- 0:36Pastor David, and today we continue our special
- 0:39Did You Know bonus series within our 250 -year
- 0:43celebration of faith and freedom. In this episode,
- 0:46we're stepping back into the earliest days of
- 0:48the Republic to uncover one of the most important,
- 0:51yet often overlooked, decisions Congress ever
- 0:54made. A decision that shaped justice, strengthened
- 0:57the Constitution, and set the foundation for
- 1:00how America would uphold truth for generations
- 1:03to come. Let's explore the story behind the Judiciary
- 1:07Act of 1789, when Congress created the federal
- 1:11court system. Did you know that one of the most
- 1:14important decisions Congress ever made came in
- 1:17its very first year? In 1789, just months after
- 1:21the Constitution took effect, the new Congress
- 1:24passed a law that would shape the course of American
- 1:27justice for centuries to come. The Judiciary
- 1:30Act of 1789. This act created the federal court
- 1:34system, giving life to the third branch of government
- 1:37that the Constitution had named, but not yet
- 1:40defined. It was signed into law by President
- 1:43George Washington on September 24, 1789, and
- 1:47it remains one of the foundational pillars of
- 1:50American governance. But let's look deeper. The
- 1:54who, the what, the when, and the why behind this
- 1:57historic moment. The who were the men of faith
- 2:01and foresight. Oliver Ellsworth of Connecticut,
- 2:05William Patterson of New Jersey, and Richard
- 2:08Henry Lee of Virginia. They were part of the
- 2:11first Congress, and they understood that liberty
- 2:13without law would soon become chaos. They believed,
- 2:18as in Psalm 11, verse 7, declares, For the Lord
- 2:22is righteous, he loves justice, the upright will
- 2:25see his face. Justice was not merely a civic
- 2:30duty. It was a divine calling. The what was a
- 2:34framework for justice. The Judiciary Act established
- 2:37a Supreme Court with one Chief Justice and five
- 2:41Associate Judges. It created 13 district courts
- 2:45and three circuit courts, defining how cases
- 2:48would move through the system. It also authorized
- 2:51the U .S. Marshals to enforce the law, a visible
- 2:54reminder that justice must be carried out not
- 2:58just declared this structure balanced federal
- 3:01authority with state sovereignty ensuring that
- 3:04the same constitution which united the states
- 3:06would also protect the rights of individuals
- 3:09within them the when was the fragile dawn of
- 3:13the republic the constitution had been ratified
- 3:16only a year earlier and the government was still
- 3:19finding its footing the judiciary act came before
- 3:22the bill of rights before the first census before
- 3:25the navy because the founders knew that a nation
- 3:28cannot stand without justice. They understood
- 3:31the words of Isaiah 1, verse 17, Learn to do
- 3:36right, seek justice, defend the oppressed. Justice
- 3:41was the cornerstone of freedom. And the why,
- 3:45the reason Congress created the federal court
- 3:48system, was rooted in both principle and necessity.
- 3:52Under the old Articles of Confederation, there
- 3:55had been no national judiciary. Disputes between
- 3:58states went unresolved, and citizens had no consistent
- 4:02protection under the law. The new Constitution
- 4:05promised justice, but that promise required structure.
- 4:09Congress acted to ensure that the rule of law
- 4:13would be uniform across the land, that no state
- 4:16could stand above the Constitution, and no citizen
- 4:19would stand beneath its protection. They believed,
- 4:23as in Psalm 89 verse 14 reminds us, Righteousness
- 4:28and justice are the foundation of your throne.
- 4:32If God's throne is built on justice, then a nation
- 4:36that seeks his blessing must also build its government
- 4:39upon justice. The Judiciary Act of 1789 gave
- 4:44birth to the first Supreme Court. It was led
- 4:47by Chief Justice John Jay. It established the
- 4:50principle, the federal law would be the ultimate
- 4:53authority in the land and though founders could
- 4:56not have foreseen every case that would come
- 4:59before these courts they knew the truth must
- 5:03have a voice and that voice would be the law
- 5:06through this act congress did more than create
- 5:09the courts it created confidence it gave the
- 5:12people assurance that justice would not depend
- 5:15on wealth power or geography but on truth it
- 5:19gave the young republic a moral compass, a legal
- 5:23backbone, and a system of accountability that
- 5:26reflected the character of its creator. So did
- 5:30you know, when Congress passed the Judiciary
- 5:33Act of 1789, it wasn't just building a government.
- 5:37It was building a testimony. A testimony that
- 5:41justice matters, the truth endures, and that
- 5:44righteousness exalts a nation. Proverbs 21 verse
- 5:493 says, To do what is right and just is more
- 5:54acceptable to the Lord than sacrifice. That is
- 6:00the spirit behind the Judiciary Act and the spirit
- 6:03that still calls America to walk in justice today.
