- 0:04Speaker 1: In this episode, we're diving right back into the deposition
- 0:07Speaker 1: given by Michael Ostrich Virginia Roberts ex boyfriend. So let's
- 0:12Speaker 1: get right back to it, shall we. Manager. And between
- 0:16Speaker 1: the time you met her at your dad's house and
- 0:19Speaker 1: the time that you broke up, did you guys break
- 0:21Speaker 1: up and get back together or was it one consistent
- 0:24Speaker 1: relationship and then it had to have an end date? Answer? Yeah,
- 0:29Speaker 1: one consistent relationship. Manager. Okay, you mentioned that you moved
- 0:33Speaker 1: into an apartment in Royal Palm Beach. Answer yeah, I
- 0:37Speaker 1: believe that's where it was, Royal Palm Beach. Manager. Do
- 0:40Speaker 1: you remember anything about that apartment? Answer all, I remember
- 0:44Speaker 1: it was on the third floor. Manager. And who got
- 0:47Speaker 1: the apartment? Answer I did? Manager? Again, you were over
- 0:51Speaker 1: eighteen at that time. Answer yes, Manager, So you got
- 0:55Speaker 1: the least answer yes, Manager. Do you remember looking for
- 0:59Speaker 1: the apartment? Answer I believe so. Manager. And it wasn't
- 1:04Speaker 1: the first apartment that you rented right answer no, No,
- 1:07Speaker 1: the one in Oakland Park was the first one. Manager. Okay,
- 1:12Speaker 1: I'm going to show you some photographs. If I could
- 1:15Speaker 1: have you mark this I guess we'll start again with
- 1:18Speaker 1: I guess we'll start again with defendants. Exhibit I got
- 1:21Speaker 1: one for you, defendants, Exhibit one or a whatever you
- 1:25Speaker 1: put on it. Court reporter one. Exhibit one. Manager, Please
- 1:30Speaker 1: take a look at this. There are two photographs stapled together.
- 1:33Speaker 1: Does that look like the apartment that you lived in
- 1:35Speaker 1: on the third floor? Answer? It could be. I don't
- 1:38Speaker 1: really remember it. Manager. The address on this is three
- 1:42Speaker 1: six eight bent Oak. Does that sound about right? Answer?
- 1:46Speaker 1: Bent Oak? Sounds familiar. Manager, You don't recognize the It
- 1:50Speaker 1: may have been painted, for example? Answer yeah, I mean
- 1:53Speaker 1: all I remember is being on the third floor. Manager,
- 1:57Speaker 1: I'm going to show you another exhibit. Let me find it.
- 1:59Speaker 1: We'll mark this to defend an exhibit number two. Manager.
- 2:03Speaker 1: I know this is not terribly easy to read, but
- 2:05Speaker 1: it's a passport application that has been previously identified in
- 2:09Speaker 1: this case. And in the middle section there's an emergency
- 2:12Speaker 1: contact information that says James Ostrich. Do you see that? Yes? Manager?
- 2:18Speaker 1: Is that you answer yes, manager and it says three
- 2:22Speaker 1: six eight bent Oak? Drive below that answer yes, manager?
- 2:27Speaker 1: Does that refresh your memory to the address the apartment
- 2:30Speaker 1: that you lived in in Royal Palm Beach. Answer, Like
- 2:33Speaker 1: I said, Bentoke sounds very familiar, and I know it
- 2:36Speaker 1: was Royal Palm Beach, so possibly it was that one. Menager. Okay,
- 2:42Speaker 1: and how long do you think that you lived in
- 2:44Speaker 1: this apartment? Answer? I'm not entirely sure, less than a year. Manager.
- 2:49Speaker 1: I'm going to mark this exhibit as exhibit number three. Manager.
- 2:54Speaker 1: I'm going to have you take a look at this. Actually,
- 2:56Speaker 1: I apologize because I need you to turn back several
- 2:59Speaker 1: pages to the lower right hand corner has some page
- 3:03Speaker 1: numbers that say GM, and I need you to go
- 3:06Speaker 1: to seven eighty one. Menager. Could I have you take
- 3:10Speaker 1: a look at the narrative section of that page if
- 3:12Speaker 1: you want to just read that paragraph. Answer John Perkins,
- 3:16Speaker 1: I don't even know that name, Menager. I guess you
- 3:19Speaker 1: guys haven't kept in touch. Edwards, he was scared that day,
- 3:24Speaker 1: the witness. Plus when I left there, I didn't really
- 3:27Speaker 1: talk to anybody from up there. I remember somewhat of that. Yeah,
- 3:30Speaker 1: I remember the cops telling me, even though it was
- 3:32Speaker 1: under my name, I couldn't go in, and I think
- 3:35Speaker 1: later on they got out so I could go back
- 3:38Speaker 1: and get my stuff. I think I was going to
- 3:40Speaker 1: see my animals. Menager, Yeah, I didn't know if reading
- 3:43Speaker 1: this might cause you to remember some things. Answer I
- 3:47Speaker 1: somewhat remember that. I remember the cops coming and telling
- 3:50Speaker 1: me I wasn't allowed to go in my own apartment
- 3:52Speaker 1: that was under my own name. Menager. Okay, so this
- 3:55Speaker 1: is dated June tenth of two thousand and one, and
- 3:58Speaker 1: it places you at three six eight Bent Oak Drive.
- 4:01Speaker 1: Correct answer yes, Menager. Okay, do you understand that to
- 4:06Speaker 1: likely be where you were living with Miss Roberts. Answer yeah,
- 4:09Speaker 1: but at the time, I was already back in Broward. Manager. Okay,
- 4:13Speaker 1: do you know how long you had been back in Broward?
- 4:15Speaker 1: Answer not a clue, Menager. And in this it refers
- 4:20Speaker 1: to Miss Roberts as your ex fiance. Correct answer yes, Manager,
- 4:25Speaker 1: So presumably the event you described where you had a
- 4:28Speaker 1: fight and left had already occurred. Answer yes, Brad Edwards
- 4:33Speaker 1: objects the form. Answer I know, I was already out
- 4:36Speaker 1: of there, and that's why when I went back. That's
- 4:39Speaker 1: one of the cops that I couldn't go in my
- 4:40Speaker 1: own apartment. Manager. So your recollection today is that you
- 4:45Speaker 1: were returning to the apartment to either get things or
- 4:47Speaker 1: check on your pets. Answer yes, Manager. What pets do
- 4:51Speaker 1: you recall having answer A dog and six cats, and
- 4:55Speaker 1: I believe ferrets and rabbits. One reason we got along
- 4:58Speaker 1: so well is because we like that animals. Manager, And
- 5:02Speaker 1: do you remember going back to the apartment to check
- 5:04Speaker 1: on the pets and encountering mister Roberts and Tony? Answer yes, Manager.
- 5:08Speaker 1: Were you inside the apartment when you encountered them? Answer
- 5:12Speaker 1: no outside Manager. Did you understand them to be living
- 5:15Speaker 1: in the apartment at the time? Answer yes. Manager. In
- 5:19Speaker 1: the police report, it says Ostrich stated his ex fiance,
- 5:22Speaker 1: Virginia Roberts her friend to the apartment. Answer I believe
- 5:27Speaker 1: that was Tony. Manager. Okay, and at this time the
- 5:30Speaker 1: police are indicating that you both live there, but that's
- 5:33Speaker 1: not what you remember. Answer no. They wouldn't even let
- 5:36Speaker 1: me all. I remember. I remember being outside the door
- 5:40Speaker 1: and the cops wouldn't let me go in there because
- 5:42Speaker 1: even though it was my apartment and my address was
- 5:44Speaker 1: on the thing, I wasn't allowed in there because I'm
- 5:47Speaker 1: pretty sure I wasn't living there. I just came back
- 5:50Speaker 1: to get something. Manager. Do you know how long after
- 5:53Speaker 1: you left you were coming back to get something? Answer
- 5:57Speaker 1: I don't remember, Manager, if you left your pets there.
- 6:00Speaker 1: I guess I'm just wondering whether you intended to go
- 6:02Speaker 1: back and get your pets. Answer I couldn't because my
- 6:05Speaker 1: dad didn't. My dad didn't really take like he didn't
- 6:08Speaker 1: want all those animals because he already had three dogs
- 6:11Speaker 1: and he wasn't a big fan of cats. To this,
- 6:14Speaker 1: Brad Edwards innerjets or ferrets, continued, or ferrets or rabbits.
- 6:19Speaker 1: I think we had a durable mice, rats, all kinds
- 6:21Speaker 1: of stuff. I know we had a pet store cages
- 6:24Speaker 1: that we bought to keep them all in because when
- 6:26Speaker 1: we lived in West Palm Beach it was like a
- 6:28Speaker 1: little animal rescue for a while. Menager. Did you get
- 6:32Speaker 1: that stuff from the pet store where you both had worked?
- 6:35Speaker 1: Answer yes, Menager, a discount, I hope, Menager. I feel
- 6:39Speaker 1: like every time I went to the pet store I
- 6:41Speaker 1: got a new animal. Still do the same thing, Menager?
- 6:44Speaker 1: Do you have pets today? Answer? Oh, yeah, I have dogs.
- 6:48Speaker 1: I have two dogs. We have six cats and three birds. Menager,
- 6:51Speaker 1: no reptiles? Answer no, No, I don't really like Menager.
- 6:56Speaker 1: Is that a different kind of a pet owner? Answer? Well,
- 6:59Speaker 1: I had reptiles in West Palm Beach. They are too
- 7:01Speaker 1: hard to take care of. Manager spiders. Answer no, I
- 7:05Speaker 1: don't want to be I have enough spiders where I live.
- 7:08Speaker 1: I don't need pet spiders. Manager, okay, all right. Do
- 7:12Speaker 1: you remember Tony punching you in the face? Answer I
- 7:15Speaker 1: don't remember. Manager. You see that's what the police report says.
- 7:19Speaker 1: Answer yeah, yeah, he might have. I don't remember, Manager,
- 7:23Speaker 1: And the police observed you to have minor swelling and
- 7:26Speaker 1: a large red mark. Does that sound accurate? Answer from
- 7:30Speaker 1: according to what it says, Yeah, I don't really remember that.
- 7:33Speaker 1: I remember being at the door and the cops coming
- 7:36Speaker 1: and telling me I can't go in there. Once I
- 7:38Speaker 1: read that, that's really all I remember. Manager. Do you
- 7:41Speaker 1: believe that whatever altercation you had took place within the
- 7:45Speaker 1: apartment or outside the apartment? Answer in the doorway at
- 7:49Speaker 1: the most. I never went inside that apartment when that
- 7:52Speaker 1: was happening, not that I remember. Manager. Do you ever
- 7:56Speaker 1: get to see those pets again? Answer yes, I think
- 7:58Speaker 1: later on they both let for the day and let
- 8:01Speaker 1: me go in and see my pets. Menager. Now, this
- 8:04Speaker 1: indicates that the police were there at about nine twenty
- 8:07Speaker 1: in the evening and you were there with mister Perkins,
- 8:10Speaker 1: But you don't remember mister Perkins. Answer no. If it
- 8:14Speaker 1: would have said Josh, I think that might be a
- 8:16Speaker 1: name I remember, But John. I know we had two
- 8:19Speaker 1: friends up there. John could have been one of them,
- 8:21Speaker 1: But I don't really remember John Perkins. That's so weird, Menager.
- 8:26Speaker 1: The police report also indicates that mister Figueroa observed Perkins
- 8:30Speaker 1: on the telephone and fled the scene prior to arrival.
- 8:33Speaker 1: Do you remember that? Answer no, I don't remember Perkins.
- 8:38Speaker 1: As soon as I saw that name, I'm like, who
- 8:39Speaker 1: the hell is John Perkins? Menager? All right, if you
- 8:42Speaker 1: can turn to the next page. The police report continues
- 8:46Speaker 1: that they made numerous attempts to contact you and mister Perkins,
- 8:49Speaker 1: whoever he is. Answer yeah, Menager, and miss Roberts at
- 8:53Speaker 1: the residence or on the phone, but had not been
- 8:56Speaker 1: able to do that. Answer if they called the residence,
- 8:59Speaker 1: I was living there and I don't remember them ever
- 9:02Speaker 1: trying to call me and Broward Menager? Do you know
- 9:05Speaker 1: if you had a cell phone? This was back in
- 9:07Speaker 1: one I don't even know if I had a cell
- 9:09Speaker 1: phone and no one answer yeah, I really couldn't tell you, Manager, Okay.
- 9:14Speaker 1: So your best recollection after reviewing this report is that
- 9:18Speaker 1: you had left on a previous date and came back
- 9:20Speaker 1: on this date to see your pets. Answer yeah, Manager,
- 9:24Speaker 1: and that you were ultimately able to get in and
- 9:27Speaker 1: see the pets. Answer later on, yes, manager, okay, like
- 9:31Speaker 1: the same day or answer later on? I don't really
- 9:35Speaker 1: remember how much longer, how many days later or something
- 9:38Speaker 1: not too long? Manager. And when you came back at
- 9:42Speaker 1: that later time, you did not encounter Miss Roberts. Answer no,
- 9:46Speaker 1: nobody was in the house but my animals. Menager. And
- 9:49Speaker 1: since that time you have not had any contact with
- 9:52Speaker 1: Miss Roberts. Answer no, manager, okay. And what was your
- 9:56Speaker 1: opinion of Tony Edward's objection to form? Answer an idiot,
- 10:02Speaker 1: That's all I really remember. Manager. Did you believe him
- 10:05Speaker 1: to be using drugs? Answer yes? Manager. Do you know
- 10:09Speaker 1: what kind answer whatever he could get? Manager? When Miss
- 10:13Speaker 1: Roberts started hanging out with Tony again, did you believe
- 10:16Speaker 1: her to be using drugs? Answer yes, objection deformed by
- 10:21Speaker 1: Brad Edwards. Manager, What caused you to have that belief?
- 10:24Speaker 1: Answer actions Edwards? Same objection, Menager, what kinds of actions? Answer,
- 10:30Speaker 1: I don't remember. All I remember is that's what Sorry,
- 10:34Speaker 1: you're still under oath, do you remember? Answer yes? And
- 10:37Speaker 1: here the topic of conversation moves to a completely different direction,
- 10:41Speaker 1: and it looks like there's a page or two that
- 10:44Speaker 1: is missing. Menager back to questioning manager. So you were
- 10:48Speaker 1: referring a little bit to the time that miss Roberts
- 10:51Speaker 1: worked worked for Jeff Answer yes, Manager, you knew him
- 10:55Speaker 1: as Jeff or Jeffrey. Answer, I remember Jeff. It could
- 10:58Speaker 1: have been Jeffrey. Manager. Okay, tell me what you recall
- 11:01Speaker 1: about miss Roberts going to work for Jeff. Answer. I
- 11:04Speaker 1: don't remember much of it really. All I remember is
- 11:07Speaker 1: that she went to work for him. I know they
- 11:09Speaker 1: went to some island. I know they traveled around and
- 11:12Speaker 1: he had a beach, a house in Palm Beach. I
- 11:14Speaker 1: think it was manager. Did she tell you what she
- 11:16Speaker 1: was doing for Jeff? Answer at the beginning, it was massage,
- 11:20Speaker 1: That's what I was told manager by her. Answer yes, manager. Okay,
- 11:24Speaker 1: did you seem excited about the job? Answer yes, manager.
- 11:27Speaker 1: Was she getting paid more money? Answer yes, manager. Do
- 11:31Speaker 1: you know how much? Answer? No, a lot more, manager,
- 11:35Speaker 1: So she hadn't come to you before that and said, Hey,
- 11:38Speaker 1: I'm having to do something other than massages. Answer I
- 11:41Speaker 1: don't remember. Manager. She may have, she may not have.
- 11:45Speaker 1: Answer Yeah, I don't remember. Manager. Well, why would you
- 11:49Speaker 1: be fighting about it at the end. Answer, Well, that's
- 11:52Speaker 1: because she was messing with Tony the idiot. Manager so
- 11:56Speaker 1: the fight. Answer, I mean that's what he the fights
- 11:59Speaker 1: what brought everything out? Menager. Okay, so she was messing
- 12:03Speaker 1: with Tony the idiot, and you guys got into a
- 12:05Speaker 1: fight about her messing with Tony. Answer. I think that's
- 12:09Speaker 1: what it originally it was because she was supposed to
- 12:12Speaker 1: come home, and I think she went over there instead.
- 12:15Speaker 1: That's when I found out. That's when I found out
- 12:17Speaker 1: about that with that idiot. Then I believe the other
- 12:20Speaker 1: stuff came to light. I don't really remember, Menager. As
- 12:24Speaker 1: you sit here, you think that's when you were finding
- 12:27Speaker 1: out about all of this at that time. Answer? I
- 12:31Speaker 1: believe so, but I don't really remember, Menager. Do you
- 12:34Speaker 1: know where Tony lived? Answer somewhere around there where our
- 12:39Speaker 1: other apartment was. Manager. You had trouble figuring out what
- 12:43Speaker 1: was the truth? Answer? Yeah, but I know for sure
- 12:46Speaker 1: she was with the idiot, So that's the main reason. Menager,
- 12:49Speaker 1: Well you saw her with him, right? Answer well, I
- 12:52Speaker 1: found out that she was in town, but not here,
- 12:55Speaker 1: and that's when I found out. Menager. Okay, not at home,
- 13:00Speaker 1: not at your home? Answer yeah, manager, when you believed
- 13:03Speaker 1: yourself to be engaged? Answer yes, Menager, Okay, she was
- 13:07Speaker 1: not truthful with you about her whereabouts Edwards objective form
- 13:12Speaker 1: answer yes, Menager, and you confirm that in some fashion?
- 13:16Speaker 1: Answer yes, manager, When another problem arose at the apartment,
- 13:21Speaker 1: the police were called correct Edward's form ostrich other than that,
- 13:25Speaker 1: Menager with mister Perkins. Answer I don't. All I remember
- 13:29Speaker 1: is that one time, Menager, I just did a really
- 13:33Speaker 1: bad question. So let me try again about being forced
- 13:37Speaker 1: to do things? Answer no, she might have told me
- 13:40Speaker 1: some stuff, but what I don't remember. Really, who knows
- 13:43Speaker 1: if it was the truth at that time? Anyway, Menager,
- 13:46Speaker 1: And you weren't doing drugs at that time? Answer I
- 13:48Speaker 1: wouldn't say no. I know at the end I was
- 13:51Speaker 1: smoking a lot, and I might have been doing some
- 13:53Speaker 1: other stuff. I'm not sure. Menager. Okay, regardless, you would
- 13:57Speaker 1: not have been comfortable believing your fiance was having said
- 14:00Speaker 1: with other people. Answer no, Menainger did she Miss Roberts,
- 14:05Speaker 1: ever tell you that she was posing naked for photographs?
- 14:08Speaker 1: Answer no, menager. Would you have been okay with her
- 14:12Speaker 1: posing naked for photographs? Answer no, menager. Did Miss Roberts
- 14:16Speaker 1: ever mentioned Galaine Maxwell my client? Answer? If she did,
- 14:21Speaker 1: I don't remember the name. Like I said, I only
- 14:23Speaker 1: remember Jeff. That name is all I really remember. Meninger,
- 14:27Speaker 1: Because you don't remember Miss Maxwell's name, I assume you
- 14:30Speaker 1: don't remember Miss Roberts telling you that she was assaulted
- 14:35Speaker 1: by Miss Maxwell. And that is exactly where this deposition
- 14:38Speaker 1: cuts off. So that's gonna do it for us, and
- 14:41Speaker 1: that's certainly gonna do it for this episode. All of
- 14:44Speaker 1: the information that goes with this episode can be found
- 14:48Speaker 1: in the description box.
