Transcript
- 0:00Speaker 1: What's up everyone and welcome back to the program. In
- 0:03Speaker 1: this episode, we're going to spin back up to Moscow
- 0:06Speaker 1: and we're going to talk a little bit more about
- 0:08Speaker 1: Brian Kohlberger and his latest legal moves. And now we're
- 0:12Speaker 1: hearing that he's trying to get Judge Hippler thrown off
- 0:15Speaker 1: the case. And if you've been following along for any
- 0:18Speaker 1: period of time, you know why. Judge Hippler has not
- 0:22Speaker 1: played Brian Kohlberger's game and Kohlberger hates the fact that
- 0:25Speaker 1: he's not in control. So he's making the move now
- 0:29Speaker 1: to try and get Hippler removed. And I don't know
- 0:34Speaker 1: if he's going to be successful with this little stunt
- 0:36Speaker 1: of his. And I think that the court in Idaho
- 0:41Speaker 1: is going to tell him to get stuffed. So today,
- 0:44Speaker 1: in this episode, we're going to talk a little bit
- 0:46Speaker 1: more about Brian Kohlberger and his attempt to remove Judge
- 0:49Speaker 1: Hippler from the case. This article was published by the
- 0:53Speaker 1: New York Post. Headline, Brian Kohlberger seeks judge's removal, an
- 0:58Speaker 1: escalating bid, to undo guilty plea for killing four Idaho students.
- 1:03Speaker 1: This article was authored by Louis Cassiano. And I'm telling
- 1:09Speaker 1: you right now, as soon as this Lindsay Clancy case ends,
- 1:12Speaker 1: wait for the crazies to show up. The Karen Reid
- 1:15Speaker 1: effect is in full swing, and the crazies are going
- 1:18Speaker 1: to be looking for the next person to try and spring.
- 1:21Speaker 1: And I'm telling you right now, I fully expect the
- 1:24Speaker 1: Candace crazies and the Karen Reid wine ant brigade to
- 1:27Speaker 1: show up. And they're going to show up talking a
- 1:30Speaker 1: bunch of shit about things they have no idea about,
- 1:33Speaker 1: like usual. The problem for them, though, is that there
- 1:36Speaker 1: wasn't a shoddy investigation done up here. And the evidence
- 1:40Speaker 1: is what it is. And as much as I didn't
- 1:42Speaker 1: like Karen Reid, if you remember, I told you that
- 1:45Speaker 1: there's no way to convict her. When you have an
- 1:48Speaker 1: investigation as bad as that investigation was up in Canton,
- 1:51Speaker 1: how can you convict beyond a reasonable doubt? You can't.
- 1:55Speaker 1: But that's not the case here. We've been through the
- 1:59Speaker 1: evidence over the years, and we continue to go through it.
- 2:02Speaker 1: So we're not talking about red Solo cups that were
- 2:05Speaker 1: used for evidence collection, right? We're talking about a thorough
- 2:08Speaker 1: investigation that included the FBI BAU. You know, the unit
- 2:14Speaker 1: that the show Mindhunter was based on? Yeah, those guys.
- 2:18Speaker 1: They were involved. And I'm not a big fan of
- 2:20Speaker 1: the FBI, as you well know. But when it comes
- 2:22Speaker 1: to this kind of work, there's nobody better. The FBI
- 2:26Speaker 1: knows exactly what they're doing. and the analysts that they have,
- 2:30Speaker 1: and the people that create profiles, are the best in
- 2:33Speaker 1: the business. So I honestly welcome the crazies to show
- 2:36Speaker 1: up here, because their nonsense is going to be easy
- 2:39Speaker 1: to just decimate. Brian Kohlberger, the man convicted of fatally
- 2:44Speaker 1: stabbing four University of Idaho students, is asking a court
- 2:48Speaker 1: to disqualify the judge in his case, and is asked
- 2:51Speaker 1: for a change of venue as he attempts to take
- 2:53Speaker 1: back his guilty plea. This dirty son of a bitch
- 2:56Speaker 1: has already had one change of venue. Where does he
- 2:59Speaker 1: want to change it back to? Back down to Moscow? Yeah,
- 3:02Speaker 1: let's go back down to Moscow. Change a venue to
- 3:04Speaker 1: the fucking Mars. Probably the only place where jurors aren't
- 3:08Speaker 1: going to hate you. And probably even there. We have
- 3:11Speaker 1: some fucking aliens who've been watching the news who know
- 3:14Speaker 1: that Brian Kohlberger is a piece of shit. Motions for
- 3:17Speaker 1: both requests were filed Thursday by Kohlberger's new court-appointed attorney,
- 3:21Speaker 1: Gregory Rausch. The move came after Kohlberger was convicted of
- 3:25Speaker 1: first-degree murder. I haven't looked at these filings yet, because
- 3:29Speaker 1: I was out late last night at the UNLV game.
- 3:32Speaker 1: We lost, by the way. Not very much fun. So
- 3:35Speaker 1: I haven't really had time to dive into those court
- 3:38Speaker 1: filings yet, but I'm going to later on today. And
- 3:42Speaker 1: we'll get those added to the catalog as well. Kohlberger
- 3:47Speaker 1: has since claimed he's innocent and has blamed his defense
- 3:49Speaker 1: team for leading him to take or make a false confession.
- 3:53Speaker 1: The motions are asking for 4th Judicial District Judge Stephen
- 3:57Speaker 1: Hippler to be disqualified for Kohlberger's post-conviction court proceedings and
- 4:01Speaker 1: for the hearings to be moved out of Ada County.
- 4:04Speaker 1: The motion to disqualify Hippler questions his impartiality. It questions
- 4:10Speaker 1: his impartiality? Give me a break, dude. You got every
- 4:13Speaker 1: single thing you asked for. The fact that the judge
- 4:17Speaker 1: ruled against you doesn't imply that he's impartial. It implies
- 4:21Speaker 1: that the evidence is stacked against you, stupid. I can't
- 4:27Speaker 1: wait for everybody to tell me that because Brian Kohlberger
- 4:30Speaker 1: had autism that he can't be responsible for what he did.
- 4:34Speaker 1: Fuck out of here. That sort of shit is going
- 4:36Speaker 1: to be met with extreme mockery and extreme sarcasm. Now,
- 4:40Speaker 1: if you want to talk about his conditions, then cool.
- 4:44Speaker 1: During mitigation, when we're talking about the penalty phase. But
- 4:48Speaker 1: as far as anything else, I don't want to hear it.
- 4:51Speaker 1: This man knew exactly what he was doing. He planned this.
- 4:54Speaker 1: He premeditated it. Then he carried it out. So if
- 4:58Speaker 1: you want to call him crazy or insane, cool, I agree.
- 5:01Speaker 1: But he certainly knew what he was doing. The motion
- 5:04Speaker 1: does not rest upon one adverse ruling, one harsh statement,
- 5:08Speaker 1: or the mere fact that the judge who presided over
- 5:10Speaker 1: Brian Kohlberger's criminal case has been assigned to his post-conviction proceeding.
- 5:15Speaker 1: The motion states, Oh yeah, everything was lined up against Kohlberger.
- 5:23Speaker 1: Mainly the evidence. Nobody was looking to screw Kohlberger over.
- 5:28Speaker 1: Dude had three years. Could have taken the stand. Could
- 5:31Speaker 1: have at any point told us his side of the story.
- 5:34Speaker 1: Never did any of that. Instead, he got up there
- 5:38Speaker 1: like a little pussy and admitted that he killed these people.
- 5:42Speaker 1: But he didn't go into detail. He didn't give us motive.
- 5:45Speaker 1: He didn't tell us why he did it. Instead, he
- 5:49Speaker 1: got up there and said, yes, I plead guilty, blah, blah, blah.
- 5:53Speaker 1: He should have been forced. to give a throaty-ass confession.
- 5:56Speaker 1: And if he didn't want to do that, cool. See
- 5:58Speaker 1: you at trial, bro. We have the evidence. And then
- 6:02Speaker 1: after the trial, after you've been convicted, enjoy having your
- 6:06Speaker 1: date with the firing squad. Because that was this buffoon's fate.
- 6:10Speaker 1: That's why Ann Taylor and Alyssa Massoth and the legal
- 6:13Speaker 1: team told him that he should plead. And it's going
- 6:17Speaker 1: to be the same thing with Tyler Robinson. Mark my words.
- 6:20Speaker 1: I highly doubt that gets to trial. The evidence is
- 6:23Speaker 1: so stacked against them that they're going to do everything
- 6:26Speaker 1: in their power just to try and get them off
- 6:28Speaker 1: the death penalty. And if that means he has to
- 6:32Speaker 1: plead guilty, that's what he's going to do. Although, I
- 6:36Speaker 1: don't know if the state of Utah is going to
- 6:38Speaker 1: play that game. They got a lot of evidence, folks.
- 6:42Speaker 1: A lot of evidence. Now, of course, we're very early
- 6:44Speaker 1: in the process, right? So there's still a lot of
- 6:47Speaker 1: things that can pop up. There's some inconsistencies over there.
- 6:50Speaker 1: And there's a lot of questions that still need to
- 6:51Speaker 1: be answered. But at this point, they have a lot
- 6:55Speaker 1: of evidence stacked against this dude. And with all the
- 6:58Speaker 1: discovery that they've already passed over to his team, forget it.
- 7:02Speaker 1: And it's kind of the same deal that we saw
- 7:03Speaker 1: with Kohlberger, right? Very similar. Very contentious back and forth
- 7:08Speaker 1: between the state and the defense. Huge amount of discovery.
- 7:12Speaker 1: And then the defense has to go through all that discovery.
- 7:16Speaker 1: And that's pretty much where we're at right now. The
- 7:18Speaker 1: defense is going through it all and trying to figure
- 7:20Speaker 1: out what helps and what hurts. Although his original criminal
- 7:26Speaker 1: trial was relocated to Ada County in 2024 to ensure
- 7:30Speaker 1: an impartial jury and adequate resources, his lawyers argue those
- 7:34Speaker 1: concerns are irrelevant to a bench proceeding decided solely by
- 7:38Speaker 1: a judge. So let's spend more money, more taxpayer dollars,
- 7:42Speaker 1: on giving Brian Kohlberger what he wants? This man is
- 7:46Speaker 1: a convicted murderer, okay? Not accused, not maybe. Convicted. He
- 7:53Speaker 1: admitted to murdering these four kids. So what the fuck
- 7:57Speaker 1: are we even doing here? No, you're not getting a
- 7:59Speaker 1: venue change. You'll sit in front of Judge Hippler and
- 8:02Speaker 1: he'll make a decision. And if you don't like that decision,
- 8:04Speaker 1: you can go above him, appeal it, maybe go to
- 8:06Speaker 1: the Supreme Court of Idaho, whatever the steps are. But
- 8:09Speaker 1: we don't need a new judge and we damn well
- 8:11Speaker 1: don't need a new venue. Kohlberger, 31, last year pleaded
- 8:15Speaker 1: guilty to four counts of first-degree murder and a felony
- 8:18Speaker 1: burglary charge for the 2022 stabbing deaths of University of
- 8:22Speaker 1: Idaho students Madison Mogan, Kaylee Gonsalves, Zanna Kernodle, and Ethan Chapin. However,
- 8:29Speaker 1: Kohlberger is now asking to be granted a trial, even
- 8:32Speaker 1: though he could possibly face the death penalty. Bro had
- 8:36Speaker 1: a little taste of prison and is not a big fan.
- 8:39Speaker 1: That's really what it comes down to. And plus he's
- 8:41Speaker 1: trying to, you know, cause as much damage to the
- 8:44Speaker 1: families as he can. And he's doing a pretty good
- 8:48Speaker 1: job of it. Because imagine waking up and finding out
- 8:51Speaker 1: that this piece of shit is might get a new trial,
- 8:54Speaker 1: that this son of a bitch has a chance to
- 8:55Speaker 1: beat this rap, I'd be pissed. In fact, you wouldn't
- 8:59Speaker 1: be able to shut me up. The central pillar of
- 9:02Speaker 1: the motion to remove the judge rests on the constitutional
- 9:05Speaker 1: adequacy of the trial counsel's preparation. Defense lawyers argued the
- 9:10Speaker 1: capital trial schedule made it impossible to review the massive
- 9:13Speaker 1: amount of evidence in the case. Wrong. Sorry. Had plenty
- 9:18Speaker 1: of time to do it. Plenty of time to go
- 9:20Speaker 1: through that evidence. And if you need to hire other
- 9:22Speaker 1: people to help you then do that. The state was
- 9:25Speaker 1: paying for it anyway. The defense cautioned the court that
- 9:29Speaker 1: forcing it to proceed to trial under those conditions threatened
- 9:32Speaker 1: Kohlberger's constitutional right to effective representation. You know what? The
- 9:38Speaker 1: state has a right to a speedy trial too. And
- 9:41Speaker 1: the people? They deserve justice. And Brian Kohlberger was given
- 9:45Speaker 1: every opportunity to bring in specialists, to argue his case,
- 9:50Speaker 1: and to show the court that he had standing either
- 9:54Speaker 1: be found innocent or at the very least not get
- 9:57Speaker 1: the death penalty and he was unable to do that,
- 10:00Speaker 1: time and time again, motion after motion. Hippler rejected the
- 10:05Speaker 1: defense claims that it was unprepared for trial, accusing it
- 10:09Speaker 1: of using the massive volume of discovery as a tactic
- 10:11Speaker 1: for delay, rather than a genuine concern, and I agree. Like,
- 10:17Speaker 1: there has to be deadlines, right? You can't just forever
- 10:20Speaker 1: go through discovery and be like look there's a lot
- 10:22Speaker 1: of it so you know it's going to take us
- 10:23Speaker 1: forever what does that even mean once that discovery gets
- 10:28Speaker 1: to you it's up to you to go through it
- 10:32Speaker 1: and believe me if they didn't turn over this much
- 10:35Speaker 1: evidence this much discovery then the conversation would have been
- 10:37Speaker 1: about brady violations but the result would be the same
- 10:43Speaker 1: brian kolberger would be crying foul and saying that he
- 10:46Speaker 1: needs a new trial LaMotion also refers to Hippler's statement
- 10:49Speaker 1: during sentencing, which he made pronouncements regarding Kohlberger's ability to
- 10:53Speaker 1: tell the truth. Do we really believe, after all of this,
- 10:56Speaker 1: he is capable of speaking the truth, he said according
- 10:59Speaker 1: to the document? Well, I doubt it. But when it
- 11:04Speaker 1: comes to pleading guilty, he's pleading guilty. The evidence all
- 11:08Speaker 1: points to him, nobody else, and he takes... Credit for it? Okay,
- 11:11Speaker 1: you're guilty, dude. See you in fucking prison. The judge
- 11:14Speaker 1: also called Koberger a faceless coward and the worst of
- 11:17Speaker 1: the worst. Well, what do you call somebody who murders
- 11:19Speaker 1: four kids while they're sleeping? I think a faceless coward
- 11:25Speaker 1: is a toned down version of what I would have
- 11:27Speaker 1: called them. Those statements are fundamentally different from believing Koberger
- 11:31Speaker 1: committed terrible crimes or deserved severe punishment. The motion states,
- 11:35Speaker 1: there are forward-looking judgments about his credibility and credibility is
- 11:39Speaker 1: may now be at the center of this proceeding. Yo,
- 11:41Speaker 1: that's hilarious. Brian Kohlberger is going to talk about credibility?
- 11:44Speaker 1: This motherfucker has as much credibility as an obese person
- 11:48Speaker 1: at a buffet. The fuck do you even mean, homie? Credibility.
- 11:53Speaker 1: The move to change the venue asked the court to
- 11:55Speaker 1: relocate the proceeding from Ada County, where Kohlberger pleaded guilty
- 11:59Speaker 1: and was sentenced, to Latah County, where the murders occurred.
- 12:02Speaker 1: You know, the place where he said he couldn't get
- 12:04Speaker 1: a fair trial, where he wasn't going to get a
- 12:05Speaker 1: fair shake? But now, now, things will be fairer. Transfer
- 12:10Speaker 1: is warranted in a case like this where the convenience
- 12:12Speaker 1: of witnesses and the ends of justice would be promoted
- 12:16Speaker 1: by the change, the motion states. So, look, that's a
- 12:20Speaker 1: lot to unpack, right? And I knew it was coming
- 12:23Speaker 1: as far as the request, but it's pretty ridiculous. And
- 12:28Speaker 1: I have a funny feeling that the court in Idaho
- 12:30Speaker 1: is going to feel the same way. But, as always,
- 12:34Speaker 1: we'll keep an eye on things. And when we have
- 12:36Speaker 1: some more information one way or the other, we'll get
- 12:38Speaker 1: it added to the catalog. All the information that goes
- 12:41Speaker 1: with this episode can be found in the description box.
