- 0:00Speaker 1: Disturbing new reporting today about that deadly ICE shooting in
- 0:04Speaker 1: Maine is raising enormous questions about the agency's vetting and
- 0:09Speaker 1: training processes. As we reported on Monday, an ICE officer
- 0:13Speaker 1: shot and killed a twenty six year old Columbian national
- 0:16Speaker 1: named Joan Sebastian Guerrero in his car near his home.
- 0:20Speaker 1: Guerrero was not actually the target of an ICE warrant,
- 0:24Speaker 1: according to the officials briefed by the Department of Homeland Security,
- 0:28Speaker 1: and the Associated Press has new reporting today about the
- 0:31Speaker 1: officer who shot him, with several of the officer's own
- 0:35Speaker 1: close relatives telling the AP that the officer is quote
- 0:38Speaker 1: an Army veteran who has struggled with serious mental health
- 0:42Speaker 1: issues since early childhood and never should have been given
- 0:46Speaker 1: a badge and gun to patrol American streets. That reporting,
- 0:50Speaker 1: according to the AP, is based on conversations with the
- 0:53Speaker 1: man's ex wife and two daughters who spoke on the record,
- 0:57Speaker 1: and another ex wife and an immediate family man who
- 1:00Speaker 1: spoke on condition of anonymity. ICE did not confirm the
- 1:04Speaker 1: officer's identity to the AP, and the officer did not
- 1:07Speaker 1: respond to text messages or an email seeking comment. The
- 1:10Speaker 1: ap writes that the officer quote told his ex wife
- 1:14Speaker 1: late last year that he had been hired by ICE.
- 1:17Speaker 1: She said that because of his long history of psychiatric issues,
- 1:22Speaker 1: she thought he was having a mental health episode and
- 1:26Speaker 1: she didn't believe him. She later spoke with CBS News.
- 1:32Speaker 2: I didn't realize that he was actually working for ICE
- 1:34Speaker 2: until a yesterday, and I was completely shocked, because I'm like,
- 1:38Speaker 2: how do you keep getting into these jobs where you're
- 1:41Speaker 2: around guns all the time. I told him that I
- 1:43Speaker 2: was not going to lie for him, that I've waited
- 1:46Speaker 2: years to speak my truth. I've been silenced long enough,
- 1:48Speaker 2: and now I need to come out with everything because
- 1:52Speaker 2: a man lost his life. So it was abuse not
- 1:55Speaker 2: only to me but to our daughter, and even being
- 1:58Speaker 2: divorced from him, I've delt with harassment, phone calls, threats
- 2:02Speaker 2: of him wanting to kill me.
- 2:06Speaker 1: Joining me now to discuss is Brad Lander. He is
- 2:09Speaker 1: the former New York City Controller. He is the Democratic
- 2:11Speaker 1: nominee for Congress in New York's tenth district. So, Brad,
- 2:17Speaker 1: I want to ask you about what you think the reporting. Thus,
- 2:22Speaker 1: Fart tells us about the training that is being given
- 2:27Speaker 1: to ICE ations and the vetting processes.
- 2:29Speaker 3: For that matter, I think it tells us two important things.
- 2:31Speaker 3: I mean, there's not much training or vetting. They've hired
- 2:34Speaker 3: up twelve thousand new agents, and it's clear that they're
- 2:37Speaker 3: not doing the background checks, that they're not providing the training.
- 2:40Speaker 3: The other thing is, though, that a culture of cruelty
- 2:43Speaker 3: and violence is part of what they're cultivating. They clearly
- 2:48Speaker 3: want officers who are willing to act in cruel ways
- 2:52Speaker 3: and to threaten people. The cruelty, in many ways is
- 2:55Speaker 3: the point they want to scare people, have them afraid,
- 2:58Speaker 3: and they're communicating to these offens is that there is
- 3:00Speaker 3: not really accountability.
- 3:02Speaker 1: Yeah, there's not really accountability. It seems like they're in
- 3:05Speaker 1: a real hurry to get any warm body they can
- 3:08Speaker 1: into these positions, and either they don't care or maybe
- 3:12Speaker 1: they're even selecting on the fact that, you know, people
- 3:14Speaker 1: want these jobs under this administration.
- 3:16Speaker 3: You do in something and the federal government's going to lie
- 3:19Speaker 3: and say, you know, the victim caused it, even though
- 3:23Speaker 3: there's no evidence of that if you didn't have your
- 3:25Speaker 3: body camera on.
- 3:26Speaker 1: So what?
- 3:27Speaker 3: In immigration court, I've seen folks like throw people to
- 3:31Speaker 3: the ground and then just be back the next day.
- 3:34Speaker 1: Okay, So, speaking of immigration court, you have been regularly
- 3:37Speaker 1: visiting immigration court despite being arrested a couple of times.
- 3:41Speaker 1: You recently met two boys, as I understand it, who
- 3:44Speaker 1: have been separated from their parents, who are being held
- 3:47Speaker 1: in iced attention with little or maybe no access to
- 3:50Speaker 1: legal counsel. Can you tell us a little bit about
- 3:52Speaker 1: their story.
- 3:52Speaker 3: So the last two weeks, I've been in a docke
- 3:54Speaker 3: that's for detained kids. These are kids who maybe their
- 3:57Speaker 3: parents are here, they crossed with a different relation relatives,
- 4:00Speaker 3: so if they were detained, they're put in custody with
- 4:03Speaker 3: the Office of Refugee Resettlement or ARR. But that has
- 4:06Speaker 3: gone up dramatically. There are many more detained children, more
- 4:10Speaker 3: than twice as many than there were during the Biden administration,
- 4:14Speaker 3: and the length of time they're being separated from their
- 4:16Speaker 3: parents has grown. I was in court two weeks ago.
- 4:19Speaker 3: There was the case of a three year old girl
- 4:22Speaker 3: who our government has separated from her mother for ten months.
- 4:26Speaker 3: Her mom is going through immigration proceedings, but the whole
- 4:30Speaker 3: point is that she's supposed to be able to sponsor
- 4:32Speaker 3: to get her daughter out, because while they're awaiting finding
- 4:35Speaker 3: out whether they'll be able to stay here or not.
- 4:38Speaker 3: What government on earth would separate a three year old
- 4:41Speaker 3: from her mom. Yeah, And then this week there was
- 4:44Speaker 3: one twelve year old boy who didn't have a lawyer,
- 4:48Speaker 3: didn't have a child advocause.
- 4:49Speaker 1: He just went up.
- 4:50Speaker 3: He was brought in. He's in a shelter. He's like,
- 4:53Speaker 3: that's how where he's being kept while he's separated from
- 4:55Speaker 3: his mom, who's also in New York City. He goes
- 4:59Speaker 3: up and sits at the witness desk and the judge
- 5:02Speaker 3: is talking to him through an interpreter, telling him, here's
- 5:04Speaker 3: your asylum application to fill out. He's twelve years old,
- 5:07Speaker 3: he doesn't speak English. And then there was this one
- 5:11Speaker 3: sixteen year old who they called his dad in to
- 5:15Speaker 3: fill out the sponsor paperwork to try to get him out,
- 5:17Speaker 3: but it was a trick. It was Ice and not arr.
- 5:20Speaker 3: He came in for the interview. Ice detained his father,
- 5:23Speaker 3: like used his son as an abduction trap.
- 5:27Speaker 1: So, yeah, as a trap as bait. Essentially, what is
- 5:33Speaker 1: the government's possible excuse rationale for doing something like keeping
- 5:40Speaker 1: a three year old girl from her mom for months
- 5:44Speaker 1: when they are both here and the mom is not
- 5:47Speaker 1: in detention or isn't it.
- 5:48Speaker 3: Mom is not in detention, she's in immigration proceeding, so
- 5:51Speaker 3: she may not be allowed to stay. But no the mom.
- 5:53Speaker 1: So what possible rationale can read in that case?
- 5:56Speaker 3: What they said is that the mom's boyfriend has an
- 6:00Speaker 3: ex girlfriend who lodged a domestic violence But I mean,
- 6:05Speaker 3: so therefore we keep this three year old girl separated
- 6:07Speaker 3: from her mom for ten months? I mean, really, cruelty
- 6:11Speaker 3: is the only explanation.
- 6:14Speaker 1: I also want to ask you about what's going on
- 6:17Speaker 1: with these arrests at these courthouses. So one thing that
- 6:22Speaker 1: has been striking that you've been observing an immigration court
- 6:26Speaker 1: and that others have been reporting on, is that people
- 6:30Speaker 1: are filing their paperwork, they're showing up for their court dates.
- 6:32Speaker 1: They're getting arrested anyway. As I understand it, there was
- 6:36Speaker 1: a federal court decision that says that at least in
- 6:40Speaker 1: Manhattan ICE ICE agents cannot actually arrest people under these
- 6:46Speaker 1: conditions in the courthouse, and they're doing it anyway. It's
- 6:49Speaker 1: happened like six or seven.
- 6:50Speaker 3: Times despite the order of a federal judge, Judge Costel.
- 6:54Speaker 1: So why is it still happening?
- 6:56Speaker 3: I mean, for a year they were doing it lawlessly,
- 6:58Speaker 3: and it turned out they knew they were doing it lawlessly.
- 7:01Speaker 3: The US Attorney for the Southern District, actually Jay Clayton,
- 7:03Speaker 3: who's now up to be the head of National Intelligence.
- 7:07Speaker 3: He had to come forth to the judge and say,
- 7:09Speaker 3: your honor, the memo we were relying on does not apply.
- 7:12Speaker 3: It never applied. And so Judge Costell said, WHOA, no
- 7:15Speaker 3: more arrests.
- 7:16Speaker 1: In these courthouses.
- 7:17Speaker 3: People need to know they can come to the courthouse
- 7:20Speaker 3: for their case without being grabbed in the hallway. But still, yes,
- 7:23Speaker 3: ICE has done seven or eight arrests in the hallways
- 7:26Speaker 3: despite a direct federal order not to do them.
- 7:30Speaker 1: I also want to ask you about something that DHS
- 7:33Speaker 1: Secretary Mark Wayne Mallin has said today. He said that
- 7:36Speaker 1: any calls to turn down the temperature regarding ICE enforcement
- 7:39Speaker 1: apply only to the media, not to ICE officers. Let's
- 7:43Speaker 1: listen to that.
- 7:47Speaker 3: Did you mentioned turning down the temperature?
- 7:49Speaker 4: What assurance can you hear, American Ice Office?
- 7:54Speaker 3: If you good by data.
- 7:57Speaker 1: Use of Force College.
- 7:58Speaker 4: When I say turned down the temperature? Were I turned
- 8:00Speaker 4: out the temperature with you? Guys? We're turning up the
- 8:03Speaker 4: heat on the streets. We're out there working harder than
- 8:06Speaker 4: we ever had because we've empowered our law enforcement to
- 8:11Speaker 4: do their job. What I'm trying to do is remove
- 8:14Speaker 4: us from the headlines every single day, but everybody will
- 8:17Speaker 4: be held accountable.
- 8:23Speaker 1: A thing to say, after we've had two deaths, two
- 8:26Speaker 1: shooting deaths.
- 8:27Speaker 3: They killed two people that were not even the people
- 8:30Speaker 3: they were looking to peacefully arrest. Presumably even the people
- 8:33Speaker 3: they were looking for only committed civil offenses. But these
- 8:37Speaker 3: two people they weren't looking for at all. They shot
- 8:39Speaker 3: them to death. And he blames the media.
- 8:42Speaker 1: Yeah, he blames the media, says, you know, keep us
- 8:45Speaker 1: out of the headlines, let us act with impunity.
- 8:47Speaker 3: And it's important to know that, you know, well over
- 8:49Speaker 3: half more like seventy and some states eighty percent of
- 8:52Speaker 3: people in niced attention have no criminal charges whatsoever.
