with what we know about guns. It
- 15:53Speaker 2: was terrible and so disorganized too. It was just absolutely terrible.
- 15:58Speaker 1: Lee, you're the best. Thanks so much for the time.
- 16:00Speaker 1: I appreciate all you're doing and we'll be in touch.
- 16:02Speaker 2: Thank you, Thank you for taking care.
- 16:05Speaker 1: All right, Lee Williams. He is the gun writer. It's
- 16:07Speaker 1: the gun Writer dot substack dot com. Great material and
- 16:12Speaker 1: a guest on the Morning Show with Preston Scott
