- 0:00Speaker 1: Here's your host, Alex Garrett. All right, well, maybe it's
- 0:06Speaker 1: the time I spend on the Arthur I Dylla Power Hour,
- 0:08Speaker 1: that is, maybe put on my legal hat here. But
- 0:13Speaker 1: yesterday I got this news and I'm sure we all did.
- 0:16Speaker 1: Luigia mang you own latest judge orders hearing over seizure
- 0:20Speaker 1: of backpack. Of course, Mangioni is the guy that is
- 0:25Speaker 1: accused of gunning down the United Healthcare CEO Brian Thompson.
- 0:30Speaker 1: He's also been in the face of many conspiracy theories.
- 0:32Speaker 1: Is it the guy? Is it the right guy they
- 0:34Speaker 1: picked up now Tuna? Is there a real suspect on
- 0:36Speaker 1: the loose? What will they ever find a real suspect?
- 0:38Speaker 1: Is he the real suspect? Well, here's what's happening now.
- 0:43Speaker 1: A federal judge on Monday changed her mind and decided
- 0:47Speaker 1: there should be hearing to determine whether Luigian Mangioni's backpack
- 0:52Speaker 1: was a lawful It was lawfully seized and searched during
- 0:55Speaker 1: his arrest in Altuna, Pennsylvania Judge Margaret Garnett's but she
- 1:00Speaker 1: considered that both the arguments made by council on Friday
- 1:04Speaker 1: and the series is of charges the defendant is facing
- 1:07Speaker 1: death penality. In deciding to hold the evidential hearing after
- 1:14Speaker 1: saying a hearing was unnecessary, the brief hearing should include
- 1:18Speaker 1: testimony from an out Tuna police officer about the department's
- 1:24Speaker 1: procedures for securing, safeguard and inventoring the personal property of
- 1:28Speaker 1: a person arrested in a public space. The judge said,
- 1:33Speaker 1: so she wants to hear again from the police officer
- 1:37Speaker 1: that arrested him and found I guess the manifesto and
- 1:45Speaker 1: other things. She noted the witness did not need to
- 1:49Speaker 1: be one of the dozen officers involved in Mangione's arrest.
- 1:53Speaker 1: Several Altuna officers testified during a three week hearing in
- 1:56Speaker 1: state court where Mangione is seeking to exclude evidence police
- 2:00Speaker 1: seeds from his backpack, including the murder weapon, a llegedment
- 2:05Speaker 1: murder weapon, a notebook, and writings. Defense attorneys are also
- 2:12Speaker 1: trying to eliminate those items from the federal case, which
- 2:18Speaker 1: could result in possible death sentence if manjon is convicted.
- 2:22Speaker 1: He has pleaded not guilty. Man Jones accused of stalking
- 2:26Speaker 1: and of course killing a night healthcare ceo. Look, right now,
- 2:31Speaker 1: we have two cases of assassins simultaneously going on the
- 2:39Speaker 1: mange Own case and of course Tyler Robison swirling around
- 2:43Speaker 1: those two cases are a lot of doubts from people.
- 2:46Speaker 1: Is that the guy that shot Turley Kirk? Is this
- 2:49Speaker 1: the guy that shot Brian Tom Thompson. Well, here's where
- 2:56Speaker 1: we're at right now. These two assassins are edge to
- 3:00Speaker 1: have assassinated Kirk and Thompson. They are the two suspects.
- 3:07Speaker 1: I don't really care about possible patsyism and whether this
- 3:11Speaker 1: guy was the frame one or whatever, and the real
- 3:14Speaker 1: guys out there, you know what I care about. I
- 3:17Speaker 1: care about what this is gonna look like if Mangione
- 3:21Speaker 1: doesn't face any jail time because of evidentiary procedure. I
- 3:27Speaker 1: care about what is going to look like if an
- 3:29Speaker 1: accused assassin, an accused assassin, because of technicalities and other things,
- 3:38Speaker 1: is let off the hook for a murder we all
- 3:41Speaker 1: saw in broad daylight on camera quite frankly, and excuse
- 3:47Speaker 1: the conspiratorians here, the conspiracy folks here. I don't give
- 3:53Speaker 1: a crap who actually shot him. If that's not who's
- 3:56Speaker 1: being investigated and the suspect on try I care about
- 4:01Speaker 1: these two are on trial for a murder that took place,
- 4:08Speaker 1: so they're involved in some way, and if they don't
- 4:13Speaker 1: face consequences. I understand guilty, innocent until proven guilty. I
- 4:19Speaker 1: understand this is America. But if he gets out on
- 4:25Speaker 1: a technicality, do you know the message that's gonna send
- 4:31Speaker 1: to more and more evildoers out there? That message gonna
- 4:36Speaker 1: be so loud and clear. Hey, on a technicality, you
- 4:40Speaker 1: too can be let off the hook. On a technicality,
- 4:44Speaker 1: you too could be set free for a murder one
- 4:48Speaker 1: way or another you're involved in. And at this point
- 4:55Speaker 1: I do want to believe innocent until proven guilty. But
- 4:58Speaker 1: you know what, the copycat era that we're in right
- 5:02Speaker 1: now is scary. If you see these two at the
- 5:06Speaker 1: same time in their trial just be able to be
- 5:12Speaker 1: let off the hook with it not even a jail
- 5:18Speaker 1: sentence for being involved in this murder, that's gonna be awful. Now. Okay,
- 5:30Speaker 1: you might say, but why weren't you like this with
- 5:32Speaker 1: Daniel Penny? Why are you happy he stept free? Shouldn't
- 5:36Speaker 1: Daniel Penny have face jail time? Well, justice prevailed for him,
- 5:43Speaker 1: and maybe justice will prevail from Luigi MANGIOI. But he's
- 5:53Speaker 1: already coming into this having grown a fan base for
- 5:56Speaker 1: shooting allegedly shooting a CEO. Now imagine all the cheers
- 6:09Speaker 1: and all the emboldened people that we'll see, not even
- 6:15Speaker 1: a conviction on a technicality, and go, oh, so it's
- 6:18Speaker 1: that easy to do. Huh. That's scary to me, and
- 6:23Speaker 1: it should be scary to you. If he's let out
- 6:29Speaker 1: on evidentiary procedure, not DNA, not traditional ways. You are
- 6:39Speaker 1: basically found innocent through testimony shore and also through eyewitness
- 6:53Speaker 1: accounts and all that. But on technicality, you understand them
- 7:00Speaker 1: message that's gonna send. So while I appreciate the judge's thoroughness,
- 7:06Speaker 1: it makes me worried that if she has some doubts here,
- 7:12Speaker 1: what if those doubts lead her to completely what's the word,
- 7:19Speaker 1: what's the legal turn I'm thinking of here, not vilified,
- 7:26Speaker 1: but completely I'll think of it in a second, completely
- 7:32Speaker 1: let off the hook, Luigi Mangioni. That message is gonna
- 7:40Speaker 1: be stronger. Then well, guess what we get did in
- 7:44Speaker 1: the DNA test and found that he was not included
- 7:48Speaker 1: in the scene, and we'll tell others, Hey, you can
- 7:55Speaker 1: get off on a technicality, you can shoot anybody, and
- 7:57Speaker 1: you can get off on a technicality. The big thing
- 8:01Speaker 1: with Tyler Robinson where the gun was placed, and of
- 8:06Speaker 1: course how did you shoot from that angle in such
- 8:09Speaker 1: a accurate way. I mean it looked closer than the
- 8:14Speaker 1: garage and in the balcony, the roofs up. They say
- 8:16Speaker 1: he was at let's be honest about that. But they
- 8:24Speaker 1: are involved in some way, somehow to these two murders.
- 8:31Speaker 1: And quite frankly, even if they're not the actual assassin,
- 8:35Speaker 1: to be involved with these two assassinations should bring some
- 8:40Speaker 1: kind of jail time, not complete innocence, not complete, you know,
- 9:02Speaker 1: not convictionless, because these two are roped into a crime
- 9:09Speaker 1: for some reason, roped into assassinations. And yes, I do
- 9:19Speaker 1: believe they did shoot, because I want to say law
- 9:21Speaker 1: enforcement didn't screw either investigation up. But the evidentiary, the procedural,
- 9:30Speaker 1: if that's what the judge is looking at as a
- 9:34Speaker 1: way to I guess one of the words the number
- 9:40Speaker 1: has absolved and exonerate. That's the word exonerate. Luigi Manngioni
- 9:48Speaker 1: and Robeson that are completely exonerated by the end of
- 9:53Speaker 1: these two trials. What does that send out to the
- 9:58Speaker 1: world if we're thinking about it from a legal thing. Well,
- 10:04Speaker 1: it's true, then you were incidentil proven guilty and you
- 10:07Speaker 1: weren't proven guilty. Okay, but what about the ways they
- 10:11Speaker 1: get to that point? Usually you're found guilty because of
- 10:15Speaker 1: eyewitness statements, because of DNA tests most importantly, and if
- 10:29Speaker 1: Robeson and Luigi Mangion don't face any consequences for being
- 10:38Speaker 1: wrapped up in two major assassinations in our lifetime, I
- 10:45Speaker 1: do nothing that brings justice. I think that brings in
- 10:49Speaker 1: boldenness to the evil ones that would do something like that,
- 10:54Speaker 1: That would show them, hey, you can kill someone too.
- 11:00Speaker 1: Is that the message we want to send? Is that
- 11:03Speaker 1: the message at the end of the day of these
- 11:05Speaker 1: two trials we want to send or do we want
- 11:09Speaker 1: these two brats? And really, I mean twenty two and
- 11:17Speaker 1: thirty I think, I mean they know what they did,
- 11:24Speaker 1: but these two killers, you know, suspect the killers. Do
- 11:32Speaker 1: we want them totally off the hook? Because I think
- 11:37Speaker 1: in this day and age, if you're even implicated, if
- 11:41Speaker 1: you're an even implicated and on trial for these shootings,
- 11:47Speaker 1: then you deserve some punishment. If it's found Luigi MANJIONI
- 11:54Speaker 1: did not kill which is going to be hard to believe,
- 11:56Speaker 1: but did not kill Brian Thompson, then it would be
- 12:08Speaker 1: a shocker. It would be innocent toil proven guilty. But
- 12:14Speaker 1: then the other part is why was he involved in
- 12:16Speaker 1: this crime to begin with? Shouldn't that face consequences and
- 12:24Speaker 1: shouldn't he not fully be off the hook and exonerated
- 12:32Speaker 1: and one of the most heinous, cold blooded assassinations that
- 12:37Speaker 1: we've seen in our lifetime. Weigh in with me Alex
- 12:40Speaker 1: at alexjanyc dot com. Alex at alexjanyc dot com. We
- 12:44Speaker 1: want one leg up for justice that is true, but
- 12:48Speaker 1: don't we want one leg up for the families of
- 12:51Speaker 1: these slain victims. Both can be said and be true,
- 13:02Speaker 1: and both can be had. And I think to take
- 13:11Speaker 1: him and set him for a technicality man Joni, especially
- 13:17Speaker 1: sending the wrong message their judge. So I hope you
- 13:20Speaker 1: think hard about this as much as you thinking about
- 13:23Speaker 1: heard about the death that I hope you think about
- 13:27Speaker 1: as hard on trying to figure out if he did
- 13:33Speaker 1: kill him. Any kind of leeway the defense is going
- 13:38Speaker 1: to go to it, and I think we all should
- 13:41Speaker 1: be afraid of that leeway because that leeway could be
- 13:46Speaker 1: a gateway to a wiped out conviction or non conviction,
- 13:55Speaker 1: and a disaster ahead. In this day and age, how
- 14:04Speaker 1: do we fight for justice while not emboldening those that
- 14:12Speaker 1: want to commit crime. Man, we'll examine that next time
- 14:16Speaker 1: on the one the Gouvern Network
