Latest / Beyond The Horizon / Mega Edition: Day Three Of The Chad Daybell Trial (10/18/26)
Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. The
- 0:03Speaker 1: Chad Daybell trial is off and running and after a
- 0:07Speaker 1: short week last week, we have a full slate ahead
- 0:11Speaker 1: of us this week with proceedings expected to happen throughout.
- 0:16Speaker 1: So let's not waste any time with any sort of
- 0:19Speaker 1: rambling or whinging and let's just dive right into the
- 0:23Speaker 1: recap of what went down. On Monday, April 15th, day
- 0:29Speaker 1: number three, at the Chad Daybell trial. And once again,
- 0:33Speaker 1: to do that, we're going to be using an article
- 0:36Speaker 1: from eastidahonews.com, and the author of this article is Nate Eaton. 8.20 a.m.
- 0:45Speaker 1: We are waiting in line to get into the courtroom.
- 0:47Speaker 1: The trial court administrator just told us Judge Boyce is
- 0:51Speaker 1: conducting a last-minute hearing that will be live-streamed only. 8.23 a.m.
- 0:57Speaker 1: Cameras and audio seem much better today. This hearing seems
- 1:01Speaker 1: to be about Alex Cox's encounter with Joseph Ryan back
- 1:05Speaker 1: in 2007. 826 a.m. This hearing is being held with
- 1:09Speaker 1: the jury present. We are told that once this portion
- 1:12Speaker 1: is over, we will be allowed in the courtroom and
- 1:15Speaker 1: the jurors will be brought in. 829 a.m. Judge rules
- 1:20Speaker 1: John Pryor cannot reference the incidents involving Joseph Ryan and
- 1:25Speaker 1: Alex Cox. Now, Joseph Ryan, for those of you who
- 1:27Speaker 1: might not be hip, is Lori Vallow's XXX husband. You know,
- 1:32Speaker 1: this lady had multiple husbands, right? But the man they're
- 1:35Speaker 1: referring to here is Tylee Ryan's dad. 8.36 a.m. The
- 1:40Speaker 1: bailiff reminds everyone to silence their phone as someone's phone rings.
- 1:44Speaker 1: If you are unsure if your phone will go off,
- 1:47Speaker 1: turn it off, the bailiff says during the breaks. Everyone
- 1:50Speaker 1: needs to leave and take all of their items with them.
- 1:54Speaker 2: 8.38 a.m.
- 1:55Speaker 1: There are around 30 to 40 people in the courtroom today.
- 1:58Speaker 1: one of the largest days we have seen. Boyce is
- 2:00Speaker 1: on the bench, prosecution ready to call its next witness.
- 2:04Speaker 1: Jurors will be brought in. 8.41 a.m. The jurors are
- 2:09Speaker 1: in their seats, and each of them have signed their
- 2:11Speaker 1: declaration that they didn't do any research on the case
- 2:14Speaker 1: over the long weekend. 8.42 a.m. Vince Kayakamanu is the
- 2:19Speaker 1: next witness. He was an investigator with the Fremont County
- 2:22Speaker 1: Sheriff's Office until taking a job as the chief deputy
- 2:25Speaker 1: of with the Madison County Sheriff's Office earlier this year. 8.45 a.m.
- 2:31Speaker 1: Kaya Kamanu worked for the Fremont County Sheriff's Office for
- 2:34Speaker 1: 18 years. Kaya Kamanu now oversees the Madison County Jail. 8.46 a.m.
- 2:42Speaker 1: Madison County Prosecuting Attorney Rob Wood is questioning Kaya Kamanu.
- 2:47Speaker 1: The Chief Deputy explains he oversees the Telmate phone video
- 2:50Speaker 1: system that inmates use in the jail. Wood asks Kaya Kamanu,
- 2:55Speaker 1: how we make sure inmates don't make calls on behalf
- 2:58Speaker 1: of other inmates. The deputy explains every inmate has a
- 3:02Speaker 1: PIN number and a photo is taken. Their voice is
- 3:05Speaker 1: also recorded. So whenever you're in prison, obviously, or in jail,
- 3:10Speaker 1: everything you do is monitored. So it always amazes me
- 3:14Speaker 1: when these dumbasses who are locked up decide to make
- 3:17Speaker 1: a phone call or talk to somebody and think that
- 3:20Speaker 1: that information is not going to be recorded by the government.
- 3:24Speaker 1: Breaking news, dum-dum. It's going to be 8.48 a.m. Kaya
- 3:29Speaker 1: Kamanu says all inmate calls are recorded. He can log
- 3:32Speaker 1: into the system and listen to calls, but he's unable
- 3:35Speaker 1: to edit the information. Tablets and phones are located in
- 3:39Speaker 1: the pods of the jail for inmate use. 8.50 a.m.
- 3:44Speaker 1: Wood asked about the June 9, 2020, Lori Vallow Daybell
- 3:48Speaker 1: was in Madison County Jail. Chad Daybell was not in jail.
- 3:52Speaker 1: Wood asked to admit an exhibit. 8.51 a.m. The exhibit
- 3:58Speaker 1: is a thumb drive containing a call between Chad and Lori.
- 4:01Speaker 1: Wood is about to play the call.
- 4:04Speaker 2: 8.52 a.m.
- 4:05Speaker 1: Lori called Chad. Hi babe, are you okay, she says.
- 4:08Speaker 1: They're searching the property, Chad responds. The house right now,
- 4:13Speaker 1: Lori responds. Yes, yes, Chad says. So Mark Means will
- 4:17Speaker 1: be talking to you. Lori asks if they're in the house.
- 4:21Speaker 1: Chad says no, they're out on the property. Lori asks
- 4:25Speaker 1: if they are seizing stuff again. Chad responds, they're searching. 8.54 a.m.
- 4:31Speaker 1: Chad is looking at the screen in the courtroom as
- 4:34Speaker 1: the call is played. The call continues with Chad saying,
- 4:37Speaker 1: I'm glad that you called. We'll see what transpires. Lori responds, Kay,
- 4:42Speaker 1: what do you want me to do? Pray? Chad says. Yeah, pray.
- 4:46Speaker 1: And yeah. Chad tells Lori to call Mark. Maybe. Mark
- 4:50Speaker 1: means is their former attorney.
- 4:52Speaker 2: 8.56 a.m.
- 4:54Speaker 1: Chad tells Lori he's getting a call from someone else.
- 4:57Speaker 1: I love you so much, he says. Lori asks Chad
- 5:00Speaker 1: if he could try and call him later. Chad says,
- 5:02Speaker 1: I don't know. I don't know. You can try. I'll
- 5:04Speaker 1: answer if I can. Chad says, I love you, and
- 5:08Speaker 1: I'll talk to you soon. Lori says she loves him,
- 5:10Speaker 1: and the call ends. 8.57 a.m. Wood has no further
- 5:15Speaker 1: questions for Kaya Kamanu. Pryor will now cross-examine.
- 5:19Speaker 2: 8.58 a.m.
- 5:20Speaker 1: Pryor asks, How many officers were at Chad's house? Kayakamanu
- 5:25Speaker 1: says more than 30. Pryor asks about Chad, mentioning on
- 5:29Speaker 1: the phone that he was at his daughter Emma's house,
- 5:32Speaker 1: which was kitty-cornered to Chad's home. Pryor asks if he
- 5:36Speaker 1: found out who the person was calling that interrupted Chad's
- 5:39Speaker 1: call with Lori. Kayakamanu says he does not know. 9 a.m.
- 5:45Speaker 1: Pryor references Lori mentioning search again on the call with Chad.
- 5:49Speaker 1: He asks Kayakamanu, How many times officers had searched Chad's
- 5:53Speaker 1: home prior to the June search? Kaya Kamanu says they
- 5:57Speaker 1: went in January 2020. Pryor asks if officers ever showed
- 6:01Speaker 1: up unannounced at Chad's house to search the property. Kaya
- 6:04Speaker 1: Kamanu says no. They did go with the search warrant
- 6:08Speaker 1: in January. And what Pryor's trying to do here is
- 6:10Speaker 1: look for holes, right? Is everything on the up and up?
- 6:15Speaker 1: Was the chain of custody respected? Were the search warrants...
- 6:19Speaker 1: drawn up properly, you know, all of this stuff, the
- 6:22Speaker 1: loopholes and technicalities. Because as we all know, that's really
- 6:27Speaker 1: the only defense for somebody like Chad Daybell, who pretty
- 6:30Speaker 1: much has been caught dead to rights at this point. 9.02 a.m.
- 6:34Speaker 1: Pryor asks Kayakamanu if he has interviewed Melanie Gibb. Kayakamanu
- 6:39Speaker 1: says he has one time. Pryor asks Kayakamanu about interviewing
- 6:44Speaker 1: Garth Daybell, Chad's son. Kaya Kamanu says he interviewed Garth
- 6:48Speaker 1: one time at the Rexburg Police Department. Kaya Kamanu says
- 6:52Speaker 1: he also went to the school where Garth teaches with
- 6:55Speaker 1: an FBI special agent. I get like this Hills Have
- 6:58Speaker 1: Eyes kind of vibe from Chad Daybell and his family, too.
- 7:02Speaker 1: Maybe it's just me, but it's real, like, hill people
- 7:06Speaker 1: type shit going on over here.
- 7:07Speaker 2: 9.04 a.m.
- 7:10Speaker 1: Pryor asks how long Garth was at RPD for the interview.
- 7:14Speaker 1: Kaya Kamanu says for a few hours. They got a
- 7:17Speaker 1: McDonald's and a soda. Garth asks for an attorney, and
- 7:20Speaker 1: the lawyer showed up. Remember, that's not an admission of
- 7:23Speaker 1: guilt or anything like that. Anytime that you're being questioned
- 7:26Speaker 1: by the police, or the police come to talk to
- 7:29Speaker 1: you even, I suggest having a lawyer present. Because the
- 7:33Speaker 1: last thing you want to do is talk yourself into
- 7:35Speaker 1: a jail cell. Prior asks, Kaya Kamanu is reviewed videotape
- 7:39Speaker 1: of Chad and Emma from June 9th. Kaya Kamanu has not. 9.06 a.m.
- 7:45Speaker 1: Pryor asks if anyone was on the scene at Chad's
- 7:47Speaker 1: house on June 9th who was not law enforcement. Kayakamanu
- 7:52Speaker 1: says the coroner and some canine dogs were there. They
- 7:55Speaker 1: work from 7 a.m. to 4 or 5 p.m. Pryor
- 7:59Speaker 1: has no further questions. Wood has some redirect questions. 9.08 a.m.
- 8:04Speaker 1: Pryor spoke to Kayakamanu about how people get nervous when
- 8:08Speaker 1: the police show up. Wood asks Kayakamanu If he has
- 8:11Speaker 1: listened to multiple calls between Chad and Lori. Kayakamanu says yes.
- 8:16Speaker 1: Wood asks if the tone of the phone calls on
- 8:19Speaker 1: June 9th was different to their average phone call. Kayakamanu
- 8:23Speaker 1: says yes. Wood says Kayakamanu if he was present when
- 8:27Speaker 1: Chad drove away. Kayakamanu was. Wood asks what was happening.
- 8:31Speaker 1: Pryor objects. Boyce overrules. Kayakamanu says when Chad drove away,
- 8:37Speaker 1: police were looking for two bodies on his property. Nothing
- 8:41Speaker 1: suspicious there, folks. Dude just had to go to the
- 8:44Speaker 1: store real quick. All of a sudden had an urge
- 8:47Speaker 1: to go get himself some Tums because I'm guessing the
- 8:50Speaker 1: Ajita was building quickly. He knew that the cards were
- 8:54Speaker 1: about to tumble down. He knew that the whole entire
- 8:57Speaker 1: jig was up and his bitch ass tried to run
- 9:00Speaker 1: like the coward he is. 9.11 a.m. Kaya Kamanu says
- 9:05Speaker 1: when Chad drove away, police were in the process of
- 9:08Speaker 1: discovering JJ Vallow's body. Wood has no further questions. Pryor
- 9:13Speaker 1: is questioning Kayakamanu on the phone calls again. He asks
- 9:16Speaker 1: if there were 30 officers on the property. There would
- 9:19Speaker 1: be a different tone. Kayakamanu says yes. Pryor asks Kayakamanu
- 9:24Speaker 1: if he was aware that Chad was going to get
- 9:27Speaker 1: an attorney. Kayakamanu was not. He was going to get
- 9:31Speaker 1: an attorney, huh? The attorney couldn't come to him? Maybe
- 9:34Speaker 1: he should have called Saul. 9.12 a.m. Pryor has no
- 9:39Speaker 1: further questions. Kayakamanu is the state's designated agent, so he
- 9:43Speaker 1: gets to sit in the courthouse the entire trial. Pryor
- 9:46Speaker 1: says he plans to recall Kayakamanu again. The next witness
- 9:50Speaker 1: is Rexburg detective Eric Wheeler. 9.13 a.m. Wheeler walks in
- 9:57Speaker 1: and takes the stand. Fremont County Deputy Prosecutor. Attorney Rocky
- 10:01Speaker 1: Wixom is questioning Wheeler. Wheeler has worked for RPD for
- 10:06Speaker 1: 18 years. He was a patrol sergeant before becoming a detective. 9.16 a.m.
- 10:12Speaker 1: Wixom asked Wheeler if he assisted on the search on
- 10:15Speaker 1: June 9, 2020. Wheeler's role was to maintain scene security, traffic,
- 10:20Speaker 1: and crowd control while investigators conducted their search. 9.17 a.m.
- 10:26Speaker 1: During the search, Wheeler found remains of Tylee and observed
- 10:30Speaker 1: the remains of J.J. He says Tylee's remains were found
- 10:34Speaker 1: near the fire pit and J.J. 's remains were found
- 10:37Speaker 1: near the pond in the rear of the property. 9.19 a.m.
- 10:41Speaker 1: Wheeler says when he arrived, he helped maintain traffic and
- 10:44Speaker 1: stood by as detectives served the warrant to Chad. His
- 10:48Speaker 1: role was to stand by and observe the occupants of
- 10:50Speaker 1: the home as they were coming and going. 9.20 a.m.
- 10:54Speaker 1: Wheeler arrived at the home just after 7 a.m. He
- 10:57Speaker 1: says multiple law enforcement agencies were involved. Rexburg Police, Fremont
- 11:02Speaker 1: County Sheriff's Office, and the FBI. So the FBI is
- 11:06Speaker 1: going to get involved whenever you have something like this
- 11:09Speaker 1: with children, especially across state lines. Once it becomes federal
- 11:14Speaker 1: and it moves across state lines... The FBI is well
- 11:17Speaker 1: within their scope to get involved. 9.21 a.m. Wheeler first
- 11:22Speaker 1: saw Chad Daybell leave the home at around 7.30 a.m.
- 11:26Speaker 1: and he walked to his vehicle. Wheeler says he moved
- 11:29Speaker 1: his vehicle to a spot where he had just had
- 11:31Speaker 1: a better location of the pond area. He sat in
- 11:35Speaker 1: this vehicle and was on his phone for quite some time.
- 11:38Speaker 1: Just sat there in his vehicle, Wheeler said. 9.22 a.m.
- 11:43Speaker 1: Wheeler says there were multiple times he saw Chad looking
- 11:46Speaker 1: awkwardly over his shoulder toward where the investigators and cadaver
- 11:50Speaker 1: dogs were working. Chad Daybell is writing on a yellow notepad,
- 11:55Speaker 1: and he just showed it to Pryor. Wheeler continues to
- 11:58Speaker 1: say Chad appeared to be suspicious about something in the
- 12:01Speaker 1: pond area. Yeah, he knew. He knew that the authorities
- 12:05Speaker 1: were on the scent. and he knew that it wouldn't
- 12:08Speaker 1: be long before they found these children's bodies, and that's
- 12:11Speaker 1: because he knew where they were buried. Even if he
- 12:13Speaker 1: didn't do it, he wasn't the one who killed them.
- 12:16Speaker 1: He knew where they were buried, and that's because he
- 12:18Speaker 1: planned it all out with Lori Vallow. Allegedly. 9.24 a.m.
- 12:23Speaker 1: At one point, Chad got out of the vehicle, walked around,
- 12:26Speaker 1: then got back in. He made a phone call and
- 12:29Speaker 1: then drove over to Emma's house. Wheeler says Chad had
- 12:32Speaker 1: a brief conversation outside and then went into her house.
- 12:36Speaker 1: He was inside for an hour, or 90 minutes. 9.25 a.m.
- 12:41Speaker 1: Wheeler says when Chad left the property, he appeared to
- 12:44Speaker 1: be in a hurry. Detectives were assigned to keep an
- 12:47Speaker 1: eye on him, and Wheeler told Detective Schmidt that Chad
- 12:50Speaker 1: was leaving in a vehicle. Other investigators came running over
- 12:54Speaker 1: and said hurry and go stop him. Imagine the audacity
- 12:57Speaker 1: of this clown to try and get away. Let me
- 13:00Speaker 1: just hop in the whip and try and drive away
- 13:02Speaker 1: from this big-ass investigation. as they're excavating my house looking
- 13:06Speaker 1: for bodies. 9.26 a.m. Wheeler says he heard Chad accelerate
- 13:12Speaker 1: and he thought, is he trying to run? Wheeler stopped
- 13:15Speaker 1: Chad around the Fremont-Madison County line. Wheeler asked Chad to
- 13:19Speaker 1: get out of his vehicle and said detectives were on
- 13:22Speaker 1: the way to talk to him. Wheeler says Chad didn't
- 13:25Speaker 1: ask any questions and wasn't shocked or surprised that he
- 13:28Speaker 1: was stopped. 9.28 a.m. Wixom asked Wheeler, If there was
- 13:34Speaker 1: some interaction with Chad, Wheeler says he placed handcuffs on Chad.
- 13:39Speaker 1: He was told he was being detained and Chad was
- 13:42Speaker 1: put in Wheeler's patrol vehicle. Chad was told JJ had
- 13:45Speaker 1: been found. Wheeler says there are three cameras inside his vehicle.
- 13:49Speaker 1: Wixom moves to admit the video footage from the patrol vehicle.
- 13:53Speaker 1: One dash cam inside the vehicle. The other is a
- 13:56Speaker 1: camera recording from outside the vehicle.
- 13:59Speaker 2: 9.32 a.m.
- 14:02Speaker 1: The videos are over an hour long, but only 15
- 14:04Speaker 1: minutes will be played in court. Prosecutors and the defense
- 14:08Speaker 1: each agree they can play whatever portions of the video
- 14:11Speaker 1: that they would like. 9.35 a.m. The video will start
- 14:16Speaker 1: at the 1 hour and 3 minute mark. The clip
- 14:18Speaker 1: comes up on the screen. Chad Daybell is wearing a
- 14:21Speaker 1: baseball cap and a polo shirt. The video shows Chad
- 14:25Speaker 1: in the backseat of the car. Emma, Chad's daughter, comes
- 14:28Speaker 1: up to the side of the car and is crying.
- 14:30Speaker 1: She says I love you so much and gives her
- 14:33Speaker 1: dad a hug. Directly after a body was just found
- 14:36Speaker 1: at a little boy's property. I got news for you.
- 14:39Speaker 1: As much as I love my dad, if somebody pulled
- 14:42Speaker 1: a child's body from his property, we'd have a conversation.
- 14:46Speaker 1: And it wouldn't be me running over there crying and
- 14:49Speaker 1: carrying on talking about how much I love you. I
- 14:52Speaker 1: have some questions, Dad. 9.37 a.m. Wixom asks Wheeler to
- 14:57Speaker 1: explain the position of his vehicle relative to the Daybell property.
- 15:01Speaker 1: Wheeler says he is parked on the south side of
- 15:03Speaker 1: the residence facing west. If you were to look right
- 15:07Speaker 1: outside of that door, you would be looking at his house. 9.39 a.m.
- 15:12Speaker 1: The video continues to play. Chad asks Emma to get
- 15:15Speaker 1: his wallet. Lieutenant Ball asks if he can look through it.
- 15:18Speaker 1: Chad says sure. Chad says Emma will be running his finances.
- 15:23Speaker 1: I suppose. Chad is looking at the screen in the
- 15:25Speaker 1: courtroom as the video is played. Chad tells Emma there
- 15:28Speaker 1: is about $ 9, 000 in a middle drawer in Mark's room.
- 15:33Speaker 1: Must be nice to keep 9Gs just laying around the house.
- 15:35Speaker 2: 9.41 a.m.
- 15:39Speaker 1: Chad tells his daughter the password to his bank account.
- 15:41Speaker 1: He goes through his bank cards with his daughter. He
- 15:44Speaker 1: tells her the company business card is in the same
- 15:46Speaker 1: drawer as the 9Gs. Chad tells Emma that the card
- 15:50Speaker 1: used for Tellmate. Emma says she already has a Tellmate account.
- 15:54Speaker 1: and that she's been talking to Lori on it. Chad
- 15:56Speaker 1: tells Emma he puts $ 30 a week on Lori's commissary.
- 16:01Speaker 1: Emma starts to cry and says, I love you so much.
- 16:04Speaker 1: Chad says, I'm sorry, and tells her to cooperate with
- 16:06Speaker 1: the police as much as she feels. Look, I don't
- 16:09Speaker 1: know these kids, but my guess is they're all into
- 16:12Speaker 1: the same weird shit that their pops was into. You know,
- 16:15Speaker 1: the whole entire cult nonsense. You know, the whole entire
- 16:18Speaker 1: end of the world BS. My guess is these kids
- 16:22Speaker 1: bought right into it if their dad's into it and
- 16:25Speaker 1: they're this close to him.
- 16:26Speaker 2: 9.43 a.m.
- 16:29Speaker 1: Emma says the police have been kind to them that day.
- 16:32Speaker 1: She says she texted John Pryor so he has her number.
- 16:35Speaker 1: She continues to explain financial information to his daughter. Emma
- 16:39Speaker 1: says to her dad that it sounds like he won't
- 16:41Speaker 1: be out for a while. Chad kind of laughs and says, right, yeah,
- 16:45Speaker 1: never again. This dude will never see the sunshine as
- 16:49Speaker 1: a free man again. ever again in my opinion. He
- 16:52Speaker 1: is exactly where he belongs. 1000%, without a doubt, exactly
- 16:58Speaker 1: where he belongs. 9.45am. Wheeler says at this point, Chad
- 17:04Speaker 1: had not been arrested. Emma tells her dad that she
- 17:06Speaker 1: will take care of Mark, her brother, and her and
- 17:09Speaker 1: her dad as best she can. Chad tells Emma to
- 17:12Speaker 1: keep paying the mortgage out of the company account. They
- 17:15Speaker 1: discuss the car payment. Chad says, I'm not coming back. Yeah, well,
- 17:19Speaker 1: that's about the only prophecy that this dude has made
- 17:23Speaker 1: that's going to come true. 9.47 a.m. Chad tells Emma
- 17:27Speaker 1: the house is essentially hers and he will talk to
- 17:30Speaker 1: John Pryor about financial arrangements. He continues to talk about
- 17:34Speaker 1: money and maybe refinancing the house. 9.49 a.m. Emma asks
- 17:39Speaker 1: if things can be sent from Amazon to the jail.
- 17:41Speaker 1: Chad says Lori would know the Amazon account. He says
- 17:44Speaker 1: he has around $ 265 dollars in gift certificates in the
- 17:48Speaker 1: Amazon account. Emma asks the office near the car if
- 17:52Speaker 1: they are leaving things in the home, like the computer.
- 17:55Speaker 1: He says he doesn't know. 9.51 a.m. Chad says it'll
- 17:59Speaker 1: work out. Emma says she's going to miss her dad
- 18:02Speaker 1: so much. Chad says he isn't sure if he's going
- 18:05Speaker 1: to Madison or Fremont County Jail. Chad says he's sure
- 18:09Speaker 1: Fremont has a telemate system so they can talk. Chad
- 18:12Speaker 1: ended up going to Fremont County Jail. Chad says all
- 18:15Speaker 1: the neighbors are going to be talking. Emma says they
- 18:18Speaker 1: already are. She tells her dad, we're okay, dad. We're okay.
- 18:22Speaker 1: You raised us, so we're independent now. I'm not Colby.
- 18:25Speaker 1: Apparently referring to Colby Ryan, Lori's son. Yeah, I'm not
- 18:29Speaker 1: a big fan of Chad Daybell's kids, folks. I'll just
- 18:31Speaker 1: be straight up and clear. And I'm not a fan
- 18:35Speaker 1: of all the other little toads that were running around
- 18:37Speaker 1: with Lori Vallow and Chad Daybell either. I think that
- 18:40Speaker 1: they know a lot more, and in fact, I think
- 18:41Speaker 1: they might have been involved a lot more than we're hearing.
- 18:45Speaker 1: Of course, that's just my speculation, but usually when you
- 18:49Speaker 1: have people who are on the fringes like that, they
- 18:51Speaker 1: have information. And my guess is that the authorities didn't
- 18:55Speaker 1: press charges against some of these people because they turned
- 18:58Speaker 1: state's evidence. 9.53 a.m. Emma and Chad continue to discuss finances.
- 19:04Speaker 1: He tells her that he spoke with Lori for a
- 19:06Speaker 1: few minutes. Emma asked if Lori was surprised, and Chad
- 19:10Speaker 1: says she seemed bothered and disturbed. Emma tells her dad
- 19:14Speaker 1: that she asked police where they found the human remains.
- 19:17Speaker 1: She was told under the tree and there were boards
- 19:19Speaker 1: over it. Chad says, okay. Emma says, I can see
- 19:23Speaker 1: in your face that it surprises you. 9.55 a.m. Emma
- 19:27Speaker 1: says her conversation with the police. She was told one
- 19:31Speaker 1: set of human remains were found and they were looking
- 19:34Speaker 1: for another. Wixom pauses the video after Chad says they're
- 19:38Speaker 1: not searching inside the house. Wheeler confirms the search was
- 19:41Speaker 1: focused on the property. Not inside the home. Yeah, because
- 19:45Speaker 1: they already were on the scent. They knew the deal,
- 19:48Speaker 1: and they knew the general area that they were going
- 19:50Speaker 1: to look in. 9.56 a.m. Emma says she called Mark,
- 19:54Speaker 1: her brother, and told her that her dad was arrested.
- 19:57Speaker 1: Chad says it's all a matter of timing and things
- 20:00Speaker 1: will come together. He says that he loves Emma and
- 20:03Speaker 1: they hug. He says they can talk on Tellmate, Wixom
- 20:07Speaker 1: pauses the video and advances further in the clip. 9.58 a.m.
- 20:12Speaker 1: Wixom plays a short clip and asks Wheeler what direction
- 20:15Speaker 1: Chad is looking. Wheeler says Chad is looking at the
- 20:19Speaker 1: fire pit area and where Tylee's remains were found. Wheeler
- 20:23Speaker 1: says he was asked to transport Chad to the Fremont
- 20:26Speaker 1: County Jail where his mugshot was taken. 10.01 a.m. Wheeler
- 20:31Speaker 1: returned to the Daybell home and began searching in the
- 20:34Speaker 1: fire pit area. Wheeler says he also assisted in setting
- 20:38Speaker 1: up light trailers that evening. Wixom Has no further questions. 10.03 a.m.
- 20:44Speaker 1: Boyce says we will now take a morning recess before
- 20:46Speaker 1: Pryor begins cross-examination. Back in 30 minutes. So we're going
- 20:51Speaker 1: to take a break here too. And then we'll pick
- 20:53Speaker 1: up in the next episode where we left off with
- 20:56Speaker 1: the rest of the morning session of testimony from the
- 21:00Speaker 1: Chad Daybell trial on April 15th. All of the information
- 21:05Speaker 1: that goes with this episode can be found in the
- 21:08Speaker 1: description box. What's up everyone and welcome back to the program.
- 21:12Speaker 1: In this episode we're going to pick up where we
- 21:14Speaker 1: left off with the Chad Daybell trial with Detective Wheeler
- 21:19Speaker 1: on the stand. This article was published by EastIdahoNews.com and
- 21:24Speaker 1: the author is Nate Eaton. 10.33 a.m. We are back
- 21:29Speaker 1: in the courtroom. Chad Daybell is sitting alone at his
- 21:32Speaker 1: table waiting on the attorneys and judge.
- 21:34Speaker 2: 10.44 a.m.
- 21:36Speaker 1: Attorneys are at their table, Judge Boyce is on the bench,
- 21:39Speaker 1: Detective Wheeler remains on the stand, and the jurors will
- 21:43Speaker 1: be brought in. 10.48 a.m. Pryor wants to clarify Wheeler's
- 21:48Speaker 1: role the morning of June 9th. Wheeler says he assisted
- 21:52Speaker 1: in securing the road in front of the property. Pryor
- 21:55Speaker 1: asks how many officers were at the home. Wheeler can't
- 21:58Speaker 1: testify to that, but confirms multiple agencies.
- 22:01Speaker 2: 10.50 a.m.
- 22:03Speaker 1: Pryor asks if any other citizens were at the property.
- 22:06Speaker 1: Wheeler says no. 10.51 a.m. Pryor asking Wheeler about his
- 22:11Speaker 1: body camera. Wheeler confirms he wore a camera that day. 10.53 a.m.
- 22:17Speaker 1: Wheeler explains the events of that morning. Over the course
- 22:21Speaker 1: of that morning, Daybell got into his car, moved it
- 22:24Speaker 1: to the west side of his home, then took it
- 22:26Speaker 1: to the home kitty corner to his property, and then
- 22:29Speaker 1: left southbound.
- 22:29Speaker 2: 10.55 a.m.
- 22:31Speaker 1: Pryor asks Wheeler when Chad was advised remains had been
- 22:35Speaker 1: found on the property. Wheeler says that happened during the
- 22:38Speaker 1: traffic stop. 10.56 a.m. Wheeler confirms Chad was in Emma's
- 22:44Speaker 1: house for around 90 minutes to two hours. Pryor asks
- 22:47Speaker 1: about Chad leaving Emma's house. Pryor asks Wheeler to clarify
- 22:51Speaker 1: Chad speeding off. Pryor asks what the speed limit is
- 22:54Speaker 1: in front of Chad's house. Wheeler says it's 50 miles
- 22:57Speaker 1: per hour. Pryor asks if it would be unusual for
- 23:00Speaker 1: someone to accelerate once they got on the highway. Wheeler
- 23:03Speaker 1: says that would not be unusual. And what Pryor is
- 23:06Speaker 1: trying to say is that it's no big deal that
- 23:08Speaker 1: he was accelerating at a high rate of speed. That's
- 23:11Speaker 1: because he was trying to merge onto the freeway, just
- 23:14Speaker 1: like anybody else would be doing. Well, the difference is
- 23:18Speaker 1: the vast majority of us, and I'm going to say 99.9%
- 23:22Speaker 1: of us, wouldn't be speeding away from a site That
- 23:24Speaker 1: happens to be our home, where a child's remains were
- 23:28Speaker 1: just excavated. So he could try to explain that away
- 23:31Speaker 1: all he wants, but the fact is Chad Daybell was
- 23:34Speaker 1: trying to scoot as these remains were being exhumed. 11 a.m.
- 23:39Speaker 1: Pryor asks about Wheeler's body camera footage. Wheeler doesn't recall
- 23:43Speaker 1: the exact conversation on the video before Chad was taken
- 23:46Speaker 1: into custody. Pryor asks to publish the body camera footage. 11.01 a.m.
- 23:52Speaker 1: We now see the body camera footage. Detective Ball walks
- 23:56Speaker 1: up to Chad and says he is going to be detained.
- 23:59Speaker 1: Chad says something inaudible and Ball responds, your attorney can
- 24:02Speaker 1: now come. 11.02 a.m. Pryor says it appears Mr. Daybell
- 24:08Speaker 1: was in the process to see his lawyer that morning.
- 24:10Speaker 1: Wheeler says he can't testify to that. And look, I
- 24:15Speaker 1: get it. You want some legal advice, right? Why not
- 24:17Speaker 1: have your lawyer come to you, though? You have 17
- 24:20Speaker 1: different agencies at your house. pulling remains of children out
- 24:24Speaker 1: of the ground, and you're trying to leave the property
- 24:27Speaker 1: to go talk to your lawyer? Probably a better idea
- 24:30Speaker 1: to have that lawyer make like a doctor in the
- 24:33Speaker 1: 30s and do a house call. 11.03 a.m. Chad is
- 24:38Speaker 1: then put into handcuffs and placed into the backseat of
- 24:41Speaker 1: Wheeler's car. Wheeler asks at what point Chad was advised
- 24:45Speaker 1: they found the body on his property. Wheeler says it
- 24:48Speaker 1: was right at this time.
- 24:49Speaker 2: 11.05 a.m.
- 24:52Speaker 1: At that point, Chad was put in the back of
- 24:54Speaker 1: the police car and Emma was allowed to talk with him.
- 24:57Speaker 1: Pryor discusses how Chad spoke with Emma about their credit cards,
- 25:01Speaker 1: business accounts, etc. We don't know whether he was doing
- 25:04Speaker 1: that to try to figure out whether he was trying
- 25:07Speaker 1: to post bond. And as much as I hate this
- 25:10Speaker 1: do not, I don't blame him for trying to post bond.
- 25:13Speaker 1: I wouldn't want to spend one second in jail either.
- 25:16Speaker 1: I've said it a million times. Your boy is not
- 25:18Speaker 1: built for that life. Bunch of gross ass, sweaty ass.
- 25:21Speaker 1: Disgusting-ass dudes taking craps all day in front of you.
- 25:25Speaker 1: Everything smells. Everybody's gross. No thank you. 11.06 a.m. Pryor
- 25:30Speaker 1: asks if where Chad parked gave him the best view
- 25:33Speaker 1: of the fire pit and pond. Wheeler says he is
- 25:36Speaker 1: unsure about the pond, but yes, on the fire pit. 11.08 a.m.
- 25:41Speaker 1: Pryor says he's having difficulty understanding why Chad moved his car.
- 25:45Speaker 1: If you have such a good view of the fire
- 25:47Speaker 1: pit and the pond and the tree where JJ was found...
- 25:50Speaker 1: If your purpose is to observe or see what's going
- 25:53Speaker 1: on for some nefarious reason, why would he move? Pryor says.
- 25:57Speaker 1: Wheeler responds that he was told to move by law enforcement.
- 26:00Speaker 1: And what does it matter where he's at watching while
- 26:03Speaker 1: this whole entire thing's being excavated? The fact is he
- 26:07Speaker 1: knows that eventually they're going to find these remains. That's
- 26:11Speaker 1: what he knows. So I have no idea what he
- 26:13Speaker 1: thought he was going to accomplish by sitting around and
- 26:16Speaker 1: staring at the site where the remains were eventually found. 11.10 a.m.
- 26:21Speaker 1: Wheeler says Chad turned his head four to five times
- 26:24Speaker 1: to look where police were working. Pryor says that Chad
- 26:28Speaker 1: didn't run at that point. He went to his daughter's
- 26:30Speaker 1: for 90 minutes to two hours. 11.12 a.m. Pryor asked
- 26:35Speaker 1: Wheeler about the statement Emma made. She said to her
- 26:38Speaker 1: dad that she could tell by his reaction that he
- 26:41Speaker 1: didn't know what was going on out there. 11.13 a.m.
- 26:44Speaker 1: Pryor continues to ask questions about where Chad was looking
- 26:48Speaker 1: that morning. He then asked Wheeler, what time Chad had
- 26:52Speaker 1: been dropped off at the jail. It was around 1245,
- 26:55Speaker 1: according to Wheeler. Pryor asked Wheeler if he had been
- 26:58Speaker 1: on Chad's property before. He says no. Wheeler saw cadaver
- 27:02Speaker 1: dogs on the property that morning. Yo, you know you're
- 27:06Speaker 1: as good as cooked. When the cadaver dogs show up,
- 27:09Speaker 1: if you have a body buried on your property, those
- 27:12Speaker 1: dogs are going to find it. 1115 a.m. Wheeler returned
- 27:15Speaker 1: to the home at 1.30 p.m., After he returned, he
- 27:19Speaker 1: was assigned to help the fire pit area. There were
- 27:22Speaker 1: multiple people at the fire pit, and Wheeler says they
- 27:25Speaker 1: were coming and going. 11.16 a.m. Wheeler says shovels, sifters,
- 27:30Speaker 1: and hand tools were used to dig in the dirt.
- 27:33Speaker 1: Pryor has no further questions. And imagine, again, being one
- 27:37Speaker 1: of these people, one of these guys, gals, whatever, out
- 27:40Speaker 1: there digging with their hands, these sifters, looking for the
- 27:43Speaker 1: remains of these children. I can't even put it into words.
- 27:47Speaker 1: How disturbing that is. And honestly, I'm grateful that there's
- 27:51Speaker 1: people out there that are willing to do this job.
- 27:53Speaker 1: Because it's not a job that I'd be willing to do.
- 27:56Speaker 1: It's bad enough that we talk about this stuff on
- 27:58Speaker 1: a regular basis. Never mind digging through the dirt, looking
- 28:02Speaker 1: for the remains of these children. I mean, I'd find
- 28:05Speaker 1: some bones or something. And forget arresting you. I'd go
- 28:08Speaker 1: Vic Mackey on your ass and beat the living shit
- 28:11Speaker 1: out of you. So I have a lot of respect
- 28:13Speaker 1: for the people that can do this job and remain professional.
- 28:16Speaker 1: Because I'm telling you right now, I would not be
- 28:18Speaker 1: able to. 11.19 a.m. Wixom will ask some redirect questions.
- 28:24Speaker 1: He begins by asking about someone getting nervous during a
- 28:27Speaker 1: typical traffic stop. Wheeler says most people get a little
- 28:31Speaker 1: nervous during traffic stops. Well, that sounds about right. Nobody
- 28:35Speaker 1: wants to get pulled over and nobody certainly wants to
- 28:38Speaker 1: pay some fine. So yeah, people are usually nervous when
- 28:41Speaker 1: they get pulled over. And I'm guessing you're a lot
- 28:44Speaker 1: more nervous when you get pulled over after a child's
- 28:46Speaker 1: body has been dug up on your property. I'd say
- 28:49Speaker 1: that there's some nerves. 11.20 a.m. In your experience, if
- 28:53Speaker 1: someone is about to be discovered in a crime, about
- 28:57Speaker 1: to be caught in a crime, have you ever experienced
- 29:00Speaker 1: someone just acknowledging that and surrendering because they are caught,
- 29:03Speaker 1: Wixom says? Wheeler says it's common for suspects to try
- 29:07Speaker 1: and distance themselves Well, yeah, nobody wants to get caught, right?
- 29:11Speaker 1: Everybody wants to get away with it. If they wanted
- 29:13Speaker 1: to get caught, they'd go and turn themselves in right
- 29:16Speaker 1: after the crime. 11.22 a.m. Wixom follows up on the
- 29:20Speaker 1: speed issue that Pryor brought up earlier. He asks if
- 29:24Speaker 1: someone who had bodies buried on their property might accelerate
- 29:27Speaker 1: quickly to get away from the property. Wheeler says yes. Yeah,
- 29:31Speaker 1: you would think. Time to put the pedal to the
- 29:33Speaker 1: metal and get out of Dodge. Or I guess in
- 29:36Speaker 1: this case, out of Rexburg. 11.23am. Wixom asks Wheeler if
- 29:41Speaker 1: any of Tylee's remains were buried in the Pet Cemetery.
- 29:45Speaker 1: Wheeler can't testify exactly where the remains were in the
- 29:48Speaker 1: fire pit area. 11.25 a.m. Wixom follows up the question
- 29:53Speaker 1: about shovels and tools used to recover Tylee's remains. Wheeler
- 29:57Speaker 1: says the majority of what he did was on his
- 30:00Speaker 1: hands and knees, using brushes to remove portions of dirt
- 30:04Speaker 1: away from the mass that was found. 11.27 a.m. Wheeler
- 30:08Speaker 1: says he found a portion of a skull, flesh, and
- 30:11Speaker 1: other bones in a bucket, melted. Other than JJ and Tylee,
- 30:15Speaker 1: no other human remains were found on the property. So
- 30:19Speaker 1: it's not like they can say, oh, we were burying
- 30:21Speaker 1: our relatives here, and not like that would even work
- 30:23Speaker 1: because of DNA. So... All of a sudden, these kids
- 30:28Speaker 1: are found dead and buried on your property as you're
- 30:31Speaker 1: accelerating at a high speed away from the site? Yeah,
- 30:35Speaker 1: nobody has any questions for you, Stunod. You're not going
- 30:38Speaker 1: to prison, dumbass. 11.23 a.m. Wixom asks Wheeler if any
- 30:44Speaker 1: of Tylee's remains were buried in the pet cemetery. Wheeler
- 30:47Speaker 1: can testify exactly where the remains were in the fire
- 30:51Speaker 1: pit area. 11.29 a.m. Wheeler says all conduct by law
- 30:57Speaker 1: enforcement in recovering the remains that morning was careful. Pryor
- 31:00Speaker 1: objects to Wixom questions and Boyce calls for a sidebar.
- 31:04Speaker 1: All the attorneys leave the courtroom. 11.32 a.m. Boyce is
- 31:09Speaker 1: back on the bench and the attorneys have returned. 11.33 a.m.
- 31:14Speaker 1: Wixom asks a question and Pryor objects, then asks for
- 31:17Speaker 1: a sidebar with the judge. All the attorneys leave the
- 31:20Speaker 1: courtroom again with Boyce. Wixom has tried to bring up
- 31:24Speaker 1: the term. consciousness of guilt, twice and prior as opposed
- 31:27Speaker 1: to it. 1134 AM. Boyce says the question is struck
- 31:32Speaker 1: from the record. Wixom says he has a few more questions.
- 31:36Speaker 1: So a little bit of a win there for Chad Daybell,
- 31:39Speaker 1: for once, considering all the L's this dude has piled up.
- 31:43Speaker 1: At least he got a little bit of a win
- 31:44Speaker 1: there by having the comment struck from the record. Unfortunately
- 31:49Speaker 1: for Daybell, that's like blowing your nose in the middle
- 31:52Speaker 1: of having Ebola. Sure, it feels good for a little instant,
- 31:55Speaker 1: and then you realize, well, I still have Ebola. 11.35 a.m.
- 32:01Speaker 1: Wixom asked Wheeler to clarify that he was not directly
- 32:04Speaker 1: involved in recovering JJ's remains. He was not, but made observations.
- 32:09Speaker 1: The only time Wheeler saw law enforcement go into the
- 32:12Speaker 1: house was at the beginning of the day. All of
- 32:15Speaker 1: the search was happening outside the property.
- 32:17Speaker 2: 11.37 a.m.
- 32:20Speaker 1: Wixom again asks Wheeler where Chad was looking while in
- 32:22Speaker 1: the driveway. Wheeler says he was looking toward the fire pit.
- 32:26Speaker 1: Wixom has no further questions. Pryor has some follow-ups. 11.38 a.m.
- 32:32Speaker 1: Pryor asks Wheeler if he spoke to any other law
- 32:35Speaker 1: enforcement during the break. Wheeler says he did not. Pryor
- 32:39Speaker 1: asks about Chad leaving when he learned about the remains
- 32:42Speaker 1: being found on his property. Wheeler explains when he left
- 32:46Speaker 1: It was from Emma's residence shortly after Wheeler learned JJ's
- 32:49Speaker 1: body had been found. 1140 a.m. Pryor asks if Chad knew,
- 32:55Speaker 1: at that point, that he left Emma's house if Chad
- 32:59Speaker 1: had been told anything about the remains being found. Wheeler
- 33:02Speaker 1: says at that point Chad likely would not have known.
- 33:05Speaker 1: 1141 a.m. Wheeler's testimony is concluded. Pryor and Wixom say
- 33:10Speaker 1: Wheeler may be recalled later in the trial. 1142 a.m.
- 33:15Speaker 1: The next witness is Fremont County Lieutenant Joe Powell. 1144 a.m.
- 33:22Speaker 1: Powell has been at the Sheriff's Office for 22 years.
- 33:25Speaker 1: Wixom asks Powell if his role includes getting involved with
- 33:29Speaker 1: unattended deaths. Powell says yes. An unattended death is when
- 33:33Speaker 1: someone discovers someone's death. There's nobody around when it happens.
- 33:38Speaker 1: 1146 a.m. Wixom asks about the morning Tammy Daybell died.
- 33:42Speaker 1: October 19th, 2019. Powell was notified of Tammy's death by
- 33:48Speaker 1: a deputy. On October 31, 2019, Powell got a call
- 33:52Speaker 1: from law enforcement in Arizona inquiring about Tammy Daybell's death.
- 33:57Speaker 1: They asked for a copy of the death report. 11.47 a.m.
- 34:01Speaker 1: Powell reviewed the report and requested Tammy's medical records. He
- 34:05Speaker 1: sent the information to Gilbert Police. Gilbert also asked Powell
- 34:10Speaker 1: if they could locate the gray Jeep Wrangler with Texas plates.
- 34:13Speaker 1: They told him they believe the Jeep was in Fremont
- 34:16Speaker 1: County and it was involved in an attempted shooting. 11.48 a.m.
- 34:22Speaker 1: Gilbert gave Powell the names of Alex Cox and Lori Vallow,
- 34:25Speaker 1: or Jamie and Circe Lannister, whichever way you want to
- 34:28Speaker 1: go with that. They told him that they might have
- 34:30Speaker 1: ties to Chad Daybell. Powell drove to Chad's house on
- 34:34Speaker 1: October 31, 2019. The Jeep wasn't there and Powell notified Gilbert.
- 34:39Speaker 1: The next day, Powell got an email asking if he
- 34:42Speaker 1: could check some more addresses about the Jeep. One of
- 34:45Speaker 1: the addresses was the P.O. Box in Sugar City. Another
- 34:48Speaker 1: was Lori's apartment in Rexburg. 11.50 a.m. Powell proceeded to
- 34:55Speaker 1: do surveillance on Lori's apartment. They saw Chad leave the
- 34:58Speaker 1: apartment on Pioneer Road the morning of November 1, 2019.
- 35:04Speaker 1: Powell consulted with Rexburg police as Lori's apartment was in Rexburg. 11.52 a.m.
- 35:11Speaker 1: Powell followed Chad from the apartment to Mountain American Credit Union.
- 35:15Speaker 1: They lost him after that, so they went back to
- 35:18Speaker 1: Lori's apartment. They saw Lori leave and go to the
- 35:21Speaker 1: post office in Sugar City. She then went to Walgreens.
- 35:25Speaker 1: Chad and Lori then leave the apartment to a credit
- 35:28Speaker 1: union in Idaho Falls, followed by Hobby Lobby and Cafe Rio.
- 35:32Speaker 1: Hobby Lobby, is it? Why am I not shocked?
- 35:34Speaker 2: 11.54 a.m.
- 35:37Speaker 1: Powell saw Lori and Chad holding hands as they walked
- 35:40Speaker 1: into Hobby Lobby. A photo was taken and Wixom asked
- 35:43Speaker 1: to admit the picture. Pryor objects to the image. Boyce
- 35:47Speaker 1: overrules that objection. The photo is shown on the screen.
- 35:51Speaker 1: Powell says Chad and Lori held hands the entire time
- 35:54Speaker 1: they walked in. Meanwhile, those kids are dead. And these two,
- 35:59Speaker 1: Scafusa and Stunad, are living their best life. Helicopters, volcanoes.
- 36:04Speaker 2: 11.57 a.m.
- 36:07Speaker 1: After Chad and Lori left Cafe Rio, they drove to
- 36:10Speaker 1: Cafe Rio. Powell and Chief Deputy Sean Garner went inside.
- 36:15Speaker 1: Wixom asked to admit a photo of Chad and Lori
- 36:17Speaker 1: eating inside Cafe Rio.
- 36:20Speaker 2: Noon.
- 36:21Speaker 1: We are now taking a lunch break. We will be
- 36:23Speaker 1: back at 1 p.m. So that signals for us that
- 36:26Speaker 1: we're going to take a break as well. And in
- 36:28Speaker 1: the next episode, we'll finish up our recap of what
- 36:31Speaker 1: went down at the Chad Daybell trial on day number three.
- 36:36Speaker 1: All of the information that goes with this episode can
- 36:38Speaker 1: be found in the description box. What's up, everyone, and
- 36:42Speaker 1: welcome back to the program. In this episode, we're getting
- 36:45Speaker 1: right back to the recap of the Chad Daybell trial
- 36:49Speaker 1: and what went down on day number three. This article
- 36:53Speaker 1: was published by EastIdahoNews.com, and the author, once again, is
- 36:58Speaker 1: Nate Eaton. 1.02 p.m. We are back in the courtroom.
- 37:02Speaker 1: Pryor is sitting next to Chad Daybell. Boyce is on
- 37:05Speaker 1: the bench. Rob Wood and Ingrid Beatty are at the
- 37:08Speaker 1: prosecutor's table. Rocky Wixom will continue questioning Lieutenant Joe Powell.
- 37:13Speaker 1: Larry and Kay Woodcock are inside the courtroom today. So
- 37:17Speaker 1: is Vicki Hoban, Tammy Daybell's aunt.
- 37:21Speaker 2: 1.05 p.m.
- 37:22Speaker 1: Jurors are in their seat. Lindsay Blake joins the prosecutor's table.
- 37:26Speaker 1: Wixom picks up the Gilbert call he received about Tammy
- 37:29Speaker 1: Daybell's death. 1.10 p.m. Wixom moves to admit an exhibit.
- 37:35Speaker 1: Powell testifies that Chad told the deputy that Tammy didn't
- 37:39Speaker 1: go to the doctor very often, and the last time
- 37:41Speaker 1: she had been to the doctor was two months prior
- 37:44Speaker 1: for an arm injury. Powell ran her name through law
- 37:48Speaker 1: enforcement prescription program to find out if Tammy was on
- 37:51Speaker 1: any medicine. She was on tramadol, and she had been
- 37:55Speaker 1: prescribed fluoxetine and antidepressant. That kind of runs counter to
- 38:00Speaker 1: what the kids and Chad said, right? That she never
- 38:03Speaker 1: went to the doctor? Well, she went to the doctor
- 38:05Speaker 1: for her arm being hurt. Leads me to believe that
- 38:08Speaker 1: if she had anything seriously wrong with her, all of
- 38:11Speaker 1: these maladies that Chad Daybell was saying she had, that
- 38:15Speaker 1: she would have went to the doctor. Yeah, I have
- 38:17Speaker 1: this chronic cough I can't get rid of for three years,
- 38:21Speaker 1: but I'm not going to go to the doctor. I
- 38:23Speaker 1: hurt my arm? Oh, I better go to the doctor.
- 38:25Speaker 1: Does that make sense to anybody out there? 1.14 p.m.
- 38:30Speaker 1: Wixom asked the court to admit an exhibit. Part of
- 38:33Speaker 1: it's not legible. Boy sidebars with attorneys. White noise is
- 38:36Speaker 1: played in the courtroom. 1.18 p.m. Attorneys are back. Wixom
- 38:42Speaker 1: publishes the exhibit. It shows Tammy's medical records from Teton
- 38:46Speaker 1: Medical Group. Powell says when dealing with unattended death cases,
- 38:50Speaker 1: it's typical to get medical records. Powell says Tammy's past
- 38:54Speaker 1: medical history is pretty normal, other than depression. Well, you're
- 38:58Speaker 1: married to Chad Daybell. You're out here being the breadwinner,
- 39:01Speaker 1: working hard every day to put food on the table.
- 39:04Speaker 1: And this dude's writing fantasy stories about the end of
- 39:07Speaker 1: the world and running off with the skafooza Lori Vallow. Yeah,
- 39:13Speaker 1: I would say depression is certainly on the way. 1.19 p.m.
- 39:16Speaker 1: Powell requested Tammy's records for two years. Wixom asked to
- 39:20Speaker 1: publish the season's medical record. We see the record on
- 39:23Speaker 1: the screen. She was being seen for depression and nothing else.
- 39:27Speaker 1: She appeared to be healthy, so I got a warrant.
- 39:30Speaker 1: for exhumation, Powell says. And this is where it's really
- 39:33Speaker 1: going to get tricky for Chad Daybell when it comes
- 39:36Speaker 1: to Tammy Daybell. She wasn't sickly like he said. Now
- 39:40Speaker 1: they might want to infer that, and his kids might
- 39:42Speaker 1: want to run cover for him. But there's no evidence
- 39:45Speaker 1: pointing us in that direction, saying that, oh yeah, Tammy was,
- 39:49Speaker 1: you know... Sick all the time. She had all these problems.
- 39:53Speaker 1: In fact, the record shows us something different. 1.22 p.m.
- 39:58Speaker 1: Powell said he worked with the court in Utah and
- 40:01Speaker 1: had Tammy exhumed. Wixom asked to approach. The attorneys go
- 40:05Speaker 1: to the judge's chambers. Daybell is scrolling on his laptop. 1.27 p.m.
- 40:11Speaker 1: Attorneys are back and Wixom asked to admit more exhibits.
- 40:15Speaker 1: Wixom asked Powell what kind of things they look for
- 40:17Speaker 1: to make sure There hasn't been any tampering at the
- 40:20Speaker 1: site of an exhumation. Powell says at the gravesite where
- 40:24Speaker 1: Tammy's casket was pulled from the ground.
- 40:26Speaker 2: 1.28 p.m.
- 40:30Speaker 1: Wixom shows images on the screen. The first one shows
- 40:33Speaker 1: the backhoe getting ready to dig at the gravesite in Springville.
- 40:36Speaker 1: We see another photo of the cement vault being lifted
- 40:39Speaker 1: out of the ground and another photo showing the casket
- 40:43Speaker 1: under the cement lid. Powell didn't see any tampering. 1.30 p.m.
- 40:48Speaker 1: The casket was loaded into a hearse and taken to
- 40:51Speaker 1: the medical examiner's office in Utah. Powell followed the body
- 40:55Speaker 1: to the office and observed the autopsy. We now see
- 40:58Speaker 1: an autopsy photo of Tammy Daybell. 1.32 p.m. Powell explains
- 41:04Speaker 1: that he served a warrant on Chad's home in January 2020.
- 41:08Speaker 1: He helped collect electronic devices and take them to the
- 41:12Speaker 1: Fremont County Sheriff's Office.
- 41:14Speaker 2: 1.33 p.m.
- 41:16Speaker 1: Chad did not react when the photo of his dead
- 41:18Speaker 1: wife was displayed on the screen. Of course he didn't react.
- 41:22Speaker 1: He doesn't care. Let's just be very clear, okay? This
- 41:26Speaker 1: man maliciously killed his wife. And I think that's what
- 41:29Speaker 1: the evidence has pointed to for this whole entire time.
- 41:33Speaker 1: And now it's just getting slammed home. This is like
- 41:36Speaker 1: showing up with a receipt, right? And that's what the
- 41:39Speaker 1: prosecution is doing. And for Chad Daybell, forget it. He
- 41:43Speaker 1: has no out here. His only hope is that there
- 41:45Speaker 1: was some kind of prosecutorial misconduct along the way that
- 41:49Speaker 1: he can, you know, hang his hat on and hope
- 41:52Speaker 1: that he gets a mistrial or later on for an appeal.
- 41:55Speaker 1: But besides that, this dude is cooked. 1.34 p.m. Pryor
- 41:59Speaker 1: will now conduct cross-examination. Vicki Hoban, Tammy Day-Belzant, is wiping
- 42:04Speaker 1: her eyes and nose with a tissue. Boyce asks for
- 42:07Speaker 1: a sidebar with attorneys. 1.39 p.m. Boyce mentions Tammy's death
- 42:12Speaker 1: certificate and was admitted but never published. Pryor begins to
- 42:17Speaker 1: question Powell and is reminded, once again, to speak into
- 42:20Speaker 1: his microphone.
- 42:22Speaker 2: 1.40 p.m.
- 42:23Speaker 1: Pryor asks if Powell has any camera in his car
- 42:27Speaker 1: or a body camera. Powell says no. Pryor says it's
- 42:30Speaker 1: important to get the facts right from the witnesses so
- 42:33Speaker 1: cameras could be helpful. It's a tool you use to
- 42:35Speaker 1: make sure everybody is playing on the same page. Would
- 42:39Speaker 1: you agree with that, Pryor asks? Powell agrees. Again, looking
- 42:42Speaker 1: for some kind of technicality to sink their teeth into. Oh,
- 42:46Speaker 1: he didn't have a body camera on. This, that, the
- 42:48Speaker 1: other thing. But the reality is this. You're going to
- 42:51Speaker 1: have to explain how those children were found buried on
- 42:54Speaker 1: your property. And then you're going to have to explain
- 42:57Speaker 1: all the other bullshit. So good luck, pal. 1.42 p.m.
- 43:03Speaker 1: Pryor asked about the call Powell received from Gilbert police.
- 43:07Speaker 1: Pryor explains Powell received information about Alex Cox and Lori
- 43:11Speaker 1: Vallow and the shooting involving Brandon Boudreau. Pryor says as
- 43:16Speaker 1: part of Powell's surveillance, he was able to establish a
- 43:18Speaker 1: relationship between Lori and Chad. Powell says yes. 1.44 p.m. Pryor,
- 43:25Speaker 1: what's suspicious about two single people going to Hobby Lobby
- 43:29Speaker 1: or going out to eat? Powell says it's not suspicious. Well,
- 43:32Speaker 1: when they're supposed to have kids, and those kids are
- 43:34Speaker 1: nowhere to be found, I'd say that's a bit suspicious, no?
- 43:38Speaker 1: Where did these kids go? Did you drop them off
- 43:41Speaker 1: at the bounce factory? Are they hanging out with Jesse Pinkman?
- 43:46Speaker 1: Where are these kids at? Nobody knows. And that's because
- 43:49Speaker 1: these kids were dead. So maybe it's not suspicious for
- 43:52Speaker 1: two single people with no kids to be doing what
- 43:55Speaker 1: Valo and Daybell were doing. But when you have children,
- 43:59Speaker 1: probably going to have those kids around a little bit, no?
- 44:01Speaker 1: So that's a bit suspicious to me. 1.47 p.m. Pryor
- 44:07Speaker 1: shows the Teton medical record on the screen. He points
- 44:10Speaker 1: out that anemia is listed on the medical record. Pryor
- 44:14Speaker 1: points out anxiety and depression are also on the record. 1.49 p.m.
- 44:19Speaker 1: Pryor points out the family history listed on Tammy's record.
- 44:23Speaker 1: Pryor now shows another exhibit, Tammy Daybell's death certificate. He
- 44:27Speaker 1: asks Powell if he looked at her death certificate. Powell
- 44:30Speaker 1: says he did not.
- 44:31Speaker 2: 1.50 p.m.
- 44:34Speaker 1: Powell says Tammy Daybell's children were never notified their mother
- 44:37Speaker 1: was being exhumed. Back to the certificate. The cause of
- 44:41Speaker 1: death says cardiac event and pulmonary edema. Pryor points out
- 44:45Speaker 1: Tammy's father has a history of heart issues. So again,
- 44:50Speaker 1: inferring that this was a natural death, that Tammy just
- 44:53Speaker 1: had all of these issues that were not documented by
- 44:57Speaker 1: her doctor, by the way, and that it was because
- 45:00Speaker 1: of these issues that Tammy ended up dead. Meanwhile, back
- 45:03Speaker 1: here in reality, 1.52 p.m. You went to a judge
- 45:07Speaker 1: to have her dug out of the ground, and you
- 45:09Speaker 1: didn't even once look at the certificate of death, Pryor asks?
- 45:12Speaker 1: Powell responds, nope. 1.53 p.m. Pryor shows another exhibit and
- 45:19Speaker 1: asks Powell to read from the screen. This is a
- 45:22Speaker 1: report of what Chad said happened the morning Tammy died.
- 45:25Speaker 1: He says Tammy had a coughing fit and vomited. She
- 45:29Speaker 1: went to sleep and died, according to Chad, 1.56 p.m.
- 45:33Speaker 1: Chad told investigators Tammy did not have any serious medical conditions.
- 45:37Speaker 1: The last time she was at the doctor was approximately
- 45:40Speaker 1: two months prior when she had fallen in the driveway
- 45:43Speaker 1: after hurting her arm. Chad said Tammy had been feeling
- 45:47Speaker 1: sick and been going through menopause. 1.57 p.m. Pryor points
- 45:52Speaker 1: out Tammy used herbal medicines and untraditional treatments instead of
- 45:56Speaker 1: going to the doctor when she was sick. Most of
- 45:59Speaker 1: what was in her cupboard was was essential oils and
- 46:02Speaker 1: natural medicines. Well, if that's the case, why didn't she
- 46:06Speaker 1: just use one of those natural oils or one of
- 46:08Speaker 1: those medicines on her busted-ass arm? Oh, that's because if
- 46:13Speaker 1: she has something seriously wrong with her, she's going to
- 46:15Speaker 1: the doctor. So save the rest of that BS for
- 46:17Speaker 1: somebody else. 1.58 p.m. Pryor asks about bruises on Tammy's
- 46:23Speaker 1: body at the time she passed away. Powell says he
- 46:26Speaker 1: was aware of bruises. Pryor asks if they were old bruises.
- 46:30Speaker 1: Powell doesn't recall. Pryor says Tammy was clearly taking medication
- 46:34Speaker 1: for bruising. Powell responds, that's what the report says. 2 p.m.
- 46:40Speaker 1: Chad also told the coroner his wife was having seizures.
- 46:44Speaker 1: Their daughter, said Tammy, was taking clogging classes and had
- 46:47Speaker 1: slowed down lately. You didn't take that into consideration when
- 46:50Speaker 1: you decided to dig Tammy up, did you? Pryor asks.
- 46:54Speaker 1: Powell says no. Well, was she having those seizures because
- 46:57Speaker 1: she was being poisoned over a period of time? So
- 47:00Speaker 1: all of these questions that Pryor has can be answered
- 47:03Speaker 1: with another question directed directly back at Chad Daybell. 2.02 p.m.
- 47:09Speaker 1: Pryor lists the medical conditions Tammy was having and confirms
- 47:12Speaker 1: with Powell that he didn't take these items into consideration
- 47:16Speaker 1: before digging Tammy from the ground. Powell confirms he did not.
- 47:19Speaker 1: Pryor is done questioning. but intends to bring him back
- 47:22Speaker 1: during the defense portion of the trial. 2.04 p.m. Wixom
- 47:27Speaker 1: has follow-up questions. He asked Powell if at the time
- 47:31Speaker 1: of the exhumation he was aware the kids were missing.
- 47:34Speaker 1: Powell says yes. Wixom says Powell if he was aware
- 47:38Speaker 1: Chad and Lori were together at the time of the exhumation.
- 47:41Speaker 1: Powell says yes, Lori and Chad were holding hands at
- 47:45Speaker 1: Hobby Lobby 12 days after Tammy died. Now who the
- 47:48Speaker 1: hell's strolling around Hobby Lobby with their gumad after their
- 47:52Speaker 1: wife just died 12 days ago? Well, Stunad Daybell, that's who.
- 47:58Speaker 1: And the audacity of this moron to actually think he
- 48:01Speaker 1: was going to get away with this shit. 2.07pm. Chad
- 48:06Speaker 1: Daybell did not want an autopsy on his wife. Wixom
- 48:09Speaker 1: asks if there were other factors surrounding the decision for
- 48:12Speaker 1: the exhumation. Powell says all the deaths surrounding Lori Vallow
- 48:16Speaker 1: were a factor. 2.08 p.m. Wixom says despite what was
- 48:21Speaker 1: in the deputy's report, did other facts lead Powell to
- 48:24Speaker 1: seek the exhumation order? Powell says yes. 2.10 p.m. Powell
- 48:28Speaker 1: says Lori and Chad were together four to six hours
- 48:31Speaker 1: on November 1st, 2019. Powell never saw any children with
- 48:36Speaker 1: the couple. Wixom says Has no further questions. Pryor asks
- 48:40Speaker 1: for further questions. Boyce says as long as it's very
- 48:43Speaker 1: limited in scope.
- 48:45Speaker 2: 212.
- 48:46Speaker 1: Pryor asks if Powell is aware that Chad is not
- 48:48Speaker 1: implicated in the murder of Charles Vallow and the attempted
- 48:51Speaker 1: murder of Brandon Boudreau. Powell says he's aware of that.
- 48:55Speaker 1: Pryor asks because of these other deaths, how does that
- 48:58Speaker 1: give Powell the right to dig up Tammy Daybell? Powell
- 49:01Speaker 1: says it's because of all the other information. Pryor has
- 49:05Speaker 1: nothing further.
- 49:05Speaker 2: 213 p.m.
- 49:08Speaker 1: Towel is done on the stand, but may be recalled.
- 49:11Speaker 1: We are now taking an afternoon break. Be back in
- 49:14Speaker 1: 30 minutes. 2.44 p.m. We are back in the courtroom.
- 49:20Speaker 1: All the attorneys are at their tables and Chad is
- 49:22Speaker 1: chatting with John Pryor. 2.45 p.m. Boyce says there has
- 49:26Speaker 1: been an issue with some people who attended the trial today.
- 49:29Speaker 1: It involved the jury and those people are not permitted
- 49:32Speaker 1: back in the courtroom. He reminds everyone of the courtroom
- 49:35Speaker 1: conduct order. So yeah, if you're outside of the conduct order,
- 49:39Speaker 1: You're going to get tossed, and you might face other
- 49:42Speaker 1: sanctions as well, depending on what sort of behavior you
- 49:45Speaker 1: are engaging in.
- 49:46Speaker 2: 2.48 p.m.
- 49:49Speaker 1: Jurors are in their seats. State calls Nicole Heidemann to
- 49:53Speaker 1: the stand. She is an FBI tactical specialist. She also
- 49:57Speaker 1: testified in Lori Vallow's trial. 2.50 p.m. Heidemann has worked
- 50:02Speaker 1: for the FBI for 16 years. She became involved in
- 50:05Speaker 1: the missing kid case in early 2020. She was assigned
- 50:09Speaker 1: to research data and phone attribution. Phone attribution is meant
- 50:13Speaker 1: to determine the likely primary user of a phone number. 2.52 p.m.
- 50:19Speaker 1: Lindsay Blake is questioning Heidemann. Blake asked to admit a
- 50:22Speaker 1: PowerPoint presentation prepared by Heidemann. 2.54 p.m. The presentation shows
- 50:29Speaker 1: the phone attribution of Chad, Lori, and Alex. Chad had
- 50:33Speaker 1: nine phone numbers, three of interest. Lori had six, three
- 50:36Speaker 1: of interest. Chad had six phone numbers, three of interest. 2.56 p.m.
- 50:43Speaker 1: This research was done between October 2018 and January 2020.
- 50:48Speaker 1: Blake displays one of Chad's phone numbers and there are
- 50:51Speaker 1: nine items of interest under the number. The number was
- 50:54Speaker 1: subscribed to Tammy Daybell. It was listed as contact number
- 50:57Speaker 1: for Chad in a Hawaii rental agreement. It was saved
- 51:01Speaker 1: in Tammy's phone as Chad. It was associated with Chad's
- 51:04Speaker 1: Gmail account and it was listed as Bishop Shumway. in
- 51:07Speaker 1: the Lori for Style iCloud account. It was also saved
- 51:11Speaker 1: as contact dad in Seth Daybell's phone. Bishop Shumway. More
- 51:16Speaker 1: like Bishop Stunad. Bishop Jerkoff. Bishop Moron. 2.59pm. Blake asks
- 51:23Speaker 1: Heideman how she does her research to determine numbers are legitimate.
- 51:27Speaker 1: She explains how she does her research, and Blake shows
- 51:30Speaker 1: another phone number on the screen associated with Chad. It
- 51:34Speaker 1: was activated in 2018 and deactivated in January 2019. It's
- 51:40Speaker 1: saved as Melanie2 in LoriForStyle iCloud account. The next phone
- 51:44Speaker 1: number was activated the same day the prior number expired,
- 51:48Speaker 1: January 31st, 2019. It was saved as contact Janie in
- 51:53Speaker 1: LoriForStyle iCloud account. 3.02 PM. The next phone number was
- 51:57Speaker 1: saved as contact Bobby in the LolliTime iCloud account, Lori's account.
- 52:03Speaker 1: The number called the Valley of the Sun Mortuary on
- 52:05Speaker 1: July 11th, 2019. It was Chad who called. On August 11th, 2019,
- 52:11Speaker 1: Chad's birthday, Lori sent a text of kisses. It was
- 52:14Speaker 1: saved as Shumway in the Lori for Style account. And folks,
- 52:18Speaker 1: you're just getting a little glimpse here of how ridiculous
- 52:21Speaker 1: these people are. Wait until this progresses a little bit
- 52:24Speaker 1: and you hear some more of the evidence. You're going
- 52:26Speaker 1: to leave this episode... and this trial shaking your head
- 52:29Speaker 1: and wondering how these people could be not only this stupid,
- 52:34Speaker 1: but this evil. 3.04 p.m. The last number was first
- 52:39Speaker 1: identified in connection to Alex Cox. The contact was saved
- 52:42Speaker 1: in the Lori for Style iCloud account as Bishop Miller. 3.05 p.m.
- 52:47Speaker 1: There are a lot of cell phones in this investigation.
- 52:50Speaker 1: Heidemann says two numbers were listed in white on the
- 52:53Speaker 1: screen and three other numbers listed in yellow. Heidemann says
- 52:56Speaker 1: the yellow numbers are particularly relevant in the trial. 3.07 p.m.
- 53:01Speaker 1: Heidemann says there are a lot of numbers and a
- 53:03Speaker 1: lot of aliases associated with people in the investigation. Heidemann
- 53:08Speaker 1: explains some texts that were sent to different numbers. 3.10 p.m.
- 53:13Speaker 1: Heidemann details a phone number that was used for Legion
- 53:16Speaker 1: Airline reservations and other purposes. The next number appeared in
- 53:20Speaker 1: various places within the investigation. It was subscribed to Lori
- 53:24Speaker 1: Vallow and associated with the Lolly Time and Lori for
- 53:29Speaker 1: Style iCloud accounts. 3.13 p.m. Heidemann reads the next number
- 53:35Speaker 1: into the record. She now focuses on the main three
- 53:37Speaker 1: numbers in the investigation. 3.15 p.m. Heidemann now explaining the
- 53:43Speaker 1: phone numbers attributed to Alex Cox. She talks about the
- 53:47Speaker 1: relevant information she found on these numbers that connect Alex
- 53:51Speaker 1: to the case.
- 53:51Speaker 2: 3.17 p.m.
- 53:54Speaker 1: Blake asks to approach. The attorneys go back into chambers
- 53:57Speaker 1: with the judge. 3.22 p.m. Blake says the exhibit is
- 54:02Speaker 1: finished but has more for the witness. She says this
- 54:05Speaker 1: would be a logical stopping point for the day. The
- 54:07Speaker 1: exhibit is admitted. Tomorrow court will run from 8.30 to 3.30,
- 54:12Speaker 1: but a motion will be taken up at 1 p.m.
- 54:15Speaker 1: outside of the jury's presence.
- 54:18Speaker 2: 3.23 p.m.
- 54:19Speaker 1: Court is adjourned until tomorrow. All right, folks, so there
- 54:23Speaker 1: you have it, a recap of day number three at
- 54:26Speaker 1: the Chad Daybell trial. And after today's proceedings, after we
- 54:31Speaker 1: get the testimony in and we hear what went down,
- 54:33Speaker 1: I'll get it all added to the catalog and we'll
- 54:35Speaker 1: just keep it rolling. But until then, that's going to
- 54:39Speaker 1: do it for this one. All of the information that
- 54:41Speaker 1: goes with this episode can be found in the description box.
