- 0:00Speaker 1: What's up, everyone, and welcome back to the Epstein Chronicles.
- 0:04In this episode, we're going to pick up where we
- 0:05left off with the memorandum of law and support of
- 0:09John Dejong's motion to dismiss the lawsuit brought against them
- 0:13by the Epstein survivors. Six second CoA no aiding and
- 0:18a betting liability under section fifteen ninety five. The second
- 0:22CoA alleges that defendants and their officers, agents, and employees aided, abetted,
- 0:27and induced Epstein sex trafficking venture in violation of US
- 0:31Code Section eighteen fifteen ninety one A one, fifteen ninety

- 0:39aiding and a betting liability is not provided for the

- 0:50a statute under which a person may sue and recover
- 0:53damages from a private defendant for the defendants violation of
- 0:57some statutory norm, there is no general presumption the plaintiff
- 1:00may also sue aiders and a betters. CoA two must
- 1:04be dismissed because there is no aiding and a betting
- 1:07liability under Section fifteen ninety five seven third CoA no

- 3:33Mister DeJong Section fifteen ninety five d contains tvpra's sole
- 3:38mechanism for state enforcement of TVPR, allowing only the attorney
- 3:43general of a state to bring a civil action against
- 3:45a person who violates section fifteen ninety one US Code eighteen,
- 3:50Section fifteen ninety five D. The TVPR does not authorize
- 3:54a state or territorial governor to enforce or bring a
- 3:58civil action, even when he would governor. Mister DeJong was
- 4:02unauthorized to bring civil action under the TVPR. The FAC
- 4:06fails to state mister Dejong's duty or ability to enforce
- 4:10the TVPR. Ce FAC fails to plead causation. Mister DeJong
- 4:16incorporates his causation argument from his article to standing discussion above.
- 4:20The plaintiffs have failed to plead causation nine all coas
- 4:25failure to distinguish conduct during a DeJong term. The FAC
- 4:29specifically alleges that mister DeJong was at all all relevant

- 5:00Ten all CoA failure to pleade exception to USVII immunity.
- 5:05The FAC specifically alleges that mister DeJong was at all
- 5:09relevant times the governor of the USVII. Therefore, at all
- 5:12relevant times, mister DeJong was not a private person. He
- 5:16has only sued in his capacity as the governor. The
- 5:19Governor of the Virgin Islands is absolutely immune from suit
- 5:22for the performance of his official duties or acts within
- 5:25the scope of his line of duty. Moreover, to the
- 5:28extent mister DeJong is named in his official capacity. Whereas
- 5:32the Government of the VI the Revised Organic Act grants
- 5:36sovereign immunity to the Virgin Islands for toward claims. While
- 5:39the government has waived immunity in certain situations, the FAC
- 5:43does not begin to allege that waiver applies here the
- 5:46plaintiffs have not pleaded or shown any exception to the
- 5:49governor's immunity. Similarly, in New York, it's well settled that

- 9:05In TVPR cases A feder siev P. Twelve f Immaterial
- 9:10scandalous loan arrest allegations must be stricken. The FAC seventy
- 9:15seven gratuitously includes impertinent, scandalous, and prejudicial criminal allegations about
- 9:21mister DeJong that have no real bearing on the case.
- 9:24These allegations should be stricken because they have no real
- 9:27bearing on the case, will likely prejudice the move in,
- 9:30or they have criminal overtones. First, the alleged depstein to
- 9:34John DeJong loan as pleded is completely immaterial. There are
- 9:38no allegations that the loan was part of a corrupt
- 9:41quid pro quo or that the loan had anything to
- 9:43do with abuse or trafficking. Second, even if the plaintiffs
- 9:47had pleaded, a nexus between the loan and the abuse
- 9:51or the trafficking to the extent the allegations relate to
- 9:54dissimilar criminal conduct and appear to be included solely to
- 9:57demonstrate mister Dejong's willingness to violate applicable laws. The allegations
- 10:02are scandalous and immaterial, and are appropriate targets of emotion.
- 10:06To Strike nine, any dismissal must be with prejudice. ASA's
- 10:11one year window closed eleven twenty four to twenty twenty
- 10:14three statute is run if the court dismisses the fac
- 10:19dismissal should be with prejudice. Plaintiffs cannot refile a complaint
- 10:23or fix their allegations because the one year look back
- 10:25window under the ASA expired on eleven twenty four to
- 10:29twenty twenty three. Ordinarily, as in the case cited, supra
- 10:33district courts will dismiss without prejudice to allow the plaintiffs
- 10:37to correct their deficient pleading. However, because the look back
- 10:40window has expired, the plaintiffs can no longer refile this
- 10:44FAC and any dismissal must be with prejudice, even if
- 10:48the court deems this a harsh remedy. The plaintiff's attorneys
- 10:51elected to wait until two days before the ASA window
- 10:54closed to file the original complaint on eleven twenty two,
- 10:58twenty three, when plaintiffs have the opportunity to amend and
- 11:02file this FAC on twelve thirteen, twenty three after the
- 11:06ASA window closed. Conclusion. Rarely are there so many grounds
- 11:11to ask for dismissal of a complaint to this stage,
- 11:14especially pursuant to so many subsections are Rule twelve. This
- 11:17is one of those rare instances. The FAC fails to
- 11:20minimally allege specific conduct that involved a specific dough plaintiff
- 11:25and a specific defendant. Mister de Jong insufficient allegations are
- 11:29insufficient allegations, even if they are spread out over forty
- 11:32eight pages and two hundred and twenty five paragraphs to
- 11:35conceal this fact. That's why so many independent grounds exist
- 11:39for dismissal and transfer of the case. The court should
- 11:43dismiss the FAC. If it does not dismiss the FAC,
- 11:46it should transfer the case to the DVII. Finally, the
- 11:49court should strike the unnecessary impertinent allegations. This article was
- 11:54signed by Daniel Savalis and it was dated January twenty first,
- 11:58twenty twenty four. All right, so that's going to conclude
- 12:01the memorandum of law filed by John DeJong in hopes
- 12:05to get the case transferred or have it struck from
- 12:08the docket. All of the information that goes with this
- 12:11episode can be found in the description box.
