- 1:56I got I got some text I wanted to get to from the show yes
- 2:00yesterday, and some other things that are on the mind of Dave it's a
- 2:02scary place to be, and so we're going to give that a little bit
- 2:06later on. I want to welcome to the show though this morning, Michael
- 2:08Sholz, who was a candidate for spot of the West Virginian Intermediate Court of
- 2:13Appeals. Good morning, sir, how are you. Good morning, Dave.
- 2:15I am doing greats yourself. I'm doing fine. Thank you for being
- 2:19here. It's my pleasure. Yeah. And the full disclosure, not the
- 2:23first time you've been on the radio. You're a radio guy. I am
- 2:27a radio guy. I'd like to well, I have a face made for
- 2:30believe me. Please, voters don't hold that against him, that he's a
- 2:32radio guy. Right, but I do have the scary mind of which you
- 2:36speak. Yes, indeed, indeed, let me get into explaining. I'll
- 2:40let you explain it. The Estate's Intermediate Court of Appeals. Give us the
- 2:46kind of the brief overview of how that came into being. What exactly is
- 2:49the role of the Intermediate Court of Appeals. You know, the Intermediate Court
- 2:52of Appeals has actually only been in existence up and running since July one,
- 2:57twenty twenty two. The legislature as the legislation that spring of twenty twenty one
- 3:02that established the court. It's a three judge court and since it's gone live
- 3:07July one, twenty twenty two, it hears four different types of appeals.
- 3:15Primarily, Number one is civil appeals. Civil matters that are tried at the
- 3:20circuit court level, they are now appealed to the Intermediate Court of Appeals.
- 3:23You have family law matters, family law, most family there are some that
- 3:28go straight to the Supreme Court, but most family law matters that are before
- 3:30family law judges now go to the intermediate state of Intermediate Court of Appeals.
- 3:36You have workers' compensation claims that go up on appeal. Those go to the
- 3:39Intermediate Court. And the fourth category, and it's the smallest of the four,
- 3:44are appeals from administrative agencies al J's government agency appeals. So it's it's
- 3:53a court that wish only want to al Jays administrative law judge. Okay.
- 3:58So for instance, if you were trying to get unemployment compensation benefits, where
- 4:02you go before a grievanceport because you're a state employee and you don't like the
- 4:06decision that's made. Eventually, if you go up the appeal chain, you're
- 4:11going to reach the intermediate Court of Appeals. And while it's only been around
- 4:15up and running for about a year and a half, and it's only been
- 4:18an existence since the legislation has been passed a little over two years ago,
- 4:23this has been an idea that was kicked around since two thousand oughts about a
- 4:28fifteen year journey odyssey effort to make this intermediate court of reality. So give
- 4:33us a bio. Tell us who is Michael Schulz. I am a lawyer,
- 4:40Believe it or not, I'm a litigator. The way I describe what
- 4:44I do as I say, you know all the people who advertise on TV
- 4:46and on bus stops and all that I go against them. So I'm a
- 4:51trial lawyer. But I'm a defense trial lawyer and have been my entire career
- 4:56over thirty one years. I'm a little unusual in that I w I wasn't
- 5:00born and raised in West Virginia. I was born and raised in Milwaukee,
- 5:02Wisconsin. I came to Charleston, West Virginia, right out of law school,
- 5:06took my first job here in Charleston, and I have never looked back.
- 5:11I've spent my entire career here, well over half my life, and
- 5:15I can't say I was born and raised a proud mountaineer, but I chose
- 5:18to come here, and I chose to stay here. I've had many opportunities
- 5:24to leave, but I chose to stay here. Raised two wonderful daughters,
- 5:28the younger of which will be graduating from WVU in just a few weeks.
- 5:31And that's who I am. I have experience. I've litigated throughout the state
- 5:38of West Virginia, Eastern Panhandle, Northern Panhandle, spent a lot of time
- 5:42in Ohio County, Brook County, Marshall County, over in Berkeley County,
- 5:46the southern part of the state. At the beginning of my career, I
- 5:49was all over southern West Virginia. Talked about the new Para mar restore down
- 5:53in Whitesville. Yea, I'm like, I know that I've been through in
- 5:56Whitesfield, trust me, and it's that experience is why I'm running. It's
- 6:01part of the reason that I'm running because I don't think there's anybody who could
- 6:05possibly put in for this court, for this position that's going to have the
- 6:12breadth and depth of my experience in terms of litigation. I've got to get
- 6:15Michael Scholes again, who is a candidate for the Estate's Intermediate Court of Appeals.
- 6:19I liked what you said there, Michael, about you know you're not
- 6:23from West Virginia. A friend of mine. I'm not even sure who it
- 6:27was. I've heard other people say it who said I'm not from West Virginia.
- 6:30But I got here as quickly as I could. But you had an
- 6:32opportunity, as you said, many opportunities to go other places, but you
- 6:35chose to stay in West Virginia. And I know this hays absolutely nothing to
- 6:40do with your campaign, but I like hearing this every now and then.
- 6:42What is it about West Virginia that made Michael Scholes say, Hey, I
- 6:46may be from Milwaukee, but this is where I choose to be. What
- 6:48was number one? Number two, and number three are the people I could
- 6:55have? In fact, I had a job offer in two places come out
- 6:58of law school. When was in Charleston, West and one was in Washington,
- 7:00d C. And I went for interviews to both and it was the
- 7:04people not only that I met at the firm where I eventually joined, but
- 7:09also just the people around as I was walking around trying to figure out because
- 7:14coming out of law school, you're gonna work hard, and I'm going to
- 7:16work long hours. Where do I want to be when I'm not working.
- 7:19Do I want to spend an hour and a half on a metro or on
- 7:24a bus trying to get home, or do I want to spend that time
- 7:27out and about in the community, getting involved in the community. And that's
- 7:30what brought me here initially, and that is what has kept me here all
- 7:35this time. I mean, I made sure as soon as I got here.
- 7:39For instance, me and two friends started to coach youth sports teams because
- 7:43we're a big sports guy, and that got us involved in the community,
- 7:46even before we had kids, before we put down deep roots that got us
- 7:50kind of into the community. I was on the board of Junior Achievement for
- 7:54a long time when I had just moved here. That got me deeply involved.
- 7:58And that's a commitment to the community that I've carried throughout my career to
- 8:03this point. And it's all because of the people. Love the people in
- 8:07West Virginia. And when I bring people or I talk to people or clients
- 8:11or friends who come to the Charleston family members, to be blunt, They're
- 8:15like, Wow, the people here are incredible. I'm like, yeah,
- 8:18we have a bad rap in terms of reputation nationally, including as lawyers,
- 8:22because you know we're just country bumpkins, right, yes, and I just
- 8:26I let that stereotype fester until the point where you know what, we know
- 8:31what we're doing. We're good, we may be kind, but don't sell
- 8:33us short because we are astute, we're smart, and we're very capable.
- 8:39But Dave Haland show on five, any line brought to you apartment about husband's

- 8:48Michael. Campaigning for any judicial position in West Virginia can be a little bit
- 8:52difficult, or at least different, I'll say, than the other positions and
- 8:56offices. You know you aren't allowed to directly solicit camp funds, the positions
- 9:01are nonpartisan. What is your plan for the campaign? You know, you're
- 9:03right, it is different, and it's different in addition for this seat because
- 9:07number one is the state wide race and number two it's never been done before.
- 9:13This is the first time that a seat on the Intermediate Court of Appeals
- 9:16has come open. So my plan is to is to get out and visit
- 9:22the state. I am the immediate past chair of the Board for Leadership West
- 9:28Virginia, which is a statewide leadership program class of twenty fifteen, best class
- 9:31ever. But go ahead and if there are any Leadership West Virginia people who
- 9:37were listening, they know exactly what you mean. And so I've gotten to
- 9:43meet people. I plan to tap into that network all around the state and
- 9:48set up meet and greats throughout the state. I'm also the currently the President
- 9:52elect of the Defense Trial Council of West Virginia, which again the Board for
- 9:58Defense Trial Council, and the members of that organization are all over the state.
- 10:03In addition, I have practiced all over the states, so I've met
- 10:05people. So my plan is I may not be able to outraise, and
- 10:11of course I can't ask directly, I would have people. May not be
- 10:13able to outraise people. What I think I bring is I have networks of
- 10:18people that I know I've interacted with professionally as part of these organizations all over
- 10:22the state, and I plan to just get out and meet people and kind
- 10:26of explain as I'm doing here today, my experience, what I bring to
- 10:31the job, the importance of this court, which I think is vitally important.
- 10:33And there's an education element to that because a lot of people are not
- 10:37going to know what the Intermediate Court of Appeals is. And that's where I'm
- 10:41going to tap into my over fifteen years of teaching at West Virginia State on
- 10:45a subject no one likes to sit in college and listen to, which is
- 10:48history, and so you have to educate and make it interesting. And I
- 10:52think I can do that and that's what I plan on doing. And how
- 10:56many people are we going to be electing. How many people will be on
- 10:58the ballot? Just one? So just one position available. Correct. Three
- 11:01were appointed by Governor Justice. They were appointed to terms two, four,
- 11:07and six. Okay, so they're staggered. Right. Judge Tom Scarr was
- 11:13appointed the two year term. He is not going to be running, So
- 11:16the first open seat is going to be decided at the primary on May fourteenth,
- 11:24twenty twenty four. All judicial races, since they are nonpartisan, as
- 11:28you mentioned, will be decided in the primary, right, Yeah, And
- 11:33I think that's so as far as you're not running for a particular seat,
- 11:37there's not really a district that represents a certain area. It's just kind of
- 11:41you know, all it's state wide, state wide, state wide. Enter
- 11:45Michael Final thirty, wat should someone vote for you? They should vote for
- 11:48me, because what you want from a judge is somebody demonstrated one I'm smart
- 11:54and I'll let other people decide if I'm smart or not. But I think
- 11:56that you want somebody who works hard, and I have over thirty one years
- 12:01demonstrated work ethic. You want somebody who is fair. I remember a friend
- 12:05of mine who is a prominent trial dyer on the plane of side was interview
- 12:09talked about judges. You want somebody who is smart, who listens, and
- 12:13who gives you a shot and is just fair. And that's me. And
- 12:18again my experience over thirty one years all over the state, because the appeals
- 12:22come in from all over the state, my experience is going to be unmatched
- 12:26in this race. And that's why somebody should vote for me. And where
- 12:28can people learn more about your campaign? Michael Schultz for WV dot com.
- 12:33That's Nycha L. S. Ch Ulz for WFV dot com. All right,

- 16:27brag good morning. How are you sir? Dave? Hey, what are
- 16:30you doing here on the Dave Allen Show. I just stop in for a
- 16:34cup of coffee every day. Then that's uh, that's I just come in
- 16:40and you know, keep ryan, you know in candy and everything. That's
- 16:44uh, that's what I do. I want to get your input, Brad
- 16:48on on West Virginia. First, you have a story posted about a WV
- 16:52metronews dot com. Now, this is the foundation, Brad that is meant
- 16:56tasked with distributing over two hundred and seventeen million dollars in the opioid settlement money.
- 17:00I found it somewhat comical, Brad, in your's story that you said
- 17:06the group went into executive session yesterday to discuss transparency wit what Yeah, not
- 17:15ideal? Right, So, I mean, I think the issue is that
- 17:19this is a newly established group and they're kind of setting their own ground rules
- 17:25as they as they taxi down the runway. It doesn't necessarily I mean,
- 17:32it's it's a composite of a variety of like the governor names five people to
- 17:41it, and different regions around the state name people to it, and and
- 17:45they're they don't have any pre established rules to go by, So I think
- 17:51their heart's in the right place and that they want to This is a lot
- 17:55of money. It's not taxpayer dollars, but it is public money. It's
- 17:59the proceeds from the opioid litigation that you know, the opioid crisis affected so
- 18:06many communities. So they want to they want to be careful with the dollars,
- 18:08and they want to earn the public trust, and they want to I
- 18:15think, in the end be open with with how they're distributing that money and
- 18:21where it is in the meantime and how their decisions are made. But until
- 18:26then, yes, they did go into a closed session kicking the media in
- 18:32a nice way, kicking the media and other members of the public off the
- 18:36call so that they could go into this. Uh. It was an online
- 18:41meeting folk. Uh, so they could go into a meeting without us to
- 18:47talk about transparency. There's the irony was on the door. There's a Yogi
- 18:49bear reference in there somewhere, Brad, And nobody goes there anymore because it's
- 18:53too crowded or something like that. So that's all I could think of.
- 18:56And I want to read your story yesterday Brad. Since we lasket there have
- 19:00I want to get into some political developments and some races here. There were
- 19:04three in the race for attorney general. Now there is two. Ryan Weld
- 19:10is out, leaving only Mike Stewart and J. B. McCuskey in the
- 19:11race for now on the Republican side. Stewart was on the show yesterday lobbying
- 19:15some real jabs against JB. McCuskey. This race is ugly, and I
- 19:21think it's going to get uglier. Your take, I think so, and
- 19:27you know a couple of things. My theory the case could be wrong,
- 19:33so forgive me, but I think Weld was occupying sort of a center right
- 19:41moderate lane along with McCuskey, and that Stewart is to the right of them.
- 19:48Everyone forgive me if my synopsis is incorrect. But by coming off the
- 19:52board, Weld opens that moderate lane at center right lane more to mccusky.
- 20:00Now Stewart's probably going to be the one who disagrees with that, because I
- 20:04think he's gonna call mccusky. You know, if he didn't on the show
- 20:07yesterday, he probably did. He did. He did a liberal rhino,
- 20:15left wing socialist Tommy. So did I get all the adjectives, A few
- 20:22of them, not all of them, but a few of them, Brad,
- 20:23and a few of them, a few of them. But I just
- 20:26and I asked the question yesterday to Mike Stewart, I just said, is
- 20:27this going to fracture the Republican Party? He says it's not. But I
- 20:33think it already has to a certain extent because I traveled a lot of Republicans.
- 20:37I'll travel anywhere, people will give me food, uh and I and
- 20:41I have heard, you know, some battle lines being drawn there. But
- 20:45you know that's that's one of the that's not unique to that race, though,
- 20:48Brad, because we we had this for years with the Democrats, you
- 20:52know, I mean they controlled things for for eighty three years, and now
- 20:56the Republicans are going to go through that. Be careful what you wish for
- 20:57absolute power? You know what I'm me and uh uh and and you're going
- 21:02to see more of that, and you want to see that in uh in
- 21:04and let's say the governor's race December eleventh, Hopey is going to be hosting
- 21:08a Gooba Toil gathering debate whatever you want to call it. The front runner,
- 21:12Attorney General Patrick Morrissey, as far as I know, is not taking
- 21:17part. Is that right? Yeah, that's right, And you know,
- 21:21I think that is true. I think you're going to see it down the
- 21:22line that there are that the Republicans now dominate West Virginia elections, but it's
- 21:29a big tent and there are different flavors of Republicans, just like there used
- 21:33to be different flavors of Democrats. And you know, you can see from
- 21:38the top one down. But in the US Senate race, as much as
- 21:41it is a race, Congressman Alex Mooney is calling Governor Justice a liberal rhino
- 21:49tax and spins guy. Uh. And and so you know, you see
- 21:55that all the way down the board that it's a although it is a dominant
- 22:00party in West Virginia, it's it's also a somewhat fractured party. Uh.
- 22:07You know, and you see it. You see it in the Senate,
- 22:10the state Senate also, uh, with with sort of more populist candidates taking
- 22:15on more traditional financially conservative candidates. Just I mean, it's it's you see
- 22:25those divides all the way down the line. And this Attorney General's race is
- 22:29a good example. Well, and again I want to throw this out there
- 22:33for the second consecutive day. I gave the wrong date. Now, I
- 22:34don't know what my fascination is, but it is December seventh, not the
- 22:37eleventh. Two days in a row. I've said that. I don't know
- 22:41why. Maybe there's another debate in my head. I don't know, but
- 22:45no, it is the It is the seventh. That same day, Brad
- 22:48and I talked about this a little bit yesterday. Chris Warner, the brother
- 22:52of Gubernuzuel candidate and Secretary of State Mike Warner, has a gathering in Charleston
- 22:56while a while his brother is about to take the stage more Town for this
- 23:00debate. Chris Warner is going to be hosting an event in Charleston where he's
- 23:03expected to announce he'll be running for Secretary of State, joining former House Minority
- 23:07Leader and delegate and one time Democrat now Republican Doug scaff Putnam County Clerk Brian
- 23:12Wood, former delegate, can read current Delegate Chris print. It's a crowded
- 23:17field there for secretary of State, and it may get even more crowded er
- 23:22your thoughts. Crowded field, and you know I mean Scaff made because of
- 23:30the unique situation where he'd been the Democratic leader in the House of Delegates,
- 23:37and so we got some juice out of those headlines. Chris Warner, I
- 23:42think is the beneficiary of the Warner brand. I mean, it's it's brothers
- 23:49in politics and Max two terms as the Secretary of State, and you know,
- 23:56I think Chris could potentially draft off of that. But it is an
- 24:00interesting race. WMV, one of our affiliates, and Tom Sussman, one
- 24:06of the owners of WMV, had a really interesting poll last week and one
- 24:08of the interesting things that I found was, you know, all right,
- 24:12it's we're headed toward December, but just all of the people in many of
- 24:18these races somewhat down ballot who remain undecided. And I think that's reasonable for
- 24:23the voters. But the Attorney General's race a lot of undecided. Many people
- 24:32could still come to mccusky or Stewart. The Secretary of States race is somewhat
- 24:37regional in nature, and it's for grabs for anybody based on all those undecided,
- 24:45and a lot of it is going to be you know, who could
- 24:47raise the money to get their name out there and swing people their way.

- 25:11dot us. Brad, I was listening to you and Happy yesterday and I
- 25:14think I heard about all of the tree puns that I can handle for a
- 25:18lifetime. What does all this tree talk before we let you go? Well,
- 25:22you know it's West Virginians are proud of their own, whether it is
- 25:27Brad Paisley or Jennifer Garner. And in this case, I've got a tree
- 25:32for you. It is a sixty eight foot sixty eight foot maybe sixty three
- 25:37Norway spruce from the Mononga Hill in National Forest, and it is going to
- 25:44be in a place of honor at the US Capitol during the Christmas season.
- 25:48Our Chris Lawrence has done a lot of coverage of this tree and now I
- 25:53am taking it over a little bit of a tree handoff here because there is
- 25:59going to be a lighting ceremony at the US Capital tonight. Uh. The
- 26:02West Virginia delegation expected to be there. A fourth grader who is Hoppy's first
- 26:07guest today on talk line, who was the winner of an essay contest,
- 26:12will be actually doing the lighting of the tree. I don't think he sets
- 26:17it on fire. I think you hit the button, but he will be.
- 26:19He will be lighting the tree. So that's pretty exciting for you know,
- 26:22lifetime memory. Well you give me as a fourth you give you give
- 26:26fourth grade day vallance something like that. Something's going up in flames. I'm
- 26:29just saying, we better hope this tree has been properly watered. But in
- 26:34all seriousns, I was, like I said, I was, let's see
- 26:36you in Hoppy, and even the Hoppies listeners even fired back with puns,
- 26:40you know, via text and whatever. And I think I think it's great.
- 26:41I like that dad kind of humor, even on a non Dad.
- 26:45But you know, this is kind of a big deal, Brad, for
- 26:48West Virginia. It really really is. Well yeah, and you know,
- 26:53West Virginia takes some pride in its world nature. It's beautiful scenery. It's
- 27:00enormous and lovely trees, and so this one will be on display inside the
- 27:06Beltway in the swamp, and so it's going to be a lovely ceremony.
- 27:11It's tonight at five pm. I think you can watch it if you're interested,
- 27:15on YouTube, either live or on delay. And we will have a
- 27:18story at West Virginia metronews dot com with some quotes from the fourth grader who
- 27:25has this position of honor with West Virginia's congressional delegation. The Richwood High School
- 27:30marching band expected to be on site. And then as a follow up,
- 27:33West Virginia's got another prominent tree. This one's going to be the National Christmas
- 27:37Tree over at the White House. The ceremony on that one will be Thursday,
- 27:44and it's that that has an all star cast, a cavalcade of performers,
- 27:51and it's going to be on delay on CBS, I believe, So
- 27:56you know watch that one that CBS is broadcast. So that might actually be
- 28:00December eleventh, the day you have in mind. Maybe it's December twelfth.
- 28:03But you can see the West Virginia tree in both instances, both at the
- 28:10Capital for Congress and at the White House for presidential adoration. I'm just going
- 28:17to start saying everything is on that particular day because I seem to be infatuated
- 28:21with the date December eleventh. So I'm just going to say Christmas this year
- 28:23is on December eleventh, just so you know you can do is celebrate your
- 28:27anniversary and you can just like make sure you just got it nailed down,
- 28:32like all right, we're doing this December eleventh, and whenever it really is,
- 28:36I'll at least be taken care of real quick, Brad, because I
- 28:38know you got to go what are you working on today? Other than other
- 28:41than trees? What are you working on today? What are you keeping an
- 28:44eye on? I actually am going to the tree lighting ceremony tonight. Yeah.
- 28:48I believe Leslie Rubin of WCS Television also going to be there. Rubes
- 28:52from her. Yeah, yeah. So it is a major news event in
- 28:57West Virginia, you know, other than that where I'm going to go from
- 29:02that to some bureaucracy here. But I do have a story up fresh this
- 29:07morning about there's a there's a big lawsuit about the conditions in West Virginia's foster
- 29:11care system. There is a situation a subplot within that where the evidence was
- 29:18meant to be some of the emails back and forth from d HHR higher ups,
- 29:26and so is what is your thinking, are you really taking the foster
- 29:30care system seriously? Well, those emails got wiped during a bunch of the
- 29:34turnover of those employees, whether they were tired or got fired or moved on
- 29:38to other jobs or whatever. The emails got lost. They can no longer
- 29:42be evidence. And so the plaintiffs are arguing that that is that essentially it's
- 29:51the state's fault. The state was not careful enough with that potential evidence,
- 29:55and they're asking for sanctions. Just blasted the state on it, and there's
- 29:59a pretty fresh story on West Virginia metronews dot com about that situation. From
- 30:04there, we'll move on to the fresh Christmas tree tonight. We did this
- 30:07entire segment, Brad, and we didn't mention the governor one time. I
- 30:11don't think we did not talk about the governor. So I'm sure that we're
- 30:15always there's always news with the governor every day, so I'm sure you'll be
- 30:18following that as well. Hey, Brad, enjoy your time there up up
- 30:23in DC. Enjoy your time in the swamp watching trees go up. I
- 30:29will I will adjust expectations accordingly and do my best. All right, Brad,
- 30:33appreciate it. Man. Thanks a lot, Brad mckalaheady again. It

- 36:22The gas crisis on the West Side story posted from yesterday wv Metronews dot com.
- 36:25Mountaineer Gas Senior vice president Most Scaff, appearing on Hoppy yesterday, said
- 36:31that there were still about one hundred customers whose homes of businesses were pending inspections.
- 36:37Now, one hundred percent of the customers on the West Side have gas
- 36:40service, but not all have been inspected. So that is a key thing
- 36:46to remember. And when you hear us on the news and other news outlets
- 36:50talking about one hundred percent having service, that doesn't mean they're all up and
- 36:53running because they still have to go through these inspections, which are very very
- 36:58important. A Scaff said that Mountaineer Gas is paying one hundred percent of the
- 37:02bill and who will come along later and help them pay those bills? Who
- 37:09knows, But I will say that the Public Service Commission has started an investigation
- 37:16into the water main brink from West Virginian American water that flooded the gas lines.
- 37:21There is going to be a Public Service Commission meeting today now This was
- 37:24scheduled prior to all this, and it does have to do with a separate
- 37:32issue involving Mountaineer Gas. This was a totally separate thing, but this was
- 37:37scheduled again ahead of time. I'm not a lawyer, but I am told
- 37:43that this is an evidentiary hearing into a July request by Mountaineer Gas for a
- 37:49rate increase. Now we'll see how that goes. Of course, our team
- 37:52here will be covering that very closely. I said, you asked for Governor's
- 37:59news. He's making an announcement at eleven at the Lewisbourg Airport five million dollars
- 38:04in terminal and runway upgrades. Well, there you go. It was a
- 38:15busy long Thanksgiving weekend here in the valley, particularly in Charleston. Holly Jolly
- 38:22Braley and Light the Night Over at the Ballpark story posted about at WCCHS network
- 38:27dot com. According to a release from the Dirty Birds, your hometown baseball
- 38:31team, over twenty three thousand people have already visited light to Night at the
- 38:39ballpark. Now they didn't do it last night. They had scheduled a couple
- 38:43of Mondays off and last night was one. So these numbers are pretty accurate
- 38:45with this press release. It came out yesterday. Over twenty three thousand people
- 38:50visited Light the Night at the ballpark. Saturday night alone had nearly sixty five
- 38:54hundred people there, making that the largest attendance event ever in the history of
- 39:01the park, Bigger than a Dirty Birds game, a concert, WVU or
- 39:06Marshall Baseball, State Baseball Tournament, etc. Now, as for Holly Jolly
- 39:10Brally, over ten thousand people over two days came out for this and for
- 39:16all the people that were stressed out over PODA, that is the private outdoor
- 39:22designated area where people can purchase alcoholic beverages from local bars and drink them in
- 39:29those designated areas, there apparently were from what I'm told, no issues at
- 39:34all. In fact, the restaurants and bars called it their words, record
- 39:39breaking for them and they love it. So there were nearly eighteen hundred people
- 39:47who rode the Holly Jolly Brally trolley. I just love saying that with Kart
- 39:54donating the service, and that will continue now. It's open to ride from
- 40:00four until ten every Friday through the end of the year. That's every Friday,
- 40:05not every night, and just every Friday. It makes stops at the
- 40:07City Center, Lee Triangle, the Ballpark, and Capitol Market. Holly Jolly
- 40:12Braley in Light the Night will continue until the end of the year as well.
- 40:16Capital Market is going to kick off their Holiday Village on Friday Night.
- 40:22They'll run that Friday, Saturday, and Sunday through the next three weekends.
- 40:24Of course, Christmas, Bread and Charleston also coming up. That is coming
- 40:30up here soon as well. But I want to get back to PODA for
- 40:32a moment again, as according to the information, not a single issue.
- 40:40It's been very successful in Huntington. Matter of fact, they are looking I
- 40:45understand Huntington City Council is looking to expand it because it's been so successful,
- 40:52and I know a lot of people were against it, but a lot of
- 40:55that is because people just don't understand how it works. It works seemingly in
- 41:00every major US city, and many here in West Virginia when it's done right,
- 41:05are already doing. As I said, Huntington's already looking to expand it,
- 41:09and from what I'm seeing, for all intents and purposes, it's being
- 41:13done right. In Charleston. It apparently isn't the drunken spectacle that people thought
- 41:20it was going to be or that many hoped it would be. Sorry,
- 41:24sorry for the haters, but it seems to be working out pretty well.
- 41:30Texas says the PSC investigating the gas issue on the West side. I mean
- 41:36as well have Mountaineer Gas investigate themselves. Also, in two weeks, the

- 47:28was a text to the show yesterday that I didn't get to quite frankly,
- 47:32because when you have Mike Stewart on the show, you don't get a whole
- 47:36lot else but Mike Stewart. And I don't mean that negatively toward Mike.
- 47:38I'm just saying he elicits. A lot of texts or guests are like that,
- 47:42and Mike is is is definitely one. The text came though, in
- 47:45before Stewart went on the air, and it was a question directly to me,
- 47:50and I'll paraphrase it, but it basically said, Dave, you have
- 47:52said you will never vote for Trump again. Does that mean you will vote
- 47:57for Biden for president? And I don't want to answer that. I can,
- 48:00absolutely, without a doubt say the answer is no, I will not
- 48:06vote for Joe Biden, and I also will not vote for Donald Trump.
- 48:08And I know what you're saying. Quoting Getty Lee of Rush here. If
- 48:13you choose not to decide, you have still made a choice. And I
- 48:15get that. But just speaking for myself, me, me alone, me
- 48:21only, I cannot in good conscience vote for either one. And I did
- 48:24a little research. I kind of have a history of this. I did
- 48:29not vote for president in two thousand and eight. Now, I voted for
- 48:31all the other offices, but I did not vote for president in the year
- 48:35that was two thousand and eight. That was the presidential elected election that pitted
- 48:38Barack Obama against John McCain. Now let me say this for the record.
- 48:43I love John McCain. I respected him for his military career above anything else.
- 48:47However, John McCain, for all the good that he did, was
- 48:52not an advocate for the coal industry. And in two thousand and eight,
- 48:57I was living and working in Logan County, and I watched as people were
- 49:00losing everything they had worked for. And no, it was not all because
- 49:05of Barack Obama, because Obama wasn't in the White House yet. But I
- 49:08knew what an Obama presidency would mean to the coal industry, and also knew
- 49:15what a McCain presidency would mean to the coal industry. So I went with
- 49:21that I mean, pardon the pun. I went with what kept the lights
- 49:25on in Logan, Boom, Mingo and Wyoming Counties, the areas that was
- 49:29served by the radio station where I worked at the time, and I knew
- 49:32that with a good conscious I could not vote for either onet, so I
- 49:39didn't. I did everything I have voted for any other race that was hunted
- 49:44b out I just didn't vote for president. And if something doesn't change,
- 49:50and Biden and Trump are the nominees, which I have no reasona believe that
- 49:53they're not going to be I again, and I say this not proudly.
- 50:00I just stated, for a matter of fact, I probably won't vote for
- 50:01either one of them. Now you can call me what you want and say
- 50:05about me what you want. Trust me, people, do I have zero
- 50:09respect for either guy. Now, I respect the office of the presidency greatly,
- 50:15which, to be honest, in my opinion, is more than either
- 50:20of them do. If either of those two had any ounce of respect and
- 50:30love for the country, they wouldn't be running in the first place. And
- 50:36I will literally support any other Republican in the race as it stands. Now,
- 50:44Okay, all right, not Ramaswamy, but any of the others,
- 50:47Nikki Haley, Christie Ronde sans any of them. But I can't for me,
- 50:52me alone. I cannot support Donald Trump in twenty sixteen, and I
- 51:00did in twenty twenty. But from the trump disrespect to the military to the
- 51:09cult like status that he pretty much demands from his followers, you can count.
- 51:16You can count this old Logan County boy out. And I was speaking
- 51:20only for me, no one else associated with this company, the advertisers or
- 51:24whatever, just like the disclaimer says at the top of the show. But
- 51:30I simply can't do it. It's a note of Biden, and it's a
- 51:35note to Donald Trump for me and me, Alam, Texas, Biden has
- 51:39been great for West Virginia. Why not vote for him? Have you seen
- 51:43him lately? Have you watched him lately? Have you seen him attempt to
- 51:47give a speech lately? Have you seen him walk lately? There's your answer,
- 51:54Texas. Dave agree with the text about the price of lights of a
- 51:58family of five. There's no paying that much as he lights. They need
- 52:01to have family pricing. Texas Day oil and gas production is higher this year
- 52:10under Biden than it ever was under Trump. Is an oil and gas production.
- 52:13The litmus test for Conservatives. Day one point was the country financially better
- 52:19illegal border crossing. It's almost at zero in the world, a hell of
- 52:22a lot more safe place under Trump compared to the Marxists. Now, yes,
- 52:25I agree with that, I do, but I'm so not going to
- 52:30vote for Trump. All right, we're out coming up on the show tomorrow.
